Re: Street damage
Dear Mr. & Mrs. Kiecker,
On July 3 of this year your street received a new bituminous overlay as part of the
Citywide Pavement Management Program. On July 6, while driving through your
neighborhood, I observed a contractor working at your residence. As part of your project
they illegally dumped a large amount of dirt, gravel and other landscape material on the
new bituminous streetmat; this is a direct violation of City Code. I've included photos
for your reference taken that day as well as the damage discovered later. On July 6 we
had a high temperature of 102 degrees which contributed to the soft blacktop. The
contractor working for the City, on the street overlay project, delayed doing clean-up
work in your neighborhood because of the extreme temperatures and the soft pavement.
I stopped and talked to your contractor twice that day and explained the issues we have
with dumping materials on the street, especially on brand new blacktop. I was assured
that they would be extremely careful; i.e. they stated they had new rubber tracks on their
skid loader so it wouldn't damage the street and they would power wash the street when
they were done. As I'm sure you've seen by now, they did not follow through on any of
their promises and in fact, caused substantial damage to the new pavement.
The purpose of the new bituminous overlay is to help extend the life of the street by 20 -
25 years. In order to accomplish this, the damaged street area in front of your property
will have to be removed and replaced. The estimated cost to complete this repair is
$1,500. As the owner that hired the private contractor who caused the damage to public
property, you are responsible to resolve the matter.
I apologize for not contacting you sooner but we were reviewing the damage and waiting
to hear back from our contractor with a cost estimate. I hope you can appreciate the
responsibility we have to properly maintain our public right of way. Please contact me
