SUBJECT: AIRPORT RELATIONS COMMISSION MEETING /TUESDAY
JUNE 11, 2013
The Eagan Airport Relations Commission will meet on Tuesday, June 11 at 6:30 p.m. in the City
Council Chambers. Following a brief regular meeting, the Commission will be asked to adjourn to a
workshop in Conference Room 1A &B at approximately 7 p.m, to discuss and formulate goals for
2013 -2014.

I. ROLL CALL AND ADOPTION OF THE AGENDA
The agenda, as presented or modified, is in order for adoption by the Commission.
II. APPROVAL OF MINUTES
The minutes of the January 8, 2013 and May 8, 2013 Airport Relations Commission meeting are
enclosed on pages 5 through 9 . These minutes, as presented or modified, are in order
for adoption by the Commission. These are the most recent minutes needing approval as the
ARC held a town hall meeting in March and did not approve minutes at the joint meeting with
Mendota Heights and Inver Grove Heights on May 8.
III. VISITORS TO BE HEARD
The Eagan City Council and its Commissions set aside up to ten minutes at the beginning of
public meetings to permit visitors to address items of interest that are not addressed on the
regular agenda. Items that will take more than ten minutes or that require specific action can be
scheduled for a future meeting agenda.
IV. OLD BUSINESS
A. Communications Update — It is the practice of the Airport Relations Commission to
discuss their communication initiatives each month, which include articles in the Experience

Eagan Newsletter, as well as stories aired on the City's local access cable channels. Currently,
the March 14 Town Hall meeting is airing. The Commission is welcome at this time to make
additional suggestions for communication initiatives regarding airport issues.
B. MAC Monthly Reports – Eagan /Mendota Heights Corridor Analysis /Technical
Advisory Report /17 -35 Departure Analysis Report – Enclosed on ages P) through L11
is the April 2013 Technical Advisor's Report. Enclosed on pages W2 through 5-6 is the
April 2013 Eagan/Mendota Heights Corridor Analysis. Enclosed on pages 5 through (QO
is the April 2013 Runway 17 Departure Analysis Report. Enclosed on pages (0 though is
the April 2013 Crossing -in- the - Corridor Analysis. The April reports are the most current reports
available on the MAC website.
C. FAA Update on Partial Implementation of RNAV at MSP Airport —At the May 15,
2013 Noise Oversight Committee meeting, MAC staff and FAA representatives provided an
update on the progress being made regarding partial implementation of RNAV at MSP. As a
reminder, partial implementation would mean using new RNAV tracks to the south, southeast,
and southwest, but not to the north and northwest. According to the FAA, they continue to
review the feasibility and safety of the partial implementation, and acknowledged that the review
has been slowed due to sequestration. That said, the FAA stated that provided the partial
implementation is feasible, the FAA remains on track to publish those tracks in July 2014
(arrivals) and September 2014 (departures). The FAA anticipated meeting in late May to further
review the tracks, and a decision should be forthcoming.
V. NEW BUSINESS
A. Amendment to the 2007 Consent Decree re: Noise Mitigation — Enclosed on pages
through � is a memo and additional information prepared by MAC staff regarding a
recent amendment to the 2007 Consent Decree to provide ongoing mitigation for those homes
that are added to the actual noise contours as a result of growth at the airport through 2020.
Given that homes were anticipated to be added to the 60+ DNL contours, the MAC worked in
partnership with the communities of Eagan, Minneapolis and Richfield to amend the consent
decree to ensure mitigation would be provided in the future at the same level as outlined in the
decree. For a home to be considered eligible for mitigation under the amended decree, it must:
• Be located in the actual 60+ DNL noise contour
• Within a higher noise impact mitigation area when compared to its status relative to the
Consent Decree noise mitigation program
• Be located in the 60+ DNL contour for a total of three consecutive years, and
• With the first of the three years beginning no later than 2020
The Eagan City Council approved the amended consent decree on May 7, 2013. The only homes
that are anticipated to be added to the contour are located in Minneapolis. There are no Eagan
homes anticipated to be added to the contours between now and 2020. However, all of the
communities thought it was in their best interest to ensure that the decree reflects this

amendment to ensure equitable treatment of homes in all communities should the contours
change in the future. The amendment to the decree results in the FAA allowing airport revenues
to be used for off - airport noise mitigation.
VI. STAFF / COMMISSIONER REPORT
A. New MAC Manager of Noise, Environment and Planning — Enclosed on page 10 is a
memo noting that Chad Leqve has assumed a new position at the MAC as the Director of
Planning and Environment, and as such, John Nelson has assumed the role of MAC Manager —
Noise, Environment and Planning. The change means that Mr. Nelson will be the new staff
liaison to the Noise Oversight Committee. Mr. Nelson has previously overseen the Part 150 noise
mitigation program at the MAC and is very familiar with the City of Eagan.
VII. ROUNDTABLE
Per the request of the Commission, this agenda item has been added so that Commissioners have
the opportunity to ask questions or make requests for future agenda items.
VIII. ADJOURNMENT
Per the request of the Commission, the Eagan ARC meetings will go no later than 8:30 p.m.
unless agreed upon by the Commission.
The Commission will be asked to recess into a workshop immediately following the regular
ARC meeting.
IX. 2013 -2014 WORK PLAN DEVELOPMENT
In keeping with past practice, dedicated time has been set aside to provide an informal
opportunity for the Commission to brainstorm their 2013 -2014 ARC work plan for
recommendation to the City Council this fall. Enclosed on pages 9 1 and 'I I is the 2012 -2013
approved ARC work plan.
Commission members are encouraged to bring suggestions to the workshop of items that could
be considered for the 2013 -2014 work plan.

JANUARY 8, 2013
A regular meeting of the Eagan Airport Relations Commission was held on Tuesday, January 8, 2013 at
7:00 p.m. Those present were Curtis Aljets, Steve Beseke, Charles Thorkildson, Dan Johnson, Carol
Whisnant, Scott Johnson and Chad Stambaugh. Also present was Assistant City Administrator Miller.
AGENDA
D. Johnson moved, Whisnant seconded a motion to approve the agenda as presented. All members
voted in favor.
APPROVAL OF MINUTES
Whisnant made a motion to approve the minutes of the September 27, 2012 regular meeting of the
Eagan Airport Relations Commission as presented, Aljets seconded the motion. All members voted in
favor.
There were no visitors to be heard.
VISITORS TO BE HEARD
PRESENTATIONS
Assistant City Administrator Miller introduced Jeffrey Hart, Delta Airline's General Manager of Airport
Customer Service at MSP and Co -Chair of the Noise Oversight Committee. Mr. Hart gave a presentation
on fleet trends, as well as overall trends Delta is observing in the airline industry.
OLD BUSINESS

MAC MONTHLY REPORTS— EAGAN /MENDOTA HEIGHTS CORRIDOR ANALYSIS/
TECHNICAL ADVISORY REPORT /17 -35 DEPARTURE ANALYSIS REPORT
Assistant City Administrator Miller introduced the November 2012 Eagan /Mendota Heights Corridor
Analysis Report, the November 2012 Technical Advisory Report, the November 2012 Runway 17
Departure Analysis Report and the November 2012 Crossing -in- the - Corridor Analysis Report.
The Commission discussed the results of the November 2012 reports. Member Aljets noted the noise
complaints for Eagan increased in the month of November.
FAA UPDATE ON PERFORMANCE BASED NAVIGATION (PBN) IMPLEMENTATION AT MSP
Assistant City Administrator Miller gave an update on the FAA Performance Based Navigation
implementation at MSP.
Gary Torfin, 1291 Dunberry Lane, addressed the Commission noting his opposition to the proposed
RNAV flight tracks. The Commission discussed his concerns noting they will be passed along to the City
Council.
2013 NOISE OVERSIGHT COMMITTEE (NOC) WORK PLAN
Assistant City Administrator Miller introduced the Noise Oversight Committee work plan that
highlighted the accomplishments of the NOC in 2013. Miller noted an addition was made to the NOC
work plan, to consider the request from the City of Edina for a community representative seat on the
NOC.
NEW BUSINESS
2013 ARC TOWN HALL MEETING
Assistant City Administrator Miller introduced the 2013 ARC Town Hall meeting noting per the ARC work
plan, a town hall meeting is tentatively scheduled for Thursday, March 14, 2013, The Commission
discussed past meeting locations. Member Thorkildson suggested Deerwood Elementary School as a
meeting location. Member Beske suggested inviting single family homes within an area near the school.
Assistant City Administrator Miller noted she would send out the invitations to single family households
around that area, offering the opportunity for the electronic survey. The Commission agreed the
meeting should be held at 6:30 p.m.
STAFF / COMMISSIONER REPORT
CONTINUED REVIEW OF RUNWAY 35 RIVER VISUAL APPROACH PROCEDURE
Assistant City Administrator Miller introduced the continued review of Runway 35 River Visual Approach
Procedure noting the FAA did review the procedure and came to the same conclusions; they need
further information and the procedure is not yet ready for implementation.
FAA UPDATE ON RNAV RIVER VALLEY PROCEDURES
Assistant City Administrator Miller noted the FAA will be giving an update on the RNAV River Valley
Procedures at the Noise Oversight Committee next week.
ROUNDTABLE
Assistant City Administrator Miller mentioned Commission members should have received an email
invitation to a Community Reception held on Thursday, January 17, 2013 to meet the four finalists
selected for the City Administrator position.

A special meeting of the Eagan Airport Relations Commission was held on Wednesday, May 8, 2013 at
7:00 p.m. Those present were Curtis Aljets, Steve Beseke, Charles Thorkildson, Dan Johnson, Carol
Whisnant, Scott Johnson, Chad Stambaugh, and Assistant City Administrator Miller.
Also present were ARC Commission Members of Mendota Heights and Inver Grove Heights. Justin
Miller, City Administrator of Mendota Heights, was also present, along with Jenelle Teppen, Assistant
City Administrator of Inver Grove Heights.

favor.
ORGANIZATIONAL BUSINESS

JOINT MEETING WITH THE AIRPORT RELATIONS FROM
MENDOTA HEIGHTS AND INVER GROVE HEIGHTS
Dennis Probst, Executive Vice President of the Metropolitan Airports Commission, provided a
presentation to the commissions. The three commissions discussed the presentation, operations at
MSP, and future plans for use of area navigation technology.

At the March 20, 2013 Noise Oversight Committee (NOC) meeting staff provided an update on
the status of the MSP 2020 Improvements Environmental Assessment/Environmental
Assessment Worksheet (EA /EAW) process. The discussion included a review of the residential
noise mitigation included in the Final EA /EAW and the related FAA findings published in the
Finding of No Significant Impact/Record of Decision (FONSI /ROD).
By way of background, as is detailed in the Final MSP 2020 Improvements EA /EAW, the
Preferred Alternative — Airlines Relocate scenario does not have the potential for significant
environmental effects. The forecasted noise contours around Minneapolis -St. Paul International
Airport (MSP) are driven by natural traffic growth that is anticipated to occur with or without
implementation of the 2020 Improvements project.
However, given past noise mitigation activities surrounding MSP, the terms of the 2007 Consent
Decree in City of Minneapolis, et. al. v. Metropolitan Airports Commission, and local land use
compatibility guidelines defined by the Metropolitan Council, many of the public comments on
the EA /EAW focused on future noise mitigation efforts. Additionally, the upcoming September
2014 completion of the Consent Decree noise mitigation program and possible implementation
of Performance -Based Navigation (PBN) procedures by the Federal Aviation Administration
(FAA) at MSP have stimulated community interest and concern relative to the future of noise
mitigation.
In response, in consultation with the MSP Noise Oversight Committee (NOC), a noise mitigation
plan was developed and included in the Draft EA /EAW for the 2020 Improvements Project,
published on August 30, 2012. The proposed mitigation built upon the mitigation strategies of
the 2007 Consent Decree and offered similar mitigation based upon noise impact level, with
eligibility defined by the 2020 Preferred Alternative — Airlines Relocate scenario noise contours
using the block- intersect methodology. The noise mitigation would have begun when the level of
total annual operations at MSP reached 484,879 or in the year 2020, whichever came first.
During the public comment period on the Draft EA /EAW, which extended from August 30 to
October 11, 2012, some commenters raised concerns with basing eligibility for noise mitigation
on noise contours that are forecasted 10 years into the future. In response, the MAC
recommended the use of actual noise impact contours to determine noise mitigation eligibility.
Therefore, the Final MSP 2020 Improvements EA /EAW provided that noise mitigation program
eligibility be based upon actual noise contours that the MAC would prepare for MSP on an
annual basis. To be eligible for noise mitigation, a home would need to be located for three
consecutive years in a higher noise mitigation impact level when compared to the home's status
under the terms of the 2007 Consent Decree.
On January 7, 2013, the FAA published the Final EA /EAW and the Draft FONSI/ROD, which
included the following position regarding the proposed noise mitigation program:

"The FAA is reviewing MAC's proposal for noise mitigation of homes for consistency with
the 1999 FAA Policy and Procedures concerning the use of airport revenue and other
applicable policy guidance."
During the public comment period on the FAA's Draft FONSI /ROD many communities submitted
comments urging the FAA to approve the MAC's revised noise mitigation proposal. Following
the close of the comment period, staff worked diligently with the FAA to establish a path forward
to allow the MAC to fund the proposed noise mitigation program.
On March 5, 2013, the FAA approved the FONSI /ROD for the MSP 2020 Improvements EA.
Specifically, in the approved FONSI /ROD (pg. 15), the FAA stated that noise mitigation would
not be a condition of FAA approval of the 2020 MSP Improvements project because "[n]o areas
of sensitive land uses would experience a 1.5 dB or greater increase in the 65 DNL noise
contour when comparing the No Action Alternative for 2020 and 2025 with the Proposed Action
[Preferred Alternative — Airlines Relocate scenario] for the respective years." However, the FAA
included a letter dated March 5, 2013, as Attachment D, to the FONSI /ROD that addresses the
conditions under which airport revenue may be used for off - airport noise mitigation. In that letter,
the FAA states:
"As a matter of general principle mitigation measures imposed by a state court as part of
a consent decree are eligible for use of airport revenue. Conceptually MAC could use
airport revenues if it were to amend the 2007 consent decree to include the proposed
mitigation."
Based on the above, at the March 20, 2013 NOC meeting, the Committee voted unanimously
supporting the following position:
"NOC supports the noise mitigation program as detailed in the Final EA/EAWin principle
and supports follow -up negotiations between the parties to the Consent Decree to
establish mutually agreeable terms for the modification of the Consent Decree consistent
with the March 5`" FAA letter in Appendix D of the FONSI ROD, for consideration by the
Court."
Subsequently, on April 15, 2013 the MAC Full Commission made a negative declaration on the
MSP 2020 Improvements EAW marking a final determination by the MAC related to state
environmental review requirements. Additionally, the MAC Full Commission took action to
approve the proposed noise mitigation program contained in the Final 2020 Improvements
EA /EAW in principle and directed staff to enter negotiations with the parties to the 2007 Consent
Decree to develop mutually agreeable terms for amending the Consent Decree to allow the use
of airport revenue to fund the proposed noise mitigation program.
The attorneys representing the parties have made significant progress to -date on the precise
terms of a proposed amendment to the Consent Decree. Following completion of this process,
the proposed amendments will be submitted to their respective governing bodies for approval
and to the FAA for a determination that it is consistent with federal law and policy regarding the
use of airport revenue. Upon approval by the respective parties' governing bodies, and after
receiving a written determination confirmation from FAA, the parties will submit the Consent
Decree amendment to the Court for its approval.
At the May 15, 2013 NOC meeting staff will provide an update on this topic.

On April 29, 2013 Mr. John Nelson assumed a new role as the Manager — Noise,
Environment and Planning for the Metropolitan Airports Commission (MAC). In his new
capacity, John will be serving as the Noise Oversight Committee (NOC) Technical
Advisor starting at the July 17, 2013 NOC meeting. As many of you know, since 2000
John has held the position of Part 150 Program Manager at the MAC with the
responsibility for implementation of one of the most extensive and complex residential
noise mitigation programs in the nation. John brings extensive technical background,
and experience from the perspective of multiple stakeholder groups, related to
addressing aircraft noise issues.I am confident that the experience, skills and
relationships that John brings to his new role will ensure the continued success of the
Metropolitan Airports Commission's Aviation Noise Programs.
We are extremely fortunate to have John as the newest member of the Environment
Department. Please join me in congratulating him on his new role!
