Hauge RE: Trail Opinion Dated: May 6, 1974 A recent opinion of the Attorney General dated April 11, 1974, Number 469 Al2 questioned whether a statutory city similar to Eagan has legal authority to accept easements for trail purposes which are of limited duration of 2 or 3 years. The Attorney General indicated that such an easement of a limited duration is proper in carrying out any proper city purpose. The establishment of pedestrian and other public pathways constitutes such a public purpose under M.S.A. 412.211 Subd.(6) and the Village of Kennedy -v- Sorenson, 251 Minn. 397, 88 NW2nd 89 (1958). The second question asked of the Attorney General was whether a city may agree in consideration of the conveyance to defend and indemnify the grantor of the easements in the event that the grantor is named a party in a lawsuit in connection with a condition or activity taking place on the land over which the easement extends. Again the Attorney General said that it would be proper under M.S.A. 412.221 Subd. (2) where a city may enter into contracts necessary to make effective any power possessed by a city council. In Port Authority -v- Fischer, 269 Minn. 276, 132 NW2nd 183 (1964) the uses of public funds were laid out in detail. The main objective is that the purpose is not to promote some private end. TO: Eagan Park Committee and City Council PROM: Paul R. :auge RE: Cash Donations for Parks Date: May 6, 1974 At a meeting of the Park Board Committee on Thursday, ipril 25th some guidelines were recommended for payment of cash donation for park purposes by developers and the following is a summary of suggestions: 1. One issue came up because certain developers have found that it is difficult to make cash donations at the commencement of construction of their projects or acquisition of building permits in light of the present interest rate.. 2. it was recommended that an *attention of time be granted to developers in the City of Eagan or payment of cash contributions for park purposes under the Eagan ordinance granting an extension of time on all projects other than R*1 and R -2 until an occupancy permit is granted. This policy is temporary and should be reviewed by the Council by November 1, 1974. The cash donation for park purposes should be determined at the time of payment on the basis of the required amount in existence at the time of acquisition of the building permit. Hauge DATED: May 3, 1974 The following are several recommendations being made to the Park Com- mittee and City Council regarding contribution of land by developers in the City of Eagan for park contributions pursuant to the Ordinance # #10. 1. Fee Title for Parks It is recommended that where land is contributed for a proposed park intended to be developed for recreational purposes at some future time, the fee title be transferred to the City of Eagan according to the Ordinance requirement at the time that the first building permit is acquired. 2. Area Computation M E M O Computation of the land area to be dedicated shall be determined according to the ordinance by the City Council upon recommendation of the park committee as to the location, size and determined on the basis of the value of the land within the subdivision. 3. Primary Trails Generally primary trails should be acquired in the form of easements rather than fee title. The reason for acquisition of an easement is that in the event that the city determines that at some time in the future that it wishes to abandon the trail, it may vacate by public hearing. The vacated trailway would then attach to the abutting land owners. In certain circumstances, however, the City Council may upon recommendation of the Park Committee, determine that title in fee should be acquired from the developer for primary trails. 4. Existing Easements Park dedication credits for primary trails located in existing private or public utility easements shall be granted to the extent of 50% of the normal credit. 5. Technical Requirements In the event that fee title is acquired from a developer, certain requirements should be met: MEMO TO Council and Park Committee RE: Land dedication for Park Purposes DATED: May 3, 1974 a. The developer should deliver to the City a Surveyor's Certificate showing the exact legal description of the park area to be dedicated or the centerline of the trail easement. In the event that the trail easement is a meandering trail in width, then an exact description of the boundary lines of the trail easement should be delivered by the developer to the City. b. The developer should be required to deliver proof of ownership in the form of an abstract of title or other satisfactory proof as determined by the City Attorney. PHH:ras 6. Exceptions Page 2 Exceptions to the ordinance requirements as to donation of cash or a dedication of property shall be granted only upon determina- tion by the City Council upon recommendation of the Park Committee. 7. Dedication'by Easement or Deed The general rule shall be that easements and park land should not be granted by the plat but rather that the grants be made by separate approved documents described by an outlot or platted lot. In addition, it is preferrable to accept the easement as a "trail ease- ment" rather than eg "pedestrian easement ". The word "nonmotorized" may be accepted under certain circumstances. We have located a source of mature White Pine trees which we can obtain through Dakota County at minimal cost and are pro- posing to transplant them to this area. We pare asking for your approval of this planting plan, per- mission for us to plant approximately 40 trees on your property a and just inside the park fence to provide a visual barrier beitween the residential and industrial property, and $750.00 as partial payment for the trees and rental of the tree spade. We will provide the manpower and the truck and other equip - ment necessary to move the trees from their present location and will water they after they are planted. We will also absorb all costs over the $750,00 estimate which could be considerable due to the fact that it is difficult to anticipate the amount of time required to complete such a project. The planting plan is approximate and we would not plant on the steep slope and would place the trees closer to each other to compensate for the elimination of the second row in that area as per our telephone comversation last week.
