Scipioni, City Clerk EXHIBIT A RESOLUTION CITY OF EAGAN WHEREAS, a regular meeting of the City Council of the City of Eagan, Dakota County, Minnesota, was held on the 17th day of July, 2012, at 6:30 p.m. at the City Hall located at 3830 Pilot Knob Road, Eagan, Minnesota; all members being present; and WHEREAS, pursuant to M.S.A. §412.851, the Mayor convened the public hearing to consider the proposed vacation of drainage and utility easements lying over and across the following described real property in the City of Eagan, County of Dakota, State of Minnesota, described as follows: Lot Two (2), Bock One (1), Northwood Business Park 3rd Addition, according to the recorded plat thereof, Dakota County, Minnesota. d Easement Vacation Description: That part of Lot 2, Block 1, Northwood Business Park 3rd Addition, Dakota County, Minnesota, described as follows: Commencing at the Northeast corner of said Lot 2; thence S 00° 23' 49" W, along the East line of said Lot 2, a distance of 216.66 feet; thence N 440 52' 42" W, a distance of 14.07 feet to the point of beginning of the easement to be vacated; thence N 440 52' 42" W, a distance of 104.80 feet; thence N 890 59' 28" E, a distance of 26.70 feet; thence S 320 27' 54" E, a distance of 88.02 feet to the point of beginning. WHEREAS, the Council at a regular meeting on the 19th day of June, 2012, accepted a petition to vacate said drainage and utility easements pursuant to a petition and scheduled a public hearing on the vacation for the 17th day of July, 2012, at 6:30 p.m. at the City Hall; and WHEREAS, an Affidavit of Publication of Notice of Hearing in the Sun Thisweek newspaper, dated June 29, 2012, and July 6, 2012, relative to the proposed vacation was submitted; and WHEREAS, there appearing no objections to said vacation and the Council desiring to vacate said drainage and utility easements; and WHEREAS, it having been determined that other than petitioner, there are no other parties, including public utility companies, having an interest in said drainage and utility easements, and it appearing that it is in the public interest to vacate such easement, and there being no objections; NOW THEREFORE, upon motion by Councilmember Hansen, seconded by Councilmember Tilley, it was RESOLVED that the drainage and utility easements lying over and across the following described property are hereby vacated: Lot Two (2), Bock One (1), Northwood Business Park 3`d Addition, according to the recorded plat thereof, Dakota County, Minnesota.
