That tower was constructed in 1996 pursuant to a CUP, which predates the current antenna tower ordinance. The City adopted a new communications tower ordinance in 1997 that allows communication towers in Agricultural districts only as an accessory use, to a height oFup to 60 feet, and such towers aze not to be used for commercial purposes. The VFW property is zoned Agricultural and the existing tower is 100 feet in height and was designed for co-location, to accommodate a second user at 80 feet. This tower was conforming to city codes at the time it was constructed. Co-location is encouraged in the current ordinance, and this tower was designed for colocation, this second commercial antenna on the existing tower structure is consistent with the intent of the ordinance and in keeping with the Conditional Use Permit. 3. Said Conditional Use Permit shall run with the land as long as all conditional use standards are met. 4. Said Conditional Use Permit shall be subject to conformance with the Eagan City Code and with the conditions set forth herein to include, but not limited to: ? avi Additional Conditions: ?l.
