The fence handout illustrates the allowable fence heights on a corner lot situation, and what is the "front yard" where a 42" height limit applies vs. the "side yard" where a fence up to 6' height is allowed. Since it exceeds the 42" height in a front yard, the existing 5' chain link fence is non -conforming. However, City Code also allows for replacement of an existing non -conforming structure. Thus, the Zoning Permit for the 4' (48") wood fence issued last month was approved since it was noted "to replace 5' chain link," and would have lessened the non- conformity of the existing fence. You are now proposing a new and additional fence "in front of chain link" rather than a replacement, so it was held to the 42" height limit in the front yard. Your permit application says it is for a 2 -story playhouse, and based on our previous correspondence, I understood the playhouse to be on an elevated platform, but without an enclosed lower level. To be clear, the City Code does allow for an elevated structure, but not for a two-story structure. In either case, the side wall cannot exceed 8' and the overall height cannot exceed the height of the house. Please attach these notes to the Zoning Permit and keep them for your records, I will do the same here.
