4037 Deerwood Tr - Drainage Issues Ltr . 1 0 l March 13,2015 Mike Maguire Michael&Pamala Nass Mayor 4037 Deerwood Trail Eagan,MN. 55122 Paul Bakken Cyndee Fields Gary Hansen RE: Drainage issues Meg Tilley Council Members Dear Michael&Pamala, ave osberg Ms. Nass requested a follow-up letter be written regarding what we discussed at your home on City Administrator Mondax March 9`. In 2007,when you contacted the City regarding drainage issues,I visited your property and was told by Ms. Nass that the issue was the additional water coming from your neighbor's home (4041Deerwood Trail) flowing through your back yard, and the possibility that it would start to enter your home at the walk oud patio area. Ms.Nass informed me Monday that water may now be entering your garage through the block wall near the top of the hill. There is a flat area holding Municipal Center water near your garage, just west of your driveway bump out area that may be draining toward your 3830 Pilot Knob Road g'age. Water is evident in your garage and ponding in the landscape/rock area right against the ', garage:During our meeting,Ms.Nass was adamant that the only issue is the water coming from the ' Eagan, MN 55122-1810 roof drains at 4041 Deerwood Trail, and that if that water was removed, there would not be a I, 651.675.5000 phone problen in your garage. 'I 651.675.5012 fax 651.454.8535 TDD Although the downspout from 4041 Deerwood Trail contributes water to the area, the fact that the area doesn't drain properly(away from your garage) is just as much the cause of the water problem as the added water to the site. Getting the water to run away from you garagelhome is critical to Maintenance Facility keeping things dry. 3501 Coachman Point I suggested this option, and it was not accepted very well by Ms.Nass. She instead focused on the Eagan, MN 55122 idea that the City approved something next door(4041)that doesn't work. While the drainage may 651.675.5300 phone not currently work properly, the City did not approve inadequate drainage at the time of the original 651.675.5360 fax or sub5equent building permits. Builders and grading contractors are notorious for "wasting" 651.454.8535 TDD material on site so the} do not have to pay to haul it away. This may be the case in this situation and the City does not take responsibility for what contractors do after the permit approvals/inspections are made. www.cityoteagan.com I reviewed the certificates of survey far both properties I also looked over the letter written by the City to your neighbor and copied to you (May 2007). The letter stated that the addition to the 4041property(1990}may have stightly altered the drainage pattern of that tot to accommodate the addition. The drainage was altered, but perhaps to your benefit. Their original 4041 property survey (attached) showed the water from the middle of their backyard splitting, with half going north and half going around the house toward your home and exiting toward the street. If that The Lone Oak Tree currentl drainage pattern were still in ptace, you may have more water coming from the 4041 back The symbol of strength and growth ' in our community. . . 1 0 Il yard into this area than you currently do with their downspout directing it there. They essentially Mike Maguire cut off half of their back yard and half of their side yard draining that direction. Mayor Also, the lot survey and aerial photos of your properiy (4037) show that you have added a portion Paul Bakken of driveway pavement in the drainage & utility easement constructed after the original building permit approval (attached). The original approved permit shows the proposed driveway to be Cyndee Fieds installed on a straight line from the street to the corner of your garage, with nothing south of the Gary Hansen garage area. 'This could be contributing to the flat area created near your garage due to fill placed to Meg Tilley level off the driveway surface. It also could be affecting the drainage of that area since the added Counci Members driveway area is located within the easement which is meant to handle the water draining from both properties. Dave Osberg City Administrator I have discussed the situation with the City Engineer, and while we are sympathetic to your situation,we feel that this is a civil matter and not something warranting further City involvement. We are available for reference and to offer suggestions, but in these types of situations, the two parties involved need to come to an agreement and work together on a solution.
