March 2, 2011 Mr. Brian Christopherson Stone Cottage Construction, Inc. 14815 Energy Way Suite 200 Apple Valley, MN 55124 Re: 4900 Biscayne Avenue Dear Mr. Christopherson, As was discussed earlier this week, it is my understanding you are taking over the building permit for the new home being constructed at 4900 Biscayne Avenue. I've been informed that you will be requesting a Temporary Certificate of Occupancy (TCO) within the next week or two. Please be aware that due to the proximity of the nearby wetlands and storm water retention basin the City has serious concerns over potential contamination of these resources due to construction on your site and what has been inadequate erosion control on the project. Because of the deep snow cover we are not able to properly inspect and assess these areas and won't have this opportunity until well after your TCO is issued. In an effort to keep your project moving forward the City is willing to accept a financial guarantee in the amount of $3,000 in order to ensure these important tasks are addressed in a timely manner, as soon as conditions allow in the spring. City staff visited the site yesterday to assess what conditions they could. From what is currently visible on site, the following list of items will either need attention or may need attention but can't be determined because of the current snow cover. Also included is the dollar break down for each item that was used to arrive at the $3,000 amount. 1. Sediment removal from the wetland and/or storm water retention basin: $2,000 2. Replace damaged "natural area" sign posts (2): $100 3. Re- establish natural area (seed and erosion blanket): $500 In addition to the above items all erosion control must be in place and installed properly prior to the City issuing the TCO. This includes, but is not limited to, all perimeter control, seed and mulch on all areas that have exposed soil and a properly constructed and maintained construction entrance.
