111 MINUTES
REGULAR MEETING OF BOARD OF SUPERVISORS, EAGAN TOWNSHIP, FEBRUARY 5, 1963
A regular meeting of the Board of Supervisors, Eagan Township, was
• held on February 5th, 1963, at 8:00 o'clock P. M. at the town hall
at which all members were present, except Chairman Rahn.
The reading of the minutes of the previous meeting was unamiously
waived. Supervisor Schwanz presided. There were no building permit
applications.
The matter of the investigation of the operation of the Gopher
Smelting Company Plant was again brought before the Board. A
preliminary investigation report was submitted by the town attorney
and read together with a proposed Ordinance No. XII, entitled
"Eagan Township Smoke Ordinance." Mr. Vance B. Granis, Attorney,
appeared on behalf of Gohper Smelting Company, and Mr. Irving Beaudien,
Attorney, appeared on behalf of Mr. Donald Chapelain and other interested
residents in the area of the plant. Mr. Beaudien requested that no final
action be taken on the adoption of the proposed ordinance until the
test reports form Twin City Testing Laboratories were completed. Mr.
Granis made no objection to this request. Supervisor Schwanz direct that
the further consideration of the proposes Smoke Ordinance until February
12th meeting of the Board of Supervisors.
The request for renewal of it's gravel pit permit on Highway
No. 13 was submitted by Swanson Bros. Company together with appropriate
bond as required by the ordinance for the year 1963. Upon motion
duly made by Supervisor Schwanz and seconded by Supervisor Trapp it
was RESOLVED that said permit for the year 1963, be and the same hereby
is renewed.

The matter of the dedication and acceptance by the Board of
Supervisors of the separate resolution covering Cedar Grove Addition
streets and storm was set over to the February 12th meeting.
• Mr. George Ohman appeared with respect to an amended snow plowing
agreement for the balance of the 1962-63 season. The town attorney
presented an opinion regarding the granting of such contracts without
first accepting bids in the manner provided by law. Mr. Ohman
thereupon withdrew his request for a change in contract and agreed to
complete the current season on the old basis.
The application of Robert Schumacher, 3170 So. Lexington, for
a dog kennel license was requested by Mr. Schumacher's attorney to
be continued until the February 12th meeting, which Supervisor Schanz
directed be done.
The attorney reported that he had checked with the township's
insurance agent and that the township did carry adequate public
liability coverage at this time, except that the present coverage
should be extended to include the new town park in Cedar Grove.
Upon motion duly made by Supervisor Schwanz and seconded by
Supervisor Trapp, it was RESOLVED that the annual meeting be set for
March 12th, 1963 and commence at 10:00 o'clock. A.M. and that the
voting polls in the three precincts opin at 1:00 o'clock P. M. and
close at 8:00 o'clock P. M., said polling places to be situated .

111 Upon the recommendation of the town engineer and town attorney,
upon motion duly made by Supervisor Trapp and seconded by Supervisor
Schwanz, it was RESOLVED that Twin City Testing Laboratories be, and
the same hereby is, hired to conduct the tests as proposed for the
sum of $600.
The applications for reduction of tax bases for personal property
tax submitted by:
Arthur Gustafson, 3345 Sible Highway, St. Paul,
The Airline Motel on Highway 55.
Ben Oehrlen, Pilot Knob Road, for personal property tax
were next consiaered. After discussion on each application and upon
motion duly made and,;_seconded, it was RESOLVED that the following
action on the foregoing applications be, and it hereby is, enacted.
Application by Arthur Gustafson for reduction in tax bases on
portable camper, denied; Application by Airline Motel for reduction
of tax bases of motel personal property, denied; Application of Ben
Oehrlen for reduction of tax bases for tractor, granted.
