Present were Mayor Maguire, Councilmembers Bakken, Fields, Hansen and Tilley. There were no visitors who wished to be heard. A regular meeting of the Eagan City Council was held on Tuesday, February 1, 2011 at 6:30 p.m. at the Eagan Municipal Center. Present were Mayor Maguire, Councilmembers Bakken, Hansen, Fields and Tilley. Also present were City Administrator Tom Hedges, Community Development Director John Hohenstein, Public Works Director Tom Colbert, Administrative Services Director Gene VanOverbeke, City Planner Mike Ridley, City Attorney Mike Dougherty, and Administrative Secretary / Deputy Clerk Mira Broyles. Public Works Director Colbert presented an overview of the comprehensive Pavement Management Program. Assistant City Engineer Gorder gave a staff report. Mayor Maguire opened the public hearing. City Planner Ridley gave a staff report. The applicant was present to answer questions of the Council. A brief discussion was held. City Staff present: City Administrator Hedges, Assistant to the City Administrator Miller, Director of Administrative Services VanOverbeke, Parks and Recreation Director Seydell Johnson, Police Chief McDonald, Fire Chief Scott, Public Works Director Colbert, Community Development Hohenstein and City Planner Ridley. I. ROLL CALL AND ADOPTION OF THE AGENDA City Administrator Hedges requested that under Other Business, the City Council discuss a process for considering a retreat facilitator. JOINT MEETING WITH EAGAN'S LEGISLATIVE DELEGATION Mayor Maguire welcomed State Senator Ted Daley (District 38), State Representative Doug Wardlow (District 38B), and State Representative Diane Anderson (District 38A). Members of the legislative delegation introduced themselves to the City Council. City Administrator Hedges and staff summarized the City's 2011 Legislative priorities and positions. Mayor Maguire welcomed Tom Pohl of Messerli and Kramer, who serves on the Municipal Legislative Commission. The City Council and legislative delegation discussed the City's legislative priorities. Mayor Maguire and the City Council thanked the delegation for their presence at the meeting and encouraged them to approach the City early in the process on any issues pertaining to local government. Mayor Maguire also expressed the City's desire to be a partner to the delegation and serve as a resource to each of them. f7 Special City Council Minutes January 11, 2011 Page 2 IV. OPPORTUNITY CITY UPDATE City Administrator Hedges introduced the item noting that the City of Eagan approved an agreement to move forward with the Urban Land Institute (ULI) and Regional Council of Mayors (RCM) in being a part of the Opportunity Cities Program. Community Development Director Hohenstein noted that the Council received an update regarding community change data at its workshop on September 14, 2010. Hohenstein noted that the project team has since developed the Housing Audit information, facilitated the ULI Site Evaluation Panel that took a closer look at the Central Commons, Cliff Road Commons and Cedar Grove Commons Special Areas, and developed the Site Evaluation Report. Cathy Bennett of Bennett Community Consulting provided a presentation to the Council summarizing the draft Opportunity Cities Report. The City Council and staff discussed the draft report. A question was raised as to whether the ring -road could be branded to encourage a neighborhood feel. Ms. Bennett and staff summarized the 4 -key observations /considerations from the Opportunity Cities housing recommendations, which included: 1.) neighborhood preservation strategies, 2.) aging in place, 3.) attract and retain young households, and 4.) connectivity. Mayor Maguire asked for a brief pause on this agenda item and noted that State Representatives Rick Hansen (District 39A) just joined the Council meeting. At the Mayor's invitation, Representative Hansen noted that a bill has been introduced to provide $14 million to the Metropolitan Council to assist with Inflow and Infiltration (I &I) Programs. The Council thanked Representative Hansen for attending the meeting and for work on the I &I Bill. Mayor Maguire resumed the discussion with regard to the Opportunity Cities Program. Community Development Director Hohenstein noted that a future workshop item will be scheduled with a summary report, which will include specific next steps for the Council's consideration. It was noted that Elizabeth Ryan with the Family Housing Fund was in attendance. City Administrator Hedges noted that Ms. Ryan is a former Intern with the City of Eagan. Ms. Ryan expressed her pleasure to have the opportunity to work with the Regional Council of Mayors and the City of Eagan. V. TRAIL CONNECTION POLICY UPDATE — CITY OF EAGAN City Administrator Hedges introduced the item noting that the City's Engineering and Planning staff have worked together on a grant proposal to create a program intended to support enhanced bike and pedestrian connections to existing retail service areas within the City of Eagan. Hedges added that in March 2010, the City Council approved a contract with Dakota County awarding the City of Eagan $16,000 for the purposes of creating a bike /pedestrian connection program within retail service areas. Special City Council Minutes January 11, 2011 Page 3 City Planner Ridley provided a presentation to the City Council regarding the potential use of a framework that reviews and ranks privately proposed bike /pedestrian access in and around retail service areas. The Mayor and Council thanked staff for the presentation and noted that such a framework prepares the City in the event that funding becomes available. The City Council gave direction to staff to proceed with the proposed framework. VI. OTHER BUSINESS City Administrator Hedges noted that per the direction of the Council, City staff has researched two possible retreat facilitators. The Council directed staff and the Mayor to meet with the two potential facilitators and negotiate with the preferred facilitator in an effort to lower the cost for the facilitation services. VII. APPROVE OFF -SALE LIQUOR LICENSE FOR MARKO ERIAN, INC., DBA EAGAN LIQUOR MART, 1454 YANKEE DOODLE ROAD City Administrator Hedges introduced the item noting that Marko Erian, Inc. has applied for an off - sale liquor license. Hedges noted that the new license essentially changes the store name from E & M Liquor to Eagan Liquor Mart and the store address from 1444 Yankee Doodle Road to 1454 Yankee Doodle Road. Hedges added that there was an inadvertent mistake in processing the liquor license and, thus, the agenda item is being brought to the City Council in advance of the February 1, 2011 City Council meeting. Councilmember Bakken moved, Councilmember Tilley seconded a motion to approve the off -sale liquor license for Marko Erian, Inc., dba Eagan Liquor Mart, 1454 Yankee Doodle Road, subject to review by Community Development to ensure the location of the store meets criteria specified in the City Code. APPROVE CHANGE ORDERS FOR FIRE SAFETY CENTER PROJECT ACTION TO BE CONSIDERED: To APPROVE change orders for Fire Safety Center. FACTS: The Council has previously authorized award of 26 contracts for the construction of the Fire Safety Center project. We have had to make minor adjustments to the project as it proceeds, which has resulted in the changes listed below. City Staff and Bossardt Staff are recommending the following change orders for an increase of $9,501. 1. PR -021R overhead door sensors- $2,940 2. PR -034 Adjustment to ceiling design room 257- ($427) 3. PR -049 Provide guardrail around generator- $30 4. PR -051 Change emergency generator transfer switch- ($5,290) 5. PR -055 Add fan for smoke training pipe- $408 6. PR -056 Modify CMU wall for window frame- $2,450 7. PR -057 Provide CMU enclosures for manifolds in bays- $4,550 8. RCO -036 Remove and replace embeds on steel door- $3,783 9. RCO -068 Cut metal studs to accommodate stairway stringers- $0 10. RCO -074 Provide additional metal door for stairway A- $667 11. RCO -077 Provide low voltage wiring to exterior opening- $529 12. RCO -078 Replace damaged roof on portable toilet- ($139) • In addition to the above changes SEH Architects have agreed to reduce their overall fees for the Fire Safety Center project by $60,000. This reduction is a result of City Staff successfully pursing SEH for reimbursement for several change orders that City Staff felt were the direct result of errors /omissions /changes on the part of SEH staff. REQUIRED VOTE FOR APPROVAL: Majority of Council Members Present FACTS: ➢ Demand for, and interest in developing, senior housing will continue to increase. ➢ City staff believes the City Code should reflect realistic standards when determining adequate off - street parking requirements for senior living facilities. ➢ Currently, the Eagan City Code does not address parking requirements for senior housing, save nursing homes. All other facilities can currently only be reviewed against multiple - family residential, such as apartments. ➢ Staff surveyed a number of metro cities regarding this type of use and requirements. In most cases, senior housing developments required less parking. Staff will work to establish reasonable and adequate requirements for such uses. REQUIRED VOTE FOR APPROVAL: Majority of Council Members Present FACTS: ➢ To ensure that street upgrades accompany development of property along Minimum Maintenance roads, the City Attorney has suggested that a maximum density for such properties be established. ➢ The City has two public rights -of -way designated by Council action as Minimum Maintenance roadways, Towerview Road (east of Quarry Lane only) and Wuthering Heights Road. The designation means the City is not responsible for snow and ice removal, structural maintenance of the existing surfaces, curbing and /or street repairs. ➢ The ordinance amendment would establish a maximum density to prevent further subdivision of property and intensification of development along roads designated as Minimum Maintenance roads until such time as the street is upgraded and the Minimum Maintenance designation can be removed. SCHEDULE PUBLIC HEARING TO CONSIDER EXTENSION OF MINNESOTA INVESTMENT FUND AGREEMENT WITH BIOPOLYMER ENGINEERING, INC (BIOTHERA) ACTION TO BE CONSIDERED: Schedule a public hearing on March 15, 2011 for consideration of a one -year extension to the Minnesota Investment Fund Agreement with Biothera. REQUIRED VOTE FOR APPROVAL: Majority of Council Members Present FACTS: ➢ In March 2009, the City of Eagan received a $350,000 Minnesota Investment Fund (MIF) grant from the State of Minnesota's Department of Employment and Economic Development (DEED) to provide an expansion loan to Biothera. The loan was to partially fund new equipment and a needed expansion of their facility at 3388 Mike Collins Drive. ➢ The MIF agreement requires that the applicant meet a job creation requirement within a two year period or payback the outstanding balance of the loan. For Biothera, this was set at 30 new jobs with a deadline of March 9, 2011. ➢ The agreement allows the City as the loan grantee to approve a one -year extension for the recipient to meet the job requirement goal. ➢ Biothera has indicated to City Staff they are close to meeting their job requirement but that a one -year extension may be necessary. ➢ Staff is requesting that a public hearing to consider a one -year extension be scheduled for March 15, 2011. CONTRACT 11-04,2011 CITYWIDE SANITARY SEWER LINING ACTION TO BE CONSIDERED: Receive the Bids and award Contract 11 -04 to Insituform Technologies for the base bid amount of $164,100 and authorize the Mayor and City Clerk to execute all related documents. FACTS: • As a part of the 5 year Capital Improvement Program (2011 -2015) and the 2011 operating budget, the City Council authorized the rehabilitation of approximately 5,000 linear feet of existing sanitary sewer pipe to be strategically selected from throughout the City for structural and I & I mitigation lining improvements. The budget was approved at $115,000 based on an estimated $23 per foot for 8 -9" diameter sewer pipes. • After the budget estimate was prepared, staff had the opportunity to review and evaluated the 2010 sewer flows from all 22 sewer districts. It was determined that the 12" diameter sewer trunk line in Carnelian Lane and a 10" trunk line in Rahn Rd (all in District #1) were a high priority for I & I benefits. The private I & I in -home inspection program was also performed within this same district in 2010. • Late in 2010, The Metropolitan Council of Environmental Services (MCES) rolled out an I &I grant program for affected cities to help with their cost of mitigating public infrastructure related I &I. The grant will fund 50% of "eligible" improvement costs. Sewer Lining costs have been qualified as 50% eligible (i.e. net 25 %). Staff prepared the grant application to include the 2011 and 2012 sewer lining programs along with some additional other local improvements. We were subsequently approved for $88,500 of grant funds from the MCES. • With this notification of additional approved funding, staff prepared bid documents for 6,000 ft in hopes of taking advantage of the excellent bidding climate. On February 10, 2011 at 11:00 a.m., formal bids were received for this project. A copy of the bid tabulation is enclosed. • While technically, the low bid is $49,100 (43 %) over budget due to the increased quantity (5,000 to 6,000 ft) and higher cost large diameter trunk sewer (8" to 12 "), the grant funds ($88,500) are more than sufficient to cover this additional cost ($49,100). The low bid unit price still remains competitive with the low bid prices from the last 3 years. • All bids have been reviewed for compliance with the bid specifications and accuracy on unit price extensions and summations. The low bid from Insituform Technologies has been reviewed by the Utility Division and found to be in order for favorable Council Action. FACTS: For the past 26 years (1985), the City of Eagan has participated in a Joint Powers Agreement (JPA) with other local agencies to solicit competitive prices for pavement traffic marking, street sweeping, crack sealing and seal coating contractual services. The only changes to this year's agreement are the deletion of Farmington and the addition of Mendota Heights joining the other cities of Eagan, Burnsville, Apple Valley, Elko New Market, Hastings, Lakeville, Prior Lake, Rosemount, Savage, Shakopee, South St. Paul, Waconia and West St. Paul. • The consolidation of the administrative services and subsequent economy of scale competitive bidding has resulted in significant savings to the City of Eagan and resulted in a Certificate of Commendation from the Governor in 1995. • A copy of the 2011 JPA is now being presented to the City Council for their consideration of approval. Approve a Joint Powers Agreement with the State of Minnesota regarding the DataMaster DMT -G Breath Testing Equipment ACTION TO BE CONSIDERED: Approve the Agreement FACTS: • The Minnesota Department of Public Safety has secured funding to replace the State's current breath testing equipment, the Intoxilyzer 5000 with a new instrument known as the DataMaster DMT -G. • The instrument will be used to measure the blood alcohol concentration of persons arrested for driving under the influence of alcohol. • Although the City of Eagan will have possession of the equipment, the State retains ownership. • The Eagan City Attorney has reviewed the Joint Powers Agreement. ATTACHMENT: Joint Powers Agreement on pages 84 33 MN DEPARTMENT OF PUBLIC SAFETY DATAMASTER DMT -G WITH FUEL CELL OPTION EVIDENTIAL BREATH TESTER INSTRUMENT AGREEMENT (DISTRIBUTION OF EQUIPMENT TO LAW ENFORCEMENT AGENCIES) Contract # BCA- DMT -0044 THIS JOINT POWERS AGREEMENT, by and between the State of Minnesota, acting through its . Commissioner of Public Safety, Bureau of Criminal Apprehension, Forensic Science Laboratory (hereinafter referred to as the STATE) and City of Eagan (hereinafter referred to as the GOVERNMENTAL UNIT) witness that: WHEREAS, the STATE has received an appropriation to purchase DataMaster DMT -G with Fuel Cell Option breath test instruments and is authorized to distribute DataMaster DMT -G with Fuel Cell Option breath test instruments to criminal justice agencies and /or city, county, or political subdivisions; and WHEREAS, the GOVERNMENTAL UNIT represents that it is a criminal justice agency, or is a city, county, or political subdivision authorized to accept equipment/services from the STATE for the purpose specified herein; and WHEREAS, the GOVERNMENTAL UNIT represents that it is duly qualified and willing to perform and carry out the services and tasks described in this Agreement. NOW, THEREFORE, it is agreed: I. STATE'S RESPONSIBILITIES. A. The STATE will provide GOVERNMENTAL UNIT with a DataMaster DMT -G with Fuel Cell Option breath test instrument ( "instrument "), which includes a DataMaster DMT -G with Fuel Cell Option, initial dry gas cylinder, a keyboard, a keyboard carrel, a printer with a toner cartridge, and mouthpieces for use as specified under Clause II of this Agreement. The GOVERNMENTAL UNIT will use and have possession of the instrument; but the STATE shall retain legal ownership of the instrument. B. Any and all repairs shall be made by or at the direction of the STATE. If funding is available, the STATE will pay for the cost of maintenance and repair, or replacement due to normal wear and tear resulting from routine, proper use of the instrument. C. The STATE will maintain all necessary state and federal inventory control records on these instruments. . GOVERNMENTAL UNIT RESPONSIBILITIES - A. The GOVERNMENTAL UNIT will use the instrument specified above to assist in enforcing Minnesota laws and local ordinances relating to traffic and highway safety and for other law enforcement applications. B. The GOVERNMENTAL UNIT will keep and maintain the instrument provided by the STATE in proper operating condition. The GOVERNMENTAL UNIT will also be responsible for any and all costs of repairing or replacing the instrument that is lost or damaged due to misuse or abuse. C. The GOVERNMENTAL UNIT will provide and maintain all disposable and consumable components originally provided by the STATE, such as DataMaster DMT -G with Fuel Cell Option mouthpieces, dry gas cylinders, printer toner cartridges, and paper and will supply all other necessary disposable and consumable components not provided by the STATE at the GOVERNMENTAL UNIT'S expense. 01 D. The GOVERNMENTAL UNIT will make this instrument available for use by any breath test operator certified by the STATE. E. The GOVERNMENTAL UNIT will not permit the instrument to be operated or tampered with by individuals who are not trained in its operation and certified by the STATE as DataMaster DMT- G with Fuel Cell Option operators. F. The GOVERNMENTAL UNIT will make the instrument available to STATE authorized personnel when required for inventory or inspection purposes. III. . TERMS OF AGREEMENT This Agreement shall be effective on January 1, 2011 or upon the date that the final required signature is obtained by the STATE, pursuant to Minn. Stat. § 16C.05, Subdivision 2, whichever occurs later, and shall remain in effect until the instrument is no longer used and supported by the STATE or until terminated by either of the parties as provided in Clause IV below, whichever occurs first. At the end of this Agreement, the STATE will notify the GOVERNMENT UNIT if they are required to return the instrument to the STATE. IV. . TERMINATION This Agreement may be terminated by either the STATE or GOVERNMENTAL UNIT at any time, with or without cause, upon ten (10) days written notice to the other party. The instrument must be returned to the STATE within 30 days of the termination date, and if the GOVERNMENTAL UNIT fails to return the instrument within this time period the GOVERNMENTAL UNIT agrees to pay the STATE the cost of replacing the instrument and payment will be made to the STATE within 30 days of receipt of invoice. V. . STATE'S AUTHORIZED REPRESENTATIVE The STATE'S authorized representative agent for the purposes of this Agreement is . Frank C. Doleisi or his designee, . LIABILITY GOVERNMENTAL UNIT shall indemnify, save and hold the STATE, its agents and employees, harmless from any claims or causes of action, including all attorneys' fees incurred by the STATE, arising from the performance of this Agreement by GOVERNMENTAL UNIT or GOVERNMENTAL UNIT'S agents or employees. This clause will not be construed to bar any legal remedies GOVERNMENTAL UNIT may have for the STATE's failure to fulfill its obligations pursuant to this Agreement. Adopt a resolution supporting a technology enhancement to the manner in which outdoor warning sirens are activated. ACTION TO BE CONSIDERED: Adopt the Resolution supporting a county -wide plan to enhance the City's Outdoor Warning Siren System. FACTS: • The City of Eagan owns and services 12 outdoor warning sirens within the community. • In the event of an emergency, the sirens are activated by the Dakota Communications Center (DCC) who broadcasts a radio signal. • The type of radio signal used to activate the sirens is characterized as "wide - band." • The Federal Communications Commission (FCC) recently enacted new regulations on wide -band systems. To summarize, systems using wide -band technology must be converted to "narrow- band" prior to January 1, 2013. • Along with compliance to the FCC standards, the plan provides for faster -more secure siren activation technology and offers remote monitoring capabilities. • Representatives from governments throughout Dakota County formed a work group to formulate a migration plan and develop a cost sharing formula. • It is estimated the upgrade to Eagan's system will cost approximately $7,600. However, by adopting the resolution, the County will reimburse the City 50 percent of the costs incurred. The work is expected to be completed in 2012. • The DCC Board of Directors adopted the plan. ATTACHMENTS Resolution on page -3 �? -37 City of Eagan County of Dakota State of Minnesota Resolution of Outdoor Warning Siren System Narrow Banding WHEREAS, in 2007 the Dakota Communications Center (DCC) began to provide 9 -1 -1 call answering, public safety radio dispatching, and related Public Safety Answering Point (PSAP) services to the citizens and visitors of Dakota County; and, WHEREAS, in 2008 the DCC and Dakota County (County) entered into an Agreement relating to the maintenance, operation, and support certain fixed radio communications and signaling equipment used to activate individual outdoor warning sirens located in various communities and townships within or near Dakota County; and, WHEREAS, individual outdoor warning sirens are owned and maintained by various entities including cities, townships, and private enterprises (e.g. Xcel Energy); and, WHEREAS, the Federal Communications Commission (FCC) has established Rules and Regulations which require the reconfiguration of radio transmitters and receivers used in conjunction with the outdoor warning siren system by January 1, 2013; and, WHEREAS, the aforementioned transmitter /receiver reconfiguration is commonly known as the First Phase Narrow Banding requirement; and, WHEREAS, failure to comply with FCC Rules and Regulations may subject the County and /or the Cities to possible sanctions including loss of FCC license authority and /or fines; and, WHEREAS, representatives of the Cities and Dakota County staff (Work Group) have been planning a method to narrow band equipment used by the DCC to activate outdoor warning sirens as well as individually owned /operated sirens across the County; and, WHEREAS, the DCC Joint Operations Committee has reviewed and recommended the Work Group recommendations to the DCC joint power's board. PROJECT 923, HIGHWAY 149 CORRIDOR ANALYSIS ACTION TO BE CONSIDERED: Authorize the preparation of a corridor analysis /traffic study for Highway (TH) 149, I -494 to TH 55, by the consulting engineering firm of SRF Consulting Group, Inc. FACTS: • On June 2, 2009, the City Council adopted a resolution supporting Federal Transportation Funding applications to the Surface Transportation Plan (STP) program to provide funding for the upgrade of the segment of Highway 149 from the south intersection of TH 55 to the I- 494 north ramp intersection from the existing four -lane divided roadway to a six -lane facility. The proposed improvements included a bituminous trail on the south and west sides of TH 149. • The STP program provides federal funding for projects on regionally significant roadways that connect or feed the metropolitan area freeway /highway system. • In February, 2010, the City was notified that the STP application for the segment of TH 149 between I -494 and the north intersection of TH 55 (`A' Minor Arterial - Reliever), Project 923, was successful in the funding period of 2013 -14 for $2,480,000. The funding requires a local match of $496,000. • The Minnesota Department of Transportation (MnDOT) did not have the City's selected STP application included as a part of their Statewide 20 -Year Highway Investment Plan (2009- 2028), so coordination efforts between City staff and MnDOT staff have been occurring over the past year to facilitate a successful project. Said discussions have included the possible inclusion of additional minor improvements (traffic signals) with alternative funding sources. • The proposed corridor analysis /traffic study will combine the recent efforts used in the preparation of the Regional Roadway System Visioning Study and a MnDOT Signal Optimization Project to better understand the forecasted 2030 traffic volumes for the intersections along TH 149 and confirm the future needs of the corridor. The results of the analysis would provide the necessary improvement options for the City and MnDOT to consider as they pursue improvements for the TH 149 corridor. • The analysis may also prove helpful to a combined MnDOT /City application in 2011 for STP funding in the 2015 -16 period for similar improvements to the common segment of TH 55 and 149 (Principal Arterial). If successful, this last improvement would finalize the upgrade of TH 149 throughout the City of Eagan. • As of April 1, 2011, new federal requirements will require additional noise analysis on all federally funded projects. Completion of the requested analysis prior to this date will allow Project 923 to proceed without the need to meet said requirements. • Based on this schedule, it would be appropriate for the City Council to authorize the preparation of a corridor analysis /traffic study by the consulting engineering firm to help City and MnDOT staff further refine the scope, cost, schedule and method of financing these proposed improvements. 3q Agenda Memo February 15, 2011 City Council Meeting Q. FACTS: • Staff was directed to investigate opportunities to make enhancements to the space made available after the replacement of the Civic West Arena floor, based on partnership interest expressed by the Eagan Hockey Association. • In order to determine the cost associated with a potential training space preliminary architectural estimates came in near the $500,000 range with the understanding that these costs might be improved with actual bids. • Formal plans and specifications were completed and bids were solicited and opened on September 14. • Preliminary retail estimates based on the final architectural drawings were in the $600,000 range, however the lowest bid came in at $343,969. • At their September 21, 2010 meeting the City Council awarded the bid to Morcon Construction, Inc. in the amount of $343,969. • Change orders to the project resulted in a net addition of $14,459.14 for a final construction contract amount of $358,428.14. To approve an agreement with Healthways to offer the Silver Sneakers program at the Eagan Community Center and direct the Mayor and City Clerk to sign all appropriate documents. FACTS: • The ECC fitness center currently has several programs that offer reimbursed programs for various types of memberships. • Over the last several years we have had several fitness and community members ask us to offer the Silver Sneakers program at our facility. Unfortunately at those times Healthways offered Silver Sneakers at various other limited facilities and were not able to expand to the ECC. • ECC staff was recently approached by Healthways to offer the Silver Sneakers program at our facility. • Silver Sneakers is a program open to participants 65 and older who are enrolled in Medicare. The program offers free access to the fitness center along with specialized classes to maintain a healthy and active lifestyle for this population. • In consideration for access to the ECC fitness center and specialized class offerings, Healthways will reimburse the ECC a dollar amount for each visit for registered members of Silver Sneakers. The reimbursement per person cannot exceed $30 per month, which is close to the monthly membership rate. • This program would help meet the demand for a growing 65+ population in Eagan and will be key to maintaining an active lifestyle. This will also be a good transition from the current 55+ fitness programs that currently exist in the ECC. • Once an agreement has been approved, the program will take approximately 4 -6 weeks to implement. Healthways will train existing fitness instructors to be able to teach specific classes designed for this population. FACTS: • Since 1990, the City has implemented a comprehensive Pavement Management Program that provides timely pavement rehabilitation to our local streets, significantly extending their overall life expectancy. During these past 21 years, the City has rehabilitated approximately 161 miles of local streets. • The resurfacing of the 2 miles of numerous streets within the Woodlands/ Sunrise Hills neighborhood in east - central Eagan has been programmed for 2011 in the City's 5 -Year Capital Improvement Program. • On June 1, 2010 the City Council directed staff to prepare a feasibility report considering a rehabilitation of these streets. • On January 18, 2011, the feasibility report for Project 1037 was presented to the City Council and a Public Hearing was scheduled for February 15 to formally present and discuss the report with the adjacent property owners. • An informational neighborhood meeting was held on February 7 for the adjacent property owners to discuss the proposed improvements. Of the 203 total properties (all single - family homes) proposed to be assessed under this improvement, two residents representing two properties attended the meeting. • All notices have been published in the legal newspaper and sent to all affected property owners informing them of this public hearing. In 1989, a Pavement Management System (PMS) was developed that allowed the City to evaluate the condition of the existing pavement surface for all the streets on a routine basis and schedule timely maintenance. A Five Year Capital Improvement Program (CIP) for street rehabilitation is developed from this information. The nearly 2 miles of residential streets in the Woodlands/ Sunrise Hills neighborhood in east - central Eagan are identified for the 2011 street revitalization improvements. Figure 1, located in Appendix C, illustrates the project location. The streets in this neighborhood were constructed in 1988. Based on the data and engineering strategies available at this time, the City's current PMP incorporates local and ongoing maintenance strategies with seal coating occurring as needed (at 5 to 7 years, again at 12 to 14 years) with a bituminous overlay at approximately 20+ years. Overlaying the roadways located within the project area, which are presently at the 20+ year time frame, will prevent further decay of the pavement surface, thus protecting and extending the structural life of the streets. Timely maintenance work, such as bituminous patching, crack sealing and seal coating have occurred at appropriate intervals during the life of the pavement in the area. The City of Eagan's maintenance records indicate that these streets were seal coated in 1993 and 2003. Woodlands /Sunrise Hills 4 1 The Public Works maintenance program typically includes extensive patching and crack sealing during the summer prior to the overlay. The Public Works crews, as part of the Preparatory Pavement Management Plan, removed and replaced deteriorated pavement areas and placed leveling and maintenance overlays on portions of the streets under consideration, where necessary. These repairs alone will not substantially extend the life expectancy of the street section if not combined with the bituminous overlay proposed with this project. The Public Works Department has also inspected the utility infrastructure (sanitary sewer, water main, and storm sewer) in the project area and determined the system is in good working order and that no major repairs are necessary. Scope This project will provide resurfacing (edge mill and overlay) for approximately 2 miles of roadway. Figure 2 in Appendix C, illustrates the project limits. Included in this project are the following improvements: replacement of damaged curb and gutter, adjustments and /or replacement to sanitary /storm sewer utility castings, water gate valves, street signage, and pedestrian ramps. Feasibility and Recommendations The mill and overlay project is necessary to prevent further decay of the pavement section, create a safer driving surface, increase ride ability, and add structural strength. The mill and overlay portion of the project is cost effective in that the proposed improvement (resurfacing) is considerably less expensive than complete reconstruction of this street. The mill and overlay is feasible in that this type of improvement has been used successfully to extend the life expectancy of numerous other streets throughout the City and the region. This project is in accordance with the Five Year Capital Improvement Plan (2011 -2015) for the City of Eagan and the schedule as outlined in the Pavement Management Program. It is recommended that the project be constructed as proposed in this report in combination with other similar projects in the area. Woodlands /Sunrise Hills /� 7 2 Street Evaluation The City of Eagan's Pavement Management System allows the City to evaluate the condition of the existing street surface to help schedule timely maintenance and improvements. The Pavement Condition Index (PCI) ranks the surface condition for each street. The general categories that define PCI rankings are as follows: PCI Recommended Improvement 56-100 Routine Maintenance /Crack Seal /Seal Coat 36-55 Patch /Repair and /or Overlay 0-35 Reconstruct The 2010 PCI rankings for the street segments have a weighted average pavement condition rating of 53 for Woodlands /Sunrise Hills, which falls in the rankings of the "Patch /Repair and /or Overlay" category, as mentioned above. The street pavement has reached an age where, based on the City's past experience, the integrity of the pavement can rapidly decline if no improvements are performed. Therefore, the 2011 construction season is the optimal time to construct the bituminous overlay on this street. Any delay of the project may reduce the structural benefit to the street sections and require full reconstruction. Proposed Improvements Pavement - The proposed street improvements for Woodlands /Sunrise Hills are shown in Figure 3. The existing street section for this roadway consists of 3" bituminous pavement supported by 6" gravel base. The existing bituminous surface will be milled adjacent to the existing curb and gutter (6' -8' wide) to accommodate a 1% -inch bituminous overlay. The overlay, combined with the existing street section, will provide a street section Woodlands /Sunrise Hills 49 3 consistent with current City standards for residential streets. The combination of patching and overlay will not eliminate cracking due to the temperature extremes experienced in Minnesota. Bituminous overlays will show some continued frost movements and reflective cracking consistent with the underlying pavement. Routine maintenance will still need to continue under the City's Pavement Management Program. Concrete curb & gutter - Damaged curb & gutter will be replaced if severely cracked, spalled, or settled. It is estimated that approximately 16% of the existing concrete curb and gutter will have to be replaced. Boulevard turf will be removed and replaced. While the contractor who performs the work is responsible for its establishment in the first 30 days after placement, adjacent property owners are encouraged to consistently water the new turf, where possible, to help ensure its growth. Signage - All traffic control and street identification signage within the project limits will be replaced due to diminished reflectivity, deteriorated support posts, and the signs or posts no longer meeting City and State standards. Sidewalk /Path & Pedestrian Ramp — Revisions to the Americans with Disabilities Act (ADA) requires jurisdictional agencies to provide detectable warnings at all existing pedestrian ramps of sidewalks and paths with public streets that are improved, including street surface improvements. The most common method of providing this detectable warning is through the installation of truncated domes a minimum of two feet in length across the width of all Woodlands /Sunrise Hills `7' 1 4 pedestrian ramps. This project provides for the installation of truncated dome pedestrian ramps along the existing Wescott Road sidewalk. Easement /Permits All work will be in the public right -of -way. No additional easements will be necessary. It is anticipated that no permits will be required for the resurfacing project. Cost Estimate Detailed cost estimates are located in Appendix A. The estimates are based on anticipated 2011 construction costs and include a 5% contingency and indirect cost of 30 %, which include legal, administration, engineering, and bond interest. Presentation of Project Details • Gorder welcomed the property owners and presented project information, including details such as construction, costs, schedule and assessments. B. Questions/ Comments • Will our irrigation systems be affected? Prior to curb replacement that may affect irrigation system heads and invisible dog fences, the City notifies residents of this possibility, and asks them to mark these systems. The City makes wire marking flags available to residents. • What happens if oil prices continue to climb? The price of asphalt oil, a component of the bituminous mixtures used, are not as dependent on the price of crude oil, as other product such as gasoline. If the bid prices received exceed the estimated costs by more than 10 %, it is City policy to hold another public hearing with the residents to determine if the project should proceed with the higher costs and associated assessments. • Will we be able to access our driveways during construction? The edge mill & overlay construction will provide a hard surface for vehicles at all times during the project. There may some limited access for short periods of time during curb replacement and manhole adjustment. Access to some driveways will also be limited if curb replacement is adjacent to driveways. Room for on- street parking will be provided while new curb in front of driveways cures, or hardens. • How long will this street improvement last? The wear and tear of the house construction traffic is essentially done. The combination of the structural strength of the new overlay pavement, along with less wear and tear from traffic, should extend the pavement life another 20 years. FACTS: • Since 1990, the City has implemented a comprehensive Pavement Management Program that provides timely pavement rehabilitation to our local streets, significantly extending their overall life expectancy. During these past 21 years, the City has rehabilitated approximately 161 miles of local streets. • The resurfacing of the 3 /4 mile of streets within the Engstroms Deerwood neighborhood ( Deerwood Trail/ Court/ Path/ Place) in central Eagan have been programmed for 2011 in the City's 5 -Year Capital Improvement Program. • On June 1, 2010 the City Council directed staff to prepare a feasibility report considering a rehabilitation of these streets. • On January 18, 2011, the feasibility report for Project 1038 was presented to the City Council and a Public Hearing was scheduled for February 15 to formally present and discuss the report with the adjacent property owners. • An informational neighborhood meeting was held on February 7 for the adjacent property owners to discuss the proposed improvements. Of the 84 total properties (all single- family homes) proposed to be assessed under this improvement, two residents representing one property attended the meeting. • All notices have been published in the legal newspaper and sent to all affected property owners informing them of this public hearing. In 1989, a Pavement Management System (PMS) was developed that allowed the City to evaluate the condition of the existing pavement surface for all the streets on a routine basis and schedule timely maintenance. A Five Year Capital Improvement Program (CIP) for street rehabilitation is developed from this information. The nearly 3/4 mile of Engstroms Deerwood residential streets in central Eagan are identified for 2011 street revitalization improvements. Figure 1, located in Appendix C, illustrates the project location. The streets in this residential neighborhood were constructed in 1988. Based on the data and engineering strategies available at this time, the City's current PMP incorporates local and ongoing maintenance strategies with seal coating occurring as needed (at 5 to 7 years, again at 12 to 14 years) with a bituminous overlay at approximately 20+ years. Overlaying the roadway located within the project area, which is in the 20+ year time frame, will prevent further decay of the pavement surface, thus protecting and extending the structural life of the streets. Timely maintenance work, such as bituminous patching, crack sealing and seal coating have occurred at appropriate intervals during the life of the pavement in the area. The City of Eagan's maintenance records indicate that these streets were seal coated in 1993 and 2001. Engstroms Deerwood -71 1 The Public Works maintenance program typically includes extensive patching and crack sealing during the summer prior to the overlay. The Public Works crews, as part of the Preparatory Pavement Management Plan, removed and replaced deteriorated pavement areas and placed leveling and maintenance overlays on portions of the streets under consideration, where necessary. These repairs alone will not substantially extend the life expectancy of the street section if not combined with the bituminous recycling and overlay proposed with this project. The Public Works Department has also inspected the utility infrastructure (sanitary sewer, water main, and storm sewer) in the project area and determined the system is in good working order and that no major repairs are necessary. Scope This project will provide resurfacing (edge mill and overlay) for approximately 3/4 mile of roadway. Figure 2 in Appendix C, illustrates the project limits. Included in this project are the following improvements; replacement of damaged curb and gutter, adjustments and /or replacement to sanitary /storm sewer utility castings, water gate valves, and street signage. Feasibility and Recommendations The mill and overlay project is necessary to maintain and enhance the structural integrity of the pavement section, create a safer driving surface, and increase rideability. The mill and overlay portion of the project is cost effective in that the proposed improvement (resurfacing) is considerably less expensive than complete reconstruction of this street. The mill and overlay is feasible in that this type of improvement has been used successfully to extend the life expectancy of numerous other streets throughout the City and the region. This project is in accordance with the Five Year Capital Improvement Plan (2011— 2015) for the City of Eagan and the schedule as outlined in the Pavement Management Program. It is recommended that the project be constructed as proposed in this report in combination with other similar projects in the area. Engstroms Deerwood - 7a 2 Street Evaluation The City of Eagan's Pavement Management System allows the City to evaluate the condition of the existing street surface to help schedule timely maintenance and improvements. The Pavement Condition Index (PCI) ranks the surface condition for each street. The general categories that define PCI rankings are as follows: PCI Recommended Improvement 56-100 Routine Maintenance /Crack Seal /Seal Coat 36-55 Patch /Repair and /or Overlay 0-35 Reconstruct/ Reclaim The 2010 PCI rankings for the street segments have a weighted average pavement condition rating of 49 for Engstroms Deerwood, which falls in the rankings of the "Patch /Repair and /or Overlay" category, as mentioned above. The street pavement has reached an age where, based on the City's past experience, the integrity of the pavement can rapidly decline if no improvements are performed. Therefore, the 2011 construction season is the optimal time to construct the bituminous overlay on this street. Any delay of the project may reduce the structural benefit to the street sections and require full reconstruction. Proposed Improvements Pavement - The proposed street improvements for Engstroms Deerwood are shown in Figure 3. The existing street section for this roadway consists of 3" bituminous pavement supported by 6" gravel base. The existing bituminous surface will be milled adjacent to the existing curb and gutter (6' -8' wide) to accommodate a 1% -inch bituminous overlay. The overlay, combined with the existing street section, will provide a street Engstroms Deerwood --733 section consistent with current City standards for residential streets. The combination of patching and overlay will not eliminate cracking due to the temperature extremes experienced in Minnesota. Bituminous overlays will show some continued frost movements and reflective cracking consistent with the underlying pavement. Routine maintenance will still need to continue under the City's Pavement Management Program. Concrete curb & gutter - Damaged curb & gutter will be replaced if severely cracked, spalled, or settled. It is estimated that approximately 15% of the existing concrete curb and gutter will have to be replaced. Boulevard turf will be removed and replaced. While the contractor who performs the work is responsible for its establishment in the first 30 days after placement, adjacent property owners are encouraged to consistently water the new turf, where possible, to help ensure its growth. Signage - All traffic control and street identification signage within the project limits will be replaced due to diminished reflectivity, deteriorated support posts, and the signs or posts no longer meeting City and State standards. Engstroms Deerwood —7+ 4 Easement /Permits All work will be in the public right -of -way. No additional easements will be necessary. It is anticipated that no permits will be required for the resurfacing project. Cost Estimate Detailed cost estimates are located in Appendix A. The estimates are based on anticipated 2011 construction costs and include a 5% contingency and indirect cost of 30 %, which include legal, administration, engineering, and bond interest. Questions/ Comments • After the paving, won't the road be too steep in the middle? It has been the City's experience that the "crown" of streets tend to fall over time, so the 1.5" blacktop overlay restores the crown closer to the original design, and improves overall drainage. • Should we replace our driveway before or after construction? Depending on the condition of the concrete curb adjacent to your driveway. If the curb does not need to be replaced, the driveway work should be completed before the City project. If the curb needs to be replaced, the driveway work should be completed after the City's work. City staff is available to review the condition of the curb in the spring when the curbs are clear of snow and ice. • How long will this street improvement last? The wear and tear of the house construction traffic is essentially done. The combination of the structural strength of the new overlay pavement, along with less wear and tear from traffic, should extend the pavement life another 20 years. FACTS: • Since 1990, the City has implemented a comprehensive Pavement Management Program that provides timely pavement rehabilitation to our local streets, significantly extending their overall life expectancy. During these past 21 years, the City has rehabilitated approximately 161 miles of local streets. • The resurfacing of the 2 miles of numerous streets within the Trotters Ridge/ Stafford Place neighborhood in east - central Eagan has been programmed for 2011 in the City's 5 -Year Capital Improvement Program. • On June 1, 2010 the City Council directed staff to prepare a feasibility report considering a rehabilitation of these streets. • On January 18, 2011, the feasibility report for Project 1032 was presented to the City Council and a Public Hearing was scheduled for February 15 to formally present and discuss the report with the adjacent property owners. • An informational neighborhood meeting was held on February 7 for the adjacent property owners to discuss the proposed improvements. Of the 201 total properties (all single - family homes) proposed to be assessed under this improvement, six residents representing five properties attended the meeting. • All notices have been published in the legal newspaper and sent to all affected property owners informing them of this public hearing. In 1989, a Pavement Management System (PMS) was developed that allowed the City to evaluate the condition of the existing pavement surface for all the streets on a routine basis and schedule timely maintenance. A Five Year Capital Improvement Program (CIP) for street rehabilitation is developed from this information. The nearly 2 miles of residential Trotters Ridge/ Stafford Place streets in east - central Eagan are identified for the 2011 street revitalization improvements. Figure 1, located in Appendix C, illustrates the project location. The streets in this residential neighborhood were constructed in 1987. Based on the data and engineering strategies available at this time, the City's current PMP incorporates local and ongoing maintenance strategies with seal coating occurring as needed (at 5 to 7 years, again at 12 to 14 years) with a bituminous overlay at approximately 20+ years. Overlaying the roadway located within the project area, which is presently at the 20+ year time frame, will prevent further decay of the pavement surface, thus protecting and extending the structural life of the streets. Timely maintenance work, such as bituminous patching, crack sealing and seal coating have occurred at appropriate intervals during the life of the pavement in the area. Trotters Ridge /Stafford Place 9 1 The City of Eagan's maintenance records indicate that these streets were seal coated in 1992 and 2002. The Public Works maintenance program typically includes extensive patching and crack sealing during the summer prior to the overlay. The Public Works crews, as part of the Preparatory Pavement Management Plan, removed and replaced deteriorated pavement areas and placed leveling and maintenance overlays on portions of the streets under consideration, where necessary. These repairs alone will not substantially extend the life expectancy of the street section if not combined with the bituminous overlay proposed with this project. The Public Works Department has also inspected the utility infrastructure (sanitary sewer, water main, and storm sewer) in the project area and determined the system is in good working order and that no major repairs are necessary. Scope This project will provide resurfacing (edge mill and overlay) for approximately 2 miles of residential roadway. Figure 2 in Appendix C, illustrates the project limits. Included in this project are the following improvements: replacement of damaged curb and gutter, adjustments and /or replacement to sanitary /storm sewer utility castings, water gate valves, street signage, and pedestrian ramps. Feasibility and Recommendations The mill and overlay project is necessary to maintain and enhance the structural integrity of the pavement section, create a safer driving surface, and increase ride ability. The mill and overlay project is cost effective in that the proposed improvement (resurfacing) is considerably less expensive than complete reconstruction of the streets. Trotters Ridge /Stafford Place 94-)-, 2 The mill and overlay is feasible in that this type of improvement has been used successfully to extend the life expectancy of numerous other streets throughout the City and the region. This project is in accordance with the Five Year Capital Improvement Plan (2011— 2015) for the City of Eagan and the schedule as outlined in the Pavement Management Program. It is recommended that the project be constructed as proposed in this report in combination with other similar projects in the area. Street Evaluation The City of Eagan's Pavement Management System allows the City to evaluate the condition of the existing street surface to help schedule timely maintenance and improvements. The Pavement Condition Index (PCI) ranks the surface condition for each street. The general categories that define PCI rankings are as follows: PCI Recommended Improvement 56-100 Routine Maintenance /Crack Seal /Seal Coat 36-55 Patch /Repair and /or Overlay 0-35 Reconstruct/ Reclaim The 2010 PCI rankings for the street segments have a weighted average pavement condition rating of 55 for Trotters Ridge /Stafford Place, which falls in the rankings of the "Patch /Repair and /or Overlay" category, as mentioned above. The street pavement has reached an age where, based on the City's past experience, the integrity of the pavement can rapidly decline if no improvements are performed. Therefore, the 2011 construction season is the optimal time to construct the bituminous overlay on this street. Any delay of the project may reduce the structural benefit to the street sections and require full reconstruction. Trotters Ridge /Stafford Place 3 �t3 Proposed Improvements Pavement - The proposed street - improvements for Trotters Ridge /Staffordf Place are shown in Figure 3. The existing - street section for this roadway consists of Y 3" bituminous pavement supported by 6" - gravel base. The existing bituminous surface will be milled adjacent to the existing curb and gutter (6' -8' wide) to ro ` accommodate a 1% -inch bituminous overlay. The overlay, combined with the existing street section, will provide a street section consistent with current City standards for residential streets. The combination of patching and overlay will not eliminate cracking due to the temperature extremes experienced in Minnesota. Bituminous overlays will show some continued frost movements and reflective cracking consistent with the underlying pavement. Routine maintenance will still need to continue under the City's Pavement Management Program. Concrete curb & gutter - Damaged curb & gutter will be replaced if severely -,y cracked, spalled, or settled. It is T estimated that approximately 20% of the L _. existing concrete curb and gutter will have to be replaced. Boulevard turf will be removed and replaced. While the contractor who performs the work is responsible for its establishment in the first 30 days after placement, adjacent property owners are encouraged to consistently water the new turf, where possible, to help ensure its growth. Trotters Ridge /Stafford Place a+ 4 Signage - All traffic control and street identification signage within the project limits will be replaced due to diminished reflectivity, deteriorated support posts, and the signs or posts no longer meeting City and State standards. Sidewalk /Path & Pedestrian Ramp — Revisions to the Americans with Disabilities Act (ADA) requires jurisdictional agencies to provide detectable warnings at all existing pedestrian ramps of sidewalks and paths with public streets that are improved, including street surface improvements. The most common method of providing this detectable warning is through the installation of truncated domes a minimum of two feet in length across the width of all pedestrian ramps. This project provides for the installation of truncated dome pedestrian ramps along the existing trail. Trotters Ridge /Stafford Place �'� 5 Easement /Permits All work will be in the public right -of -way. No additional easements will be necessary. It is anticipated that no permits will be required for the resurfacing project. Cost Estimate Detailed cost estimates are located in Appendix A. The estimates are based on anticipated 2011 construction costs and include a 5% contingency and indirect cost of 30 %, which include legal, administration, engineering, and bond interest. Assessments Assessments are proposed to be levied against the benefited properties for the total improvement with costs allocated in accordance with the City of Eagan's Special Assessment Policy for a mill and overlay improvement for residential streets. The estimated cost per single - family lot to be assessed based on the City Assessment Policy is $866/lot and is calculated as follows: 50% x $348,300 (Overlay and Signage Cost) $866 201 (Residential Lots) Residential Lot Assessment Financing Options The property owner will have the option at the time of the assessment hearing to pay the full assessment or include the assessment in with their property tax statement. If the assessment is included with the property tax statement, the assessment will be spread over five years with the interest determined by the results of the bond sale used to finance the improvements. Presentation of Project Details • Gorder welcomed the property owners and presented project information, including details such as construction, costs, schedule and assessments. B. Questions/ Comments • What authority does the City have to assess our properties? Minnesota statutes provide authority for local agencies, including cities, to assess costs of improvements to benefiting properties. The City has been consistent in its use of this authority, under the guidelines of its Special Assessment Policy, in assessing these types of street improvements to about 14,000 properties. • Will we be able to access our driveways during construction? The edge mill & overlay construction will provide a hard surface for vehicles at all times during the project. There may some limited access for short periods of time during curb replacement and manhole adjustment. Access to some driveways will also be limited if curb replacement is adjacent to driveways. Room for on- street parking will be provided while new curb in front of driveways cures, or hardens. • How long will this street improvement last? The wear and tear of the house construction traffic is essentially done. The combination of the structural strength of the new overlay pavement, along with less wear and tear from traffic, should extend the pavement life another 20 years. • Who attends the public hearing? It is held as part of the regular Council meeting, so the City Council, City staff (Administrator, Public Works Director, Attorney) and interested citizens are all in attendance. As part of the public hearing, the Council provides the opportunity for anyone interested in the project to speak and provide input to the Council. • Will the sealcoating still be needed after the project? Routine maintenance will still need to continue under the City's Pavement Management Program, including sealcoating every 5 to 7 years to prevent pavement oxidation. The principal structure setback requirement is 30 feet from any public right -of -way, 10 feet from the side property line and 15 feet from the rear property line. Modifications to the existing storm sewer within Deerwood Drive are necessary to accommodate the proposed shared driveway for Lots 1 and 2. Utilities — The preliminary utility plan is acceptable. The existing house on proposed Lot 3 (1565 Johnny Cake Alcove) is connected to City utility services. Water service is readily available to the proposed homes on Lots 1 and 2 from the existing 18 -inch water main in the south boulevard of Deerwood Drive. Sanitary sewer service is available in the north boulevard of Deerwood Drive and will require the extension of an 8 -inch public sanitary sewer across Deerwood Drive by the developer. A Magellan high - pressure gas line runs along the north end of proposed Lots 1 and 2 within a private easement in favor of Magellan Companies. Streets /Access /Circulation — Public street access for the existing house on Lot 3 is from Johnny Cake Alcove to the south and will remain unchanged with this development. Public street access for Lots 1 and 2 is available to Deerwood Drive via a shared driveway, consistent with other similar developments to the east along Deerwood Drive (Engstroms Deerwood 2 nd Addition). Because Deerwood Drive is a collector roadway with relatively high traffic volumes, the driveway to Lots 1 and 2 should be constructed with a vehicle turnaround, in accordance with City standards. The driveway entrance apron onto Deerwood Drive should be constructed with concrete in accordance with City Engineering standards. Right -of -Way /Easements — All work within the Deerwood Drive right -of -way necessary for the development of Lots 1 and 2 (concrete driveway apron, sewer /water service stubs, stone sewer modifications) should be completed with the Final Subdivision. A private access agreement, covering the shared use of the driveway to Lots 1 and 2, in a forte acceptable to the City attorney, should be prepared and executed by the developer at time of Final Subdivision approval. Although this subdivision will generate additional stormwater runoff within the City, its relatively small size affects the feasible and prudent implementation of stormwater management standards. According to City Code §4.33 and consistent with historical practice, the City may waive installation requirements and instead require a cash payment to satisfy stormwater management standards. There are no wetlands associated with this site. Parks and Recreation — This development shall be responsible for a cash park dedication and a cash trail dedication for the two newly created lots based on the rates in effect at the time of Final Subdivision. The previous plat dedicated a 10 foot drainage and utility easement on the rear (east) lot line. We are proposing to vacate 5 feet of the easement to leave a standard 5 foot easement on the side lot line of the proposed lot. Two different grading schemes are proposed for the lots, so the fixture buyer /builder will have two options: Option A is a Tuck Under with the shared driveway along Deerwood Drive, Option B is a Walkout with the shared driveway between the lots and climbing up to the garage elevation. The proposed lots would access Deerwood Drive to the north, and be served from existing utilities. The sanitary sewer will be extended via directional boring to the manhole at Deerwood Drive and Fawn Way. The water will be tapped off of the existing 18" Water Main south the Deerwood Drive. The site drainage will flow north and east as it has to date, and the existing catch basins in Deerwood Drive will be adjusted for the driveway access. There is an existing overhead powerline and a 12" petroleum product pipeline along the south side of Deerwood Drive that will remain. The powerline and pipeline are located in existing easements. Approvals for the crossing of the pipeline with sewer and water services and the driveway are being sought with the utility owner Magellan LP. To summarize, the subdividing of the parcel into two additional lots will benefit the public by utilizing the available density, adding two conforming lots to the neighborhood, and increase the tax base to support efficient use of the public improvements and services to the area. NORTHEAST EAGAN REDEVELOPMENT DISTRICT — REQUEST FOR EXTENSION OF DEVELOPMENT TIMEFRAME FOR BLUE GENTIAN CORPORATE CENTER ACTION TO BE CONSIDERED To approve (or deny) an extension of the timeframe for the first phase of development of the Blue Gentian Corporate Center in Redevelopment District #2 -5 to May 1, 2013 and to authorize the EDA President and staff to execute the necessary documents. FACTS: • At its meeting of March 6, 2006, the EDA and City Council approved a TIF Development Agreement between the City and MG Eagan for the redevelopment of property in the Northeast Eagan Redevelopment District No. 2 -4. Since that time, the City and the developer have completed the assembly of the redevelopment property and the developer has received approval for the development of the Blue Gentian Corporate Center project. • In addition, the City approved the decertification of a portion of District No. 2 -4 and the recertification of a new TIF District No. 2 -5. • On June 17, 2008, the EDA and City Council approved an amendment of the original TIF Development Agreement for the property to align the term of the agreement with the term of the recertified district. • The amended agreement reflected a requirement of state law, that if after one year of the sale of property by the City to the developer, the developer has not commenced development of the property, the City has the option to repurchase the property from the developer. The agreement was amended on April 7, 2009, to permit McGough additional time to market the property. • While company has actively marketed the site, it has not been able to secure a tenant for the first phase of the development to date, due to the state of the office development and construction financing markets. The legal requirement is intended to provide the City to step in if a developer is not actively pursuing the development of the property for the intended use in a timely manner. • The developer has requested an additional extension at this time. In consideration of the developer's efforts and the effect of the current economy on development activity, the requested extension may be in order at the discretion of the EDA.
