�ave osberg Ms. Nass requested a follow-up letter be written regarding what we discussed at your home on
City Administrator Mondax March 9�`.
In 2007,when you contacted the City regarding drainage issues,I visited your property and was told
by Ms. Nass that the issue was the additional water coming from your neighbor's home
(4041Deerwood Trail) flowing through your back yard, and the possibility that it would start to
enter your home at the walk oud patio area. Ms.Nass informed me Monday that water may now be
entering your garage through the block wall near the top of the hill. There is a flat area holding
Municipal Center water near your garage,just west of your driveway bump out area that may be draining toward your

area doesn't drain properly(away from your garage) is just as much the cause of the water problem
as the added water to the site. Getting the water to run away from you garagelhome is critical to

and the City does not take responsibility for what contractors do after the permit
approvals/inspections are made.

City to your neighbor and copied to you (May 2007). The letter stated that the addition to the
4041property(1990}may have stightly altered the drainage pattern of that tot to accommodate the
addition. The drainage was altered, but perhaps to your benefit. Their original 4041 property
survey (attached) showed the water from the middle of their backyard splitting, with half going
north and half going around the house toward your home and exiting toward the street. If that

Also, the lot survey and aerial photos of your properiy (4037) show that you have added a portion

permit approval (attached). The original approved permit shows the proposed driveway to be

Counci� Members driveway area is located within the easement which is meant to handle the water draining from both
properties.

City Administrator I have discussed the situation with the City Engineer, and while we are sympathetic to your
situation,we feel that this is a civil matter and not something warranting further City involvement.
We are available for reference and to offer suggestions, but in these types of situations, the two
parties involved need to come to an agreement and work together on a solution.
