MEMO TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: JULY 30, 1993 SUBJECT: AGENDA INFORMATION FOR THE AUGUST 3, 1993 CITY COUNCIL MEETING ADOPT AGENIWAPIMOVE MINUTES After approval is given to the August 3, 1993 City Council agenda and the regular meeting minutes of the June 20, 1993 City Council meeting, the following items are in order for consideration. DEPARTMENT HEAD':BUSINESS A. POLICE DEPARTMENT Item 1. Hunting License/Jon Yanta, 2927 Ewing Avenue, Minneapolis, MN--The City has received an application for a special hunting permit from Jon Yanta of 2927 Ewing Avenue in Minneapolis. The application is also to include hunting by Tim Yanta, Jim Yanta, Bill Kieffer and Joe Flynn. The application is for hunting of deer, ducks, geese and pheasant with bow and arrow and shotgun. The property on which the hunting will occur is owned by Joseph Kennealy in Section 18. For the Council's information, Mr. Yanta also applied in 1992 for a special hunting for the above types of hunting. The City Council, at that time, only granted permission for hunting deer with a bow and arrow, because of safe concerns regarding the discharge of guns within the City of Eagan. Enclosed on pages through are copies of Eagan City Council minutes for August 4, 1992 and August 18, 1992 in reference to this item. Also enclosed on page `(' is a copy of the minutes from the July 20, 1993 Eagan City Council meeting hunting licenses fore 1993 season was discussed. Also enclosed for the Council's information on pages through (o is a copy of the application f m Mr. Yanta. Also enclosed for the Council's information on pages 7 through , 7 are a copy of a letter from John Parker of the Department of Natural Resources to Mr. Yanta regarding the hunting of wildlife and copies of maps showing the site on which Mr. Yanta and the other people named in his application wish to hunt. ACTION TO BE CONSIDERED ON THIS ITEM: (1) To approve or deny a hunting permit for Jon Yanta, Tim Yanta, Jim Yanta, Bill Kieffer and Joe Flynn for the hunting of deer with bow and arrow, and (2) to approve a hunting license for the above listed persons for the hunting of ducks, geese and pheasant with shotgun. l l,•;. 0L 33 MINUTES OF A REGULAR MEETING OF THE EAGAN, CITY COUNCIL - - Eagan, Minnesota August 4, 1992 A regular meeting of the Eagan City Council was held on Tuesday, August 4, 1992, at the Eagan Municipal Center. Present were Mayor Egan and Councilmembers Wachter, Awada, McCrea, and Pawlenty. Aiso present were City Administrator Hedges, Community Development Director Dale Runkle, Director of Public Works Tom Colbert, and City Attorney James Sheldon. s OEND Pawlenty moved,Awada seconded,a motion to approve the agenda for the August 4,1992,regular City Council meeting as presented. Aye: 5 Nay: 0 MINUTES In regard to the minutes of a regular meeting of the Eagan City Council on July 21, 1992, Councilmember Pawlenty recommended that a heading be placed before Paragraph 4 on Page 3 to indicate the iter concerns Rahn Road. In addition, Councilmember McCrea recommended the following correction: Page 9, Paragraph 5, Sentence 2., replace the word, "option," with the word, "alternate." at Wachter moved,McCrea seconded,a motion to approve the minutes of the regular meeting of July 21, 1992, as amended. Aye: 5 Nay: 0 t, MISCELLANEOUS ANEOUS TEEMS, Licensing At this time, the City Council took the opportunity to ask a number of questions of the Department Heads. In answer to a licensing question from Councilmember McCrea, Chief of Police Geagan said that an establishment employing a masseuse would pay an establishment fee, an initial investigation fee for each masseuse, as well as a yearly renewal fee. A question was then asked about the licensing of store managers where beer is sold. A concern was expressed about a store such as Cub Foods that rotates its managers having to pay a license fee each time they change managers. Chief Geagan noted, however,that there are investigation costs to the City with each change. Hunting Permits L Discussion then took place in regard to hunting permits in the City. Chief of Police Geagan said he had suggested that hunting permits be limited to geese and deer using only bow and arrow. When asked by • Councilmember Awada as to his reasons, Chief Geagan cited concerns about the safety of using firearms in the City. Councilmember Wachter noted that the only reason he votes in favor of the special hunting permits is because of the number of car accidents involving deer. He also pointed out that any violations of the ordinance would result in the termination of this priviledge for everyone. l r f• /' Page 2/EAGAN CITY COUNCIL MINUTES August 18, 1992 Wachter moved, Pawlenty seconded, a motion to approve the bid of 3.8330% true interest from Smith 4.= Barney,Harris Upham& Company Incorporate,for General Obligation Equipment Certificates of Indebtedness, Series 1992C in the amount of$400,000. Aye: 5 Nay: 0 Pawlenty moved, Awada seconded, a motion to approve the bid of 4.4899% true interest from Harris to z Trust and Savings Bank for the General Obligation Improvement Refunding Bonds,Series 1992A,in the amount of$5,440,000. Aye: 5 Nay: 0 FINANCE DEPARTMENT/FALSE ALARM PROGRAM Mayor Egan introduced this item as consideration of the revised false alarm program. Discussion began oa whether there is a difference in cost to the City for commercial versus residential false alarms. Chief of Police Geagan said the cost of responding to an alarm is the officers' time and all alarms are responded to whether they are commercial or residential. Councilmember Wachter indicated he would prefer staying with z - a two tier fine system as the financial burden would be greater on the individual than on a company. Pawlenty moved, Awada seconded, a motion to approve revision of the City's false alarm program by reducing to three the number of free false alarms and by imposing a single fine rate of S75 for all false alarms whether residential or commercial. Aye: 4 Nay: 1 (Wachter) POLICE DEPARTMENT/HUNTING PERMITS :.j^ After introduction,Councilmember Pawlenty recapped previous discussions that indicated the City would continue to special permit bow hunting of deer in the City but not shotgun hunting. It was noted that all three hunting permit applications were for bow hunting; however, one also included shotgun hunting of ducks, geese and pheasants. That applicant,Jon Yanta,said that he and his party have always acted in a professional manner and had hunted ducks and geese in the river bottoms with a shotgun for approximately 20 years. Councilmember Wachter reminded the applicant that no hunting is permitted in the City without a special permit. Because of the growth of the City,safety concerns have led him to believe that the special permits should be limited to bow `r. deer hunting. Councilmember Awada asked a question about the special hunts organi7pd by the Department of Natural Resources (DNR). Councilmember Wachter noted the main difference as being the DNR's screening and control of the hunts. Police Chief Geagan added that the Eagan Police Department is not prepared as a • public safety agency to become that extensively involved in hunting in the City. Wachter moved, Egan seconded, a motion to approve special permits for bow and arrow deer hunting . only for: Norm Svien, Marvin A. Bohnett, Jon Yanta, Tim Yanta and Jim Yanta. Aye: 5 Nay: 0 FIELD REPRESENTATIVE/CONGRESSMAN RAMSTAD'S OFFICE David Hetland of Congressman Jim Ramstad's office was present to offer the Congressman's assistance to the City on matters of interest and to announce a Town Meeting hosted by the Congressman to be held in the Eagan City Council Chambers on August 26 from 7:00 - 9:00 p.m. VONSENT AGENDA City Administrator Hedges again referenced the Consent Agenda changes that were noted with the approval of the agenda. ;.:x William Sutterley as regular members of the Eagan Volunteer Fire Department. Aye: 5 Nay: 0 POLICE DEPARTMENT/DIRECTION, HUNTING LICENSES Mayor Egan introduced this item as direction regarding hunting licenses for the 1993 season. City Administrator Hedges stated that comments are made each year regarding the issue of hunting licenses in the City and after speaking with Chief of Police Geagan, decid^d it may be well to get direction from the City Council. Chit " Geagan indicated that the City has been following those guidelinep adopted in 1989 and would like Council 's direction as to whether these guidelines still apply. Councilmember Wachter said the City has grown to the point where perhaps hunting should no longer be permitted. Councilmember Hunter was of the opinion that there are some areas that can still be hunted along the river and indicated he was not in favor of an out and out ban. Councilmember Awada agreed. Mayor Egan also indicated that his concerns for general safety were outweighed by the danger on the roads due to the large deer population. Councilmember Masin asked whether the hunted properties were posted because children may wander into hunting areas accidently. Chief of Police Geagan mentioned there have been a number of licenses issued for properties outside of the river bottoms, few of which were issued to the property owners but rather friends or lessees. He doubted very much that the properties would be posted. Chief Geagan stated that if the City Council is comfortable with the guidelines, applicants will be informed of the criteria before bringing the licenses to the City Council for consideration. ............................................................ .... ................................................... ............................................................ After discussion, a meeting of the Personnel Committee will be set to review the City's car use policy. Additional discussion took place regarding Items D and E and why both had come in over estimates. The sealcoating bid was adversely affected by delays in the industry due to poor weather. Because of the high bids, only a portion of the bid was awarded. A. Personnel Items Item 1. Seasonal Park Maintenance Workers--It was recommended that the hiring of David Jungers and James McKnights as seasonal maintenance workers be ratified. Item 2 . Seasonal Park Attendant--It was recommended that the hiring of Laura Hampton as a seasonal park attendant be ratified. Item 3 . Seasonal Recreational Assistant--It was recommended that the hiring of Brian Larson as a seasonal recreational assistant be ratified. You anticipate having 3 to 4 hunters on the property at various times hunting deer and Canada geese. The property is located in the south 1/2 of Section 18 between old Cedar Avenue and the Burlington Northern tracks. I would encourage the city to allow you to hunt this area. This is the type of situation which I had in mind when I discussed the proposed hunting closure with Police Chief Gagen. Your harvest_ of Canada geese would be in accord with the,objectivg .pf_the DNR fo°s��aa the grawth of the population in the 7-county metro area. I have already had nuisance canplaints fran Eagan residents regarding geese. Any goose harvest, especially during the special metro seasons (Sept 1-10) and December will help to reduce local geese while not impacting migrants. The alternative is the expensive 7ttrap and transplant" program which is underway in other canmunities and is paid for by the cities. Our projections indicated that the metro population would increase by 200 3 (triple)"bj 1990 without action. Our objective is to limit-the increase to 100 % (double) : This goose harvest will be beneficial to the city. Geese will not be eliminated from the city, but the harvest will reduce the need for other controls. r The harvest of deer in this area is also in accord with DNR objectives to reduce the deer population density. Our objectives are well knoFn to the city council, and they have endorsed them by opening the Fort Snelling State Park for shotgun deer hunting. Your harvest of deer will help us attain our goal, and it will reduce the need for taking additional deer with sharpshooters. I request that you report the number nand sex of deer taken in this area if the city allows. Interpretation -Application of Tree Preservation Policy To Grading Permits--City staff has received an application to allow approximately 250,000 cubic yards of fill to be placed along the heavily wooded northern portion of the Lost Spur Country Club adjacent to I-494. This fill will change the elevation by more than 50' in some locations. While all property owners within 350' will be notified of this permit application, its high visibility to the travelling public and entrance to our community may raise questions. With the recent adoption of the tree preservation/replacement policy by Council action on July 6, a determination needs to be provided by the City Council as to whether or not this policy should apply to all grading permits. Also, although the Excavation and Fill Ordinance (Sec. 4.30, Subd. 10) requires a concurrent Conditional use Permit (CUP), historically most grading permits have been issued without the accompanying CUP. It seems the primary purpose of the CUP process was to provide for a public hearing before the Planning Commision. Staff would like to review with the Council whether the CUP requirement is still appropriate and if it should be applied to all qualifying permit applications or the Excavation and Fill Ordinance amended accordingly. Community Development Director--In official action taken at a Special City Council meeting held on Tuesday, July 27, 1993, the City Administrator was directed to offer the position of Director of Community Development at the City of Eagan to Peggy Reichert. The City Administrator did offer the position to Ms. Reichert and Ms. Reichert has accepted the City's offer. It would be appropriate at this time for the Council to ratify this appointment. COLON and VIRGINIA COLON, husband and wife (hereinafter referred to as the "Applicant") . The Agreement shall be amended to include specific conditions to the development of Outlots B and C, Park Center, as set forth herein. All other requirements of the Agreement, except as otherwise amended, shall remain in full force and effect as fully set forth in the Agreement. Said specific conditions are: (1) All pylon signs shall be constructed with the same style, namely two 20" x 20" brick Columns; and (2) The building shall be constructed of brown tone color brick and limited to no more than two tones of brown. i (3) Each lot shall be reviewed in detail by the APC and City Council before building permits are issued. (4) No rooftop mechanical equipment shall be visible from the public streets. (5) All trash shall be contained within the buildings or in enclosures attached to the building and constructed of the same materials. (6) Berming shall be provided along the public streets. 3 . This Agreement shall run with the land until terminated and shall be binding upon the successors and assigns of the Applicant. 4 . This Agreement shall become part of the original Agreement, fully binding upon the parties, as if fully set forth in the Agreement. Change in Ownership,Applebee's Neighborhood Grill and Bar, 1335 Town Centre Drive-- Midwest Restaurant Associates, Ltd.,currently listed as owner of Applebee's Neighbor Grill and Bar in Eagan, has decided to transfer the operations in each state. As a result, Apple American Limited Partnership of Minnesota was created to own the Minnesota operations. The partners are identical and own the same percent interest of both organizations. Although completion dates have been extended as requested by the developer, it appears he is either unwilling or unable to finish the development requirements. Subsequently, staff is requesting the City Council to officially declare this developer in default and authorize the corrective work to be performed through the financial security placed with this development. Due to the failure of Fortune Realty to comply with the most recently revised completion dates, a final formal letter was provided requesting completion in full by June 30, 1993. As of this date the only item which has been addressed is the negative balance of the Developer's Escrow which has been reduced to $320.00. This site is located in the northeast quarter of Section 12 south of Lone Oak Road and is zoned A (Agricultural). COMMENTS: The applicants have owned the two-acre site for the past 25 years. They have stated the property taxes have increased to the point where they cannot afford to build on it themselves and have found a potential buyer. The contingency is whether or not a single family dwelling unit will be permitted. There are existing houses on both side of this parcel preventing the owners from acquiring additional land to meet the five-acre minimum. These were the hardships defined by the applicants. Chapter 11,Subd. 24(b)13,Platting,requires all land zoned Residential shall be platted prior to placing any structure thereon. Subd. 26, Placement of a House on a Residential Lot, states: "On all residential lots not served by public utilities which are at least 24,000 sq. ft. in area and 170' in width, all structures shall be placed so that the lot may be further subdivided in the future unless otherwise approved by the Council." This site is located in the northeast quarter of Section 12, north of Highway 55. BACKGROUND: In 1984 the applicant, Harvey Kirschner, requested a Variance to the minimum lot size and frontage. The City Council approved this Variance with several conditions, as well as extending the term of the Variance to two years. The Variance was never acted upon and expired in 1986. COMMENTS: The current owner of the property is intending to sell the property to a prospective buyer who would like to construct a home on it sometime in the future. Mr. Aviles is also requesting the Council to consider a longer than one year term. Variances are valid for one year after date of Council approval. City Code, Section 11.40, Subd. 3, states: "The City Council shall determine that a special condition applying to the structures or land in question are peculiar to such property or immediately adjoining property and do not apply generally to other land or structures in the district in which said land is located in that the granting of such Variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable hardship or difficulty." Nowhere in the applicant's submission for the Variance request was an explanation of any hardship provided. The parcel is approximately four acres, has 264.25'of frontage along the north right-of-way of Highway 55, and completely surrounds a smaller parcel along Highway 55. BACKGROUND: The City Council approved Lakeview Trails Addition in May 1992. The first addition was 37 lots on 19.5 acres. During the planning'of the first addition, Lots 23 and 24, Block 1, were designed to accommodate the potential of acquiring the additional property to be replatted into three lots in the future. EXISTING CONDITIONS: The location of the proposed plat is Lots 23 and 24, Block 1, of the Lakeview Trail Addition. The Comprehensive Land Use Guide Plan designates the proposed area as D-II (Mixed Residential, 0-6 units/acre). The proposal meets the D-II designation. PROPOSAL: The applicant is proposing three lots on 1.24 acres for a density of 2.41 units/acre. As proposed, the lots meet, or exceed the minimum lot size of 12,000 sq. ft. for an R-1 district, as well as the minimum lot width of 85'. Access for all lots shall be from the existing McFaddens Trail. Lot 3, Block 1, shall be subject to the shoreland zoning requirements of a minimum 50' setback from the OHWM of 922.6. PARKS & RECREATION: The Parks&Recreation Department is requesting a cash parks and trails dedication for this plat. GRADING/DRAINAGE/EROSION CONTROL: A minimal amount of grading will be needed to prepare the site for the three houses. The preliminary grading plan shows that a maximum of 4 feet of fill will be added to Lot 2, and Lots 1 and 3 will not require any grading. The drainage from the front yards of the three lots will go to an existing storm sewer in McFaddens Trail which drains to Pond LP-26.1, a water quality treatment pond constructed with the Lakeview Trail 1st Addition. The backyard areas will drain overland to Pond LP- 26,which is a pond on the City's Comprehensive Stormwater Management Plan. The outlet for Pond LP-26 was constructed in 1992 with the Lakeview Trail 1st Addition. Pond LP-26 is a DNR controlled pond and the DNR Number is 77P. The development will be responsible for installing and maintaining erosion control measures in accordance with the City's Erosion/Sediment Control Standards. WATER QUALITY: This portion of the Lakeview Trails subdivision is already served by a constructed detention basin, Pond LP-26.1. As originally designed, the wet pond volume of Pond LP-26.1 is adequate to handle the additional runoff generated by the extra lot proposed. However, there are some indications that erosion from the development of the site has reduced the wet pond volume of this pond. City staff will determine the existing wet pond volume of Pond LP-26.1. If the volume is deficient, the developer will, as a condition of approval of this plat, be required to restore the volume of this detention basin to that originally agreed upon in the development contract for Lakeview Trails. The wetland associated with Pond LP-26 is the only wetland within the site and has already been delineated. No filling or draining of this wetland will be allowed, and none is planned as part of this development. These recommendations are subject to the approval of the Advisory Parks, Recreation, and Natural Resources Commission. UTILITIES: Sanitary sewer and water main services have been stubbed to the three lots from McFaddens Trail. The utilities in McFaddens Trail were constructed in 1992 under City Contract No. 92-11. The services for Lots 1 and 3 were constructed in 1992 with the utilities, and the services for Lot 2 were constructed in the Spring of 1993 at the developer's request. STREETS/ACCESS/CIRCULATION: Street access for the three lots will be provided from McFaddens Trail, a newly constructed bituminous street with mountable curb and gutter. McFaddens Trail connects to Dodd Road on the west edge of the Lakeview Trail 1st Addition. EASEMENTS/RIGHT-OF-WAY/PERMITS: This development shall dedicate all easements required for Pond LP-26 to 3 feet above the HWL of the pond. This development will be responsible for ensuring that all regulatory agency permits are acquired prior to final plat approval. • FINANCIAL OBLIGATION - Lakeview Trails 2nd Addition Based upon the study of the financial obligations collected in the past and the uses proposed for the property, the following charges are proposed. The charges are computed using the City's existing fee schedule and connections proposed to be made to the City's utility system based on the submitted plans. These standard conditions of plat approval as adopted by Council action on February 2, 1993 shall be complied with: Al, B1, B4, Cl, C2, El, Fl, G1, and H1 2. Lot 3, Block 1, shall be subject to the shoreland zoning requirements. 3. Pond LP-26.1 shall provide a minimum surface area of 0.26 acres of the NWL, 0.96 acre feet of wet pond volume and a mean depth at NWL of 3.69 feet. STANDARD CONDITIONS OF PLAT APPROVAL A. Financial Obligations 1. This development shall accept Its additional financial obligations as defined in the staff's report in accordance with the final plat dimensions and the rates in effect at the time of final plat approval. B. Easements and Rights-of-Way 1. This development shall dedicate 10-foot drainage and utility easements centered over all lot lines and, in addition, where necessary to accommodate existing or proposed utilities for drainage ways within the plat. The development shall dedicate easements of sufficient width and location as determined necessary by engineering standards. 2. This development shall dedicate, provide, or financially guarantee the acquisition costs of drainage, ponding, and utility easements in addition to public street rights-of-way as required by the alignment, depth, and storage capacity of all required public utilities and streets located beyond the boundaries of this plat as necessary to service or accommodate this development. 3. This development shall dedicate all public right-of-way and temporary slope easements for ultimate development of adjacent roadways as required by the appropriate jurisdictional agency. 4. This development shall dedicate adequate drainage and ponding easements to incorporate the required high water elevation plus three (3) feet as necessitated by storm water storage volume requirements. C. Plans and Specifications 1. All public and private streets, drainage systems and utilities necessary to provide service to this development shall be designed and certified by a registered professional engineer in accordance with City adopted codes, engineering standards, guidelines and policies prior to application for final plat approval. 2. EAGAN EAGAN ADVISORY PLANNING COMMISSION MINUTES JULY 27, 1993 L IZVIEW TRAIL 2ND ADDITION - flANROCE DEVELONOINT Chairman Voracek opened the first public hearing of the evening regarding a Rezoning of approximately .22 AG (Agricultural) acres to R-1 (Single Family) and a Preliminary Plat consisting of three lots on approximately 1.2 acres located along the south side of McFaddens Trail in the NE 1/4 of Section 36. City Planner Sturm stated that this application basically replete Lots 23 and 24 of the Lakeview Trails Addition. The applicant was present to answer any questions. Gorman moved, Heyl seconded, the notion to approve the Rezoning of approximately .22 AG (Agricultural) acres to R-1 (Single Family) located along the south side of McFaddens Trail in the NE 1/4 of Section 36. All present voted in favor. Gorman moved, Heyl seconded, the motion to approve a Preliminary Plat consisting of three lots on approximately 1.2 acres located along the south side of McFaddens Trail in the NE 1/4 of Section 36, subject to the following conditions: 1. These standard conditions of plat approval as adopted by Council action on February 2, 1993 shall be complied with: Al, 81, B4, Cl, C2, El, F1, G1 and H1 2. Lot 3, Block 1, shall be subject to the ehoreland zoning requirements. 3. Pond LP-26.1 shall provide a minimum surfBGe area of 0.26 acres of the NWL, 0.96 acre feet of wet pond volume and a mean depth at NWL of 3.69 feet. All present voted in favor. C MEMO TO: HONORABLE MAYOR & CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: JULY 30, 1993 SUBJECT: DIRECTOR OF COMMUNITY DEVELOPMENT/ACCEPTANCE OF OFFER The following is an update regarding the hiring of our new Director of Community Development. Background As the Council is aware, I was directed to offer the position to Peggy Reichert. I offered her the position on Wednesday, July 28, 1993 . She had some questions, so we met on Thursday morning to discuss them. Following this discussion, I conducted a poll of the Council to see if there was approval of an advancement of a step on the compensation plan as of the six month anniversary and beginning at the three week vacation accrual level due to Peggy' s experience and longevity in local government service. A majority of the Council approved both of these conditions. Update I contacted Peggy with the answers regarding the above conditions. She did accept the Council 's offer and has agreed to be our new Director of Community Development. Her first day of employment with the City will probably be Tuesday, September 7, the day after Labor Day. I met with the members of the Community Development Department first thing this morning and informed them of the selection and the acceptance. The reaction was very positive. They are quite excited and eager to proceed. In fact, they're already planning to hold a welcoming picnic for her so she can get informally acquainted with members of the department. Obviously, the word has spread throughout City Hall and the feedback I 've received is very good. Not only are employees happy to have a decision, but the decision, itself, seems very popular. I wrote a letter to Peggy informing her of the above information, a copy of which is attached for your information. The item is scheduled for ratification under Personnel Items in the Consent Agenda as is the normal procedure.
