Re: request for exception to the current building code
Mr. Thompson:
Your request for an exception to the requirement for a minimum 36" width for a stairway
(section R- 311.5.1)in the 2007 Minnesota State Building code is accepted. The existing
construction does not allow room for more than the existing, 34" width without extensive
reconstruction.
Your request for an exception to the maximum riser height of 7 -3/4" is denied. Based on the
dimension that you have provided, the existing opening in the floor should allow for the new
stair framing to meet the rise, run and headroom requirements of the current code. See section
R -311.5 attached.

ATTACHMENT TO 2012 RESIDENTIAL BUILDING PERMIT APPLICATION

To whom it may concern regarding the reinstallation of my stairs and meeting
the current code for a stairwell:
To rebuild the stairs in my home, which were originally constructed in the tatter
60's, I would like to request 2 exceptions from the stairway code:
1. The finished width will be approx 34 1/2" rather than 36 ". After removing
the 2 layers of wallboard on each side of the stairwell, from my floor rim
joist to the ibeam on the opposite side is 35 1 /2 ". By installing 1 /4" wall
board on each side will leave a width of approximately 35 ". The only way
to attain the 36" would be to move the entire kitchen wall and the floor
rim joist which would negatively impact the structural integrity of my
home itself, Op, piiN P
2. The sunroom /kitchen now has a tile floor and consequently the rise of the
top step is 8 3 /4 ". All the remaining steps have a 7 3 /4" rise. Again in
order to change the rise of the top step would require removing the
floor /ceiling joist AND cause me to remove a door in my den as the door

Consequently, other than these two exceptions, the remaining code dimensions,
ie, 10' tread and 6'8" minimum height can all be met. 7 74,c 4
