We will require a clear working area. This clear size is to be an area within an eight (8) foot perimeter of the opening inside the building, and 30' perimeter outside the building, to allow for the use of scissors lifts or forklifts as needed. Removal of equipment and materials, snow removal, etc., for access around the work area is by others. Fabcon will not start any work if adequate access is not provided. 2. This proposal does not include any protection of existing conditions. Fabcon is not responsible for any adjacent landscaping. Fabcon will not be responsible for existing utilities. 3. This agreement assumes adequate site access. 4. All temporary enclosures required to protect surroundings are by others. Note that water will be used in the saw cutting operation. Water control by others will be needed within eight (8) feet of the perimeter of the opening or as instructed by Fabcon, Inc. 5. No finish painting or washing is included. 6. Benchmarks are to be provided by the owner or General Contractor. 7. Fabcon is a union contractor operating under an International Agreement with the Bricklayers and Laborers unions. The general contractor would be responsible for any costs and/or delays caused by jurisdictional and/or union action. 8. This proposal is based upon a visual inspection or verbal information supplied by the customer. Should concealed conditions be uncovered in the course of performing the work, we will proceed on a time and material basis after written authorization. 1 9314 General Terms and Conditions 1. Engineering design and layout is based solely on the drawings or information provided by the customer. Fabcon assumes no liability for additional work that may have been performed on the building that is not documented on the drawings. The design assumes that there are no pre-existing structural defects and the existing construction iss adequate to support all design loads per applicable building code. If field conditions vary from those shown on the attached drawing, the engineering study is invalid. 2. Fabcon covenants that its services are performed in accordance with the customary standards of the consulting engineering profession. No other warranty or representation, either expressed or implied, is included in its proposal, contracts, or reports. The sole liability of Fabcon arising out of or in connection with this agreement shall be limited to Fabcon correcting any work performed by Fabcon, which fails to meet the standard of performance, provided such failure is reported to Fabcon within thirty (30) days of its discovery or occurrence, whichever is later, or the amount the customer has paid for design, whichever is less. The foregoing remedy shall be the customer's sole remedy under this agreement, and the customer releases Fabcon for all other liability, including direct, indirect, incidental, or consequential (including loss of profits) incurred by the customer or any third party which are by or are in any way related to the performance of services under this agreement or by the use of reports or other work products, of this agreement. Fabcon will not be held responsible for other than gross negligence in the preparation of the design. 3. Fabcon will not provide signed or stamped drawings by a registered engineer for any type of work thatis performed on this building. 4. We have not included the cost of a performance labor and material bond. 5. All work is to be performed during regular working hours. 6.
