09/05/1967 - City Council Regular MINUTES OF A REGULAR MEETING OF TIlE BOARD OF SUPERVISORS OF EAGAN TO,lllS11IP, Di\KOTA COUNlY, MINNESOTA September 5, 1967 A regular meeting of the Board of Supervisors of Eagan Township, Dakota County, Minnesota, was held at the town hall at 8:00 o'clock P. M. on September 5, 1967. Present were Chairman Klein and Supervisor Rabn. Supervisor SC~Aanz was absent. Chairman Klein announced the commencement of a public hearing concerning the application of Wayne R. Winsor for Associated Families, 1455 Lone Oak Road for approval of preliminary plat covering 97 acres near Bl~ckhawk L6ke in Section 16. It was noted that the Advisory Planning coumittee recommended approval. Mr. Don Campbell together with the applicant appeared and indicated certain changes namely, Blocks 2 and 3 would consist of one lot earh and that~a,sewer trunk line easero~llt would be granted over the East p~rtion of the property. Upon motion by Chairman Klein, and seconded by Supervisor Rahn, it was RESOLVED that the application be, and hereby is, approved for rezoning. Upon motion the re~ding of the minutes of the previous meeting was waived. There were no building permit applications. The Board then reviewed the verbal and written objections to the proposed sanitary sewer trunk assessment for 1967. The hearing had been continued from August 29, 1967. Upon motion by Chairman Klein and seconded by Supervisor Rahn it was RESOLVED that the 1967 Sanitary Sewer Trunk Assessment Roll be, and hereby is, adopted as amended pursuant to the RESOLUTION attached hereto and made a part of these 1t~nutes. The application of DCR Company for building permit for an industrial building, 34,830 square feet, on Lot 1, Block 2, Cedar Industrial Park ~s next presented. It was noted that the Planning Committee recommended approval. - 1 - Upon motion by Chairman Klein, and seconded by Supervisor Rann 1.t was RESOLVED that said building permit application be and hereby is, approved subject to final approval of the town engineer. Estimated cost $150,000. Upon motion made and seconded, it was RESOLVED that the contract 't~ith Phelps~Drake Company in the amount of $184.098.50 for Water Trunk Extension, Improvm~nC Project #15, Part A. be, aDd hereby is, awarded. The town attorney reviewed the proposals of the Assessment Committee meeting of August 29, 1967, relative to sanitary sewer, water and storm sewor projects. Included was the recommendation that 20% of storm sewer projE'!~-\:s be financed from general town revenue. Upon motion by Chairman Klein, seconded by Supervisor Rahn, it was RESOLVED that said proposals be, B1W hereby are, adopted by the Board of Supervisors. Certain revisions to the ~roposed Bloomington-Eagan-Burnsville Joint Sewer Plant Agreement were presented and upon motion by Chairman Klein, and seconded by Supervisor r.ahn, it was RESOLVED that said amended Joint Sewer Plant Agreement be, and hereby is, adopted and that the clerk be directed to forward executed copies to the two other municipa lities. The Board next discussed the proposed sewer rate increase to $8.25 pe~ month by Cedar Grove Utilities Company. After extended discussion and upo~, motion by Chairman Klein and seconded by Supervisor Rehn, it was RESOLVED that the town attorney be, and hereby is, instructed to write Cedar Grove UtUities Company requesting and directing that they be present at the re8ular meeting on September 19, 1967, at 8:00 o'clock p. M. to submit the necessary justification to warrant the increase and further that Cedar Grove Utilities compaDy submit to -the town attorney within ten days financial information relative to the proposed increase and FURTHER RESOINED that th~ ~own attorney an~ lO~nl engineer be authorized to consult with a competent accounting firm .. 2 .. relative to such financial statements. Upon motion by Chairman Klein, and seconded by Supervisor Rahn, i.t WM RESOLVED that the contract with Husting and Engstrom, Inc., Hastings, Minnes~ta for the extension of Rahn Road to Beau de Rue Drive be, and hereby is, authorizedl to be executed by the appropriate town officers. "-, Upon motion by Supervisor Rahn, and seconded by Chairman Kl~iu iC was RESOLVED that the plans submitted by the tOt~ engineer covering Improvement Project #15, Part B be, and h~r~by are, accepted and that the clerk be, and hereby is, directed to advertize for bids for said project to be opened at 8:00 P. M., September 26, 1967, at the town hall; it was FURTHER RESOLVED that the proposed sanitary sewer project in the Valley View Village apartment complex on Rahn Road be, and hereby is, incorporated in said project together with the proposed sanitary sewer project to serve the Su Su Ling Drive In restaurant near Cedar Avenue and Beau de Rue Drive, provided, bouever, that thl:" property owner of each of the latter projects submit a letter to th~ Boar.l agreeing to be assessed 100% for the cost of said projects thereby waiving 1:n3 preliminary hearing on said projects. It was FURTHER RESOLVED that ~3ic hearings be waived provided that the property owners will provide the neceSSAry ease~ents for the utility lines. Mr. Nels Linde, a property owner in KoJ10ski ~ndition along Highway #55 appeared relative to the maintenance of streets in KoHoski Mdition. Upon motion by Chairmain Klein, secorAed by Sur-ervisor Rahn, it was RESOLVED that the request of the Chief of Police to interview and make recommendations to the Board for the hiring of an additional part time police- man from the existing register of applicants bet and hereby is, approved. Upon motion by Chairman Klein, seconded by Supervisor Rahn, it was RESOLVED that the resignation of Bernhard T. Ringberg as Chief of the E.agan Fire Department be, and hereby is, accepted and the town clerk be directed to forward a letter to Mr. Ringberg expressing apprecla~ion for his efforts. Upon motion duly made and seconded it was RESOLVED that William Schultz be, and hereby is appointed as Chief of the Eagan Volunteer Fire Department and Mr. Jerry Adams be appointed First Assistant Chief. The town engineer presented a proposed easement from Ted Kaysen, Jr. along BlaCkhawk Road and indicated that 1-Ir. Kaysen would be requested to execute the easement. Upon motion by Chairman Klein, seconded by Supervisor Rahn, it was RESOLVEP that l~rvin Wenzel be compensated at the rate of $3.25 per hour effective 9/1/61 Upon motion by Chairman Klein, seconded by Supervisor Rahn, it was RESOLVlID that Mr. Herbert Polzin be compensated the sum of $700 per year for bookkeeping services effective April 1, 1967 Upon motiun made and seconded it was RESOLVED that a credit for tbe st~rm sewer easement covering Lot 5, atNei1l Homestead be granted toward the 1967 sanitary sewer trunk assessment and that the property owner be notified of the fact. Upon motion all bills were paid. Upon motion the meeting was adjourned. Dated: September 5, 1967. /) I/-J JrJ:~ i~ '" ) ^- - :_- ~- ( c:lerk - 4 - EXTRACT OF MINUTES OF MEETING OF THE BOARD OF SUPERVISORS EAG.AN TOWNSHIP) DAKOTA COUNTY, MINNESOTA September 5, 1967 Pursuant to due call and notice thereof, a continued special meeting of the Board of Supervisors of Eagan Township, was duly held at the Town Hall on the 5th day of September, 1967 at 8:00 P. M. Members Klein and Rahn were present; Member Schwanz was absent. The chairman announced that the continued hearing concerning the assessments covering sanitary sewer trunks for 1967 was open for consideration of oral and written objections submitted to the Board. The Board reviewed in detail all objections submitted to the Board. Member Klein then introduced the following resolution and moved its adoption: Resolution adopting and confirming assessments for Sanitary Sewer Trunk 1967. BE IT RESOLVED by the Board of Supervisors of Eagan Township, Dakota County, Minnesota, as follows: (1) The Clerk, with the assistance of a qualified person heretofore selected by the Board of Supervisors, has calculated the amount proper and necessary to be specially assessed for Sanitary Sewer Trunks - 1967 against every assessable lot, piece or parcel of land affected thereby upon the basis of benefits, without regard to cash valuation, in accordance with the provisions of Minnesota Statutes Annotated, Section 429, and notice has been duly published and mailed, as required by law, that this Board would meet to hear and pass upon all objections, if any, and to amend said proposed assessments as might be necessary, and said proposed assessment roll has at all times since its filing been open for public inspection, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessments and said proposed assessment has been amended as to certain parcels of land, by resolution duly adopted this date. - 4 - (2) This Board having heard and considered all objections so presented, and being fully advised in the premises, finds that each of the lots, pieces and parcels of land enumerated in the proposed assessment roll as so amended was and is specially benefitted by the construction of said improvement in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, and that such amount so set out is hereby levied against each of the respective lots, pieces, and parcels of land therein described. (3) The proposed assessment roll as amended is hereby adopted and confirmed as the proper special assessment for each of said lots, pieces and parcels of land respectively, and the assessment against each parcel, together with interest at the rate of 6% per annum accruing on the full amount thereof from time to time unpaid shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessment shall be payable in equal annual installments extending over a period of 30 years, the first of said installments, together with interest on the entire assessment from the date hereof to December 31, 1967, to be payable with the general taxes collectable during the year 1968, and one of each of the remaining installments, together with one year's interest on that and all other unpaid installments, to be payable with general taxes for each consecutive year thereafter until the entire assessment is paid. (4) Prior to certification of the assessment roll to the County Auditor, the owner of any lot, piece or parcel of land assessed hereby may at any time pay the whole of such assessment with interest accrued to the date of payment to the Treasurer of the municipality. (5) The Clerk, shall, as soon as may be, prepare and transmit to the County Auditor a certified duplicate of the Assessment Roll, with each then unpaid installment and interest set forth separately, to be extended upon the proper tax lists of the County and the County Auditor shall thereafter collect said assessments in the manner provided by law. (6) The proposed assessments heretofore made in respect of the improvement shall be and are hereby amended so as to read as shown below, and the clerk is authorized and directed to indicate the said amendments on the face of said assessment roll. The motion for the adoption of the foregoing resolution was duly seconded by Member Rahn, and upon vote being taken thereon the following voted in favor: Rahn and Klein; and the following voted against same: None. Whereupon said resolution was declared duly passed and adopted.
