Designers and installers should inform home owners of the need to have all
compartments pumped. As-built drawings should also reference this. Homeowners
need to be able to locate all maintenance holes Tor the pumpers.
Designers are required to state the correct Dakota County tank sizing for repfacement
and upgrades.
It is highly recommended that property transfer compliance inspections indicate whether
the septic tank capacity meets the above standard. The buyer would then be informed
of the need for a-dditional septic tank capacity requirements before adding a garbage
disposal, basement sewage ?ift, etc.

Dear. Mr. Holden:
This letter is in follow up to our conversation on May 12, 2003 regarding septic effluent
discharging above grade from your property.
Dakota County Ordinance No. 113, Individual Sewage Treatment Systems, defines
failing systems, in part, as any sewage system that discharges sewage to a seepage pit,
cesspool, drywell, leaching pit, surface water, ground surface, or causes sewage back-up
in to a building. The ordinance also defines an imminent threat to public health or safety
as a situation with the potential to immediately and adversely impact or threaten public
health or safety. Section 213.6 requires an imminent health threat to be repaired or
replaced within 30 days after notification from the municipality. The Citv is repuesting
that vou correct this sewa2e problem on-site bv June 23, 2003.

Dear Ms. Wucherpfennig:
The Dakota County Plat Commission met on December 1, 1997, to consider a proposal by Mr. Holden. Mr.
Holden is considering purchasing the tax forfeit parcel identified as 10-02900-030-05. The parcel is adjacent to
CSAH 30 and is, therefore, subject to the Dakota County Contiguous Plat Ordinance if developed.
The parcel is currently in Tax ForFeit status and scheduled to be sold at public auction. Present right of way
appears to meet the County's right of way guidelines for a 4-lane divided highway. Because of the short
distance between Blackhawk Road and the west on ramp of I-35E, the parcel does not meet the County's
Access Spacing guideline for a right-in/out access. Mr. Holden has no current plans for this parcel, but is
investigating possibilities if he purchases the tax forfeit parcet. The Plat Commission would recommend an
access to this parcel be from Blackhawk Road through Mr. Holden's property. The Plat Commission feels that
another access to CSAH 30 at this location is not desirable and recommends that the County Highway
Department request the parcel be removed from the sale list of tax forfeited properties for at least one year in
order that the County has time to consider if the parcel should remain in public ownership for highway purposes.
No work shall commence in the County right of way until a permit is obtained from the County Highway
Department and no permit will be issued until the plat has been filed. The Plat Commission does not review or
approve actual engineering design of proposed accesses and other improvements made in the right of way.
The permit process reviews the design and may reauire construction of hiphway improvements not discussed
during plat reviews, including, but not limited, to turn lanes, drainage features, etc.

Dear Mr. Hedges:
Pursuant to the decision in this appeals case published in the October 3, 1986
issue of Finance & Commerce, we were able to make contact with Judge
Nierengarten's law clerk in regard to the actual meaning of the decision in
that case.
As indicated to you before, we have successfully appealed the Court's award of
$5,559.10 reducing the City's original assessment of approximatelq $27,043.37.
Judge Nierengarten's clerk has confirmed our interpretation of the decision to
say that the City's levied assessment is reinstated and the trial court
overruled on the basis that the assessmenta do not exceed the benefit to the
property.
A copy of the decision has been served upon Holden's attorney to insure that
any appeal time wi21 begin to run. We would request that the City Clerk
advise us if there is any difficulty with the County in having the aasessment
reinatated ar the stay lifted, as the case may be.

BACKGROUND INFORMATION
While each of the above property owners have submitted individuals appeals/
objections, they are all neighbors affected by the same street and utility
project. Therefore, it would be beneficial to discuss all four property
owners' situations collectively to avoid any repetition.
Project 317 provided for the installation of sanitary sewer, water, storm
sewer and street improvements on Blackhawk Road from Diffley Road to the
northside of I-35E/Blackhawk Road overpass. In order for the State to construct
the 48-foot-wide bridge over I-35E, the City had to commit to a concurrent
construction of Blackhawk Road from I-35E to Cliff Road and also to Diffley
Road. Due to the fact that Blackhawk Road is classified as a municipal
State-aid street, certain design standards had to be complied with. Prior
to permanently improving a street to its ultimate design section, all underground
utilities have to be installed. Subsequently, Project 317 was initiated
and constructed during 1983. These four property owners along Blackhawk
Road are existing residents who did not petition for improvements and expressed
their objections at the time of the public hearing and have followed through
with written objections at the final assessment hearing which was held on
September 18, 1984. Enclosed on pagesL7 through71)_ are copies of the
written ob'ections submitted by these four property owners. Enclosed on
page _7 y is a topographic map referencing these four property owners and
the parcels under their ownership. Enclosed on page?14_ is a breakdown
of the assessments associated with each property showing the frontage and
areas used to determine the final assessments based on the individual rates.
The City Attorney and Public Works Director have had several meetings with
these property owners from the inception of the project at the original
public hearing to most recently on September 24 to review the concerns with
the property owners listed as fallows:
1. The project was not at the request of the property owners but rather
initiated by the City over their objections.
2. The amount of the assessment exceeds the benefit to each of the
parcels affected.
3. The amount of the assessments is excessive as to what each property
owner can afford on a monthly/yearly basis.
During the meetings with property owners, the staff has reviewed how the
costs of the assessments were determined, the method used to calculate the

unit rates and the amount of City participation for the various improvements.
The property owners are requesting further review by the Special Assessment
Committee to see if any special consideration to their unique situation
through the deferment, postponement or reduction of the assessments relating
to this improvement.
The staff has hired Mr. Dan Dwyer as an appraiser to evaluate the increase
in valuation to the property as a result of this project in relationship
to the amount of the assesments. At the time of this packet preparation,
this appraisal report has not been completed. Therefore, it is anticipated
that this information will be made available to the Special Assessment Committee
at their meeting on October'9, 1984.
STAFF RECOMMENDATION
While the staff understands the situation and the concerns of the adjacent
property owners pertaining to the assessments resuiting from this project,
the assessment revenue generated from this project had to be guaranteed
against the sale of the bonds used to finance the construction of this project.
If the appraisal report substantiates an increase in value to the property
equal to or greater than the amount of the assessments, it is staff's recommenda-

Pursuant to the decision in this appeals case published in the October 3, 1986
issue of Finance & Commerce, we were able to make contact with Judge
Nierengarten's law clerk in regard to the actual meaning of the decision in
that case.
As indicated to you before, we have successfully appealed the Court's award of
$5,559.10 reducing the City's original assessment of approximately $27,043.37.
Judge Nierengarten's clerk has confirmed our interpretation of the decision to
say that the City's levied asaessment is reinstated and the trial court
overruled on the basis that the assessmenta do not exceed the benefit to the
property.
A copy of the decision has been served upon Holden's attorney to insure that
any appeal time will begin to run. We would request that the City Clerk
advise us if there is any difficulty with the County in having the assessment
reinstated or the stay lifted, as the case may be.

BACKGROUND INFORMATION
While each of the above property owners have submitted individuals appeals/
objections, they are all neighbors affected by the same street and utility
project. Therefore, it would be beneficial to discuss all four property
owners' situations collectively to avoid any repetition.
Project 317 provided for the installation of sanitary sewer, water, storm
sewer and street improvements on Blackhawk Road from Diffley Road to the
northside of I-35E/Blackhawk Road overpass. In order for the State to construct
the 48-foot-wide bridge over I-35E, the City had to commit to a concurrent
construction of Blackhawk Road from I-35E to Cliff Road and also to Diffley
Road. Due to the fact that Blackhawk Road is classified as a municipal
State-aid street, certain design standards had to be complied with. Prior
to permanently improving a street to its ultimate design section, all underground
utilities have to be installed. Subsequently, Project 317 was initiated
and constructed during 1983. These four property owners along Blackhawk
Road are existing residents who did not petition for improvements and expressed
their objections at the time of the public hearing and have followed through
with written objections at the final assessment hearing which was held on
September 1$, 1984. Enclosed on pages67_through% 1)_ are copies of the
written ob'ections submitted by these four property owners. Enclosed on
page is a topographic map referencing these four property owners and
the parcels under their ownership. Enclosed on page14, is a breakdown
of the assessments associated with each property showing the frontage and
areas used to determine the final assessments based on the individual rates.
The City Attorney and Public Works Director have had several meetings with
these property owners from the inception of the project at the original
public hearing to most recently on September 24 to review the concerns with
the property owners listed as foilows:
1. The project was not at the request of the property owners but rather
initiated by the City over their objectians.
2. The amount of the assessment exceeds the benefit to each of the
parcels affected.
3. The amount of the assessments is excessive as to what each property
owner can afford on a monthlyjyearly basis.
During the meetings with property owners, the staff has reviewed how the
costs of the assessments were determined, the method used to calculate the

unit rates and the amount of City participation for the various improvements.
The property owners are requesting further review by the Special Assessment
Committee to see if any special consideration to their unique situation
through the deferment, postponement or reduction of the assessments relating
to this improvement.
The staff has hired Mr. Dan Dwyer as an appraiser to evaluate the increase
in valuation to the property as a result of this project in relationship
to the amount of the assesments. At the time of this packet preparation,
this appraisal report has not been completed. Therefore, it is anticipated
that this information will be made available to the Special Assessment CommiCtee
at their meeting on October'9, 1984.
STAFF RECOMMENDATION
While the staff understands the situation and the concerns of the adjacent
property owners pertaining to the assessments resulting from this project,
the assessment revenue generated from this project had to be guaranteed
against the sale of the bonds used to finance the construction of this project.
If the appraisal report substantiates an increase in value to the property
equal to or greater than the amount of the assessments, it is staff's recommenda-
tion that the assessments be reaffirmed, adopted and certified to the County
as presented at the final assessment hearing on September 18, 1984.

BACKGROUND INFORMATION
While each of the above property owners have submitted individuals appeals/
objections, they are all neighbors affected by the same street and utility
project. Therefore, it would be beneficial to discuss all four property
owners' situations collectively to avoid any repetition.
Project 317 provided for the installation of sanitary sewer, water, storm
sewer and street improvements on Blackhawk Road from Diffley Road to the
northside of I-35E/Blackhawk Road overpass. In order for the State to construct
the 48-foot-wide bridge over I-35E, the City had to commit to a concurrent
construction of Blackhawk Road from I-35E to Cliff Road and also to Diffley
Road. Due to the fact that Blackhawk Road is classified as a municipal
State-aid street, certain design standards had to be complied with. Prior
to permanently improving a street to its ultimate design section, all underground
utilities have to be installed. Subsequently, Project 317 was initiated
and constructed during 1983. These four property owners along Blackhawk
Road are existing residents who did not petition for improvements and expressed
their objections at the time of the public hearing and have followed through
with written objections at the final assessment hearing which was held on
September 18, 1984. Enclosed on pages67 through7[) are copies of the
written ob'ections submitted by these four property owners. Enclosed on
page is a topographic map referencing these four property owners and
the parcels under their ownership. Enclosed on page'14- is a breakdown
of the assessments associated with each property showing the frontage and
areas used to determine the final assessments based on the individual rates.
The City Attorney and Public Works Director have had several meetings with
these property owners from the inception of the project at the original
public hearing to most recently on September 24 to review the concerns with
the property owners listed as follows:
1. The project was not at the request of the property owners but rather
initiated by the City over their objections.
2. The amount of the assessment exceeds the benefit to each of the
parcels affected.
3. The amount of the assessments is excessive as to what each property
owner can afford on a monthly/yearly basis.
During the meetings with property owners, the staff has reviewed how the
costs of the assessments were determined, the method used to calculate the

unit rates and the amount of City participation for the various improvements.
The property owners are requesting further review by the Special Assessment
Committee to see if any special consideration to their unique situation
through the deferment, postponement or reduction of the assessments relating
to this improvement.
The staff has hired Mr. Dan Dwyer as an appraiser to evaluate the increase
in valuation to the property as a result of this project in relationship
to the amount of the assesments. At the time of this packet preparation,
this appraisal report has not been completed. Therefore, iC is anticipated
that this information will be made available to the Special Assessment Committee
at their meeting on October'9, 1984.
STAFF RECOMMENDATION
While the staff understands the situation and the concerns of the adjacent
property owners pertaining to the assessments resulting from this project,
the assessment revenue generated from this project had to be guaranteed
against the sale of the bonds used to finance the construction of this project.
If the appraisal report substantiates an increase in value to the property
equal to or greater than the amount of the assessments, it is staff's recommenda-
tion that the assessments be reaffirmed, adopted and certified to the County
as presented at the final assessment hearing on September 18, 1984.

THIS AGREEMENT dated this day of February, 1985, between CITY OF
EAGAN ("City") and DAROLD L. HOLDEN and MAUIS I. HOLDEN, husband and wife
("Owner) of 4232 Blackhawk Road, Eagan, Minnesota;
WHEREAS, the City proposes to assess the following described premises in
Dakota County, Minnesota, owned solely by Owner:
Part of the NW 1/4 of the NE 1/4 commencing at the NW corner, thence
E 244.7' to center line of Blackhawk Road, thence S 5 degrees E on
center line 209' to point of beginning; thence E 2421, thence S 5
degrees E 57.3', thence E 807.37' to 1/4 1/4, thence S 1961, thence W
4631, thence right 2 degrees 30" 185.41, thence right 10 degrees
214', thence left lU degrees 30" to center line of Blackhawk Road,
thence NE on center line to beginning, sub;;ect to 100' road easement,
and except Minnesota Department of Transportation Right-of-Way Plat
No. 19-39, all in Section 29, Township 27, Range 23, Dakota County,
Minnesota.

WHEREAS, on February 5, 1985, the Eagan City Council approved the levy of
$25,319.37 in assessments for said improvements against said property, sub;;ect
to the right of Owner and City to agree within 30 days of said date to the
levy of $11,000.00 of said assessments and the postponement of the remainder
until the occurrence of certain conditions; and,
WHEREAS, Owner and City desire to enter into
NOW THEREFORE, upon consideration of the
parties hereto agree as follows;
1. The City shall immediately assess the al
sum of a11,000.00 for the above described
schedule attached hereto as Exhibit A and made a

2. Upon the happening of any of the following conditions the remaining
assessments shall be levied or a connection charge in lieu thereof made in the
manfter specified in paragraph 3:
A. Sale of any portion of the property, except that if after such
sale the property continues to be used as it is currently used, the
remaining assessments shall not be levied at such time of sale. Upan any
sale the City shall review the intended use, and if the intended use does
not change tne current use, the remaining assessments shall not be levied
at that time.
B. The property is split or platted,
C. The property is rezoned.
D. The property is developed.
E. A building permit is issued for a residence on the property.
3. Upon the happening of any of the conditions specified in paragraph 2,
the remaining assessments as described in Exhibit A shall be levied at the
standard City assessment rates in effect at that time.
4. Qwner hereby waives the right to appeal the assessments of $11,000.00
to be levied, and if Owner does appeal such assessments, this agreement shall
be null and void and the assessment of $25,319.37 shall be immediately
certified to Dakota County.
5. The Owner agrees for himself, his heirs, executors, administrators,
successors, and assigns, that if the actual use of said property is changed in
the future to a use or zoning category which is assessable at a higher rate
than the rate for the present use, the City may reassess or levy a
supplemental assessment at such time equal to the difference between the
assessment for the new land use and the assessment for the present land use at
the assessment rates, according to.City policy, in effect at such future time.

6. This agreement shall run with the land and binds the heirs, executors,
successors, administrators and assigns of Owner.
7. The Owner, for himself, his heirs, executors, administrators,
successors and assigns hereby waives notice of any and all hearings necessary
and waives ob;;ection to any technical defects in any proceedings related to
any such future assessments or connection charges and further waives the right
to ob;;ect to or appeal from any such future assessments or connection charges
made pursuant to this agreenent.
8. The undersigned hereby agree that this agreement may be recorded with
the Dakota County Recorder and that the Owner shall execute any and all
documents necessary to iMplement the recording of this agreement, including
the delivery of the Owner's Duplicate Certificate of Title to the affected
lands if necessary.
9. The undersigned includes all of the persons, firms or corporation that
hold an interest in the land described above, including the fee title owners,
contract for deed vendees or vendors or holders of any other interest under
contraet for deed, option or otherwise.
The undersigned have read and understand the above agreement and hereby
bind themselves to it in all respects.

Pursuant to the decision in this appeals case published in the October 3, 1986
issue of Finance & Commerce, we were able to make contact with Judge
Nierengarten's law clerk in regard to the actual meaning of the decision in
that case.
As indicated to you before, we have succesefully appealed the Court's award of
$5,559.10 reducing the City's ariginal assessment of approsimately $27,043.37.
Judge Nierengarten's clerk has confirmed our interpretation of the decision to
say that the City's levied asaesament is reinstated and the trial court
overruled on the basis that the assessments do not exceed the benefit ta the
property.
A copy of the deciaion has been served upon Holden's attorney to insure that
any appeal time will begin to run. We would request that the City Clerk
advise us if there is any difficulty with the County in having the assessment
reinatated or the stay lifted, as the case may be.

In response to your letter of December 13, 1994, I apologize for not answering the specific
question to your satisfaction in my letter of October 28, 1994.
The Holden parcel was assessed at the $25,319.37 rate and not at the $11,000 rate with a defenal
o€ the difference. When Mr. Holden chose not to accept the City's settlement offer and to
exercise his appeal rights, the settlement offer was taken off the table. In the appeal process the
City deals with the outcome as determined through the judicial system and expects appellants to
do likewise. We do not incur the expense of an appeal only to provide the property owner to
after the fact choose what would be his/her most beneficial course of action. When Mr. Holden
did not prevail through the appeal process he no longer had the settlement option available to
him.
W. Holden was assessed at the rate allowed through the appeal process because he chose not to
accept the City's settlement offer. His rate was not different than other parcels because he
exercised his appeal rights.

Thank you for your letter of October 28, 1994.
Mr. Holden's concern is that in 1985 he was presented with
an agreement which provided that if he did not appeal the
$25,319.37 assessment on Parcel 030-05, the initial assessment
would be reduced to $11,000.00, which would be amortized over a
period of years, with the difference of $14,319.37 completely
deferred until the conditions set forth in paragraph 2(A) of the
agreement occurred.
It is Mr. Holden's understanding that because he appealed
the assessment and did not accept the agreement, the entire
$25,319.37 was assessed against his properiy and amorLized over a
period of years. Apparently the nonappealing landowners were
assessed at the lower initial figure of $11,000.00, with the
balance deferred, and were additionally given the area credit and
single family rate credits that Mr. Holden did receive. The only
question is whether the Holden parcel was assessed at the
$25,319.37 rate or the $11,000.00 rate, which apparently he would
have received if he had not exercised his appeal rights.
The Dakota County Auditor's Department has sent me some
history of the tax payments for this parcel; however, it does not
answer the question regarding the initial tax assessment against
the property and whether the nonappealing landowners were given
the deferral program.

Dear Mr. McCullough:
In response to your letter dated October 18, 1994, gleaser: fmd . enciosed a copy of the
proposed assessment agreement covering parcel #1,04)2900-03M offered to the Holdens
by the City of Eagan. Four propeny owners originally objected to the proposed assessment
of Project #317, which provided for the improvements to Blackhawk Road and related
utilities. One of the property owners decided to accept the assessments as levied; the other
two property owners signed the agreements and thereby took advantage of the deferral
section of those agreements. Please see the enclosed City Council minutes of March 5,
1985. I believe the assessments levied against parcel #10-02900-070-05 were not objected
to by the Holdens.
Specifically, regarding the Holden parcels, in prepazation of the final assessment roll parcel
# 10-02900-030-OS was granted a 20% credit to the area, assuming future deveiopment,
thereby allowing for future right-of-way. This parcel, as well as parcel # 10-02900-070-05,
was assessed for storm sewer trunk at a single family rate. An additional connection charge
may be required if the property is rezoned or develops at a higher classification. Both of
these assessment policies can be looked at as deferrals, however, they were applied
consistently to all property in the final assessment roll. I believe the Holden's property was
treated no differently than the property of non-appealing landowners.
To my knowledge, there were no other deferral options presented ta any nan-appealing
landowners. If you have specific information to the contrary, I would be happy to review
it and to respond.

("Owner) of 4232 Blackhawk Road, Eagan, Minnesota;
WHEREAS, the City proposes to assess the following described premises in
Dakota County, Minnesota, owned solely by Owner:
Part of the NW 1/4 of the NE 1/4 commencing at the NW corner, thence
E 244.7' to center line of BZackhawk Road, thenee S 5 degrees E on
eenter line 209' to point of beginning: thence E 2421, thence S 5

WHEREAS, on February 5, 1985, the Eagan City Council approved the levy of
$25,319.37 in assessments for said improvements against said property, sub;;ect
to the right of Owner and City to agree withfn 30 days of said date to the
levy of $11,000.00 of said assessments and the postponement of the remainder
until the occurrence of certain conditions; and,
WHEREAS, Owner and City desire to enter into such an agreement;
NOW THEREFORE, upon consideratfon of the mutual covenants herein, the
partfes hereto agree as follows:
1. The City shall immediately assess the above described property in the
sum of $11,000.00 for the above described improvements pursuant to the
schedule attached hereto as Exhibit A and made a part hereof.

2. Upon the happening of any of the following conditions the remaining
assessments shall be levied or a connection charge in lieu thereof made in the
man6er specified in paragraph 3:
A. Sale of any portion of the property, except that if after such
sale the property continues to be used as it is currently used, the
remaining assessments shall not be levied at such time of sale. Upan any
sale the City shall review the intended use, and if the intended use does
not change the current use, the remaining assessments shall not be levied
at that tine.
B. The property is split or platted.
C. The property is rezoned.
D. The property is developed.
E. A building permit is issued for a residence on the property.
3. Upon the happening of any of the conditions specified in paragraph 2,
the remaining assessments as described in Exhibit A shall be levied at the
standard City assessment rates in effect at that time.
4. Owner hereby waives the right to appeal the assessments of $11,000.00
to be levied, and if Owner does appeal such assessments, this agreement shall
be null and void and the assessment of $25,319.37 shall be immediately
certified to Dakota County.
5. The Owner agrees for himself, his heirs, executors, administrators,
successors, and assigns, that if the actual use of said property is changed in
the future to a use or zoning category which is assessable at a higher rate
than the rate for the present use, the City may reassess ar levy a
supplemental assessment at such time equal to the difference between the
assessment for the new land use and the assessment for the present land nse at
the assessment rates, accordfng to.City policy, in effeet at such future time.

6. This agreement shall run with the land and binds the heirs, executors,
successors, administrators and assigns of Qwner.
7. The Owner, for himself, his heirs, executors, administrators,
successors and assigns hereby waives notice of any and aII hearings necessary
and waives ob;;ection to any technical defects in any proceedings related to
any such future assessments or eonnection charges and further waives the right
to ob;,ect to or appeal from any such future assessments or connection charges
made pursuant to this agreement.
8. The undersigned hereby agree that this agreement may be recorded with
the Dakota County Recorder and that the Owner shall execute any and all
documents necessary to iMplement the reeording of this agreement, ineluding
the delivery of the Owner's Duplicate Certificate of Title to the affected
lands if necessary.
9. The undersigned includes all of the persons, firms or corporation that
hold an interest in the land described above, including the fee title owners,
contract for deed vendees or vendors or holders of any other interest under
contract for deed, option or otherwise.
The undersigned have read and understand the above agreement and hereby
bind themselves to it in all respects.

PEACEFUL HEIGHTS ADDITION - PLANS AND SPECS - CONTRACT #85-2
The next set of plans brought before the Council concerned Peacefui
Heights Addition streets and utility improvements under Contract #85-2 and it
was recommended they be approved. Mr. Colbert explained the revisions to the
plans and Smith moved, Thomas seconded the motion to approve the detailed
plans and specs and to authorize the Clerk to advertise for the bids to be
published in the legal newspaper with bid opening to be held on Friday, March
29, 1985 at 10:30 a.m, at the Eagan Municipal Center. All members voted yes.

BLACRHAWK ROAD - SPECIAL ASSESSMENT DEFERMENTS - PROJECT #317
On February 5, 1985 the continued final assessment hearing for four
property owners along Blackhawk Road was held with final assessments being
adopted with revisions. The City Attorney's office prepared agreements cover-
ing three of the properties including Holden, Kruger and Tscherne. Al1 of the
property owners were present and Tschernes and Krugers indicated they were
willing to sign the Agreement, but Mr. & Mrs. Holden were present and objected
to the amount of the assessment against their property. Tom Colbert explained
the provisions of the agreement and it was noted that as long as the uses do
not change, then the assessment provisions will remain without revision.
Darold Holden requested to have an extension of 60 days in order for him to
contact his attorney regarding the assessments and Councilman Thomas suggested
the Cauncil allow addikional tim,e i.n order to perfect his appeal. Councilman
Smith stated that the Holdens were given an opportunity on February 5 to sub-
mit any appraisal information that they had and they did not do so, although
Mr. Holden, on March 5 submitted a letter from Mark ParranCo regarding the
valuation of the Holden property.
City Attorney Paul Hauge indicated that the 30 day appeal time was juris-
dictional under the Minnesota Statutes, but that the Council could waive any
objection to an extension of time. It was noted, however, that the appeal
time wouid soon expire and that it would be safest for the Holdens to perfect
their appeal if they wish to do so. Councilman Egan stated the attempt was to
assess an average of $11,000.00 per unit, and thus the amount for the amount
of the assessment against the Holden property.
Egan moved, Wachter seconded the motion to approve the Kruger and Tscherne
agreements, subject to execution by the property owners. All members voted
yes. Smith then moved, Egan seconded the motion to extend the period of time
for acceptance of an agreement from Mr. & Mrs. Holden, noting however, the
statutory appeal time is 30 days from the adoption of the assessments on Feb-
ruary 5, 1985, but that the City Council will not object to the affection of
the appeal for an additional 30 days beyond March 5, 1985. All members voted
yes.
BUILDING INSPECTION DEPARTMENT TRUCR
, Tom Hedges indicated that quotes have now been received for 1/2 ton pick-
up tor the Building Inspection Department and noted the low quote was from
Southview Chevrolet in the sum of $8,917.00. Smith moved, Thomas seconded the
motion to approve the low quote and authorize the City to acquire the truck
from Southview Chevrolet. All members voted yes.

the Dakata Caunty Plat #1, streets and utilities and the installation of
sidewalk alang the west side of Rahn Raad from Cliff Road to Rahn Park under
Projects #370 and P367. There was discussion concerning the acquisition of an
easement from A1exa Burow for the sidewalk and Mr. Hauge stated that the
easement has not been acquired at the present time. Smith moved, Wachter
seconded the motion to approve the plaris and speeifications for Contract #83-6
to authorize advertisement of bids, to be opened at 10:30 a.m. on Thursday,
June 16, 1983 at the City Hall; further, ta authorize the city attorney's
office to commence condemnation action to acquire the necessary right-of-way
if negotiations for the acquisition of the easement are not suecessful. A11
voted yea.

concerning the aequisition af easements and it was noted by Paul Hauge, that
of seven easements to be acquired for the road right-of-way, three have now
been acquired and four are still being negotiated. However, the quiek-take
condemnation proceedings have been eommenced. Smith moved, Thomas seconded
the motion to approve the detailed plans arid specifications for Contraet #83-8
and authorize the Clerk to advertise for bids to be opened at the City Ha11 on

The Council diseussed the praposed amendments to Section 6.42 concerning
eontraetor licensing regarding performance bond and insurance for homeowners
who are construeting their own improvements. The draft of proposed ehanges

to continue consideration of the issue but that the staff be directed not to
enforce the band insuranee provisians until the Cauncil acts upon the recom-

BLACKHAWK ROAD - EASEMMS
Tom Colbert and Paul Hauge reviewed with the Couneil the progress to date
concerning approximately 10 easements in the process of acquisition on Black-
hawk Road, between Cliff Road and County Road #30. It was noted that 4 of the
easements have been aequired and negotiations are being continued on the
remaining parcels. Condemnation has been commeneed and the staff was re-
quested to continue negotiations, noting the circumstances involving the
possible effect on the adjoining parcel of property, ineluding the potential
for installing retaining walls, some blacktop driveways, etc.

A letter from the City Attorney dated June 6, 1983 was reviewed con-
cerning a meeting held with the proposed developer of Outlot B, Pilot Knob
Heights 4th Addition, concerning the settlement of the property acquisition by
the City for park purposes. A demand has been made by the property owner and
appraisals have been acquired both by the City and the property owner. Be-
cause of the big disparity in the appraisaZs, the Council determined that
futher cansideration will be given to the acquisitian of-the property, noting
that the Council has taken the position that the property is owned by the
City. No speeifie action was taken and negotiations will continue.

An applieation has been submitted by Unitog Company, a business clothing
manufacturer from Kansas City, Missouri, requesting financing for purposes of
building a new facility in Eagandale Center Industrial Park. The projeet wi11

Mayor Blomquist convened thP public hearing relating to the final
assessment roll for Projecf #493 and Thomas Colbert introduced the assessment
roll and noted that a 5 year spread of assessments at llg interest was
proposed. There were no comments from the public and no objections. WaGhter-
moved, Egan seconded the motion tQ close the public hearing and to approve the
final assessment roll as proposed with a 5 year spread of assessments at 11$
interest. All members voted in favor.
WILLFAMS & LaRUE AQDITIDN - FROJECT #422
Mayor 8lomquist convened the continued hearing regarding Project #422,
Williams & LaRue Addition which had been continued from the [3ovember 20, 1984
meeting. Thamas Colbert recommended that the hearing be continued
indefinitely and renoticed when the Rosemount School District has determined
whether the northwest corner of Wescott Road and Lexington Avenue is a viable
site for a proposed elementary school. 8e mentioned ttiat he should lcnow mare
about the status of this within a week or two. Egan moved, Wachter seconded
the motion to continue the public hearing until Eebruary 19, 1985 at 7:08 p.m.
and to request staff to contact the school district to determine the status.

Mayor Blomquist canvened the public hearing cancerniny the proposed
vacation of public right-of-way of ttie east one-half of West Service Raad,
sauth of Center Court. It was noted that the west half has already been
vacated. No one appeared in opposition to the vacation. Thomas moved, Smith
seconded the motion to clase the public hearing and approve the vacation of
public right-af-way over the east one-half of West Service Road, south of
Center Court, and to authorize the Mayor and City Clerk to execute all related
documents. Al1 voted yes. PROJECT #317 - GONTIAIIfED FINAL ASSESSMENT REAFtINGS
Mayor Blomquist convened the continued final assessment hearings relating
to Blackhawk Road and Project #317. It was noted by Thamas Colbert that at
the original assessment hearing on September 18, 1984, four property owners
had submitted written objections, and that the Council hau continued
consideration of the assessments relating to the those properties nntil a
later date. He stated that the continued public hearings had bEen noticed by
publication and mailing. He stated that the City has had appraisals done
relating to all four properties by appraiser, Daniel Dwyer, that the proposed
assessments are for assessment at current City rates, subject to a maximum
based upon the appraised benefit to the property resulting fram the
improvements.
With regard to the James and Carol Ashworth property, Mr. CaZbert stated
that the amount of the original assessment propose@ on September 18 waa
$18,848.62 and that Daniel Dwyer had determined the benefit to be $11,900.95.
James D. Ashworth appeared and stated that the assessments would be a severe

hardship upon him to pay each month and that as to the remaining matters in
issue, he would rely on the objection previously filed with the City. Member
Egan asked Daniel Dwyer a number of questions concerning his method of
appraisal.. Mr. Dwyer indicated that he assumed that the highest and best use
for the Ashworth groperty was its present nse with a sinyle fa.mily dwelling,
and that while he attributes to the benefits of the improvements to the Iand
only, that he did look at the building on the property and determinea that
there was no benefit to the building. Councilman Smith stated that $11,000.00
for all assessments was not out of line with the size of the lot and the
improvements made and Councilman Wachter mentioned that his assessments were
$13,890.00. Mr. Dwyer stated that assessments for these types of itnprovements
run in the $18,800.08 to $15,000.09 range in other communities in the area.
Councilman Egan stated that the Special Assessment Committee didn't recommer?d
a specific assessment, but did recommend that it be set hy the City Council
according to the amount of benefit determined by the City's appFaiser, or the
property owner's appraiser, whichever the Council determined to be bettPr.
Egan move@, Wachter seconc3ed the motion to approve the proposed assessment of
$11,900.09 based upon the proposed findings prepared by City stafE with the
findings to state also that the assessments will be certified and spread over
15 years at 10 I/2$ interest. All members voted yes.
Robert D. Kruger appeared and stated that he had previously submitted a
letter to the City with regard to his assessments and also mentioned that he
feeZs he has a claim against the City for damages relating to changes to his
driveway resulting ftom the improvements. He stated that he could believe the
value of his property has gone up even $22,000.08 as the City's appraiser had
stated. He stated that he has a well and septic systems on both halves of his
property. Councilman Wachter stated that there is a problem with the
drivecaay, which is nQw much steeper, but that this is a separate issue from
the assessments. Councilman Egan statPd that the Assessmen.t Committee had
recommended ta the City Council that it Iaok at any anpraisals presented to it
and determine the assessment on that basis. Daniel Dwyer stated that the
pfoperty would be worth much more than he determined if it were to tie in with
other propertp, but he assumed that its highest and best use was to have two
single famiZy dwellings on it, one on the north half and one on the south
half. Smith maved, Egan seconded the motian to approve the proposed
assessment in the amount oF $22,600.90 in accotdance with the proposed
Findings prepared by City staff,' with assessments to be certified and spread
aver 15 years at 10 1/2$ interest. All members vated in favor.
Thomas Colbert reviewed the propased assessments for the Tscherne
property, and stated that the original proposed assessment was $27,124.08, and
that pucsuant ta the appraisal of Daniel Dwyer, the assessment would be
$17,508.08. Leslie Tscherne appeared and reviewed a letter to the City by the
Tscherne's attorney, Daniel 8eeson, which stated that the Tscherne property is
unique in that it is-long and natr_ow, has a swamp, would be very difficult to
develop, and has a home in the middle of it, that the Gity's appraiser, Daniel
Dwyer, has admitted that the highest and best use is for single family
dwelling, that Mr. Dwyer's appraisal lacked comgarable sales to substantiate
it, that the compar•ables aIl dealt with raw land for development, that there
were no before and after values on any of the comparable lots, that a State
Supreme Court case had stated that Mr. Dwyer's appraisal technique was not
acceptable. Mrs. Tscherne also stated that they had hired an appraiser who
stated that the benefit ta .the property was $3,099.80.to $8,800,90, and that _
any appraisal must include the land and buildings. Jay Tscherne stated that

the City obtained an easemenL fram the Tschernes based uoon land values of
$28,068.80 ger acre and that the assesstnents would require them to pay $390.90
per month for 15 years. Assis'tant City Attorney Smith indicated that Mr.
Seeson`s interpretation of the Minnesota Supreme Court case was subject to
disagreement, and that it did not necessarily apply to this situation or Mr.
Dwyer's appraisal. Mr. Dwyer stated that he did loak at the building in
ma[cing his appraisal, and that standard appraisal techniques were usea. Smith
moved, Thomas seconcled the motion to approve the assessment in the amount of
$17,500.09 to be sgread over 15 years at 10 1/2$ interest with the
understanding that if the owners and the City enter into an agreement within
30 days of E'ebruary 5, 1985 providing for:
1. The assessment of $11,000.00 naw.
2. The assessment of the remainder to be postponed until the earliest of
the following;
a. Devel.opment of the property.
b. Rezoning of the property.
c. Sale of the progerty.
d. Change of use of the praperty from the carrent use with one single
famiy residentc to any other use.
e. Or, platting of the propert,y or splitting of the lot, except that
if the ].ot is sold to a party who does nat change the use from the
current use wiLh one single family residence, upon review and
determination by the City Council to that effect, the assessment
shall continue to be postponed untiZ orce of the above conditions
is met, then the assessments shall be approved according to such
aqreement with the agreement to run with the land.
AlI members voted in favor.
Thomas Colbert described the assessments with regard to the Darold and
Mavis Holden property and stated that the City's appraisec, Daniel Dwyer had
appraised the benefit as a result af the improvements to be above the initial
proposed assessments of $27,643.37. DaroZd Holden appeared and stated that
the State o€ Minnesota had paid him $29,999.89 per acre for his property in
eandemnation proceedinys with sewer and water in the area, and that his pole
barn on the north portion of his property would have to be removed far the
property to develop as R-3, as it appears in the Comprehensive Guide Plan. He
stated that he accepted less than what the.prQperty wa.s worth, and that there
is no benefit from the sewer and water through much of his property.
Councilmember Egan asked about possible ponding credit and Tam Colbert stated
that this would be allowec3 only if the pond an the back of the Holden property
is necessary for the City's storm sewer system, anr3 if an easement is granted
for ponding purposes. Mayor Blomquist inoved, Egan secandeci the motion to Ievy
the full praposed assessments on the two back ].ots, Parcel 60-95 and 79-85, in
the amount of $711.15 and $1,012.85, and to levy the Eull amount af the
proposed assessments of $25,319.37 against the remaining Parcel 30-03, a1Z to
be spread over 15 years at 10 1/2$ percent interest, an the condition that if
the City and Mr. Holden enter inta an agreement within 39 days of February 5,

MULTI-FAMILY H4USING REVENUE BQNDS
ROYAL OAKS CIRCLE APAR'FMEAIT PROJECT
Mayor Blomquist convened the public hearing relating to the application
for multi-famiZy housing revenue bonds in the amount of $13,365,589.09 for the
Royal Oaks Circle Apartment groject, Thomas Hedges reviewed the proposal in
detail and there was considerable discussian concerning the number of
remaininq units that the City can allocate to low-income housing for the rest
of the decade unaer its goals. It was noted that the City's goal is not
binding and that many of the units approved for low-income housing wil2
probably not be built. Mayor Blomquist stated her concern that the City
should nat let the market dictate to the City Council the number of low-income
units which are approve@ by the City and that a balance of property uses is
necessary. She stated her preFerence that the City stay within its plan and
not "simply approve multi-family housing revenue bands on a first-come first-
served basis. Councilman Egan stated that while balance is important, the
City cannot dictate balance but only give an opportunity for balance and that
if the property has the prop_er zoning, the City shouldn't discourage
development by denying such revenue bonds praposals. An Eagan resident near
the proposed apartments stated his desire ta see the area stay single €amily
and also stated that the proposed apartments were not aesthetically pleasing.
Smith moved, Thomas seconded the motion to close the public hearing and
approve the multi-family housing revenne_bonds in the amount of $13,365,000.90
for the Royal Oaks Circle Apartment project as presented by City staff. All
members voted in favor except Wachter who voted in opposition to the motion.
The Mayar stated that she voted in favor of the bonds because while she
believes that it*is important to stay within the City's goal of low incorae
units that this project is still in keeging with the gaal. -

Mayor Blomqnist convened the public hear.ing concerning the application for

amount actually recommen@ed for approval is $12,560,000.00, which is 88$ of
the appraised value, pursuant to City policp. There were no comments from the
audience. Counci2man Smith stated that he thauqht the plan was a good one and
he moved to close the hearing and approve the multi-family housing revenue
bonds in the amount of $12,568,900,00 for Lemay Lake lst'Addition project as
presented by City stafE. Egan seconded the motion. All members voted yes,
except Wachter who voted in oppositian. Mayor Blomquist stated that she voted

C. Project 317, Approve Agreement for Special Assessment Defer-
ments (Blackhawk Road) -- On February 5, 1985, the continued
final assessment hearing for four property owners alonq Blackhawk
Road was held with the final as5essments being adopted as revised.
One of the conditions of the final adoption of assessmerlts provided
for the deferment of a specific portion subject to the execution
of an agreement by the affected property owners. The City At-
torney's office has prepared those agreements to incorporate
the conditions of the Council and concerns of the property owners.
Enclosed on pages through is a copy of the typical
agreement used as a basis for all affected property owners.
The City Attorney will be available to discuss any specific dif-
ferences as it may apply to each individual property owner.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the agreement
providing for the deferment of certain special assessments associa-
ted with Project 317 (Blackhawk Road - Streets and Utilities)
and authorize the Mayor and City Clerk to execute all related
documents.

and the results of our research:

Unable to locate agreement in City files.
2. Citv Council Minutes Aertainin2 to the previouslv mentioned Riaht-of-Entrv
A2reement or Proiect 317. City Council minutes from 1983 and 1984 were
reviewed. Minutes related to Project 317 are enclosed for your reference.
3. Final Assessment Public HearinZ Minutes of February 5, 1985 where Proiect
317 was discussed. Enclosed.
4. Record of $5 000 check issued to Mr. Holden in 1983. In accordance with
Minnesota Statutes, accounts payable and ciry-praject related inforniation is retained
for 10 years. Thus, records of such a payment were not located.
As you are aware, the requested records are from 1983. Significant resources and staff time
have been used to research the requested City records as they are not readily available. In

The following consent agenda items were recommended for approval:
1. MSA Street Construction Program. The Engineerang Division prepared
a projeeted 5-year expenditure of MSAS funds with annual allotments of
$425,000.00 per year for the 5-year period. The City wculd not be rela to an
antieipated time table for construetion and the Couneil will retain some
flexibility in revising the list. It was recommended that the Council aoprove
the proposed 5-year MSA street construction program.
2. Project 0317 - Blackhawk Road Feasibility Report. In November of
1982, MnDOT awarded a Contract for construction of the interchange of I-35E
with Cliff Road and also construction of the Blacichawk Road hridge aver I-35E.
The Feasibility report for Project #317 consisting of streets and utilities,
south of County Road #30 on Blackhawk Road, has now been completed. It was
understood that the Engineering Department will attempt to move the right-of-
way of Blackhawk Road as far west as possible under Project #317 to minimize
the impact on the existing homes. It was recom mended that the report be
accepted and that a publie hearing be seheduled for Mareh 1, 19$3 at 7:00 p.m.
at the City Hall.
3. Project #354 - Trunk Storm Sewer - Blaekhawk Raad. It was recom-
m ended that the Feasibility Report that has now been prepared for Project #354
eonsisting of trunk storm sewer improvements on I-35E and Blackhawk Road be
accepted and approved by the Couneil and that a public hearing be scheduled
for March l, 1983 at 7:00 p.m, at City Hall.
4. Project #355 - South Blackhawk Road, Surfacing. With the improve-
ments to Blackhawk Road on Projects #317 and #354 and the anticipated designa-
tion of Blackhawk Road as a detour for County Road #30 during construction of
County Road #30 interchange with I-35E during 1984, a Feasibility Report has
naw been prepared and it was recommended that the Report be aecepted covering
Pro ject #355 and that a hearing on the report be scheduled at the Eagan City
Hall on March l, 1983 to begin at 7:00 p.m.
5. Project #367 - South Rahn Raad - Sidewalk. It was recommended that
a sidewalk be constructed along the north side of Cliff Road between Blackhawk
Road and Rahn Road as a part of the I-35E/C1ifF Road interchange. A Feasi-
bility Report has now been prepared by the Consulting Engineer and it was
recom mended that his report be aceepted and approved and that the public
hearing on the report be scheduled befare the City Council at City Hall on
February 15, 1983 commeneing at 7:00 p.m.
6. Project #370 _ Streets and Utilities - Dakota County Plat #1. The
Preliminary Report covering Project #370 regarding feasibility report for
Dakota County P1at #1, streets and utilities has now been completed and it was
recommended that the report be aceepted and approved and the public hearing be
seheduled for Fehruary 15, 19$3 at the Eagan City Hall to begin at 7:00 p.m.
Upon motion by Wachter, seconded Egan, it was resolved that the foregoing
Consent Agenda items be approved and ordered implemented by the City staff.

PROJFGT #342 - CEDAR GROVE STREETS
Mike Forester appeared with a Petition signed by approximately 100
persons requesting the Council resurface the streets in Cedar Grove Addition
under Project #342 and that the Gouneil not take bids on the installatian of
concrete curb and gutter. He stated 17 persons declined to sign and 14 stated
they preferred curb and gutter in his survey. No action was taken.
POBLIC HEARINGS
PROJECTS 1355, #317, and #354
The Mayor convened the public hearings regarding Projects #355, Blackhawk
Road Surfacing south of I-35E, Project #3I7, Blackhawk Road Streets and
Utilities north of proposed I-35E, and Project #354, Blackhawk Road Trunk
Storm Sewer at I-35E. Mr. Colbert and Mr. Rosene explained the pro jects in
detail. It was noted that the MnDOT Park and Ride facility along the west
side of the south end of Blackhawk Road would not be assessed for the street
imgrovements, in that MnDOT has decided that it will not aceept assessments
for the improvements. The improvements would then be required to be paid from
the City's major street fund. A number of affected property owners were
present, some of whom objected to portions of the project. Tom Klein asked if
grading and gravel base had been assessed and asked questions about the
assessments. He was told that the grading and gravel base had been assessed
on the southerly portion of Blackhawk Road and the proposal now is to complete
the improvements ineluding curb, gutter and surfacing. The construetion is
being built to 9-ton capacity because of anticipated heavy traffic. There
were also coneerns about need for traffie signals at Cliff and Blaekhawk Road
and also at County Road #30 and Blaekhawk Road, but no signals are being
planned at Cliff and Blackhawk Road at the present time. There is a sidewalk
plan on the west of Blackhawk to connect with the sidewalk across the I-35E
Bridge. Dave Sellergren, attorney for Cliff Road Properties appeared and
submitted a written statement and also detailed some objections that Cliff
Road Propertieshad to the proposed assessments. He stated that on-site pands
cauld possibly handle the run-off and that the purpose for the storm sewer
construetion is solely for I-35E. He stated Pitt Lake is proposed to be
raised about 4 feet and it may infringe on some of the proposed development
area. He furthPr stated there is no assessment proposed for City park land
within the highline easement and requested that that area also be assessed.
It was noted, however, that this is an area assessment at standard assessment
rates for storm sewer purposes. He also questioned the sizing of the pipe and
suggested that additional comments from Cliff Road Properties be allowed
during the development process. He stated that there is no immediate plan for
development of the Cliff Road site and that much of the proposal is not needed
for that property at the present time. He stated under Praject #317 there was
cancern about the site of the propased easement for sanitary sewer and asked

that the layout be reviewed with the staff. He indicated that it is not
expected that the revenue from the development would justify the amount of
assessments and therePore suggested several methods of relieving the assess-
ment burden on the developer. There were numerous questions fr.om couneil-
members and Couneilman Wachter objected to MnDOT not paying for its share of
the cost alang the south portion of Blaekhawk Road, adjacent to the Park and
Ride site. Egan then moved, Smith seconded the motion to elose the hearing
regarding Pro ject #355, to approve the pro ject, t.o order in the pro jeet and
authorize the preparation of plans and specifications. All voted in favor
except Wachter who abstained. Smith then moved, Thomas seconded the motian to
elose the hearing concerning Project #317, to order in the pro,jeet and autho-
rize the City Engineer to prepare the plans and specifications for the
projeet. All voted yes. Egan then moved, Wachter seeonded the motion to

The next publie hearing canvened by Mayor Blomquist covered Project #330
consisting of streets and storm sewer improvements on Lexington Avenue from
Cliff Road to Diffley Road. It was noted that a Petition had been reeeived
from the developer of the Lexington South PUD for improvement of Lexington
Avenue and the City had entered into agreements with the developer and Dakota
County for the ultimate upgrading of the road. The developer has dedicated
the right-of-way and performed all necessary rough-grading prior to any eon-
struction by the County. It is understood that the County now has funds set
aside for finaneing the improvements during 1983. There were no appearanees
by the developer but a letter from Rod Hardy of Sienna Corporation.requesting
special consideration concerning the length of the assessment spread and the
amount of the assessments,. in light of the fact that the developers dedicated
all necessary right-of-way and performed substantial quantities of rough-
grading, at no cost to the City or County, was revieWed. Mr. Rosene presented
the report and it was noted the project will be a County Road praject. The
City's portion would cover the utility improvements and 45% of the cost of
upgrading the street. There were eoncerns by the Gouncil that the Contraet
not be awarded until the issue with the developer is resolved. There were no
objections to the project. Smith moved, Wachter seeonded the motion to close
the hearing, and to order in the project and authorize the plans and specifi-
cations with the understanding that the Contract will not be awar.ded until an
understanding has been reached coneerning assessments against the adjoining
property. All voted in favor.

City Public Works Director Colbe-rt explained to the Council the problems
that are being encounLered with the acqusition of necessary easements ior the
improvement of Blackhawk Road between I-35E and Diffley Road. He noted thaL
the grade of proposed Blackhawk Road will affect the driveways and lots of
several single family residential property owners and that in light of the
amount oi the assessments being proposed to be levied against several of the
properties, he expects that it will be necessay to com men¢e condemnation of
the acquisition of tne necessary right-of-way. Councilmembers recommended
that the staff and Public Works Committee members Wachter and Thomas meet with
property owners on Blackhawk Road on Tuesday, April 26, 1983 at 6:30 p.m. at
the police building to discuss various alternatives for the alignment of
Blackhawk Road. Upon motion by Egan, seconded Smith, iti was resolved that the
City Council be on record recommending further negotiations with the property
owners for the acquisition of the righ'u-of-way and in the event that it
becomes necessary to do so, that the staff be directed and authorized to
commence necessary condemnation for the aequisition of the right-of-way for
Blackhawk Road and further, that the stafi be authorized to acquire an
appraiser for the road right-of-way acquisition. A11 members voted yes.
