SUBJECT: AIRPORT RELATIONS COMMISSION MEETING OF OCTOBER 14
A regular meeting of the Eagan Airport Relations Commission will be held on Tuesday, October 14, 2003 at
7:00 p.m. in the Eagan City Council Chambers. Please contact Mary Swenson at 651- 675 -5005, if you are
unable to attend this meeting.
I. ROLL CALL AND ADOPTION OF AGENDA
The agenda, as presented or modified, is in order for adoption by the Commission.
H. APPROVAL OF MINUTES
The minutes of September 9, 2003 ARC meeting are attached on pages through . These
minutes, as presented or modified, are in order for adoption by the Commission.
III. VISITORS TO BE HEARD
The Eagan City Council and its Commissions set aside up to ten minutes at the beginning of public
meetings to permit visitors to address items of interest to the meeting that are not on the regular agenda.
Items that will take more than ten minutes or that require specific action, can be scheduled for future
agenda.
IV. OLD BUSINESS
A. ARC Communication Plan —As is customary, an agenda item is included to provide progress
reports /concept ideas on the ARC's communications initiatives. Recently, a Your Town News story aired
regarding the meeting that the ARC had with Cindy Greene of the FAA and Chad Leqve of the MAC. Per
the request of the newsletter subcommittee, an article regarding how airplane noise is measured is
scheduled for the November /December edition of Experience Eagan. The following are the ARC
communications subcommittees, which have been provided should the subcommittees wish to provide an
update:
a. Newsletter articles Commissioners DiNella, Thorkildson, and Hooppaw
b. ARC "Notebook" —Chair Staricha, and Commissioners Schlax and Thompson
C. Cable Television—Commissioners Nierengarten and Krahn
B. Airport Disclosure /Declaration Legislation —Per the request of the City Council, the
Commission, at the August 12 ARC meeting, discussed the issue of disclosure legislation, as well
as previous deliberations that the Commission had regarding this issue. As the cornnussion may
recall, the discussion stemmed from legislation passed in the State of the California which required
property owners to disclose if a property is located within the vicinity of an airport. Enclosed on
pages through is a copy of the California legislation. Per the request of the Commission,
enclosed on pages through is a copy of the City's Comprehensive Guide Plan section
entitled, "Airports and Aviation ". Included in the section is reference to land -use compatibility
guidelines. In speaking to the City Attorney, he informed staff that the City cannot require
homeowners to disclose how airport noise impacts their home. The Connnission is asked to further
discuss the issue of disclosure and provide a recommendation to the City Council as to whether the
City should proceed in investigating and /or promoting State legislation regarding the disclosure of
airport noise
C. Eagan /Mendota Heights Corridor Analysis Attached on pages through is the August
2003 Eagan/Mendota Heights Departure Corridor Analysis. Also enclosed, on pages through
, is the August 2003 Technical Advisory Report. The August reports are the most recent
reports available from the MAC. Assistant to the City Administrator lord contacted MAC
regarding updated 2002/2003 comparisons reports. MAC staff informed Ms. Lord that due to a
reduction in staffing, they are no longer producing the comparisons reports. However, MAC
encouraged the City to contact them with any specific requests for information that previously
would have been included in the reports. Also, for the Commission's information, MAC has hired
an employee to focus on the ANOMS program. He or she will be starting at the end of October. If
it is the desire of the Commission, further discussion regarding Corridor compliance would be in
order.
V. NEW BUSINES
A. Response from Cindy Greene re: Corridor Deviation on September 20, 2003 —Per the request
of Commissioner Nierengarten and the feedback provided via e mail from other Commissioners,
staff was in contact with Cindy Greene, FAA Tower Operations Manager. Enclosed on page is
Ms. Greene's response to the City's inquiry. Furthermore, staff inquired about the cost to obtain
ATC transcripts. According to Ms. Greene, the FAA does not release the voice tapes; however,
they will provide transcripts of tapes at a cost of approximately $150 -200 per one hour of
operations. The Commission may wish to discuss the process they would prefer to take in regards
to obtaining infonnation about future incidents in which deviation occurs
B. Resolution re: Relocation of the Minnesota Army National Guard —Per the request of
Commissioner Sclilax, enclosed on pages through is an article that appeared in the October
6, 2003 Star Tribune regarding the possible relocation of the Army National Guard from the
downtown St. Paul airport. Commissioner Schlax requested that the Connnission discuss the
possible relocation and consider recommending a resolution to the City Council to voice opposition
to the relocation due to increased air traffic over Eagan.
C. Mendota Heights Comprehensive Guide Plan Amendment Request —The City of Mendota
Heights is requesting comments on an Environmental Assessment Worksheet for a residential
development called The Bluffs in western Mendota Heights within Noise Zone 4 as defined by
the Metropolitan Council Aviation System Plan. Excerpts from the EAW dated August 26,
2003 are enclosed on pages . While the City of Mendota Heights has guided the
area for residential uses in its Comprehensive Guide Plan and indicates an intention to require
the development to conform to its sound attenuation ordinance, the addition of new housing
units within a known noise impacted area will diminish the effectiveness of the corridor to
minimize impacts on residential areas.
In the past, the Eagan City Council, at the recommendation of the ARC, has made policy
statements voicing opposition to development that is incompatible with airplane noise.
Furthermore, the City of Eagan has long maintained that compatible land uses in and near the
Eagan/Mendota Heights Corridor should be maintained to the greatest extent possible. As an
example, enclosed on page is correspondence that was sent to the City of Mendota
Heights, and copied to the Metropolitan Council, in 1999.
The Eagan City Council will have the opportunity to comment on Mendota Height's
Environmental Assessment Worksheet at its meeting on October 21, 2003 in anticipation of the
comment deadline of October 30, 2003. Therefore, the Commission is asked to discuss whether it
desires to reaffirm the City's position in speaking against incompatible development within airport
noise zones and within or near the corridor. The ARC's recommendation will be forwarded to the
City Council at the time they consider comments to Mendota Heights regarding the EAW.
D. 2004 -2010 MAC Capital Improvement Program (CIP)— Enclosed on pages through
is correspondence from the MAC regarding their proposed 2004 -2010 CIP. Also included with the
correspondence is an analysis that was conducted by MAC to determine what the effect would be if
Runway 17/35 were to be delayed. The MAC Planning and Environment Committee discussed the
proposed CIP at the October 8 meeting. A discussion of MAC Commission of the whole will take
place on Monday, October 20. All municipalities surrounding the MSP Airport have been provided
a copy of the proposed CIP for review and comment. If the Commission has comments or questions
regarding any of the proposed CIP projects, it may wish to consider a recommendation that the City
Council send formal correspondence voicing any comments about the CIP projects to the MAC.
E. INM Data Variables —Per the request of Chair Staricha, Assistant to the City Administrator Lord
contacted the MAC to inquire whether the HNTB consultant who provided a presentation of the
INM data variables to the NOC would be able to give the same presentation to the ARC. AS the
Commission will recall, the INM data variables will be used in preparing the Part 150 study and the
2007 noise contours. Unfortunately, the HNTB consultant, Kent Duffy, is located in Alexandria,
Virginia and there are no other HNTB consultants in the Minneapolis area that have been involved
in the Part 150 process at MSP. Included on pages through is the power point presentation
that was provided by HNTB at the August 21 NOC meeting. An agenda item has been included to
provide an opportunity for the Commission to raise questions about the enclosed data. Any
questions or concerns could then be forwarded to Mr. Leqve for a response.
VI. STAFF / COMMISSION REPORT
A. Noise Oversight Committee — Assistant to the City Administrator Lord attended the Noise
Oversight Committee (NOC) meeting on September 18, 2003. Enclosed on pages through are the
draft minutes from the NOC meeting. Also enclosed, on pages through , is an updated schedule
provided to the NOC regarding the Part 150 process.
B. MAC Meeting Update—Assistant to the City Administrator Lord attended the October 8
MAC Planning and Enviromnent Committee meeting, at which the Committee was provided an
update regarding the Part 150 Forecast. An open house will take place on Thursday, October
23, from 4 -8 p.m. at the MAC General Offices to provide a forum for discussing the revised
forecast and other information that will be used in developing the airport noise contours for
2007. A separate open house will be scheduled when the draft noise contours are being
proposed. The Planning and Environment Committee also discussed the proposed 2004 -2010
Capital Improvement Program (CIP), which was referenced under New Business.
F. MSP Joint Airport Zoning Board (JAZB) —As Commissioner Schlax noted at the September 9
ARC meeting, the JAZB has not met since they submitted the final Draft Airport Zoning Ordinance
to MnDOT. The JAZB will reconvene when they receive a response from the MnDOT
Conunissioner regarding the draft ordinance.
G. The Airport Noise and Capacity Act of 1990 —Per the request of the Commission at the
September 9 ARC meeting, enclosed on pages through is a copy of United States Code
pertaining to the National Aviation Noise Policy, which is based on The Airport Noise and
Capacity Act of 1990. Also enclosed, on pages through , is a law review of the 1990 Act,
which provides additional insight about the regulations provided in the Airport Noise and Capacity
Act.
H. Response from Governor Pawlenty re: Eagan's Representation on MAC —Per the
Commission's request, staff followed up with the Governor's office regarding the correspondence
sent by the City In July 2003 regarding the Governor's position on the current structure of the
MAC, particularly as it relates to Eagan's representation. After speaking to numerous staff
members at the Governor's office, it appears that the letter was misplaced, to which they offered
their apology. A copy of the letter was faxed to the Governor's office in August with a request that
a response be prepared in advance of the October 14 ARC meeting. As of Wednesday, October 8,
the City has not received a letter of response. In the event the letter is received after the ARC packet
has been prepared, Assistant to the City Administrator Lord will provide the Commission with a
copy of the letter at the ARC meeting.
I. N.O.I.S.E. Conference MaterialCouncilmembers Carlson and Fields attended the 2003
N.O.I.S.E Conference, held in Washington D.C., this past July. Enclosed are copies of handouts
that were provided to attendees at various conference sessions and in their welcome packet. The
material is being provided at the request of Chair Staricha, and is intended for informational
purposes. No action is required.
J. November ARC Meeting Date —The November ARC meeting falls on Tuesday, November 11,
which is Veteran's Day. Therefore, the November ARC meeting date must be rescheduled. The
City Council has expressed an interest in conducting a joint meeting with the Eagan City Council at
their November workshop. The Council, in efforts to maintain communications with their advisory
commissions, has been holding joint meetings with each commission. The November Council
workshop is tentatively scheduled for Monday, November 10. The Council will be discussing their
November workshop date at the October 14 workshop. Assistant to the City Administrator Lord
will be able to provide the ARC with a confirmed November workshop date at the October ARC
meeting. It would be beneficial for the Commission to brainstorm topics that they would like to
discuss with the City Council.
VII. ROUNDTABLE Per the request of the Commission at the March 3 Goals setting workshop,
this agenda item has been added so that commissioners have the opportunity to ask questions or
make requests for future agenda items.)
VIII. ADJOURNMENT
Commission meetings will go no later than 8:30 p.m. unless agreed upon by the Conullission.
