Public Works Department -- ITEM #1: Excavation Permit Request - Pilot Knob .Properties (Walden Heights Subdivision) -- The City has received an application to initiate the related grading associated with the. proposed Walden Heights Subdivision. The preliminary plat for Walden Heights was approved by the City Council on March 18, 1980. The grading and drainage plan has not yet been submitted or reviewed by the Public Works Department, but a recommendation will be available by the Consulting Engineer at the meeting on- Tuesday. The Consulting Engineer will be present and review the excavating permit. Action to be considered on the matter: To either approve or deny the excavation permit as submitted by Pilot Knob Properties, ITEM #2 -- Seneca Disposal Project - City Approval -- --The, City has received a request by the Metropolitan Waste Control '" Commission to review plans and specifications relating t the transfer of approximatly 20,000 cubic' yards of a material from settling basins located at the - Seneca Wa t Water Treatment Plant. The plans and specifications ha been reviewed by the Public Works Department and are found to be acceptable with the condition that appropriate erosion, control - measures be inacted to protect the existing drainage ',through Cedar''�� way of the Cities storm sewer system the "-t0 Industrial Park. ACTION TO BE CONSIDERED ON THIS MATTER: To approve or deny the request by the MWCC to approve plans and - specifi- cations relating to the transfer of approximatly 20,000 cubic yards of ash material from the settling basins. ITEM #3: - Improvement 79 -16 Alexandria Road Street Construe -. o =- -N—ring the construction of Alexandria Road to provide the new access to the R. L. Johnson Warehouse by Meadowview�,,,, Road, a pocket of bad subsoil was encountered requiring the removal and replacement. After conversations with Mr. Bob Johnson, owner of the property, it was determined that there was not enough excess material on site to provide for the required 8,000 cubic yard replacement. In order to proceed with this project, it will become necessary V to bring in fill material from offsite. A potential barrow site is available immediately adjacent to the R.L. Johnson site. This is the location of the City of Eagan's property upon which is located a storm water detention basin (CT' 8). It is felt that material could be taken from this site (approximately 8,000 cubic yards). Because this property is under fee ownership of the City of Eagan, it will acquire the approval of the City Council to obtain the necessary material., Upon reviewing similar unit prices for this type of granular barrow,. it has been determined by staff that of fair price of 35.0 - C.Y. could be established. This cost would then be charged against Improvement 79 16 with the revenue being credited to the. City's General Fund. This will also have the benefit of enlarging the capacity of our storm water detention basin, in addition to completing this much needed project in a timely manner at a fair 7 price to the developer. This work will require a formal change order however before the City can proceed, Council authorization to sell the excess granular material will be required. The Consulting Engineer will be available at the meeting on Tuesday to explain the proposal. ACTION TO BE TAKEN ON THE MATTER: To either approve or deny the sale of excess granular material owned by the City of Eagan to Improvement Project 79r-16 a Agenda Information Memo July 30, 1980 Page Three ITEM #4 -- Improvement 79 -i3 -Lakeside Estates, Saddlehorn } Addi of n and Dodd Road -Utilities -- During the Public Hearing for this proposed project (241), consideration' was not given to assessing for trunk storm sewer at the time (August 1978). The City Staff has concerns -whether the trunk area storm sewer. assessment should be included at this4r1 6/Z time -due to the fact that all other streets and utilities will be assessed during September. of 1980 This would leave only the trunk .area storm sewer to be assessed at a later date. The staff is concerned. that similar problems to the Thomas Lake Trunk Area Storm Sewer assessment could exist- if. the Public Hearing is delayed. This matter should be informally discussed with the Council with some direction as to whether a Public Hearing should be held at this time, prior to the Final Assessment Hearing, to consider assessing the trunk area storm sewer in conjunction with all other assess - ments. The Consulting Engineer and City Administrator will discuss this matter ' in - further detail. Equipment Quotation -- At the May 20 City. Council meeting, the Council received bids for 1 ton Park Maintenance Vehicle that was provided for in the 1980 budget. Due to the bid quotations exceeding :anticipated purchase amount, the Council directed the staff to revise the specifications an resolicit quotations. Public Works Department has 6, subsequently . remodified the specifications an requested quotations on a cab and chassis only with °subsequent dump box and plow to be purchased at a'later date. The quotations were received and tabulated it is the recommendation of the staff that the bid be awarded to Ridgedale Ford in the amount of $7,750 (net) taking into consideration of $1,200 trade for the existing, Park Maintenance Vehicle. ACTION TO BE CONSIDERED ON THE MATTER: To approve or deny the low bid in the amount of $7,750 to Ridgedale Ford for 1 Ton Park Maintenance. Vehicle. Temporary Extension of Water for Diamond -T Ranch At a regular meeting of the Assessment Committee on July 28, 1977 and meeting of the City Council August._ 2, 1977, temporary water connection. was granted to Jerry Thomas for a period of up to two years to service the Diamond T Ranch. This agreement should have expired last year however has continued in force until the present. As a part- of the agreement approved by the City Council there was language that the agreement can be extended upon approval of the City Council. The reason a temporary water connection was granted due to the I -35 corridor displacing the Diamond T Ranch. The Assessment Committee and City Council felt that since the water connection was only for a 'temporary period of time, there was no reason .to' charge lateral of trunk benefit to the Diamond T Ranch or a connection charge which is normal procedure. Because plans have slowed down for I -35E Mr. Thomas is asking for a continuation for another year. His letter is attached on page (4 for your reference. Assuming the City Council wishes to maintain its policy on this matter to not assess water lateral or trunk benefit. A formal request has been made to the Dakota- County Auditor to grant an extension of the October 10 certification date to October 31, 1980. As of this date the City has not recieved response to that request however it is anticipated that the extension will be granted. Project 307 (St.Francis Woods 2nd Addition Utilities) for F.easibilty Report and Set Public Hearing for 9 -16 -80 /�Ol -- The developer has completed his preliminary platting process for the St. Francis, Woods 2nd Addition. A stipulation of that plat approval was the preparation of a- Feasiblity Report due to the requirement of extension of trunk sanitary sewer lines to serve the proposed subdivision. The 'developer subsequently submitted a written report guaranteeing the cost of the Feasibility Report. -' The report has been completed and is available for Council review. ACTION TO--BE- CONSIDERED.-ON THIS MATTER: To approve or deny the Feasibility Report and assuming approval the Public Hearing would be set for September 16,'1980. IMPROVEMENT-80-25 F. Improvement 80 -25 (Wescott Road Grading) for Approval of Alignment -- On June 17, ,1980 'a Public Hearing was held to consider the improvement of Wescott Road to Denmark Avenue to Lexington Ave. (Project 305). Subsequent to that Public Hearing, the City Council ordered in the improve- ment (Improvement 80 -25) with the stipulation that the final alignment details be reviewed by the Public Works Committee as it pertains to the concerns expressed by Mr. Patick McCarthy over the alignment through his property. On Wednesday, July 9, the City Council, in. addition to the Public Works Committee walked the entire proposed F Agenda Information Memo July 20. 1980 Page Eight alignment of Wescott Road. Staff is requesting that the City Council give approval to the alignment as presented at the Public Hearing June 17, to allow the appropriate easements documents- to be draw up in right -of -way acquisition process initiated. ACTION TO BED CONSIDERED ON THE MATTER: To approve or deny the alignment as presented by the Engineers at the Public Hearing on June 17 for Improvment 80 -25. PROJECT- NO,- 182R.- (T.H. -55 -STORM SEWER) r G. Project no. 182R.- (T.H. Storm Sewer) - Feasibility Report Set Public Hearing for 9/16/80 -- On July 15, 1980, the City Council reviewed the Preliminary Plat application for the Joyce Addition as submitted by the applicant, Reuben C% and Joyce Meissner. During the review of this Preliminary Plat application, the Public Works Department determined that this plat should` not be approved until - a storm sewer outlet had been provided for T.H. 55 area just east or Random Road, due to past and present storm sewer dranage problems. Since then, the City Council ordered- staff to update the previous Feasibility Report that was prepared concerning - this storm sewer outlet. This report has been revised and updated and is being presented to Council for 5 their consideration. ACTION TO BE .CONSIDERED ON THE MATTER: Receive the Feasibility Report for 182R and schedule the Public Hearing to be held on September 16, 1980. IMPROVEMENT- NO. -79 -14 H. Imrpovement No. 79 -14 (Rahn 'Park Tennis Courts) For Final Acceptance -- The new tennis ;,court completion under the above referenced improvement has been completed.. The City has received certification from the Consulting Engineer-(11� _ that it is in comformance with the approved plans and specifi- cations and has been reviewed and approved by City Staff. It is the, recommendation of the Public Works Director that final payment be made to Dailey & Sons Contracting Co. in the amount of $2,861.10 and that the City accept the project as being completed in full. The City has received certification from the Consulting (t� Engineer that the work was completed in conformance with the approval plans and specifications and has been reviewed by the Public Works - Department and -found to be acceptable. Special Use Permit for Granville House .Inc. -- An applica- tion was presented to the City by Granville_ House Inc., for a Special Use - Permit for an extended care facility for chemically dependant adolescents at 720 Blue Gentain Road. The Special Use Permit applied for by Granville House Inc. would convert the Aims Estate to a treatment center for chemically dependant adolescents. As stated in the lust packet -- Granville Inc. is planning to purchase the Aims Estate for $450,000._ The City Planner has notified {s` this office that approximatly 30 occupants would be housed in the Aims Estate. There would be approximatly 8 or 9 staff people. If the Special Permit is approved the City Planner is asking that it be made subject to the following conditions: 1) The site plan be approved providing adequate ,parking for the facility. • 2) The site is in the noise corridors so performance standards should 'be enforced to reduce noise levels within the building. 3) All state' building codes must be met prior to the opening to the facility. 4) The applicant cannot object to proposed City improvement ©u hen they-are for Blue Gentain Road . �proposed As a part of the last packet a copy of the most recent Annual Report for Granville House- Inc. was included. Olson SCOPE: This project includes the construction of sanitary sewer, water and storm sewer trunks and laterals in the Ridgecliffe Addition in Eagan, Minne- sota. FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance with the Master Plans for Sewer, Water and Storm Sewer for the City of Eagan. For bidding purposes it can best be carried out as outlined herein and not as a part of any other project. DISCUSSION: The proposed Ridgecliffe Addition consists of 160 single family and 176 four -plex units located on 150 acres at the southwest quadrant of Johnny Cake Ridge Road and Cliff Road. Utilities to serve lots 1 through 3 of Block 3 and all of Block 4 of the First Addition and all of the Second Addi- tion are being installed by the developer under private contract and will not be constructed as a part of this project. A portion of water trunk will be constructed by the developer at his cost in this private contract. The most northerly and easterly portions of the proposed development will obtain sanitary sewer service through laterals draining to the north. These laterals will connect to a sanitary sewer in place on the south side of Cliff Road at Lenore Lane which was installed with the recently completed Clearview Utilities Project No. 235. 25 2D Page 1. • The remainder of the development will obtain service through laterals draining to a trunk which will be constructed from the western edge of the plat to the trunk sewer under construction to Safari Estates. This trunk will be constructed along the proposed realignment of Galaxie Avenue and across proposed I -35E to the trunk under construction in City Improvement 79 -17. The portion of sewer along Galaxie Avenue will be assessed to benefited property as a lateral. As is in accordance with the Master Plan for Water Main, a 16" diameter water main will be constructed across the proposed plat in an east -west direc- tion, connecting to a stub in place on the west side of Johnny Cake Ridge Road. Laterals connecting to this trunk and to the water trunk in place on the south side of Cliff Road will serve Ridgecliffe. Water pressures in the proposed development will range between 85 psi and • 100 psi. It is recommended that individual pressure reducers be installed in • each unit to reduce the water pressure to the recommended limit of 85 psi static pressure. As is shown on the Master Plan for Storm Sewer, Drainage from Ridgecliffe will run in three directions. The eastern portion of the development will drain through laterals to a storm sewer trunk in place on the west side of Johnny Cake Ridge Road. This trunk drains to the pond shown on the Master. Plan as LP -57. The most northerly portion of the development will drain to the pond shown on the Master Plan as BP -32 which is located within Ridgecliffe. An outlet will be constructed from BP -32 to BP -31 from where the water will drain through a series of ponds in the Woodgate Addition to BP -6. 252D Page 2. 11 t . E • The remainder of the proposed plat will drain to two low areas within Ridgecliffe which will become storm sewer retention ponds. Outlets from these ponds will drain to the pond shown on the Master Plan as AP -14. Pond AP -14 will require an outlet as shown on the Storm Sewer Master Plan. This outlet must be constructed before sufficient excess runoff causes the pond to fill above its normal high water mark. Approximately two thirds of the area within the Ridgecliffe Addition contributes runoff to this pond. Considering the size of Pond AP -14 and the other holding ponds within Ridgecliffe, it is expected that this outlet should be in place by the time that half the lots within the Ridgecliffe addition are built upon. Easements will be required to construct the sanitary sewer trunk from the west edge of Ridgecliffe to the trunk serving Safari Estates. Olson Project 311 Eagan, Minnesota June 26, 1980 SCOPE: This project includes the upgrading of Galaxie Avenue from the Apple Valley Boundary north for approximately 3,4001. FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance with the Major Street Plan for the City of Eagan. It can best be carried out as outlined herein and not as apart of any other project. DISCUSSION: The Major Street Plan for the City of Eagan designates Galaxie • Avenue from Cliff Road to the Apple Valley boundary as a collector street. As such it will be constructed with a 44' wide bituminous driving surface, B618 concrete curb and gutter and a 9 ton carrying capability. A concrete sidewalk will be constructed along one side of the street in its final stage. Phase One of this portion of Galaxie Avenue will consist of the grading, gravel base and storm sewer portions of the project. It is suggested that Phase One be completed during the 1980 construction season as this part of the road surface is currently being disrupted and it would be cost effective to replace the driving surfee to its ultimate grade at this time rather than to duplicate this cost in the future. Galaxie Avenue from the northern terminus of this project to Cliff Road will be constructed by the Minnesota Department of Transportation as a part of T.H. 35E construction. It is suggested that the final construction of this • project be timed to correspond with Mn /DOT construction which is currently Page 1. 245D A9 ' I • scheduled for the 1982 construction season. These projects will be the sub - ject of a future report. Storm sewer drainage is included in this report which will drain the nor- therly portion of this project to the pond shown on the Master Plan as AP -15. Galaxie Avenue is designated as a State Aid Street and is eligible for Minnesota Gas Tax (MSA) funding. It is suggested that MSA funding be used for this project. It is expected that a full residential equivalent be assessed all abut- ting property at this time to avoid assessments against platted lots in the future. A full residential equivalent includes a of the total grading, crushed rock or gravel base, concrete curb & gutter and bituminous surfacing for a 32' wide, 5 ton road. The residential equivalent charge for that portion of Safari Estates that fronts on Galaxie Avenue is expected to be • spread among all lots in the addition and not entirely against those lots which actually abut the street. COMMENTS: The current zoning map shows the subject parcel zoned FP (Flood Plain Dis- trict). The zoning map has everything on the north and west side of the Chicago, St.Paul, Minneapolis and Omaha Railroad listed as the Flood Plain District. The zoning map is based on physical barrier rather than a con- tour elevation. The U.S. Geological survey bases the flood plain on a contour elevation. This contour elevation is 717 of which most of the par- cel is above the 717 elevation. The dark dash line on the preliminary plat indicates the 717 elevation. The applicant has worked with the Corp of Engineers and the Department of Natural Resources in putting together the preliminary plat. Both the-Corp of Engineers and the Department of Natural Resources have indicated that they would grant permits for grading for the proposed office /warehouse complex. ;The applicant has submitted a site plan for the subject parcel to show the feasibility of an office /warehouse. The developer has indicated however that • he is not proposing to build this facility at this time but would give him the option if the zoning and plat has been approved to sell the parcel for a Light Industrial use of which the office /warehouse is a permitted use. .50 %"n-. I CITY OF EAGAN R:�LPH LINVILL/L & F ADDITION JUNE 18, 1980 PAGE TWO • SITE PLAN REVIEW: The proposed site is located in the triangular area between old Trunk Highway No.36 and the new Trunk Highway No.36. On the southeast portion of the plan is the Metropolitan Sewer Board sanitary sewer easement. The proposed warehouse would have a finished floor elevation of 722.5 which would be 5.5 feet above the U.S. Geological Surveys indicated flood plain of 717. The proposed building would contain 48,000 square feet of 17.2% lot coverage. Of that 48,000 square feet, office would consist of 4,800 square feet or 10 %.. According to the parking calculations, the building would require 94 parking spaces. The applicant's proposing 96 spaces. The building meets all setback requirements and the parking stalls are all 10 by 19 feet. IF APPROVED, the plat should be subject to the following conditions: 1. If this plan is not followed, then a detailed site plan shall be approved prior to the issuance of a building permit. 2. Parking area shall be surfaced and concrete curbing shall be provided around the perimeter of the parking lot. 3. Buffering or screening should be provided along the west side of the truck docks. 4. Any outside storage or other use than office /warehouse shall be approved by the City through conditional use permit. 5. Detailed grading, drainage and erosion control plans shall be submitted and approved by City Staff prior to the submission of the final plat. 6. All easements shall be dedicated as requested by the Eagan City Staff. 7. Detailed landscape plan shall be approved by the City Staff and a $2,000 landscape bond shall be provided and not released until one (1) year after the landscaping has been completed. 8. The proposed plat abuts State Highway rights of way and should be subject to MnDOT's recommendations and comments. ENGINEERING RECOIA ENDATIONS: 1. COLBERT, DIRECTOR OF PUBLIC WORKS DATE: JUNE 18, 1980 RE: PRELIMINARY PLAT - L & F ADDITION (RALPH LINVILL) The Engineering Division has the following comments to offer in regards to the above proposed plat: UTILITIES: Sanitary sewer service of sufficient size and depth is available by way of the MWCC trunk sanitary sewer line (66 inch) along the south property line of this proposed plat. Connection to this trunk sanitary sewer line will require written permission from the MWCC as the line is under their jurisdic- tion. Watermain to service this proposed site is not immediately available. The nearest watermain is located at the intersection of Silver Bell Road and Nicols Road, approximately 1,300 feet to the south. Because of the lack of other development in this vicinity, and the distance involved, the Engineering Department will not require that watermain facilities be provided to this • proposed plat at this time. An agreement should be executed as a part of final plat approval, whereby the property owners agree to assume their respec- tive assessments and connect to City water when,and if, it becomes available. The City will require a meter to be installed either on their private well supply or on their sewage flow for the proper billing purposes. STREETS: Access to this proposed plat is provided by way of the inplace Nicols Road, by way of Silver Bell Road, upon the completion and operation of the new Cedar Avenue Freeway. Silver Bell Road is presently under contract for improvement to a nine (9) ton street. Present Nicols Road is of sufficient capacity to handle the proposed traffic generated from this proposed use. EASEMENTS AND RIGHTS OF WAY: Typical ten (10)foot side yard drainage. and utility easements will be required. Sufficient right of way should be dedicated adjacent to.Nicols Road, providing for a fifty (50) foot half right of way. The existing MWCC sanitary sewer ease - ment should be reaffirmed on this plat. In addition, sufficient drainage and utility easement should be dedicated to conform with the location of the flood plain limits as agreed to by the Corp of Engineers. SITE PLAN LAYOUT: The Engineering Department has no objections to their proposed configuration of internal traffic distribution or proposed parking stall configurations. However, internal storm sewer catch basins will be required to pick up parking lot drainage and discharge it toward the Minnesota River. This will eliminate the proposed depressed curbing and surface which becomes ineffective during the spring freeze and thaw cycle with the pertinent snow banks that occur. RUNKLE, CITY PLANNER 0 DATE: July 25, 1980 SUBJECT: ENVIRONMENTAL ASSESSMENT WORKSHEET REVIEW FOR THE L & F ADDITION The Eagan Advisory Planning Commission requested that an Environmental Assessment Worksheet be completed for the proposed L & F Addition. The developer of the L & F Addition is Mr. Ralph Linvill, and the proposed plat is located in the SW4 of Section 18. The proposed plat contains approximately 5.5 acres and is bordered by the new alignment of Cedar Avenue on the west, a ponding area which is within the Minnesota Department of Transportation right -of -way on the north, Nicols Road on the east and the railroad tracks on the south. The parcel is completely isolated by the physical barriers mentioned above. As mentioned before, the proposed site consists of 5.5 acres and would contain one lot. Of the 5.5 acres, 1.65 acres is within the flood plain designated by the U. S. Department of Interiors Geological Survey. The applicant is proposing to fill the 1.65 acres to an elevation above the designated flood plain elevation. The developer has estimated that approximately 20,000 cubic yards of fill would be needed to bring the 1.65 out of the flood plain elevation. In reviewing the Environmental Assessment Worksheet, the staff has determined that there are no major environmental impacts for the proposed site. The appli- cant has also submitted letters to the staff from the Department of Natural Re- sources, The Department of Army Corps of Engineers, and the Lower Minnesota River Watershed District. All of the agencies have given preliminary approval for the proposed project and formal approval would be obtained in the review process of the environmental assessment worksheet. The staff requests the City Council declare a Negative Declaration Notice which states that no EIS is needed on this project because the project is not a major action and /or does not have the potential for significant environmental effects and /or private action only „ the project is not of more than local significance. S% MINUTES OF A REGULAR MEETING OF THE EAGAN ADVISORY PLANNING COMMISSION • EAGAN, MINNESOTA JULY 22, 1980 A regular meeting of the Eagan Advisory Planning Commission was held on Tuesday, July 22, 1980, at 7 p.m. at the City Hall. Those present were Chairman Harrison and Members Bohne, Krob, Wilkins and Roszak. AGENDA A motion was made and seconded, all members voting in favor, to approve the agenda as distributed with the addition covering review and discussion relating to the proposed Metropolitan Guidelines covering the amendments to municipal comprehensive plans and also consideration of appointment of Planning Commission Members to the Eagan Advisory Cable TV committee. MINUTES It was noted that the July 8, 1980, minutes had not been distributed to Planning Commission Members. L & F ADDITION PRELIMINARY PLAT AND REZONING The Chairman then convened the public hearing that had been continued from July 8 concerning the application of Ralph Linvill for approval of the preliminary plat of proposed L & F Addition and rezoning from Flood Plain District to Light Industrial covering the parcel of property at the northwest corner of the railroad right -of -way and Cedar Avenue. The property is owned by the Harold Feyen estate and Mr. and Mrs. James Kennealy. Mr. and Mrs. Kennealy were present as was David Grannis III, attorney for the Feyen estate. Mr. Ralph Wagner explained the proposal for the applicant and Mr. Linvill was also present. Mr. Wagner indicated there were no objections to the recommendations of the City Planner, that the peat would be removed up to 14 feet and stored on the property and that pilings would be installed for the proposed warehouse building. Mr. Linvill indicated the EAW had been sub- mitted to the staff and Mr. Runkle indicated that all information had been in but that the staff had not had time to complete the review. In addition, he indicated that a number of state and federal agencies will be reviewing it and will be making comments on the EAW. There was discussion concerning whether Flood Plain Ordinance No. 61 applied and the applicant had proceeded under Ordinance No. 52 to rezone the pro- perty. Mr. Linvill indicated that he would agree that an application for building permit would be submitted to the Planning Commission for review but not to commit to no outside storage on the property for the future. Chairman Harrison objected to the rezoning for the same reasons as were cited on July 8. Harrison moved, Wilkins seconded the motion to recommend denial because of its being spot zoning, that it will not enhance the aesthetics of the City, that the DNR and Corps of Engineers have not made recommendations as to approval or denial and also the other reasons cited in the July 9, 1980 minutes. There was concern about the developer and owner holding the City harmless in the event of any flood or water damage due to location of the property and Mr. Linvill agrees to such a hold harmless agreement. Those in favor were Harrison and Wilkins. Those against were Krob, Bohne and Roszak. SC6 APC Minutes July 22, 1980 Page Two Roszak then moved, Bohne seconded the motion to recommend approval of the application to rezone from Flood Plain District to I -1. Krob, Bohne and Roszak voted in favor and Wilkins and Harrison voted against. CLEARVIEW 3RD ADDITION The next public hearing convened by Chairman Harrison concerned the application of Joseph Peterson for preliminary plat approval of Clearview3rd Addition. Mr. Peterson was present. The 2.4 acre parcel at the present time is Block 1, Lot .6, of Clearview lst Addition and would be subdivided into three single family lots. There was concern about the pond to be developed in the subdivision and no objections from neighboring property owners. Two neighboring property owners were present and favored the development because of its being an eyesore at the present time. It would have a maximum 12 foot storm sewer elevation and 919 minimum basement floor level as recommended by the staff. The staff recommended against fencing around the pond. Krob moved, Bohne seconded the motion to recommend approval of the preliminary plat subject to the following conditions: . 1. A drainage and utility easement shall be dedicated to incorporate the 916.0 contour elevation. 2. A grading, drainage and erosion control plan must be submitted and approved is by the Engineering Division prior to final plat approval. 3. Typical 10 -foot drainage and utility easements shall be provided adjacent to all public right -of -way and centered over common lot lines, 4. A 10 -foot drainage and utility easement centered over the existing storm sewer outfall from Beecher Drive shall be dedicated as a part of this plat. 5. Preliminary Plat and Three Variances- for Coachman Land Company 1st Addition -- A Public Hearing was first held by the Advisory Planning Commission on February 27, 1980 to consider a preliminary plat and three variances submitted by the Rosewood Corp. for the purpose of developing Coachman Land Co. 1st Addition. The Advisory Planning Commission after reviewing the `applications did make a recommendation this spring to the City. Council to approve the preliminary plat and three variances as presented. The City Council has considered the application pp zcation on -several occasions and was the last determination that the City was requiring a loop street for the proposed development and the dedication of 1.4 acres of additional park land at no cost to the City. The _ -park land would be contiguous with park land already aquired from the Rosewood Corp. on Coachman Road section 9. Representitives of the Coachman Land Co. (Rosewood Corp.) have again requested time on the agenda to present their preliminary plat and variances for further consideration. Runkle - City Planner Application Submitted: An application has been submitted for a preliminary plat, Coachman Land Company lst Addition, which contains approximately 62 acres. The proposed subdivision consists of 80 lots and 1 outlot, lots 1 through 52 block l and lots 1 through 24 block 2 would contain 19 quadriminiumi buildings, 76 dwelling units. Outlot It is.a proposed recreation area for thefquad project. Lot 53 block 1 and lot 1 through 3 of block 3 delineate the uses and phases which Rosewood Corporation is proposing to develop in the future. The second application is for a variance to allow a 35 foot setback instead of the normal 40 foot setback along Four Oaks Road. The second variance application is a request to have a 20 foot setback instead of a 30 foot setback between buildings in the quadriminium project. The third variance requested is to allow a 0 setback requirement for the driveways adjacent to the recreation area known as outlot A: Comments: 1. Phase I, which is the quadriminium development is the only phase under con- sideration at this time. Lot l through 52 block land lot 1 through 24 block 2 and the outlot will contain 76 units, 19 quadriminium buildings,and outlot recre- ation area. 2. The first phase of development contains approximately 14 acres of land, of which 11.9 acres could be used for density. The maximum number of units allowed in phase I is 86.8 dwelling units. Rosewood Corporation is proposing 76 dwelling units. This revised plat contains 1 four -plex or four units more than the original plat which was submitted last month. This is the only ehange within this proposed subdi.yi,aion. 3. The applicant is proposing to plat two cul -de -sac streets to provide access to the quadriminium units. The applicant feels the two cul -jde -sacs provide the best design and livability for the proposed project. However, the loop street, I 0 ROSEWOOD CORPORATION FEBRUARY 20, 1980 PAGE TWO would be the best for maintenance on the City's part. The applicant has • requested to stay with the two cul-de-sacs because of the design and livability that the cul -de -sac would provide. 4. The first variance request is for a 35 foot setback instead of a 40 foot setback which is required along Four Oaks Road. This type of variance has been granted in other subdivisions. The second variance request is to allow a 20 foot setback from the lot line instead of a 30 foot setback which is required., The design of the project, the 20 foot setback would only occur at one point with the building spreading out to at least a 30 foot in the rear. Economically this is a better layout and it is an meeting the intent of the ordinance. The last variance application is for a O setback for the driveway adjacent to outlot A. No variance would be required normally the City requests that the driveways be five (5) feet from the property .line however, with outlot'A' owned in common this request would not be necessary. 5. The Park Committee has reviewed this project and has indicated that the park dedication has already been established and that the park dedication for this pro - posed plat would consist of an additional 1.4 acres to be added to the existing park land. If approved the plat should be subject to the following conditions: 1. A Home Owners Association shall be established and the by -laws of the Home Owners Association shall be submitted and reviewed by City Staff prior to final plat approval. 2. The tot -lot should be installed by the developer to provide for the needs of the pre - school children. 3. The sidewalk should be installed on one side of the collector street according to City policy. 4. All drainage and utility easements shall be provided as required by City Staff. 5. Building permits shall only be issued on the first phase of the development and before building permits can be issued, the developer must complete all portions of the final plat with the exception of filing the final plat of the First Addition with the County. The final plat shall be filed with the County after the foundations of the building have been constructed. 6. The City requests that thepark land,which Rosewood Corporation has sold to the City of Eagan or dedicated to the City be included in the preliminary plat of Coachman Land Company 1st Addition. Engineering Recommendations: 1. A revised grading and drainage plan must be submitted and approved by the City Staff prior to final plat application. This should provide for maximum slopes of 3 -1, and proper erosion control measures. • 2. The proposed two cul -de -sacs be eliminated and replaced with the loop street system. It fails to project itself as a real leader in developing into a desirable planned community. This image is of utmost concern to me and others who reside here.' Maybe it is time to change all that. Our city is plagued by areas of unharmonious zoning. While we cannot change the zoning, we can try to make the most imaginative • use of it. Rosewood Corporation has proposed just that in' its preliminary plan for the quadraminium units located north of Four Oaks Road. Their plan, with the proposed cul- de -sacs, not only shows imaginative planning, but a real concern for their project's impact on the rest of the com- munity. As I understand it, these plans may be rejected solely on the basis of the proposed cul -de -sacs, permission for which, in the past, has supposedly been granted only when terrain dictated. It has been suggested that Rosewood substitute a through street in place of the cul -de -sacs. While this would, of course, be the most expedient solution, it very definitely would not be the most liveable or aesth- etically pleasing solution, particularly for those families whose properties would border on the. development. Isn't it time for the City to sit back and take a long look.at itself? Is it going to continue to engineer the future of our community in the most expedient, inflexible manner or is it going to be innovative and flexible in its approach? As citizens of this fine community, we all have a responsibility to look forward and build to the future - a future in which other generations can enjoy and take pride in a community which was not just engineered, but molded is with imagination, creativity and, perhaps.most importantly, sensitivity. (.0-7 While the residents of Timberline are not exactly enamored with the.prospect of two high density housing projects (including the Shields project) bordering our neighborhood on two sides, we are, nonetheless, pragmatic enough to recognize the importance of creating an atmosphere of cooperation in order to make the most of the situation. We, as citizens, cannot realistically affect Eagan's zoning, but we can make our voices heard in other ways, including working with the developers to make sure legitimate concerns for our neighborhoods and community are considered in their planning. It is for that reason the residents support the Rosewood Corporation plan as submitted. They have demon- strated a willingness to "listen" and have responded to our concerns in the imaginative planning of their development. As you know, that kind of dialogue and cooperation has not always existed with other developers in the past. Rosewood Corporation has responded positively. I -35E Plan Review -- At the July 15, 1980 City Council meeting, MNDOT submitted a Preliminary Plan showing the layout of I -35E from Blackhawk Road to Lone Oak Road indicating construction limits. MNDOT is requesting that the City Council review the plans so-. they can proceed with the detailed design. It was determined at the last City Council meeting that this item be placed on the August 5, 1980 agenda. The Director of Public Works has prepared .a report of his review of the plans with recommended conditions to be placed on the approval resolution. This information is contained on pages through. � I I I I -35E LAYOUT #11 PRELIMINARY LAYOUT APPROVAL A -2 Blackhawk Lake Alignment The City has received a request from District 9 from the Minnesota Department of Transportation to pass a resolution approving the preliminary layout design for I -35E from Cliff Road to 0.4 miles south of Lone Oak Road. Upon receipt of this request, the Council at the July 15 meeting, scheduled the review of this proposed alignment for the August 5th Council Meeting. Subsequently, our Consulting Engi- neer, Bob Rosene, And myself reviewed these proposed plans in detail and discussed our concerns with representatives of MnDOT at a meeting held at the District 9 offices on July 30th. Several major areas of concerns were addressed with the following comments being made available for the Council's information: BLACKHAWK ROAD MnDOT will be providing a major overpass for Blackhawk Road over the freeway. The limits of their construction will terminate at a point where they can blend in to the existing alignment and grade. Completion of the remaining portion of Blackhawk Road will have to be constructed under City contract which should be done concurrently due to the proposed intention of using Blackhawk Road as a bypass during the construction of the intersection of 35E with County Road 30. M MT is providing for a 5 -foot sidewalk along the east side of Blackhawk Road with a 8 -foot trail along the west side. MnDOT is presently working cooperatively with the MTC to review the feasibility of a park and ride site-being located in is the northwest quadrant of the intersection of Blackhawk Road with Cliff Road. HIGHLINE TRAIL MnDOT is proposing to construct a 16 -foot minimum width all purpose pedestrian overpass in alignment with our proposed Highline Trail. The City will have to provide for the final connection from that portion of the Highline Trail presently constructed or under contract to the limits of construction by MnDOT. This pedes- trian overpass has been submitted to the federal government but no final approval has yet been received. NOISE ABATEMENT Noise abatement is being provided along various segments of 35E as required by the PCA standards. It has not yet been determined whether this noise attenuation will be a dirt berm or wall structure. STORM WATER DRAINAGE PONDS Several ponds are proposed to be locally constructed by MnDOT with total fee title acquisition. We are presently coordinating our comprehensive storm water plan with MnDOT's drainage plan to insure optimum use and appropriate cost parti- cipation being provided for. It is MnDOT's intention to acquire fee title the pond located in the northwest corner of Jim Horn's property to an elevation of 831 or 832. As a result of this acquisition, it appears that acquisition of the remaining land in the extreme northwest corner of Mr. Horn's property will also have to be acquired. We have requested MnDOT to provide us with their pro - posed right -of -way acquisition limits to aid the City in reviewing any proposed future land development plans that may be submitted in the interim period. 16 i I -35E PRELIMINARY LAYOUT APPROVAL PAGE TWO . UTILITIES A. Water Main There will be only two required crossings of the freeway right -of -way to provide. for the installation of trunk water main facilities. The first will be located in the vicinity of the City's future reservoir site located immediately south of Deerwood Drive. The second crossing will be required at the approximate location of Duckwood Drive extended. It will require the relocation of two existing trunk water mains located on Yankee Doodle Road and Pilot Knob Road to provide for the proper elevation. The relocation will be at VTMT's expense and the new installa- tions will be the responsibility of the City. . B. Sanitary Sewer There is only one major trunk sanitary sewer crossing required located at the northerly end by the Highsite Apartments. There presently exists a 33 inch trunk sanitary sewer around the east end of Blackhawk Lake which will have to be re- located between Blackhawk Lake and the new freeway alignment. Again, relocation expense will be absorbed by MnDOT. C. Storm Sewer Several storm sewer crossings will be required to interconnect the various ponds that are proposed to be constructed by MnDOT and /or the City. Various cost parti- cipation agreements will have to be prepared based on the respective percentage of drainage contributed by MnDOT or the City. Presently, it is anticipated that the majority of the storm sewer crossings will be constructed as a part of freeway construction. DEERWOOD DRIVE Deerwood Drive is proposed to be relocated along a curve to.the south of the ex- isting alignment through the Francis Franz property. This alignment was discussed in detail with Leo Murphy, Francis Franz and Dunn and Curry Real Estate, affected property owners of this realignment. As a result of subsequent discussions, the access road from Deerwood Drive to the north will have to be realigned slightly to provide for continuity with an anticipated future residential layout over the Leo Murphy property. Apparently in 1976/77, the City-Council formally passed a resolution requesting that a 5 -foot sidewalk be constructed on the northside of Deerwood Drive with a trail proposed on the southside. As a result of recent reviews by the City Park Committee, Planning Commission and City Council, in conjunction with the proposed construction of sidewalk along existing portions of Deerwood Drive, the location of the proposed sidewalk and trail will have to be reversed providing for the side- walk on the southside and the trail on the northside. FEDERAL DRIVE /BLACKHAWK HILLS ROAD CONNECTION (WEST FRONTAGE ROAD) Our major street plan provides for the extension of Federal Street as a 44 -foot collector street south from Washington Drive to the center section line of Section 16 and then continuing further south at a normal residential 32 foot width to a connection with Blackhawk Hills Road.. MnDOT construction responsibility will be from Washington Drive south to the connection of the existing gravel portion of Englert Road. The remaining 500 feet will be the City's financial responsibility 7 1 I -35E PRELI1.4INARY LAYOUT APPROVAL • PAGE THREE but will be constructed by MnDOT on a cost participation basis as a part of the freeway construction. In accordance with the City's present policy, a 5 -foot sidewalk will be constructed on the eastside of Federal Drive extension down to the center section line of Section 16. TRAILS AND SIDEWALKS In addition to the previously referenced trails and sidewalks, MnDOT will be providing for a major 10 -foot wide trail along the eastside only of Pilot Knob Road from Dtic:kwood Drive to Yankee Doodle Road. This is a result of pedestrian safety reviews which minimize the number of crossings of freeway ramps. Similarly, a 10 -foot major trail complex will be constructed along the southside of Yankee Doodle Road from Denmark Avenue extended to Pilot Knob Road. PILOT KNOB ROAD/YANKEE DOODLE ROAD INTERCHANGE Because of the close proximity of existing major county roads, the unique inter- change with 35E is required. This configuration creates an unusable triangle in the southeast quadrant of the intersection of Yankee Doodle Road and Pilot Knob Road. There has been some discussion of the possibility of researching the feasi- bility of locating an additional park and ride site in this triangle. As a result of this unique interchange configuration, the City staff has some con- cerns over the necessity of certain freeway ramp intersections with Pilot Knob Road. Public Works Department feels that if the park and ride site is not to be constructed in the previously referenced triangle, that the southbound 35E exit ramp for northbound Pilot Knob Road should be eliminated as it will create potential future crossing conflicts. It is felt that northbound Pilot Knob Road from south- bound 35E can adequately be handled from the Yankee Doodle Road exit ramp. There are also similar concerns by staff regarding the proposed southbound Pilot Knob Rd. access to northbound 35E on the southside of the proposed interchange. It is felt that this northbound 35E access can be more effectively and safely handled via Yankee Doodle Road cloverleaf. This would also eliminate an additional turning movement across the City's proposed major trail crossing along the eastside of Pilot Knob Road. SIGNALIZED INTERSECTIONS It is proposed to have a full signalized intersection installed at Yankee Doodle Road and Pilot Knob Road. A signal system at the intersection of Duckwood Drive with Pilot Knob Road has yet to be justified based on uncommited future development and resultant opening day traffic projections. However, MnDOT will be providing the necessary conduit to provide for future signal installations. It is the City's concern that if the previously referenced entrance and exit ramps from Pilot Knob Road are not eliminated due to concerns previously expressed, it is felt that addi- tional turning conflicts will be created requiring the installation of additional signalization. This may jeopardize the City's position in providing a signal system at the intersection of Duckwood Drive.due to the close proximity of several major intersections in a short distance. I -35E PRELIMINARY LAYOUT APPROVAL PAGE FOUR • There will be the appropriate signal installations at the major intersections of 35E with County Road 30 and County Road 32 as traffic warrants justify. Several other minor concerns were discussed with MnDOT and satisfactorily resolved for inclusion or revision in the final design. However, because MnDOT is requesting formal Council action for the approval of the layout as presented on August 5, it is recommended that the resolution be approved with an exhibit of special conditions. These conditions are listed on a separate page. Bob Rosene, our Consulting Enginner, will be available to discuss in detail some of the staff's concern at the meeting of August 5. Final Plat for Windtree Addition -- The final plat application was received for Windtree Addition from the Naikwa Corp. The Windtree Addition is that development adjoining the Gopher Smelting plat on the east side of Elrene Road and to the north of the South Hills Plat on the west side of Elrene Road. The Nakwa Corp. of Winnipeg Manitoba has recently added corporate offices in the Minneapo- lis- area. The first 'phase of their development in Eagan is. the Windtree Addition this year and it appears that, assuming economical conditions, that the Windcrest development will proceed in 1981. The development agreement and all other documents relating to the final plat are in order for consideration. Enclosed on page Bn is a. copy the final plat for Windtree Addition. ACTION TO BE. An application was submitted to the City by Mr. Gary Sauer President' of - Barton Enterprises° Inc. requesting a Special Use Permit for a temporary concrete plant to be established on. lot -2 and- 3 of block 1 Cedar Ridge 2nd Addition. The plant is required for the final leg of the Cedar Ave. Freeway project. The project will incompass a period of four (4) months beginning immediately upon acceptance by the City Council and ending in late November or earlier weather permiting. The equipment used in the set up consists of a concrete portable, batch plant, storage bin for aggregate sand feeds,(1) one vertical cement silo, two .(2) lay down units, a PCA approved dust arrears unit and a loader to supply the bins. They are requesting the same hours as the asphalt plant which has been changed from '7:00 a.m. to 7 :00 p,m. The City Planner _`suggested that Mr. Sauer meet- with Mr. Dick- Victor and any other residents of River Hills -9th Addition to explain the project prior to the meeting on August 5. Improvement 80 -14 for Execution of Contract for Art Rahn Addition With C. Wayne Erickson Inc. in the - Amount Of $66,887 -- The contract for the _Art; Rahn Addition is in order for execution by the Mayor and City Clerk. The - contract is between the City of Eagan and C. Wayne Erickson Inc. the low bidder; for Improvement 80 -14 ACTION TO BE CONSIDERED ON THE MATTER': To authorize the Mayor and City Clerk to execute the contract for Improvement 80 -14 with C. Imrprovement 80 -20 for Northview, School and Schmidt Addition Utilities -- On March 4, 1980, the City Council held the formal Public Hearing for the consideration of the installation of utilities to service Northview Elementary School on County 30. On June 3, 1980, the 'City Council held the formal Public Hearing for consideration of this installation of water main to service the Schmidt; Addition located on Lexington Ave. north of County Road 30. This project was petitioned by several residents of the Schmidt Addition. Subsequently, these two projects were combined under one Improvement Project. Plan and specifications for this improvement have been completed and are ready for review by the -City Council. ACTION TO CONSIDERED ON THE MATTER: To approve the plans and specifications for Improvement 80 -20 and order the advertisment for bids with the bid opening scheduled for August 28, 1980 at 3:00 p.m.' • IMPROVEMENT 80 -27 C Improvement 80 -27 Brittany 2nd _& 3rd Addition Ches Mar East 2nd Addition Street Improvement -- On April 1, 1980,,the formal Public Hearing was .held for consideration of the installation of streets in the Brittany 2nd & 3rd Ok Addition (Poject 303). On April 1, 1980 the formal Public Hearing was also held for the installation of streets in the Ches Mar East 2nd & 3rd Addition (301). On December 18, 1979, the formal Public Hearing was held to consider installation of streets in the i the Art Rahn Addition (Project 266). Subsequently, these three` projects were combined for benefit of economics, The plans and, have been completed and. are being presented to the Council for approval. THEREFORE ACTION IS IN ORDER TO: Approve plans and specifications for Improvement' 80 -27 and order the advertisment for bids with the bid opening scheduled for August 28, 1980 °at,3:00 p.m.' IMPROVEMENT 80 -19 D. Improvement 80 -19 Twin View Manor Utility Improvements — During March and April of 1980, there were several Public Hearings to consider the installation of sanitary sewer, water main and storm sewer in the Twin View Manors Addition. As a of these Public Hearings, :result several the Council approved installation of utilities and ordered the preparation -of' plans and specifications. The City Attorney has informed me that a temporary injuction case before the District Court has 'served on the City of Eagan by residents of Twin View Manor is scheduled for hearing August 6, 1980. ACTION TO BE CONSIDERED ON THE MATTER: To approve plans and specifications for Improvement 80 -19 and order the advertisement for bids with the bid opening scheduled for °August 28, 1980 at 3:00 p.m. PROJECT 306 E. Project 306 (County Road 30 - Street Improvements) According to the Public Works Director the Preliminary Engineering and Feasibility report for the proposed upgrading of Wildwood Lane (County Road 30) from Nicols Ave. to Blackhawk Road has been completed by the Consulting Engineer and is ready for review by the City Council As you recall during 1979 Public Hearings were held at Cedar Elementary School to consider proposals for the upgrading of that • portion of Wildwood Lane. It was generally agreed by the City Council that the width of Wildwood Lane be reduced from a 52 foot urban sectiori to a 44 foot wide road alignment. The Dakota Highway Engineer has suggested Wildwood Lane will be included in the 1981 County Budget. Therefore it is advisable that the City Council review the plans as revised and determine what procedure will be used to present the plans to the residents of budding Wildwood Lane The Consulting Engineer will _review the revised at the meeting on Tuesday. ACTION TO CONSIDERED ON THIS MATTER: To approve or deny exceptance of the Feasibility. Report as presented and set a Public Hearing to consider revisions to project 306. WESCOTT ROAD DRAINAGE PROBLEM F.' Wescott Drainage Problem < -- Since the compeletion of the upgrading of Wescott Road from South Hills to T.H 'SZ 149 during 1978, the city has 'been experiencing high wate drainage problems with the existing ponds located adjacent to Wescott Road and � mile west of South Hills- Addition. During the spring melts of. 1979 and 1980, Wescott RRoad. had to becompletely closed off for periods of up to three weeks In addition, the high water in these ponds have flooded adjacent property killing, a number of trees on Chuck Hall's property. Our Consultant`, Bob Rosene, has researched the problem and discussed the situation and proposed solution with Chuck Hall. It would require approxi- mately $7,000 to 10,000 to, provide an outlet from the pond adjacent to escott Road through Mr. Halls property a Agenda Information Memo July 30, 1980 Page Twenty One into Old Lake in the northeast of section 23. The Director of Public Works is requesting authorization from the City Council to perform this maintenance work this fall. This does not involve a required detailed Feasibility Report but could be prepared if the City. Council so desires. The project will be :`further discussed by the Consulting Engineer at the meeting on Tuesday. ACTION TO BE TAKEN ON THE MATTER: To approve or deny a directive for the Director of Public Works to perform the necessary maintenance. FIRE STATION 1 &-3— - CONTRACT REVISION` G. Fire Station 1 and 3`Contract Revision -- The contract for Fire Stations -1 -and 3 provided for the turf establishment of seeding. If this were accomplished by Park Maintenance '33► crews, it would provide a deduct of $778 which could be used for trees and decorative shrubs. The Director of • Parks and Recreation is in agreement with this idea. The City could purchase up to $1,500 worth of trees under the state 50% cost participation shade tree program for our $750. The Director of Finance will begin working toward implmentation of LOGIS as soon as possible and it is expected that the City will be operation- al late this full and certainly January 1, 1981.
