Dear Mr. Endres,
It has come to the City's attention that the home you recently completed at the
above address has a retaining wall constructed on the east side of the lot and a
portion of it is within the drainage and utility easement. In addition, the wall
crosses the property line and is encroaching onto the neighboring property by
approximately 10 feet.
The wall must be removed from the neighboring property as well as the easement
as soon as possible. To insure compliance with this serious matter the City has
placed a hold on issuing the Certificate of Occupancy for the home. As a
reminder, per City Code, any retaining wall over 4 feet in height (measured from
the bottom of the buried blocks to the top of the wall) requires a building permit
and engineered plans. It also appears that portions of the irrigation system may be
encroaching onto the neighboring property in the same area. If this is the case
then the irrigation layout should be adjusted to insure that it is placed completely
on your property.
Please let me know when you have completed the relocation work as well as
subsequent grading so City staff can perform a follow-up inspection prior to
releasing the hold on the Certificate of Occupancy. If you have any questions or
