PAUL), MINNESOTA 55122 (612) 454-4224 September. 5, 1974 You will recall that we have discussed the Green Acre deferred tax implication on the Burow property which has existed since some months after we closed the acquisition of 1973. Minneapolis Office Suite 2210 • IDS Center Minneapolis, Minnesota 55402 (512) 335 -5361 At the time of closing I was lead to believe that there would be no green acre tax payable and in fact we were permitted to record the documents and complete the transaction without payment of the green acre tax. You will also recall that Eagan agreed to pay taxes and assessments on the property and that we started with an agreed upon figure of approximately $181,000.00 and increased it by about $11,500.00 which constituted the real estate tax for thecurrent year together with all assessments unpaid. I have reviewed this matter with the county attorney, the county auditor and the attorney for the seller and the county's position is that the money must be paid. The property owner through her attorney has indicated that she is unwilling to pay it and it appears that the law although not entirely clear would require payment by the buyer. This in effect is an involuntary conversion through condemnation and the statute provides that the buyer upon condemnation picks up outstanding taxes. I received a copy of an opinion from the County Attorney through the County Auditor indicating that the money should be paid and I discussed this matter with Carl Onischuk on several occasions. I would therefore recommend that taxes be paid and I assume that we can avoid any penalty on the tax. A survey of the property is desirable and in the event of a plat, this of course will automatically be furnished. 3. An abstract of title brought up to date covering the parcel of land to be dedicated which should be delivered to the City Attorney or in his discretion an up to date title opinion by an attorney for the developer covering the same property. PAUL August 22, 1974 The Metropolitan Council recently approved the sale of $35 million in bonds to finance the acquisition of regional parks and open space within the seven county metropolitan area., One of those sites in Dakota County is located partly in Fagan, Apple Valley and Rosemount. This particular sight is an expansion of the present county park known as Holland-Jensen. I am enclosing a map describing this site. The red colored area is the sight for the proposed state zoological garden purchased h>> the county for purpose's of cst.Jhlislung a state zoo; the blue area is presently owned county park land; the green area is proposed park acquisition. Negoti- ations with the property owners as shown in the greenarea, especially on the west and east end of the proposed area which 1 have marked with an "X ", will begin within the next few weeks. We will not he acquiring any houses until we have acquired some of the • large holdings under one ownership. Some of the homes within the site may not he acquired at all. The Pete Schaffer property is one area with homes we would like to acquirer hut it nay or may not he possible lo do so 1 .. _ 1 1. 612 - 4 3!Col There may be a flurry of development action in and around this area now that the county has committed to the purchase of these lands and bonds have been sold rnaking the funds available. We shall try to acquire these lands as rapidly as possible. Eagan will receive from the Metropolitan Council cash payments in lieu of taxes for the land being purchased. THE HUB E WILL NUT BE LENT OUT dITHOUT UNE OF THE REGULAR CREW GOES WITH IT. BASE iLUUDING Two men on the tank truck every night. Two men on another truck plus regular crew. ore can either get volunteer's or hire part time men. This flooding would be just covering the rink with water and get out. Let it freeze then another coat until there is a built up layer of good ice. The base will depend on when we get cold weather for this purpose. 1VVA1NTANCE iLoODING The heavy flooding will be done at night, so it can freeze solid before it is used. The lighter flooding can be done early in the morning. Darning Christmas vacation the work will be done at night, due to heavy ice ueeage darning vac ation. After vacation the regular hours can be used. Bill branch will work out how the guy's will be paid and the hours for the guy's. v'hen there is a heavy snowfall the guy's will work untill all the rinks are clean. V n0?OTD i V C X n - - o <D mz Z " p C T r - m XI -4 O Z I - RESOLUTION WHEREAS, a regular meeting of the Eagan City Council was held on 1974, all metbers being present; and WHEREAS, the Council reviewed recommendations of the Eagan Park Committee relating to the formula and general requirements regarding perk dedication in new subdivisions in the City including ponding for park purposes, trails and private recreational developments; and WHEREAS, the City Council determined that by Resolution it would adopt regulations concerning the going issues to supplement the general requirements of the Ordinance No. 10, the subdivision ordinance in addition to Resolutions adopted earlier by the Council relating to Park dedication requirements; NOW THEREFORE, upon motion duly made by and seconded by , it was RESOLVED as follows: 1. Where Land is to be Dedicated for Public Parks, Playgrounds, Trails, or Public Open Space, the following Formula shall Guide said Dedication: 1. Area Requirements /t-is the policy of the City to require ten percent (lOX) of the total area of a new subdivision to be dedicated for public park purposes. Where none or only a lesser amount of the area is found suitable by the City Council for public park use, the difference shall be made up by cash contribution. 2. Pondin1 Where a pending area has been determined by the City Council to have park functions and is to be dedicated for public park purposes, credits shall be generally determined as follows: (a) A minimum of seven percent (7Z) of land above the high hater mark must be dedicated before any credit for ponds is granted. (b) There shall be a public access to at least fifty percent (50%) of the total shoreline of any pond before any park dedication credits are granted. (c) Only fifty°ypercent (502) of the total area of pond dedicated shall be credited as park dedication (e.g. 6% pond ■ 32 park dedication). (d) Duplicate credits shall not be given for ponds or ponding that are dedicated and credited as a part of the City's Storm Drainage System. Trails Where trails are to be dedicated by developers for public park purposes, credits shall be determined by the Council as follows: (a) Internal Trails: There should be no credit for internal trails. These are defined as trails which meander through residential projects in close proximity to dwelling units. These trails lead to 'primary trails"; as such, they serve to replace the sidewalks. These trails should be encouraged, howevey, to take advantage of the "Primary Trail Systems." (b) Primary Trails: These trails are those shown on the "Trail Guide Plan Map" of the Park Development Guide. These trails will be maintained by the City, whereas internal trails will be maintained by the abutting property owner or a homer owners association, whichever is applicable. Park Dedication Credit shall be given for Primary Trails which are a minimum thirty (30) feet wide. 4. Private Recreational Credits shall be given, however, where the developer constructs recreational facilities including trails in accordance with City Specifications, on property that is completely under the control of the City. Such credits shall be determined by the Council upon recommendation of the Park Committee. II. General Requirements Relatin& to Park Dedication 1. Fee Title for Parks It is recommended that Where land is contributed for a proposed park intended to be developed for recreational purposes at some future time, the fee title be transferred to the City of Eagan according to the subdivision ordinance requirement at the time that the first building permit is acquired. 2. Area. Computation Computation of the land area to be dedicated shall be determined according to the ordinance by the City Council upon recommendation of the park committee as-to the location, size and determined on the basis of the value of the land within the subdivision. 3. Primary Trails. Generally, primary trails should be acquired in the form of easements rather than fee title. The reason for acquisition of an easement is that in the event that the city determines that at some time in the future that it wishes to abandon the trail, it may vacate by public hearing. The vacated trailway would then attach to the abutting land owners. In certain circumstances, however, the City Council may upon recommendation of the Park Committee, determine that title in fee should be acquired from the developer for primary trails. 4. Existing Easements Park dedicstionT:credits for primary trails located in existing private or public utility easements shall be granted to the extent of 50% of the normal credit. S. Technical Requirements In the event that fee title is acquired from a developer, certain requirements should be met: (a) The developer shall deliver to the City a Surveyor's Certificate shoving the exact legal description of the park area to be dedicated or the centerline of the trail easement. In the event that the trail easement is a meandering trail in width, than an exact description of the boundary lines of the trail easement shall be delivered by the developer to the City. (b) The developer shall be required to deliver proof of ownership in the form of an abstract of title or other satisfactory proof as determined by the City Attorney. 6. Dedication by Easement or Deed The general rule shall be that easements and park land shall not be granted by the plat but rather that the dedication be made by separate approved documents described by an outlot or platted lot. In addition, it is preferrable to accept the easement as a "trail easement" rather than eg. "Pedestrian easement". The wort "nonmotorised" may be accepted under certain circumstances. 7. Exceptions Exceptions to the ordinance requirements as to donation of cash or a dedication of property shall be granted only upon determination by the Cit -Co&ncil after recommendation of the Park Committee.
