1665 Woodgate Lane - Cancelled Addition Permit & (Incorrect) Easement Determination

RE: 1665 WOODGATE LANE
On July 29, 2003, Home Enhancers questioned if they could get a refund for Building Permit
#58921 issued 5/02/03 to construct an addition and deck at 1665 Woodgate Lane.
A pipeline easement runs through the back of this property. In July 1994, a building permit to
construct a room addition and deck was issued to Powers Construction Company.
In July 2003, Owners, Karen and Don Landin, contracted with Home Enhancers to widen this
addition by 9', as well as add another deck. After ordering building materials, Home Enhancers
was informed by the Owners that Nancy Opdahl, representing Northern Natural Gas, telephone
#952-887-1735, told them the gas company would not allow this expansion as it encroaches into
the gas company's easement.
Nancy Opdahl further advised the Owners that the easement appeared to be improperly marked
on the survey. A line drawn on the survey has wording "Northern Natural Gas Easement" and
should say "Northern Natural Gas Pi'peline", making the easement area 30' on both sides of this
line. As a result, the existing addition and deck were built into the easement.
Stan Lexvold, the City's Construction Supervisor, met with Karen Landin at her home on July
30th to discuss this matter. Karen informed Stan that they would not construct this addition and
were considering installing a hot tub instead.
A permit applicatiori and hot tub requirements were mailed to the Owners on July 31, 2003.
Home Enhancers was asked to send a letter to my attention requesting a refund.
