A Listening Session was held at 6:00 p.m. prior to the regular City Council meeting. Present were Mayor
Maguire, Councilmembers Bakken, Fields, Hansen and Tilley. There were no visitors who wished to be
heard.
A regular meeting of the Eagan City Council was held on Tuesday, January 18, 2011 at 6:30 p.m. at the
Eagan Municipal Center. Present were Mayor Maguire, Councilmembers Bakken, Hansen, Fields and
Tilley. Also present were City Administrator Tom Hedges,

EASEMENT VACATION
City Administrator Hedges introduced this item regarding the vacation of public drainage and utility
easement on Lots 1 & 4, Block 1, Eagandale Center Industrial Park No. 7. Public Works Director Colbert
provided an overview on the property located at 2855 Eagandale Blvd., Factory Motor Parts, along with a
description of the easements to be vacated.
Mayor Maguire opened the public hearing. There being no comments, he turned the discussion to the
City Council.
Councilmember Tilley moved, Councilmember Fields seconded a motion to approve the vacation of
public drainage & utility easement on Lots 1 & 4, Block 1, Eagandale Center Industrial Park No. 7 as
presented and authorized the execution of all related documents. Aye: 5 Nay: 0
CITY ORGANIZATIONAL BUSINESS
City Administrator Hedges explained that organizational business is considered at the second regular City
Council meeting in January. The following items were acted on:

FACTS:
• The Eastview Hockey Association has applied for a premise permit to conduct a pull -tab
operation at Caspers Cherokee Sirloin Room, 4625 Nicols Road.
• The pull -tab operation at Caspers was previously operated by the Eagan Hockey
Association.
• The Police Department conducted a background investigation and found no reason to
deny the application.
• All requirements have been met and staff deems the application in order for approval.

GAMBLING CONTROL BOARD PREMISE PERMIT
FOR EASTVIEW HOCKEY ASSOCIATION
ON CASPERS CHEROKEE SIRLOIN ROOM PREMISES
WHEREAS, the Eastview Hockey Association has applied for a Gambling
Control Board premise permit for a pulltab operation at Caspers Cherokee Sirloin Room,
located at 4625 Nicols Road; and
WHEREAS, the Eagan Police Department has reviewed the application and has
not identified any reason to deny; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of Eagan,
Dakota County, Minnesota, hereby approves the Eastview Hockey Association's
application for a premise permit to conduct a pulltab operation at the Caspers Cherokee
Sirloin Room.

CONSENT AGENDA:
G. DECLARE 1988 FIRE ENGINE SURPLUS AND AUTHORIZE ITS SALE
ACTION TO BE CONSIDERED:
Declare 1988 Fire Engine surplus and authorize its sale.
FACTS:
• Unit 1220 is a 1988 Peterbilt fire engine that has been in service with the City
of Eagan for 23 years.
• Typically fire engines are designated for replacement after 20 years of service.
• Unit 1220 is designated to be replaced with 2011 fire apparatus CIP
replacement funds.
• Staff will advertise the truck for sale by sealed bids through the League of
Minnesota Cities and other free fire apparatus sites.
• Due to the age of the apparatus, its current condition and limited water tank
(this truck has a 500 gallon water tank, most rural departments want at least
1,000 gallons of water) staff is recommending a minimum bid amount of
$20,000.

H. DECLARE FIRE STATION #2 SURPLUS PROPERTY
ACTION TO BE CONSIDERED: To declare Fire Station #2 at 2980 Lone Oak Circle
to be surplus property to permit its sale for private use.
FACTS:
➢ As the City prepares to relocate the functions currently housed at Fire Station #2 to
the new Fire Safety Facility, it is taking steps to allow it to be marketed. On January
18, 2011, the City Council approved a Comprehensive Guide Plan Amendment and
rezoning of the property from Public Facilities to Limited Industrial to permit it to be
sold and used privately.
➢ In order to sell City -owned real property under state law, it is necessary for the
Advisory Planning Commission to take action to make findings that the prospective
use of the property is consistent with the Comprehensive Plan.
➢ At the direction of the City Council the APC considered this matter at its meeting of
January 25 and made the finding that 1 -1 uses would be consistent. It is now in order
for the City Council to declare the property to be surplus.
➢ Upon approval, staff will proceed with signage and marketing materials for
disposition of the building.

I. CONTRACT 11 -01, CITYWIDE STREET IMPROVEMENTS
ACTION TO BE CONSIDERED: Approve the plans and specifications for Contract 11 -01
(Citywide Street Improvements) and authorize the advertisement for a bid opening to be held at
10:30 a.m. on Thursday, March 10, 2011.
FACTS:
• Contract 11 -01 provides for the street improvements of:
o Park Knoll Addition (City Project 1021)
o Wilderness Ponds Addition (Project 1039)
o Fairway Hills Addition (Project 1040)
o Clearview Addition (Project 1044)
o Galaxie/ Cliff Plaza (Plaza Drive) (Project 1045)
o Blue Cross Road (Project 1048)
o Wilderness Run Road (Project 1049)
as outlined and discussed in the respective feasibility reports for each project.
• On December 21, 2010, the City Council held public hearings for Projects 1044, 1048 &
1049. After public testimony on Projects 1048 and 1049, the Council approved the projects
and authorized preparation of detailed plans and specifications for the 2011 construction
season.
• On January 4, 2011, the City Council held public hearings for Projects 1021, 1039, 1040 &
1045. After public testimony on Project 1040, the Council also approved the projects and
authorized preparation of detailed plans and specifications for 2011 construction.
• These projects are being combined under one contract for economies of scale in the
competitive bidding process. The plans and specifications have been completed by the City
Engineer and are being presented to the City Council for their approval and authorization for
the advertisement of bids.
• Minnesota state law allows local agencies to choose a procurement system, termed Best
Value Contracting (BVC), as an alternative to the standard low -bid contracting system. The
law was advocated by a coalition of labor organizations and requires two factors to be
considered during the BVC procurement process: price and performance.
• BVC uses the relationship between performance and price to achieve the best overall value
and lowest long -term cost for government construction projects.
• On March 18, 2008, the City Council adopted, as practice, the Best Value Contracting
method for the procurement system of public improvement projects for the City.
• The BVC method of procurement has been successfully used for numerous previous street &
utility improvement contracts since 2008.
• The BVC method of procurement will be used for this contract, and will be advertised in the
solicitation of these bids. All bids will be evaluated in an open and competitive manner.

ENGINEERING, RIGHT OF WAY ACQUISITION & CONSTRUCTION AGREEMENT
• ACTION TO BE CONSIDERED: Approve an Agreement for Engineering, Right of Way
Acquisition and Highway Construction for Project 1050, Cliff Road/ Johnny Cake Ridge Road
(Intersection & Traffic Signal Reconfiguration), Cliff Road/ Nicols Road (Intersection & Traffic
Signal Reconfiguration), and Cliff Road, Nicols Road to Cinnamon Ridge Trail (Trail Improvements)
with Dakota County and authorize the Mayor and Deputy City Clerk to execute all related documents.
FACTS:
• On June 1, 2010, the City Council authorized staff to initiate the public improvement process for the
upgrade of two intersections with Cliff Road (County State Aid Highway 32), at Johnny Cake Ridge
Road and Nicols Road, as well as trail improvements on Cliff Road between Nicols Road and
Cinnamon Ridge Trail in southwestern Eagan.
• Reconfiguration of the intersections, including traffic signal modifications, for the two intersections
and the new trail segment along the north side of Cliff Road are programmed for 2011 in the City of
Eagan's 5 -Year CIP (2011- 2015).
• Also included in the proposed improvements are the installation of audio pedestrian signals (APS) at
Cliff Road and Slater Road and at Cliff Road and the Trunk Highway (TH) 77 ramps and installation
of conduit for future fiber optic cable to connect signal systems along Cliff Road from Slater Road to
Pilot Knob Road. All of these improvements have been merged into Project 1050 to achieve an
economy of scale benefit in design, right of way acquisition and construction costs.
• An agreement between the City of Eagan and the Dakota County Transportation Department has been
prepared providing for each agency's cost responsibility for the engineering, right of way acquisition
and construction. As set forth in the agreement, the City's financial responsibility for the engineering
costs will be based on the City's share of the final construction costs.
• The City will be responsible for 45% of any needed right of way acquisition for the construction of
the improvements. The City will be responsible for 45% of the construction costs for the
reconstruction of the intersection of Cliff Road and Nicols Road, the reconstruction of the intersection
of Cliff Road and Johnny Cake Ridge Road, and the construction of a bituminous trail along Cliff
Road from Cinnamon Ridge Trail to Nicols Road.
• The City will be responsible for 50% of the construction costs for the signal improvements at Cliff
Road and Nicols Road and at Cliff Road and Johnny Cake Ridge Road, as well as 50% of the costs to
retrofit the audible pedestrian signals at Cliff Road and Slater Road and the TH 77 ramps.
• The cost to install the cables for the signal interconnect shall be shared in the amount of 50% by the
County and 50% by the City.
• Public Works staff and the City Attorney's office have reviewed this agreement and found it to be
similar to other previous construction project agreements and in order for favorable Council action.

K. PROJECT 971, DUCKWOOD DRIVE OVERPASS
EASEMENT ACQUISITION
ACTION TO BE CONSIDERED: Approve an Easement Agreement for Project 971
(Duckwood Drive — Bridge and Street Improvements) with the owner of PIN 10- 26500-
010-01 and authorize the Mayor and Deputy City Clerk to execute all related documents.
FACTS:
• On March 16, 2010, the City Council amended the Part III 5 -Year Capital
Improvement Program (2010 -2014) to incorporate the placement of Contract 09 -18
(Duckwood Drive /Federal Drive - Bridge /Street Improvements) in 2011. The
improvement includes the construction of the Duckwood Drive Overpass and
associated street improvements.
• The construction of an overpass for Duckwood Drive requires the acquisition of
permanent and temporary easements from a number of impacted properties.
• Appraisals have been obtained for all required easements. The estimated value of the
permanent easement for the referenced property indicated a value of $11,400 (Tires
Plus). An offer was accordingly forwarded to the legal representative of the property.
The representative has accepted the City's offer.
• An agreement between the City of Eagan and the owner of Lot 1, Block 1, First
Minnehaha Addition (Property Identification Number 10- 26500- 010 -01) has been
prepared providing for the acquisition cost for the necessary easement.
• Engineering staff and the City Attorney's office have reviewed the agreement and
found it to be in order for favorable Council action.
ISSUES:
• If the City Council would desire to discuss this item, it would be appropriate to direct
any discussion to a Closed Session due to the pending litigation status of this
easement acquisition.

L. NO PARKING DESIGNATION ON BLUE CROSS ROAD
ACTION TO BE CONSIDERED: Approve a resolution to prohibit parking on both
sides of Blue Cross Road from Blackhawk Road to Yankee Doodle Road (CSAH 28) and
authorize the Mayor and Deputy City Clerk to execute all related documents.
FACTS:
• On December 21, 2010, the City Council approved Project 1048 including street
improvements to Blue Cross Road and authorized the preparation of detailed plans
and specifications.
• As a designated Municipal State Aid route, it is desirable for the City to obtain the
use of State Aid funding to reimburse the construction costs of the proposed
improvements.
• Since 1994, and prior to Blue Cross Road being designated as a Municipal State Aid
route, parking has been prohibited along the entire length of Blue Cross Road, except
in an area near the main entrance to the Blue Cross/ Blue Shield MN campus (3535
Blue Cross Road), where parking is prohibited 6 A.M. to 6 P.M.
• This proposed resolution for no parking on Blue Cross Road would be consistent with
the current no parking prohibitions along a majority of the roadway, and would
further prohibit parking in the current 6 A.M. to 6 P.M. area to 24 hours.
• This resolution has been reviewed with representatives of adjacent business
properties, and the City Police and Parks/ Recreation Departments. No objections or
issues were raised.

STREET & UTILITY IMPROVEMENTS
ACTION TO BE CONSIDERED: Receive the Draft Feasibility Report for Project
1051, (Cedar Grove Boulevard - Street and Utility Improvements) and schedule a public
presentation to be held on February 10, 2011.
FACTS:
• On June 1, 2010, the City Council directed staff to prepare a feasibility report
considering the realignment of Cedarvale Boulevard within the Cedar Grove
Redevelopment Area in northwest Eagan.
• On September 17, 2010, the Department of Employment and Economic Development
(DEED) awarded the City of Eagan $559,986 as a redevelopment grant for assistance
with infrastructure improvements within the Cedar Grove Redevelopment Area,
specifically the upgrade and realignment of Cedarvale Boulevard (to be renamed
Cedar Grove Boulevard) to correspond with conceptual layout of the core
development area.
• The upgrade of Cedarvale Boulevard, formerly Sibley Memorial Highway, is
programmed for 2011 in the City of Eagan's 5 -Year CIP (2011- 2015).
• The draft report includes the following:
• 3 Options of Street /ROW Typical Sections
• Recommended Full Improvements — Cedar Grove Boulevard (Silver Bell Road to
Nicols Road /Carnelian Lane), includes trail on Cedar Grove Pkwy, all streetscaping,
ponding and all relevant utility improvements — Cost Estimate $3.86 million
• • Recommended 1 st Phase (Grant funds + City Obligation) - Cedar Grove
Boulevard (Silver Bell Road west as far as can go), includes minimum ponding &
relevant utility improvements, as well as connection to Cedar Grove Pkwy — Cost
Estimate $1.18 million
• • Suggested Future Phases - Cedar Grove Boulevard (West of 1 st Phase), includes
trail on Cedar Grove Pkwy, all streetscaping, remaining ponding and relevant utility
improvements — Cost Estimate $2.7+ million
• An informational neighborhood meeting with the adjacent property owners prior to
further consideration of a construction project would review and discuss the proposed
improvements.
• A draft of this Feasibility Report has been prepared and is being presented to the
Council for their consideration of scheduling a public presentation for Thursday,
February 10, 2011.

DRAINAGE & UTILITY EASEMENT VACATION
ACTION TO BE CONSIDERED: Receive the petition to vacate public drainage &
utility easement on Lot 10, Block 1, The Woodlands, and schedule a public hearing to be
held on March 1, 2011.
FACTS:
• On January 19, 2011, City staff received a petition from William Morrissey, treasurer
of the Woodlands Homeowners Association, representing the property owners of
3798 Briarwood Lane (Lot 10, Block 1 The Woodlands) requesting the vacation of a
portion of public drainage & utility easement within that property.
• The easement is a standard common lot line drainage and utility easement dedicated
with The Woodlands plat. There are not any existing public utility lines near the
portion of easement for which the vacation has been requested.
• The applicant is requesting the vacation to install a neighborhood identification sign.
• Notices will be published in the legal papers and sent to all potentially affected and/or
interested parties for comment prior to the scheduled public hearing.

O. CONTRACT 11 -03, WATER RESERVOIR RECONDITIONING
(DEERWOOD)
ACTION TO BE CONSIDERED: Approve the Plans and Specifications for Contract
11 -03 (Deerwood Water Reservoir Reconditioning) and authorize the advertisement for a
bid opening to be held at 10:30 a.m., Thursday, February 24, 2011.
FACTS:
• The Deerwood Water reservoir is a 4 million gallon water storage tank providing
reserve capacity and sustainable pressure for the City's water distribution system.
This reservoir was originally built in 1995 and now requires a full interior and
exterior reconditioning and repainting.
• In 2006, all City reservoirs were thoroughly inspected inside and out. A condition
rating was performed with required and recommended improvements
documented. These improvements were then integrated into the Public Works
Department Capital Improvement Program (CIP) for efficient and economical
scheduling. This tank was programmed for 2010 in the 5yr CIP approved by
Council on June 2, 2009. It was subsequently included in the 2010 Utility
Enterprise Operating Budget approved by Council on December 15, 2009.
However, the solicitation process for a new consultant combined with unfavorable
fall weather conditions resulted in having to delay this project to the 2011 season.
• Because this reservoir is critical to maintaining the City's water distribution
system, and the seasonally constrained repainting associated with the overall
refurbishment conflicts with the City's peak water use periods, this reservoir has
to be taken out of service either in late spring or early fall. The contract is set up
to solicit a bid for each season. Also, this reservoir has numerous wireless
communication antennae attached to them requiring close coordination with these
leased tenants for their removal and reinstallation.

-SOUTH WATER TREATMENT PLANT
ACTION TO BE CONSIDERED: Approve Change Order #2 for Contract 10 -10
(South Water Treatment Plant) and authorize the Mayor and Deputy City Clerk to
execute all related documents.
FACTS:
• Contract 10 -10 provides for the upgrade and rehabilitation of the south water
treatment facility originally constructed in 1990 at the intersection of Pilot Knob
Road and Cliff Road. The project consists of the following: restoration of the
building's interior; modification of the water treatment process and related equipment;
energy efficiency and waste reduction upgrades to the building envelope, HVAC
system, electrical /lighting system, computer /automated operational controls and water
treatment process equipment; surface treatment/protection (painting); worker safety
enhancements; work station upgrades; chemical storage area modifications; regulated
substance control; and security system enhancements, as programmed in the CIP and
approved by the City Council on June 2, 2009, and June 1, 2010 (respectively).
• This treatment plant consists of 2 filter bays with each containing 4 filter cells.
During the draining of the filter bays and related disassembly, repair, replacement
and /or refurbishment of many of the control valves, it has been determined that the
backwash waste water control valves (total of 8) do not function properly and need to
be serviced and repaired. This work was not anticipated nor included in the original
contract specifications, but it would be most efficient and cost effective to perform
this work while the plant is out of service and the filter cells drained and dry.
• This Change Order would result in an ADD of $53,213.84 to the original contract
amount of $3,738,700 ( +1.4 %) and has been reviewed by the Public Works
Department and found to be in order for favorable consideration by the Council.

Q. CONTRACT 11 -07, RAIN GARDENS
SCHWANZ LAKE DIRECT DRAINAGE AREA
ACTION TO BE CONSIDERED: Approve the plans and specifications for Contract
No. 11 -07 (Rain Gardens - Schwartz Lake Direct Drainage /Kirsten Court) and authorize
the advertisement for a bid opening to be held at 10:30 a.m. on Thursday, March 3, 2011.
FACTS:
• Contract 11 -07 provides for the continuation of the rain garden improvements within
the nearly 30 acre direct drainage area north of Schwanz Lake that began in 2009
(City Contract 09 -14). Seven rain gardens will be constructed under this contract to
add to the 19 gardens already constructed in this neighborhood.
• Funding for construction in 2010 and 2011 is from: 1) a Clean Water Fund grant from
the Board of Water and Soil Resources through the Gun Club Lake Watershed
Management Organization and 2) the City of Eagan's Water Quality Capital
Improvement Program.
• The total of 26 rain gardens to be completed within the neighborhood are estimated to
reduce the neighborhood's runoff volumes by 65 %, total phosphorus by 72 %, and
total suspended solids by 84 %.
• All of the construction activity for said improvements has been designed to occur
within existing public right -of -way or easements.
• The plans and specifications have been completed and are being presented to the City
Council for their approval and authorization of the advertisement for bids.
• An advertisement will be published in the legal newspaper informing contractors of
the bid.

R. ACCEPT a grant from the Dakota County Public Health Department through
a program called Improving Environments for Active Living.
ACTION TO BE CONSIDERED:
Accept a grant of $22,000 from the Dakota County Public Health Department through a program
called Improving Environments for Active Living, authorize the Mayor and Deputy City Clerk to
execute all appropriate documents and authorize the change to the 2011 budget.
FACTS:
• The Dakota County Public Health Department (DCPHD) with funding from the
Statewide Health Improvement Program (SHIP), offered an opportunity for local
government agencies in Dakota County to apply for grants to create active communities
by increasing opportunities for non - motorized transportation and /or increasing access to
community recreation facilities.
• On November 16, 2010 the City Council took action to authorize the submission of a
grant application.
• Parks and Recreation staff was recently notified that the City of Eagan was awarded
funds not to exceed $22,000 to implement sustainable policy, environmental and systems
changes.
• The funds awarded are for bike racks at various city locations, way finding signs on
major park trails, incentive promotional items to encourage bike riding, bike education
and safety materials.
• Eagan was one of four (4) cities in Dakota County to receive funding during this grant
cycle. Other recipients were West St. Paul ($25,000), Rosemount ($10,500) and Hastings
($12,500).

ACTION TO BE CONSIDERED:
Adopt Resolution to approve a Premise Permit for the Eagan Hockey Association to conduct
lawful gambling at Al Baker's Restaurant, 3434 Washington Drive.
FACTS:
• The Eagan Hockey Association (EHA)has applied for a premise permit to conduct a pull -
tab operation at Al Baker's Restaurant, 3434 Washington Drive.
• The pull -tab operation at Al Baker's is currently operated by the Eagan Athletic
Association (EAA) however they are ceasing to operate in March.
• The EHA plans to contribute a portion of their proceeds to the EAA.
• The EHA also conducts gambling operations at Cooper's Restaurant, Ansari's and
Wildcats Bar & Grill.
• All requirements have been met and staff deems the application in order for approval.

located at 3434 Washington Drive;
WHEREAS, the Eagan Hockey Association has operated pull -tab operations in
the City of Eagan for several years, and;
NOW, THEREFORE, BE IT RESOLVED that the City Council of Eagan,
Dakota County, Minnesota, hereby approves the Eagan Hockey Association application
for a premise permit at Al Baker's Restaurant.

ACTION TO BE CONSIDERED: Approve Project 1041, Hills of Stonebridge 1St
Addition (Street Improvements) as presented and authorize the preparation of detailed
plans and specifications.
FACTS:
• Since 1990, the City has implemented a comprehensive Pavement Management
Program that provides timely pavement rehabilitation to our local streets, significantly
extending their overall life expectancy. During these past 21 years, the City has
rehabilitated approximately 161 miles of local streets.
• The resurfacing of the 2 miles of streets within the Hills of Stonebridge neighborhood
in east - central Eagan has been programmed for 2011 in the City's 5 -Year Capital
Improvement Program.
• On June 1, 2010 the City Council directed staff to prepare a feasibility report
considering a rehabilitation of these streets.
• On January 4, 2011, the feasibility report for Project 1041 was presented to the City
Council and a Public Hearing was scheduled for February 1 to formally present and
discuss the report with the adjacent property owners.
• An informational neighborhood meeting was held on January 24 for the adjacent
property owners to discuss the proposed improvements. Of the 223 total properties
(all single- family homes) proposed to be assessed under this improvement, eleven
residents representing eight properties attended the meeting.
• All notices have been published in the legal newspaper and sent to all affected
property owners informing them of this public hearing.

Introduction/ History
Streets - As a part of Eagan's Pavement Management Program, (PMP), the City evaluates
streets within the community throughout their life cycle and implements appropriate
maintenance strategies. In 1989, a Pavement Management System (PMS) was developed
that allowed the City to evaluate the condition of the existing pavement surface for all the
streets on a routine basis and schedule timely maintenance. A Five Year Capital
Improvement Program (CIP) for street rehabilitation is developed from this information.
The nearly 2 miles of residential Hills of Stonebridge neighborhood streets in east - central
Eagan are identified for 2011 revitalization improvements. Figure 1, located in Appendix C,
illustrates the project location. The streets in this residential neighborhood were
constructed in 1988.
Based on the data and engineering strategies available at this time, the City's current PMP
incorporates local and ongoing maintenance strategies with seal coating occurring as
needed (at 5 to 7 years, again at 12 to 14 years) with a bituminous overlay at
approximately 20+ years. Recycling or overlaying the roadway located within the project
area, which is presently at the 20+ year time frame, will prevent further decay of the
pavement surface, thus protecting and extending the structural life of the streets.
Timely maintenance work, such as bituminous patching, crack sealing and seal coating have
occurred at appropriate intervals during the life of the pavement in the area.
The City of Eagan's maintenance records indicate that these streets were seal coated in
1993 and 2002.

The Public Works maintenance program typically includes extensive patching and crack
sealing during the summer prior to the overlay. The Public Works crews, as part of the
Preparatory Pavement Management Plan, removed and replaced deteriorated pavement
areas and placed leveling and maintenance overlays on portions of the streets under
consideration, where necessary. These repairs alone will not substantially extend the life
expectancy of the street section if not combined with the bituminous recycling and overlay
proposed with this project.
The Public Works Department has also inspected the utility infrastructure (sanitary sewer,
water main, and storm sewer) in the project area and determined the system is in good
working order and that no major repairs are necessary.
Scope
This project will provide resurfacing (edge mill and overlay) for approximately 2 miles of
roadway. Figure 2, in Appendix C, illustrates the project limits.
Included in this project are the following improvements; replacement of damaged curb and
gutter, adjustments and /or replacement to sanitary /storm sewer utility castings, water
gate valves, and street signage.
Feasibility and Recommendations
The mill and overlay project is necessary to maintain and enhance the structural integrity
of the pavement section, create a safer driving surface, and increase ride ability.
The mill and overlay project is cost effective in that the proposed improvement
(resurfacing) is considerably less expensive than complete reconstruction of this street.
The mill and overlay is feasible in that this type of improvement has been used successfully
to extend the life expectancy of numerous other streets throughout the City and the
region.
This project is in accordance with the Five Year Capital Improvement Plan (2011— 2015) for
the City of Eagan and the schedule as outlined in the Pavement Management Program. It is

recommended that the project be constructed as proposed in this report in combination
with other similar projects in the area.
Street Evaluation
The City of Eagan's Pavement Management System allows the City to evaluate the
condition of the existing street surface to help schedule timely maintenance and
improvements. The Pavement Condition Index (PCI) ranks the surface condition for each
street. The general categories that define PCI rankings are as follows:

The 2010 PCI rankings for the street segments in Hills of Stonebridge have a weighted
average pavement condition rating of 42 for Hills of Stonebridge, which falls in the rankings
of the "Patch/ Repair and /or Overlay" category. The street pavement has reached an age
where, based on the City's past experience, the integrity of the pavement can rapidly
decline if no improvements are performed. Therefore, the 2011 construction season is the
optimal time to construct the bituminous overlay on this street. Any delay of the project
may reduce the structural benefit to the street sections and require full reconstruction.
Proposed Improvements
Pavement - The proposed street
improvements for Hills of Stonebridge
are shown in Figure 3. The existing
street section for this roadway consists
of 3" bituminous pavement supported
by 6" gravel base. The existing
bituminous surface will be milled

adjacent to the existing curb and gutter (6' -8' wide) to accommodate a 1% -inch bituminous
overlay. The overlay, combined with the existing street section, will provide a street section
consistent with current City standards for residential streets. The combination of patching
and overlay will not eliminate cracking due to the temperature extremes experienced in
Minnesota. Bituminous overlays will show some continued frost movements and reflective
cracking consistent with the underlying pavement. Routine maintenance will still need to
continue under the City's Pavement Management Program.
Concrete Curb & Gutter - Damaged
curb & gutter will be replaced if
severely cracked, spalled, or settled. It
is estimated that approximately 13% of
the existing concrete curb and gutter
will have to be replaced. Boulevard turf
will be removed and replaced. While
the contractor who performs the work
is responsible for its establishment in
the first 30 days after placement, adjacent property owners are encouraged to consistently
water the new turf, where possible, to help ensure its growth.
Sidewalk /Path & Pedestrian Ramp —
Revisions to the Americans with Disabilities
Act (ADA) requires jurisdictional agencies to
provide detectable warnings at all existing
pedestrian ramps of sidewalks and paths
with public streets that are improved,
including street surface improvements. The
most common method of providing this
detectable warning is through the installation of truncated domes a minimum of two feet
in length across the width of all pedestrian ramps. This project provides for the installation
of truncated dome pedestrian ramps along the existing trail along Northview Park Road.

Signage - All traffic control and street identification signage within the project limits will be
replaced due to diminished reflectivity, deteriorated support posts, and the signs or posts
no longer meeting City and State standards.
Easement /Permits
All work will be in the public right -of -way. No additional easements will be necessary. It is
anticipated that no permits will be required for the resurfacing project.
Cost Estimate
Detailed cost estimates are located in Appendix A. The estimates are based on anticipated
2011 construction costs and include a 5% contingency and indirect cost of 30 %, which
include legal, administration, engineering, and bond interest. A summary of the costs is as

Assessments
Assessments are proposed to be levied against the benefited properties for the total
improvement with costs allocated in accordance with the City of Eagan's Special
Assessment Policy for a mill and overlay improvement for residential streets. All
assessments will be revised based on final costs. A preliminary assessment roll is included
in Appendix B.

All residential lots (223 total single - family residential lots), as shown on Figures 2A -2D and
having driveway access on to the street to be improved, are proposed to be assessed. The
City's Assessment Policy states that 50% of the mill and overlay costs are assessable for
local residential streets, based on a standard 32 -foot width. The estimated cost per single -
family lot to be assessed based on the City Assessment Policy is $865/lot and is calculated
as follows:

Assessment Financine Options
The property owner will have the option at the time of the assessment hearing to pay the
full assessment or include the assessment in with their property tax statement. If the
assessment is included with the property tax statement, the assessment will be spread
over five years with the interest determined by the results of the bond sale used to finance
the improvements. The following payment schedule is an example of the estimated $865
assessment with an estimated 5.0% interest for the assessed amounts:

A. Presentation of Project Details
• Gorder welcomed the property owners and presented project information, including
details such as construction, costs, schedule and assessments.
B. Questions/ Comments
• Have previous projects like this one been delayed? Only for reasons of coordinating
with other nearby improvements, which is not the case in this project. The street
pavements in the neighborhood have reached an age where, based on the City's past
experience, the integrity of the pavement can rapidly decline if no improvements are
performed. The overall pavement condition is 42 on a condition scale of 1 -100, a
condition where a mill & overlay is the best rehabilitation method to preserve the
integrity and extend the life of the existing pavement.
• Will we have access to our properties? The edge mill & overlay construction will
provide a hard surface for vehicles at all times during the project. There may some
limited access for short periods of time during curb replacement and manhole adjustment.
Access to some driveways will also be limited if curb replacement is adjacent to
driveways. Room for on- street parking will be provided while new curb in front of
driveways cures, or hardens.
• How will construction affect graduation parties planned for June? Since a majority
of the street improvement projects are within mostly residential areas, it is anticipated
that there would be graduation parties around the time of construction. It is specified in
the contracts, and past contractors have worked well in this regard, to have the streets
cleaned up and suitable for party parking, if not completely finished, by the dates of the
parties in mid -June.

STREET IMPROVEMENTS
ACTION TO BE CONSIDERED: Approve Project 1042, Bridle Ridge Addition (Street
Improvements) as presented and authorize the preparation of detailed plans and
specifications.
FACTS:
• Since 1990, the City has implemented a comprehensive Pavement Management
Program that provides timely pavement rehabilitation to our local streets, significantly
extending their overall life expectancy. During these past 21 years, the City has
rehabilitated approximately 161 miles of local streets.
• The resurfacing of the 1.5 miles of streets within the Bridle Ridge neighborhood in
east - central Eagan has been programmed for 2011 in the City's 5 -Year Capital
Improvement Program.
• On June 1, 2010 the City Council directed staff to prepare a feasibility report
considering a rehabilitation of these streets.
• On January 4, 2011, the feasibility report for Project 1042 was presented to the City
Council and a Public Hearing was scheduled for February 1 to formally present and
discuss the report with the adjacent property owners.
• An informational neighborhood meeting was held on January 24 for the adjacent
property owners to discuss the proposed improvements. Of the 202 total properties
(all single - family homes) proposed to be assessed under this improvement, seven
residents representing five properties attended the meeting.
• City staff also received a letter from Mr. Jim Sorenson, 691 Bridle Ridge Road,
regarding the proposed project and the associated assessments.
• All notices have been published in the legal newspaper and sent to all affected
property owners informing them of this public hearing.

Introduction/ History
Streets - As a part of Eagan's Pavement Management Program, (PMP), the City evaluates
streets within the community throughout their life cycle and implements appropriate
maintenance strategies. In 1989, a Pavement Management System (PMS) was developed that
allowed the City to evaluate the condition of the existing pavement surface for all the streets on
a routine basis and schedule timely maintenance. A Five Year Capital Improvement Program
(CIP) for street rehabilitation is developed from this information.
The nearly 1.5 miles of Bridle Ridge 1St Addition residential /neighborhood streets in east - central
Eagan is identified for the 2011 street revitalization improvements. Figure 1, located in
Appendix C, illustrates the project location. The streets in this residential neighborhood were
constructed in 1987.
Based on the data and engineering strategies available at this time, the City's current PMP
incorporates local and ongoing maintenance strategies with seal coating occurring as needed
(at 5 to 7 years, again at 12 to 14 years) with a bituminous overlay at approximately 20+ years.
Recycling or overlaying the roadway located within the project area, which is presently near the
25 year time frame, will prevent further decay of the pavement surface, thus protecting and
extending the structural life of the streets.
Timely maintenance work, such as bituminous patching, crack sealing and seal coating have
occurred at appropriate intervals during the life of the pavement in the area.
The City of Eagan's maintenance records indicate that these streets were seal coated in 1992
and 2002.

The Public Works maintenance program typically includes extensive patching and crack sealing
during the summer prior to the overlay. The Public Works crews, as part of the Preparatory
Pavement Management Plan, removed and replaced deteriorated pavement areas and placed
leveling and maintenance overlays on portions of the streets under consideration, where
necessary. These repairs alone will not substantially extend the life expectancy of the street
section if not combined with the bituminous recycling and overlay proposed with this project.
The Public Works Department has also inspected the utility infrastructure (sanitary sewer,
water main, and storm sewer) in the project area and determined the system is in good
working order and that no major repairs are necessary.
Scope
This project will provide resurfacing (edge mill and overlay) for approximately 1.5 miles of
roadway. Figure 2 in Appendix C, illustrates the project limits.
Included in this project are the following improvements; replacement of damaged curb and
gutter, adjustments and /or replacement to sanitary /storm sewer utility castings, water gate
valves, and street signage.
Feasibility and Recommendations
The mill and overlay project is necessary to maintain and enhance the structural integrity of the
pavement section, create a safer driving surface, increase ride ability.
The mill and overlay is cost effective in that the proposed improvement (resurfacing) is
considerably less expensive than complete reconstruction of this street.
The mill and overlay is feasible in that this type of improvement has been used successfully to
extend the life expectancy of numerous other streets throughout the City and the region.
This project is in accordance with the Five Year Capital Improvement Plan (2011— 2015) for the
City of Eagan and the schedule as outlined in the Pavement Management Program. It is
recommended that the project be constructed as proposed in this report in combination with
other similar projects in the area.

Street Evaluation
The City of Eagan's Pavement Management System allows the City to evaluate the condition of
the existing street surface to help schedule timely maintenance and improvements. The
Pavement Condition Index (PCI) ranks the surface condition for each street. The general
categories that define PCI rankings are as follows:

The 2010 PCI rankings for the street segments in Bridle Ridge 1 St Addition have a weighted
average pavement condition rating of 47, which falls in the rankings of the "Patch /Repair
and /or Overlay" category. The street pavement has reached an age where, based on the City's
past experience, the integrity of the pavement can rapidly decline if no improvements are
performed. Therefore, the 2011 construction season is the optimal time to construct the
bituminous overlay on this street. Any delay of the project may reduce the structural benefit to
the street sections and require full reconstruction.
Proposed Improvements
Pavement - The proposed street
improvements for Bridle Ridge 1St
Addition are shown in Figure 3. The
existing street section for this roadway
consists of 3" bituminous pavement
supported by 6" gravel base. The existing
bituminous surface will be milled adjacent
to the existing curb and gutter (6' -8' wide)
to accommodate a 1% -inch bituminous
overlay. The overlay, combined with the

existing street section, will provide a street section consistent with current City standards for
residential streets. The combination of patching and overlay will not eliminate cracking due to
the temperature extremes experienced in Minnesota. Bituminous overlays will show some
continued frost movements and reflective cracking consistent with the underlying pavement.
Routine maintenance will still need to continue under the City's Pavement Management
Program.
Concrete Curb & Gutter - Damaged curb & gutter will be replaced if severely cracked, spalled,
or settled. It is estimated that approximately
17% of the existing concrete curb and gutter
will have to be replaced. Boulevard turf will be
removed and replaced. While the contractor
who performs the work is responsible for its
establishment in the first 30 days after
placement, adjacent property owners are
encouraged to consistently water the new turf,
where possible, to help ensure its growth.
Sidewalk /Path & Pedestrian Ramp — Revisions to the Americans with Disabilities Act (ADA)
requires jurisdictional agencies to provide detectable warnings at all existing pedestrian ramps
of sidewalks and paths with public streets that
are improved, including street surface
improvements. The most common method of
providing this detectable warning is through the
installation of truncated domes a minimum of
two feet in length across the width of all
pedestrian ramps. This project provides for the
installation of truncated dome pedestrian ramps
along the existing trail.

Signage - All traffic control and street identification signage within the project limits will be
replaced due to diminished reflectivity, deteriorated support posts, and the signs or posts no
longer meeting City and State standards.
Easement /Permits
All work will be in the public right -of -way. No additional easements will be necessary. It is
anticipated that no permits will be required for the resurfacing project.
Cost Estimate
Detailed cost estimates are located in Appendix A. The estimates are based on anticipated
2011 construction costs and include a 5% contingency and indirect cost of 30 %, which include
legal, administration, engineering, and bond interest. A summary of the costs is as follows:

A. Presentation of Project Details
• Gorder welcomed the property owners and presented project information, including
details such as construction, costs, schedule and assessments.
B. Questions/ Comments
• Will we have access to our properties? The edge mill & overlay construction will
provide a hard surface for vehicles at all times during the project. There may some
limited access for short periods of time during curb replacement and manhole adjustment.
Access to some driveways will also be limited if curb replacement is adjacent to
driveways. Room for on- street parking will be provided while new curb in front of
driveways cures, or hardens.
• How long will this street improvement last? The wear and tear of the house
construction traffic is essentially done. The combination of the structural strength of the
new overlay pavement, along with less wear and tear from traffic, should extend the
pavement life another 20 years.
• There should be a discount for paying the assessment within 30 days of assessment.
The City does not have a policy for providing a discount for payment within 30 days of
the assessment public hearing. The "credit" given is that the property owner is not
charged interest on the assessment if paid within 30 days.
• Will the sealcoating still be needed after the project? Routine maintenance will still
need to continue under the City's Pavement Management Program, including sealcoating
every 5 to 7 years to prevent pavement oxidation.

ACTION TO BE CONSIDERED: Approve Project 1043, Blackhawk Pond Addition
(Street Improvements) as presented and authorize the preparation of detailed plans and
specifications.
FACTS:
• Since 1990, the City has implemented a comprehensive Pavement Management
Program that provides timely pavement rehabilitation to our local streets, significantly
extending their overall life expectancy. During these past 21 years, the City has
rehabilitated approximately 161 miles of local streets.
• The resurfacing of the '/2 mile of streets within the Blackhawk Pond neighborhood in
east - central Eagan has been programmed for 2011 in the City's 5 -Year Capital
Improvement Program.
• On June 1, 2010, the City Council directed staff to prepare a feasibility report
considering a rehabilitation of these streets.
• On January 4, 2011, the feasibility report for Project 1043 was presented to the City
Council and a Public Hearing was scheduled for February 1 to formally present and
discuss the report with the adjacent property owners.
• An informational neighborhood meeting was held on January 24 for the adjacent
property owners to discuss the proposed improvements. Of the 202 total properties
(all single - family homes) proposed to be assessed under this improvement, no one
attended the meeting.
• All notices have been published in the legal newspaper and sent to all affected
property owners informing them of this public hearing.

Introduction/ History
Streets - As a part of Eagan's Pavement Management Program, (PMP), the City evaluates
streets within the community throughout their life cycle and implements appropriate
maintenance strategies. In 1989, a Pavement Management System (PMS) was developed that
allowed the City to evaluate the condition of the existing pavement surface for all the streets on
a routine basis and schedule timely maintenance. A Five Year Capital Improvement Program
(CIP) for street rehabilitation is developed from this information.
The nearly 1/2 mile of Blackhawk Pond and Murphy Farm 2 nd Addition residential/
neighborhood streets in central Eagan is identified for the 2011 street revitalization
improvements. Figure 1, located in Appendix C, illustrates the project location. The streets in
this residential neighborhood were constructed in 1988.
Based on the data and engineering strategies available at this time, the City's current PMP
incorporates local and ongoing maintenance strategies with seal coating occurring as needed
(at 5 to 7 years, again at 12 to 14 years) with a bituminous overlay at approximately 20+ years.
Recycling or overlaying the roadway located within the project area, which is presently at the
20+ year time frame, will prevent further decay of the pavement surface, thus protecting and
extending the structural life of the streets.
Timely maintenance work, such as bituminous patching, crack sealing and seal coating have
occurred at appropriate intervals during the life of the pavement in the area.
The City of Eagan's maintenance records indicate that the streets in Blackhawk Ponds were seal
coated in 1995 and 2005.

The Public Works maintenance program typically includes extensive patching and crack sealing
during the summer prior to the overlay. The Public Works crews, as part of the Preparatory
Pavement Management Plan, removed and replaced deteriorated pavement areas and placed
leveling and maintenance overlays on portions of the streets under consideration, where
necessary. These repairs alone will not substantially extend the life expectancy of the street
section if not combined with the bituminous recycling and overlay proposed with this project.
The Public Works Department has also inspected the utility infrastructure (sanitary sewer,
water main, and storm sewer) in the project area and determined the system is in good
working order and that no major repairs are necessary.
Scope
This project will provide full depth recycling of the bituminous pavement for approximately
2,000 feet of roadway on Murphy Parkway and resurfacing (edge mill and overlay) for the
remaining 1,300 feet. Figures 2A & 2B in Appendix C, illustrate the project limits.
Included in this project are the following improvements; replacement of damaged curb and
gutter, adjustments and /or replacement to sanitary /storm sewer utility castings, water gate
valves, street signage, and pedestrian ramps.
Feasibility and Recommendations
The recycling and mill & overlay improvements are necessary to maintain and enhance the
structural integrity of the pavement section, create a safer driving surface, and increase vehicle
ride quality.
The project is cost effective in that the proposed improvements (recycling and resurfacing) are
considerably less expensive than complete reconstruction of the streets.
The mill & overlay/ reclaim & recycling are feasible in that these types of improvements have
been used successfully to extend the life expectancy of numerous other streets throughout the
City and the region.
This project is in accordance with the Five Year Capital Improvement Plan (2011— 2015) for the
City of Eagan and the schedule as outlined in the Pavement Management Program. It is

recommended that the project be constructed as proposed in this report in combination with
other similar projects in the area.
Street Evaluation
The City of Eagan's Pavement Management System allows the City to evaluate the condition of
the existing street surface to help schedule timely maintenance and improvements. The
Pavement Condition Index (PCI) ranks the surface condition for each street. The general
categories that define PCI rankings are as follows:

The 2010 PCI rankings for the street segments have an overall weighted average pavement
condition rating of 39. The southern portion of Blackhawk Road, from Deerwood Drive to the
Blackhawk Park entrance, has a pavement condition of 52, which falls in the rankings of the
"Patch /Repair and /or Overlay" category, due to the significant City maintenance performed.
The remainder of Murphy Parkway, from the entrance north to the cul -de -sac, has a pavement
condition of 26 to 30, which falls in the "Reconstruct/ Reclaim" category, due in large part to
the volume of construction traffic at time of build -out the 51 homes on a long cul -de -sac with
no other street outlet. The street pavements have reached an age and condition where, based
on the City's past experience, the integrity of the pavement can rapidly decline if no
improvements are performed. Therefore, the 2011 construction season is the optimal time to
recycle/ reclaim the northern portion of Murphy Parkway and construct the bituminous overlay
on its southern portion. Any delay of the project may reduce the structural benefit to the street
sections and require full reconstruction, including new gravel base.
Proposed Improvements
Pavement - The proposed street improvements are shown on Figure 3. The existing street
section for the streets (Murphy Parkway and Hawk Place) consist of 3" bituminous pavement
supported by 6" gravel base.

The existing pavement on Murphy Parkway has reached a condition that warrants replacement
for the northernmost 2,000 feet, from
Blackhawk Park entrance to the north. The
pavement will be recycled as gravel base,
with a new 3.5 -inch layer of bituminous
pavement placed over the recycled gravel
base. The existing bituminous surface, along
with 3 -inch of the existing gravel base will be
recycled (milled and replaced) to a depth of
approximately 6 inches. This recycled
material will be salvaged and used as a base
beneath. a new 2 -inch base course and a 1%-
inch wear course bituminous pavement. The
new pavement, combined with the recycled
material and existing street section, will
provide a street section consistent with
current City standards for a residential street.
The remaining 1,300 feet of existing
bituminous surface on Murphy Parkway
(Deerwood Drive to Blackhawk Park entrance) is proposed for standard edge mill & overlay
construction. The pavement in this area will be milled adjacent to the existing curb and gutter
(6' -8' wide adjacent to curbs) to accommodate a 1% -inch bituminous overlay. The overlay,
combined with the existing street section, will provide a street section consistent with current
City standards for residential neighborhood streets.
The combination of recycling, patching and overlay will not eliminate cracking due to the
temperature extremes experienced in Minnesota. Bituminous streets will show some continued
frost movements and reflective cracking consistent with the existing pavement, although
greatly reduced in the case of the recycling of Murphy Parkway. Routine maintenance will still
need to continue under the City's Pavement Management Program.

Concrete Curb & Gutter - Damaged curb & gutter will be replaced if severely cracked, spalled,
or settled. It is estimated that approximately 7% of the existing concrete curb and gutter will
have to be replaced. Boulevard turf will

consistently water the new turf, where
possible, to help ensure its growth.
Signage - All traffic control and street identification signage within the project limits will be
replaced due to diminished reflectivity, deteriorated support posts, and the signs or posts no
longer meeting City and State standards.
Sidewalk /Path & Pedestrian Ramp — Revisions to the Americans with Disabilities Act (ADA)
requires jurisdictional agencies to provide
detectable warnings at all existing pedestrian
ramps of sidewalks and paths with public streets
that are improved, including street surface
improvements. The most common method of
providing this detectable warning is through the
installation of truncated domes a minimum of
two feet in length across the width of all
pedestrian ramps. This project provides for the
installation of truncated dome pedestrian ramps along the existing trail intersections with
public streets.

Easement /Permits
All work will be in the public right -of -way. No additional easements will be necessary. It is
anticipated that no permits will be required for the resurfacing project.
Cost Estimate
Detailed cost estimates are located in Appendix A. The estimates are based on anticipated
2011 construction costs and include a 5% contingency and indirect cost of 30 %, which include
legal, administration, engineering, and bond interest. A summary of the costs is as follows:

Assessments
Assessments are proposed to be levied against the benefited properties for the total
improvement with costs allocated in accordance with the City of Eagan's Special Assessment
Policy for a mill and overlay improvement for residential streets. All assessments will be revised
based on final costs. A preliminary assessment roll is included in Appendix B.

ACTION TO BE CONSIDERED:
Approve Ordinance Amendment to City Code Chapter 10, Sect. 10.53, Subd. 4, relating
to Property Maintenance regulations.
REQUIRED VOTE FOR APPROVAL: Majority of Council Members Present
FACTS:
➢ Chapter 10 of the Eagan City Code sets forth property maintenance regulations. The
intention of this code section is to promote on -going maintenance for the purpose of
preserving the value of the City's neighborhoods and business areas.
➢ In reviewing responses to certain code enforcement efforts, it has been determined
that tweaking the maintenance language is necessary to avoid an unintended
consequence found with the strict application of the existing language.
➢ The City Council directed staff to prepare an amendment at the January 4, 2011, City
Council meeting.
➢ As an amendment to Chapter 10, a Public Hearing before the APC is not necessary
before the item comes back before the City Council.

SUMMARY OF REQUEST
To amend the Ordinance as it pertains to the Property Maintenance regulations.
AUTHORITY FOR REVIEW
City Code Chapter 11, Section 11.50, Subdivision 5 states, in part:
1. The provisions of this chapter may be amended by the majority vote of the council, except
that amendments changing the boundaries of any district or changing the regulations of any
district may only be made by an affirmative vote of two - thirds of all members of the council.
BACKGROUND /HISTORY
The City adopted exterior building material finish standards in 2006; however, the standards do
not apply to single family residential structures, nor do they address on -going maintenance of
exterior building materials. 441-M 3
Over the past year, City Staff has encountered
properties where the exterior finish material has
been repaired with a material that is not in
keeping with the requirements of the Minnesota
State Building Code and /or the building
materials ordinance. Additionally, staff has
determined that the quality of certain repairs
has been substandard.

This has resulted in certain circumstances where the letter of the ordinance may have been met
but the intent has not.
At their regular meeting on January 4, 2011, the City Council directed staff to prepare an
amendment relating to property maintenance regulations.
ANALYSIS
The resulting draft ordinance was designed to promote on -going maintenance for the purpose of
preserving the value and extending the life of the City's neighborhoods and business areas.
Draft ordinance language is attached that represents the modifications to the Ordinance as
proposed by the City Attorney's office.
ACTION TO BE CONSIDERED
To recommend approval of an Ordinance Amendment to Chapter 10 relative to Property
Maintenance regulations.

ORDINANCE NO. 2ND SERIES
AN ORDINANCE OF THE CITY OF EAGAN, MINNESOTA, AMENDING EAGAN CITY
CODE CHAPTER TEN ENTITLED "PUBLIC PROTECTION, CRIMES AND OFFENSES" BY
AMENDING SECTION 10.53 REGARDING BUILDING AND STRUCTURE SAFETY AND
APPEARANCE REGULATIONS; AND BY ADOPTING BY REFERENCE EAGAN CITY
CODE CHAPTER 1 AND SECTION 10.99.
The City Council of the City of Eagan does ordain:
Section 1 . Eagan City Code Chapter Ten is hereby amended by adding Section 10.53, Subd.
4, to read as follows:
Subd. 4. Workmanship Requirements. All maintenance and repairs shall be as such as to re-
establish the structure and/or property to its original safety, appearance and maintenance
standards.
Repairs, maintenance work, alterations or installations shall be executed and installed in
accordance with the Minnesota State Building, Plumbing Mechanical, Fuel Gas, Electrical and
Fire Codes, the City Code, and the manufacturer's installation instructions. All repairs,
maintenance, and alterations to the exterior of the primary structure shall be constructed of or
completed with compatible or like materials and finishes to blend into or match surrounding
exterior surfaces.
Section 2 . Eagan City Code Chapter 1 entitled "General Provisions and Definitions
Applicable to the Entire City Code Including 'Penalty for Violation "' and Section 10.99, entitled
"Violation a Misdemeanor" are hereby adopted in their entirety by reference as though repeated
verbatim.
Section 3 . Effective Date. This ordinance shall take effect upon its adoption and publication
according to law.

ACTION TO BE CONSIDERED:
To approve a Final Plat (Ruth Addition) to consolidate three parcels into one lot consisting of
approximately 6.7 acres located at 2101 Wuthering Heights Road, legally described as Part of
Government Lots 5, 6 and 7, and Outlot 1, Silver Bell Addition.
To approve (OR direct preparation of Findings of Fact for Denial), termination of the Planned
Development and a Rezoning from PD, Planned Development, to A, Agricultural, for
approximately 6.7 acres located at 2101 Wuthering Heights Road, legally described as Part of
Government Lots 5, 6 and 7, and Outlot 1, Silver Bell Addition.
REQUIRED VOTE FOR APPROVAL: Majority of Councilmembers present
FACTS:
➢ The applicant is requesting approval of a Rezoning from PD, Planned Development, to
A, Agricultural. The Rezoning is accompanied by a Final Plat to consolidate the
existing three parcels into a single lot consisting of 6.7 acres.
➢ In 2006, a Preliminary PD for a 107 -unit apartment building on this site was approved for
a 5 -year term, expiring in July 2011. A change in the land use designation to HD, High
Density residential was also approved at that time.
➢ Single- family is non - nonconforming under the approved PD, and the City Code prohibits
the reestablishment of nonconforming uses.
➢ The purpose of the proposed Rezoning from PD to A is to allow rehabilitation of the
single - family home as a conforming use; single - family is a permitted use in A zoning.
➢ The site will retain the present HD land use designation in the City's Comprehensive
Guide Plan. Agricultural zoning is considered consistent with all land use designations.
➢ The Agricultural zoning district requires a minimum lot size of 5 acres, which is satisfied.
➢ The Final Plat dedicates 50' x 50' right of way for Wuthering Heights Road for snow
plowing purposes.
➢ Approval of the Rezoning to A terminates the Planned Development.
➢ A public hearing for the Rezoning was held by the Advisory Planning Commission on
January 25, 2011 and the APC recommended approval.

Planner Dudziak introduced this item and highlighted the information presented in the City Staff
report dated January 19, 2011. She noted the background and history.
Chair Chavez opened the public hearing.
There being no public comment, Chair Chavez closed the public hearing and turned the
discussion back to the Commission.
Member Heaney asked about the status of the barn.
Richard Curtin, SB Landco, indicated he has been watching the site for 5 years. The property
recently became available at a price that makes it possible to be held for the long term.
Chair Chavez asked if sound attenuation has been considered.
Mr. Curtin indicated he has a long -term investment in the neighborhood, and has owned the
neighboring apartment building for years. He indicated he understands the concerns and while
the City's ordinance does not require it, he does intend to sound proof the house as best he
can.
Josh Tibbetz, 2111 Wuthering Heights Road, spoke in favor of the proposal.
Member Dugan asked if the owner would be able to convert the use when the market changes
or if the approval would be forever.
Planner Dudziak responded that future redevelopment would be possible and would involve
rezoning and possibly subdivision at that time.
Member Filipi moved, Member Heaney seconded a motion to recommend termination of the
Planned Development and approval of a Rezoning from PD, Planned Development, to A,
Agricultural, for approximately 6.7 acres located at 2101 Wuthering Heights Road.
All voted in favor. Motion carried 6 -0.

SUMMARY OF REQUEST
The applicant is requesting approval of a Rezoning from PD, Planned Development to A,
Agricultural, for approximately 6.7 acres located at 2101 Wuthering Heights Road.
Accompanying the Rezoning request is a proposed Final Plat to consolidate the three parcels
that comprise the site into a single lot. The Final Plat is not subject to a public hearing and does
not require Advisory Planning Commission action.
AUTHORITY FOR REVIEW
City Code Chapter 11, Section 11.50, Subd. 5 states in part,
1. The provisions of this chapter maybe amended by the majority vote of the council,
except that amendments changing the regulations of any district may only be made by an
affirmative vote of two - thirds of all members of the council.
2. The City Council shall not rezone any land or area in any zoning district or snake any
other proposed amendment to the zoning ordinance without first having referred it to the
planning commission for its consideration and recommendation.
BACKGROUNDMISTORY
In July 2006, the City approved a Preliminary Planned Development for a term of five years, to
permit construction of a 107 -unit apartment building. In conjunction with the Preliminary PD,
the land use designation was changed to HD, High Density residential. In addition the
application included a proposal to replat the three existing parcels into a single lot. Final Planned

Development approval was not completed, nor was the plat recorded, however, the HD land use
designation was implemented.
The applicant indicates that development of the property in conformance with the approved PD
zoning is not anticipated. The property contains a single- family home which has been vacant for
several years. During that time, the home suffered some damage such as broken windows and
water leakage. The applicant also reports the home is in need of new mechanical equipment such
as a furnace and water heater. The applicant, who acquired the site in the latter part of 2010,
wishes to restore the existing building to a condition in which it can be occupied as a single -
family residence.
The single - family use is nonconforming under the PD zoning, and is inconsistent with the HD,
High Density land use designation. City Code prohibits reestablislunent of a nonconforming use.
Therefore, in order to pursue restoring the single- family home to use, the property must be
rezoned to a zoning designation in which single- family homes are a permitted use.
The Agricultural zoning is requested because Agricultural zoning is considered compatible with
all land use districts, and thus, the HD, High Density, land use designation can be maintained.
The site is large enough to support the five acre lot size required for Agricultural zoning, and the
Agricultural zoning also prevents farther subdivision of the property.
A site visit showed that in addition to the house, the property contains a barn and a barbed wire
fence, remnants from when horses were kept on the site. Also, brush and concrete have been
improperly deposited along the driveway. The property should be maintained in accordance with
City zoning and property maintenance ordinances. Consequently, the brush, concrete and any
other materials that have been dumped on the property should be removed, as well as the barbed
wire fence. The barn will need further evaluation to determine what action is appropriate to
attain compliance with City ordinances.
EXISTING CONDITIONS
The 6.7 acre site is heavily wooded and generally slopes to the northwest. A heavily wooded
ravine extends along the west edge of the property. The ravine has steep slopes with significant
natural resource considerations, including tree preservation and impacts to downstream property.
This ravine is directly above the Minnesota River flats, and appears to be highly susceptible to
erosion. The ravine should be subject to stringent temporary and permanent erosion control
measures with any type of land use and development.
The site consists of three parcels, two unplatted and one platted outlot. The outlot does not have
public street frontage along its current boundaries. The unplatted northern portion of the site
takes access from Wuthering Heights Road, which is designated as a minimum maintenance
road.

Compatibility with Surrounding Area — Other properties along Wuthering Heights Road consist
of single - family development.
Airport Noise Considerations — The proposal does not involve a change to the land use
designation, which will remain HD, High Density. The HD land use designation is consistent
within Airport Noise Policy Zone 4. Because the proposal involves remodeling an existing
structure for the same use, single - family residential, the City's noise attenuation ordinance does
not apply.
Wetlands —There are no wetlands associated with this parcel.
GradinW Topography — The site is heavily wooded and generally slopes to the northwest. A
heavily wooded ravine extends along the west edge of the site. This ravine is directly above the
Minnesota River flats. No grading is proposed with this rezoning application.
Storm Drainage — No modifications to the existing storm drainage in the area are proposed with
this proposal.
Utilities — The existing house on the site is connected to City sanitary sewer and water main.
Water main and sanitary sewer service is also readily available to serve fixture development of the
property.

gravel road within public right -of -way. Wuthering Heights Road was designated as a Low

Road west toward Wuthering Heights Road. A temporary cul -de -sac was preliminarily approved
on the end of this street, with no direct connection to Wuthering Heights Road, and one driveway
connection to an apartment building shown to the public street. Future possible rezoning of the
property will require the construction of this public street, and will also require public street
easement dedication across the adjacent parcel (Lot 1, Block 1, Vogelpohl Addition) to Silver
Bell Road. The proposed public street will be required to be constructed to City engineering
standards.
Easements/ Permits/ Right -of -Way — This plat will be required to dedicate sufficient public right -
of -way for City snowplowing purposes, over the end of Wuthering Heights Road, in accordance
with City Engineering standards.
At time of development of this property, the developer will be required to acquire the necessary
public street easement from Silver Bell Road to this property to cover the street extension, in
accordance with City Engineering standards.
Assessments/ Connection Charges — At this time, there are no pending assessments on the parcel
proposed for re- zoning platting. Future charges will be computed and using the rates in effect at
time of subdivision or redevelopment of the property as the land use guided in the City's
Comprehensive Land Use Plan.
Tree Preservation — Tree preservation is not applicable to a rezoning. Compliance with the city's
Tree Preservation ordinance will be evaluated upon future subdivision or redevelopment of the
site.
Parks and Recreation — This proposal is not subject to park and trail dedications. The 2006
Preliminary Planned Development Agreement did include a stipulation for park and trail
dedications to be paid on a per -unit basis for the 107 -unit multi - family development. Rezoning
of the property will terminate the Planned Development. Future park and trail dedications will
be based upon redevelopment of the property.
SUMMARY /CONCLUSION
In summary, the applicant is requesting approval of a Rezoning from PD, Planned Development,
to A, Agricultural. The purpose of the proposed Rezoning is to allow the single - family home as
a conforming use. The proposal does not involve a change to the land use designation, which
will remain HD, High Density. The Agricultural zoning district requires a minimum lot size of 5
acres, which is satisfied. The Rezoning is accompanied by a proposed Final Plat to consolidate
the existing three parcels into a single lot consisting of 6.7 acres.
ACTION TO BE CONSIDERED
To recommend termination of the Planned Development and approval of a Rezoning from PD,
Planned Development, to A, Agricultural, for approximately 6.7 acres located at 2101 Wuthering
Heights Road.

Application for Zoning Change
From Planned Unit Development to Original Zoning, R -4 and Agricultural
Property & Request: In October 2010 SB Landco, LLC purchased
three parcels of land consisting of 6.7396 acres, all of which was included in
Planned Unit Development approved June 6, 2006, Planning Report Case No.
18- PD- 02- 05 -06.
This land consists of three parcels. One parcel (PIN 10- 01800- 060 -78), is
approximating 4.7 acres and contains a single family home, presently
unoccupied, and has the street address 2101 Wuthering Heights Road.
The second parcel (PIN 10- 01800- 012 -76) is a vacant strip of land 30 feet
wide, contiguous to 2101 Wuthering Heights Road, and is approximately .4
acres. These two parcels consist of exactly 5.017 acres of land and
applicant is requesting both parcels be zoned Agricultural, the zoning before
the PUD was approved.
The third parcel (PIN 10- 68060- 010 -00) is a vacant outlot consisting of
approximately 1.7 acres. Applicant is requesting this outlot be zoned
Agricultural.
A plat combining these two unplatted parcels and the one platted parcel into
a single parcel is being prepared for submission to Dakota County.
History: The PUD approved in 2006 (expiring in six months) contemplated
a 107 unit apartment building. This project was apparently abandoned by
the developer shortly after. the PUD was adopted and the property was for
sale for several years, first listed with NorthMarq, later listed with CBRE.
Eventually M &I Bank obtained title and sold it to applicant.
Plan: Applicant intends to restore the house at 2101 Wuthering Heights
Road. A restoration contractor has inspected the house at 2101 Wuthering
Heights Road and advised applicant that the structure is sound, though
HVAC, wiring and appliances all require extensive work, Restoration will
begin as soon as a permit can be obtained, and will be completed during the
summer of 2011. Applicant does not desire to subdivide the property,
remove any trees, or have more than one single family dwelling on the
property.

Applicant intends to leave the outlot as a wooded area, serving as a buffer
between two apartment complexes. Richard Curtin, managing director of SB
Landco has an ownership interest in one of these apartment complexes,
Silver Bell Apartments located at 2095 and 2091 Silver Bell Road.
Impact: The proposed change is consistent with existing uses.
2101Wuthering has public land on one side; single family residential on one
side; multifamily (and the outlot) on one side; and industrial on one side.
Access is from Wuthering Heights Road.
The outlot is bordered by 2101 Wuthering, and two apartment complexes.
An easement, recorded as document 583283 provides access to Silver Bell
Road. This is not a buildable lot and Applicant: has no plans to remove any
trees or erect anything on the Outlot.
The rezoning will have a beneficial impact on surrounding property as it will
mean less density, preserve mature trees, maintain current drainage, and
continue the current wildlife habitat. It will also give the neighborhood
closure on what is going to happen with the PUID.
The rezoning will have similar benefits to the property being rezoned.
Any impact on City services will be minimal as no new development is being
approved or contemplated.
