In order that there is a quorum present, please contact Mary O'Brien at 651- 675 -5005 if you are unable to attend this meeting. I. ROLL CALL AND ADOPTION OF AGENDA The agenda, as presented or modified, is in order for adoption by the Commission. II. APPROVAL OF MINUTES The min tes of the February 10, 2009 Airport Relations Commission meeting are enclosed on pages through , . These minutes, as presented or modified, are in order for adoption by the ommission. III. VISITORS TO BE HEARD The Eagan City Council and its Commissions set aside up to ten minutes at the beginning of public meetings to permit visitors to address items of interest that are not addressed on the regular agenda. Items that will take more than ten minutes or that require specific action can be scheduled for a future agenda. W. OLD BUSINESS A. Communications Update — It is the practice of the Airport Relations Commission to discuss their communication initiatives each month, which include articles in the Experience Eagan Newsletter, as well as stories aired on the City's local access cable channels. An article will be included in the next Experience Eagan newsletter regarding the upcoming closure of the north parallel runway. The Commission is welcome at this time to make additional suggestions for communication initiatives regarding airport issues. B. MAC Monthly Reports – Eagan/Mendota Heights Corridor Analysis/Technical Advisory Report/17 -35 Departure Analysis Report – Enclosed on pages Le through ( t is the January 2009 Eagan/Mendota Heights Corridor Analysis. Enclosed on pages through is the January 2009 Technical Advisory Report. Enclosed on pages throughgl_ is the January 2009 Runway 17 Departure Analysis Report. The January reports were the most current reports available on the MAC website at the time of packet preparation. It is the practice of the Commission to review the reports and discuss any significant deviations that may have occurred or any other noteworthy occurrences as reported in the analyses. V. NEW BUSINESS VII. ROUNDTABLE a A. Dialogue with MAC Commissioner Bert McKasy –Bert McKasy, commissioner from the MAC, has been invited to the March ARC meeting to discuss the NWA/Delta merger and how it will be affecting the airport and Eagan residents. Commissioner McKasy wi1J also be vering a general update on the happenings at MSP Airport. Enclosed on page through is a list of preliminary questions that have been sent to Commissioner McKasy for review. VI. STAFF / COMMISSIONER REPORT //��,,,, A. Update: Phase 2A Noise Mitigation Program – Enclosed on pages through is a memo from Gary Warren, Director of Airport Development at the MAC, regarding the windows /doors construction contract that was issued to Flannery Construction, Inc. Flannery Construction has been unable to acquire a performance bond that is required for the construction documents. MAC staff recommends rescinding previous action and rejecting the bid from Flannery Construction. MAC staff also recommends rejecting all bids from Dec. 16, 2008 with the intent to redefine and re- advertise for bids to be received in March 2009. John Nelson, a Mac staff member, was contacted to determine if there were going to be delays due to the rebidding process. Mr. Nelson indicated that the AC installation process would proceed as normal but the installation of doors and windows in the $4000 installation package would be postponed 2 -3 months. B. Upcoming Vacancies on the ARC —There will be five terms that will become vacant on the ARC at the end of April 2009. Four of those vacancies are 2 -year terms and one is the 1 -year alternate term. Those interested in serving on the ARC are encouraged to fill out an application which is available on the City of Eagan's website at www.cityofeagan.com or by calling the City Administrator's office. Applications are due March 27, 2009. Per the request of the Commission, this agenda item has been added so that Commissioners have the opportunity to ask questions or make requests for future agenda items. VIII. ADJOURNMENT Per the request of the Commission, the Eagan ARC meetings will go no later than 8:30 p.m. unless agreed upon by the Commission. Administrative Intern 3 MINUTES OF THE EAGAN AIRPORT RELATIONS COMMISSION MEETING FEBRUARY 10, 2009 A regular meeting of the Eagan Airport Relations Commission was held on Tuesday, February 10, 2009 at 7:00 p.m. Those present were Curtis Aljets, Steve Beseke, James Casper, Beth Prouty, Carol Shattuck and Chad Stambaugh. Also present was Administrative Intern Matt Kline. AGENDA Shattuck made a motion to approve the agenda as presented. Beseke seconded the motion. All members voted in favor. APPROVAL OF MINUTES Beseke made a motion to approve the minutes of the January 13, 2009 regular meeting of the Eagan Airport Relations Commission as presented. Prouty seconded the motion. All members voted in favor. VISITORS TO BE HEARD There were no visitors to be heard. Aljets invited residents to voice their concerns regarding airport noise at a future ARC meeting. COMMUNICATIONS UPDATE Kline introduced the item stating a short article will be appearing in the next Experience Eagan Newsletter regarding the upcoming reconstruction of North Parallel Runway. MAC MONTHLY REPORTS — EAGAN/MENDOTA HEIGHTS CORRIDOR ANALYSIS/TECHNICAL ADVISORY REPORT /17 -35 DEPARTURE ANALYSIS REPORT Aljets introduced the item and gave background on the December reports. Aljets noted that 92.2 percent of the Eagan Mendota Heights Corridor operations remained in the corridor, which was down from last month at 96 percent. He also commented on the Technical Advisors Report regarding the number of noise complaints for the month of December. Aljets noted that nighttime operations were at 7.4 percent, totaling 80 departure operations off Runway 17. Aljets noted December had 123 operations off Runway 17 to Chicago along with 84 off Runway 12L and 12R. The Commission discussed the Eagan/Mendota Heights Corridor Analysis Report and requested Kline to question the MAC regarding Runway 17 departures to Chicago and departures to Chicago from the parallel runways 12L and 12R. Kline will report findings at the March ARC meeting. IMPLEMENTATION OF NORTHWEST AIRLINES' RUNWAY 12L, 12R AND 17 RNAV DEPARTURE PROCEDURES Aljets introduced the item stating the trial for Runway 17 RNAV procedure will begin on February 23, 2009. Aljets and the Commission discussed the RNAV procedure and noted this will allow the FAA to Eagan Airport Relations Commission February 10, 2009 Page 2 of 2 more accurately position operations over Eagan, while also discussing the affect of the concentration of operations to Eagan residents. SPECIAL MEETING OF THE MAC / NWA DRAFT TERM SHEET Aljets introduced the item. The Commission discussed the revised term sheet between the MAC and Northwest/Delta Airlines which MAC approved at the January 26, 2009 meeting. UPCOMING RECONSTRUCTION OF THE NORTH PARALLEL RUNWAY (12L /30R) Aljets stated the North Parallel Runway is expected to be out of operation due to reconstruction from August 17, 2009 through October 30, 2009. Aljets stated, per Chad Leqve, that during the runway closure, approximately 16 to 18 percent of operations will depart off Runway 17 and 31 to 33 percent will depart off 30L. Also, Aljets noted that 30 to 31 percent of arrivals will take place off Runway 35 and 20 to 21 percent will arrive on 30L. He stated the most noticeable impact on Eagan will be an increase in arrivals on Runway 17/35 and, if the projected 30 percent of arrivals do occur on Runway 35, this will be twice as many arrivals that would normally use that runway in a typical month. MAC NOISE MITIGATION PROGRAM Kline introduced the item regarding the noise mitigation program currently underway as the result of the settlement in the cities litigation versus the MAC. Kline stated in summary, the Eagan homeowners who have selected to receive central air conditioning, the $4,000 package; their homes will be mitigated in 2009 and, for those homeowners who have selected the approximate $14,000 package, their homes will begin to be mitigated in 2010. He further stated the reimbursement program for residents is also underway; however, actual monetary reimbursements from the MAC will not begin until March 2010. Kline stated residents should have received a letter, but they can also call the MAC or the City and through address and neighborhood information can find out where they fall on the mitigation lists. MARCH ARC MEETING / COMMISSIONER MCKASY Aljets stated MAC Commissioner Bert McKasy will be attending the March 10, 2009 ARC meeting and will provide a MSP update and give any insight he may have on the implications of the Delta/Northwest merger. Aljets noted if Commissioners have questions for Commissioner McKasy in advance of the March meeting, please forward them to Matt Kline by phone or email. Kline suggested forwarding specific questions to Commissioner McKasy by the end of February. I believe the MAC needs to communicate anticipated impacts as soon as they know what NWA /Delta is doing to reduce the number of employees in the local area. The communication needs to be in a realistic way to affected communities so they can plan for the changes without scaring or exaggerating the problems. What estimates does MAC have for the job loss for Eagan residents with Delta and industries that serve the airline? How many employees will be laid off, given early retirement, or released from employment at MSP because of the merger and when will this happen? Is there any coordinated effort by the MAC, Met Council, State or other governmental entities to assist the laid off employees? Examples would include retraining, development of bonding zones to encourage new business, recruiting new businesses with tax incentives, etc. Merger Communication What is being done to communicate the impact of the merger to the adjacent communities such as Eagan? Airport Facilities What is ultimately planned for Northwest's current world headquarters in Eagan? What is being done to fill the facilities vacated by NWA /Delta? Delta Fleet and Noise What is the age of Delta's fleet that it will be using at the MSP airport and how does this affect noise concerns that Eagan residents have? (JD 1 want to further fine tune the question regarding the age of the fleet that Delta plans to fly out of MSP. What are the fleet types of the planes Delta plans to fly out of MSP? Does Delta have a plan in place to phase out the older planes? What planes does it plan to replace the older ones with? Delta Business and Minnesota /Eagan Residents Do you think the merger agreement does enough to keep Delta's business functions in Minnesota? Noise Mitigation Program — Phase 2A i. Windows /Doors (106 -6 -351) DATE: February 10, 2009 In January 2009, the Commission awarded. the Windows /Doors construction contract (106 -6 -351) for the Phase 2A Noise Mitigation Program to Flannery Construction, Inc. Unfortunately, Flannery Construction, Inc. has been unable to provide the Commission with a satisfactory performance bond which is 'required by the construction documents. Without the performance bond MAC is unable to enter into a construction contract with Flannery Construction, Inc. for this project. Staff therefore must recommend that the Commission rescind its previous action and reject the bid from Flannery Construction, Inc. Unfortunately, the other bids received for the Windows /Doors construction package ranged from $9.9 million to $11.8 million (see Attachment 1), which significantly exceeds the construction estimate of $8,551,576. Staff believes it is in the best interest of the Commission and the Noise Mitigation program to reject all of the bids received on December 16, 2008 for the Windows /Doors Phase 2A project, and that the project be redefined and re- advertised for bids to be received in March 2009. - With the rejection of all bids the Commission also needs to revise the project budget approved by the Commission in January to reflect the reduced contract award amount at this time. Therefore, for budget purposes and to account for the possibility of the numerous variables in the yet to be completed designs and work scopes for each individual home, staff is recommending a combined construction budget of $3,750,000 be established for the Insulation and Asbestos Abatement construction packages in Phase 2A, resulting in an approximate 9.2 percent contingency for project adjustments.
