ORDINANCE FOR TUMS
VILLAGE OF EAGAN
I, being a firm believer in conservation and see the need of
preservation of vegetation as these are the largest manufacturers of
oxygen and aids in filtering pollution out of the air we in the world
breathe, do hereby recommend to the Council the following ordinance:
All subdivision shall be Planned, designed, constructed and
maintained so that:
1. Existing healthy trees and native vegetation on the site are preserved to
the maximum extent feasible and are protected by adequate means during
construction. If an adequate sized tree need be removed because of
building location, a recommended variety specie be replanted on the
premises.
2. Existing: native vegetation not to be disturbed, injured or removed
prior to site develoamen.t.
3. Following construction, vegetation suitable to the site is planted the
type or species of tree planted shall be approved aloe-, with a landscape
plan. Trees shall have a trunk diameter (Measured 12 inches above ground
level) of not less than 1 - 3/4 inches and shall be planted in good
growing soil along with recommended fertilizer. No tree shall be planted
within the road rif►ht-of-way.
4. Existing trees are preserved within any right-of-way when such trees
are suitably located, healthy, and when approved grading allows.
5. tdo dead trees, or uprooted stumps remain after development.
6. No tree shall be used for signs or permanent lighting or television
antennas.
7. Aprlicant shall submit agreement and performance bond or cash escrow
agreement in such reasonable amount as determined by the Village Council
to assure improvements completion according to plan. The Village Council
shall retain the right of occupancy.

1. Commercial, Industrial and Residential Subdivision Planting Plan.
A subdivision planting plan at the same scale as the preliminary and
final plats shall show:
a. The specific name, size and location of every proposed
and every existing, preservable tree.
b. The distance in feet between trees in any one tow,
c. The nature of existing soil in the planting ipace to
a depth of three fbety
2. Only trees listed as approved shali be planted and in any one block
not less than two or mote than three species shall be plantede
3, Required subdivision trees must have a trunk diameter of at least
one and three quarter inches (1 • 3/411) one foot above ground level.
4, No subdivision tree shall be planted in soil too poor to insure
growth of such tree unless twenty-seven cubic feet (31x 31x 3')
of soil be removed and replaced with suitable loam.
The developer shall submit an adequate plan of trees existing on the
property prior to development.
