is scheduled for Wednesday, June 24, 1981 , at 7 :00 p.m. at the
Eagan City Hall. This meeting was scheduled at the regular City
Council meeting held on June 16 , 1981 . The purpose of the meeting
is to discuss and consider the following items :

SUBJECT: SPECIAL CITY COUNCIL MEETING
RIDGECLIFFE_NEIGHBORHOOD_ PARK- MASTER- PLAN
Mr. Fred Hoisington of Brauer & Associates will be present to review
the neighborhood park master plan for Ridgecliffe Park with the
Advisory Park & Recreation Committee and City Council Members .
The purpose of the meeting is to review the proposed plan as recom-
mended by the. City Council and consider the topographic impact,
if any, of the plan that is under consideration. Assuming there
are no topographic impacts, the final drawings for the master plan
can be approved along with authorization given to U. S. Homes to
proceed with the grading and site development per the development
agreement.
PLUMBING- INSPECTOR
Approved in the 1981 budget was a new position in the inspection
department for a full time Plumbing Inspector. Justification was
discussed and defined during the budget process . The salary for
the new position was set at $18 ,000-20,000. Approximately twenty
( 20) applications were submitted to the City; initial screening
was performed by the Chief Building Inspector. The final four
(4) candidates were interviewed by a panel of three (3 ) consisting
of Severt Hendrickson, State of Minnesota Building Code Division;
John Gretz, Community Development Director of Apple Valley; and
City Administrator Hedges . The two ( 2) finalists, as a result
of the interviews, were carefully screened. The recommendation
of the City Administrator is to hire Mr. Bill Adams, who is a Master
Plumber with approximately twenty years of experience. Mr. Adams
resides in the City of Eagan at 2976 Burnside Drive.
1982- BUDGET
Normally, the City Administrator prepares a draft budget, which
is a collection of department head budgetary proposals to the City
Council in August. Each departmental request is reviewed and
adjusted by the City Administrator. This year, due to legislative
changes and the position of the Governor regarding municipal
revenue collections , it seemed appropriate to review budget
philosophy and objectives earlier in the budgetary development
process with the City Council . Attached is a copy of the budget
calendar as developed by the City Administrator. The City Adminis-
trator, with the cooperation of the Director of Finance, will review
preliminary revenue projections for the 1982 budget. Realizing
inflation is a major contributing factor to budgetary increases
for existing programs, both new and existing program objectives
sho d be di cussed in general by the City Council .

into preliminary City Budget complete with

August 1 , 1980: City receives information from State Department
of Revenue on levy limits and an estimate
of receipts from Local Government Aid.

September 18 , 1981: and conferences as required.
October 6 , 1981 : Resolution certifying tax levy is adopted.

DNR-LAKE- LEVEL-HEARINGS/CAPONI
Enclosed is a memo for your reference that reviews the DNR lake
level hearings held at City Hall during the past two ( 2 ) weeks .
PILOT- KNOB- ROAD PROJECT
Enclosed is a letter that was sent to all residents who live on
Pilot Knob Road between Yankee Doodle and I-494. Hopefully, the
letter, requested by Mayor Blomquist, will assure residents that
the various construction problems are under consideration by the
County and further that residents will call the appropriate County
official if they have a problem.
I-35E- Draft- EIS/ST. - PAUL
The City Administrator attended the final I-35E Coordinating Com-
mittee meeting in St. Paul on June 18. The Draft EIS is now com-
plete, defining the alternatives for construction of I-35E in St.
Paul . A copy of the EIS will be available for review at the special
meeting.
JOINT BURNSVILLE MEETING
A follow up meeting between administration of Eagan and Burnsville
is scheduled for Wednesday, noon, June 24. More to relate later
on any discovery of alternatives to the transportation and sewage
needs for planned developments along our corporate boundaries .

RE: Anthony Caponi vs. City of Eagan, Bonestroo, Carlson, Tilsen et al -
DNR Lake Level Setting Hearing
Dear Tom:
On Wednesday, June 17th, we completed five days and one evening of hearings before
Allan Klein, a Minnesota Hearing Examiner, which was held at the City Hall concern-
ing an Order of District Judge Bruenig that the DNR Commissioners set the ordinary
high water mark for Quigley Lake. The Judge issued his Order after a motion was
made by Mr. Caponi's lawyer to determine the OHW in the action being brought in
the District Court for $60,000 in damages due to the alleged setting of the outlet
at 851.16 which it was claimed is several feet higher than the normal high water
level of Quigley Lake.
We heard numerous witnesses from the DNR for Mr. Caponi, Arnold Carlson, Bob Rosene
and a large number of neighbors around the lake who testified during the course of
the hearing. Nearly every . neighboring resident favored retaining the level at the
present level, with Mr. Caponi requesting that the OHW be set approximately 2 to
3 feet lower. The Hearing Examiner has requested that briefs be submitted by all
parties by July 24th and that reply briefs then be submitted by all parties by
August 14th. He will then make a recommendation to the Commissioner of the Depart-
ment of Natural Resources, who will in turn make his decision. That decision can
be appealed to the District Court and, of course, ultimately to the Minnesota
Supreme Court.
Another issue of controversy is the question whether the natural outlet that was
dug in the form of a ditch in approximately 1916 was at 850.4 or lower. Mark Hurd
contour maps are somewhat unclear and a request has been made for a second deposi-
tion at the Mark Hurd office of one of the Mark Hurd employees who prepared the
1970 Mark Hurd two foot contour map involving additional expense to each of the
parties. Testimony of the City and of the DNR was that the man made ditch was
850.4 and the DNR generally requests that the storm sewer outlet be placed up to
1-1/2 feet lower than the OHW. It appears from the evidence that there is a pos-
sibility that the Hearing Examiner and the DNR Commissioner would set the OHW at
between 850 to 850.4 due to testimony from several of the witnesses. If this is
true and that level is ultimately determined to be correct, there would undoubtedly
be some damages that Mr. Caponi would receive in the District Court. Therefore, I

have been asked by several of the parties to determine whether there would be con-
tribution from the defendants for settling the case. Included in this proposed
settlement is a request by Mr. Caponi that he sell the approximately 3 to 4 acre
point along the West line of Quigley Lake that adjoins several of the private lots
lying on the East side of Dunrovin Lane.
I am sending a copy of this letter to all of the attorneys and would request that
they contact their clients for a determination as to any contribution that would
be made toward settling. I would expect from the discussion with Tom Rooney, Mr.
Caponi's attorney, that a cash settlement apart from the purchase of the point on
the West end of the lake would be accepted only in the area of $20,000 to $30,000.
I would appreciate hearing from each of the parties at the very earliest time so
that if there is a possibility of settlement, that we can avoid the next deposi-
tion and the briefing that will be required for the OHW setting, together with the
subsequent District Court action.

Re: Status-Report- for- the- Pilot- Knob Road; -Dakota County Project #31-05
Dear Pilot Knob Road Property Owner:
We have received a number of questions in recent days concerning
various details of the above-referenced project, and we will attempt
herein to answer some of the more general and frequently asked
questions .
The reconstruction of County Road 31 (Pilot Knob Road) , County
Road 26 (Lone Oak Road) , and County Road 28 (Yankee Doodle Road)
is being performed by the Dakota County Highway Department .
Because of this construction, it is necessary that various improve-
ments to the sanitary sewer, water and storm sewer systems be under-
taken. This work will be performed under the provisions on the
County's Contract 431-05) . Since this construction is under the
control and management of the County Highway Department and its
prime contractor, detailed questions concerning the project ' s
progress and schedule should be directed to the County Engineer,
Robert Sandeen, at 437-0398 or your District County Commissioner,
Mr. John Voss, at 890-2320.
The County has informed us that the progress of the work is
presently dependent upon the completion of the utility relocations
required by Northwestern Bell Telephone Company. Grade adjustments
to some of the existing sewer and water services have been completed
and a portion of the storm sewer system located north of Eagandale
Boulevard has been installed. The portion of Pilot Knob Road north
of Lone Oak Road is presently being graded. None of the instal-
lations of new sewer and water services has been completed. The
exact schedule and sequence of the remaining work is not firmly
established at this time. Because of difficulties being encountered
with the progress of the private utility work, highway department
officials have scheduled a second coordination meeting for all
of the various contractors and utility companies .

One of the problems encountered relates to the interruption of
mail service due to the construction work and the resulting dif-
ficulties associated with maintaining the required location and
height of the mail boxes in accordance with U.S. postal regulations .
Consequently, the postal carrier cannot always provide daily service
through the construction area. Subsequently, the appropriate County
Highway Department officials will meet with the post office person-
nel to develop an alternative plan to assure continued mail service
during construction.
A certain amount of inconvenience is unavoidable during a con-
struction project of this nature. However, we suggest that
residents experiencing problems regarding access , utility or mail
service interruption or other inconveniences contact the previously
mentioned County officials. If we can be of help in regards to
the final location and placement of the sanitary sewer, storm sewer
or water system, please call us .
