III. HOURS OF OPERATION FOR OFF -SALE LIQUOR ESTABLISHMENTS
DIRECTION TO BE CONSIDERED: To provide staff with direction regarding a potential
ordinance amendment to off -sale liquor establishment hours of operation.
FACTS:
➢ At the April 17 Listening Session, the City Council directed staff to place a review of the
permitted hours of operation for off -sale liquor stores on a Special City Council agenda.
➢ Under current City regulations, liquor stores may be open from 8 a.m. to 8 p.m. Monday
through Thursday and 8 a.m. to 10 p.m. Friday and Saturday. Per State Statute, the latest
a city may allow liquor stores to be open is 10 p.m.
➢ Attached is a survey of the off -sale liquor store hours of operation allowed in nearby
communities. The survey was conducted in April at the request of the City Council. The
responses were also provided in the April 13 Additional Information Memo. Staff also
contacted nearby cities with 10 p.m. closing times and learned that none of the
communities have had any significant issues with a later closing time.
➢ A survey of all off -sale liquor stores was also conducted in April per the direction of the
City Council. Five stores expressed a preference for maintaining the 8 p.m. closing time.
Nine stores supported a 10 p.m. closing time. Two stores did not respond. Also attached
is a summary of the feedback.
➢ Per the direction of the Council, staff notified all off -sale licensees that the Council
would be reviewing the permitted hours of operation at the June 12 City Council meeting.
Licensees were invited to attend the workshop and /or provide written testimony.

The Eagan City Council is considering a change to the permitted hours of operation of
off -sale liquor stores. The Council will be discussing issue at a Special City Council
meeting to be held on Tuesday, June 12 at 5:30 p.m.
Under current City regulations, liquor stores may be open from 8 a.m. to 8 p.m. Monday
through Thursday and 8 a.m. to 10 p.m. Friday and Saturday. The Council will be
discussing potential changes to the City's 8 p.m. closing time on weekdays. Per State
Statute, the latest a city may allow a liquor store to be open is 10 p.m.
As an off -sale liquor license holder, the Council invites you to attend the Special City
Council meeting to provide testimony about how a change in the permitted hours of
operation would affect your business. The meeting will be held in the Eagan Room at the
Eagan Municipal Center, 3830 Pilot Knob Road.

Dear Christina,
Due to prior commitments I regretfully will not be able to attend the scheduled Special City
Council meeting on June 12 Therefore, I am providing this written comment of my position
on the agenda of extending liquor store hours from 8am to 10pm Mon. — Sat.
I would be in favor of changing the permitted hours of operation to include Mon. — Thurs. from
8am to 10pm. I believe that this is an important step for Eagan Liquor Stores to be competitive
in the market, due to the fact that all the surrounding communities have adopted these hours
of operation. MGM is regularly turning away customers at 8:00 pm on Mon. — Thurs. I believe
that we are losing those sales to Apple Valley, Burnsville, Rosemount, etc. In order to compete
with the surrounding communities I would vote to increase the hours of operation.

Subject: Change in hours
Hi Christina,
It is great to hear about this. I wish this would have been a consideration long time ago. I
am sorry I will not be able to attend the meeting. Therefore I would like to take this
opportunity to express my sentiments in this email.
The change to stay open until 10 pm has many benefits. The city of Eagan can bring more
revenue, which will provide more flexibility in spending.
Consumers will have the opportunity to spend their money in their city instead of nearby
cities. They will be more happy to be totally honest.
I have seen consumers getting upset at many occasions.
We as a business owner can also use more money to pay our bills and invest in other
promotional areas. We can offer additional service to our local community, especially in the
summer time. This is a benefit to everyone (City of Eagan, Consumers and business owners).
It's a no brainer.
