The Eagan Airport Relations Commission will meet on Monda November 10, 2008 at 7;00 p.m,
in the Eagan City Council Chambers. The meeting is scheduled on Monday due to the observance
of Veteran's Day on Tuesday, November 11. In order that there is a quorum present, please contact
Mary O'Brien at 651 -675 -5005 if you are unable to attend this meeting.
I. ROLL CALL AND ADOPTION OF AGENDA
The agenda, as presented or modified, is in order for adoption by the Commission.
II, APPROVAL OF MINUTES
The minutes of the October 14, 2008 Airport Relations Commission meeting are enclosed on
pages through. These minutes, as presented or modified, are in order for adoption
by the Omission.
III. VISITORS TO BE HEARD
The Eagan City Council and its Commissions set aside up to ten minutes at the begiiuiing of
public meetings to permit visitors to address items of interest that are not addressed on the
regular agenda, Items that will take more than ten minutes or that require specific action can be
scheduled for a future agenda.
IV. OLD BUSINESS
A. Communications Update — It is the practice of the Airport Relations Commission to
discuss their communication initiatives each month, which include articles in the Experience
Eagan Newsletter, as well as stories aired on the City's local access cable channels. Currently on
the City of Eagan website is a featured video from the October 21 Eagan City Council meeting,
where the Council provided direction to send correspondence to the FAA Air Traffic Control
Tower regarding concerns the City of Eagan has with the current use of Runway 17 -35. The
Commission is welcome at this time to make suggestions for additional communication
initiatives regarding airport issues.
B. MAC Mont4ly Reports — Eagan /Mendota Heights Corridor Anal sis/Technicalq
Advisory Report /17 -35 Departure Analysis Report — Enclosed on pages through j
is the Se tember 2008 EaganWendota Heights Corridor Analysis. Enclosed on pagesf 0
through is the September 2008 Technical Advisory Report. Enclosed on pages
through is the September 2008 Runway 17 Departure Analysis Report, The September
reports wer the most current reports available on the MAC website at the time of packet
preparation. It is the practice of the Commission to review the reports and discuss any
significant deviations that may have occurred or any other noteworthy occurrences as reported in
the analyses.
C. Correspondence to the FAA Regarding Use of Runway 17 -35 — Enclosed on pages
throught� is correspondence that was sent to Mr. Carl Rydeen, MSP Air Traffic
Control District Manager, voicing the City of Eagan's concerns with the use of Runway 17 -35.
The letter was prepared per the direction of the Airport Relations Commission, and was
approved by the City Council at the October 21, 2008 City Council meeting. The City has yet to
receive a response from Mr. Rydeen, Also enclosed on page is an article that appeared in
the Minnesota Sun Newspaper, entitled Turning the Trebles: EaMaking Noise to Airport
Controls.
D. Update: City of Eagan Noise Attenuation Ordinance — The Eagan City Council had
continued discussion regarding the formation of a noise attenuation ordinance at their October
28, 2008 City Council Workshop. Enclosed on pages (CF through is the background
information that was sent to the City Council in preparation for the discussion. Following the
Council's discussion, they provided direction on the 28t" to formalize the City's past practice
with respect to the application of noise attenuation analysis and noise attenuation conditions for
development applications within the noise zones and buffer zone. Through research conducted
by staff, it was discovered there are only 6 (or fewer) lots within the noise zones that might see
the potential for the construction of a residential or other noise sensitive use, without the
opportunity for the City to apply conditions through a land use approval of some kind. The
Council had previously stated that they were not interested in applying different standards for
additions made to homes or remodeling of homes. The Council will be considering formal
direction at their November 6 meeting to direct the preparation of a noise attenuation ordinance
that formalizes how the City has been considering the development applications in the noise
zones and buffer area. No action is needed by the ARC; rather, this update was added per the
request of the Commission at the October meeting.
V. NEW BUSINESS
A. Review MAC Complaint Tracking System — Per the request of the ARC at the August
meeting, an agenda item has been added to allow the Commission an opportunity to discuss the
current reporting system that the MAC utilizes with regard to noise complaints received from the
public. The Commission is encouraged to discuss any improvements that they would like made
to the system. Any recommendations suggested by the ARC will be forwarded to Mr. Chad
Leqve, Manager of the MAC Aviation Noise and Satellite Programs Office. The Commission
can review the current reporting structure used by the MAC by looking at the enclosed
September 2008 Technical Advisory Report, in which the complaint tracking document appears
on the third page.

VI. STAFF / COMMISSIONER REPORT
A. Update on NOC Cities Meeting — The city representatives that serve on the Noise
Oversight Committee (NOC) met on October 15, 2008 to review the items proposed for
inclusion in the 2009 MSP NOC Work Plan. The Conunittee members were comfortable with
the City of Eagan's recommendation to ask for continued review of the Runway 35 River Arrival
Approach as part of future RNAV departure procedure discussions. Questions were also raised
by Connnittee members regarding how the Delta fleet will change when the Northwest /Delta
merger is formalized. In order to discuss the fleet mix implications, as well as other operational
impacts of the merger, a meeting is being scheduled with MAC Executive Director Jeff Hamel,
MAC Chairman Lanners, and MAC Legal Counsel Anderson, along with the Committee
representatives of the NOC.
B. December 2008 ARC Meeting — As was discussed at the October ARC meeting, the
Commission's December meeting is scheduled for Tuesday, December 9, 2008. In previous
years, the Commission has waited until the month of November to discuss whether a
Commission meeting is necessary in the month of December and whether a quorum would be
present should the meeting be held. Commissioners are encouraged to review their schedules in
advance of the November meeting in order that a discussion can be held during the meeting as to
whether the December Commission meeting will occur.
VII. ROUNDTABLE
Per the request of the Commission, this agenda item has been added so that Commissioners have
the opportunity to ask questions or make requests for future agenda items.
VIII. ADJOURNMENT
Per the request of the Commission, the Eagan ARC meetings will go no later than 8:30 p.m.
unless agreed upon by the Commission.

AIRPORT RELATIONS COMMISSION MEETING
OCTOBER 14, 2008
A regular meeting of the Eagan Airport Relations Commission was held on Tuesday, October 14,
2008 at 7:00 p.m, Those present were Curtis Aljets, James Casper, Beth Prouty, Carol Shattuck and Chad
Stambaugh. Absent was Steve Beseke. Also present was Assistant to the City Administrator Miller.
Chair Ajets noted the resignation of Commissioner Brett Walsh and expressed appreciation for his
service on the Eagan Airport Relations Commission. He stated Commissioner Walsh's position on the
ARC will be filled in April of 2009.
AGENDA
Shattuck made a motion to amend the agenda and continue the MAC Noise Complaint System item
to the November 10, 2008 meeting. Casper seconded the motion. All members voted in favor.
APPROVAL OF MINUTES
Stambaugh made a motion to approve the minutes of the August 12, 2008 regular meeting of the
Eagan Airport Relations Commission as presented. Shattuck seconded the motion. All members voted in
favor.
There were no visitors to be heard.
VISITORS TO BE HEARD
COMMUNICATIONS UPDATE
Miller stated it is the practice of the Airport Relations Commission to discuss their communication
initiatives each month which include articles in the Experience Eagan Newsletter as well as stories aired on

Casper suggested including information on the RNAV Departure Procedures once the 30 -day trial
period has been completed.
MAC MONTHLY REPORTS — EAGAN/MENDOTA HEIGHTS CORRIDOR
ANALYSIS /TECHNICAL ADVISORY REPORT /17 -35 DEPARTURE ANALYSIS REPORT
Aljets introduced the item noting these reports appear monthly in the Commissioners' packets and
asked the Commission for conunents regarding the August reports.
Stambaugh noted complaints from Eagan residents were at 43.2 percent, which was up from last
month, while other communities were down or had remained the same. Aljets noted the Eagan/Mendota
Heights Corridor Analysis Report showed operations were 95.2 percent compliant. Stambaugh
commented that nighttime operations reported in August were 9.8 percent.
The Commission requested a letter from the Eagan City Council be sent to the FAA inquiring as to
why the number of nighttime operations has increased.

RUNWAY 35 RIVER VISUAL APPROACH PROCEDURE
Aljets gave a brief overview on the Runway 35 River Visual Approach Procedure. Miller noted a
memo from Chad Leqve, Manager of the Aviation Noise and Satellite Programs, which addresses the
Runway 35 River Visual Approach Procedure that was included in the 2008 Noise Oversight Committee
(NOC) work plan at the request of the City of Eagan. Miller stated Mr. Leqve recommended to the NOC
that the procedure would be better suited to be considered in the context of the Area Navigation (RNAV)
discussion and encouraged the City of Eagan to recommend this procedure be included in the RNAV
discussions and included in the 2009 NOC work plan.
Miller stated residents are aware that the River Visual Approach was included in the 2004 Noise
Compatibility Program, which was part of the Part 150 document submitted to the FAA, but was informed
by Mr. Leqve that the Noise Compatibility Program is intended as a brainstorming document and residents
should not assume every inclusion in the document will be implemented in the near future. She farther
stated Mr. Leqve encourages the City to recommend that the River Visual Approach Procedure be included
in the ongoing RNAV discussions.
RNAV DEPARTURE PROCEDURES UPDATE
Aljets introduced the item. Miller noted a memo from Chad Leqve, Manager of the Aviation Noise
and Satellite Programs, regarding the RNAV Departure Procedure and stated the procedure is being
explored at the MSP Airport by Northwest Airlines only when demand is low. She also stated that MAC is
currently awaiting FAA approval of the thirty -day trial period. Miller explained the procedure is also
referred to as the Crossing in the Corridor Procedure off the Eagan/Mendota Heights Corridor and the
Minnesota River Departure Procedure off Runway 17. Miller commented that should the FAA find the
trial is successful; the formal process to get the procedures publically approved could take one to two years.
REVIEW PROPOSED 2009 MSP NOISE OVERSIGHT COMMITTEE WORK PLAN
Aljets referred the Commission to a memo from Chad Leqve which summarized the items proposed
to be included in the 2009 MSP Noise Oversight Committee work plan. Miller stated the NOC will be
finalizing the 2009 work plan at their November 19, 2008 meeting.
The Commission discussed an item from Mr. Leqve's summary under the Residential Noise
Mitigation Program regarding community implementation policies on residential development in the 60 to
64 DNL noise contours. Miller stated the cities of Richfield, Minneapolis and Eagan are discussing noise
attenuation requirements on new homes as a result of the Settlement Agreement. Miller fiuher stated the
City Council discussed this issue at their August 26 workshop and the item is to be being brought back to
the Council's October 28, 2008 workshop for further discussion.
Miller stated she will have additional information for the Commission at the November ARC
meeting following the Council's October 28 discussion.

REVIEW JULY 2008 RUNWAY 17 DEPARTURE ANALYSIS
Miller introduced the item stating that due to the number of complaints from Eagan residents
regarding departure operations off Runway 17 during the month of July, she requested MAC prepare an
analysis on the number of operations off Runway 17 in July using each of the headings over Eagan. The
Commission discussed the flight tracks being used most frequently and the distribution of fanning
departures off Runway 17. The Commission further discussed the purpose and objective of the RNAV
Departure Procedure and fanning.
AIR TRAFFIC CONTROL TOWER TOUR FEEDBACK/OBSERVATIONS
The Commission discussed the Air Traffic Control Tower tour and stated it was very worthwhile.
Several comments were made regarding the availability and capacity of the Parallel Runways and the
overuse of Runway 17 with departure operations. The Commission recommended that a letter be prepared
to the FAA and recommended to the City Council to address the issues of nighttime use, the use of the 120
degree heading, and adherence to the RUS and overall use of Runway 17.
ARC MEETING SCHEDULE FOR THE REMAINDER OF 2008
Aljets reminded the Commission that November's meeting is scheduled for the second Monday in
November in observance of Veteran's Day. Miller asked the Commission to check their calendars
regarding the December meeting to insure a quorum; otherwise, the December meeting could be cancelled
and meetings would resume in January.
MAC NOISE COMPLAINT SYSTEM
This item was continued to the November 10, 2008 Airport Relations Commission meeting.
ADJOURNMENT
Upon motion by Casper, seconded by Shattuck, the meeting adjourned at 7:50 p.rn. All members
voted in favor.

Based on observations at the Tower tour, and as a result of feedback from Eagan residents over
the past few months, the ARC discussed the issue of the use of Runway 17 at their October 14,
2008 Commission meeting. In particular, concerns have been raised regarding the fanning of
departures off of 17, nighttime departures, and the adherence to the Runway Use System (RUS),

produced by the MAC, which shows that the 120 degree heading was used more than any of the
other tracks. With so many residents living under the 120 degree track, it is concerning to the

As you are -well aware, the City of Eagan has also had concerns In the past over the usage of
Runway 17 during the evening hours (1030 p.m. -6:00 a.m.). In response to the request of both
the MSP Noise Oversight Committee (NOC) and the Eagan ARC in the fall of 2007, it appeared
that the RUS was being more strictly adhered to as the nighttime use of Runway 17 was reduced
significantly since last summer. The City was very pleased with the resulting reduction of noise
over our community during the evening hours, when noise is most bothersome to residents.
Over the past few months, however, the City has observed that nighttime use of Runway 17 is
again rising. The following is a month -by -month comparison of evening departure percentage
off of Runway 17 based on the monthly MAC Technical Advisor's Report, which shows the
nighttime use of 17 gradually Increasing each month since January 2008:

Based on past trends, it would appear that nighttime usage of 17 is seasonal in nature, likely
based on prevailing winds. The City was pleased to see the nighttime usage percentage of 17
decrease in September 2008 and would hope that this trend of less'usage will be seen in the
months to come. The City will continue to actively promote the usage of the RUS during the
evening hours, which calls for the parallel runways to be used as the first priority for evening
departure operations,
Lastly, the City remains concerned and frustrated by the continued use of Runway 17 for such a
significant number of departure operations, particularly when compared to the use of the
parallel runways over the Eagan /Mendota Heights Corridor. Using August and September of
2008 as an example, Runway 17 has been used for 30% of the departure operations, while the
parallel runways combined have been used for approximately 25% of departure operations.
During the ARC's tour of the Tower, Mr. Yesl<e communicated to the ARC that the use of Runway
17 for departure operations is a very efficient configuration for departures due in part to the
fact that there are limited airspace conflicts when planes depart off of 17 compared to the other
runways. The Commission observed first hand at the tour the number of planes lined up to take
off on 17 while the parallel runways were both being used for arrival operations. Anecdotally,

the Commission members could count on one hand the number of arrivals they observed at that
time, as compared to the dozens of planes departing on 17. While the City will never advocate
for the FAA to jeopardize safety, it is very apparent to both outside observers such as the
Commission and to the many pilots in the Eagan community, that the parallel runways could be
used to a much greater extent than they currently are.
The City has been told on numerous occasions that the runway usage percentages estimated
through the EIS process do not drive how the controllers are directing air traffic. However, yet
again, on the tour of the Tower, the Commission heard firsthand how Runway 17 is being
utilized for significant departure operations in order to adhere to the EIS projections. Clearly,
the City of Eagan recognizes the pressure in which the FAA is under by other communities to
reach those EIS projections, but it is our strong hope and expectation that those percentage
projections are not the driving factor in how departure operations are being directed at MSP.
Rather, sound public policy should trump projections and if capacity exists on the parallel
runways, then those runways should be utilized to take advantage of the less noise sensitive
land uses within the Eagan /Mendota Heights Corridor,
While the Eagan Airport Relations Commission certainly had reactions and feedback to the tour
of the Tower, we would be remiss if we did not commend the controllers for their excellent
work in ensuring the safety of passengers and residents living around the airport. The issues
raised in this letter are ongoing concerns of both the City, as well as Eagan residents and pilots.
We would very much appreciate a response to the questions and concerns raised above, and
we would welcome you to a future a Eagan Airport Relations Commission meeting to further
address the concerns of the City.

Making noise to airport officials about noise concerns over Eagan homes Is the purpose of the letter,
The Eagan City Council approved Tuesday, Oct, 21, to send a letter to the Air Traffic Control Tower at
the Minneapolls -St, Paul Airport asking controllers to take measures to minimize airplane noise in the
city.
The letter outlines Issues that already have been talked about with the airport's noise oversight
committee, but the Federal Aviation Administration oversees the control tower.
A main concern voiced in the letter deals with the nighttime use of Runway 17/35, the airport's
newest runway, which sends planes over residential areas of Eagan, Officials were successful In
lobbying for less use of the runway last summer, but the city has received more complaints about
airplane noise recently,
"We saw a significant decrease in the use of (the runway] in the evening hours, which was very well
received by our residents," said Assistant City Administrator Dianne Miller, "We've noticed that It's
slowly Inching Its way up again,"
Departures on the runway Increased from 1,2 percent of nighttime departures in January to 9.8
percent In August,
While acknowledging the Increase may have to do with seasonal prevailing winds, the city again is
asking that nighttime flights on the runway be kept to a minimum,
The letter also outlines the city's request to more evenly distribute outgoing flight paths, as recent
data suggests residents living on one path have been subject to the brunt of the noise from
departures,
"We can't eliminate airport noise or airplanes flying over," said Mayor Mike Maguire. "What we can do
is more evenly spread them."
In other council news:
The council approved a licensing procedure for body art establishments at the meeting. Currently, the
city has no tattoo parlors, but it has recently received a number of Inquiries, said Community
Development Director Jon Hohenstein.
The ordinance outlines safety provisions for the establishments, as body art establishments are
regulated by local governments, Parlor owners must also undergo background checks and present the
city with a plan to keep minors out of the establishment, as state law prohibits minors from receiving
tattoos without written parental consent,
owners must renew the license annually and compliance will be enforced on a complaint basis,
"If police have reason to believe an Issue Is occurring, then they'll Investigate," said Hohenstein,

VII. CONTINUED DISCUSSION OF NOISE ATTENUATION ORDINANCE
DIRECTION TO BE CONSIDERED:
To provide direction regarding the regarding next steps for the consideration of an aircraft
noise attenuation ordinance.
FACTS:
The City of Eagan considers aircraft noise impacts as part of decisions related to
applications for new developments within the Met Councils MSP Noise Exposure Zones
and buffer zone. Where appropriate, the City applies noise attenuation construction
standards as part of the approvals of such developments.
As a part of its 2000 Comprehensive Plan, the City established a goal to consider the
adoption of a noise-attenuation ordinance that would apply to all new construction within
the Noise Exposure Zones and buffer zone. On June 13, 2005, the City Council
authorized the preparation of an ordinance, but the effort was put on hold pending the
outcome of the MAC lawsuit. Subsequently, the Consent Decree that settled the lawsuit
filed by the Cities of Eagan, Minneapolis and Richfield, required the cities to consider the
adoption of such an ordinance related specifically to new residential construction within
certain noise contours.
At its workshop meeting of August 26, 2008, the City Council considered a range of
approaches to the implementation of an ordinance and gave direction to staff to:
o Continue the past practice of applying noise attenuation analysis and conditions for
new development applications within the noise zones and buffer zone.
o Not apply additional noise requirements for building additions or remodeling.
o Inventory the number of lots that have the potential to have new buildings constructed
with only a building permit and no PD or subdivision application or amendment.
o Prepare a comparison of the costs of applying standards for the various noise
attenuation ordinances - Mendota Heights/Met Council model, Minneapolis /Richfield
(Consent Decree model) and Bloomington model.
Staff's analysis of the noise zones concluded:
o Nine (9) R -1 lots that could possibly pull a building permit without subdivision.
However, only four (4) of these lots are under 1 acre in size. Recent experience
suggests that it is likely that owners would strongly consider further subdivision of
the larger lots prior to additional construction.
o Other noise sensitive uses include education, medical, schools, churches, hospitals,
nursing homes, cultural, entertainment/recreation, transient lodging, and office; all
with varying degrees of zoning and noise compatibility. However, there are very few
vacant lots within the noise zones that would not require some sort of approval to

construct a facility for one of these uses. The most likely candidates would be two
(2) vacant lots in Zone 3 within the Eagan Woods /Compri Hotel PD's, but
construction without some sort of new PD condition would be unlikely.
o Therefore, it appears that six or fewer lots within the noise zones might see the
potential for the construction of a residential or other noise sensitive use, without the
opportunity for the City to apply conditions through a land use approval of some
kind.
As a consequence of the determination that all but this small number of properties could
be addressed through the development approval and condition approach the City has
applied successfully for nearly fifteen years, the benefit of adopting a detailed ordinance
is very limited. This also obviated the value of doing a cost comparison among the
ordinances adopted or considered by the other cities,
Given the small potential benefit, it does not appear advisable to draft or consider further
a detailed noise attenuation ordinance. Staff and the City Attorney have determined that
it would be worthwhile to consider an ordinance that would formalize the City's past
practice with respect to the application of noise attenuation analysis and noise attenuation
conditions for development applications within the noise zones and buffer zone and they
are asking the Council to consider giving authorization to proceed in that direction at this
time.
