Could one of you please verify if this lot drains to Bald Lake? It is within the 1000' distance,so subject to the 25% max
impervious with Shoreland zoning. But if it doesn't drain to the lake,then it could be exempt.
The lot is only 8,513 sf,and currently exceeds the 25% max impervious. The homeowner has made application for a
Zoning Permit to replace the driveway and sidewalk, and expand both. I advised them of the 25%max,and they
abandoned the driveway expansion, but would still like to fill in a small landscaped area adjacent to the existing sidewalk

(�100 sf)to make a small front patio. They offered permeable pavers, but where the 25%ix exceeded,we cannot
administratively approve such measures without a CUP. And the CUP process seems to be overkill for such a small
improvement, so I told them I would double check.

A request to exceed impervious coverage limits is by Conditional Use Permit (CUP), not Variance. The CUP process takes
about 60 days, and must go through a public hearing with the Advisory Planning Commission,then City Council. The
application fee is$350, with an escrow deposit of$500. The submittal of an application gets the request heard,there is
no guarantee of approval. In the handful of cases where we have processed a similar request,the applicant has been
required to implement some mitigating measures (such as a rain garden)to capture the added runoff from the excess
impervious.
I'd be happy to discuss the CUP with your further. Please share this info with the homeowner first and see if it is
something they want to pursue given the additional cost and time involved.

We are in receipt of your zoning permit application for a driveway and sidewalk replacement and expansion. The zoning
permit seeks to expand the driveway width by 8', and to pave a landscaped area between the sidewalk and house. This
property is located within the Shoreland Overlay District of Bald Lake (within 100'of the lake) and therefore, is subject
to a maximum of 25% impervious coverage. Impervious coverage includes not c�nly buildings, but also driveways,
sidewalks, patios, sport courts and the like. � ��v ��
Our records indicate the existing impervious coverage on this lot currently exceeds the 25% maximum,therefore,we are
unable to approved expansion of these hard surfaced areas. For this reason,your Zoning Permit application is
denied. The existing driveway and sidewalk may be replaced in their current configuration without the expansion
areas. Please discuss the matter with the homeowner.
For further information, my evaluation was based on data in the County records,which indicate a lot area of 8,513
sf. Thus, 2,128 sf of impervious coverage is allowed. The existing house/garage cover 1,758 sf, or 20.6%. I estimated
the existing driveway(approx. 18'x 30') and sidewalk(approx.. 5' wide x 23' long) based on the site survey and aerial
photography. This adds approx. 655 sf, bringing the total existing impervious coverage to approximately 2,413 sf,or
28%. Since the existing impervious coverage exceeds 25%,the existing paved areas cannot be expanded.
