Adjourn IL LEROY CHAPDELAINE-REVIEW DEVELOPMENT REQUIREMENT FOR STORM SEWER ISSUE Mr.'s Martin DesLauriers and Don Chapdelaine have met with the Public Works Director and City Administrator to discuss past,present and future storm sewer improvements and related assessments associated with the property formerly owned by LeRoy and Joseph Chapdelaine. These parcels are all located in the west half of Section 12 and are identified as Parcels 010-30, 010-52, and 020-52. Mr.DesLauriers and Mr. Chapdelaine have requested the City to review the trunk area storm sewer assessments levied under Project 381 on August 7, 1984 and the potential assessments for improvements necessary for development as previously identified under Project 591 which was approved by the City Council on May 17, 1990 and subsequently canceled on January 15, 1991. Their questions are summarized as follows: 1. Why were these parcels assessed under Project 381? 2. Why would these parcels be responsible for any future storm sewer related improvements as once proposed under Project 591? BACKGROUND Project 381 incorporated approximately 72 parcels(700 acres-Exhibit A)for the trunk storm sewer outlet from the Borchert-Ingersoll Pond (EP-1) which is the central receiving body for Drainage District E (approximately 1,900 acres) as shown on Exhibit B. The parcels were assessed the following amounts under Project 381. 010-30 $7,552. 010-52 711. (original $2,548) * 020-52 711. * *Reduced for residential large lot credit Project 591 was initiated as a requirement of the final plat of the Tranby 1st Addition which is adjacent to and west of these referenced parcels. This project provided for the creation of water quality and storm Pond EP-4A(Exhibits C&D)which was designed to serve Subdrainage District E-10(Exhibit E)in lieu of constructing a large diameter over-depth storm sewer from these parcels under the railroad track to Ponds EP-1 and 2 to the west. It was determined more economical under Project 591 to construct Pond EP-4A and its outlet northwesterly along the railroad right-of-way to existing Pond EP-4 (Exhibit F). Project 591 also proposed a sanitary sewer extension to facilitate future development(Figure G). The local storm sewer lateral outlet from Pond EP-4A was proposed to be assessed on an area basis as shown by Exhibit H. The cost for constructing the storm water quality and storage pond EP-4A was also proposed to be spread on an area basis(Exhibit I), all of which incorporates the parcels in question. The proposed assessments under Project 591 are summarized as follows: Parcel Lateral P n Total 010-30 $5,500.00 $4,250.00 $9,750.00 010-52 2,050.00 1,600.00 3,650.00 020-52 2,400.00 1,850.00 4,250.00 On January 15, 1991, the City Council formally canceled these public improvements subject to the execution of a recordable agreement for the Tranby 1st Addition which prohibits any construction or development of the property without these improvements being reauthorized by Council action. All pending assessments against the Chapdelaine parcels were also removed but a notation remains in the file to inform any future perspective developers of the need for these improvements. Due to the length of time that has elapsed, a new cost analysis would have to be performed for a specific development proposal to ensure compatibility and adequacy. DON KLEIN-REVIEW SANITARY SEWER AVAILABILITY OPTIONS Don and Sandy Klein reside at 4070 Dodd Road(Parcel 010-53, SW Qtr. 24). This is an unplatted large lot agricultural zoned single-family dwelling. The trunk sanitary sewer outlet for the Country Hollow and Coventry Pass developments located to the east was constructed adjacent to and across the most northerly point of this parcel (Exhibit A). Subsequent sanitary sewer lateral extensions along the west side of Dodd Road serve the Hills of Stonebridge subdivisions. Subsequently, there is approximately 25 acres located north of Diffley and east of Dodd that remain unplatted and without direct sanitary sewer service. Mr. and Mrs. Klein have been experiencing problems with their current septic system and have inquired about the feasibility of hooking to City sanitary sewer. In reviewing this request during the Fall of 1994, several options were evaluated and estimated. Sewer connection charges for 1995 were calculated at$5,600 based on the current single-family use. If the property were to further subdivide, and additional$5,400 of trunk area sanitary sewer assessment would be due and payable. In addition to this connection charge, it was estimated that it would cost approximately $20,000 to bring the sewer lateral to the east side of Dodd Road. Adding this to the actual plumber's cost to install a service line and convert their existing septic system creates a financial situation that the Kleins would like the City to review. If sanitary sewer were to be installed across Dodd Road and southerly along the east right-of-way to serve the remaining unsewered parcels, the crossing could/should be shared by all who would be serviced by this line. The topography(Exhibit B)of the unsewered area would allow this sewer to be extended southerly in incremental segments once the Dodd Road crossing had been completed. An alternative for the Kleins is to extend a long sewer service from Witham Lane at the northern end of their property or across Dodd Road to the existing sewer lateral. Under this option, extension of sanitary sewer to serve the remaining southerly properties would not be able to depend on the Klein parcel for financial participation. The Public Works Committee should provide direction as to whether the City should initiate the extension of sanitary sewer to serve the remaining unsewered parcels east of Dodd Road or whether the Kleins should proceed with a direct sewer service connection to the existing system wherever deemed most beneficial and economical by them. In attendance were Committee Chair Councilmember Ted Wachter, Councilmember Shawn Hunter, City Administrator Tom Hedges, Public Works Director Tom Colbert, and Assistant City Engineer Mike Foertsch. LEROY CHAPDELAINE-REVIEW DEVELOPMENT REQUIREMENT FOR STORM SEWER The LeRoy Chapdelaine property was represented by Mr. Don Chapdelaine and Mr. Martin DesLauriers. Mr.DesLaurier informed the Committee that a potential buyer for the property backed out of the acquisition after learning from the City that there would be storm sewer ponding and a lateral drainage system required to accommodate the development. Mr. DesLaurier then indicated that he researched City files to determine the extent of this new storm sewer requirement in relationship to previous storm sewer assessments. His first question related to the rationale for the property being assessed under Project 381 in 1984. Tom Colbert explained the details associated with that project, the assessable area and the assessments against the Chapdelaine property in question. Don Chapdelaine indicated he understood the explanation and then wanted to proceed with additional questions. Mr. DesLaurier then questioned the amount of the assessment in relationship to the project cost. Councilmember Hunter responded with an explanation regarding the uniformity of the City's Assessment Policy and its history. Tom Colbert added additional information explaining the difference between the trunk storm sewer system assessed under Project 381 and the lateral storm sewer system required with future development. Mr. DesLaurier then questioned why the Chapdelaine assessment wasn't reduced similar to the Borchert-Ingersoll and Gopher Smelting property. A general discussion followed regarding the special assessment appeal process associated with public improvements and the rationale of fairness and equity of applying a uniform rate to all similar classifications of property on a City-wide basis-in lieu of adjusting rates specifically for individual drainage basins. Councilmember Hunter then requested the City Attorney to review the City's method of applying a uniform rate on a project-by-project basis and to comment on its appropriateness and legality. Don Chapdelaine then submitted a proposal for the Committee's consideration of calculating what the assessment rate would be based on the construction costs for Project 381 and compare it to the assessment amount levied and credit the difference towards any future storm sewer lateral and ponding costs that may be required with future development. The Committee indicated it would take it under consideration and let Mr. Chapdelaine know of their position. t DON KLEIN- REVIEW SANITARY SEWER AVAILABILITY OPTIONS Mr.Klein was present and explained the current condition of his onsite septic system and the history of problems he has had requiring him to hook up to the City's sewer system as soon as possible. Tom Colbert then reviewed the design options and cost estimates associated with extending lateral sanitary sewer to Mr. Klein's property and its possible extension southerly along the east side of Dodd Road to ultimately service the remaining large lot undeveloped agricultural properties in the immediate area. Mr.Klein indicated that after reviewing the costs associated with bringing sanitary sewer across Dodd Road and his potential assessment, he felt the quickest and most economical method would be to extend a long private sanitary sewer service from Witham Lane. Councilmember Wachter questioned whether this would allow the future subdivision of Mr. Klein's property to maximize development potential. Tom Colbert recommended that Mr. Klein provide a layout of his property identifying potential future lots so that Mr.Klein could locate his sewer service along a common lot line allowing maximum flexibility for future development options. Mr. Wachter then summarized the discussion indicating that Mr. Klein's proposed sewer service extension from Witham Lane was most practical but also expressed concern regarding providing sanitary sewer service to the remaining undeveloped properties to the south in a scheduled and timely manner.
