ADJOURNMENT MEMO TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: JANUARY 2, 1981 SUBJECT: AGENDA INFORMATION MEMO After approval of the December 16, 1980, regular City Council minutes and the agenda for the January 6, 1981 City Council meeting, the following items are in order for consideration: W672"VENSIM6 aim OATH OF OFFICE/GENE VANOVERBEKE, CITY CLERK-TREASURER It is necessary to handle one (1 ) organizational item at the January 6 , 1981 City Council meeting. The appointment of Mr. Gene VanOver- beke as City Clerk-Treasurer is required. due to the necessity to sign checks and other legal documents on behalf of the City of Eagan. Mr. VanOverbeke has received the necessary bonds and all other . requirements per personnel ordinance and state law have been satisfied. The City Administrator will therefore administer the oath of office as required. FIRE DEPARTMENT A. Fire Department -- Mayor Blomquist has asked that certificates of recognition be presented to three ( 3) Fire Fighters who located and saved the life of a one-year old, at the Eagan Green Apartments on December 24, 1980. The Fire Fighters are Mark Adam, Dan Kling- beil and Maynard Klang. A certificate is also being prepared for Mr. Steve Olson, a resident in the building, who entered the burning apartment to rescue two (2) of the children, however was unaware that another child remained in the apartment until the Fire Fighters arrived. Fire Chief Childers is also preparing some certificates and will assist the Mayor in the presentation at the meeting on Tuesday. POLICE DEPARTMENT B. Police Department -- There are no items to be considered for the Police Department at this time. PARK DEPARTMENT C. Park Department -- The Director` of Parks and Recreation is requesting authorization to proceed with specifications and the advertisementfor bids to consider the purchase of a 'gang mower, ' weed sprayer, small utility vehicle and a three-quarter ton pickup. The small utility vehicle would either be similar to a station wagon or a log truck to be used for both administration and • 0 Agenda Information Memo January 2, 1981 Page Two recreation field activities . These items have all been given consi- deration for purchase as capital outlay in the 1981 budget . ACTION TO BE CONSIDERED ON THIS MATTER: To approve or deny authori- zation for the Director of Parks and Recreation to proceed with the advertisement for bids for the equipment as stated. PUBLIC WORKS 'DEPARTMENT D. Public Works Department -- During 1980, the City has worked coorperatively with the Metropolitan Transit Commission (MTC) to provide a priority listing of designated sites to be considered for future consideration of passenger waiting shelters . At the January 15, 1980 City Council meeting, four sites were to be con- sidered for future locations of passenger waiting shelters in the following priority listing: (1 ) Valley View Apartments on Rahn Road, ( 2 ) Wildwood Lane (County Road 30) at Rahn Road, (3 ) Easy Street Apartments on Silver Bell Road, (4) Silver Bell Road- Inter- section on Blackhawk Road. MTC plans to install forty shelters in 1981 throughout the metropolitan ,area. They have received re- quests for shelters from 41 cities. Consequently, the City of Eagan will receive authorization for the installation of one ( 1 ) shelter only. However, the MTC has submitted site plans for review and approval by the City for the first three ( 3) priority requests . The reason the MTC is requesting site approval for several locations from the City is to insure that, if the number one selection is for some reason rejected, other potential sites will be readily available to receive a shelter installation without running the risk of being deleted from their 1981 program. Consequently, the MTC has submitted site plans for Valley View Apartments (C-990) , Wildwood Lane/Rahn Road (C-976 ) , and Easy Street Apartments (C- 991 ) . The City has received a notice of objection from Mt . Calvery Lutheran, Church pertaining to the proposed location of the shelter - for the number one priority listing of Valley View Apartments (C- 990) . Based on subsequent information that the Director of Public Works has received from the MTC pertaining to load counts and taking into consideration the location of the apartment site and the existing sidewalk facility, it is recommended that the MTC be re- quested to consider locating the proposed waiting shelter on the west side of Rahn Road for the Valley View Apartment location. The City has not received an objection from any of the other pro- perty owners affected by the proposed shleter locations . ACTION TO BE CONSIDERED ON THIS MATTER: To approve site plan # C-991 and # C-976 and to not approve site plan # C-990, dated 9 13-80, and to request the MTC to redesign and resubmit a shelter station for the Valley View Apartments on the west side of Rahn Road. • 0 Agenda Information Memo January 2, 1981 Page Three • There are nine (9) items on the agenda referred to as Consent Items requiring one (1 ) motion by the City Council . CONTRACT 79-22 A. . Contract 79-22, Johnny Cake Ridge Addition Utilities for Final Payment/Acceptance -- The City has received certification from the Consulting Engineering firm that the above referenced , contract has been completed according to City plans and specifications . All inspections and tests have been performed and found acceptable. The final construction amount was 2 . 71% under the contract amount. This project has been assessed previously and the final pay request has been taken into consideration during final assessment cost tabulation,. ACTION TO BE CONSIDERED ON THIS MATTER: To authorize the ninth and final payment to Encon Utilities in the amount of $5,000 for Contract 79-22 (Johnny Cake Ridge Addition Utilities ) and accept these utilities for perpetual maintenance. CONTRACT 79-17 B. Contract 79-17, Safari Estates Utilities for Final Payment/ Acceptance -- The City has received verification from the Consulting Engineering firm that the above referenced contract has been com- pleted in accordance with the plans and specifications. All tests and inspections have been performed and are found to be satisfactory for final acceptance by the City. The final costs associated with this project are 2.6% under the anticipated construction cost based on contract award. This project has not yet been final assessed. ACTION TO BE CONSIDERED ON THIS MATTER: To authorize the eighth and final payment of $31 ,741 .90 to Austin P. Keller Construction Company and -accept the utilities for perpetual maintance for Con- tract 79-17. CONTRACT 79-5 C. Contract 79-5, Vienna Woods Utilities for Final Payment/ Acceptance - The City has received written concurrence from the Consulting Engineering firm that the above referenced project has been completedaccording to plans and specifications approved by the City. All inspections and tests have been performed and are found to be satisfactory for final acceptance. The final construc- tion costs associated with this project were 0.8% over the contract award amount. This project has been assessed based on these final construction costs. CONTRACT 79-7 D. Contract 79-7, Thomas Lake Trunk Storm Sewer Outlet, for Crop Damage Payment During the construction ofthetrunk storm sewer outlet for Thomas Lake to B,lackhawk Lake, the alignment adversely affected -existing agricultural-used land. The =City has received a claim from Mr. Leo Murphy for crop damage and loss incurred as a result of this trunk storm sewer construction during the summer of 1979 . Copies of this claim are made available for Council infor- mation on pages S through (0 There are also pictures available as provided y Mr. MurpiFy 'hat were not reproducible but will be available at the City Council meeting if there is any question on this agenda item. It has been standard City- policy to authorize payment for crop damage as part of the easement nego- tiation process'. Petition (Streets & Utilities) , Joyce Addition -- The preli- minary plat for "Joyce Addition" has been approved with the stipu- lation that final plat approval not be considered until the trunk storm sewer has been ordered for installation for T.H. 55 and Burr Oak Pond 'outlet (182R and 319 respectively) . These projects were approved at the November 18 meeting of the City Council. Sub- sequently, the developer will be processing the final plat applica- tion. " In conjunction with this, he has submitted a ;petition re- questing the City to prepare a feasibility report for the installa- tion of streets and utilities in this subdivision.. The developer has guaranteed the cost of the report if the project is not ordered. ACTION TO BE CONSIDERED ON THIS MATTER: To receive the petition for street and utilities in the Joyce Addition and authorize the preparation of feasibility report #327 . CHANGE ORDER #5 FOR CONTRACT 232A F. Change Order #5, Contract 232A (Super . America Utilities) -- Change Order #5 consists of three ( 3) Barts: PART 1 consists of the installation of storm sewer in Neil Armstrongggoulevard prior to the street surfacing contract. Add $10,457. PART 2 consists of additional water main wet taps and hydrant relocations required by change in plat development. Add $33783. PART 3 consists of additional gravel required by MnDOT for trench bac fill in the area of T.H. 13 and County Road 30 frontage road. Add $2,601 .20. All costs associated with this change order will be assessed the benefited poject. ACTION TO BE CONSIDERED ON THIS MATTER: To approve Change Order #5 , Contract 232A, in the amount of $16 ,841.20 to Encon Utilities. CONTRACT 232A G. Contract 232A, Super America, Cameron Addition, Sill Addition, Neil Armstrong Boulevard and Carlson Lake -Lift Station, for Final Payment/Acceptance - The City has received varification from the Consulting Engineering firm that the above referenced contract has been completed according to City plans and specifications . All tests and inspections have been performed and are found to be acceptable for final acceptance. The final' construction costs exceeded the revised contract amount by 1.72%. The City discovered that a double payment was processed previously under this contract. Taking into consideration all final costs due the contractor, the result is a net overpayment of $11 ,623.96 that was previously recom- mended by the Consulting Engineering firm to Encon Utilities, Inc. ACTION TO BE CONSIDERED ON THIS MATTER: Authorize the eleventh and final payment reflecting a reimbursement from Encon Utilities , Inc. , in the amount of $11 ,623 .96 and that the City accept the projects under this contract for perpetual maintenance. Agenda Information Memo January 2, 1981 Page Six CHANGE ORDER #1 CONTRACT 80-15 H. Change Order #1 for Contract 80-15 for Silver Bell Road Street Improvements -- This change order provides for an extension of the newly installed sidewalk from the Vogelpohl Apartments to T.H. 13. This project will be installed as a part of the municipal stateaid' project for Silver Bell Road from Nicols Road to the Vogelpohl Apartments and all costs will be paid by MSAS funding. ACTION TO BE CONSIDERED ON THIS MATTER: To approve Change Order #1 to Contract 80-15 to Bituminous 'Roadways in the amount of $14,871 . 50. CHANGE ORDER #3 - CONTRACT 79-15 I. Change Order #3 for Contract 79-15 for Vienna Woods Street Improvements -- This project provides for the adjustment to the final grade of all City utility castings located within the Safari Pass roadway which was constructed by MnDOT prior to final paving. MnDOT` s contract did not provide for these adjustments and MnDOT informed the City that it would be the City' s responsibility to perform the work. The City made use of the contractor on MnDOT'.s contract to adjust these utilities by way of a change order to an existing City contract under jurisdiction of the same contractor. ACTION TO BE CONSIDERED ON THIS MATTER: To approve Change Order #3 to Contract 79--15 to Minnesota Valley Surfacing in the amount of $3,130.95. I.R. NOTE = E. L. MURPHY TRUCKING COMPANY A. Tax Exempt Financing ` (I.R. Note) for E. L. Murphy Trucking Company in the Amount of, $2,000,000 -- .The City has received an application for a $2,000,000 industrial revenue note to finance a' portion of the cost of constructing a two (2) story, 20. 550 square foot office building and, a remodeling of the existing office building. According to information supplied by Miller & Schroeder Municipals , Inc. , it is estimated that approximately 50 new jobs would be created at an annual estimated payroll of $750,000. All of the information relative to consideration of the preliminary resolution is enclosed without page number in a special folder. E. L. Murphy has also provided a portfolio of their trucking company that I feel the City Council will find of interest. Specific infor- mation_ on how the actual industrial revenue note will be placed will .be more available when the final resolution is considered at a later date. - This specifically relates to the recent, question of temporary financing vs . long term financing. Mr. Ernie Clark, 0 Agenda Information Memo January 2, 1981 Page Seven ' the City' s Fiscal Consultant, has the financial information, and upon completion of his analysis, the City will have a letter for consideration by January 6, 1981 , as to the feasibility of giving considerationto approval of the industrial revenue note. ACTION TO BE CONSIDERED ON THIS MATTER: To approve or deny a pre- liminary resolution for an industrial revenue note for E. L. Murphy Trucking Company in the amount of $2,000,000 for the purpose as stated. I.R. NOTE - J.P.K. PARK COMPANY B. Tax Exempt Financing (I.R. Note) for J.P.K. Park Company in theAmount of $2,800,000 A public hearing is scheduled to, consi- der an industrial revenue note for J.P.K. Park Company for the purpose of constructing a 67,000 square foot shopping center. The shopping center will include a 25 ,000 :square foot supermarket with the balance of space leased to retail shops. The estimated - payroll is $1 ,150,000, based on an estimated 115 new jobs. Infor- mation relative to this tax exempt financing request is found .in the attached document prepared by Miller and Schroeder Municipals , Inc. , (no page numbers are given) . This tax exempt financing re- quest is for approval of a preliminary resolution and, therefore, the details regarding the placement of the mortgage note will be considered - in - the future when the final resolution is presented to the City. A request for a $2,500,000 industrial revenue note was considered by the City Council at the February 19, 1980 City Council meeting for construction of a 67,000 square foot shopping center proposed by J.P.K. Park' Company. This tax exempt mortgage request was not approved as a result of a motion for reasons offered in the minutes, a copy- of which is enclosed on page /0 for your reference. All the information for this tax exempts nancing re- quest is in order for consideration. . ' Again, as stated, a copy of the document regarding public purpose and other 'support informa- tion is enclosed for your reference. If there is any , additional information required by the City Council , please feel free to con tact this office prior to the meeting on Tuesday. ACTION TO BE CONSIDERED ON THIS MATTER: To approve or deny the I .R. not in the amount of $2,800,000 for J.P.K. Park Company for the 'public purpose as stated. i i City Council Minutes February 19, 1980 Page Three Wachter moved to approve the bond issue on the basis of the need for an office building in the area. There was no second and the motion died. Mr. Nick Hay, attorney from Head and Truhn, Minneapolis, appeared for the applicant and re- quested a continuance to further review the application and submit additional data. Egan moved and Wachter seconded the motion to continue the hearing until the regular meeting of March 18, 1980, at 7:00 p.m. at City Hall in order to acquire further information. All voted in favor. SEE BOND FILE JPK PARK COMPANY IDR BONDS - NICOLS STATION The next public hearing convened by Mayor Blomquist concerned the appli- cation of JPK Park Company for industrial revenue bonds in the amount of $2,500,000 for a 67,000 square foot shopping center at the intersection of Wildwood Lane and Nicols Road. Mr. Mark Parranto indicated a conflict and withdrew from consideration and reviewed the proposal for the applicants. Finance Committee Chairman Smith discussed the committee's findings and recommended approval after citing reasons given by the Finance Committee for approval including the following: Miller & Schroeder had reviewed the application and stated that it was economically feasible, that the lease rental proposals appeared to be economically practical , that it would improve the area in relation to its present condition, and that there would be only one project instead of several scattered commercial buildings. There was discussion by Councilmember Smith concerning the Metram Project, called Silver Bell Center, and the denial by the Council to issue industrial revenue bonds. Mr. Smith noted that no recommendation had been made by the Finance Committee at that time. Issues were also discussed concerning compatibility with the overall development plans and objectives of the City, employment potential, etc. There were concerns about using industrial revenue bonds for competition with other commercial development in the area but there were no objections from members of the audience. Smith moved to authorize the $2.5 million industrial revenue bond issue as requested subject to normal City and other applicable rules and regulations. Egan seconded the motiDn. Mayor Blomquist expressed her concerns including the fact that there is a considerable amount of vacant commercial space in the general area and that the Council had already denied IDR bonding for Silver Bell Center. Those in favor were Smith and Egan, those opposed were Blomquist and Wachter and the motion died. SEE BOND FILE IMPROVEMENT PROJECT #300 - JAMES REFRIGERATION The Mayor convened the public hearing regarding Improvement Project #300 consisting of the Janes Refrigeration neighborhood business site at the north- east corner of Pilot Knob Road on Wildwood Lane. Mr. Rosene explained the utility project and a representative of James Refrigeration and Dunn& Curry was present and favored the project. He indicated that Dunn & Curry may request that the storm # sewer running easterly may be rerouted in the future but that it would be done at the developer's expense. There was discussion concerning the need for the easement and the recording with the County Recorder. There were no objections to the project. Wachter moved and Smith seconded the motion to close the hearing, to approve the project, and to authorize the City Engineer to prepare the plans and specifications subject to the acquisition of the necessary easements with the understanding that in the event that the developer should request that the storm sewer be moved that all costs would be covered by the owner upon approval by the City. All voted in favor. 10 r1 ADDENDUM TO DEVELOPMENT ACRRFMENT / /6 This addendum to the agreement dated , 1979, between B & K Properties Co. , a partnership and the City of Eagan; WHEREAS, the parties entered into a Development Contract dated , 1979, covering Vienna Woods, City of Eagan, Dakota County, Minnesota; and WHEREAS, the parties desire to amend said Development Contract relating to assessment against the land within Vienna Woods; NOW THEREFORE, the parties agree as follows: 1. All lots on the North side of Kings Road in Vienna Woods including Lots 26 through 32, Block 2, and the land owned by Richard Kreitz will be assessed on a front foot basis for street improvements for that portion of the North side of Kings Road including curb and gutter at a residential equivalent rate and in addition, sanitary sewer, water and storm sewer laterals. The normal City policy will apply for storm sewer and water trunk assessments on said lots. 2. All other lots in the subdivision will be assessed on an equal per lot basis for improvements installed by the City of Eagan except that Lots 9, 10, and 11, Block 2 will not be assessed for street improvements and such street improvements will be assessed against all lots currently owned by B & K Properties Company. 3. Lots 9, 10, and 11, and Lots 26 through 32, Block 2, and the land owned by Richard Kreitz will each be assessed 1/106th of the street improvements for that portion of the South one-half of Kings Road from the West line of Vienna Woods to the East line of the Kreitz Property. Paratransit Proposal for Grant Funding Consideration -- At a recent joint meeting of several cities in Dakota County and the City of Savage in Scott County, it was decided that additional planning concerning the feasibility of a paratransit system for this region of the metropolitan area would be considered only if a grant application were approved by the U.S. Urban Mass Trans - portation Administration for funds to complete a market analysis and a feasibility study for such a paratransit system. A resolution has been approved by the City of Burnsville and is under' considera- tion bytheCities of Apple Valley, Lakeville, Savage and Rosemount to make a grant application to the Urban Mass Transportation Admini- stration for planning funds for the continued development of- a paratransit system to operate in this region of the metropolitan area. Those present included Chairman Joseph Harrison and Planning Commission Members Turnham, Wilkins, Bohne, Krob and Gits. Absent was member Hall. Also present were City Planner Dale Runkle, Assistant Planner Steve Mielka, City Engineer Rosene and City Attorney Hauge. MINUTES Gits moved, Wilkins seconded the motion, to approve the minutes as distributed. All voted yes. McDONALDS CORPORATION CONDITIONAL USE PERMIT Chairman Harrison convened the public hearing regarding the application of McDonalds Corporation for conditional use permit to allow a Class II restaurant with drive up facility in a Community Shopping Center district located on Lot 1, Block 1, Mari Acres and application for conditional use permit for pylon sign at that location. Mr. Mike Asad appeared for the applicant. There were numerous questions but no objections to the application. The proposal would include a drive through and would require a 15-foot variance from parking setback requirement on the west side. Hillcrest Development had received approval of a 15-foot variance on the west side of its property along the same street. There were concerns about the amoun t of parking but it was noted that it was a fast food restaurant and the developer indi- cated that there is sufficient parking for its purposes. The Planning Commission members noted that the Council may table the application for sign permit because the Sign Committee is studying signs along freeways and also noted that the 34 foot height request would not comply with the Eagan ordinance. Also, Mr. Asad indicated that the radius curves would be corrected. It was noted that there were platted roads on two sides so that a hardship is created if the 15-foot variance is not granted. The plan is to start construction in the spring and open by mid-summer. There were concerns about compatibility with other buildings in Hillcrest Center and Mr. Asad said that the exterior would be compatible. Gits moved, Krob seconded the motion to recommend approval of the conditional use permit to allow a Class II restaurant with drive up facility subject to the following conditions: 1. The proposed building permit shall not be issued to McDonald's until such time that Hillcrest Development Corporation has received their building permit. 2. The parking area shall have asphalt surfacing and concrete curbing around all perimeters of the parking and drive-through area. 3. The 15-foot variance shall be approved for this proposed site plan. MUSICAL EATERIES, INC. -- CISCO'S City Planner Runkle indicated that the abstract covering property owners in the vicinity of the proposed Cisco's Restaurant in Cedarvale Center had not been submitted in time to hear the application at the December meeting and that it would be carried over and heard at the January Planning Commission meeting. PEACE REFORMED CHURCH -- REZONING A public hearing was commenced regarding the application of Peace Reformed Church to rezone approximately 12.5 acres from R-4 to LB, Limited Business, located in the east one-half of the northwest corner of Section 30 south of County Road #30 between old and new Cedar Avenues. A representative of the church was present and indicated that it is intended that the church would be located on the south portion of the property and possibly a school or retirement home would be located on the balance of the property. The representative indicated that it is not expected that the property would be used for commercial type use such as office building, and the Planning Commission Members recommended the zoning be Public Facilities rather than Limited Business. It was estimated that the construction of the church would begin within two years. Richard Kennealy, the property owner to the north zoned Roadside Business District property was concerned about the 300-foot spacing between a proposed liquor license restaurant on his property and the proposed church. The representative indicated there could be at least 300 feet because it was suggested that the church be located on the south end of the 12.5 acre parcel. The Planning Commission con- tinued the matter until later in the meeting to permit the representative to discuss the issues with other church Board members. 2`�.. • Agenda Information Memo January 2 1981 Page Ten MAXI SUDITS FOR PUBLIC BUILDINGS B. Maxi Audits for Public Buildings -- The City has participated in a state and federal funding program for mini audits which were conducted by Holstad Associates this past year. The mini audits provided the City with a list of energy deficiencies in each of its ' public buildings. The next step , in the process is the maxi auditgrants which are also .partially funded by state and federal government agencies. The benefits of the maxi audit include iden- tification of projects that would ` make the buildings more energy efficient, including an engineering, analysis to determine the pro- ject ' s' cost effectiveness . Supposedly when the maxi audit process is completed, the City will be able to implement measures to enhance conservation of energy throughout all of its public buildings . The Administrative Intern, Mr. Steve Mielke, has prepared a memoran- dum which addresses the maxi audit bids , three ( 3 ) were received for completion of the program. It is the recommendation of the City Administrator that the ' City proceed with the entire maxi audit which would be a cost to the City of $660, assuming the low bid of Holstad 'Associates. A total of $3,309 will be assumed state and federal agencies if the grant is approved. By participating , in a `maxi audit program, good faith is demonstrated by the City for future grants or programs that might attach some energy criteria. Excavation Permit Application for Hillandale Addition -- The City has received an application from the Beure' Company pertaining to grading and excavating within the Hillandale 1st Addition adja- cent to County Road 30. All bonds, fees and insurance certificates have been submitted and found to be in order. However, the grading and drainage plan has been inspected by the Director of Public Works and has been found to present some drainage problems for adjacent property owners . The Director of Public Works has re- quested that a revised plan be submitted showing provisions for ahndiing all drainage onsite. The applicant has indicated that this is possible and will be resubmitting the revised plans prior to the Tuesday night City Council meeting on January 6 . W.111113 1981 SEWER/WATER RATE STUDY A. 1981 Sewer/Water Rate Study Proposal - At the last regular meeting of the City Council on 12-16-80, the sewer and water rate study as prepared by the firm of Bonestroo, Rosene & Anderlik was presented for review purposes . The Director of Public Works , Director of Finance and City Administrator have reviewed the docu- ments and the City Administrator and Director of Public Works will comment on the proposal at the meeting on Tuesday. If any member of the City Council has misplaced their rate study, please feel free to contact this office and another copy will be distributed. Agenda Information Memo January 2, 1981 Page Twelve ZONING MAP UPDATE B. Zoning Map Update/1981 -- Each year, the City updates the zoning map. This year, it seemed appropriate that additional research be provided by the staff to determine whether any zoning changes have been overlooked in previous years to assure that this year' s zoning map is more accurate once the update is completed. The interns , Mr. Ulrich and Mr. Mielke, have worked on the zoning map changes at the direction of the City Planner and City Administrator. Administrative Intern Mielke was asked to prepare a list of all the changes for Council consideration. There are nine ( 9) distinct zoning changes that should be considered. There are also nine (9 ) properties that have been designated as park land which have never been zoned public facilities . The City staff needs directive as to whether these City properties should be zoned, and, if so, the nine _ parcels should be included to the aforementioned zoning changes to complete the zoning map update. In order to process all the final zoning, a public hearing must be scheduled with legal notice outlining all the 'zoning changes under consideration. These outlots have not officially been zoned public facilities. Fellow staff members are not sure of the status of these outlots and the future of these outlots. Dakota County Housing Assistance Update -- The Dakota County HRA is requesting that cities in Dakota County review their housing assistance plans (HAP) and that city councils take any action that is necessary for updating the 1981 housing assistance plan for their respective communities. The City Planner and Administrative Intern have met with Carol Schultz and other employees of the HRA to discuss the various alternatives and review the ten year and three year goals that were set forth in the Eagan Comprehensive Guide Plan. The City of Eagan has accomplished much of its ten year goal for moderate housing by successfully completing the Minne- sota Housing Finance Loan portion of the ten year goal . This was accomplished by participating in the tax exempt mortgage financing plan which should be concluded within the next one to two months . The City has not fulfilled much of the low income housing goal of 1980. The City has not fulfilled any of the Section 8 new con- struction; however, eight of the twelve units for the rental assis- tance program have been fulfilled. The City has participated in the scattered site housing program which has been successful in the City of Eagan; however, due to County Board action, it is apparent that this program will not exist after 1981 . To insure a favorable review by the Metropolitan Council on future grant programs and also to provide low income housing as set forth in the Comprehensive Guide Plan for the next ten (10) years , some or all of the goals for housing units that were originally consi- dered for 1980 should be carried over to 1981 . It would also be reasonable to increase the number of units for new construction in the scattered site program from seven to ten units for 1981 , which again insures the Metropolitan Council that the City of Eagan is making all attempts and efforts to participate in a subsidized housing program. Enclosed on pages 12 through -35' is a report which was written by the Administrative Intern, Mr:Steve Mielke, regarding the need to update the housing assistance plan for the City of Eagan for 1981 . There is background provided regarding the ten year goals the City of Eagan has set forth in the Compre- hensive Guide Plan and also the three year funding allocation. A discussion of the 1980 and 1981 housing allocation plans is offered along with possible actions and recommendations for imple- mentation of a subsidized housing program for 1981 . Carol Schultz " of the HRA will be present to answer any questions the City Council may have regarding action to be considered for the update of the housing assistance plan. Please make reference to the third page of the report which outlines two possible actions and a recommenda- tion. The first action is to carry over twenty-five or thirty units of new construction this year and then spread the remainder over the rest of the following years. Reasons for this action are listed in the report. A second action is to consider increasing the scattered site new construction from seven to ten units which should insure a favorable response for subsidized housing by the 0 Fourteen Metropolitan Council . The recommendation listed in item three is merely food for thought for how Eagan should consider the three year housing allocation plan. ACTION TO BE CONSIDERED ON THIS MATTER: To provide a housing assis- tance plan update for 1981 based on the actions mentioned above and described in more detail in the attached report. REVIEW Eagan has been and presently is a member of the Dakota County Housing and Redevelopment Authority (HRA) . A duty of the HRA is to develop a Housing Assistance Plan (HAP) . This plan is a guide for the County in determining where to distribute rent subsidy monies. The HAP is also a determining factor in the "213 Review Process. " The 213 Review Process is a ranking of proposed projects within the Dakota County HRA. The rankings indicate to the Metropolitian Council which projects Dakota County feels are most beneficial to the County. The 213 Review and the HAP must be in accord in order to receive a favorable review. A negative review would probably cause the funding to be denied. Dakota County HRA is presently revising its HAP for the coming year and have requested that we analyze our situation and respond to their office, it is necessary for Eagan to carefully consider the options available. The Metropolitian Council has identified a 10 year "full share" d)f subsidized housing for all communities within the Metropolitian Area. This full share" is the number of units that Eagan is expected to )Deed and fulfill within a ten year period. _ It is to Eagan' s benefit to show in the Comprehensive Plan that Eagan is in accord with the Council ' s goal. This 10-year goal is , however merely that, a goal, and is of no consequence to the City' s "3- year funding allocation. " The 3-year funding allocation is a monetary allocation set aside by the Metropolitian Council for use on approved projects within Eagan. The following is a representation of the 10-year goal as presented by the Metropolitian Council. The 1980 Dakota County HAP has started an agreed goal between Eagan and the HRA, of 63 units. The HRA staff has informed us that the scattered site housing may be discontinued after Fiscal Year 1981. This is due to the fact that the County Board does not want to underwrite the program. Eagan has, in the past, been very active in this area and has preferred this type of subsidization over many of the other programs. At a recent meeting with HRA staff, we were offered the opportunity to carry over some or all of our Sec. 8 new construction goals from 1980. This will allow us to demonstrate that Eagan is com- mitted to the concept of providing subsidized housing, and would cause projects to recieve favorable reviews. If we carry over some or all of the 1980 goal , Eagan shall offer to developers the opportunity of subsidizing some units to help the project fly. Another consideration is the fact that there are persons on a waiting list who desire and qualify for subsidized housing in Eagan. The following is a representation of the current waiting list. Since we didn't meet our goals in 1980 , and our 1981 HAP does not meet requirements , we should carry some or all of our 1980 goal units over to 1981 . It would seem to make sense to carry over at least 25 or 30 units of new construction this year and then spread out the rest over the following years. To do this would: A. Insure our City of receiving a favorable review from the Metropolitian Council on other grant programs applied for. (Policy 39) B. Subsidized units can be used as a marketing tool to help questionable projects go that normally wouldn't. If we don't increase our goals , the projects that apply for subsidized units will not receive a favorable review. C. There is a waiting list for Sec. 8 housing and to increase our goal would demonstrate that Eagan is concerned for the public ' s needs. D. Although we accept the higher goal, the Council still has the last word on each new project. 2 . The HRA is willing to grant a new cooperation agreement to increase our allocation of scattered site new construction from 7 to 10 units. Eagan should do this for following reason: A. This would indicate to Metropolitian Council that we are responding favorably towards subsidized housing. 3 . What does Eagan want to see in the future with regards to the 1981 to 1984 housing plan? A. This shall require a decision as to what steps Eagan should take in the future towards fullfilling the needs of its citizenship in the area of subisdized housing. B. If we agree to an increase in the 1981 HAP, we _should be able to spread the next HAP in smaller increments. C. Eagan should keep the 1981 to 1984 HAP consistent with the HRA and Metropolitian Council 3 year allocation so as to help insure funding of projects the council approves of. 3� ATTACHMENT #1 Subsidized housing is available to eligible applicants in two (2) basic types : A. Rental Subsidies B. Subsidized Home Ownership The rental Subsidies Program is more commonly known as the "Section 8" Program. The Section 8 Program is designed to help low and moderate incomes. There are currently three (3) approaches to Section 8 funding: A. Leasing existing units B. New construction c. Substantially rehabilitated housing Rents may not exceed certain dollar amounts and the eligible house- hold is required to pay no more than 25% of its monthly income for rent. The Subsidized Home Ownership Programs are more commonly known as the "Section 235" Program and the "Affordable Homes Program" . The former program is a Federally-funded program and the latter is a State-funded program. Both are designed to offer limited home ownership to households in the moderate to lower-middle income levels. Of the two (2) types of subsidized housing, the more commonly used program is the Section 8 Program. This is due to tha lack of funds in the Home Ownership Programs. Both types of subsidized housing be offered as scattered site de- velopments. The Scattered Site Concept is an attempt to develop a mixture of income levels within a neighborhood or a community. This dis- persion of subsidized units throughout a community should insure better quality units and avoid some undesirable social complications . NOTE: It should be noted that the Metropolitian Council endorses the Scattered Site Concept for the above stated reason. The City of Eagan has enforced this endorsement by making a policy of accepting only Scattered Site Projects which are of no more than 20o subsidized units. 3 � 0 0 Agenda Information Memo January2, 1981 Page Fifteen AMUSEMENT DEVICE LICENSE D. Amusement Device License -- Action has been taken to enforce the Amusement Device License Ordinance #73 , and, therefore, eight (8) businesses have made application for amusement device license. The ordinance requires a ten p.m. closing time for operation of the amusement devices . At least four (4) of the applicants have requested a variance from the 10 p.m. closing to l a.m. to stay consistent with their other business practices . There was no spe- cific consideration given to the 10 p.m. closing when the ordinance was drafted other than a curfew for younger children. . It may be that the City Council desires an amendment to the hours for closing. These applications will be reviewed and given proper inspection prior to the meeting on Tuesday. Proposed amendments with a potential impact on a metropolitan system -- sewers, transportation, parks, airports -- would be reviewed within 90 days of receipt.
