12/03/2003 - Airport Relations Commissioncity of pagan MEMO TO: CHAIR STARICHA AND THE EAGAN AIRPORT RELATIONS COMMISSION FROM: DIANNE LORD, ASSISTANT TO THE CITY ADMINISTRATOR DATE: DECEMBER 3, 2003 SUBJECT: AIRPORT RELATIONS COMMISSION MEETING OF DECEMBER 9, 2003 A regular meeting of the Eagan Airport Relations Commission will be held on Tuesday, December 9, 2003 at 7:00 p.m. in the Eagan City Council Chambers. Please contact Mary Swenson at 651 -675 -5005, if you are unable to attend this meeting. I. ROLL CALL AND ADOPTION OF AGENDA The agenda, as presented or modified, is in order for adoption by the Commission. H. APPROVAL OF MINUTES The minutes of the October 14, 2003 ARC meeting are attached on pages through . These minutes, as presented or modified, are in order for adoption by the Commission. Also included for the Commission's information, on pages through , are the minutes from the November 12 joint meeting of the City Council and ARC. III. VISITORS TO BE HEARD The Eagan City Council and its Commissions set aside up to ten minutes at the beginning of public meetings to permit visitors to address items of interest to the meeting that are not on the regular agenda. Items that will take more than ten minutes or that require specific action, can be scheduled for future agenda. IV. OLD BUSINESS A. ARC Communication Plan—As is customary, an agenda item is included to provide progress reports /concept ideas on the ARC's communications initiatives. As the Commission may recall, e mail correspondence took place with commissioners regarding possible conununication initiatives. Enclosed on page is a recent e mail from Communications Director Garrison with his suggestions for upcoming stories and cable shows. The Commission is encouraged to further discuss their immediate communications ideas and initiatives. The following are the ARC communications subcommittees, which have been provided should the subcommittees wish to provide an update: a. Newsletter articles Commissioners DiNella, Thorkildson, and Hooppaw b. ARC "Notebook" —Chair Staricha, and Commissioners Schlax and Thompson C. Cable Television — Commissioners Nierengarten and Krahn B. Eagan /Mendota Heights Corridor Analysis Attached on pages through _ is the October 2003 Eagan/Mendota Heights Departure Corridor Analysis. Also enclosed, on pages through , is the October 2003 Technical Advisory Report. The October reports are the most current reports available on the MAC website. As a reminder, this past September, the MAC informed City staff that they will no longer be publishing the 2002/2003 comparison reports due to a reduction in staffing. V. NEW BUSINESS A. Northwest and Mesaba Airlines—At the November 12 joint meeting of the City Council and the ARC, it was suggested that the ARC invite representatives from Northwest Airlines' and Mesaba Airlines' Government Relations staff to an upcoming ARC meeting. The purpose of the discussion would be to dialogue about how the City could show its appreciation for the Airlines' presence in the community, as well as discuss how the relationship between the City and the Airlines could be strengthened. The Commission is asked to discuss what meeting would be best to invite the airlines' representative to attend, and what topics the Commission would like to discuss. B. Two -year ARC Communications Plan —At the November 12 joint meeting of the City Council and the ARC, the Council requested that the ARC formulate a two -year communications plan to address, in particular, the opening of the new North/South Runway in 2005. The Council asked that the Communications Plan be prepared and presented to the City Council by May of 2004. The Commission is asked to discuss the strategy they would like to take to formulate the Communications Plan. VI. STAFF / COMMISSION REPORT A. Noise Oversight Committee—Assistant to the City Administrator Lord attended the Noise Oversight Conunittee (NOC) meeting on November 20, 2003. As of the time the packet was mailed, the draft November NOC minutes were not available on the MAC website. Assistant to the City Administrator Lord will provide a verbal update on the most recent NOC meeting. B. MAC Meeting Update— Assistant to the City Administrator Lord will provide an update on the December 3, 2003 MAC P &E Committee meeting, at which the P &E considered the 2004- 20 10 CIP and the NOC work plan. C. MSP Joint Airport Zoning Board (JAZB) —The JAZB has not met since they submitted the final Draft Airport Zoning Ordinance to MnDOT. The JAZB will reconvene when they receive a response from the MnDOT Commissioner regarding the draft ordinance. D. Response from Governor Pawlenty re: Eagan's Representation on MAC —After following up with staff at the Governor's office regarding correspondence that the City sent pertaining to the structure of MAC, the City sent a second letter to Governor Pawlenty requesting a response to the City's questions. Enclosed on pages through is the first letter sent by the City, as well as the follow up letter that was sent. As of December 3, 2003, the City had not received a response from the Governor's office. As the Commission will recall, Mayor Geagan, at the November 12 joint meeting, noted that he would bring up the issue of the MAC structure with Representative Wilkin at their next meeting. E. Rogers Lake Lawsuit —For informational purposes only, enclosed on pages through is a Petition for Review of the FAA in the 81h Circuit Court of Appeals by Mr. Guy Heide, a resident of Mendota Heights' Rogers Lake neighborhood. The suit is challenging the Finding of No Significant Impact (FONSI) issued by the FAA for the new departure procedure off of Runway 17 ( "Alternate E "). Assistant to the City Administrator Lord will provide a brief sunmlary of the lawsuit. F. Airport Update: Congressman John Kline— Enclosed for the Conunission's information is a flyer that was mailed to Congressman Kline's constituents regarding airport noise. This is an informational item only. G. MSP Airport Noise Policy Area —Per the request of Chair Staricha, enclosed on pages through is the MSP Airport Noise Policy Area map adopted by the Metropolitan Council, which shows how the noise zones correlate to the 1996 DNL Contours. The map is included as there was some interest expressed as to how the proposed development in Mendota Heights related to the City of Eagan's requirements for construction within the designated noise zones. Also for the Commissions information, included on pages through is the City's Aviation section of the Comprehensive Guide Plan, which includes the Metropolitan Council's Land -use Compatibility Guidelines, which the City of Eagan adheres to when developing. H. Mendota Heights Development Proposal — "The Bluffs " —As an update for the Commission, the City of Mendota Heights, in response to many continents and concerns about the proposed "Bluffs" development, has chosen to have an Environmental Impact Statement (EIS) completed on the proposed development. For the Commission's information, enclosed on pages through is a memo fiom Barr Engineering, which summarizes the feedback received in response to the EAW and provides the recommendation for the EIS. I. FAA Reauthorization Bill Update —On November 21, 2003, Congress passed legislation to reauthorize the programs of the Federal Aviation Administration (FAA) for fiscal years 2004- 2007. Enclosed on page is a summary of the legislation. J. SMAAC Newsletter — Enclosed on pages through is the most recent newsletter from the South Metro Airport Action Council (SMAAC). K. Guidelines for Advisory Commission Appointments /Procedures —The City Council, during the past few months, has discussed on numerous occasions a new policy to modify the appointment process for advisory commissions. Letters were recently sent to all Commission members to notify them of the Council's action to extend the Commmissioners terms through April. Under the new policy, which is in final draft form, states that Commission appointments will now be made in April of each year, rather than January. Assistant to the City Administrator Lord, at the next ARC meeting, will elaborate on the Council's discussion and rationale for making the change. L. Commissioners' Requests for Distribution to the ARC —Per the request of Commissioner Thompson, enclosed without page number is a sample of Edina Realty's Seller's Property Disclosure Statement. Commissioner Thompson asked that the disclosure statement be included in the packet as a follow up to the Commission's discussion with the City Council regarding property owners disclosing their home's proximity to an airport. Also enclosed on pages through , per the request of Commissioner Thompson, is an article regarding Wireless LAN. Per the request of Commissioner DiNella, enclosed on pages through is an article that appeared in Travel Weekly. M. Commissioner Cook's Resignation — Commissioner Michael Cool submitted his resignation from the ARC effective January 1, 2004. The City thanks Mr. Cook for his two years of dedicated service to the community! VII. ROUNDTABLE Per the request of the Commission at the March 3 Goals setting workshop, this agenda item has been added so that commissioners have the opportunity to ask questions or make requests for future agenda items.)
