ITEM OVERVIEW: Discussion and recommendation for a policy regarding exhibiting art in City of
Eagan public buildings.
BACKGROUND/HISTORY:
Eagan Parks & Recreation seeks to create a policy in order to allow the display of artwork in City
of Eagan public buildings. The goal of this action is to strengthen our community identity
through increased public awareness and appreciation of art.
ANALYSIS:
Staff has researched policies regarding art exhibits in public areas from several other public
agencies. A number of examples are included for your review. In addition a draft policy has
been written to allow a format for commission discussion.
DISCUSSION/EVALUATION:
Please review the examples and the draft policy. Developing a policy will provide the APrC and
City Council with a guideline and reasoning for explaining /justifying decisions relating to public
art exhibits.
ALTERNATIVES FOR COMMISSION CONSIDERATION:
1. Recommend the approval of the draft policy to the City Council.
2. Recommend the approval of an amended draft policy to the City Council

Position Statement: Eagan Parks and Recreation seeks to increase public awareness and appreciation of
the arts in our community through visual art exhibitions in City of Eagan public buildings. These
exhibitions will strengthen community identity while creating visual interest in City of Eagan public
buildings.
Eligibility & Selection Process
City of Eagan
Art Exhibit in Public Buildings Policy
• Exhibits are open to emerging and professional artists ages 18 and above. Youth exhibits may
be scheduled as special exhibits.
• Media: All 2 -D artwork must be exhibit - ready, clean, dry, and wired for hanging. Hanging three -
dimensional art must be no deeper than six inches. All artwork must be less than 251bs. No saw
toothed hangers will be accepted. 3 -D artwork must not exceed 12" x 12" x 12 ". There is
limited exhibit space for 3 -D artwork.
• Exhibits are open to solo artists or small groups of artists
• Selections will be based on artistic quality, originality, and presentation and will be selected by
Eagan Art House staff. The Director of Eagan Parks & Recreation reserves the right to determine
suitable subject matter for exhibit.
• Artwork may not be obscene and shall be appropriate in terms of local community values and
for family oriented facilities. Nudity and graphic violent images will not be accepted.
• Artwork should reflect the following:
o Nature & Environment
o Eagan's Community Identity
o Eagan's Community Spirit
Exhibit Information
• Up to 6 exhibits per year will be scheduled at the Eagan Community Center. Artwork will be on
display for up to 12 weeks per exhibit. Accepted artists will be notified of exhibit schedule
approximately 6 weeks in advance.
• There will be a participation fee of $10.00 per piece, not to exceed $50. This fee will be credited
toward any commission paid from the sale of artwork. This fee covers administrative, staff,
equipment and promotional expenses associated with the exhibit.
• Sales: The public will be encouraged to purchase the artwork in this exhibit. A 25% commission
is required for all sales. Artists are required to submit and invoice for payment, less 25% to the
City of Eagan. Artists must have a Minnesota sales tax id # to collect payment. Purchased
artwork must remain on exhibit until the exhibit is over.
• Artist is responsible for hanging, identification tags and removing artwork by the scheduled
deadline. Artwork must be hung using the Eagan Parks & Recreation hanging system. There
will be a $50 equipment deposit. Deposit will be returned upon completion of the exhibit if all
equipment is accounted for and in working order. Hanging, take down and equipment return
must be coordinated with Parks & Recreation staff.
• All artwork must have an identification label securely attached to the back or bottom of the
work.
• Publicity: City of Eagan Parks & Recreation reserves the right to photograph any work in the
exhibit for educational, catalog, Internet or publicity purposes.
• Liability Waiver: Reasonable care will be taken in handling artwork, but no responsibility is
assumed by the City of Eagan, their staff, or customers for any loss, theft or damage to your
property. Your signature on the Liability Waiver and submission of artwork indicates acceptance
of these conditions.
• Insurance: There will be no insurance coverage. Artists interested in insuring their artwork must
make their own arrangements.
Application Process
• Submit attached application.
• Submit 5 -15 high resolution digital images on a CD or external hard drive. You may also e-mail
your images to the Eagan Art House. JPEG format is preferred, max 1 mg each.
• A list of the images, date of work, title, medium and dimensions.
• Artist statement about the work. If applying for a group, include a brief description of the group
and the thread that ties the work together.
• Stamped, self- addressed envelope for the return of your CD /ext drive if desired. Otherwise,
Eagan Parks & Recreation will not return materials.
• We will not review images in any other format than described or download images from your
web site.

I , acknowledge and agree that participation in the Eagan Parks and Recreation art
exhibits (the Art Show) to be conducted at City of Eagan public buildings, involves the possibility that my
property, including, without limitation, any art or other items on display (collectively, the "Property ")
may be damaged, lost of stolen, and I acknowledge I am assuming the risk of loss of the Property by
participating in the Art Show.
I am aware that and Eagan Parks & Recreation does not insure the Property, and that I must provide my
own insurance if I so choose.
For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I
agree to release and hold harmless the City of Eagan, their staff, directors, officers, agents, affiliates and
customers from any and all liability, cost or expense (including, without limitation, attorney's fees)
arising out of my participation in the Art Show including without limitation, any claims for damages, lost
or stolen Property. I further agree to indemnify and hold harmless the City of Eagan, their staff,
directors, officers, agents, affiliates and customers, from any and all loss, damage, liability, cost or
expense that the City of Eagan may incur or suffer as a result of any claim of any kind whatsoever arising
out of my participation in the Art Show.

The mission of the "Art Around BPAC" program is to support the visual arts in our community.
Artwork by local artists will be displayed throughout our building on a rotating basis for the
enjoyment of our patrons and visitors. This opportunity allows artists to market and potentially
sell their artwork. Artists who are interested in displaying their work are encouraged to submit
an application for consideration.
Eligibility & Selection Process
• "Art Around BPAC" is open to emerging and professional artists ages 18 and above.
• Individual artists working in any visual 2 -D medium may submit an application.
• 3 -D works are not currently being reviewed.
• BPAC will consider artwork that reflects the Center's design, architecture, and mission.
• Selections will also be based on artistic quality, originality, and presentation.
• Applications will be accepted on an ongoing process.
• Artwork will be selected by BPAC staff. We reserve the right to accept or reject any
artwork submission.
• BPAC staff is responsible for installation, including location designation and hanging.
• All artwork must be ready to hang with a secure wire. No saw -tooth hangers allowed.

Art Rotation Program — Guidelines
• Artwork will be displayed in the upper or lower lobbies or within the theatre offices.
• A label with the artist's name, title, medium, and price will be located on the wall next
to the artwork. The labels will be created and provided by BPAC.
• Artwork will be displayed for a 6 month rotation or until artwork is sold.
• Burnsville Performing Arts Center charges a 25% commission on sold artwork.
• All participating artists are required to sign a liability waiver during art drop -off.

Gladstone Community Center Public Art Space Exhibit Operating Policy
Mission Statement
The Mission for the Gladstone Community Center Public Art Space is to increase public
awareness and appreciation of visual arts by providing a setting for exhibition and education.
Exhibit Schedule: The Gladstone Arts Commission intends to conduct up to 6 exhibits per year in the art display
areas of the Gladstone Community Center. Each exhibit may last up to six weeks. Both the displaying artist
and affiliated gallery must commit to the full time period for display. Time will be allowed at the end of each
exhibit for needed maintenance to the display areas. The schedule of exhibits will include at least one juried
North Kansas City School District student art show per year.
Security: The Community Center will provide a security camera in the public art space, which will be monitored
by Community Center staff. Insurance on exhibited works will be the responsibility of the artist. The artist will
sign an agreement holding the City harmless for liability due to damage, destruction or theft.
Frequency of Display: A selected artist may not have exhibited in any medium within the past two years in the
Gladstone Community Center as a featured artist.
Selection: The Selection Committee will be appointed by the Arts Commission to choose the exhibition contents.
The selection committee will be comprised of representatives of the Arts Commission, City staff, and
professional artist(s). The recommendation of a specialist may be solicited to supplement the expertise of the
Selection Committee. The Selection Committee will submit its recommendations to the Arts Commission for
final selection of works to be exhibited. Acceptance or rejection letters will be sent to each submitting artist after
selections for display have been finalized. The selections made by the Arts Commission are final.
Selection Process:
• The artist will submit five (5) digital images of the works and types of work they would choose to exhibit
along with the completed application form.
The applications and digital images will be received by the Director of Parks and Recreation and
forwarded to the Selection Committee. Submissions should be addressed to:

• The Selection Committee will review all work submitted and present its recommendations to the Arts
Commission for final selection. The Parks and Recreation Department will notify each submitting artist
of the Arts Commission's final selections.. Exhibits will be scheduled up to 12 months in advance of the
commencement date for each exhibit.
• Selected artists must sign a contract agreement with the City of Gladstone.
• All exhibited paintings and photographs are required to be matted or framed.
Selection Criteria. Selection of works will be based upon artistic merit and suitability for display in a family
oriented facility. Submitted works will be selected for recommendation by the Selection Committee, and
selected for display by the Arts Commission, based on the judgment of the members of those committees. All
decisions made by the Selection Committee and Arts Commission will be final.
Deadline for Application. Artists who wish to be considered for the upcoming year must submit digital images
and application forms to the Parks and Recreation Director no later than the first Sunday of July for exhibits to
be conducted in the following calendar year. Selection notifications will be sent to each artist by the first Sunday
in September.
Insurance will be the sole responsibility of the artist. The artist must provide proof of insurance to the City prior
to installing any work for display. The City accepts no responsibility for Toss or damage to works of art
displayed in the Community Center.
Sales Policy: Each artist will be allowed to offer works for sale and will provide a price list to the Community
Center staff. The City will retain a 30% sales commission for each piece sold and will be responsible for
payment of the Missouri State Sales Tax. Purchasers will make checks payable to the City of Gladstone. In the
event of a credit card sale the City will retain a 33% sales commission. Payment for sales, less the City's
commission, will be mailed to the artist within 30 days following the removal of art from the Gladstone
Community Center. The artist must supply the following information to the City prior to the exhibit to facilitate
the processing of payments:

Exhibit Opening: The Arts Commission will hold an opening reception for each Exhibition. The exhibiting
artists will be required to be present and will receive invitations for personal invitees. All exhibits will open on
the first Tuesday of the month, in which the Exhibit is to begin, from 7:00 PM to 8:30 PM.
Exhibit Installation: Each artist is responsible for the installation of artwork with the assistance of a member of
staff and a curator - representative of the Arts Commission. The Artist must schedule a time for installation that is
mutually convenient to the staff and curator. In some cases staff may act as a designated curator -
representative of the Arts Commission. The artist will assist with installation of artwork. The artist will provide
any special materials, tools, and equipment necessary for displaying their artwork. The artist agrees not to
damage or alter any surface or equipment in the Gladstone Community Center Public Art Space. The artist
agrees to return the Gladstone Community Center Public Art Space to its original condition after the conclusion
of the Exhibit.
Publicity: The artist will provide City of Gladstone Arts Commission with a reproduction grade image of each
artwork exhibited. At least two images must be submitted no later than the press release information due date
designated by the Arts Commission for use in publicity materials. The artworks selected for publicity materials
should be of works that reproduce well in black/white and color. Digital files should be submitted on a CD and
must be labeled with name, address and telephone number, the title, medium, dimensions, date, and with the
top of the work identified. Each image must be submitted in JPEG or TIF format. Each image must be at least
300 dpl and readable by Adobe Photoshop.
The artist will also submit a completed Press Release Form including resume, biographical information, and
other information for publicity purposes.
The City will provide publicity for each Exhibit in the Parks and Recreation brochure, on the City website,
through news releases to all media, and through a mailing list of galleries, artists and art patrons. Each artist is
permitted to provide additional publicity at the artist's expense.
Artist's responsibility: Each artist will exhibit his /her own original artwork. It will be the responsibility of the artist
to deliver or ship (at his /her expense) accepted work in accordance with the exhibit schedule. Each artist will
provide a complete list of titles and sales prices of exhibited work no later than 7 days in advance of the opening
of the Exhibit. Each artist will affix labels to his /her work. No labels or other signage will be attached to the
walls of the Gladstone Community Center display area. Each artist agrees to leave his/her work on exhibit until
the conclusion of the Exhibit. Each artist will pick up all works not sold no later than one week after the
conclusion of the exhibit. A $50 fee will be imposed for each work picked -up after the deadline.

Community Art Exhibit
The Dakota County Public Art Citizen Advisory Committee seeks original works of art for its first community art
exhibition. Artists are invited to submit art per the guidelines below. The Puplic Art Citizen Advisory
Committee shall review submissions and make recommendations to the Dakota County Board of
Commissioners, which will select works of art for display in County buildings.

Works of art selected for exhibit will be displayed in public spaces in Dakota County buildings for a period of six
months.
Eligibility
Works of art may be submitted by any Dakota County resident age eight years and older.
Types of Art Work
Works of art must be original. Works of art must be produced in a form which may be hung, including, but not
limited to, drawings, paintings, or graphic art.
Conditions and Restrictions
A person may submit only one work of art.

• Subject Matter — The themes of this Community Art Exhibit are:
1. Portraits of Dakota County
2. Reflections of Dakota County
3. Secret Places of Dakota County
• Originality — artworks must be one -of -a -kind or part of an original limited edition.
• Artistic Excellence — artworks must be of high quality and aesthetic merit.
• Appropriateness to Site — two- dimensional works may not exceed 12 square feet in area.
• Condition — works must be ready for hanging, with screw eyes and wire attached. Extra wire must be
allowed for hanging adjustments. Saw tooth hangars will not be accepted. Paintings must be dry and
must be framed unless the edges constitute an integral part of the painting.
• Durability — artwork must have such structural and surface integrity that no more than routine
maintenance will be required.
• Safety — artworks may not have physically hazardous attributes.
• Restrictions — artworks will be on loan to Dakota County for a period of six months. The art will be
displayed after the artist and the County have entered into a written agreement regarding the display.
Artists will relieve the County for responsibility for any damage to the art.
• Community Values — artworks may not be obscene and shall be appropriate in terms of local
co j iunity values.

1. Member Group Exhibitions
Each fall members of Friends of the HCA are invited to submit work for a select, juried
exhibition and each spring members are invited to participate in a nonjuried show.
(Entry forms are mailed to members.) Both shows are judged for awards.
2. Off- the -Wall Member Spotlights
Friends members are also eligible to apply for an off - the -wall showcase which is
displayed on the east wall of the second floor lobby. Interested members should contact
Lynn at 952 - 979 -1107 to sign up for a three -week showcase.

Special Exhibitions
These shows explore an artistic medium, form, genre, culture or theme and often
include an educational or outreach component. We accept proposals from members or
nonmembers, from individuals or organizations, from artists or curators.
HCA or the Friends of the HCA do not pay artists to exhibit or to develop exhibition
ideas.
exhibition terms
1. HCA receives a 25% commission on exhibited work. HCA handles all sales and
requires sold work to remain in the show until it closes.
2. HCA has the right to promote the exhibition, including using artists' names and
reproducing images of their work. HCA must approve all promotion done by an
exhibiting artist.
3. Artwork must arrive ready for installation and labeled with the artist's name and
title of the piece. Artists are responsible for installing their own exhibitions.
4. HCA reserves the right to:
• refuse or remove work that it deems a hazard to the facility or its guests.

special exhibition selection process /criteria
Proposals are reviewed by a committee of artists and community members in February
of each year. Proposals may be submitted at any time but must be postmarked no later
than February 1 to be reviewed that same year. You are notified of results by April 1.
Selection criteria include the quality of the work to be exhibited and how the work will
aid in providing a diverse and exciting exhibition schedule. The potential for community
involvement and educational and interpretive content may also be considered.
A solo exhibition may require up to 40 images /works. HCA may suggest combining
proposals into shows if the work complements each offer.
HCA is not responsible for loss or damage of submitted proposal items.

The Plymouth Fine Arts Council (PFAC) and the Plymouth Parks and Recreation
Department sponsor monthly art exhibitions in the Plymouth Creek Center and the
Plymouth City Hall using the following guidelines:
• All exhibiting artists must be members of the Friends of the Arts organization, which
supports the mission of PFAC. See membership form.
• Send artwork samples (representative photographs, digital photos, slides, or
artist website) with Artist Agreement and Waiver Form to be juried by PFAC
panel. When approved, exhibit period will be confirmed with artist. Only artwork that
meets general community standards will be displayed. PFAC reserves the right of
refusal for any pieces that do not meet this guideline.
• The displaying artist is responsible for hanging and dismantling his /her own display.
The artist must provide any needed assistance. The date and time of the display
being hung and dismantled will be coordinated through the PFAC City Liaison.
Artwork to be hung on the walls must have an attached hanging wire on back.
The artist will provide:
• an information tag for each art piece indicating the work's title, artist name,
selling price (or NFS) and media (if desired).
• an information sheet with a short biography /artist statement
• list of exhibit pieces with prices (or not for sale) with artist contact information
This information will be duplicated and on display at the Recreation
Department at the Plymouth Creek Center and City Hall reception desk.
• The display will be in place at the Plymouth Creek Activity Center for one month
including installation and take down. Artists will then transfer their exhibit to
Plymouth City Hall for the following month. The same guidelines apply to the
installation and take down of an exhibit at both sites.
• Any and all purchase inquiries will be forwarded directly to the displaying artist.
Sales of any of the displayed artwork will be handled directly with the displaying
artist. If any of the exhibited art work sells as a result of the city displays, the
Plymouth Fine Arts Council will collect a 15% commission.

The above named artist agrees that his /her artwork, to be displayed at the Plymouth
Creek Center and Plymouth City Hall on the dates indicated, is at the risk of the artist.
The artist waives any and all claim against the City of Plymouth or the Plymouth Fine
Arts Council, their agents or assigns, for any Toss or damage to the artwork in
connection with the hanging, exhibition, and removal of the above referenced display.
The artist agrees to pay the Plymouth Fine Arts Council a commission of 15% of the
selling price of any artwork that sells as a result of the city displays.
The artist shall indemnify the City of Plymouth and the Plymouth Fine Arts Council, their
agents or assigns, any and all liability resulting from the negligence of the artist, his /her
agents or employees, and shall reimburse the City for any loss or expense incurred by
association by reason of such negligence.
