Unfortunately the existing plans were designed for compliance with the 2006 International Building Code (IBC) as amended by the State of Minnesota.The plans that are submitted with the new building permit application will have to comply with the current Code (2015 Minnesota Building Code).The plans for this project are required to be designed by an architect duly licensed under the laws of the State of Minnesota. Since the existing plans were designed by Mohagen Hansen Architectural Group, and are copyrighted, any revisions to their plans would have to be done/approved by them. Having said that,there may not have to be wholesale changes to the existing plans to bring them into compliance with the new Building Code. If you want to use the existing plans, I would suggest you contact Mohagen Hanson and have them revise the plans accordingly. If that is not an option, new plans prepared by a licensed architect,will have to be submitted for review when applying the new building permit. The existing structural plans would also have to be revisited by the engineer of record (Safe Haven Structural Engineering), and revised accordingly to meet the new Building Code. The building permit was applied for October 9th of 2013.A plan review letter was sent to the contractor on October 15th. Only four of the 10 items listed were addressed. A year and a day after the application was submitted we still had no further responses to the review letter,the permit was then considered abandoned. Per Chapter 1300.0120,Subp. 9, of the Building Code: "An application for a permit for any proposed . work shall be considered abandoned 180 days after the date of filing, unless the application has been persued in good faith or the permit has been issued". In the time period since the permit was abandoned, a new version of the Building Code has been adopted by the State and the City of Eagan. In order to continue with the proposed project,you will need apply for a new building permit and provide all of the required submittal documents/information listed on the third page of the application. From 2012 until around July of this year there was a lawsuit going on between the owners (not me)and as of around July there is new ownership. (which includes me at 25%) However all the old obligations and so forth have went with the project. The old owners owe Sathre-Berquist 8K and I am trying to get that money in addition another 1,500 to do the work. Of course Sathre-Berquist trusts me but they have a bad taste in their mouth from the last owners and wont move forward without the money up front, however if I tell them you will release the money to them once it is done Im sure they would go for that. How about if I tell Sathre-Berquist that you will release their total amount once the work is done and you guys can send them a check which would be less then 9,500 and is way less then the money you are holding. Even if you let the permit go forward with approvals but didn't release the permit until after the work was completed I would be OK with that because I can get it sorted out before then. The money in escrow is not mine it belongs to Jeff Scherer, in addition I have to pay the previous owner and current owner on past obligations so I wont see any money out of this project for a number of years. I know you guys want to get this to move forward and I have only been involved for a few months so you shouldn't hold things against me I wasn't involved with or have any control over. I understand you want it done and I agree I want to get it done. Sometimes it takes time to move forward and clean things up. I have known you for years and I know if I can talk to you in person we can figure out a solution that will work for the city and help us move forward.
