A. Communications Update -It is the practice of the Airport Relations Commission to
discuss their communication initiatives each month, which include articles in the Experience
Eagan Newsletter, stories aired on the City's local access cable channels, and inclusions in the
ARC Notebook. An article was published in the most recent edition of the Experience Eagan
newsletter regarding the settlement in the noise mitigation lawsuit. If any of the Commissioners
have suggestions for additional communication initiatives regarding airport issues, please voice
those suggestions at this tine.

B. MAC Monthly Reports — Eagan /Mendota Heights Corridor Analysis/Technical
Advisory Report /17 -35 Departure Analysis Report— Enclosed on pages � through,*
is the September 2007 Eagan/Mendota Heights Corridor Analysis. Enclosed on pages YYY
through _6 _ is the September 2007 Technical Advisory Report. Enclosed on pages
tlrougli� is the September 2007 Runway 17 Departure Analysis Report. The September
reports are the most current reports available on the MAC website. It is the practice of the
Commission to review the reports and discuss any significant deviations that may have occurred
or any other noteworthy occurrences as reported in the analyses.
C. Update on Nighttime Departures Off Runway 17 During Southeast Operational
Flows at MSP — As the Commission will recall, on August 22, 2007 the Eagan City Council, at
the recommendation of the ARC, sent correspondence to the co- chairs of the MSP Noise
Oversight Committee asking that the FAA examine the feasibility of moving more nighttime
traffic from Runway 17, particularly from the 120 degree heading, to Runway 12R. when demand
allows for it. Upon hearing the arguments of the City of Eagan, the MSP Noise Oversight
Committee at their September 19 meeting sent correspondence to the FAA asking that the FAA
consider moving the nighttime flights to Runway 12R as requested by the City of Eagan.
Enclosed on pages through is the letter that was sent by the co- chairs of the Noise
Oversight Committee. Enclosed on pages through63 is a letter of response from the
FAA Assistant Air Traffic Control Tower Manager, Carl R.ydeen. Also enclosed on pages
throughq is a staff memo prepared by Chad Leqve, Manager of the Aviation Noise and
Satellite Programs at the MAC, which will be presented to the Noise Oversight Committee at
their November 14 meeting.
In preparation for the NOC meeting, Assistant to the City Administrator Miller met with Mr.
Rydeen and Mr. Leqve to discuss the FAA's response and the next steps available to the City of
Eagan. Assistant to the City Administrator Miller can provide an update to the Commission
regarding that meeting, as well as recommendations with regard to proposed action for the NOC
to consider on the 14"'. As a reminder, both State Representatives Sandra Masin and MAC
Commission Bert McKasy sent correspondence to the FAA offering their support for the City of
Eagan and the NOC's request.
Also enclosed on page is a letter received from MAC Commissioner McKasy on October
22, 2007 noting that he has asked for an update of the November 14 NOC discussion to be
provided by Mr. Chad Leqve at the December 5, 2007 MAC Finance, Development and
Enviromnent Committee, which is chaired by Commissioner McKasy.
D. 1998 Final Environmental Impact Statement (FEIS) and 2003 Environmental
Assessment (EA) on Departure Procedure Off Runway 17 -35 — As part of the October 9 ARC
meeting packet, staff forwarded to the Commission a copy of the Introductory and Executive
Summary sections of the 1998 Final Environment Impact Statement. Also forwarded at that time
was the entire Final Envirorunental Assessment for the Implementation of a Departure Procedure
off Runway 17 that was prepared in 2003. Given the large size of these documents,
Commissioners are asked to consult their October packet to view a copy of the documents. If
any Commissioner needs a new copy of the documents, please contact Mary O'Brien at
nlobrien(cr?cityofeaaan.coin and she can email or mail you a copy of the documents.
In July, the ARC asked to review the documents this fall given the concerns the City had with
the number of operations occurring on Runway 17/35. In light of the Commission's decision at
the October meeting to continue this item to the November ARC meeting, the Cormnission is
now asked to review the two documents to determine if additional information is needed or if
there are specific questions the ARC has of the MAC with regard to the two documents. As a
point of clarification, much of the information contained in the 2003 Environmental Assessment
is more up -to -date than the 1998 FEIS, particularly in terns of operational forecasts and
projections.
V. NEW BUSINESS
A. Proposed Settlement in the Noise Litigation versus the MAC — On October 16, 2007
the cities of Eagan, Mimicapolis and Richfield each approved the proposed settlement in the
noise litigation filed in 2005 by the three communities against the MAC. The MAC also
approved the proposed settlement on October 15, 2007. Enclosed on page -n is a luminary
of the settlement (Consent Decree). The settlement is not officially approved until the FAA
offers their acceptance of the settlement by November 30, 2007. Enclosed on pages
throughTT5— are maps showing the area of eligibility within the City of Eagan. Enclosed on
pages _71e through is a memo from Chad Leqve, Manager of the Aviation Noise and
Satellite Programs at the MAC, to members of the MSP Noise Oversight Committee
summarizing the settlement. Assistant to the City Administrator Miller can provide a further
update regarding the settlement discussions and eligibility requirements for the program at the
November 13 ARC meeting.
B. 2008 NOC Work Program —Enclosed on page is the proposed 2008 MSP NOC
Work Plan which will be discussed at the November 14 NOC meeting. The ARC is encouraged
to voice any recommendations regarding work program items that the NOC may wish to
consider for 2008. Also enclosed on pages through far the ARC's information is an
update form Mr. Leqve on the work/issues addressed by the NOC in 2007:
VI. STAFF / COMMISSION REPORT
A. Meeting with MAC Executive Director and MAC Lobbyist — On November 5, 2007
Assistant to the City Administrator Miller as well as representatives from each of the
communities surrounding MSP Airport had the opportunity to meet with MAC Executive
Director Jeff Hamel and MAC Lobbyist Mitch Killian to discuss our cities' joint concerns
regarding representation on the MAC. Assistant to the City Administrator Miller will provide a
verbal update to the ARC on the November 13 meeting regarding the meeting held with the
communities and MAC staff.

B. December Eagan ARC Meeting — A meeting of the Eagan ARC is tentatively scheduled
for Tuesday, December 11, 2007. hi keeping with past practice, an option is provided to the
ARC as to whether they wish to meet in the month of December. In previous years, a quorum
has riot always been available due to the busy nature of this month. Staff is asking for
Commission direction as to whether a December ARC meeting should be held.
VII. ROUNDTABLE
Per the request of the Commission, this agenda item has been added so that Commissioners have
the opportunity to ask questions or make requests for future agenda items.
VIII. ADJOURNMENT
Per the request of the Commission, the Eagan ARC meetings will go no later than 8:30 p.m.
unless agreed upon by the Commission.

MINIJTES OF THE EAGAN
AIRPORT RELATIONS COMMISSION MEETING
OCTOBER 9, 2007
A regular meeting of the Eagan Airport Relations Commission was held on Tuesday, October 9,
2007 at 7:00 p.m. Those present were Curtis Aljets, Steve Beseke, Maggie Jensen, Jack Prentice,
Charles Thorkildson and Bret Walsh. Absent was Tarnrny Mencel. Also present was Assistant to the
City Administrator Miller.
AGENDA
The agenda was amended to include an update under Staff Report regarding the reopening of
Runway t2R. Upon motion by Beseke; seconded by Aljets, the agenda was approved as modified. All
members voted in favor.
APPROVAL OF MINUTES
Aljets made a motion to approve the minutes of the August 14, 2007 regular meeting of the
Eagan Airport Relations Commission as presented; Walsh seconded the motion. All members voted in
favor.
VISITORS TO BE HEARD
There were no visitors to be heard.
COMMUNICATIONS UPDATE
Miller introduced the item stating it is the practice of the Airport Relations Commission to
discuss any communication initiatives relative to airport noise each month including articles appearing
in the Experience Eagan newsletter, stories aired on the City's local access cable channels and
inclusions in the ARC Notebook.
Miller noted that the September 19 Legislative Public Hearing is currently being aired on the
local access cable channel.
MAC MONTHLY REPORTS — EAGAN/MENDOTA HEIGHTS CORRIDOR
ANALYSIS/TECHNICAL ADVISORY REPORT /17 -35 DEPARTURE ANALYSIS REPORT
Miller introduced the item stating the enclosed August 2007 Eagan /Mendota Heights Corridor
Analysis, August 2007 Technical Advisory Report and the August 2007 Runway 17 Departure Analysis
Report are the most current reports available on the MAC website. Miller reminded the Commission
that Runway 12R is presently closed and it should be noted along with the data contained in the August
reports. Aljets noted that the number of complainants and complaints from Eagan residents have been
down since the runway's closure.

DIALOGUE WITH MAC COMMISSIONER BERT MCKASY
Miller introduced MAC Commissioner Bert McKasy, stating Senator Jim Carlson and
Representative Sandra Masin were also present. Commissioner McKasy gave background on himself
and his appointment to the MAC.
Commissioner McKasy discussed the state of the airline industry. He stated in 2006 there were
475,000 aircraft operations at MSP as compared to a peak in 2004 of 541,000. He stated in 2005, 35
million people came through MSP and 53% of those passengers' flights ended here and 47% were sent
on to connecting flights. McKasy noted that the airport needs to get ready for a Senior /Executive
Management change because management staff has been there a long time and nearing retirement.
McKasy also discussed parking at the airport. He stated the ramp at the Lindberg Terminal contains
16,000 parking spaces and the ramp at the Humphrey Terminal can handle 4,500 vehicles. He further
stated they are in the process of adding 5,500 spaces through an additional ramp at the Humphrey
Terminal. He also stated completion of construction on Runway 12R has been delayed, but is scheduled
to be completed by October 22. McKasy noted that the MAC is in the process of adding a restaurant
outside of security and, hopefully, it should be opened by spring of 2008.
McKasy briefly discussed the MAC lawsuit stating it went to trial in February of 2007 and on
July 23, 2007 there was a settlement proposal and the proposal continues to be discussed. McKasy
noted that he has pushed for a settlement and for getting more houses insulated. McKasy also discussed
the Senator Craig issue.
Commissioner McKasy presented a letter he wrote dated September 27, 2007 to Carl Rydeen,
Manager, MSP Air Traffic Control Tower, in support of Eagan and the NOC. McKasy gave feedback
from the FAA stating the draft FEIS shows 480,000 operations with 37% of them off Runway 17. He
further stated the forecast in 2005 was for 575,000 operations with 37% off Runway 17, but the actual
figure in 2006 was 446,000 operations. He commented that it's possible the FAA questions why the
City of Eagan has a problem when operations are less than the original forecast. McKasy agreed with
Eagan that there are less operations, so why not redirect flights from Runway 17 to Runway 12.
McKasy stated in his opinion the FAA continues to defend its original decision for 2 reasons; 1.) the
gate -to- runway time has been decreased, and 2.) arrival flow can be better handled because it does not
have to be metered. McKasy stated there is an old saying, "Man proposes and God disposes ". He stated
in our case, the MAC proposes and the FAA disposes and the FAA has the final say. McKasy agreed
that it makes sense to move operations from Runway 17 to Runway 12.
McKasy stated in his opinion the MAC is big enough and, if an Eagan is successful in getting a
sole representative on the MAC, the number of representatives should stay the same. He also stated that
the representative would need to be open to represent more than Eagan. McKasy noted that all MAC
meetings are public and their minutes can be found on MAC's website. He also emphasized that he and
MAC staff are sensitive to the City of Eagan and the concerns brought forth by the City.

1998 FINAL ENVIRONMENTAL IMPACT STATEMENT FEIS) AND 2003
ENVIRONMENTAL, ASSESSMENHT (EA) ON 2.5 NAUTICAL MILE,
Miller introduced the item noting that per the request of the Commission at the July 10 ARC
meeting, a copy of the 1998 Final Environmental Impact Statement was obtained and the introductory
and executive summary sections of the document were enclosed for Commission review. She further
stated the 2003 Final Assessment for the Implementation of a Departure Procedure off Runway 17 was
also enclosed.
Miller noted that much of tonight's meeting was dedicated to a discussion with Commissioner
McKasy and, if the Commission would like to spend additional time on this item, the Commission could
request this item be added to the November 13 ARC meeting agenda. The Commission requested the
item be brought back for discussion at the November ARC meeting.
CORRESPONDENCE. RE: NIGHTTIME AIR TRAFFIC
Miller introduced the item stating a letter was sent from the NOC to Carl Rydeen, MSP Air
Traffic Control Tower Manager, requesting the FAA examine the feasibility of moving night -time air
traffic from Runway 17 to Runway 12R when capacity allows for it. Miller also noted correspondence
from State Representative Masin and MAC Commissioner McKasy in support of the NOC's letter.
Miller stated there was a lengthy discussion on this issue at the last NOC meeting, and following
the NOC's action, the MAC unanimously endorsed moving night -time air traffic from Runway 17 to
Runway 12R. She noted there is an average of 38 nighttime flights per month that could be affected by
the change.
SEPTEMBER 4 MEETING WITH EAGAN PILOTS
Miller stated on September 4, 2007 four Eagan residents, two active pilots and two retired pilots,
met with Assistant to the City Administrator Miller, MAC Noise Manager Leqve, FAA Control Tower
Manager R.ydeen and Northwest Chief Pilot Tim Beutell to discuss airport noise issues. She noted two
comments made by the pilots were; 1.) sitting on Runway 17 waiting to take -off when Runway 12 is
open and no waiting, and 2.) they were surprised by the in depth process for addressing environmental
documentation. Thorkildson commented that the parallels should be used for noise abatement and not
use Runway 17 -35 to capacity.
UPDATE ON THE SEPTEMBER 19 LEGISLATIVE PUBLIC HEARING
Miller introduced the item stating on September 19, 2007 a public hearing was held at the Eagan
Community Center by the House Local Government and Metropolitan Affairs Committee and the House
Transportation Working Group. She stated the purpose of the hearing was to gather input from residents
regarding the governance of MAC and the affects of the airport on surrounding neighborhoods. She
further stated approximately 75 people attended and much of the testimony received was regarding
representation on the MAC and noise concerns. Miller noted that Committee Chairwoman Hilstrom
stated that the Eagan hearing would be the first in a series of public hearings on the topic of MAC
governance. Miller thanked Commission Aljets for testifying at the hearing.
The Commission discussed ways of corresponding with MAC Commissioner McKasy to receive
updates on legislative issues regarding airport issues. They also discussed inviting him to ARC

meetings 2 to 3 times a year. Miller stated she will provide the link to the MAC minutes for an update
to the Commission.

Miller introduced the item noting an article that appeared in the September 10 edition of
BusznessWeek entitled "Fear & Loathing at the Airport ". The Commission discussed the article and
noted the system is in need of repair.
UPDATE ON THE CLOSURE OF RUNWAY 12R
Miller noted the construction on Runway 12R is behind schedule because of rain, but is
anticipated to be complete within the next two weeks. She noted that residents need to be aware that
operations will be back to normal at that time which could mean an increase in air traffic for some areas.

On August 22, 2007 Mayor Mike Maguire of Eagan sent a letter to our attention requesting that
the Noise Oversight Committee (NOC) "examine the feasibility of moving more nighttime traffic
from Runway 17 (particularly from the 120 degree heading) to Runway 12R when demand
allows." (See Attachment 1). Recently, Eagan residents have reported increased nighttime
overflights as a result of eastbound aircraft being departed off Runway 17 during southeast
operational flows at Minneapolis/St. Paul Intemational Airport (MSP). Given that the' majority of
these eastbound operations are given a departure heading of approximately 120 degrees, a
question arises as to why these aircraft are not placed on Runway 12R and given an on- course
runway heading into the Eagan\Mendota Heights Departure Corridor, which is the preferred
option per the Runway Use System (RUS) at MSP during southeast operational flows.

By way of background, the RUS was approved for
implementation as part of the environmental evaluation
conducted in the July 2003 Environmental Assessment
(EA) for the Implementation of a Departure Procedure off
Runway 17 and the related Finding of No Significant
Impact (FONSI) /Record of Decision (ROD) published by
the Federal Aviation Administration (FAA) on August 27,
2003. The EA is the most recently approved FAA National
Environmental Policy Act (NEPA) document related to the
planned operation of MSP with Runway 17/35 operational.
As detailed to the left, Table A -5 in the July 2003 EA
outlines the desired runway selection priority for the
purposes of reducing noise impact around MSP.
Per the approved RUS, when MSP is in a southeast
operational flow, during the nighttime hours of 10:30 p.m.
and 6:00 a.m., use of Runways 12L and 12R for departure
operations into the EaganWlendota Heights Departure
Corridor should be the primary departure runway
configuration. When capacity dictates, per the RUS,
Runway 17 should be used as a secondary option to
Runways 12L and 12R.

However, in July 2007 during southeast operational flows, 47.5% of the nighttime departure
operations were on Runway 12L, 33.5% of nighttime departure operations were on Runway 17
and 19.0% of nighttime departure operations were on Runway 12R. (See Attachment 2). The
use of Runway 17, with the corresponding lower departure numbers on Runway 12R, appears
inconsistent with the approved RUS at MSP during southeast operational flows.
in the July 2003 EA an analysis was conducted to determine reasonable RUS implementation
assumptions. Because capacity demand drives runway use at MSP, to adequately assess RUS
implementation, low -, mid- and high - demand criteria need to be established for purposes of the
analysis. As stated on page A-4 of the July 2003 EA:
"ATC was consulted to determine appropriate cut -off limits for each demand
period given traffic intersections and ATC workloads."
Table A -3 below, which is included on page A-4 in the July 2003 EA, provides the 15- minute
operational criteria defining each demand level.

Based on the above traffic demand period criteria, in July 2007 the average daily number of
operations per 15- minute segment establishes that the nighttime hours of 10:30 p.m. to 6 :00
a.m. at MSP were mid- to low- demand. As such, per the July 2003 EA, it is anticipated that
traffic levels allow for maximum flexibility and /or efficient selection of runways based on noise
considerations consistent with the RUS.
Attachment 2 provides a flight track map of July 2007 nighttime operations during southeast
operational flows at MSP. As detailed earlier, Runway 17 was the second- highest used runway
during the nighttime hours in July 2007 in this configuration. Of the total 134 departure
operations off Runway 17, 80 (60 %) were eastbound (120 -, 140- and 155 - degree headings). All
of the eastbound operations occurred in low- or mid - demand time periods. Of the 80
operations, 21 (26 %) occurred in a low- demand period or just above the lowest level of the mid -
demand operational criteria.

The above analysis, in the context of the July 2003 EA, related FONSI /ROD, and the approved
RUS at MSP, supports Eagan's stated concerns and presents what seems to be a logical
solution in the form of moving eastbound departure operations off of Runway 17 to Runway 12R
into the Eagan/Mendota Heights Departure Corridor during the nighttime hours, consistent with
the RUS.
Request
In consideration of the July 2003 EA, the related FONSUROD, the approved RUS at MSP, and
the analysis provided in this letter, the NOC voted to request that FAA:
• Place eastbound departure operations (headings east of 170 - degrees) during nighttime
southeast operational flows at MSP, which are currently occurring on Runway 17, on
Runway 12R consistent with the approved RUS.
• If it is FAA's determination that implementing the above request is not feasible, please
explain the Agency's position in the context of the information (FAA's July 2003 EA, the
related FONSUROD and the approved MSP RUS) and associated analysis contained in
this letter.

Dear NOC Co- Chairs Wilcox and Nelson:
This is in response to your letter dated September 19, 2007 referencing "Nighttime Southeast
Departure Headings off Runway 17 during Southeast Operational Flows at Minneapolis /St. Paul
International Airport (MSP) ".
To clarify your reference to southeast operational flows, we are assuming that the winds are too
strong to allow a head to head (Land Runway 30L -R and depart Runway 12L -R) nighttime
configuration at MSP. Normally, with south or southeast winds, ATC is directing flights to land
and depart Runways 12L -R. If traffic demand and wind condition permit, ATC will direct aircraft to
depart Runway 17 as a secondary option. This is in compliance with the Traffic Demand Period
Criteria Table contained in July, 2003 EA and mentioned in your letter.
I have reviewed the data from the month of July and it indicates that overnight runway closures
may have impacted the runway assignments, especially those occurring between the hours of
10:30 PM and Midnight. Our data concludes either Runway 12R/30L or 12U30R were closed on
13 of the 31 nights referenced. It appears maintenance was being performed on or near the
runways and a majority of these closures occurred during week nights (11 of 13) which have a
higher nighttime volume of traffic. The effect of these closures may result in tower controllers
utilizing Runway 17 more during these night time periods. I am not assuming that this Is the only
reason for the aircraft departing Runway 17, however it would certainly have an effect on the
ability to only depart on Runways 12L -R.
In your letter you make the following requests:
Place eastbound departure operations (heading east of 170 - degrees) during nighttime
southeast operational flows at MSP, which are currently occurring on Runway 17, on Runway
12R consistent with the approved RUS.
If the FAA determines implementation of the above request is not feasible, please explain the
Agency's position in the context of the Information (FAA's July 2003 EA, the related
FONSYROD and the approved MSP RUS) and associated analysis contained in this letter.

Implementing the above request is not consistent with the FAA's 2003 EA and the related
FONSI /ROD and the approved IVISP RUS. We conclude this for the following reasons:
Your request identifies only those aircraft which depart Runway 17 and directed to headings
east of 170- degrees. These aircraft are not specifically identified in any of the above
documents.
Your request only specifies Runway 12R, Table A -5 labeled as the "Revised Runway Use
System" gives no priority to Runway 12R over Runway 12L.
Your request implies "always ". There are traffic situations during these time periods that will
require that ATC direct flights off Runway 17 to go east of 170- degrees.
We have done a cursory review of the operational data that we have available (including MAC
Noise data) relating to the traffic that departs Runway 17 between the hours of 10:30 PM and 6
AM. It is our conclusion that we are operating the runway in compliance with the FAA's 2003 EA
and the related FONSI /ROD and the approved MSP RUS. More specifically, our research
indicates traffic levels during these time periods when Departures have occurred on Runway 17
are normally in the Mid Traffic Level as defined in the Traffic Demand Period Table. Those 15
minute periods are characterized as having between 3.5 and 15 operations which allows for
moderate use of the RUS.
The FAA recognizes that aircraft over - flights of residential areas, especially during nighttime
hours can be invasive. Although there are no quick and easy solutions to these problems, we can
assure you that the Minneapolis Air Traffic Control Tower staff will continue to operate in a
manner that minimizes noise impacts over residential areas.

discussed the City of Eagan's request. The Committee voted to send a letter to the FAA in a
manner consistent with the City of Eagan's request. (See Attachment A).
FAA's Response to the September 19, 2007 NOC Letter
On October 17, 2007 Mr. Carl Rydeen, MSP Federal Aviation Administration (FAA) Assistant Air
Traffic Manager, responded to the September 19th NOC letter. In his response Mr. Rydeen stated
that he assumed that head -to -head operations were not occurring in the Eagan /Mendota Heights
Departure Corridor during the July 2007 operations that were analyzed and that nighttime runway
closures and operational demand were the probable causes for the nighttime use of Runway 17 for
departures. (See Attachment B). In conclusion, Mr. Rydeen found that:
"Implementation of the [Eagan request] is not consistent with the FAA's 2003
EA and the related FONSIIROD and the approved MSP RUS. We conclude this
for the following reasons:

again look at the July 2007 flight data, but this time pull out any operations that would
have been impacted by the runway construction or took place during times of head to
head operations. Taking out these two impacts, were there still nighttime, eastbound
departures off 17 during that time period? If so, how would those operations fit within
the RUS traffic demand period criteria ?"
In response to Representative Miller's request staff removed from its analysis all nighttime Runway
17 departure operations that occurred during runway closures and /or could have been impacted by
head -to -head operations in the Eagan /Mendota Heights Departure Corridor. This removed 19
operations from the data sample, reducing a total of 134 July 2007 Runway 17 departure operations
in a southeast airport flow to 115. (See Attachment C). Of the total remaining Runway 17 departure
operations, 42 occurred during high - demand periods, with 29 of those being eastbound. (See
Attachment D). There were 66 operations that occurred during mid - demand periods, with 39 of
those eastbound. However, of the total Runway 17 departure operations during mid - demand
periods, approximately half occurred in a 15- minute period in which there were 7 or fewer
operations at the airport. (See Attachment E). During low- demand periods there were 7 total
operations, 3 of which were eastbound. (See Attachment F).
At the November 14, 2007 NOC meeting staff will provide a briefing on this topic.

Noise Oversight Committee (NOC) asking that they examine the feasibility of moving more

Over the past few months, Eagan residents have noticed an increasing number of early
morning flights departing to the east off of Runway 17 using the 120 degree heading.
According to the Runway Use System for MSP Airport, the parallel runways, over the
tagan/Mendota Heights Corridor are to be used as the preferred runways for nighttime
MUNICM COMM operations due the more compatible land uses within the Corridor. The City of Eagan

On October 17, 2007 I received a letter from Mr. Carl Rydeen, Federal Aviation Administration
(FAA) Assistant Air Traffic Manager at Minneapolis /St. Paul International Airport (MSP). The
letter was in response to my September 27, 2007 letter to the FAA supporting the position
outlined in a September 19, 2007 Noise Oversight Committee (NOC) letter to the FAA regarding
nighttime southeast departure operations off Runway 17 at MSP.
In his response to me Mr. Rydeen attached a copy of his response to the September 19 NOC
letter. Mr. Rydeen raised two primary variables that may be causing the southeast departures off
Runway 17. Nighttime runway closures and operational demand were presented as the possible
causes,
I have discussed FAA's response with Mr. Chad Leqve, Manager of Aviation Noise and Satellite
Programs. Chad indicated that Mrs. Dianne Miller has contacted him regarding the FAA's
response letter and that MAC staff is in the process of analyzing the effect of the scenarios
outlined in Mr. Rydeen's response to the September 19 NOC letter. It is my understanding that
the findings of this analysis will be discussed at the November 14, 2007 NOC meeting.
I have asked Chad to provide an update of the NOC discussion and analysis findings at the
December 5, 2007 meeting of the Metropolitan Airports Commission (MAC) Finance,
Development and Environment Committee.
In closing, I look forward to reviewing the findings of the collaborative efforts underway on this
issue.

On Monday, October 15, 2007 the MAC Board approved a settlement in a noise mitigation
lawsuit brought by the cities of Minneapolis, Richfield and Eagan together with the Minneapolis
Public Housing Authority. The cities and the Minneapolis Public Housing Authority approved the
settlement and on October 19, 2007 the settlement was approved by Hennepin County District
Court Judge Stephen Aldrich.
The cities' lawsuit, and a separate class- action lawsuit brought by residents near the
Minneapolis -St. Paul International Airport (MSP), stemmed from disagreements over the
amount of noise mitigation that is appropriate in the 60 to 64 Day -Night Average Sound Level
(DNL) noise contours (The federal government requires use of the DNL metric to measure noise
near airports.)
This settlement represents a reasonable, financially responsible plan to address aircraft noise
concerns near the airport. The agreement brings closure to an issue that has generated years of
public policy debate and disagreement.
The goal of the agreement is to provide a mitigation program commensurate with noise impacts.
The settlement takes into account the amount of mitigation needed in particular areas and
ensures every dollar provided goes toward purchase and installation of noise - reducing
improvements.
Under the settlement agreement, the MAC will provide mitigation to homes in the 60 to 64 DNL
contours. The contours are outside the federal standard for noise mitigation. Mitigation activities
will vary based on noise contour, with homes in the most noise - impacted contours eligible for
more extensive mitigation than those in less impacted areas. Multi- family dwellings (those with
more than three living units) will receive less extensive mitigation than single - family homes. The
total cost to the MAC is uncertain until the program is completed, but it is estimated the program
could cost as much as $127.65 million to implement.
Four separate residential noise mitigation plans are included in the agreement. Costs depicted
in each of the four programs are in 2007 dollars and will be adjusted annually for inflation
according to the Consumer Price Index:
1. Single - family Homes in the Projected 2007 Mitigated 63 -64 DNL Noise Contours
The, approximately 432 homes in the most noise - impacted contours will be eligible to
receive the same level of noise mitigation provided in the 65 and greater DNL contours.
The program is designed to achieve an average noise level reduction goal of five
decibels. Depending on the improvements needed to reduce interior noise sufficiently,
modifications can include: central air conditioning; exterior and storm window repair or
replacement; prime door and storm door repair or replacement; wall and attic insulation;
and baffling of roof vents and chimney treatment. Construction will be scheduled for
completion by December 31, 2009,
2. Single- family Homes in the Projected 2007 Mitigated 60 -62 Noise Contours
Owners of the approximately 5,344 homes in less noise- impacted areas will be eligible for
one of two mitigation packages: 1.) The estimated 3,421 homes that did not have central
air conditioning as of September 1, 2007 can receive it. to addition, homeowners will get
up to $4,000 (including installation costs) in other noise mitigation products and services
that they can choose from a menu provided by the MAC. 2.) Owners of homes that
already had central air conditioning installed as of September 1, 2007 or who choose not
to receive central air conditioning will be eligible for up to $14,000 (including installation
costs) of noise mitigation products and services that they can choose from a menu
provided by the MAC. Categories of products on the menu will include: exterior and
storm window repair or replacement; prime door and storm door repair or replacement;
wall and attic insulation; and baffling of roof vents and chimney treatment. Construction is
scheduled for completion by December 1, 2012.
3, Multi- family Homes in the Projected 2007 Mitigated 60 -64 DNL Contours
Any of the approximately 1,931 multi - family units in the projected 2007 mitigated 60 -64
DNL contours that do not have air conditioning will receive through- the -wall or equivalent
permanently - installed air conditioners. The MAC also will install an acoustical cover for
each air conditioner in the multi - family units. Installation is scheduled to be completed by
December 1, 2010.
4. $7 Million Total for Opt -Out and 2005 Mitigated Single- Family Homes
Single- family homes whose owners opted out of the already - completed MAC noise
mitigation program but that now have new owners will be eligible to `opt in" and receive
noise mitigation. If the total cost to the MAC of opt -in mitigation is less than $7 million,
any remaining monies will be used to reimburse owners of single4amily homes between
the 2005 Mitigated 60 -64 DNL contours and the 2007 60 'DNL contour for purchase and
installation of products included on a menu provided by the MAC. The amount each
homeowner receives will be determined by subtracting dollars spent for the opt -in
program from the total $7 million budget and dividing the remainder among the total
number of single - family homes within the 2005 60 -64 DNL and 2007 60 DNL contours.
The MAC will begin to issue reimbursements by March 1, 2010 and will complete them by
July 31, 2014. The total the MAC will spend on the opt -out and 2005 program all together
is capped at $7 million.
The following table provides an estimate of the number of dwellings in each of the DNL contour
areas subject in the settlement.

Attachment A provides a map of the new mitigation areas. Additionally, detailed map information
is also available on the www.macnoise.com website, including an interactive mapping
application that provides the ability to enter an address and map it in relation to the eligible
mitigation areas.
Owners of single- family homes participating in the program who sell the home within two years
of receiving mitigation could be required to reimburse the MAC for twenty -five percent of the
cost of providing the mitigation, up to a maximum of $3,500 per home.
The MAC will propose that representatives and members in the separate class - action suit also
accept the terms of the agreement. A proposed settlement was previously reached in the class -
action case; however, the terms of the cities settlement provides more mitigation to a greater
number of residents around the airport than the terms of the previously proposed class - action
settlement. The court in the class- action case will need to review and approve application of the
cities' settlement to the class- action case. If the judge does not agree to apply the terms of the
cities' settlement to the class- action case within 90 days of accepting the agreement in the
cities' case, the settlement in the cities' case becomes void and the cities' lawsuit will be
reinstated.
Finally, the MAC will seek the advice of the Federal Aviation Administration that the settlement
agreement with the cities is an appropriate use of airport revenue, and consistent with federal

grant obligations. Unless the MAC receives such advice by November 30, 2007, the agreement
is null and void.

work plan elements that they would like to include on the 2008 Work Plan. To date, MAC staff
has received two requests for additional items to be placed on the 2008 NOC Work Plan.
Additionally, MAC staff has also placed additional items on the work plan per requirements
outlined in the noise litigation settlement Consent Decree in the Sate by City of Minneapolis v.
MAC matter.
The attached Draft 2008 NOC Work Plan includes the items reviewed at the September 19`"
NOC meeting and the additional items that have been added for Committee consideration.
For purposes of review, the Committee had an extremely productive year accomplishing the
following in 2007 (representing completion of the 2007 NOC Work Plan):
• Analyzed departure flight track headings off of Runway 17 and associated community
concerns with the 190 - degree departure heading constraint. NOC's analyses and work
with the FAA resulted in the implementation of the 215- degree departure heading off
Runway 17, moving more westbound departure operations over the unpopulated
Minnesota River Valley.
• Analyzed runway use at MSP, per the planned runway usage, and discovered low
Runway 17/35 usage figures. The Committee sent a letter to the FAA questioning actual
runway use statistics as compared to the runway use numbers published in the
environmental documentation leading up to the opening of Runway 17. As a result, it
was discovered that the FAA was moving forward with the final phase of Runway 17/35
integration at MSP. The result was Runway17 /35 operational numbers that are now
consistent with the previously planned runway usage.
• Reviewed the operation of MSP with Runway 30L/12R closed for construction.
• Developed a communication plan consisting of four specific elements designed to inform
residents of the temporary change in operations at MSP due to the reconstruction of
Runway 30L/12R.
• Received updates on the Part 150 litigation and associated developments throughout
the year.
• Reviewed new state legislation regarding airport safety zone in real estate transactions.
• Analyzed compliance with the Runway 12L Runway End Departure Turn Point
Procedure and approved a new reporting format for the Monthly Eagan /Mendota Heights

Corridor Report which more thoroughly assesses early turns off Runway 12L and
assesses aircraft that leave the corridor boundaries over unpopulated areas but return
before flying over residential areas.
• Received an update on aircraft fleet mix trends and the increase toward quieter aircraft
operating at MSP.
• Reviewed concerns from Richfield residents regarding noise impacts from operations on
the west side of MSP.
• Initiated noise monitoring studies of west side aircraft engine start procedures and
analyzed the data to establish the best practice for reducing engine start noise impacts
in Richfield.
• Endorsed west side tenant actions to help address ramp ground noise impacts in the
City of Richfield.
• Endorsed the hushkitted Stage 3 aircraft engine start procedure for west side cargo
ramp operations providing a standardized engine start procedure that reduces noise
impacts in East Richfield.
• Requested that the late night/early morning B737 Kitty Hawk Air Cargo operation comply
with the hushkitted aircraft engine start procedure due to the low background noise
levels when the operation occurs.
• Analyzed low monthly compliance with the Eagan /Mendota Heights Departure Corridor
and communicated with the FAA on the issue, resulting in increased monthly corridor
compliance.
• Reviewed options for future discussion and analysis of possible RNAV procedures at
MSP to reduce noise impacts.
• Analyzed nighttime Runway 17 departure operations during southeast operational flows
at MSP and sent a letter to the FAA questioning Runway 17 nighttime departures, as
compared to the approved RUS at the airport, and consistency with approved
procedures.
• Evaluated nighttime operations trends and updates to the Voluntary Nighttime
Operations Agreement with airlines.
• Continued to review input received from the quarterly public input meetings.
Considering the above, the attached 2008 Work Plan is provided for Committee
concurrence /approval to be presented by the NOC Co- Chairs at the December 5, 2007 MAC
Finance, Development and Environment Committee meeting.
