II. A. City Administrator, Tom Hedges will report on recent Council actions which include the following: Approval for Park Director Schmidt to attend Bike & Pedestrian Trail Seminar in Chicago July 19, 20 and 21, 1978 C. Authorization for a survey of the South line of Thomas Lake Park Authorization to purchase a used aerator Approval of a change order for a second gate in the Pilot Knob Tennis Courts Approval of grant contracts for Rahn Thomas Trail, Rahn Tennis Courts and Pilot Knob Bikeway and related financing Action in Oak Pond Hills Mr. Hedges may also wish to update the Park Committee regarding the DNR hearing on 35E. 1. Park Construction Contract A report on the Park Construction Contract is enclosed for your review. 2. Recreation Reports Recreation reports from Rec Programmer Dorothy Peterson on the Summer Program and on the qualifications of the Summer Staff are enclosed for your review. 3. Carlson Lake A request has been received from Dave Peterson, 1300 Balsam Trail, to have Carlson Lake Park stocked as a children's fishing lake. The DNR will check the lake as to its suitability for this purpose and stock it next Spring if the City makes the request, if public access is available, if the lake will support fish life over winter and if the City agrees to be responsible for cleaning up any dead fish which may result from winterkill. The Park Committee may wish to authorize the Park Director to request this action after evaluating its potential impact on the Park System. 4. Pre - Construction - Conference on Pilot Knob Bikeway a report on the meeting is enclosed for your information and review. Fy 1979 Lawcon State Grant Program Suggested Projects in order of priority 5. Burr Oak Park Ball Diamond A letter from residents of Burr Oak Park regarding the request for a ball diamond is enclosed for your information. Park Director Schmidt will report on the possibilities of this installation at the meeting. 6. Evergreen Park Accident • Memos on an accident at Evergreen Park and a resultant meeting with the neighbors are enclosed for Park Committee discussion. Also inclosed is an opinion from the attorneys office related to this matter. 7. Pilot Knob Heights Park Dedication The matter of additional park dedication for this area was researched, as directed by the Park Committee at their last meeting. All committments for the entire PUD were satisfied with the dedication around Fish Lake per information from the City Attorneys Office. 8. Eagle Scout Project Mike Schimmels, from Roger Martins Boy Scout Troop,is interested in building and installing wood duck houses in some of the City Parks. See letter from Park Director for disposition of this request. 9. Wilkinson Land A letter from the attorney for the estate of. E. Sandra Wilkinson inquiring as to whether the City would be interested in purchasing land for the park system has been received and will be reviewed by the Park Director., 10. Special Meetings The Park Committee may wish to review the amendment to the Regional Trails Plan and decide whether they wish to comment and /or appear at the meeting. Development Proposals A limited amount of information on 2 development proposals by Fortune Realty is included for your review. City Staff will be meeting with the developer Thursday afternoon and will have additional information available at the meeting. The developer will also be present at the meeting. The Park Committee will have to consider whether they wish to recommend cash or land dedication in these areas. Currently we own portions of peninsulas or islands on Thomas Lake. The Section 32 neighborhood park needs will also need to be evaluated. At both locations the classes for 5,6 F 7 year olds are larger than the classes for 8-12 year olds. Fifty -four of the children marched in the Eagan 4th of July parade. Work begins this week on the recital scheduled for August 3 at 7:30PM at Pilot Knob School. Please attend this charming event if you possibly can. Teen Center The Rahn Building is open from 7 -10PM Mondays through Thursdays for area teenagers. Attendance has been 25 -40 youngsters a night. They play ping -pong & foosball, volleyball - some checkers and chess. The two leaders are very enthusiastic about the program. The park maintenance crew has noted a definite improvement in the area around the building. The main entryway is no longer strewn with garbage and cigarette butts daily, no further scribbling has appeared on the doors. We feel the teen center is working. Tiny Tots Sixteen Youngsters were registered for the Monday - Wednesday morning session; 1 for Tuesday and Thursday. The program is in the Rahn Building from 10- 11:30AM. We would have accepted up to 25 registrations for each session this year. Publicity was limited to prevent more requests than we could handle. The groups as they developed are of good managable size. The three leaders are very enthusiastic about the program. The first day was hectic as we had not forseen the impact mothers who stayed would have. (Only their children cried!) Now that we have gently asked mothers to leave, the children are having a wonderful time. In fact they do not want to leave when it's time to go home! In the future, ideally, tiny tots would be available at each park site. Problems to be considered are: Available staff, how to limit enrollment, could budget be expanded to cover salaries. Summer In the Park Over 400 children were registered at the playgrounds the first week. At Evergreen where the program is new 86 children had registered. We have not taken another count since the first week. 204 children went to Apple Rollerway for the first field trip. 182 will go ice skating, 196 to the Zoo and 210 will be at the all park event. We did go to an all inclusive permission slip for field trips this year. It has worked very well. From a staff viewpoint all collection of money is over, children who registered after the first two weeks have b-en no problem. Only one negative phone call was received and we were able to accomodate her special problem. The playgrounds are open Monday- Thursday from 1 -4PM at Cedar School, Woodhaven, Rahn Park, Evergreen and Pilot Knob School. Monday Wednesday at Burr Oaks,Tuesday & Thursday at Lexington. Stop by to visit if you can, join a bubble gum blowing contest, a game of capture the flag or make the craft project for the day. Memo To: City Council Members From: Dorothy Peterson, Recreation Programmer Date: June 26, 1978 Re: For Your Information In view of the questions raised regarding the summer staff at the last council meeting the following added information is provided to verify the quality of the individual chosen. The. goal of the Park and Recreation Department is to staff each playground with one adult with experience in working with children and two teen -age aides who have experience in crafts and games. Tumbling and dance teachers must have experience in working with children and have a personal background in gymnastics or dance. Tennis instructors must have experience in playing the game and /or demonstrate their ability to teach at the time of the interview from their responses to questions regarding teaching methods. The limited number of hours, we can offer an applicant, rarely more than 15 per week in anyone position, creates difficulty in hirii.g quality people. It therefore becomes necessary to ask one individual to work in more than one area or be forced to take a lesser qualified applicant. This will not require a change order as the bid specifications call for unit pricing and since the distance is minimal the contract award price could accomodate this addition without going over the award figure. Neighbors are still removing sod from the area. Trail construction should begin July 17th. May have to add a couple culverts or put dips in pathways. Barb Schmidt requested that she be present when this is determined. One culvert will be located south from where it shows on the plan. Will begin at South end. AREA CODE 612 TELEPHONE 454 -4224 You have asked our office to research the question of the City's liability for injuries due to mishaps in ponds on City property. The City is subject to tort liability unless specifically exempted by statute. In this case negligence might exist since property owners have a duty to take reasonable precautions under the circumstances then existing if a danger is foreseeable. The reasonableness of the precautions will depend partly on the ease of repair or correction. Peterson vs. Balach 199 NW 2d (1972). In addition, if protective measures such as fencing are taken, if these attract children, they might increase the danger to children and increase the exposure of the City to liability. However, if a child overcomes an obstacle and places himself in a place of danger, the landowner is not liable. Hocking vs. Duluth, M & I. Ry. 117 NW 2d 304 (1962). The use of signs to warn of danger would reduce the City's exposure to liability. Hanson vs. Christiansen 145 NW 2d 868 at 875 (1966). Once the City takes it upon itself to take precautions, it must make sure that the precautions are undertaken with reasonable care. Persons using the parks must also use reasonable care-to protect themselves. However, even if there is negligence, the City is exempted from liability for performing or failing to perform a discretionary function or duty even if the discretion is abused. Minnesota Statute §466.03. A policy decision is generally discretionary, so a decision on whether or how to prevent mishaps in ponds would probably not subject the City to Liability, unless the City has liability insurance, in which case the liability would only be to the extent of policy coverage. Minnesota Statute §466.06. Even if the City is not subject to liability, the question remains as to how to make the ponds safe without increasing the danger to the public. Considerations of cost and aesthetics might also come in, since fences and - signs could be expensive, and could detract from the beauty of the parks. Page 2 June 28, 1978 Beyond the general summary stated above, the case law will not be very helpful in deciding how to proceed, since the facts of each case are so different. Discussed cost of replacing pond with storm sewer pipe esti- mated at $1000.00 per affected lot. Explained that citizens should petition for a feasibility study if they wish this. Discussed dangers of fencing pond and creating an "attractive nuisance ". Mrs. Kluender, mother of child who nearly drowned was very insistent that if tennis courts can be fenced, so can ponds. Wants kids protected, feels bigger kids can handle it. Mrs. Krech, mother of other child did not second this. Walked out during part of this discussion. Finally one brave man and wife, Mr. and Mrs. Smith noted that it was a problem for the parents. Mentioned that it could have been the road and would there then be a request to fence the road? Another resident, Larry Morgan ( ?) stated that a good lesson had been learned by all kids in the neighborhood. City agreed to check slope beneath water areas and eleminate any quick drop offs that might exist. Park Department crews of City Engineer will measure depths of both ponds and any shaping will not be an assessment. Char Berg asked for one more picnic table near tennis court. Some citizens mentioned how much they enjoyed the park and appreciated the improvements that had been installed. July 7, 1978 Re: Item for 7 -10 -78 Council Meeting Regarding Resolution on Pilot Knob Road Bike Trail Park Director Schmidt has received a final approval letter from 1M Dot for a grant to cover 75% of the funding for Pilot Knob Trail. MnDot is also requesting a resolution from the City agreeing to finance any cost in excess of the grant award. A completed copy of MnDot's sample resolution is enclosed for Council review. The City Clerk may wish to redraft the resolution prior to the Council meeting to follow Eagan's usual resolution format. The Council should determine the source for Eagan's portion of the cost of this project. Previous sidewalk and trail projects ordered in as seperate projects by the City have been financed as follows: Asphalt Pathway to Metcalf School - Dakota County Road and Bridge Funds Sidewalk on Rahn Road East of Rahn School - State Aid Road Funds Asphalt Pathway to Pilot Knob School - Road and Bridge Funds Sidewalks on Rahn Road leading to Cedarvale - assessed to Apartment and commercial property Wilderness Run Road Bike Trail - 65% Department of Natural Resources Grant 35% Park Bond Funds Pilot Knob Bike Trail Project Costs Contract Award $19,870.00 Cost for Signs 595.60 Total $20,465.60 75% Amount of Grant $15,349.20 25 (C-i\cka—LsL_ ' — \� =1 � '_emu �� -'►-- Memo To: City Administrator, Tom Hedges From: Park Director, Barb Schmidt Date: July 10, 1978 Re: Item for July 10, 1978 Council Meeting The State Legislature appropriated $600,000.00 ($300,000.00 for the Metro area) in additional funding for tennis court projects, just before its adjournment this spring,for the Athletic Court Grant Program. Eagan's 1978 grant application for 2 additional courts at Rahn Park had previously been ranked too low to be considered but with the new funding ae are now eligible to receive a 50% grant for the installation. The grant award is in the amount of $14,500.00 and excluded lighting for the existing courts,which we had originally proposed there was a limit of 2 courts per community. It would be most cost effective to light all four courts at the time the new ones are built. The grant is intended to cover 50% of the cost of construction only and administrative expenditures are not allowable. Therefore, the cities share for the project as planned would be greater than 50% the total cost and would include the entire cost for lighting existing courts and for plans, specifications, and supervision of the construction. Project Cost Grant Award $29,000.00 (2 courts $14,500.00 with lights) 8,500.00 (lights for existing) 4,500.00 (12% Administrative) $41,750.00 City's Share $14,500.00 8,250.00 4,500.00 $27,250.00 There are no available funds in the Park Site or Park Bond Funds to cover the city's share of this project. However, the City can special levy for funds for matching grants. • Three copies of a contract for a grant award in the amount of $14,500.00 from the State Planning Agency are enclosed for signature by the Mayor, City. COPJSIDEBATIONS "i :is property has the potential of providing some very desirable home sites because of the rolling, wooded topography and proximity to Thomas Lake. Approximately 1/2 of the total area in contained in Thomas Lake and the land portions of the property have a very irregular topography. 1. `lle proposed plan is generally designed, however, several engineering; concerns still r'ernain. In particular, the intersection of the proposed cul -de -sac and Cedarcrest. Lane should be at 90 °, a portion of the proposed cul -de -sac right -of -way appears to be belcw the hi3h water line, a portion of the proposed road would require a substantial aanou t or fill, and some of the details are missing on the plat such as lot areas, the name, and the _'oposed street names. i Since this plat borders -on Cliff Road, the plat would have to be reviewed by the Dakota .County Plat Committee. 3 . Since this plat covers . a substantial amount of shoreline, it would be desirable to have an Environmental Worksheet prepared. 4. An approximate 6.acre outlot is proposed along the north edge of the plat. This borders on the existing park land which was purchased a few years ago by the City. This has not been reviewed by the Park Committee and there may be interest in having a portion of this property dedicated to the City in Order to satisfy the park dedication requirements for this plat. In any instance, this matter should be reviewed by the Park Committee for recommendations prior to any final approvals by the City Council.
