The Oath of Office will be administered to Shawn Hunter and Sandra Masin as City
Councilmembers. These officials were duly elected in the November 3, 1992 municipal
election.
ADOPT>AGENDA/APPROVE MINUTES
After approval is given to the January 5, 1993 City Council agenda, regular meeting minutes
for the December 15, 1992 City Council meeting and Special City Council meeting minutes
for the two meetings held on December 8, 1992, the following items are in order for
consideration.

There are thirteen (13) items on the agenda referred to as consent items'requiring one (1)
motion by the City Council. If the City Council wishes to discuss any of the items in further
detail, those items should be removed from the Consent Agenda and placed under
Additional Items unless the discussion required is brief.
PERSONNEL ITEMS
A. PERSONNEL ITEMS
Item 1. Police Officer--A position for a police officer has been approved in the 1993 budget.
In 1992, approximately 250 applicants for the police officer positions were invited for testing.
From the results of this testing, 50 applicants were given a second test. From the results of
the second testing, 30 applicants were selected for interviews. The top 12 candidates were
then given background investigations. After the background investigations, the top 6
candidates were given a final interview. Following this process, four police officers were
hired in September of 1992 and a hiring list was established for the remainder of the
applicants. It is the recommendation of Chief of Police Geagan that the first person on the
hiring list be hired as a police officer at this time, subject to successful completion of the
City's physical, psychological and drug testing procedures. That person is Richard Clark.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the hiring of Richard Clark
as a police officer at the City of Eagan, subject to successful completion of the City's
physical, psychological and drug testing procedures.
Item 2. Contractual Winter Sports Officials--It is the recommendation of Recreation
Supervisor Oyanagi that the following persons be offered contracts with the City of Eagan
to officiate the winter sports leagues: Wayne Fox, Mark Bush, Scott Merkley, Rick Kamrud,
Cliff Okerlund, Vincent Mergens, Bryan Mohr, Matt Mosvick, Robb Hagstrom and Steve
Matson.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve contracting with Wayne Fox,
Mark Bush, Scott Merkley, Rick Kamrud, Cliff Okerlund, Vincent Mergens, Bryan Mohr,
Matt Mosvick, Robb Hagstrom and Steve Matson to officiate the City of Eagan's winter
sports leagues.
Item 3. Winter Seasonal Park Maintenance Worker--It is the recommendation of
Superintendent of Parks VonDeLinde that Craig Brezinka be hired as a seasonal park
maintenance worker for the winter season.

ACTION TO BE CONSIDERED ON THIS ITEM: To approve the hiring of Craig Brezinka
as a seasonal maintenance worker for the winter season.
Item 4. City of Eagan Personnel Policy Revision--At the December 15, 1992 City Council
meeting, consideration of the proposed revision of the City of Eagan's personnel policy was
continued in order to further study Section 19 which is the discipline section. The concerns
expressed by the Council at that time were presented to the City's labor attorney. His
response was then forwarded to Mayor Egan who approved the amendment as suggested
by the labor attorney. That amendment was then forwarded to members of the Council's
Personnel Committee with the stipulation that a meeting of the Personnel Committee would
not be necessary unless the members have questions regarding the change. There has been
no questions or concerns regarding the proposed change; therefore, the personnel policy
revision was again being presented to the City Council for approval with the inclusion of the
change in tie discipline section. A copy of the proposed change to that section is enclosed
on page for your information.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the revised City of Eagan
personnel policy as presented including the change to the discipline section.

SUBJECT: DISCIPLINE SECTION OF PROPOSED PERSONNEL POLICY
We have checked with the Labor Attorney's office regarding concerns
raised by the City Council regarding the discipline section of the
proposed personnel policy, in particular the section regarding
"severe infractions. " It is the recommendation of the attorney
that all references to "severe infractions" be deleted.
This means that the entire Section 19.4 would be deleted. This is
the section listing severe infractions.
In addition, the following language changes would be instituted in
Section 19.2 :

If you have any questions, please contact Assistant to the City
Administrator Duffy after Christmas. There is no need to schedule
a Personnel Committee meeting unless you have questions regarding
the change. Mayor Egan is satisfied with the new wording so
stated. Unless she or I hear to the contrary, the draft Personnel
Policy with the above modifications will be again presented to the
Council for approval at the January 5, 1993 meeting.

application for off-sale beer for the SuperAmerica located at 2250 Cliff Road. The
application has been reviewed by staff and by the Police Department, which has approved
the license application. For Council's information, a copy of the application is enclosed
without page number.

EXTENSION/SHORELAND ORDINANCE AND GRANT AGREEMENT
D. Agreement Extension, Minnesota DNR Shoreland Ordinance and Grant--Enclosed on
page /0 is correspondence from the Minnesota Department of Natural Resources '
approving an extension of the City's Shoreland Ordinance due date and grant agreement to
April 2, 1993. Also enclosed on page is a copy of the agreement reflecting this
extension. The shoreland zoning ordinance is in the process of final review by the DNR and
will be forwarded to the City Council in February.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve an agreement extension

TIME EXTENSION FOR SHORELAND GRANT
Based upon the information provided in the December 11, 1992 letter
from Acting Community Development Director Jon Hohenstein, the
Department of Natural Resources has approved the City's request for
an extension to your Shoreland Grant Agreement. This will enable
the City to complete its final hearings and adoption of the amended
rules.
Enclosed is an original and 3 copies of the Amendment to your
Agreement. If the Amendment is acceptable please sign all 4 copies
and return them to Pam Albrecht at the above address. When the
Agreement has been fully executed, a copy will be sent to you.
Please note all terms and conditions of the original Agreement
remain in full force except for Item IV TERM. The new expiration
date is April 2 , 1993 . The new expiration date overrides the
initial expiration date wherever it is identified in the original
Agreement.
Please note Item I , N. A-3 : A draft ordinance must be submitted
for review at least 60 days prior to your new expiration date of
April 2 , 1993 .

SUPPLEMENT NO. 1 TO CONTRACT NO. 29000-57978-01
WHEREAS, the State of Minnesota, Department of Natural Resources has a
contract identified as Contract No. 29000-57978-01 with the City of
Eagan to adopt a shoreland management ordinance consistent with
statewide standards; and
WHEREAS, the State and the City have agreed that additional time is
necessary for the satisfactory completion of the contract; and
WHEREAS, Provision IV provides:
TERM. This Agreement shall become effective when all signatures
required have been obtained and when the funds have been encumbered by
the Commissioner of Finance, and shall continue in effect until the
agreed tasks are completed or until January 4 , 1993 whichever is
earlier.
NOW THEREFORE IT IS AGREED BY AND BETWEEN THE PARTIES HERETO;
That Provision IV shall be amended to read:

required have been obtained and when the funds have been encumbered by

E. Approve 1993 Consultant Fee Schedules--The consulting engineering firms of
Bonestroo, Rosene,Anderlik&Associates (BRAA)and Orr-Schelen-Mayeron (OSM)have
requested that the fee schedule portion of their contract be amended to provide for an
increase in their hourly rates. Enclosed on pages /,3 through /yZ is a copy of their
1993 rates as compared to 1992 reflecting the percentage increase for various technical
personnel. The increase for BRAA ranges from 2.6% - 3.7%, and OSM from 2.2% - 3.6%.

APPROVE RESOLUTION - TRAFFIC SIGNAL (cry TH 3 & CLIFF RD
F. Approve Resolution Requesting Traffic Signals @ TH 3 & Cliff Road--Last Spring,
when the City Council was considering the development proposal for the Weston Hills
subdivision located in the southeast quadrant of TH 3 & Cliff Road, there were various
comments and subsequent discussion regarding the need for a traffic signal and the timing
of its installation at this intersection.
The Minnesota Department of Transportation (MnDOT) has indicated that its typical
programming schedule would not allow it to be constructed earlier than 1995. The City and
Dakota County's Capital Improvement Program (CIP) both recognize the need for this
improvement but would like to see it installed no later than 1994.
Therefore, the Resolution enclosed on page � would assist City staff in pursuing the
timely installation of this traffic signal.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve a Resolution requesting
MnDOT installation of traffic control signals at TH 3 & Cliff Road and authorize the Mayor
and City Clerk to execute said document.

REQUEST FOR TRAFFIC SIGNAL INSTALLATION
TH 3 & CSAH 32 (CLIFF ROAD)
WHEREAS, the City of Eagan and County of Dakota have recognized the need
and benefits for installation of a traffic actuated signal control at the intersection of TH 3
and CSAH 32 (Cliff Road), and
WHEREAS, both the City of Eagan and County of Dakota have budgeted and
planned for the installation of this signal in 1994, and
WHEREAS, the number of accidents that have occurred at this intersection that
can be corrected through the installation of a traffic signal are above normal according
to MnDOT's traffic department, and
WHEREAS, the traffic volumes through this intersection have steadily increased
to the point of justifying such a traffic signal, and
WHEREAS, the health, safety and welfare of the City, County and State residents
require prompt attention by all three governmental agencies to respond to an identifiable
problem in a prompt and efficient manner.
NOW, THEREFORE, BE IT HEREBY RESOLVED that the Council of the City of
Eagan hereby requests MnDOT to take whatever measures and actions are necessary
to ensure that a full traffic actuated signal control is installed no later than 1994 at the
intersection of TH 3 and CSAH 32 (Cliff Road).
BE IT FURTHER RESOLVED,that the City of Eagan is willing to provide whatever
local assistance is available to facilitate the timely installation of this much needed signal.

TWIN CITY MODEL BOAT CLUB
G. Permit, Twin City Model Boat Club--Enclosed on pages a through I? is a
memorandum from the Police Department covering correspondence received of Randy
Sampson on behalf of the Twin City Model Boat Club. The club has operated model
boating events in the ponding area east of Cedar Avenue and north of Highway 13 for
several years. The club has received city permission in the past to conduct these activities.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve a permit for the Twin City
Model Boat Club to conduct model boating events at the pond east of Cedar Avenue, north
of Highway 13, during 1993 as presented.

SUBJECT: MODEL BOAT CLUB PERMIT
For the past several years, Twin City Model Boat Club has requested
permission and received approval from the City Council to operate
Model Boat Races just off Nicols Road near the river bottoms.
In the past, we have given them that permission with a stipulation
that if we received any complaints from noise or parking, we would
have to revoke the permit. To my knowledge, we have not had any
problems with their past activities. At this time, the Police
Department does not have any problem with their request.

H. Project 643,Authorize Pre-Improvement Appraisals(Timberline,Valley View Plateau
& Wescott Square - Street Reconstruction)--The reconstruction of streets in the Oslund-
Timberline Addition, Valley View Plateau and Wescott Square Additions are scheduled for
1993 under the City's current 5-Year CIP. While the improvement is basically the same as
the recently approved Cedar Grove street rehabilitation program, the financial impact on
the affected property owners will be different due to the lower density (fewer lots per mile)
and multiple density (Wescott Square Additions).
A preliminary draft of the feasibility report authorized by Council action has been
completed to the extent necessary to allow detailed appraisals performed to determine the
extent of benefit related from these improvements on these various types of properties.
Therefore, staff is requesting Council authorization to prepare representative pre-
improvement benefit appraisals to assist in determining the proposed assessment to be
included in the feasibility report for presentation at a public hearing in the near future.
ACTION TO BE CONSIDERED ON THIS ITEM: To authorize pre-improvement benefit
appraisals for Project 643 (Timberline, Valley View Plateau & Wescott Square Additions -
Street Rehabilitation).

I. Contract 92-08, Change Order #1 (Blackhawk Park Improvements)--During the 1992

During the 1992 construction season the Blackhawk Park Improvement incurred several
items which are not included in the City's current contract. Therefore, staff would like to
incorporate these items into the contract through Change Order#1. Provided is a summary
describing these items and their associated costs:
A. A recent Council directive to realign the road placed it within poor soils. In order
to achieve structural subgrade these soils were removed and corrected. The cost for
this item is $1,840.00.
B. The mobilization and grading for the installation of the boardwalk resulted in an
additional cost of $450.00.
C. As you are aware, a water quality project has been incorporated within the
Blackhawk Project. In order to facilitate greater effectiveness with in-basin treatment
a soft surface vehicular access was graded to the east portion of Blackhawk Lake.
The contract included a similar access within the west basin. The cost of this item
is $1,365.00 and would be taken from the Water Quality Fund.
D. Poor soils were encountered with the excavation of a small pond central to the site.
The construction methodology changed from common excavation to muck
excavation. The cost for this item is $2,400.00.
E. These referenced changes result in additional management costs to the prime
contractor in the amount of $365.50.
The total for Change Order #1 is $6,420.50. With approximately 50% of the project
complete this represents an increase to the original contract by approximately 1.5%. Staff
current request is for City Council consideration of Change Order #1 for Improvement
Contract 92-8 for the amount of $6,420.50.

determined that it would be best to solicit new quotations based on a defined scope of
services and work program. These quotations have now been received and are being
forwarded to the City Council for their consideration of awarding the contract to Jim's

SUBJECT: QUOTES FOR JANITORIAL SERVICE AT THE
CITY OF EAGAN MAINTENANCE FACILITY
In May of 1987 the city contracted for janitorial services with Northwestern Building
Maintenance, Inc. This was a one-year contract that was automatically renewed in
subsequent years. In 1991 the office area was expanded and the existing office area was
remodeled which increased the janitorial responsibilities.
During 1992 Rich Pelletier, Park Operations Supervisor, accepted the responsibility of
overseeing the cleaning and custodial services and a list of the daily, weekly and monthly
tasks were formulated.
The level of service has deteriorated over the last 1 1/2 years. Because this contract has
not been open for competitive bids since 1987, along with the increased janitorial duties, we
solicited quotes from services in December of 1992.
Four bids were received ranging from $11,400 to $15,513.28 annually. Because of the
excellent references and low hid, I recommend accepting the janitorial contract, including
stripping and waxing floors, received from Jim's Building Maintenance in the amount of
$11,400 annually.

APPLICATION SUMMARY: An application has been submitted requesting a Special Use
Permit to allow the temporary storage of concrete for recycling for the proposed Coca-Cola
parking lot expansion.
LOCATION: The site is located south of I-494 and Highway 55,west of I-35E, north of two
unplatted parcels, and east of Coca-Cola.
COMMENTS: The applicant is proposing to stockpile approximately 20,000 tons of
concrete to recycle into gravel base for the proposed Coca-Cola parking lot expansion.
Steininger Construction will be performing the earth work on the project and would like to
temporarily stockpile concrete from the Mendota bridge on the site.
The applicant would like to begin as soon as possible and anticipates the concrete would be
recycled by July 1, 1993. The recycling would take place on site, the maximum work hours
would be from 7:00 a.m. - 7:00 p.m. Dust control measures would be implemented. Erosion
control measures are detailed on the grading plan submitted. Recycling would take place
at least 100' from any public street.
If approved, this Special Use Permit shall be subject to the following conditions:
1. This permit is temporary and shall expire July 1, 1993.
2. Dust control measures shall be taken.
3. Erosion control measures shall be taken.
4. All applicable City Code requirements.

a.m. at the site. The church plans to lease an office below the theater from Federal Land
Company for administrative offices, childrens' programs during the Sunday morning worship
service, and other church-related needs. In the future, Aspen Hills Community Church
intends to rent, or lease, the Early Childhood Learning Center below the theater next to the
office from I.S.D. #197. This space would be utilized for early childhood programs during
Sunday morning worship service.
Parking for the church would be provided by the on-site parking available at the Yankee
Square Shopping Center.
If approved, this Special Use Permit shall be subject to the following conditions:

1993 CDBG APPLICATION
D. Resolution, Dakota County HRA, 1993 Community Development Block Grant
Application--In previous action, the City Council authorized staff to prepare a CDBG
application to set aside block grant funds for the second phase of the City's senior housing
facility. As noted in the previous discussion, it will be necessary to set aside approximately
three years of the City's CDBG allocations to provide a sufficient amount to initiate this
phase. In order to facilitate this set aside, the City will contribute its allocation to the
county wide single family housing rehabilitation program for two years to be repaid in 1995
and combined with that year's allocation to commence the second phase of the Eagan senior
project.
The Dakota County HRA has indicated that it will not be possible to amend this application
once the agreement is entered into. As a consequence, the City is acting to set aside its
CDBG allocation for the period and purpose indicated.
Enclosed on page 56-is a copy of the resolution authorizing this action together with a
copy of the application itself on pages 63through SCI.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve or deny a resolution
adopting the City's 1993 Community Development Block Grant application and authorizing
an agreement with the Dakota County HRA to accumulate CDBG funds for a period of
three years for the construction of the Eagan senior housing facility as presented.

5. General Description of the Project
A. Project Description
The design of the program will be a combination of loans3 and
deferred loans4 to owner-occupied, single-family homes. With
a Community Development Block Grant of $100, 000, twelve (12)
loans of $8, 500 would be available.
B. Implementation
The Dakota County HRA will act on behalf of the City of Eagan
in administering these funds. The HRA will provide the
following staff functions.
1. Program advertising and outreach
2 . Loan intake and processing
3 . Housing inspections, work write-ups, bidding, working
with contractors, and final inspections.
4 . Program fund requisitions, record keeping, and auditing.
5. On-going loan services and program income accounting.
3The maximum loan available would be $15, 000 for
rehabilitation. To secure the loan, a promissory note for the
terms and conditions agreed to and a mortgage deed shall be signed
by all parties listed on the title of the property to be improved.
The mortgage shall be recorded with the County; copies of all
recorded documents will be forwarded to the homeowner.
4The maximum deferred loan available would be $15, 000 for
rehabilitation. If the property is sold, transferred, or no longer
the principal residence of the applicant, all funds must be repaid.
A repayment agreement stating these terms and conditions shall be
signed by all parties to the title of the property to be improved.
This agreement shall be recorded with the County; copies of all
recorded documents will be forwarded to the applicant.

STALKING ORDINANCE
A. Stalking Ordinance -- City Councilmember Awada requested that the possibility of a
"Stalking Ordinance"for the City of Eagan be researched by staff. This item was extensively
discussed by legislative committees of the League of Minnesota Cities during formulation
of proposed legislation to be presented to the 1993 state legislature. The item was originally
presented by representatives of the City of Minneapolis who felt it would be more
appropriate and more effective to have a state wide law rather than a number of
miscellaneous local ordinances.
It was felt that current state law may not adequately prohibit the conduct of stalking. In the
domestic abuse area, orders for protection may be available under M.S. 518B.01. Outside
the domestic abuse area, the only means of prosecution may be the terroristic threats
statute, M.S. 609.713. That statue requires proof of a direct or indirect threat to "commit
any threat of violence with purpose to terrorize another," which makes successful
prosecution difficult. Also, the domestic abuse protection order provision only carries a
misdemeanor level penalty.
Because state laws already exist which deal somewhat with the issue, the League felt that
it would be more efficient to modify those existing statutes rather than to adopt local
regulations, which could carry no more that a misdemeanor penalty. Therefore, the League
is recommending that those statutes be amended. Representative Mary Jo McGuire is
planning to sponsor such a bill. Originally, her office sent City Councilmember Pawlenty
a copy of the then proposed legislation. However, that proposed legislation is currently
being revised. As soon as a revised version is available, her office will mail a copy to
Assistant to the City Administrator Duffy and it will be forwarded to the Council.
In addition, it was just learned Thursday morning, December 31, that Governor Carlson and
Lieutenant Dyrstad will be sponsoring stalking legislation during the upcoming session.
It is the recommendation of Chief of Police Geagan that staff monitor the legislature's
actions on this item during the 1993 session before deciding whether staff here should
proceed with an ordinance regarding stalking.
(Note: The City of Shoreview did pass a "harassing ordinance" in November of 1992. A
copy of that ordinance is enclosed for the Council's information on page(0 ( .)
ACTION TO BE CONSIDERED ON THIS ITEM: To provide direction to staff considering
legislation regarding "stalking."

AN ORDINANCE RELATING TO THE REGULATION OF HARASSING CONDUCT
The Shoreview City Council ordains that Chapter 1007 is hereby
added to the Shoreview municipal Code to read as follows:
HARASSMENT. SECTION 1007
Section 1007.010. Harassing Conduct Prohibited. A person who
commits harassment against another, after being notified not to do
so by the intended target of the harassment or by the City's Law
Enforcement Agency, is guilty of a misdemeanor. As used herein,
the term "harassment" means either a willful repeated course of
conduct consisting of acts, words or gestures which, the
perpetrator knows or reasonably should know, will alarm, anger or
disturb the intended target of the harassment; or willful repeated,
intrusive, or unwanted acts, words or gestures which, the
perpetrator knows or reasonably should know, will adversely affect
the safety, security or privacy of the intended target of the
harassment.
�✓ Effective Date. This ordinance shall be effective the day
following its publication or on the day following the publication
of an Ordinance Summary approved by the City Council.
Adoption Date. Passed by the City Council of the City of Shoreview
the 2nd day of November, 1992.
