I MEMO TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: MAY 27, 1993 SUBJECT: AGENDA INFORMATION FOR THE JUNE 1, 1993 CITY COUNCIL MEETING ADOPT AGENDA/APPROVE MINUTES After approval is given to the June 1, 1993 City Council agenda, regular meeting minutes for the May 18, 1993 City Council meeting, and special meeting minutes for the April 29, 1993 special City Council meeting, the following items are in order for consideration. DEPARTMENT HEAD BUSINESS A. FINANCE DEPARTMENT: Item 1. Presentation of Comprehensive Annual Financial Report--The 1992 audit has recently been completed and the Comprehensive Annual Financial Report for calendar year 1992 has been prepared. The report, along with two letters covering the auditing process and general management items, were previously distributed to the City Council. Staff has met with representatives of the auditing firm of Deloitte and Touche, and reviewed the management letters and the financial report in general. Mr. Jeffrey L. Radunz, partner and Ms. Beth A. Monsrud, manager, will be at the meeting to make a brief presentation to the City Council as well as to answer questions. Since the presentation will be brief, if the City Council would like additional information, arrangements can be made for a more in-depth presentation and discussion at a future work session. ACTION TO BE CONSIDERED ON THIS ITEM: To accept the audited Comprehensive Annual Financial Report for the year ended December 31, 1992. Agenda Information Memo June 1, 1993 City Council Meeting B. PARKS AND RECREATION DEPARTMENT: Item 1. National Recreation Trails Fund Grant Proposals--The Parks and Recreation Department recently received information regarding the National Recreation Trails Funding Program for potential applications for projects regarding trails. Enclosed on pages„3 through If is a copy of a memo from Director of Parks and Recreation Vraa explaining program qualifications. Attached to that memo is a list of potential projects for which grants could be applied. The Advisory Parks, Recreation and Natural Resources Commission will be reviewing this item at its June 3 meeting, however, the grant application deadline is June 10, 1993 and the Council will not be meeting between June 3 and June 10. The Director of Parks and Recreation is requesting input from the Council regarding the proposed projects. It is Director of Park and Recreation's recommendation that the trails that have the most potential are #10 on his list, the Highland Trail from Walnut Hill from Trapp Farm Park,and #15 on his list, the Wandering Walk trail from Trotter's Ridge/Bridle Ridge Additions. ACTION TO BE CONSIDERED ON THIS ITEM: To provide input to the Director of Parks and Recreation regarding potential projects for which grants can be applied for the recreational trail funding program. C2`-' MEMO _city of eagan DATE: May 19, 1993 TO: Tom Hedges, City Administrator i/FROM: perrtiAMiector of Parks and Recreation SUBJECT: Recreational Trail Funding Program Recently, this department received information regarding the National Recreation Trail Funding Program for potential applications for projects regarding trails. This program should not be confused with the application that we recently made through the ISTEA program. Interim guidelines indicate that grant dollars can be used for development of trail linkages, maintenance of existing trails, development of trail support facilities and construction of new trails on municipal lands. The maximum grant amount is $50,000. The City must match this grant amount with an additional 25%. Consequently, the largest, single project which can be undertaken, assuming the City is to match to 25%, would be $62,500. Of particular note is the fact that application deadline is June 10, 1993. If we are to meet this application deadline we will need to move with all expediency. Attached to this memorandum, which I hope you will share with the City Council, is a list of potential projects which we believe might qualify under the National Recreation Trails Grants Program. Staff will be reviewing these trails at the June 3 Advisory Parks, Recreation and Natural Resources Commission meeting. However, the City Council does not have a meeting until after the June 10 deadline for submission, therefore, I would like the City Council to have an opportunity to review these potential projects in advance of the Commission meeting. Staff would like some input regarding these 20 potential projects to reduce the submission to two applications. I believe that the ones that have the most potential are #10, the Highline Trail from Walnut Hill to Trapp Farm Park and #15, the Wandering Walk Trail from Trotter's Ridge/Bridle Ridge Additions. Your reaction, and that of the City Council, will be most appreciated in order that we can meet the June 10 submission deadline. Consistent with current City policy, parks administration has reviewed this position with City Administrator Hedges and Assistant to the City Administrator Duffy as it relates to the organization as a whole. Currently, an excess of public right-of-way was acquired than is required to construct a cul-de-sac at the westerly terminus of Englert Road. Contract 90-D, Acknowledge Completion/Authorize City Maintenance (Frank's Nursery - Storm Sewer)--The private installation of public storm sewer facilities under the above-referenced development agreement has been completed,inspected by City personnel and found to be in compliance with City plans and engineering standards. Subsequently, the developer has requested formal acknowledgement by Council action with authorization for perpetual City maintenance. Youngdahl & Associates with Mr. Jeff Bowers as the representative was approved as the City's insurance agent/broker, contingent upon the Director of Finance being satisfied that all City requirements would be met and were included in the proposed annual fee. That has been completed and enclosed on pages 1�1 through O( is a copy of a letter of understanding covering the services to be rendered. This agreement covers general liability,worker's compensation and all other non-health, life and disability coverages for the City. The agreement is for a three (3) year period subject to renewal. As we discussed the needs of the city have changed and therefore the services necessary for a city such as Eagan have changed. This is a list of the concerns that we discussed at our last meeting and our response. 1. Services need to be more clearly defined and we need to demonstrate better follow-up. The following will describe our services : a. Follow-up will be on a systematic basis on claims, requests for information, policy changes, and progress reports. b. Quarterly meetings will be set-up to discuss the above with impromptu meetings when needed. Regular meetings with insurance company loss control people, and continual follow-up on claims. 2. Commission vs fee: a. R. L. Youngdahl and Associates will service the insurance needs for City of Eagan on a net commission basis. The insurance companies will be instructed to quote all premiums net of commission and invoice net of commissions. If necessary company invoices will be available to the city for proof. The one variance to this system is the Workers' Compensation. Berkley Administrators cannot invoice on a net base. Because of this the premium is billed in full to the city from Berkley and the commissions are sent back to the city from the league. Commissions on Workers' Compensation is 2%. b. R. L. Youngdahl & Associates will bill the City of Eagan $1333.33 Page 2 for 12 months to represent the $16,000 annual fee. This will be spelled out in a formal contract. 3. R. L. Youngdahl & Associates will work with the City of Eagan an to implement a g Y g P managed health care program for the Workers' Compensation. At the present time the details have yet to be worked out by the league, However we are working with them on a direct basis. In addition, we will investigate the possibility of self-insurance for Eagan on their Workers' Compensation. • 4. We will provide a name that will do a systematic evaluation of the properties that Eagan owns. We will have this information in the next week. To make this a bona fide appraisal it needs to be done by a certified appraisal company. We are asking the league if they recommend any particular firm and if they have any special arrangements. We will either accompany the appraiser or do our own systematic review of all properties. 5. For the upcoming renewal we will have the underwriters provide us with quotes using varying levels of deductibles on all lines of insurance. We will start at $20,000 and go higher. 6. We will provide a summary of coverages in laymens terms and in abbreviated form. We will provide a short form summary for each department with that departments information only. We do this now for our other cities. 7. Claims monitoring services: a. We will set up a systematic review on all claims. This will be done on a quarterly basis or more often if needed. b. Critical claims, such as General Liability, Auto Liability, large Workers' Compensation, public officials, and unusual property claims will be followed-up on a 30-45 day basis. Other claims will be on a 60-90 day basis. c. Files will be set-up in our office for all claims and they will be documented in the file. d. We will show the city how and why claims were closed. We will get a description of how claims were closed that are over the deductible and why the city is being charged for the deductible. e. All of the above will be reviewed at the quarterly meeting. f. Workers' Compensation claims will be handled somewhat differently. They will be done on a quarterly basis, but we will also set up claims 2 ° Page 3 reviews with Berkley to discuss individual claims. In addition, we will do an acid test on the cities modification factor periodically to be sure it is correct. g. The league has put in a deductible plan for cities to offset paying your own small medical only claims. Berkley and the league have come down very strongly on cities that are paying their own medical only claims. Should the city choose the deductible plan they will receive a credit on their premium and report all claims as usual. They will then be billed for their deductible on a monthly basis. It needs to be determined on renewal if a deductible plan offers enough credit to make it worthwhile. We will help the city determine whether it is right or not. 8. We will review all contractual agreements that the city enters into to determine proper insurance levels. The city will need to forward the contracts to us for review. 9. We will sit down with the city to review all joint powers agreements. 10. We will help the city determine their insurance obligations with the school district and counties. 11. We will be sure that league recommendations for loss control are complied with by the city and that the league is providing compliance help on all Workers' Compensation laws. This list is not meant to be exhaustive and will be changed as the needs of the city change. R. L. Youngdahl will operate as a part-time safety director for the City of Eagan. Due to the Memorial Day Holiday, there will be no Administrative Packet so it will not be possible to forward any additional correspondence to the Council prior to the Council meeting. Streetlights are installed, owned,operated and maintained by the respective utility company, Northern States Power (NSP) or Dakota Electric Association (DEA). However, the only way they can be installed on a large-scale neighborhood basis is for the City to enter into a contract with the respective utility directly with the financing being the City's responsibility. Historically, the City Council has assessed all costs associated with neighborhood streetlight installation 100% to all benefitting properties within the neighborhood serviced by the streetlight system installation. It should be noted that it is not uncommon for different neighborhoods to have different costs per lot depending upon the number of streetlights to be installed, properties to be assessed, respective utility company installation recovery rates, and amount of restoration required relating to whether new concrete curb and gutter and driveway approaches are being reconstructed or not. In response to numerous • petitions received by the residents in the above referenced subdivisions, the staff has prepared a fe isibility report which will be presented to the City Council for consideration of authorizing their installation concurrent with the street improvement in progress in your neighborhood! As you recall; the installation of streetlights was originally included with the street reconstruction project presented and discussed at a special public hearing held on December 8, 1992 at Mary,.Mother of the Church. The inclusion of these streetlights with the street reconstruction program was originally initiated by staff rather than neighborhood interest. While there was no strong objection to the streetlights at the public hearing, there was concern expressed over the total assessments associated with the overall project. While the City Council authorized formal appraisals to be performed of representative; properties to determine the benefit associated with the overall reconstruction] project, the results were not available at that time. In March of tills year, the results of the appraisals indicated that, while there is benefit associated with the installation of streetlights, their inclusion with the overall project diminished their assessable value in relation to the total project which was identified at $2,200 to $3, 00 per lot. With the reduction in the assessments for this project ($1,500 to $2,000), the City had to increase its finding to finance the overall project. Because of this increase in City financing and lack of a local neighborhood initiative (petition)for streetlight installation, this portion of the overall project was subsequently deleted from the contract award at the April 20th Council meeting. As soon as this decision was made, the property owners were so informed and advised of the petition process for neighborhood streetlight installation. This public hearing is the result of that petition process by the various affected neighborhoods. Because of legal publication and notification requirements dictated by State Statute, the City is not able to consider contract award any sooner than the June 1st public hearing date. Each neighborhood's feasibility report calculated the cost of the streetlight and prorated it equally on a per lot basis to all benefitted lots within that neighborhood. These streetlights are installed, owned and operated by the representative utility company who independently establishes their installation and energy rates under the general regulation of the State's Public Utility Commission (PUC). The City acts as the facilitator to coordinate the installation of these streetlights and finances the cost on behalf of the residents by spreading the costs as a special assessment over a period of 15 years. Enclosed is a copy of the feasibility report identifying the estimated assessments associated with this improvement. Due to the number of properties affected by these improvements (approximately 760), it is not possible to accommodate each property owner in the Council Chambers at this public hearing. Therefore, if you would like to voice your support or opposition to this project, you are strongly encouraged to do so in writing and submit that position to my attention no later than May 28th. This information will then be forwarded to the City Council for their information in making their final determination as to whether to proceed with this improvement or not. While the City of Eagan has very little control over the cost of the streetlight installation, please be assured that we will try to coordinate the activity to minimize these costs as much as possible. FEASIBILITY AND RECOMMENDATIONS: This project is feasible and is in accordance with the City's policy on the installation of streetlights in residential areas. It can best be accomplished as outlined herein and not as a part of any other project. DISCUSSION: Residents in Cedar Grove No. 3 have petitioned for the installation of streetlights. This Addition contains 172 lots which would benefit from streetlighting. This area was developed before the City of Eagan adopted a comprehensive streetlighting policy. Since the enactment of this policy, all new subdivisions have been required to install streetlights and they pay for energy costs with their water and sewer bill. The above-mentioned policy also has a provision enabling older additions to petition for streetlights. Under this provision, the cost of streetlight installation is assessed against the benefitted lots and the energy charge is also to be paid quarterly by the residents along with their water and sewer bill. The energy needs for Cedar Grove No. 3 is serviced by Northern States Power Company and they offer the type of streetlighting poles, lighting fixtures and the necessary maintenance service required by the City for residential streetlighting in accordance with the City of Eagan's streetlighting policy. It is proposed to have 26 100-watt luminaire residential ornamental, 1 150-watt, and the upgrading of 4 150-watt conventional intersection streetlights. ORNAMENTAL STREETLIGHTS &CONVENTIONAL INTERSECTION LIGHTING WITH 6' MAST ARMS: These 26 streetlights would be the standard ornamental design with 100-watt high pressure sodium mounted on 18' standard poles. The 5 conventional intersection streetlights would be the standard design with 150-watt high pressure sodium "cobra" type fixtures mounted on 25' fiberglass poles with 6' aluminum mast arms. I see no useful benefit to streetlights.They are obnoxious, unsightly, costly, wasteful of energy, and as they age, noisy. I moved from St. Paul to Eagan eight years ago to get away from the bright lights of the city and live in a quiet,peaceful sub- urb.Streetlights are not a part of that desired living environment. I do not know what reasons the people who allegedly signed the petition have for wanting streetlights. If crime reduction is a concern, I fail to see how a streetlight will deter a thief. If people are concerned about this they can install yard lights or home security systems on their property at their expense. If safety in streetwalking is a concern then I suggest they do their walking in the day in one of the many fine taxpayer funded city parks.Streets are designed for cars,not people,and the mixing of the two creates a dangerous situation anytime of day.I don't feel that the installation of 100W streetlights will make walking at night any less dangerous. I have heard a lot of cars racing through the neighborhood at night recently and the safest thing a resident can do is stay off the street. Or, perhaps we should use the streetlight money to add officers to the police force.Does the city have any statistics on crime and accident reduction in other cities or neighborhoods that resulted from streetlight additions? Maybe this should be researched before making such a costly decision. With regards to the petition that was circulated,I noticed that your map of the proposed stree- tlight addition to Cedar Grove No.4 indicates that I am a petitioning homeowner. I have never signed any such petition nor have I been asked to.Either The Public Works erred on the draw- ing or my name was falsely signed to the petition (which I believe is a criminal act). I also wonder how many people were aware of the cost associated with streetlights when they signed the petition and bow many would have actually signed it if they were?I have never liked peti- tions since the people circulating them don't always have all the facts and it is too easy to coerce your neighbor on an issue that he may be uninformed of. Subsequently he signs the petition in the interest of promoting good will with his neighbor.I suggest the petition be dis- counted and that the city poll the residents themselves. As for the cost of the project,my property taxes have nearly doubled in the last six years.This has happened in a time period when Eagan has experienced rapid growth and has had new sources of tax income. I thought that property taxes were collected for such things as street repair so why does there have to be a special assessment levied each time an improvement is made?I'm sure you have good reasons,but if total cost is the issue then I would rather see the cost spread out evenly among all taxpayers and not just to those in our neighborhood.I'm sure my property taxes are applied to improvements in other neighborhoods which I don't receive direct benefits from, so why don't those other taxpayers have to share the cost of mine?Per- Page 1 t , • haps we should extend this line of logic one step further and only charge those people signing the pet lion the cost of the improvements.I wonder bow many would reconsider then? FEASIBILITY AND RECOMMENDATIONS: This project is feasible and is in accordance with the City's policy on the installation of streetlights in residential areas. It can best be accomplished as outlined herein and not as a part of any other project. DISCUSSION: Residents in Cedar Grove No. 5 have petitioned for the installation of I streetlights. This Addition contains 213 lot equivalents whic h would benefit from streetlighting. This area was developed before the City of Eagan adopted a comprehensive streetlighting policy. Since the enactment of this policy, all new subdivisions have been required to install streetlights and they pay for energy costs with their water and sewer bill. The above-mentioned policy also has a provision enabling older additions to petition for streetlights. Under this provision, the cost of streetlight installation is assessed against the benefitted lots and the energy charge is also to be paid quarterly by the residents along with their water and sewer bill. The energy needs for Cedar Grove No. 5 is serviced by Dakota Electric Association and they offer the type of streetlighting poles, lighting fixtures and the necessary maintenance service required by the City for residential streetlighting in accordance with the City of Eagan's streetlighting policy. It is proposed to have 33 100-watt residential ornamental and 2 150-watt conventional intersection streetlights. ORNAMENTAL STREETLIGHTS & CONVENTIONAL INTERSECTION LIGHTING WITH 6' MAST ARMS: These 33 streetlights would be the standard ornamental design with 100-watt high pressure sodium mounted on 18' standard poles. The 5 conventional intersection streetlights would be the standard design with 150-watt high pressure sodium "cobra" type fixtures mounted on 30' fiberglass poles with 6' aluminum mast arms. Future repairs/rewiring allowed to the Utility is another nuisance and added cost to be passed on in the rate structure. e. Construction bid evaluation/award is not reported except for on or after June 1 , 1993 . Since the benefit is implied and not substantively demonstrated, it is at best a desire of some property owners. If the benefit-to-cost ratio is impressive, it's not evident. When I built in Eagan, I could walk outside and enjoy the wonders of nature. Across the road was a swampy area which was the home for ducks, geese, deer,and an occasional skunk. One of my hobbies is astronomy,and I was able to enjoy the heavens with m telescope and watch the multi-colored aurora borealis. Visitors to my house often commente on what a nice area this was so close to the cities. We had the benefits of country living thin 20 minutes of downtown St. Paul and Minneapolis. We had a police force and city council that were know on a first name basis. Our growth rate was slow,but so was our crime rate. The started our accelerated growth. The swampy area was drained and now contains houses and to omes. The majority of wildlife one sees is usually dead alongside the many miles of roadway. The rolling hills now contain houses,town homes, apartments, condos, office complexes, and chools. The night skys are polluted with light, and one can no longer see the wonders of the t4niverse: I realize that thi growth cannot happen without some compromises, but must we continue this growth by inve 'rig money in foolish things? I watched the contractors for the sewer and street refurbishment bi to "minimal"requirements. After the contract was awarded, I watched the contractor attempting to place "Band-Aids" on the streets in-order to satisfy the cities minimal requirement, yetmake a profit. This morning, I called the city street supervisor to express my concern about tl)e inadequate preparation of my street prior to paving. Both the city supervisor and contractor Met with me and agreed that the soil at the entrance to the cul-de-sac should be taken back out d redone. I do not blame the contractor, as used the same material after repairing the stcarm sewer. In my discussions with them, I found out that core samples of the street's base materials were never taken for analysis. The main street and cul-de-sac where I live, is "clay". The foundations for the houses in this area were built above ground, and the clay fill hauled in. The greets were comprised of the same material with a coat of paving material over them. The streets have been in the state of disrepair for the past five years. We apparently have learned nothing from past lessons, as we are now again paving over the improperly installed streets. The bane coat of asphalt is already breaking up after one day. In the near distant future, we will again pa for these mistakes with another"Band Aide". My question is, "why do we not learn from theselmistakes?" Why don't we pay more and have it done right? In today's mail, i received a feasibility report and estimate of cost for street lighting. I applauded the city council for dropping this in the past. But, it seems that a few citizens have a need for "INSECURITY;LIGHTING". I ask, "why do all the residents of the areas affected have to have street lights." What purpose will these additional lights provide? If they believe that it will 1 provide better security from burglars, they are mistaken. Where is the "security"? The lighting gives the burglar an opportunity to view the area for a watch dog. I shows them whether anything outside is worth taking (i.e., bikes, mowers, etc.), whether there are the windows open, and what way they can enter and exit with the least obstruction. All the lights do is aide the criminal. Has Eagan been hit with a crime wave to give the residents the need for this false sense of security? I think not. Have we had an increase in accidents on these "dark" residential streets? Again I think not. As we have no "downtown", one has only to drive around after dark to find the streets devoid of any pedestrian traffic. This letter is not the place for a lesson in economics, but I feel that a few comments may cause the petitioners to think beyond today. The light in the night sky is the visible effect of tons of fuel consumed in a wasteful fashion. Photos from the space shuttle will confirm that the United States is the most wasteful when it comes to light pollution. This is expensive and more harmful to the environment than just the production of light pollution. The burning of fossil fuels, our main source of electricity, to light the night sky contributes to air and water pollution as well as global warming. Over 60% of all electricity in the United States is produced by coal burning plants. Much of this coal is obtained from strip mining. Remembering American history, we all know the devastation caused by strip mining. How can these problems be addressed? The problem of light pollution took two generations to develop. It can not be solved overnight. Yet steps have to be taken to begin this task. Nighttime safety, security, and recreation are best achieved by having proper nighttime lighting designed for the task at hand. For example, high volume urban arterial streets need street lights to reduce automobile/pedestrian accidents. But the streets need not be illuminated with luminaries that product glare and shine into the sky. This can be avoided by having full cut-off, shielded fixtures, timers, the proper wattage to do the lighting, and concern for light pollution. Residents who feel the need for personal security should provide it at their own expense. Today, many security lights come with motion sensors which will turn on only when needed. There is no need for this lighting to be on during all hours of darkness. The cost for this would be no greater than the assessment and would still provide them with their panacea.of security. I personally would rather see this assessment go to the addition of more police officers. Remember, even though it wastes precious resources and causes pollution, it is in the power companies best interest to sell lighting, as it generates "PROFIT." Regards, ale A. Vacate Utility Easements-Town Centre 70-2nd & 11th Additions--On May 4th, City Council received a petition from the developers of the Town Centre 70-15th Addition (Kohl's Department Store) requesting to vacate various existing previously platted drainage and utility easements in order to accommodate the proposed new development. Council scheduled a public hearing to be held on June 1st after notification of all potentially affected and/or interested parties. Therefore, it is recommended that this public hearing be continued until June 15th to ensure that development contract agreements will provide for the dedication of replacement easements and relocation of existing City utilities before the City releases its rights to the existing conditions. Vacate Drainage & Utility Easements-Lot 1,Block 1,Lembke 1st Addition--On May 4th, the City Council received a Petition from West Publishing Company requesting the vacation of existing drainage and utility easements dedicated over Lot 1, Block 1, Lembke 1st Addition in order to accommodate its replat into the West Publishing 6th Addition. City Council received this Petition and scheduled a public hearing to be held on June 1st to formally discuss this request. Enclosed on page IOC{ is a graphic and legal description of the easements to be vacated. After proper publication in the legal newspaper, the City has not received any objections to this proposed vacation. Adequate replacement drainage and utility easements are being dedicated with the West Publishing 6th Addition which is scheduled for final plat approval under the Consent Agenda for the June 1st meeting. LOCATION: LOT 2 & 1/2 OF LOT 3, BLOCK 1 SIBLEY TERMINAL INDUSTRIAL PARK EXISTING ZONING: I-1 (LIGHT INDUSTRIAL) DATE OF PUBLIC HEARING: MAY 25, 1993 DATE OF REPORT: MAY 18, 1993 COMPILED BY: COMMUNITY DEVELOPMENT DEPARTMENT APPLICATION SUMMARY: An application has been submitted requesting a Conditional Use Permit to allow a truck and freight terminal and service and sales of trucks in a Light Industrial district located at 3155 Terminal Drive. LOCATION & EXISTING CONDITIONS: The site is located between Terminal Drive and Alexander Road and west of Highway 13. North of the site is United Stationers; Safety- Kleen is located west of the site. The entire area surrounding this site is zoned I-i and the Land Use Guide Plan designates this area as IND (Industrial). The approximately seven-acre site has two existing buildings. The smaller of the two buildings is located on Alexander Road. The existing shop building is approximately 8,000 sq. ft. BACKGROUND/COMMENTS: In 1991 a previous owner of the property applied for a building permit to convert an existing warehouse to an occupied structure. At least six structural and six site conditions were necessary before occupancy was allowed. As part of the site plan, the City requested that the applicant install the driveway, parking lot, and storm sewer per the approved drawings and specifications submitted, as well as installation of landscaping per a plan to be submitted. None of those items were completed. The applicant has agreed to complete all of these improvements. Lessor's Incorporated has been located at 3303 Terminal Drive in Eagan for approximately 2-1/2 years where they currently lease space. They were previously located in St. Paul for nearly seven and one-half years and employ approximately 80 people. During the past several years the company has experienced surges in growth of almost 25% a year which has caused them to look at expanding their operations and a larger site. They have approximately 85 trucks delivering to the east coast. They anticipate selling approximately 20-25 tractors and trailers annually. L(' PROPOSAL: The current proposal includes plans for a 6,836 sq. ft. addition for office use, mezzanine, and garage support constructed of a combination of glass and block exterior finish to match their existing building color of brown/buff. The existing building and proposed addition meet, or exceed all building setbacks; the existing building along Alexander Road does not meet setback requirements. Access to this site is from both Alexander Road and Terminal Drive. There are approximately 35 tractor parking spaces, 88 trailer spaces, and 62 parking spaces. Parking requirements have been met and all parking areas meet setback requirements. The trucks enter on the west side of the building through one of the four bays and exit through the east side of the building. A landscape plan has been prepared that uses overstory and evergreen trees only along Terminal Drive. No landscaping has been proposed along the sides of the property where tractor and trailer parking occurs. Irrigation along Terminal Drive and the two lot lines will be required. Signage is provided in the form of a monument ground sign from Terminal Drive. All signs meet code requirements. GRADING/DRAINAGE/EROSION CONTROL: The existing site was rough graded under City Project #89-W. The site was left in a very erodible state with no seeding, mulching and/or silt fence installed to protect the site from erosion. At a later date a sedimentation pond was constructed in the northwest corner of the site to trap the eroded material which washed over the bank and onto the adjoining property. The agreement was that the previous owner would maintain this sedimentation basin so as the eroded material would not be washed into the City storm sewer system and ultimately end up in Pond CP-8. The previous owner was negligent in this respect and now Pond CP-8 has to be excavated of this eroded material. A minimal amount of grading will be needed to prepare the site for this new development. The preliminary grading plan submitted with this application shows fills of approximate 6' in the northwest corner and minor cuts and fills throughout the remainder of the site. A retaining wall is proposed to be constructed in the northwest corner of the parking lot to retain the 6' fill section. The developer will be responsible for submitting detailed plans and specifications of the proposed retaining wall with the grading permit or building permit application. The existing sedimentation pond located in the northwest corner of this proposed project will be maintained throughout the construction period. After construction is complete it will act as an overflow area from the parking area for the storm sewer system. The development will be responsible for installing and maintaining erosion control measures in accordance with the City's Erosion/Sediment Control Manual Standards. The drainage plan for this project is divided into two drainage districts. The northeast portion of the site is proposed to drain in a northerly direction towards an existing 48" storm sewer in Alexander Road. The 48" storm sewer in Alexander Road drains to Pond CP-9, which is a pond on the City's Comprehensive Stormwater Management Plan. The south and westerly portions of the site are proposed to drain to a storm sewer system that will connect to the existing storm sewer in Terminal Drive and along the west property line of this site. This existing storm sewer drains into Pond CP-8, which is also a pond on the City's Stormwater Management Plan. The City prohibits discharge of truck and car wash water and spillage from the gas pumps into the City's storm sewer and ponding system. It is required that the developer is responsible for removing the eroded material from Pond CP-8 that has washed into the pond from this site. City staff has met with the developer's representative at the site to show them the material that needs to be removed from the pond. The developer shall submit a restoration plan for that area affected and also obtain a permit from the DNR if needed. 1LLe UTILITIES: The existing building is presently served with an 8" sanitary sewer and a 6" watermain. These existing services are of adequate size to also serve the new proposed building addition. STREETS/ACCESS/CIRCULATION: The preliminary site plan shows two new driveway entrances being constructed from Terminal Drive. Terminal Drive has a 44' road width and was constructed in 1970. It will be required that both entrances be a minimum of 42' wide and be constructed as per the City Standard Detail Plat No. 440. EASEMENTS/RIGHT-OF-WAY/PERMITS: According to the boundary survey submitted with this application, the south half of the right-of-way for Alexander Road along the north edge of this site has not be dedicated. Alexander Road is a 44' wide public street with bituminous surfacing and concrete curb and gutter that was constructed in 1979. It will be required of this proposed development to dedicate a minimum of 30' of road right- of-way from the centerline of existing Alexander Road. FINANCIAL OBLIGATION • 8-CU•10-3.93 Lot 2, Block 1 and Pt Lot 3, Block 1, Sibley Terminal Industrial Park Based upon the study of the financial obligations collected in the past and the uses proposed for the property, the following charges are proposed. The charges are computed using the City's existing fee schedule and connections proposed to be made to the City's utility system based on the submitted plans. Chairman Voracek opened the first public hearing of the evening regarding a Conditional Use Permit to allow a truck and freight terminal and sales and service of trucks or passenger cars in a LI (Light Industrial) district on Lot 2 and part of Lot 3, Block 1, (032-01) , Sibley Terminal Industrial Park located along the north side of Terminal Drive in the AE 1/4 of Section 8. City Planner Sturm stated that the applicant has agreed to install a driveway, parking lot, storm sewer and landscaping. The applicant has further agreed to remove the eroded material from Pond CP-8. He stated that the proposed building will be built between Terminal Drive and the existing building. The applicant proposes to sell approximately 20-25 vehicles a year. He mentioned that the owner, James Sharpiro, has been very cooperative. James Sharpiro, the applicant, stated that he was available to answer any questions. Member Merkley questioned what the applicant intended to do with the small building located near Alexendar Road. Mr. Sharpiro replied that it would ultimately be removed. Member Merkley mentioned that in previous similar circumstances, the Commission placed a limit on the number of vehicles allowed to be on the premises at any one time for sale. City Planner Sturm stated that City staff does not foresee a problem with this issue as all vehicles would be sold internally. Member Hoeft asked the applicant if an antenna will be erected so that they could be in radio contact with their trucks. Mr. Sharpiro replied that no antenna would be erected. Member Hiller requested that a condition be added which requires the applicant to remove the small building near Alexander Road within two years. All trash and recycling enclosures shall be stored within the building, or attached to the building, and constructed of the same material. 2. All signage shall be subject to the one-time sign fee of $2.50/sq. ft. 3. Any rooftop mechanical equipment shall not be visible from Terminal Drive. 4. Irrigation along Terminal Drive and the two side lot lines shall be provided. 5. The City prohibits discharge of truck and car wash water from entering the City's storm sewer and pending system. 6. This development is responsible for removing the eroded material from Pond CP-8 that has washed into the pond from this site. 7. This development is responsible for dedicating 301 of half right-of-way along the north edge of this site for Alexander Road. 8. The developer will be responsible for submitting detailed plans and specifications of the propoved retaining wall with the grading permit or building permit application. 9. The display area shall be surfaced with concrete or an approved equivalent to control dust and erosion. The surface shall be properly maintained to prevent deterioration. i . The square footage of outdoor display areas shall be included in the calculation of required off-street parking for the principal use of the property. 2 . Non-compliance. Failure to comply with any condition set forth in a conditional use permit, or any other violation of City Code provisions, shall constitute sufficient cause for the termination of the conditional use permit by the Council following a public bearing. City Planner Sturm stated that City staff has received only one comment regarding this application and that came from Easter Lutheran Church. The church seemed confused as to the application and thought that additional vending machines on the site would look "junky." The applicant was not present. Member Merkley stated that he cannot support this application because outside storage should coincide with the primary purpose of the business. He did not feel that pop machines outside a liquor store was needed. Member Belli stated that she also was against this application because it does not meet the conditional use permit requirements. Further this application does not propose an enclosure that is attached to the building, the vending machines will interfere with pedestrian movement, and the vending machines will encroach into the front setback area. Chairman Voracek also stated that the vending machines are not proposed to be in an enolosure. Member Miller felt that this application does not meet the outdoor storage requirements. COMMENTS: The applicant is proposing two separate 8'wide by 3'high plywood firewood storage racks on either side of the front entrance of the Amoco station facing Washington Drive and an ice chest and propane cabinet on the south side of the building facing 81st Street. Outside storage is not allowed to encroach into any established front building setback area which is measured from the building foundation and the enclosure shall be attached to the building and is not allowed to interfere with any pedestrian movement. Storage standards also require the enclosure to be q made of materials suitable to the building and the items being stored. The applicant is proposing two three-sided plywood enclosures to be placed in front of the brick building on either side of the entrance. Both 26" deep storage racks will encroach into the front building setback and block over half of the 4' wide front sidewalk. The proposed propane cylinder storage cabinet and ice machine are self-contained units that are not encroaching in the front setback area, however the 41" deep propane cabinet and the 36" deep ice machine eliminate pedestrian use of the 4' sidewalk on the south side of the building. The City Council on April 29, 1993 gave staff direction to draft a licensing provision, including performance standards for the outside storage of propane. However, until the Council amends the Outside Storage Ordinance in this regard, a Conditional Use Permit for propane storage is appropriate. If approved, this Conditional Use Permit shall be subject to the following: 1. The Conditional Use Permit shall be recorded with the Dakota County Recorder within 60 days of approval with documentation to the City. 2. City Planner Sturm stated that the applicant is proposing the outdoor storage of firewood, ice, and propane. The firewood would be stored in two 8X3 plywood racks, located on both sides of the entrance. The ice and propane would be stored on the south side of the building. He mentioned that on April 29, 1993, the City Council directed staff to draft a licensing provision regarding the storage of propane as propane can not be stored inside. The store manager, representing the applicant, stated that storing these items outside will be more convenient for their customers. He mentioned that the ice chest and propane cabinet are vendor supplied. The ice chest has been on site since 1987 and is located around the corner where there is no parking. He further stated that the firewood is a seasonal item and will only be stored outside during the fall and winter months. Member Miller questioned how citizens of the City will get their propane if it is not allowed indoors and does not meet the • requirements for outdoor storage. Member Isberg also shared this same concern. He felt that the citizens needed some business to purchase the propane from. Member Heyl asked if the firewood racks, ice chest or propane cabinet would be attached to the building. The applicant replied that the ice chest and propane cabinet are attached to the sidewalk. Member Markley asked City staff if the intent of the outdoor storage ordinance was to have enclosures that were compatible with the existing building. City Planner Sturm answered that the intent was to have the enclosures match the building or at least be compatible. Member Merkley felt that the plywood firewood storage racks were unacceptable. He felt that it would weather fast and be an eyesore. He also felt that the propane cabinet should be enclosed within another enclosure that would be compatible with the building. Member Markley stated that this application does not meet the requirement for enclosures. / CD EAGAN ADVISORY PLANNING COMMISSION MINUTES MAY 25, 1993 Chairman Voracek stated that the ordinance addresses the appropriate manner is which to store items outside. Be felt that any items stored outside must be in a compatible enclosure. Chairman Voracek stated that the ice chest and propane cabinet should be enclosed within another enclosure. 8e mentioned that the firewood racks are not appropriate as it would interfere with pedestrian traffic. Member Miller felt that the propane cabinet, without an enclosure around it, is unsuitable and obtrusive. Member Hoeft mentioned that setting aside policy concerns he still has some problems with this application. Be felt that the sidewalk is too narrow where the firewood is proposed to be stored and that this would interfere with pedestrian movement. Also the ice chest and propane cabinet take up too much space on the sidewalk and looks cluttered. He felt that this was an eye sore and a public safety hazard. The proposed outdoor storage would have a negative impact on the motor vehicle and pedestrian traffic. The applicant stated that he tended to agree that the ice chest and propane cabinet are an eye sore, however, these were supplied by the vendor. He further mentioned that the propane cabinet is flush with the front of the building. Miller moved, Heyl seconded, the motion to deny a Conditional Use Permit to allow outdoor storage on Lot 1, Block 1, Bicentennial 3rd Addition located along the south side of Yankee Doodle Road east of Washington Drive in the NB 1/4 of Section 16, for the following reasons: 1. The firewood racks will encroach on the front setback area. 2. Screening material is not suitable to the existing building. 3. Negative impact on motor vehicle and pedestrian traffic. All present voted in favor. Chairman Voracek informed that applicant that he has the potential to get the ice chest and propane cabinet outdoor storage approved if he proposes an enclosure for them which would be compatible with the existing building. Chairman Voracek opened the last public hearing of the evening regarding a. Conditional Use Permit to allow outdoor storage on Lot 3, Block 1, Cliff Lake Centre located along the north side of Cliff Lake Road east of Cliff Lake Road in the SW 1/4 of Section 29. City Planner Sturm stated that the applicant is proposing to store 190 shopping carts behind a brick wall enclosure in front of the building. The wall will be 4 1/2 feet tall. He requested that a condition be added which requires that the enclosure be made of the same material as the building. He mentioned that the applicant has been very cooperative and responsive to City staff. No comments were received from the public. Lloyd Ellanson, the architect for the applicant, stated that he was available to answer any questions. He mentioned that the shopping carts are 37 1/2 inches from the ground to the handle and the enclosure will easily hide the shopping carts from view. Member Merkley questioned why all of the shopping carts could not be stored inside'' the building. Steven Johnson, manager of the Eagan Target, stated that they are already storing 610 shopping carts inside the building and to store all of them inside would not be feasible. chairman Voracek commented that the applicant has net the intent of the outdoor storage ordinance and he wished to compliment the applicant on this proposal. Markley moved, Gorman seconded, the motion to approve a Conditional Use Permit to allow outdoor storage on Lot 3, Block 1, Cliff Lake Centre located along the north side of Cliff Lake Road east of Cliff Lake Road in the SW 1/4 of Section 29, subject to the following conditions: 1. This Conditional Use Permit shall be recorded at Dakota County within 60 days of its approval with documentation provided to the City. The applicant stated that they would store approximately 190 carts behind a brick wall on the front of the building. The carts themselves are 37-1/2" tall and the wall would be 54" tall, constructed of brick to match the building exterior. One additional condition was added that the 54" height and the building exterior finish matching the building would be required. There were no public comments on this application and the Commission complimented Target for complying with all Conditional Use Permit standards. Request, Engstrom Company, Building Permits Prior to Final Plat, Woodlands North 3rd Addition--Enclosed on page jegri is a copy of correspondence from Robert Engstrom Companies requesting two building permits in advance of final plat for Country Home Builders for the Woodlands North 3rd Addition. The Woodlands North final plat application has been submitted and is being reviewed in timely fashion by City staff. To date, the City did not have a completed development agreement or financial guarantees from the developer. In addition, the developer has yet to provide right-of-way easements and temporary construction easements associated with the public project for this development which is being processed simultaneously with the plat application. If the owner is able to resolve these obligations, the final plat could be before the City Council in approximately two to five weeks. Enclosed on page 14,9 is subdivision 3 of Eagan City Code, section 13.02 which prohibits buildin permits from being granted on property which is not platted. Also enclosed on pages and /70 is a copy of a development plan showing the lot for which the building permit request is being submitted. The final steps for the development are in process namely the final plat and development contract, final grading plan and the City of Eagan engineering and construction of utilities. Prior to the final plat, Country Home Builders is requesting permission to build two buildings of two units each. Both buildings would be adjacent to the existing buildings, platted lots and existing streets and utilities. I am informed that Country Home Builders has eight pre-sales for the new addition. Therefore, granting the request to build two buildings would be of much assistance. Request,Williams Brothers Pipeline,Extended Hours of Work,Pipeline Right-of-Way-- Enclosed on page .22is a letter of request from Williams Brothers Pipeline to permit excavation activity related to pipeline repairs to occur on Sunday, June 6, 1993. City Code Section 4.30, Subdivision 5B prohibits operations outside of the hours of 7:00 a.m. to 7:00 p.m. and on Sundays and legal holidays. A copy of that ordinance section is enclosed on page 1for your review. In addition to the June 6 date, Williams Brothers Pipeline has indicated that they may need to make certain repairs during the hydrostatic test which begins on July 6 and will continue until the entire line meets the pressure test. As a consequence, the applicant may also be required to excavate and make repairs on July 11, 18 and 25,which are also Sundays. While the specific request in the letter is for the June 6 repair work, it may be appropriate for the Council to consider all four Sunday dates together to eliminate the need for Williams Brothers to return to the Council on several occasions or work in violation of the City's ordinance. Screening. Where necessary to eliminate unsightly view of the excavation and operations, applicant shall plant suitable fast growing screening trees which shall be a minimum of six feet high placed in two rows staggered with trees not more than ten feet apart in each row. E. Slope Maximums. During the entire period of operations, all excavations shall be sloped on all sides at a maximum ratio of 1 to 1. F. Manufacturing or Processing Prohibited Exception. A conditional use permit shall be required for the manufacturing or processing of any material on the site.
