ROLL CALL AND ADOPTION OF THE AGENDA The agenda, as presented or modified, is in order for adoption by the Commission. II. APPROVAL OF MINUTES The minutes of the September 27, 2012 Airport Relations Commission meeting are enclosed on pages Jf through ? . These minutes, as presented or modified, are in order for adoption by the Commission. These are the most recent minutes needing approval as the ARC met in a joint meeting with the City Council in October 2012, and attended the RNAV open house in November 2012. III. VISITORS TO BE HEARD The Eagan City Council and its Commissions set aside up to ten minutes at the beginning of public meetings to permit visitors to address items of interest that are not addressed on the regular agenda. Items that will take more than ten minutes or that require specific action can be scheduled for a future meeting agenda. IV. PRESENTATIONS A. Presentation by Delta Airlines —Per the ARC's work plan, Jeffrey Hart, Delta Airline's General Manager of Airport Customer Service at MSP and Co -Chair of the Noise Oversight Committee (NOC), has accepted the invitation of the ARC to speak at the January 8 meeting about fleet trends at Delta, as well as overall trends Delta is observing in the airline industry. Enclosed on pages 01 through 15 is an MSP Annual Fleet Mix Assessment (October 2011 - September 2012), which was presented to the NOC in November 2012. 11 V. OLD BUSINESS A. Communications Update - It is the practice of the Airport Relations Commission to discuss their communication initiatives each month, which include articles in the Experience Eagan Newsletter, as well as stories aired on the City's local access cable channels. The Commission is welcome at this time to make additional suggestions for communication initiatives regarding airport issues. B. MAC Monthly Reports - Eagan /Mendota Heights Corridor Analysis /Technical Advisory Report /17 -35 Departure Analysis Report - Enclosed on pages J(q through is the November 2012 Eagan/Mendota Heights Corridor Analysis. Enclosed on pages aR through So is the November 2012 Technical Advisory Report. Enclosed on pages T% through Bq is the November 2012 Runway 17 Departure Analysis Report. Enclosed on pages though 9a_ is the November 2012 Crossing -in -the- Corridor Analysis, The November reports are the most current reports available on the MAC website. C. FAA Update on Performance Based Navigation (PBN) Implementation at MSP Airport — Enclosed on page C13 is an update provided by Chad Leqve at the MAC with regard to the implementation of PBN at MSP Airport. As the memo indicates, despite the action taken by the MAC to support a partial implementation of the FAA's new flight procedures, the FAA has stated, "there is no timeline for completion of the review [of partial implementation]." Mr. Leqve had hoped to attend the January 8 ARC meeting to give this update in person; however, he is attending a City Council meeting in another community that same evening. Given the FAA's position, all communities are simply waiting to hear about next steps in the review of PBN implementation, and there is no proposal or action before the City with regard to new operations. As the Commission is aware, the City received a significant amount of communication from residents in the months of November and December, both in favor and opposition to the proposed tracks. All emails that were addressed to the ARC were shared with the Commission when they were received. The City heard from many residents, in particular, who live near the intersection of Cliff Road and Pilot Knob Road. In response to their concerns, the MAC provided the map enclosed on page aAq , which shows a comparison between the operations that would have been anticipated with the new flight tracks compared to the number of actual operations on an average annual day in 2011. According to the MAC, this area of the community could have expected an average of 5.2 additional operations per day if the new tracks had become operational. Several residents contacted the City, stating their intent to address the ARC at the January 8 meeting on this topic. Assistant City Administrator Miller has communicated that residents are always welcome to attend the ARC meetings, but also noted that there is no action or recommendation being sought from the City Council with regard to the previously proposed flight tracks, as there is no proposal before the City. D. 2013 Noise Oversight Committee (NOC) Work Plan— Enclosed on pages OIS and 0�-1 is a memo from Chad Leqve highlighting the accomplishments of the NOC in 2013. Also enclosed is the 2013 draft NOC Work Plan, which was approved by the MAC in December 2012. One addition was made to the NOC work plan, and that was the consideration of the request from the City of Edina for a community representative seat on the NOC. Enclosed on pages Cj through t is additional information about Edina's request. VI. NEW BUSINESS A. 2013 ARC Town Hall Meeting —Per the 2013 ARC works plan, a town hall meeting is tentatively scheduled for Thursday, March 14, 2013. The Commission is encouraged to discuss the logistics for this meeting, including a location, time, etc. When the work plan was prepared, it was thought that the town hall meeting could take place in a location in the City that was to be impacted by the proposed RNAV tracks. However, given that the proposed tracks are not moving forward at this time, the Commission may want to consider a location currently impacted by airport operations. Typically, once an area of the community has been identified, City staff will prepare a mailing notice area and send postcard invitations to all households within that area. VII. STAFF / COMMISSIONER REPORT A. Continued Review of Runway 35 River Visual Approach Procedure — Enclosed on page tba is a memo from Chad Leqve to the NOC regarding the FAA's ongoing review of the the Runway 35 River Visual Approach Procedure. The FAA has one again stated that several issues need to be resolved prior to the implementation of this procedure, including airspace design and a determination if such a procedure could be used at night. The river visual approach remains on the NOC work plan for 2013, per the request of the City of Eagan. B. FAA Update on RNAV River Valley Procedures — Enclosed on pages I03 and [Oq is a memo from Chad Legve to the NOC noting that on December 21, 2012, the FAA suspended the use of the RNAV procedures over the Minnesota River Valley because they have determined that the procedures "have proven to be operationally problematic from an Air Traffic Control perspective." The NOC will receive a briefing on the topic at the January 16, 2013 NOC meeting. VIII. ROUNDTABLE Per the request of the Commission, this agenda item has been added so that Commissioners have the opportunity to ask questions or make requests for fixture agenda items. IX. ADJOURNMENT Per the request of the Commission, the Eagan ARC meetings will go no later than 8:30 p.m. unless agreed upon by the Commission. Assistant City Administrator `1 MINUTES OF THE EAGAN AIRPORT RELATIONS COMMISSION MEETING SEPTEMBER 27, 2012 A regular meeting of the Eagan Airport Relations Commission was held on Thursday, September 27, 2012 at 7:00 p.m. Those present were Curtis Aljets, Steve Beseke, Charles Thorkildson, Dan Johnson, Carol Whisnant, and Scott Johnson. Chad Stambaugh was absent. Also present was Assistant City Administrator Miller. AGENDA Aljets moved, Whisnant seconded a motion to approve the agenda as presented. All members voted in favor. APPROVAL OF MINUTES D. Johnson made a motion to approve the minutes of the July 10, 2012 regular meeting of the Eagan Airport Relations Commission as amended, Aljets seconded the motion. All members voted in favor. There were no visitors to be heard. VISITORS TO BE HEARD PRESENTATIONS Assistant City Administrator Miller noted the anticipated presenter from Delta Airlines was ill and unable to attend, thus the presentation by Delta Airlines would be rescheduled for a future meeting. OLD BUSINESS COMMUNICATIONS UPDATE Assistant City Administrator Miller noted that it is the practice of the Airport Relations Commission to discuss their communication initiatives each month, which include articles in the Experience Eagan Newsletter, as well as stories aired on the City's local access cable channels. Miller welcomed the commission to make suggestions for communication initiatives regarding airport issues. Miller noted the Performance Based Navigation (PBN) Open Houses will be included in the next City newsletter, on the City's website, and a Facebook post will go out later this month encouraging citizens to attend the November 13th Open House at the Eagan Community Center from 5:30 — 8:30 p.m. MAC MONTHLY REPORTS — EAGAN /MENDOTA HEIGHTS CORRIDOR ANALYSIS/ TECHNICAL ADVISORY REPORT /17 -35 DEPARTURE ANALYSIS REPORT Assistant City Administrator Miller introduced the August 2012 Eagan /Mendota Heights Corridor Analysis Report, the August 2012 Technical Advisory Report, the August 2012 Runway 17 Departure Analysis Report and August 2012 Crossing in the Corridor Report. The Commission discussed the results of the August 2012 reports. Member Aljets noted that Eagan and Minneapolis have over 80% of the noise complaints. Member Thorkildson noted in the Top 10 Loudest Aircraft Noise Events for MSP there seems to be a lot of unknown flights. Miller noted she would inquire Airport Relations Commission Meeting Minutes September 27, 2012 Page 2 with the MAC. Member D. Johnson noted on that same report, the resurgence of DC9's to which Miller noted she would inquire with the MAC. Miller noted that she has received calls from the community regarding nighttime noise, and was informed by the MAC that Runway 12L and 30R was closed during the night time hours over several September evenings, which necessitated the use of Runway 17 for additional night time arrivals. 2012 -2013 ARC WORK PLAN Assistant City Administrator Miller introduced the draft 2012 -2013 ARC work plan that will be presented at a joint meeting with the City Council on October 22. The work plan was developed by the Commission at the July 10 workshop and has been revised to note the RNAV Open Houses. The Commission suggested that the Delta presentation be reschedule forJanuary 2013. The Commission discussed the proposed 2013 ARC town hall meeting, noting they would make a recommendation in January on which neighborhood to host the meeting. D. Johnson made a motion, Aljets seconded the motion to present the revised 2012 -2013 Eagan Airport Relations Commission (ARC) Work Plan to the City Council at the October 22, 2012 meeting. All members voted in favor. NEW BUSINESS MSP PERFORMANCE -BASED NAVIGATION PROCEDURES AND ENVIRONMENTAL /NOISE REVIEW Assistant City Administrator Miller introduced the MSP Performance -Based Navigation Procedure and Environmental /Noise Review as summarized in a memo that was prepared by MAC highlighting the proposed Area Navigation (RNAV) procedures. The Commission discussed the memo and correspondence received from Carl Rydeen, Assistant Air Traffic Control Manager, requesting an expedited review of the procedures by the MAC in order that the new procedures could become operational in Spring 2013. Miller noted Dennis Roberts, Airspace Service Manager out of FAA's Washington, D.C. office attended the NOC meeting and explained the publication process which determines when the RNAV procedures would become operational. Mr. Roberts noted that the FAA needs a letter from the Metropolitan Airport Commissions Board by the end of November confirming that the FAA did consider the noise criteria requested by the Noise Oversight Committee in March 2011. The Commission discussed the issues and proposed the following questions be asked at the October 22 meeting: 1. Why is RNAV being implemented at MSP, and what plans does the FAA have to communicate the changes to residents impacted by aircraft noise? 2. How were the new tracks developed? What role did maximizing open space /non residential areas have in the development of the tracks? Was there a noise - reduction target area (i.e. did the FAA look to reduce the number of units in the contours, 5 -7 miles out, 10+ miles, etc.)? Was Lebanon Hills Regional Park identified during track development as a noise - compatible land use? 3. Are the proposed tracks able to be adjusted, or are the track locations final from the FAA's perspective? r Airport Relations Commission Meeting Minutes September 27, 2012 Page 3 4. Will the Remote Monitoring Towers (RMT) be relocated as result of the RNAV procedures? 5. Will most people living in southwest Eagan be able to detect a change in noise compared to the current noise environment? 6. When 17/35 opened, the operations were fanned, resulting in many people being impacted by the noise (i.e. everyone "share in the misery "). It appears with RNAV that the noise is now being concentrated to a smaller area, thus increasing the noise for a specific area of the City and decreasing noise for another area. Given the long standing position of the federal government that noise is not to be moved from one neighborhood to another, how is the FAA getting around this provision given the impacts of the proposed RNAV tracks? 7. In determining the location of the tracks, were population counts considered? Does the FAA have data showing population counts under each of the tracks? 8. How is it determined which track will be selected for an operation? Will attempts be made to "spread out" or fan the operations on the various tracks? 9. What percent of the fleet at MSP is equipped with RNAV technology? How will the FAA direct those planes that are not equipped with the technology? 10. What are the vertical components of the arrival tracks (Le, will the altitude of operations over Eagan be similar to current altitudes when the Optimized Profile Descent (OPD) tracks are implemented)? 11. Can you please speak to the decision that was made to have three departure tracks off of 17, as opposed to only one track? 12. Why are more operations not being sent down Cedar Avenue for departures off of 17 given that the FAA had originally hoped to only have one southerly track (along Cedar Avenue)? a. How is noise considered when the two other southeasterly tracks (over residential areas) are proposed to be used more frequently than the track down Cedar? b. Why couldn't operations be sent down Cedar longer before making their turns to final destination (e.g. fly straight out to Cedar /35E before turning)? 13. The following is one of the criteria adopted by the Noise Oversight Committee (NOC) on March 16, 2011; Minimize the use of RNAV noise tracks as part of the Runway Use System. (An example would be, during southeast operational flows, focusing easterly -bound departure operations on Runways 12L and 12R on Corridor compliant RNAV tracks, while focusing southbound and westbound departures on Runway 17 on the River RNAV track. Given the anticipated departures in south flow operations, Runway 17 is proposed to be used significantly more for departures than 12L and 12 R (the Corridor). How is the NOC criterion being met given the proposed usage of 17 for departures in a southern flow? 14. The southern -most departure track off of 12R is proposed to make a southwest turn over heavily populated residential areas of Eagan. Why can that track not stay straight out longer (over commercial /industrial areas of the City) before making its turn? City Administrator Miller noted she will provide the questions to the MAC and FAA prior to the October 22 meeting, so the presenters can respond to the questions at the meeting. q Airport Relations Commission Meeting Minutes September 27, 2012 Page 4 MAC ENVIRONMENTAL ASSESSMENT ON LONG TERM COMPREHENSIVE PLAN Assistant City Administrator Miller introduced the MAC Environmental Assessment on Long Term Comprehensive Plan. Member Aljets shared his observations of the MAC's presentation. There was consensus of the commission to recommend that the City send comments to the MAC in response to the EA, with the comments seeking to strike a balance between protecting residents from noise impacts, while also supporting development at the airport to ensure MSP continues to be a strong economic generator for the community and region. STAFF /COMMISSIONER REPORT 2012 -2013 NOC WORK PLAN Assistant City Administrator Miller introduced the 2012 -2013 NOC Work Plan, noting the Commission is welcome to make any suggestions on changes or additions to be suggested for the work plan, which will be discussed at the November 14 NOC meeting. Commissioner D. Johnson suggested during the Review of Aircraft Fleet Mix Trends at MSP, that the NOC also review equipage of aircraft. Likewise, during the NextGen Overview and Implementation Update, D. Johnson asked for an update on Optimized Profile Descent (OPD). NOISE MITIGATION PROGRAM SUBSTANTIALLY COMPLETE Assistant City Administrator Miller gave an update noting the Noise Mitigation Program that resulted from the 2007 legal settlement is substantially complete, with only the reimbursement program continuing through 2014. OCTOBER 22 JOINT MEETING WITH THE CITY COUNCIL Assistant City Administrator Miller noted as a reminder, the joint meeting with the Eagan City Council is scheduled for Monday, October 22 at 5:30 p.m. At this meeting, ARC will have the opportunity to present the proposed 2012 -2013 work plan, and there will also be a formal presentation by the MAC and FAA on the proposed RNAV flight tracks. PAUL INTERNATIONAL AIRPORT (MSP) DATE: January 2, 2013 Following the November 14, 2012 NOC meeting, prior to the November 19, 2012 Metropolitan Airports Commission (MAC) Full Commission meeting, staff and Commissioners continued to receive a large volume of communication from residents and elected officials expressing concern about the FAA's Performance Based Navigation (PBN) proposal relative to concentrating flights over the residential areas of South Minneapolis and Edina, and the speed of the process, among other things, Based on the extensive input from community leaders and affected residents, the MAC took action during its meeting on November 19`" to support the partial implementation of the FAA's new procedures, withholding support for the implementation of the new proposed departure procedures from Runways 30L and 30R. Specifically, the MAC supported RNAV /RNP arrival procedures to Runways 12L, 12R, 30L, 30R, and 35 and RNAV departure procedures off Runways 12L, 12R and 17, The FAA will determine if it is able to move forward with partial implementation of PBN /RNAV as supported by the MAC. The FAA has stated that "the vote taken November 19 approved a "partial" package of RNAV procedures that must be studied and reviewed before any further action can be taken. At this time, there is no time line for completion of that review." Decisions about where and how aircraft fly are determined solely by the FAA, not by the MAC or other airport authorities, The future of possible RNAV departure procedures off Runways 30L and 30R over areas of South Minneapolis, Richfield, and Edina is unknown. The FAA is the agency responsible for design, environmental review, and implementation of aircraft procedures, and will ultimately make that determination. To date, MAC staff has received no requests for additional items to be placed on the 2013 NOC Work Plan. The Draft 2013 NOC Work Plan is attached for the Committee's consideration. NOC members are encouraged to come to the November 14, 2012 Committee meeting prepared to offer additional items for consideration in the 2013 NOC Work Plan finalization process. For purposes of review, the Committee had a productive year, accomplishing the following in 2012: • Facilitated implementation of increased use of Runway 30R 320 -, 340 -, and 360- degree departure heading dispersion in response to City of Minneapolis northbound departure operation concentration concerns. • Completed review of the MSP 2020 Improvements Draft EA /EAW noise analysis. • Conducted a dialogue with Mr. Dennis McGrann, Executive Director of the National Organization to Ensure a Sound - Controlled Environment (N.O.I.S.E.), on the health effects related to aircraft noise resulting in the MAC sending letters to the Airport Cooperative Research Program (ACRP) and the Partnership for AiR Transportation Noise and Emission Reduction (PARTNER) programs offering MSP as a willing participant in their ongoing studies related to methods for understanding aircraft annoyance and sleep disturbance related to health effects from noise. • Reviewed the annual MSP Noise Contour Report (assessing the 2011 actual noise contour) published per the requirements of the MSP noise litigation Consent Decree. • Conducted the Annual Scheduled Nighttime Operations Assessment. • Conducted a review of Noise Abatement Departure Profiles (NADPs) • Developed a mobile noise monitoring request form and review process, including an informational page on the MAC Noise Program website. • Runway Use Analysis — conducted a comprehensive analysis of runway use during different operational flows at MSP that included an assessment of overall and nighttime runway use patterns and the specifics surrounding Runways 12L and 30R departure operations and Runway 17 departures, including direction of flight and Minnesota River Valley Departure Procedure usage. • Reviewed the FAA's Runway 17 westbound RNAV river departure procedure implementation plans. • Reviewed status of the 64 to 60 DNL noise mitigation program implementation process at MSP and homeowner satisfaction. 6is • Conducted a noise analysis of the RNAV procedures developed by the FAA. • Conducted a public information program, including two public open houses, highlighting the RNAV procedures developed by the FAA. • Published MSP noise procedures on the WhisperTrack website for enhanced dissemination to pilots. • Continued to review input received from the quarterly public input meetings. The completion of Performance -Based Navigation (PBN) Area Navigation (RNAV) procedure use analyses activities on the 2012 NOC Work Plan were moved to 2013 due to FAA process delays. Leqve, Manager — Noise, Environment and Planning SUBJECT: CONSIDERATION OF CITY OF EDINA NOC MEMBERSHIP REQUEST DATE: January 2, 2013 On November 20, 2012 the Edina City Council passed a resolution (No. 2012 -158) requesting that the Noise Oversight Committee (NOC) Bylaws be amended "to include a new designated community representative position on the Committee for the City of Edina." The November 27, 2012 letter from Edina City Manager Scott Neal communicating the resolution and the City's request to the Metropolitan Airports Commission (MAC) is attached. On December 17, 2012 the MAC Full Commission approved the 2013 NOC Work Plan, adding an additional work item to the plan requiring the NOC to review the City of Edina's NOC membership request. Consistent with the NOC Bylaws, and precedent in the case of the City of Apple Valley's addition to the At -Large Communities in 2006, the addition of membership requires a modification to the Bylaws approved by the Committee. Based on the above, and the fact that the City of Edina is surrounded on three sides geographically by participating NOC Communities (St. Louis Park, Minneapolis and Richfield), it is staff's position that an accommodation of the City's request is warranted. There are three main provisions in the NOC Bylaws that relate to action by the Committee to modify membership. Bylaw Article II — Membership, point 2, requires: "The airport users and communities shall have an equal number of members and votes on the Committee." Article II — Membership, point 8, states: "The total Committee membership will never exceed twelve members. Modification of total membership numbers must be made by a unanimous vote of the Committee." Article IV — Voting Rights of Membership, point 3, stipulates that: "These Bylaws may be amended or altered by the vote of a super majority of the membership present at any meeting, provided that notice of such proposed amendments shall have been given fourteen (14) days prior to a general membership meeting." me In the context of the above provisions, the process required by the Committee varies depending on the action that the Committee determines appropriate to address the City of Edina's membership request. There are two options available to accommodate the request: 1) increasing the designated voting positions on the Committee to 14 (the addition of Edina and an airport user seat to maintain the required Committee membership balance) or, 2) the addition of Edina to the group of At -Large Communities as spelled out in Article II — Membership, point 4 (b) of the Bylaws. At the January 16, 2013 NOC meeting, Committee direction will be requested to determine if there is unanimous support on the Committee for option one above or if option two is the preferred action. Consistent with the Committee direction at the January 16`" Committee meeting, and in accordance with applicable Bylaw requirements, staff will draft modifications to the Bylaws for review and approval by the Committee at the March 20, 2013 NOC meeting. The procedure was outlined in the November 2004 Minneapolis -St. Paul International Airport (MSP) Part 150 Update Document as Noise Abatement Measure 16. The intent of this measure in the Part 150 Update was to consider a visual river approach to Runway 35 that routes arriving aircraft over the Minnesota River Valley. As the aircraft nears the airport, it would turn on to final approach and align with Runway 35. As detailed in the November 2004 Part 150 Update document, several issues need to be resolved prior to possible implementation of this procedure, including airspace design, Flight Standards District Office (FSDO) concurrence and flight testing. Also, additional analysis would be required to determine if the procedure could be safely used at night. MAC staff again reviewed the procedure with local Federal Aviation Administration (FAA) representatives, as was done in 2011. As was the case previously, several issues remain regarding the implementation of this procedure at the present time. Some of the issues include safety, efficiency, and established final approach segment length. Leqve, Manager — 'Noise, Environment and Planning SUBJECT: FEDERAL AVIATION ADMINISTRATION (FAA) UPDATE ON RUNWAY 17 HSTIN AND SLAYR AREA NAVIGATION (RNAV) STANDARD INSTRUMENT DEPARTURE (SID) PROCEDURE IMPLEMENTATION DATE: January 2, 2013 On November 30, 2012 the Federal Aviation Administration (FAA) operationally implemented the Runway 17 HSTIN and SLAYR Area Navigation (RNAV) Standard Instrument Departure (SID) procedures for southwest -bound departures overflying the unpopulated Minnesota River Valley. The attached map provides a sample of flight tracks from a period following the procedure implementation. As is depicted on the map, the procedures provide improvement in the concentration of operations over the river valley, providing a notable enhancement in the noise benefit provided by the longstanding Runway 17 River Departure Procedure. However, on December 21, 2012 the FAA suspended the use of these RNAV procedures because it determined that the procedures "have proven to be operationally problematic from an ATC perspective."
