July 11, 1974
On July 2nd, I closed the purchase of the property running
from Janet M. Kehne to the City of Eagan covering 5 acres where
her home is located.
I received a warranty deed and am now recording the deed
with the Register of Deeds. I also received a signed lease and
it is important that there be adequate insurance covering the
property. I delivered a check for $51,000.00 and $500.00 in
earnest money which had been paid previously. 1 am also enclosing
a check in the Rum of $250.00 as the house rent for 1974 payable
to the City of Eagan from Janet M. Kehne. I have paid the real
estate taxes for the last half of 1974 with the check drawn by
Mrs. Kehne.
Also, I am enclosing the following documents:
1. Signed copy of the purchase agreement dated January, 1974.
2.Cateck from Janet M. Kehne to the City of Eagan in the sum
of $250.00 dated July 2, 1974, for rent.

The Minnesota Department of Natural Resources, Division of Parks and Recreation,
will administer the Minnesota Bicycle Trail Assistance Program for the 1975 fis-
cal year. As in fiscal year 1974, a total of $150,000 is available for bicycle
trail construction. The program will again be operated on a grants -in -aid, cost
sharing basis with the State's share being 65% of the development cost.
In order to accommodate local units of government which have projects scheduled
for this summer, we are setting a deadline for applications. All applications
for fiscal year 1975 funds will be due by July 15, 1974. A determination of each
project will be made and grants will be awarded as soon after July 15th as possi-
ble.
If you would like to discuss your bicycle trail project, I would be happy to ar-
range a meeting. Please contact me at 612- 296 -6669 if I can be of further assis-
tance.

As you are aware, the Area Office recently conducted field monitoring
of your Open Space project. We are concerned that although adequate
project information is being maintained, it is not maintained in a
manner which permits rapid inspection.

to owners plainly explaining the acquisition process and stating
oars' rights.
2. No written Offers to Purchase with Statement of Basis for Just
Compensation or comparable statement were sent to owners.
3. A resolution was passed for each parcel stating that fair market
value was to be paid for each; however, the fair market value
price determination was not stated in the resolution.
We hope that these cents will help Eagan in facilitating future
and acquisition. If one can offer any information concerning federal
land acquisition policy, please contact us.

RE: Proposed Eagan Park Acquisition
Dear Martin:
When we talked on June 10 about the possibility of Eagan acquiring
10 acres of park land from you South of Pilot Knob School, you asked
that we get into writing some of the suggestions that we discussed.
It should be understood that these are only suggestions and not
intended to be in the form of a firm offer for purchase nor should
they be used in the future in the event that condemnation becomes
necessary.

The suggestion has been made that dedication of 10 %c the 40 acres
be made and the balance of the 10 acres be purchased outright. It
should be understood that the dedication of the land to the South of
the school property is not necessarily an indication of average value
of all of the land owned by you because of its low lying nature.
Because Eagan has acquired two appraisals which average approximately
$5,000.00 per acre, it is suggested that Eagan pay you $5,000.00 per
acre for 6 acres, also the outstanding balance on the green acres for
a three year period which we estimated at about $7,000.00 to $8,000.00
and the outstanding assessments on the property of approximately
$2,000.00 on the 10 acres for a totalc.of about $39,000.00 to $40,000.00.
Four acres would be dedicated directly by you and possibly,- contract
for deed covering the purchase of the 6 acres could be set up whereby
less than 30% could be paid in the first year and the balance over a
5 year period. The contract could be drawn so that in the event that
development of the park is to take place in the second year or later,
that the balance of the purchase price could be paid off at the time
of development.

2. Lexington South - Ed Dunn
A. Attached is a copy of the overall park and trail plan for Lexington
South. Also attached is a colored drawing illustrating a revision
in Neighborhood No. 26. The neighborhood park has been expanded
to include dedication of an area for "active recreation."
The athletic area adjacent to Northview Elementary School would not
be dedicated. This area would be reserved for the next several years
for possible purchase by the City. The Planned Development Agreement
would detail the method of purchasing this site.
B. According to the developer, he is exceeding the new park dedication
requirements. Attached is a copy of his calculations, These do not
include the additional park area described above in Neighborhood No.26.
The figures have not been verified by planometering each area, however,
this will be done.
C. It is recommended that parks, trails and ponds proposed to be dedicated
under the Lexington South Planned Development be accepted . in concept.
The details related to phasing of dedications, and the athletic area will
be spelled out in the "Planned Development Agreement." This agreement
will be prepared after the July 2nd public hearing on this Planned
Development.
Final approval by the Park Committee would be later this summer after
your review of the written agreement.
