June 14, 2011 Mr. John Niehaus 3839 Mill Run Lane ir l `I Eagan, MN. 55123 Re: City Contract No. 11 -02 Citywide Street Overlay Improvements Dear Mr. Niehaus, First of all, let me apologize for the misunderstanding of the timing of this letter. As I stated in my last voice mail message, I didn't feel it urgent to get the letter to you because all of our public contracts have a two year warranty for repair of defects that the contractors are bound to by law. Any work that is determined to be out of specification or faulty in that two year period will be repaired at the contractor's cost. I can assure you that you would not be assessed for those repairs, if needed. In response to your request for a statement that you would not be assessed for any other road projects in the near future, I can only inform you that the City's (Council approved) Capital Improvement Plan (CIP) shows your street having sealcoat maintenance done in 2016. Other than crack seal work, 2016 is the next scheduled year for street maintenance work in your area. As of now, we do not assess for sealcoat maintenance so you would not incur any road assessment costs with that work. As always, that could be subject to change with future budget considerations but for now, there are no assessments related to sealcoat or maintenance. Prior to the sealcoat work, there will be crack sealing done to prevent water from getting into the sub -grade (gravel base) of the road and creating freeze /thaw problems. Again, there are no assessments related to crack sealing at this time either. I have attached the map portion of our Capital Improvement Plan related to the sealcoat maintenance for your review.
