EAGAN CITY COUNCIL

December 7, 2010
A Listening Session was held at 6:00 p.m. prior to the regular City Council meeting. Present were Mayor
Maguire, Councilmembers Fields, Tilley, Bakken and Hansen. Meg Katzman of Oakbrooke Terrace
discussed her concern regarding heavy traffic near Blackhawk and Deerwood Schools during student
drop -off and pick -up periods. It was suggested that Ms. Katzman discuss her concerns with the schools
in an effort to inform the parents of the neighborhood traffic concerns. Staff was also directed to
investigate if any previous traffic control measures had been taken in that area.
A regular meeting of the Eagan City Council was held on Thursday, December 7, 2010 at 6:30 p.m. at the
Eagan Municipal Center. Present were Mayor Maguire, Councilmembers Fields Tilley, Bakken and
Hansen. Also present were City Administrator Tom Hedges, Community Development Director Jon
Hohenstein, City Planner Mike Ridley, Public Works Director Colbert, Administrative Services Director
Gene VanOverbeke, Director of Communications Tom Garrison, City Attorney Michael Dougherty, and
Administrative Secretary / Deputy Clerk, Mira Broyles.

A. It was recommended to approve the minutes of the November 16, 2010 Regular City Council meeting
and the November 9, 2010 Special City Council meeting as presented.
B. Personnel Items.
1. It was recommended to approve the hiring of Seasonal Employees in Parks and Recreation:
Alexander Lenartz, Annalise Peck, Ellen Sahli and Nathan Schammel, all as Building
Attendant I.
C. It was recommended to ratify check registers dated November 10, 2010, November 18, 2010 and
November 26, 2010 as presented.
D. It was recommended to receive bids and approve a resolution awarding the sale of $415,000 in
General Obligation Equipment Certificates of Indebtedness.
E. It was recommended to approve the proposed 2011 Enterprise Fund budgets for Public Utilities
(Water, Sanitary Sewer, Street Lighting, and Storm Drainage / Water Quality), Cascade Bay and the
Community Center.
F. It was recommended to approve the 2011 Special Revenue Funds Budgets: Housing Fund, DWI

W. It was recommended to direct staff to prepare an ordinance amendment to City Code Chapter 11

Street Improvements) and schedule a public hearing to be held on January 4, 2011.

CC. It was recommended to approve the final payment for Contract 10 -09 (Cliff Road Trunk Water Main)
in the amount of $76,621.12 to Ryan Contracting, Inc., and accept the improvements for perpetual
City maintenance subject to warranty provisions.
DD. It was recommended to approve Change Order No. 2 to Contract 09 -04 (Fish Lake Alum Dosing and
Settling Basin — Water Quality Improvements) and authorize the Mayor and City Clerk to execute all
related documents.
EE. It was recommended to delay Project 1047 (Johnny Cake Ridge Road — Cliff Road to Apple Valley
border — Street Improvements) to the 2012 construction season.
FF. It was recommended to approve Change Order #1 to Contract 10 -10 (South Water Treatment Plant)
and authorize the Mayor and City Clerk to execute all related documents.
GG. It was recommended to approve the retention of KLM, Inc. as the Consulting Engineer, authorize
the preparation of Plans and Specs for Contract 11 -03, Deerwood Reservoir (Repainting) and
authorize the Mayor and City Clerk to execute all related documents.
HH. It was recommended to accept a grant of $3,200 from the Metropolitan Regional Arts Council for art
exhibit supplies and equipment for the Eagan Community Center and Eagan Municipal Center and
authorize the change to the 2010 budget.
II. It was recommended to declare a hand operated corded ice edger at the Eagan Civic Arena as
surplus property.
JJ. It was recommended to approve Change Order #1 to Contract 10 -18, Civic Arena West Training

PROPOSED 2011 BUDGET AND PROPERTY TAX LEVY

City Administrator Hedges and Administrative Services Director VanOverbeke reviewed the proposed
2011 budget and property tax levy.
Mayor Maguire opened the public hearing. There being no public comment, he turned discussion
back to Council.
Councilmember Bakken moved, Councilmember Fields seconded a motion to close the public
hearing, approve the General Fund budget of $27,687,900 and approve a resolution adopting the
final 2011 levy of $28,247,111. Aye: 5 Nay: 0
Councilmember Bakken moved, Councilmember Fields seconded a motion approve the 2011
Cedarvale Special Services District levy and budget. Aye: 5 Nay: 0
OLD BUSINESS
CONSIDERATION OF REQUEST TO MODIFY COVENANTS — HAWTHORNE RIDGE
City Administrator Hedges discussed the background of this item regarding requested modifications
to the covenant restrictions for the Hawthorne Ridge strip center located at 525 Diffley Road. City
Planner Ridley noted that written notice had been provided to neighboring property owners within 350
feet of the site.
The owners of Cuqui's Caf6 spoke in regard to plans for their restaurant and proposed exhaust
systems.
Three area residents expressed their concerns regarding the changes to the covenants. One couple
spoke in favor of the change. The owner of Black Diamond Wine and Spirits stated a full service
restaurant in the strip center would be beneficial to his business.
A representative of Excel Development noted the benefit the strip center has been to the community
in regard to taxes, jobs, etc.
The Council held a discussion which included the definition of a Class I restaurant. The original intent
of the restrictive covenants and desires of the surrounding property owners were also discussed.
Mayor Maguire moved, Councilmember Tilley seconded a motion to direct no further action on this
request. Aye: 5 Nay: 0
NEW BUSINESS
PLANNED DEVELOPMENT AMENDMENT — LEEANN CHIN (LEEANN CHIN, INC.)
City Administrator Hedges introduced this item regarding a Planned Development Amendment to
add drive - through service to the existing Class II restaurant located at 2071 Cliff Road. City Planner
Ridley gave a staff report.

The applicant discussed the proposed drive through service.
Councilmember Fields moved, Councilmember Tilley seconded a motion to approve a Planned
Development Amendment to add drive - through service to the existing Class II restaurant located at
2071 Cliff Road, legally described as Lot 2, Block 1, Park Center 4th Addition subject to the following
conditions: Aye: 5 Nay: 0
1. An Amendment to the Planned Development Agreement shall be executed and recorded with the
Dakota County Recorder's office within 90 days of approval. Proof of recording shall be provided
to the City.
2. This Amendment is intended to supplement and amend the existing Planned Development
Agreements. All other conditions in the Development Agreement remain in effect and the
Property is subject to the terms and conditions of the Development Agreement, as amended by
this Amendment.
3. Menu board and directional signage shall be installed according to the submitted sign plans, and
only the numbers and size specified shall be allowed.
4. A new pedestrian connection shall be made between the site and the existing trail along Cliff
Road as shown on the Site Plan. The owner is responsible for obtaining any necessary permits
from Dakota County prior to commencing this work.
5. Two -way traffic shall be maintained between the two buildings.
6. The median separating the drive - through lane from the shared drive aisle between the two
buildings shall be widened to a 5' median and landscaping installed within the median.
REZONING — CITY OF EAGAN
City Administrator Hedges introduced this item regarding a rezoning from Planned Development (PD)
to Residential Single Family (R -1) for three vacant parcels located at the southwest intersection of
Lexington Avenue and Wescott Road. City Planner Ridley gave a staff report.
Councilmember Hansen moved, Councilmember Tilley seconded a motion to approve a rezoning
from Planned Development (PD) to Residential Single Family (R -1) for three vacant parcels located at
the southwest intersection of Lexington Avenue and Wescott Road, legally described as Lots 3 -5,
Block 2, Westbury 2nd Addition. Aye: 5 Nay: 0
The regular City Council meeting was recessed at 9:22 p.m. to immediately convene a meeting of
the Economic Development Authority.
The regular City Council meeting was reconvened at 9:27 p.m.

ACTION TO BE CONSIDERED:
To discontinue the City practice of annually providing 40 hours of Administrative Leave to
Department Directors.
• In official action on February 25, 1982 and June 8, 1982 the City Council made changes
to certain compensation practices including the accumulation of compensatory time for
department directors and other supervisory positions. The changes were formally
implemented in 1983 and for the most part have been in place since that time.
• The action was taken in part to standardize the City's practices regarding payment and/or
time off for compensatory time. Due to staffing constraints, rapid growth and related
hiring, and different employment understandings inconsistencies had developed and
certain employees had significant compensatory time balances on the books.
• To recognize the work week expectations for department directors, they have been given
40 hours of Administrative Leave each year as part of the 1982 City Council action. This
leave time has functioned much like vacation hours, except it cannot be carried over
beyond the end of the calendar year.
• The City's Senior Management Team has reached consensus that with the changing
circumstances and today's environment it would be appropriate to end this formal
allocation of additional leave time.
• Department directors will continue to be allowed to flex hours to reflect unique
circumstances with approval by the City Administrator. In general, all salaried
employees have this same opportunity with approval by their supervisors.
• Although more a staffing issue than a financial issue, elimination of Administrative
Leave has been an employee suggestion during recent budget reduction processes.

To approve the On -Sale Wine, Sunday Wine and 3.2 Percent Malt Liquor (Beer) license
for Wildcats Bar & Grill LLC, dba Wildcats Bar & Grill located at 1448 Yankee Doodle
Road.
FACTS:
➢ The sole member and owner of Wildcats Bar & Grill LLC, George Dahmah, has
applied for an On -Sale Wine, Sunday Wine and 3.2 Percent Malt Liquor (Beer)
license with the City of Eagan. The restaurant will be located at 1448 Yankee
Doodle Road in the former Steakbone's Grill location.
➢ Mr. Dahmah had originally applied for an On -Sale Liquor license; however, it was
determined that the current zoning for the property does not allow for an On -Sale
Liquor license without approval of a Planned Development Amendment, which the
applicant is expected to pursue in the near future.
➢ The license application identified Randy Cooper as an investor in Wildcats Bar and
Grill. As part of the background investigation, Mr. Dahmah informed the Police
Department that Mr. Cooper personally loaned him $65,000 (there are no written
repayment terms) to start the business. Mr. Dahmah is currently an employee at
Cooper's Restaurant and will continue to work at Cooper's in addition to Wildcats.
➢ As background, the On -Sale Liquor license for Cooper's Restaurant will be
suspended for 30 days beginning December 21.
➢ The required documents have been submitted and reviewed by City staff and the
Police Department.
➢ Following approval of the liquor licenses, the wine license will be forwarded to the
Department of Public Safety /Liquor Control Division for final approval.

FACTS:

➢ Clearwire indicates that they wish to preserve the CUP approval until the project funds
are available for construction at this site.

I am writing you this letter in response to our telephone conversation wherein you requested further
information on a prior request by Ms. Connie Lamberes of our office for and extension of the CUP for
the above mentioned wireless site. Connie is no longer on the Minneapolis project and I have taken over
her portion of the Minneapolis project.
The reason that Clearwire would like this extension is so that the CUP does not expire while we wait for
additional Project money to build new sites. We expect this money to become available some time
within the second quarter of 2011.
I would like to make a correction to the information that was provided to you by Ms. Lamberes, in that
the extension that Clearwire is requesting is for one year from February 1, 2011 to Feburary 1, 2012.

I. CONTRACT 10 -16, SCHWANZ LAKE RAIN GARDENS
ACTION TO BE CONSIDERED: Approve the final payment for Contract 10 -16
(Schwarz Lake Rain Gardens) in the amount of $11,255.50 to Urban Companies, LLC,
and accept the improvements for perpetual City maintenance subject to warranty
provisions.
FACTS:
• Contract 10 -16 provided for the continuation of the rain garden improvements within
the nearly 30 acre direct drainage area north of Schwartz Lake that began last year
(City Contract 09 -14). 9 rain gardens were constructed under this contract to add to
the original 10 constructed in this neighborhood last fall. Another 10 -11 rain gardens
are anticipated to be constructed next spring.
• The construction expenses will be reimbursed through the Gun Club Lake Watershed
Management Organization's "Schwarz Lake Direct - Drainage Targeted
Neighborhood Runoff - Reduction Project" which was funded by a $90,000 Minnesota
Pollution Control Agency grant as part of the 2009 Clean Water Fund.
• These improvements have been completed, inspected by representatives of the Public
Works Department, and found to be in order for favorable Council action of final
payment and acceptance for perpetual maintenance subject to warranty provisions.

FACTS:
• On December 3, 2010, City staff received a petition from David Sandvik,
representing the property owner of 2855 Eagandale Boulevard, Factory Motor Parts,
requesting the vacation of a public drainage & utility easement within Lots 1 and 4,
Block 1 of Eagandale Center Industrial Park No. 7.
• The easement is a standard common lot line easement dedicated with this plat that is
no longer necessary with the overall development of the properties by one property
owner and use. A portion of this easement covers a portion of the existing building at

ACTION TO BE CONSIDERED:
To approve the 2011 Parks and Recreation Department CIP for park improvements.
FACTS:
• The Advisory Park and Recreation Commission (APrC) has prepared an updated CIP for the
years 2011 — 2015. The CIP is consistent with the goals of the 20/20 Vision Plan and
existing master plans.
• At their meeting of October 18, 2010, the APrC recommended specific approval of the 2011
CIP projects with years 2012 — 2015 considered as preliminary and subject to change.
• The CIP is funded form the Park Site Fund (PSF) which derives revenues primarily from
money paid by developers in lieu of a land dedication at the time of platting.
• Use of the PSF is statutorily limited to capital improvements related specifically to the
development or improvement of park sites and related amenities. It cannot be used for
maintenance activities.
• The unaudited, projected January 2011 balance of the PSF is estimated to be approximately
$1,128,000.

FACTS:
➢ Trinity School has requested a temporary on -sale liquor license be issued to them for
their Winter Classic event planned for January 29, 2011.
➢ Trinity School has also requested that the $150.00 license fee be waived since they
are a non -profit school.
➢ The application form was reviewed and deemed in order by staff. Following

Dear Ms. Peterson:
Trinity School at River Ridge is applying for a Temporary On -Sale Liquor License for
our Winter Classic on January 29, 2011. This document serves to provide the City of
Eagan the necessary information about our event so that the City Council will approve
our license at the next City Council Meeting. Thank you for working with us to help us
secure the license.
1. The Minnesota Department of Public Safety Application and Permit for Temporary
On -sale Liquor License was completed and is included with this letter. An additional
copy can be provided.
2. I will be faxing The Certificate of Liability Insurance from the Gibson Insurance
Company. Our insurance meets or exceeds your requirements. An additional copy
can be sent if needed.
3. The Winter Classic will be held at Trinity School at River Ridge, 601 River Ridge
Parkway, Eagan, Minnesota, 55121. The event will be held indoors within the school
premises, and entrance into the Winter Classic will be through our east door, the
"Event Entrance."
4. a. We have hired two security personnel for the event who will enforce alcohol
beverage sale and consumption laws, crowd control and public safety. b. The
beverage servers will require that any person desiring to purchase or be served liquor
must show a valid photograph identification which will be checked to insure the
person is 21 or older. Then the age of the person is verified, he /she will be issued a
wristband which he /she will wear throughout the Winter Classic. No alcohol will be
served to a guest who does not have a wristband.
5. No one selling alcohol shall be intoxicated or consume alcoholic beverages during
their work shift.
6. Trinity school will post signs at the entrance notifying the public that sales to and
consumption to alcoholic beverages by persons under the age of 21 or to persons
intoxicated is prohibited.

7. The alcoholic beverages will be available for sale or consumption from 5 -11 p.m. on
Saturday, January 29, 2011.
8. Trinity School will designate an on -site manager in compliance with the City of
Eagan's requirement.
Trinity School at River Ridge requests that the City Council of Eagan wave the $150 fee
since, as a non - profit school organization. This is a fundraising event.

To approve (OR direct preparation of Findings of Fact for Denial), a one -year extension of time to
record the final plat for Lone Oak 3`d Addition, consisting of approximately 125 acres located south
of I- 494 /0'Neill Drive and east of Lone Oak Parkway.
REQUIRED VOTE FOR APPROVAL: Majority of Councilmember's present.
FACTS:
➢ The City Council approved the Preliminary Subdivision on September 21, 2010, and the
Final Subdivision on November 4, 2010. The 60 -day period for recording the plat
expires January 3, 2010.
➢ The purpose of the subdivision was to allow for sale of the existing building and its
associated parking areas. The subdivision also dedicates new right -of -way for a future
east -west public street through the site, and creates outlots for the remaining vacant
portions of the site.
➢ The intended buyer of the property has backed out, and Delta wishes to retain flexibility
in the event a new buyer desires a different configuration of the lots and /or outlots.
➢ Delta has requested an extension of one -year. Final Plat approvals are valid for 60 days
and extensions of time to record a final plat are typically granted for a period of 60 -90
days.
➢ Approval of the requested extension will result in a new expiration date of January 3,
2012.

PUBLIC HEARINGS
A. 2011 Fee Schedule
ACTION TO BE CONSIDERED:
To close the public hearing and adopt a resolution approving the 2011 Fee Schedule establishing
fees for various City services, supplies and materials.
FACTS:
Per Minnesota Statutes 462.353, the adoption of a fee schedule requires publication at least
10 days prior to a public hearing. The notice was published on December 10.
Fees are reviewed annually by staff. Fee increases are proposed by the departments
charging the fee. Proposed increases are reviewed for propriety and compiled for
presentation to the Council by the Chief Financial Officer.
The most notable proposed increases for 2011 are in the enterprise funds. In each case, the
increase has been brought before the Council for consideration earlier this year, either with
the budget proposal or as a separate workshop agenda item:
• Cascade Bay daily admission rates are up $1. Late -in -the day admission rates are up
$2, but now apply to admission after 4 pm, not 5 pm. Season pass rates are up $5.
• Sanitary Sewer utility rate is up 5.5% per the Springsted study recommendations; the
water rates are unchanged.
• Storm Drainage utility rates are impacted by the overall rate increase of 4.25%
recommended by Springsted, coupled with the equity adjustment factor applied to
all land uses to ensure each type of land continues to pay its proportionate fair share
based on runoff volume impacts. At its July 27 special meeting, the Council
directed that a revised rate structure using the adjustment factor be considered at a
future public hearing, and is included here with the other fee schedule changes.
• As a brief review of the background, staff performed a detailed analysis
revealing that an economic disparity has evolved over the years between the
different classes of land uses when comparing the volume of runoff
generated to their respective utility fee contributions. Under the present rate
structure, low- density (R1 -R3) residential properties have been paying more
than their share of the surface water runoff costs, while high- density
residential (R4) and commercial /industrial properties have been paying less
than their share. The proposed rates attempt to correct the inequity going
forward. (See attached summary of notable changes for details of rate
impact by land use type.)
• Public Works Director Colbert will be available to answer questions related
to the equity adjustment factor.

Page 6 A new impervious surface mitigation inspection escrow deposit is proposed to cover
staff review and inspection time in the situation where a resident seeks to add
impervious surface on his property and then agrees to install pervious pavers on the
driveway, for example, to keep impervious lot coverage under the 25% maximum.
Pages 12, 16 Connection charges and street assessment rates are traditionally increased by a
construction inflation index published by the Engineering News Review. For the
current year, the index increased 4.1 %.

STREET IMPROVEMENTS
ACTION TO BE CONSIDERED: Approve Project 1044, Clearview Addition (Street
Improvements) as presented and authorize the preparation of detailed plans and
specifications.
FACTS:
• Since 1990, the City has implemented a comprehensive Pavement Management
Program that provides timely pavement rehabilitation to our local streets, significantly
extending their overall life expectancy. During these past 21 years, the City has
rehabilitated approximately 161 miles of local streets.
• The resurfacing of the 0.5 mile of streets within the Clearview neighborhood (Beecher
Drive and Lenore Lane) in southwest Eagan has been programmed for 2011 in the
City's 5 -Year Capital Improvement Program.
• On June 1, 2010 the City Council directed staff to prepare a feasibility report
considering a rehabilitation of these streets.
• On November 16, 2010, the feasibility report for Project 1044 was presented to the
City Council and a Public Hearing was scheduled for December 21 to formally
present and discuss the report with the adjacent property owners.
• An informational neighborhood meeting was held on December 13 for the adjacent
property owners to discuss the proposed improvements. Of the 26 total properties (all
single - family homes) proposed to be assessed under this improvement, no one
attended the meeting.
• All notices have been published in the legal newspaper and sent to all affected
property owners informing them of this public hearing.

Neighborhood Street Revitalization

Introduction/ History
Streets - As a part of Eagan's Pavement Management Program, (PMP), the City evaluates
streets within the community throughout their life cycle and implements appropriate
maintenance strategies. In 1989, a Pavement Management System (PMS) was developed that
allowed the City to evaluate the condition of the existing pavement surface for all the streets on
a routine basis and schedule timely maintenance. A Five Year Capital Improvement Program
(CIP) for street rehabilitation is developed from this information.
The nearly 1/2 mile of residential Clearview Addition neighborhood streets in south central
Eagan is identified for the 2011 street revitalization improvements. Figure 1, located in
Appendix C, illustrates the project location. The streets in this residential neighborhood were
constructed in 1989.
Based on the data and engineering strategies available at this time, the City's current PMP
incorporates local and ongoing maintenance strategies with seal coating occurring as needed
(at 5 to 7 years, again at 12 to 14 years) with a bituminous overlay at approximately 20+ years.
Recycling or overlaying the roadway located within the project area, which is presently at the
20+ year time frame, will prevent further decay of the pavement surface, thus protecting and
extending the structural life of the streets.
Timely maintenance work, such as bituminous patching, crack sealing and seal coating have
occurred at appropriate intervals during the life of the pavement in the area. The City of

Eagan's maintenance records indicate that the streets in the Clearview Addition (Beecher Drive/
Lenore Lane) were seal coated in 1995 and 1999.
The Public Works maintenance program typically includes extensive patching and crack sealing
during the summer prior to the overlay. The Public Works crews, as part of the Preparatory
Pavement Management Plan, removed and replaced deteriorated pavement areas and placed
leveling and maintenance overlays on portions of the streets under consideration, where
necessary. These repairs alone will not substantially extend the life expectancy of the street
section if not combined with the bituminous overlay proposed with this project.
The Public Works Department has also inspected the utility infrastructure (sanitary sewer,
water main, and storm sewer) in the project area and determined the system is in good
working order and that no major repairs are necessary.
Scope
This project will provide resurfacing (edge mill and overlay) for approximately % mile of
roadway. Figure 2 in Appendix C, illustrates the project limits.
Included in this project are the following improvements; replacement of damaged curb and
gutter, adjustments and /or replacement to sanitary /storm sewer utility castings, water gate
valves, and street signage.
Feasibility and Recommendations
The mill and overlay project is necessary to maintain and enhance the structural integrity of the
pavement section, create a safer driving surface, and increase rideability.
The mill and overlay is cost effective in that the proposed improvement (resurfacing) is
considerably less expensive than complete reconstruction of this street.

The mill and overlay is feasible in that this type of improvement has been used successfully to
extend the life expectancy of numerous other streets throughout the City and the region.
This project is in accordance with the Five Year Capital Improvement Plan (2011— 2015) for the
City of Eagan and the schedule as outlined in the Pavement Management Program. It is
recommended that the project be constructed as proposed in this report in combination with
other similar projects in the area.
Street Evaluation
The City of Eagan's Pavement Management System allows the City to evaluate the condition of
the existing street surface to help schedule timely maintenance and improvements. The
Pavement Condition Index (PCI) ranks the surface condition for each street. The general
categories that define PCI rankings are as follows:

pavement condition rating of 54, which falls in the rankings of the "Patch /Repair and /or
Overlay" category, as mentioned above. The street pavement has reached an age where, based
on the City's past experience, the integrity of the pavement can rapidly decline if no
improvements are performed. Therefore, the 2011 construction season is the optimal time to
construct the bituminous overlay on these streets. Any delay of the project may reduce the
structural benefit to the street sections and require full reconstruction.

Proposed Improvements
Pavement - The proposed street improvements for
the Clearview Addition are shown in Figure 3. The
existing residential street section for this roadway
consists of 3" bituminous pavement supported by 6"
gravel base. The existing bituminous surface will be
milled adjacent to the existing curb and gutter (6' -8'
wide) to accommodate a 1% -inch bituminous
overlay. The overlay, combined with the existing
street section, will provide a street section
consistent with current City standards for residential streets. The combination of patching and
overlay will not eliminate cracking due to the temperature extremes experienced in Minnesota.
Bituminous overlays will show some continued frost movements and reflective cracking
consistent with the underlying pavement. Routine maintenance will still need to continue under
the City's Pavement Management Program.
Concrete curb & gutter - Damaged curb &
gutter will be replaced if severely cracked,
spalled, or settled. It is estimated that
approximately 7% of the existing concrete
curb and gutter will have to be replaced.
Boulevard turf will be removed and replaced.
While the contractor who performs the work is
responsible for its establishment in the first 30 days after placement, adjacent property owners
are encouraged to consistently water the new turf, where possible, to help ensure its growth.
Signage - All traffic control and street identification signage within the project limits will be
replaced due to diminished reflectivity, deteriorated support posts, and the signs or posts no
longer meeting City and State standards.

Easement /Permits
All work will be in the public right -of -way. No additional easements will be necessary.
A permit from Dakota County Transportation Department will be necessary for the work within
Cliff Road (CSAH 32) at Lenore Lane.
Cost Estimate
Detailed cost estimates are located in Appendix A. The estimates are based on anticipated
2011 construction costs and include a 5% contingency and indirect cost of 30 %, which include

Assessments are proposed to be levied against the benefited properties for the total
improvement with costs allocated in accordance with the City of Eagan's Special Assessment
Policy for a mill and overlay improvement for residential streets. All assessments will be revised

All residential - equivalent lots (28 total single - family residential lots, including 2 lot equivalents
each for 1760 Beecher Drive and 1805 Lenore Lane), as shown on Figure 2, having driveway
access on to the street to be improved, are proposed to be assessed. The 2 -lot equivalents
proposed for 1760 Beecher Drive and 1805 Lenore Lane is consistent with the special
assessments levied with the original street construction project in 1989. The City's Assessment
Policy states that 50% of the mill and overlay costs are assessable for local residential streets,
based on a standard 32 -foot width. The estimated cost per single - family lot equivalent to be
assessed based on the City Assessment Policy is $1,155/lot and is calculated as follows:

Assessment Financing Options
The property owner will have the option at the time of the assessment hearing to pay the full

ACTION TO BE CONSIDERED: Approve Project 1048, Blue Cross Road (Street
Improvements) as presented and authorize the preparation of detailed plans and
specifications.
FACTS:
• Since 1990, the City has implemented a comprehensive Pavement Management
Program that provides timely pavement rehabilitation to our local streets, significantly
extending their overall life expectancy. During these past 21 years, the City has
rehabilitated approximately 161 miles of local streets.
• The resurfacing of the 0.6 mile of Blue Cross Road (Blackhawk Road to Yankee
Doodle Road) in northwest Eagan has been programmed for 2011 in the City's 5 -Year
Capital Improvement Program.
• On June 1, 2010 the City Council directed staff to prepare a feasibility report
considering a rehabilitation of this street.
• On November 16, 2010, the feasibility report for Project 1048 was presented to the
City Council and a Public Hearing was scheduled for December 21 to formally
present and discuss the report with the adjacent property owners.
• An informational neighborhood meeting was held on December 13 for the adjacent
property owners to discuss the proposed improvements. Of the 7 total properties (6
commercial/ industrial, 1 City park) proposed to be assessed under this improvement,
2 representatives of the 6 commercial/ industrial properties attended the meeting.
• All notices have been published in the legal newspaper and sent to all affected
property owners informing them of this public hearing.

Introduction /History
Streets - As a part of Eagan's Pavement Management Program, (PMP), the City evaluates
streets within the community throughout their life cycle and implements appropriate
maintenance strategies. In 1989, a Pavement Management System (PMS) was developed that
allowed the City to evaluate the condition of the existing pavement surface for all the streets on
a routine basis and schedule timely maintenance. A Five Year Capital Improvement Program
(CIP) for street rehabilitation is developed from this information.
The nearly 0.6 mile of Blue Cross Road, a collector street in west central Eagan is identified for
the 2011 street revitalization improvements. Figure 1, located in Appendix C, illustrates the
project location. The street in this commercial/ industrial area was constructed in 1972, and
the pavement was reconstructed in 1994.
Based on the data and engineering strategies available at this time, the City's current PMP
incorporates local and ongoing maintenance strategies with seal coating occurring as needed
(at 5 to 7 years, again at 12 to 14 years). Timely maintenance work, such as bituminous
patching, crack sealing and seal coating have occurred at appropriate intervals during the life of
the pavement in the area. The City of Eagan's maintenance records indicate that Blue Cross
Road was last seal coated in 1998 after the pavement resurfacing in 1994.
The Public Works Department has also inspected the utility infrastructure (sanitary sewer,
water main, and storm sewer) in the project area and determined the system is in good
working order and that no major repairs are necessary.

Scope
This project will provide full depth recycling and reclaiming of the bituminous pavement for
approximately 0.6 mile of roadway on Blue Cross Road. Figure 1, located in Appendix C,
illustrates the project limits.
Included in this project are the following improvements; replacement of damaged curb and
gutter, adjustments and /or replacement to sanitary /storm sewer utility castings, water gate
valves, signal loops, street signage, bituminous trail rehabilitation, and pedestrian ramps.
Feasibility and Recommendations
This street improvement is necessary to create a safer driving surface, increase rideability, and
prolong the structural integrity of the roadway.
This project is cost effective in that the proposed improvements (recycling and reclaiming) is
considerably less expensive than complete reconstruction of the street.
The recycle and reclaim is feasible in that this type of improvement have been used successfully
on numerous other similar streets throughout the City and the region.
This project is in accordance with the Five Year Capital Improvement Plan (2011— 2015) for the
City of Eagan and the schedule as outlined in the Pavement Management Program. It is
recommended that the project be constructed as proposed in this report in combination with
other similar projects in the area.
Street Evaluation
The City of Eagan's Pavement Management System allows the City to evaluate the condition of
the existing street surface to help schedule timely maintenance and improvements. The
Pavement Condition Index (PCI) ranks the surface condition for each street. The general
categories that define PCI rankings are as follows:

The 2010 PCI rankings for the street segment has a weighted average pavement condition
rating of 25 for Blue Cross Road, which falls in the rankings of the "Reconstruct/ Reclaim"
category, as mentioned above. The street pavement has reached an age where, based on the
City's past experience, the integrity of the pavement can rapidly decline if no improvements are
performed. Therefore, the 2011 construction season is the optimal time to recycle and
construct the new bituminous on this street. Any delay of the project may reduce the structural
benefit to the street sections and require full reconstruction.
Proposed Improvements
Pavement - The proposed street improvement
is shown on Figure 3. The existing street
section for the Blue Cross Road consists of a
5.5" bituminous pavement supported by 6"
gravel base. The existing pavement on Blue
Cross Road has reached a condition that
warrants replacement for the entire length.
The existing pavement will be recycled as
gravel base. This recycled material will be
salvaged and used as a base beneath a new fl-
inch pavement base course and a 1%2 -inch wear
Recycle/ Reclaim Process
course bituminous pavement. The new pavement, combined with the recycled material and
existing street section, will provide a street section consistent with current City standards for a 9-
ton collector street, similar to Blackhawk Road, north of Deerwood Drive, reconstructed in 2010. A
10 -ton collector street pavement section was also evaluated as part of this project, but determined

that the cost of the additional pavement and aggregate base needed for a 10 -ton section was not
warranted given the relatively low heavy -duty ('200 per day) and passenger vehicle traffic volumes
(5,000 per day) on this section of roadway. The new pavement will experience cracking due to the
temperature extremes experienced in Minnesota. Bituminous streets will show some continued
frost movements and reflective cracking. Routine maintenance will continue under the City's
Pavement Management Program.

consistent with similar past projects in commercial/ industrial areas throughout the City and the
other properties within the project area.

Sidewalk /Path & Pedestrian Ramp —
Revisions to the Americans with Disabilities Act (ADA)
requires jurisdictional agencies to provide detectable
warnings at all existing pedestrian ramps of sidewalks
and paths with public streets that are improved,
including street surface improvements. The most
common method of providing this detectable warning is
through the installation of truncated domes a minimum
of two feet in length across the width of all pedestrian
ramps. This project provides for the installation of truncated dome pedestrian ramps along the
existing Blue Cross Road trail.

In conjunction with the installation of truncated dome pedestrian ramps and the street
improvements, the existing trail along Blue Cross Road will be cleared of overgrowth and a
1 -1/2" bituminous overlay constructed on the entire length.
Easement /Permits

anticipated that no permits will be required for the project.
A Dakota County permit will be necessary for work within Yankee Doodle Road (County State Aid
Highway 28) right -of -way.

Properties adjacent to Blue Cross Road are proposed to be assessed with a 15% credit because
the pavement condition has not met its predicted life expectancy (3 years prior to an anticipated
20 -year pavement life cycle, 3/20 = 15 %). This reduced assessment rate is in accordance with a
recent update (February 16, 2010) of the City's Special Assessment Policy addressing shortened
life cycles.

City's Assessment Policy states that 100% of the recycle and reclaim costs are assessable for
collector streets, regardless of width. The estimated cost per front foot to be assessed based on
the City Assessment Policy, with a 15% credit is $54.91/ front foot and is calculated as follows:

Driveway Entrance Replacement - The adjacent commercial/ industrial property with driveways
not to current City standards (3535 Blue Cross Road) are proposed to be assessed the total cost
of driveway entrance replacement improvements on the area of driveway installed. The total
driveway improvement assessment per lot is calculated based on the individual requirements
needed to replace existing bituminous entrances with concrete entrances in accordance with
current City standards. The estimated cost of driveway replacement is approximately $91 per
square yard replaced.
Assessment Financing Options
The property owner will have the option at the time of the assessment hearing to pay the full
assessment or include the assessment in with their property tax statement. If the assessment is
included with the property tax statement, the assessment will be spread over ten years with the
interest determined by the results of the bond sale used to finance the improvements. The
following payment schedule is an example of a $10,000 assessment with an estimated 5%
interest for the assessed amounts:

• Gorder welcomed the property owners and presented project information, including
details such as construction, costs, schedule, assessments, and project need.
B. Questions/ Comments
• Will there be access to the Blue Cross and Delta Dental buildings during
construction? Yes. The contractor will be required to provide hard driving surface,
gravel or pavement, during construction. There may be some limited access during short
periods (< 1 hour) of construction. Also, access redirection will need to occur with each
of the three Blue Cross Road concrete entrance replacements.
• Both representatives offered contact information for their staff for communication
and coordination during construction.
• Have the special assessment benefits to the properties been calculated? Appraisals of
benefit for these types of street projects are usually not prepared. The estimated
assessment amounts are calculated based on the City's long - standing Special Assessment
Policy.

ACTION TO BE CONSIDERED: Approve Project 1049, Wilderness Run Road (Street
Improvements) as presented and authorize the preparation of detailed plans and
specifications.
FACTS:
• Since 1990, the City has implemented a comprehensive Pavement Management
Program that provides timely pavement rehabilitation to our local streets, significantly
extending their overall life expectancy. During these past 21 years, the City has
rehabilitated approximately 161 miles of local streets.
• The resurfacing of the 1.5 miles of Wilderness Run Road (Capricorn Court to Dodd
Road) in southern Eagan has been programmed for 2011 in the City's 5 -Year Capital
Improvement Program.
• On June 1, 2010 the City Council directed staff to prepare a feasibility report
considering a rehabilitation of this street.
• On November 16, 2010, the feasibility report for Project 1049 was presented to the
City Council and a Public Hearing was scheduled for December 21 to formally
present and discuss the report with the adjacent property owners.
• An informational neighborhood meeting was held on December 13 for the adjacent
property owners to discuss the proposed improvements. Of the 29 total properties (1
single - family lot, 19 townhomes and 9 City park properties) proposed to be assessed
under this improvement, 2 residents representing 2 townhome properties attended the
meeting.
• All notices have been published in the legal newspaper and sent to all affected
property owners informing them of this public hearing.

Introduction/ History
Streets - As a part of Eagan's Pavement Management Program, (PMP), the City evaluates streets
within the community throughout their life cycle and implements appropriate maintenance
strategies. In 1989, a Pavement Management System (PMS) was developed that allowed the City
to evaluate the condition of the existing pavement surface for all the streets on a routine basis and
schedule timely maintenance. A Five Year Capital Improvement Program (CIP) for street
rehabilitation is developed from this information.
Nearly 1.5 miles of 36 to 44 -feet wide Wilderness Run Road (Capricorn Court to Dodd Road) in
southern Eagan is identified for the 2011 street revitalization improvements. Figure 1, located in
Appendix C, illustrates the project location. This portion of Wilderness Run Road was originally
constructed as an interim rural roadway in 1981 and reconstructed to an urban section roadway in
1991.
Based on the data and engineering strategies available at this time, the City's current PMP
incorporates local and ongoing maintenance strategies with seal coating occurring as needed (at 5
to 7 years, again at 12 to 14 years). Timely maintenance work, such as bituminous patching, crack
sealing and seal coating have occurred at appropriate intervals during the life of the pavement in
the area. The City of Eagan's maintenance records indicate that Wilderness Run Road was seal
coated in 1996 and 2005.
The Public Works Department has also inspected the utility infrastructure (sanitary sewer, water
main, and storm sewer) in the project area and determined the system is in good working order
and that no major repairs are necessary.

Scope
This project will provide full depth recycling and reclaiming of the bituminous pavement for
approximately 1.5 miles of Wilderness Run Road. Figure 1, located in Appendix C, illustrates the
project limits.
Included in this project are the following improvements; replacement of damaged curb and gutter,
adjustments and /or replacement to sanitary /storm sewer utility castings, water gate valves, street
signage, bituminous trail rehabilitation, and pedestrian ramps.
Feasibility and Recommendations
This street improvement is necessary to create a safer driving surface and increase ride - ability.
This project is cost effective in that the proposed improvements (recycling and reclaiming) is
considerably less expensive than complete reconstruction of the street.
The recycle and reclaim is feasible in that this type of improvement have been used successfully on
numerous other similar streets throughout the City and the region.
This project is in accordance with the Five Year Capital Improvement Plan (2011— 2015) for the City
of Eagan and the schedule as outlined in the Pavement Management Program. It is recommended
that the project be constructed as proposed in this report in combination with other similar
projects in the area.

Street Evaluation
The City of Eagan's Pavement Management System allows the City to evaluate the condition of the
existing street surface to help schedule timely maintenance and improvements. The Pavement
Condition Index (PCI) ranks the surface condition for each street. The general categories that define
PCI rankings are as follows:

The 2010 PCI ranking for this portion of Wilderness Run Road has a weighted average pavement
condition rating of 34, which falls in the rankings of the "Reconstruct/ Reclaim" category, as shown
above. The street pavement has reached an age (20+ years) and condition where, based on the
City's past experience, the integrity of the pavement can rapidly decline if no improvements are
performed. Therefore, the 2011 construction season is the optimal time to recycle and construct
the new bituminous pavement on this street. Any delay of the project may reduce the structural
benefit to the street sections and require full reconstruction.

Proposed Improvements
Pavement - The proposed street improvement is shown on Figure 3. The existing street section for
the Wilderness Run Road consists of approximately 3 -1/2 to 5 inches of bituminous pavement
supported by 8 to 11 inches of gravel base. The existing pavement on Wilderness Run Road has
reached a condition that warrants replacement for the entire length. The existing pavement will be
recycled as gravel base. This recycled material will be salvaged and used as a base beneath a new
3% -inch pavement base course and a 1% -inch wear course bituminous pavement (5" total). The
new pavement, combined with the recycled material and existing street section, will provide a
street section consistent with current City standards for a 9 -ton collector street, similar to
Blackhawk Road, north of Deerwood Drive, reconstructed in 2010. A 10 -ton collector street
pavement section was also evaluated as part of this project, but determined that the cost of the
additional pavement and aggregate base needed for a 10 -ton section was not warranted given the
relatively low heavy -duty ( -60 per day) and passenger vehicle traffic volumes (2,000 per day) on
this section of roadway.
The combination of recycling and reclaiming of the pavement will not eliminate cracking due to the
temperature extremes experienced in Minnesota. Routine maintenance will continue under the
City's Pavement Management Program.

Concrete curb & gutter - Damaged curb &
gutter will be replaced if severely cracked,
spalled, or settled. It is estimated that
approximately 4% of the existing concrete
curb and gutter will have to be replaced.
Boulevard turf will be removed and
replaced. While the contractor who
performs the work is responsible for its
establishment in the first 30 days after
placement, adjacent property owners are
encouraged to consistently water the new turf, where possible, to help ensure its growth.
Signage - All traffic control and street identification signage within the project limits will be
replaced due to diminished reflectivity, deteriorated support posts, and the signs or posts no
longer meeting City and State standards.

and paths with public streets that are
improved, including street surface
improvements. The most common method
of providing this detectable warning is
through the installation of truncated domes a minimum of two feet in length across the width of all
pedestrian ramps. This project provides for the installation of truncated dome pedestrian ramps
along the existing Wilderness Run Road trail.
In conjunction with the installation of truncated dome pedestrian ramps and the street
improvements, the existing trail along Wilderness Run Road will be cleared of overgrowth and a 1-

1/2" bituminous overlay will be constructed on segments of the trail that have reached a condition
warranting repair.
Easement /Permits
All work will be in the public right -of -way. No additional easements will be necessary. A Dakota
County permit will be necessary for work within Lexington Avenue (County Road 43) right -of -way.
Cost Estimate
Detailed cost estimates are located in Appendix A. The estimates are based on anticipated 2011
construction costs and include a 5% contingency and indirect cost of 30 %, which include legal,
administration, engineering, and bond interest. A summary of the costs is as follows:

driveway access onto Wilderness Run Road (805 Wilderness Run Road) as shown on Figure 2D, is
proposed to be assessed based on a typical amount of front footage adjacent to the project
improvements. The City's Assessment Policy states that 75% of the pavement recycle/ reclaim
costs are assessable for residential properties (R -1, R -2, R -3) based on a normal residential width
street, 32 feet. The average width of Wilderness Run Road within the project area is 36 feet. Due to
its collector designation, Wilderness Run Road will have much thicker bituminous than a typical
residential pavement section, 5" versus 3 ". Only 60% of the bituminous cost will be eligible for a
low- density residential (Single Family) assessment. The estimated cost per residential lot
equivalent to be assessed, based on the City Assessment Policy and consistent with assessments for
recycle/ reclaim projects in other nearby single - family neighborhood (Sheffield Addition — 2007), is
$1,900 per Single Family Lot, calculated as follows:

Assessment Financing Options
The property owner will have the option at the time of the assessment hearing to pay the full
assessment or include the assessment in with their property tax statement. If the assessment is
included with the property tax statement, the assessment will be spread over five years for
residential properties and ten years for City parks with the interest determined by the results of the
bond sale used to finance the improvements. The following payment schedules are examples of

• Gorder welcomed the property owners and presented project information, including
details such as construction, costs, schedule and assessments.
B. Questions/ Comments
• We live in the Oakwood Heights Townhomes. Why are we proposed to be assessed
for the street improvements to Wilderness Run Road when we already maintain our
own private street, Oakwood Heights Circle? The City's long- standing Special
Assessment Policy provides for the assessment of benefits from public street
improvements to properties at their first point of public street access. The private street is
considered similar to a driveway. The total townhome assessment is determined by the
amount of frontage adjacent to the public improvement, and spread out on a per unit
basis. Assessments for street improvements in many other similar situations in the past 20
year have been levied to townhomes with indirect access via private streets.
• What happens if the assessment costs go beyond the estimate? If the contractor bids
are more than 10% than the estimate, it is the City's policy to hold another public hearing
for the project. Notification will be mailed to the affected properties if this occurs.

ACTION TO BE CONSIDERED: Adopt the Obstructions and Excavations within Public Rights -
of -Way regulations into City Code as Section 7.05 & Obstructions and Dumping on Public Property
regulations into City Code as Section 10.32.
FACTS:
• On March 4, 2003, the City Council authorized the submittal of a Municipal Separate Storm Sewer
System (MS4) permit application to the Minnesota Pollution Control Agency (MPCA) under the
National Pollutant Discharge Elimination System ( NPDES), Phase II Program. A Storm Water
Pollution Prevention Plan (SWPPP) was included with this permit application. The permit and
SWPPP were modified June 1, 2006, as a result of a May, 2003 Minnesota Court of Appeals decision
in which the court required the MPCA to provide the opportunity for public review of each MS4
SWPPP.
• The NPDES Phase II Final Rule requires an operator of a regulated small MS4 (i.e. Eagan) to
develop, implement, and enforce a program to address storm water runoff within its jurisdiction that
discharges into its small MS4. Eagan's program must require control measures that enable the
detection and elimination of illicit (non - stormwater) discharge into the storm sewer system to ensure
compliance, to the extent allowable under law.
• In the SWPPP, City staff detailed, with the guidance of the League of Minnesota Cities Guide Plan,
the duties, practices and responsibilities of the City of Eagan that address the pollution abatement
efforts required to meet the permit's Maximum Extent Practicable standard.
• To develop a program consistent with this intent, Eagan must review /update existing or implement
new enforceable City Ordinances that prohibit illicit discharge into the storm sewer system such as
City Code Sec. 7.05 and 10.32, which prohibit illegal dumping.
• The revisions to Section 7.05 will enable the following issues within the Public Right -of -Way, to be
better addressed by the relevant departments responsible for such matters: Obstructions &
excavations - Public Works (Engineering or Transportation), Police, Code Enforcement, Fire; Fires —
Fire; Dumping in streets, sidewalk or trail, storm - sewers, or catch basins - Public Works

addressed by the relevant departments responsible for such matters: Obstructions — Parks; Fires —
Fire; Dumping on public property - Parks, Public Works (Engineering, Transportation, Utilities), Fire,
Code Enforcement; Signs and other structures - Parks, Code Enforcement; Snow or ice on public
property — Parks.
• On March 16, 2010, the City Council authorized the preparation of revised ordinance language as an
amendment to the City Code that addresses the City of Eagan's Storm Water Pollution Prevention
Plan (SWPPP) and directed staff to prepare draft ordinances for further consideration.
• Overall, the proposed regulations bolster the City's position to protect the public interest and to
manage the community's resources. Future modifications to other relevant chapters in the existing
code will be proposed in a comprehensive effort to address the SWPPP obligations.

• Information about the new ordinance language will be provided in a variety of formats upon City
Council adoption. Publication of the information will be completed through a press release and in
articles on the City's website, Eagan Business News and E -TV.

AN ORDINANCE OF THE CITY OF EAGAN, MINNESOTA, AMENDING EAGAN CITY
CODE CHAPTER SEVEN ENTITLED "STREETS AND SIDEWALKS GENERALLY" BY
AMENDING SECTION 7.05 REGARDING OBSTRUCTIONS IN PUBLIC RIGHTS -OF -WAY;
AND BY ADOPTING BY REFERENCE EAGAN CITY CODE CHAPTER I AND SECTION
7.99.
The City Council of the City of Eagan does ordain:
Section 1. Eagan City Code Chapter Seven is hereby amended by changing Section 7.05 to
read as follows:
Sec. 7.05. Obstructions and Excavations within Public Rights -of -Way (Streets or
Sidewalks /Trails).
Subd. 1. Application and scope. This Section shall not apply to obstructions or
excavations within public rights -of -way by a person or entity owning or controlling a utility
service facility therein, which is regulated elsewhere in this Chapter.
Subd. 2. Definitions. The following terms, as used in this Section, shall have the
meaning stated:
"Construction debris, " "yard waste, " "garbage, " "kitchen waste, " "recyclables, " and
"refuse " mean as the terms are defined in the regulations governing storage and disposal of
refuse set forth elsewhere in this Code.
"Excavate " or "excavation " means to dig into or in any way remove or physically
disturb or penetrate any public right -of -way ground surface, or any portion thereof.
"Obstruct" or "obstruction" means to place or the placement of any object in a public
right -of -way, or to remove or the removal of an existing structure, or any portion thereof, from a
public right -of -way, for an aggregate period of eight (8) hours or more.
"Public Right -of -way " means the surface, air space above the surface and the area below
the surface of any public street, highway, lane, path, alley, sidewalk, trail, avenue, boulevard,
drive, court, concourse, bridge, tunnel, park, parkway, skyway, waterway, or similar property
within the City owned by or under control of the City, or dedicated or otherwise conveyed to the
City, for general public use.
"Street" means the entire width of the roadway surface open to the public for use as a
matter of right for the purposes of vehicular traffic, including any private street or road.
Subd. 3. Obstructions & excavations. No person shall excavate, obstruct, or place,
deposit, display, install, or maintain any obstruction, including but not limited to: a fence, goods,
building or landscaping materials, any structure, landscaping, electrical cords or devices of any
kind, or other objects, within any public right -of -way. This paragraph shall not apply to
operable and registered motor vehicles lawfully parked within the street or upon a portion of a
driveway within the public right -of -way, provided the motor vehicle is not blocking any portion
of a sidewalk or trail. No violation shall occur if the person obtains a written permit from the
council for the excavation or obstruction, provided a permit will be issued only for mailboxes,
irrigation systems and landscaping that do not create a public safety concern and are placed and
maintained in compliance in all respects with the terms and conditions of such permit and the
regulations of this Code.
Subd. 4. Fires. It is a misdemeanor for any person to build or maintain a fire within or
upon a public right -of -way.
Subd. S. Dumping in streets, sidewalk or trail, storm - sewers, or catch basins. This
subdivision shall include all streets, storm sewers and catch basins, public or private. It is
unlawful and deemed as a public nuisance for any person to throw, deposit, place or cause to be
deposited or placed onto any street, sidewaWtrail or into any catch basin or storm -sewer any
refuse or garbage, dirt, rock, yard waste, sewage, petroleum products, paint, stain, finishing
products or the like, chemicals, solid or liquid, antifreeze, including fluids leaking from vehicles
or any other fluid that is not composed entirely of storm water or tap water.. .
This subdivision shall not include swimming pool water or clean ground water from sump pumps
when discharged overland before reaching the street or storm sewer or basin provided discharge
is in accordance with City policies or water from permitted irrigation systems installed or placed
in the right -of -way.
Subd. 6 Signs and other structures. Except as otherwise permitted by the City Code, it
is a misdemeanor for any person to place or maintain a sign, advertisement, or other structure in
any public right -of -way without first having obtained a written permit from the council. In a
district zoned for commercial or industrial enterprises, special permission allowing an applicant
to erect and maintain signs overhanging into the public right -of -way may be granted upon such
terms and conditions as may be set forth in the zoning or construction provisions of the City
Code. A violation of this subdivision shall be deemed a public nuisance. Any person who is in
violation of this subdivision shall immediately remove the obstruction upon demand by the city
and upon failure to do so, the violator shall pay the costs incurred by the city in connection with
its removal.
Subd. 7. Snow in streets or on sidewalks /trails.
A. Placement of snow or ice within street, sidewalk or trail right -of -way. No person,
unless acting under a specific contract with the city or with special permission from the
city, shall place snow or ice in any travel portion of any street, sidewalk or trail right -of-
way or push, blow or otherwise move snow or ice across the travel portion of any public
street to be deposited within the public right -of -way on the opposite side of street.
B. The owner or occupant of any property who deposits, or employs another who
deposits, snow or ice in any travel portion of any street, sidewalk or trail right -of -way
shall remove the deposit snow or ice within 12 hours after notice is given by the city. If
the owner or occupant fails to remove the snow or ice as required in the notice within the
12 hours, the city may perform such work and the owner or occupant shall be personally
liable and shall pay the cost within 30 days of mailing of invoice by the city. When
payment is not remitted as required herein, the city clerk- treasurer may, at the next
meeting, present such information to the city council. The city council may approve all

or a portion of any snow removal costs as herein provided as a special assessment against
the abutting property and such special assessments shall, at the time of certifying taxes to
the county auditor, be certified for collection as other special assessments are certified
and collected pursuant to Minn. Stat. § 429.101.
C. Violation. Any violation of this subdivision shall be a petty misdemeanor offense.
Subd. 8. Tracking dirt, clay or soil onto streets /responsibility of vehicle operators.
A. It shall be the responsibility of the construction project's development contract
obligee, project permit holder or property owner to immediately clean up any siltation, dirt,
earth, concrete (including concrete wash wastes and runoff liquids), asphalt or other similar
substance deposited upon any street right -of -way as a result of motor vehicle traffic from such
construction site or area or improper or insufficient erosion control measures on such site or area.
B. All direct or indirect costs incurred by the city for the removal of any substance
deposited upon any street in violation of this subdivision and not so removed as required above
shall be charged to the development contract obligee, permit holder or property owner. If the
city's invoice for its costs for removal is not paid within 30 days of the mailing of the invoice,
then the city may specially assess the charges against the property.
C. Any person who operates a motor vehicle or tows a trailer shall remove any dirt, earth,
concrete, asphalt or other similar substance from all tires, frame, and exterior body of any motor
vehicle or trailer before driving upon any street in order that such dirt, earth, concrete, asphalt or
other similar substance shall not be tracked onto or fall upon the street.
D. Any person that operates a motor vehicle or tows a trailer with any load or contents so
unsecured or inadequately enclosed or covered that a portion of the load is allowed to fall upon
public right -of -way or spill into a storm sewer or catch basin shall be personally liable for and
shall pay for all costs incurred by the city for the removal, proper disposal of the load or contents
thereof deposited upon the public right -of -way, and any repairs or restoration of the public right -
of -way.
Subd. 9. Continuing violation. Each day that any person continues in violation of this
section shall be a separate offense and punishable as such. A violation of this Section shall be
deemed a public nuisance. Any person who is in violation of this Section shall immediately
remove the obstruction, fill the excavation or otherwise comply with the Section upon demand
by the city; upon failure to do so, the violator shall pay the costs incurred by the city in
connection with its removal.
Subd. 10. Condition. Before granting any permit under any of the provisions of this
section, the council may impose such insurance or bonding conditions thereon as it, considering
the projected danger to public or private property or to persons, deems proper for safeguarding
such persons and property. Such insurance or bond shall also protect the city from any suit,
action or cause of action arising by reason of such obstruction.
Section 2. Eagan City Code Chapter 1 entitled "General Provisions and Definitions
Applicable to the Entire City Code Including 'Penalty for Violation "' and Section 7.99, entitled
"Violation a Misdemeanor" are hereby adopted in their entirety by reference as though repeated
verbatim.

granted written permission from the City. This paragraph shall not apply to operable and
registered motor vehicles lawfully parked within any designated public parking area, provided
the motor vehicle is not blocking any portion of a sidewalk or trail.
Subd. 2. Fires. Except where authorized in this Code, it is unlawful for any person to
build or maintain a fire upon public property.
Subd. 3. Dumping on public property. It is unlawful for any person to throw, deposit,
place or cause to be placed on public property any household furnishings, appliances or parts or
components thereof, vehicle parts or components, construction debris, dirt, earth, yard waste,
garbage, refuse, kitchen waste, recyclables or other similar substances, sewage, petroleum
products, antifreeze; including fluids leaking from vehicles, or to any water or other fluids
thereon. Refuse and recyclables generated during the proper use of a public property facility and
properly disposed of in designated refuse or recyclable receptacles at the same location is not a
violation of this subdivision.
Subd. 4. Signs and other structures. It is unlawful for any person to place or maintain a
sign, advertisement, or other structure on public property without first having obtained a written
pen-nit from the council.
Subd. S. Snox, or ice on public property. It is unlawful for any person not acting under a
contract with the city to dump snow or ice on public property.
Subd. 6. Continuing violation. Each day that any person continues in violation of this
section shall be a separate offense and punishable as such.

AGREEMENT FOR 3850 CEDAR GROVE PARKWAY
ACTION TO BE CONSIDERED: To approve purchase agreement in a final form acceptable
to the City Attorney for property located at 3850 Cedar Grove Parkway for redevelopment
purposes and to authorize the EDA President and Executive Director to execute the related
documents.
FACTS:
• The property at 3850 Cedar Grove Parkway is located within the Cedar Grove
Redevelopment District abutting Woodhaven Park and across the street from the Cedarvale
Bowl and Lincoln Place. It is currently occupied by a single family home in poor repair. It
was previously a country school house and a professional office.
• The site comprises .84 acres and is guided and zoned to permit medium density residential
uses under the Cedar Grove Zoning District.
• In November, staff was approached by a broker representing the lender that had reacquired
the property through foreclosure asking if the EDA would consider a purchase for
redevelopment purposes. On December 7, 2010, the EDA directed staff and the City
Attorney to make an offer for purchase.
• An agreement has been reached pending EDA approval for the purchase of the property for
$95,000.
• The agreement has been reviewed by staff and the City Attorney and is in order for
consideration. If the EDA has questions related to the agreement or negotiations, it would be
appropriate to recess to executive session to address them. Otherwise it can be acted on at
this time.
