Dear Ms. Stevens,
I received your letter inquiring about the City Council's action regarding the variance
requests of the Woodgate 3rd Homeowner's Association. I apologize if there has been an`
confusion thus far, and am thankful that you contacted the City for clarification.
At the October 15 City Council meeting, the Council considered the request of the
Woodgate 3rd Homeowner's Associations to authorize a blanket setback variance. After
discussion, the Council approved a 10 -foot blanket setback variance [to allow a 20 -foot
setback] for lots within Woodgate 3rd Addition that abut Woodgate Lane, Woodgate
Court, Woodgate Point, and Walnut Lane. Attached for your information are the minutes
pertaining to this action from the October 15 meeting.
What this direction means is that all homes that have property adjacent to the
aforementioned streets are allowed to have decks that are set back 20 feet from the right
of way. Provided that the decks are 20 feet from the right of way, a homeowner can
proceed with building a deck. Please recognize that some decks will be allowed to be
larger than others based on this direction. For example, if a home is setback 40 feet from
the right of way, that home could have a deck that extends 20 feet: however, if a home is
30 feet from the right of way, that homeowner would only be able to construct a deck tha
extends 10 feet. Both examples meet the 20 -foot setback requirement.
I recognize that some of the homes in Woodgate 3rd Addition abut Johnny Cake Ridge
Road, which are not covered under the blanket 10 -foot variance that the Council
approved. Rather, the Council reaffirmed a maximum 6 -foot depth for decks on lots that
abut Johnny Cake Ridge Road. A deck deeper than 6 feet would require a separate
variance.
Building Inspections staff was also contacted regarding your inquiry as to whether you
and other homeowners would be able to make improvements without having survey
information. The short answer to your question is that you do not need to have your land
surveyed to build a deck. According to Chief Building Official Schoeppner, you can

obtain a copy of the original site plan for the property, which is available at the City's
Engineering Department. The site plan will show lot lines and distance to the right of

way. However, due to the age of the units, the site plan does not show all of the units that
have been built on the property, which means that the homeowner would need to make a
copy of the site plan and draw in the location of the specific unit requesting the
improvement. Provided that the sketch accurately depicts the location of the unit on the
property and the correct distances to the property line and right of way, the deck permit
will be able to proceed ahead.
Once the homeowner has an accurate portrayal of the home's location on the property,
including distance to the right of way, staff will be able to proceed with a building permit
request. Please note that the permit will be processed only ifthe set back requirements
noted above are met. If a homeowner would like to request a larger deck that does not
meet the set back requirements, the homeowner would need to request a variance. which
would be handled on a case by case basis.
As you mentioned in your letter, Woodgate 3rd was constructed 27 years ago, and at that
time, the City did not collect survey information on specific properties. However, as
Planner Dudziak had previously suggested, the Woodgate Association may be well
served to consider hiring a surveyor to survey all of Woodgate 3rd Addition. In addition to
easing the homeowners in obtaining building permits, a survey would also provide the
Association with an accurate record of the property owned.
I recognize the complexity of the issue at hand, and I encourage you to contact Planner
Pam Dudziak at 651/675-5691 if you have any further questions regarding the variance
approved by the City Council, or Chief Building Official Dale Schoeppner at 651:675-
