09/13/1977 - City Council Special litMINUTES OF A SPECIAL MEETING OF THE EAGAN CITY COUNCIL EAGAN, MINNESOTA SEPTEMBER 13,1977 A special meeting of the Eagan City Council was held on September 13, 1977 at 6:30 P.M. The Mayor convened the special meeting with all members present which was called to consider an assessment hearing for Project Number 190, establishment of a bond sale for $975,000 of a general obligation improvement bona and a $183,000 general obligation equipment certificates,a progress report on the plans and specifications for a new Police Department building and discussion of the proposed 1978 budget. Also present was City Administrator Hedges. PROJECT NO. 190 ASSESSMENT HEARING. The Mayor convened the assessment hearing concerning Project Number 190 consisting of sanitary sewer and water main improvements to Carlson Acres. City Administrator Hedges reviewed the project briefly with the Council and there were no objections to the roll. He stated that the assessments were reduced to a rate of $15.86 per front foot for sanitary sewer because of an error in the calculation of the amount for seeding by the City Engineer. Upon motion by Rahn, seconded by Smith, all members voting in favor, it was RESOLVED that the assessment roll as presented be adopted and forwarded to the County Auditor. PROPOSED GENERAL OBLIGATION IMPROVEMENT'BOND AND EQUIPMENT CERTIFICATE' ISSUE. Steve Mattson of Juran and Moody Fiscal Consultants, appeared and discussed the proposed sale of $975,000 general obligation improvement bonds and $183,000 general obligation equipment certificates. Mr. Mattson stated that the bond interest rates are extremely low in comparison to recent years and recommended that the City Council consider the sale of bonds as soon as possible to receive the low IIIinterest rates. City Council Member Smith asked if the Municiple Insurer`s Association can provide a more favorable interest rating to the City of Eagan and 9-13-77 IIIin addition, if Juran and Moody is familiar with their investment procedures. Mr. Mattson stated that he was familiar with Municiple Insurer's Association however he is not familiar with bidding for ,municiple bonds and recommended that the City not consider the sale of bonds to Huniciple Insurer's Association with these issues. After further consideration and discussion and upon motion by Polzin, seconded Rahn, all members voting in favor, it was RESOLVED that the Council accept the proposal submitted by Juran and Moody for the sale of $975,000 general obligation improvement bonds of 1977 and that a sale date be scheduled for October 4, 1977 at 4:00 P.M. at the City Hall. Also, upon motion by Rahn, seconded Wachter, all members voting in favor, it was RESOLVED that the Council accept the proposal submitted by Juran and Moody for the sale of I $183,000 general obligation equipment certificates of 1977 and that the sale date be scheduled for October 4, 1977 at 4:00 P.M. at the City Hall. Mr. Steve Mattson recommended that the City receive a Moody's rating for the bond sale which is estimated to cost the City approximately $650. In a motion by Smith, seconded Rahn, all members voting in favor, authorization was given to request a Moody's rating for the general obligation improvement bonds and equipment certificates of 1977 at an estimated cost of $650. PROPOSED POLICE DEPARTMENT BUILDING. Mr. Jim Horne, representing Horne Architects, Inc., appeared and presented the City Council with revised plans and specifications for the proposed Police Department facility. City Administrator Hedges stated that no funds are available for an emergency operating center facility and therefore that portion of the building program was eliminated from the plans and specifications. He further stated that if federal funding is designated in future years for emergency operating centers, the building would be designed so that the City could reapply and finish the basement as an EOC. It was generally agreed upon by the City Council that the plumbing would be roughed-in in the proposed basement unit and two minimum walls would be included 2 9-13-77 in the City storage portion of the basement to allow for permanent record storage for all general government records. It was also discussed that a poured floor and the rough-in of plumbing would be included in the base bid and in addition, the elevator well would be constructed, however, the elevator would not be installed until a future date. W. Horne stated that the plans and specifications illustrat- ing base bids and alternates bids would be ready for review by the City Council at the September 20 meeting, that final review of all plans and specifications by the mechanical and electrical engineers as well as the architect would be available on September 29. He advised the City Council that a bid date be set for October 25 and that bids be considered the following day in a special City Council meeting. 1978 PROPOSED BUDGET. The City Administrator presented working copies of the 1978 Budget. CITY OF EAGAN, DAKOTA COUNTY, MINNESOTA HELD ON SEPTEMBER 13 1977 Pursuant to due call and notice there*f, a special meeting of the City Council, of the City of Ea-an, Dakota County, Minnesota was duly held at the City Hall in said municipality on the 13th day of September , 1977 at 6: 3(b' clock P .M. The following members were present: Mayor Polzin, Councilmen Rahn, Smith; Wachter and Rydrych aiLd the following were absent: None. The Clerk presented an affidavit showing publication of Notice of Hearing on the proposed assessments for Improvement Project 4190 - sanitary sewer and water in Carlson Acres. in the official newspaper in accordance with a resolution heretofore adopted by the City Council, which affidavit was examined, found satisfactory, and ordered placed on file. The Mayor announced that the meeting was open for the consideration of objections, if any, to said proposed assessments. All persons were then Stven.:an.•ipportunity to present oral objections, and all written objedtions theretofore filed with the Clerk were presented and considered, and all such objections were tabulated as follows: NAME PROPERTY NATURE OF OBJECTION -1- Councilman Rahn then introduced the'follawing resolution and moved its adoption: RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR IMPROVEMENT PROJECT #190 - Sanitary sewer and water in Carlson Acres. BE IT RESOLVED by the S_ty Council, of the City _f Eagan, Dakota County, Minnesota, as follows: (1) The clerk, with the assistance of a qualified person heretofore selected by the City Council has calculated the amount proper and necessary to be specially assessed for against every assessable lot, piece or parcel of land affected thereby upon the basis of benefits, without regard to cash valuation, in accordance with the provisions of Minnesota Statutes Annotated, Section 429, and notice has been duly published and mailed, as required by law, that this Council would meet to hear and pass upon all objections, if any, and to amend said proposed assessments as might be necessary, and said proposed assessment roll has at all times since its filing been open for public inspection, and an opportunity has-been given to all interested persons to present their objections, if any, to such proposed assessments (and said proposed assessment has been amended as to certain parcels of land, by resolution duly adopted this date)*. (2) This Council, having heard and considered all objections so presented, and being fully advised in the premises, finds that each of.the .lots, pieces and parcels of land enumerated in the proposed assessment roll (as so amended)* was and is specially benefitted by the construction of said improvement-in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, and that such amount so set out is hereby levied against each of the respective. lots, pieces, and parcels of land therein described. (3) The proposed assessment roll (as amended)* is hereby adopted and confirmed as the proper special assessment for each of said lots, pieces and parcels of land respectively, and the assessment against each parcel, together with interest at the rate of 8 % per annum accruing on the full amount thereof from time to time unpaid shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessment shall be payable in equal annual installments extending over a period of 15 years, the first of said installments, together with interest. on the entire assessment from the date hereof to December 31, 1978 , to•be payable with the general taxes collectable during the year 1978 , and one. of each of the remaining installments, together with one year's interest on, that and all other unpaid installments, to be payable with general taxes. for .each consecutive year thereafter until the entire assessment is paid. (4) Prior to certification of the assessment roll to the County Auditor, the owner of any lot, piece or parcel of land assessed hereby may at any time pay the whole of such assessment with interest accrued to the date of payment to the Treasurer of the City. * Strike the matter in parentheses if assessment roll was not amended. 2 (5) The Clerk, shall, as soon as may be, prepare and transmit to the County Auditor a certified duplicate of the assessment roll, with each then unpaid installment and interest set forth separately$ to be extended upon the proper tax lists of the County, and the County Auditor shall there- after collect said assessments in the manner provided by law. (6) The proposed assessments heretofore made in respect of the improvement shall be and are hereby amended so as to read as shown below, and the clerk is authorized and directed to indicate the said amendments on the face of said assessment roll. NAME PROPERTY ASSESSMENT AS AMENDED The assessment rate for the project was reduced to $15.86 per front foot. The motion for the aloption of the foregoing resolution was duly seconded by Councilman Smith and upon vote being taken thereon the following voted in favor Mayor Polzin, Councilmen Rahn, Smith, Wachter and Rydrych. and the following voted against same: None Whereupon said resolution was declared duly passed and adopted.
