ADJOURNMENT MEMO TO: HONORABLE MAYOR & CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: JUNE 12, 1981 SUBJECT: AGENDA INFORMATION MEMO After approval of the June 2, 1981 City Council minutes and of the June 16, 1981 City Coupcil agenda, the following items are in order for consideration: WINNER ' The 1942 Chevrolet fire truck that was purchased from the University of Minnesota and used as the City of Eagan' s first fire fighting vehicle is being restored by members of the Fire Department. The restoration is being made possible through cash donations by various non-profit organizations and the business community. Members of the Fire. Department are donating their time and energy to make the restoration possible. The fire engine will be displayed and used in the Fourth of July Parade and will be available for inspection by the City Council at 6 :15 p.m. just prior to the June 16 , 1981 City Council meeting. Members of the Fire Department who are working on the restoration and members of the City Council will be available for pictures which will help in the publicity of the Fourth of July activities which are two to three weeks away. There is no action required on this item. R Approximately twenty (20) public improvement projects which are under construction require a public improvement bond issue. The projects are divided into five, ten and fifteen year assessments and therefore the bond sale is structured accordingly. The bond issue is estimated at $5,500,000. Due to some bid openings that were taken on Thursday, June 11 , 1981 , the final bond issue amount is being determined by the fiscal consultant. The fiscal consultant, Mr. Ernie Clark of Miller & Schroeder Municipals, Inc. , the Director of Finance and City Administrator have discussed the option of issuing three ( 3) year temporary bonds callable after one and one- half years until a long term bond issue is sold. A temporary bond issue would allow the City to watch the market and sell longer term bonds at a new interest rate, either higher or lower, in the future. This would require two bond sales which are added expenses for both a rating and a fiscal consultant and also places more administrative responsibility on the Finance Department. If the interest rates should be higher in the future than they are presently, then the City would have the responsibility of assuming additional expenses created by the higher interest rate due to Agenda Information Memo June 12 , 1981 Page Two the inability to reassess any of the twenty (20) projects . It is the recommendation of the City Administrator with concurrance of the Director of Finance that the City Council consider issuing long term bonds for the sale. The interest rate could run from 9. 75% to 10% depending on the market. More than likely, a three year temporary bond issue would be less in interest, approximately 9% to 9.25%. The average maturity of the -bonds being issued is currently at 7.141593 years . ' There will be a call feature on Feb. 1 ,1989 for bonds maturing in 1990 through 1998 at 101 and on Feb. 1, 1992 for bonds maturing 1993 through 1998 at par. The sale is scheduled for Wednesday, July 22, 1981 , which would require a special City Council meeting at 5 :00 p.m. to consider a bid award. ACTION TO BE CONSIDERED ON THE MATTER: To authorize Miller and Schroeder Municipals, Inc. , to proceed with a bond sale for Wednes- day, July 22 , 1981 , at 12 :00 noon for an amount to be determined prior to June 16, 1981 . (The amount is estimated at $5,500,000. ) FIRE DEPARTMENT A. Fire Department -- There are no items for consideration by the Fire Department at this time. POLICE DEPARTMENT B. Police Department -- There are no items to be considered for the Police Department at this time. PARK DEPARTMENT C. Park Department -- There are no items to be considered for the Park Department at this time. PUBLIC- WORKS DEPARTMENT D. Public Works Department - Carol Lindo, who resides at 2125 Kings Road, has requested time to appear before the City Council at a regular meeting to address her special assessments relating to streets and utilities for four lots in the Vienna Woods Addition. The final assessment hearings were held in 1980 and there is no action that can be taken by the Special Assessment Committee. The assessments were levied per project costs and agreements as outlined between Mrs. Lindo and the developer, Marvin Bump. The Z Agenda Information Memo June 12, 1981 Page Three City staff has spent considerable time with Mrs. Lindo explaining the special assessments, how they relate to her property and the City Administrator has met with her on her property to further discuss the matter. Mrs. Lindo has requested a few minutes to address the overall issue with the City Council . Mrs. Lindo was originally scheduled to appear on the June 2 , 1981 City Council agenda; however, due to the length of the agenda, she was continued until June 16 and she has requested that there be no further con- tinuance. Mrs. Lindo has been advised of the length of the agenda and will make her comments as brief as possible. There is no action to be taken on this matter. MRS CAROL LINDO r 2125 KINGS RQAD EAGAN MN 55122 Re: Special Assessments Relating to Contracts 79-5 and 79-15 (Streets and utilities) Lots 9, 10, 11 and 32, Block 2, Vienna Woods Addition Dear Mrs. Lindo: It has been brought to my attention that you would like additicnal clarification per- taining to the assessments associated with the above-referenced contracts as they were assessed against the above-referenced lots under your ownership. As you may recall, the developer of the Vienna Woods Addition agreed to pick up the street assessments associated with Lots 9, 10 and 11 of Block 2. This agreement was dated April 16, 1979 and was executed by Mr. Marvin Burp, a general partner of B & K Properties Co. Mr. Bump has indicated to the City of Eagan that he will, in fact, pay the street assessments associated with Lots 9, 10 and 11, Block 2, Vienna woods Addi- tion which are currently under your ownership. This means that Mr. Bump will be respon- sible for $8,104.20 of your overall total street assessments which will reduce your overall total assessment obligation to $22,834.05. These figures represent the principal only, and do not include any interest that may acoxmlate on any remaining unpaid balance during the progression of the 10-year in- stallra-nt period that the assessment was spread over. Mr. Bump has indicated his concurrence and agreement to paying the $8,104.20 of street assessments associated with your lots. Hopefully, this helps to clarify sane of the questions I understood that you had pertaining to your assessments and their relation- ship to the agreement entered into by the developer of the Vienna Woods Addition. July Conditional Use Permit Renewals -- Three ( 3) conditional use permit renewals are in order for consideration. 1 . Inver Grove Heights Dispatching Fees at 50¢ per capita for dispatching fire services . The action in renewing this conditional use permit will only grant a renewal for ,six (6 ) months, terminating the conditional use permit for Inver Grove Heights effective December 31 , 1981 . This is a result of the contract that was approved at the 6-2-81 City Council meeting. 2. George Becker for a group type foster home at 3890 Lexing- ton Avenue South. 3. Jerry Thomas for a horse ranch at 4889 Pilot Knob Road. All three conditional use permit renewals are in order for con- sideration. ACTION TO BE CONSIDERED ON THE MATTER: To approve the annual re- newal for George Becker and Jerry Thomas and a six month renewal for the City of Inver Grove Heights for the conditional use purposes as described above. EAGAN HOCKEY- BOOSTER -- GAMBLING LICENSE B. Temporary Combination Gambling License for Eagan Hockey Boosters (July 3-5, 1981) for the Fourth of July Celebration -- A combination license for the Eagan Hockey Boosters , a non-profit organization, was applied for by Anthony Lancette. The combination license is to be used for certain games planned for the. July 4th celebration at Rahn Park. There are 251 prizes totalling $500. The gambling license is to be granted for July 3 , 4 and 5 , 1981 . Mr. Lancette was designated as the gambling manager by the Eagan Hockey Boosters group. Temporary Non-Intoxicating Malt Liquor License for Cedarvale Lanes, Softball Tournament at Univac Field, August 22-23, 1981 -- An application was submitted by Randy Spring, representing Cedar- vale Lanes , to sell non-intoxicating malt liquor at Univac Field on August 22 and 23, 1981 fo'r a softball tournament. The applica- tion is in order for consideration. The application has received a favorable review from the Chief of Police. ACTION TO BE CONSIDERED ON THE MATTER: To approve the non-intoxi- cating malt liquor license for Cedarvale Lanes in the name of Randy Springs for August 22-23 at Univac Field. FOURTH OF' JULY ASSOCIATION CONTRIBUTION D. Eagan Fourth of July Association Contribution -- A letter was received from the Eagan Fourth of July Association requesting a monetary contribution to assist in the Eagan celebration scheduled for July 3, 4 and 5. A copy of the letter is enclosed on page - A $500 contribution was budgeted under Miscellaneous , Mayor and- -Council , for 1981. A $500 contribution was given to the Eagan Fourth of July Association in 1980. ACTION TO BE CONSIDERED ON THE MATTER: To receive the feasibility report for Project 335 and authorized the public hearing to be held on July 21 , 1981 . PROJECT 337 O. Project 337, Receive Feasibility Report & Order Public Hearing (Univac Semi Conductor Utilities) -- On May 5, 1981 , the City Coun- cil received a petition from Sperry Univac and also ordered the preparation of a feasibility report for the installation of sanitary sewer and water main facilities for the new semi conductor complex under construction. This report is now complete and is being pre- sented to the City Council for consideration. ACTION TO BE CONSIDERED ON THE MATTER: To receive the feasibility report for Project 337 and order the public hearing to be held on July 21 , 1981. PROJECT 339 H. Project 339, Receive Feasibility Report & Order Public Hearing (Brown's Lake Outlet) -- At the May 19 , 1981 , the staff requested authorization to prepare a feasibility report for the installation of a trunk storm sewer lift station and outlet from Brown' s Lake, 1 0 • Agenda Information Memo June 12, 1981 Page Seven adjacent to the Beacon Hill Addition. The report is now complete and is being presented to the City Council for review. ACTION TO BE CONSIDERED ON THE MATTER: To receive the feasibility report for Project 339 and authorize the public hearing to be held on July 21 , 1981. 'PROJECT 343 I. Project 343, Receive Petition/Order Feasibility Report (Briar Hill Fouth Addition) -- The City has received a petition from Tot— lefson Development Company requesting the installation of streets and utilities to the second phase of Briar Hill Fourth Addition for streets and utilities . ACTION TO BE CONSIDERED ON THE MATTER: To receive the petition and authorize the preparation of a feasibilty report for Project 343 (Briar Hill Fourth Addition Streets& Utilities ). PROJECT 344 J. Project 344, Receive PetitionlOrder Feasibility Report (Winkler/ Jackson Addition) -- The City has received a peittion from Richard Winkler requesting the installation of sanitary sewer extension to service the proposed first addition of the Winkler/Jackson plat. A work order will not be issued by the Director of Public Works unless preliminary plat approval is given by the City Council for the Winkler/Jackson First Addition. ACTION TO BE CONSIDERED ON THE MATTER: To receive the petition and order a feasibility report for Project 344 (Winkler/Jackson 1st Addition Sanitary Sewer) . CONTRACT 219 K. Contract 219 for Authorization of Final Payment & Accept Project of Duckwood Drive Grading - The City has received a request for final payment through the consulting engineering firm along with a statement of compliance with the plans and specifications. All inspections have been performed and found acceptable. All costs associated with the final payment have been previously assessed. ACTION TO BE CONSIDERED ON THE MATTER: To authorize final payment in the amount of $14,390.90 to Husting and Engstrom, Inc. , for Contract 219 and accept for perpetual maintenance. 0 1 1 • Agenda Information Memo June 12, 1981 Page Eight ASTLEFORD - REVIEW EXCAVATION PERMIT L. Review Excavation Permit (M.G. . Astleford for 35E and Co. Rd. 32 -- With the pending improvement and construction of I-35E south of Cliff Road, Mr. Astleford has submitted an application for a grading permit for approximately twenty ( 20) acres of land located between I-35E and Cliff Road West of the existing Galaxy Avenue. The detailed grading, drainage and pollution control plans have been submitted, reviewed and approved by the Director of Public Works. It is anticipated that the required performance bond and insurance certificates will be submitted prior to the City Council meeting on June 16 . ACTION TO BE CONSIDERED ON THE MATTER: To approve the excavation permit for the Astleford property. CONTRACT,8O-15 M. Change Order #2, Contract 80-15 (Silver Bell and Deerwood Streets) -- This contract provides for the construction of three (3) separate projects for east Deerwood Drive by Pilot Knob Road, west Deerwood Drive by Blackhawk Road and Silver Bell Road north of T.H. 13 . This change order consists of three parts : Part- A Project 273 (east Deerwood Drive) -- During con- struction of theis improvement, it was necessary to remove, clean and relay the existing culvert within the Pilot Knob Road ditch section (add $735. 53 ) . Part- B- - Project 277 (west Deerwood Drive) -- Because this project requires the placement of a bituminous overlay to match an existing curb and gutter section on the north side, certain portions of the existing bitumi- nous surface were removed and patched to provide for the proper elevation of the new overlay (add $992 .45) . Part C - Project 274 (Silver Bell Road) -- In order to match the recently improved construction of Silver Bell Road performed by MnDOT, the City's contractor was required to perform minor modifications to the existing bituminous surface to provide for the proper transition of grade and cross slopes (add $518.15 ) . The net result of this change order provides for an addition of $2 ,246.13. All costs associated with this project will be computed in determining the final assessment figures . ACTION TO BE CONSIDERED ON THE MATTER: To approve Change Order #2 to Contract 80-15 in the amount of $2,246.13 . 9 0 Agenda Information Memo June 12 , 1981 Page Nine CONTRACT 80-11 N. Contract 80-11 for Final Payment/Acceptance (Brittany Second & Third Addition Utilities) -- The City has received a request for final payment from the contractor through the consulting engineering firm along with a certification of compliance with plans and specifications for final tests and inspections as verified by the Public Works maintenance division. Final construction costs associated with the project result in an approximate 10% underrun as compared with the contract estimate. ACTION TO BE CONSIDERED ON THE MATTER: To approve the fourth and final pay request for Contract 80-11 to Thomas Montgomery Construc- tion in the amount of $11 ,601 . 27 and accept for perpetual main- tenance. CONTRACT 80-22 0. Contract 80-22, Final Payment/Accept Project (Cedar Cliff Third Addition Utilities) -- The , City has received a request for final payment from the contractor through the consulting engineering firm along with a certification of compliance with plans and speci- fications in addition to all tests and inspections being verified by the Public Works maintenance division. Final construction costs of this contract resulted in a 1.4% underrun of the revised contract amount. All costs associated with this project will be assessed to the benefited properties in the future. ACTION TO BE CONSIDERED ON THE MATTER: To approve the third and final pay request for Contract 80-22 for Cedar Cliff 3rd Addition to Sandmark Construction, Inc. , in the amount of $7,255. 70 and accept for perpetual maintenance. CONTRACT 80-30 P. Final construction costs associated with this contract result in an approximate 9% underrun from the revised contract amount. All costs associated with this project will be assessed against the -benefited property owners in the near future. Project 302, I-494 Storm Sewer Outlet (O'Neil Pond) -- With the pending construction of I-494 from the Minnesota River to the interchange with I-35E, it would be appropriate to provide for the trunk storm sewer outlet' from O'Neil Pond (FP-1 ) that has been previously reviewed in detail with the City Council concerning the gravity outlet vs. a lift station and force main similar to the Blackhawk Lake Outlet. By providing for the installation of this trunk storm sewer at this time, considerable cost savings will be realised due to financial cost participation by MnDOT and the use of their right-of-way prior to the construction and comple- tion of I-494. Due to these reasons, the detailed feasibility report was presented to the Council for review at the May 5, 1981 City Council meeting. The public hearing was previously scheduled for June 2 , 1981 ; but due to omission of certain parcels as provided by the consulting engineer for the public hearing notification, it was continued until the June 16, 1981 meeting. All affected property owners to be assessed by this improvement have been legally noticed with a notice also being placed in the legal newspaper. The Director of Public Works and consulting engineering firm have held two ( 2 ) informational meetings on May 27 and June 4 to explain in detail the reasons for the project and the estimated assessments associated with the improvement. It is anticipated that major objections to the project will be submitted by the new owners (Laukka-Beck, Inc. ) of the old Dayton Hudson property and also the owners of the Granville House (Old Ames Estate) . The apparent reason for objection relates to the premature levy of assessments prior to the development of their property. Because of the tight time schedule of -MnDOT for the construction of I-494, it is neces- sary for this project to be ordered in at the June 16 meeting if the cost articipation bL MnDOT is to be. realized. Olson I-494 and I-35E Drainiversary' , Pond FP-1 Outlet Project No, 302 A� Eagan, Minnesota r ' April 28, 1981 SCOPE: This project covers the construction of a storm sewer outlet from Pond FP-1 located in the NE 1/4 of Section 2 and the extension of this outlet with- in 1-494 right-of-way to the Minnesota River. This is a joint project between the Minnesota Department of Transportation and the City of Eagan. FEASIBILITY AND RECOMMENDATIONS: This project is feasible and is in accor- dance with the Master Plan for Storm Sewer for the City of Eagan. It can best be carried out as a joint project. The Minnesota Department of Transportation will carry out the construction of these improvements with the City of Eagan sharing in their cost for benefits to areas of Eagan outside of the highway right-of-way and within the drainage area. DISCUSSION: The storm water drainage from the interchange of I-494 and I-35E as well as adjacent highway and other developments flows to Pond FP-1 as shown in the Eagan Storm Sewer Master Plan. The expected large increase in flow will necessitate the installation of an outlet to this pond during the con- struction of the highways to avoid flooding adjacent property from the in- creased runoff. A comprehensive preliminary report dated May 28, 1980 detailed the need for this pond outlet and discussed two types of construction with re- lated cost estimates. The first covered the installation of a large lift sta- Page 1. 3839a K tion and force main as shown in the 1978 Storm Sewer Master Plan. The second method covered the installation of a deep gravity storm sewer outlet lying within the right-of-way of I-494. This latter method had been considered in 1973 and in 1978 but was considered economically infeasible due to the extreme depths of the line involved. Recent improvements in the art of tunneling plus the very rapid increases in the cost of energy needed for the lift station al- ternate combined to show that, the life time construction costs of the gravity line were much less expensive than the lift station alternate. After careful review of the alternatives and their costs, the Minnesota Department of Transportation, City Council and Federal Highway Administration mutually concurred with the installation of the gravity outlet. Cost estimates for the gravity outlet alternative were prepared by the Mn/DOT Hydraulics Division with the cost of participation based upon the per- cent of peak flow capacity required by the respective drainage areas for each part of the system. The resulting trunk storm sewer outlet from Pond FP-1 will provide ade- quate capacity for all of the highway runoff as well as future storm sewer discharges into FP-1 from the Eagan trunk storm sewer system. The Mn/DOT drainage plan has provided capacity for the agricultural runoff from certain drainage areas in Mendota Heights through their system. This drainage is accommodated by the Mn/DOT share of the cost of the outlet at no additional cost to the City of Eagan. As a part of the negotiations with Mn/DOT relative to existing and pro- posed drainage, it was agreed that this proposed trunk storm sewer would in- tercept and perpetuate the discharge from the existing 54" diameter storm sewer in the Eagandale Center Industrial Park without additional cost to Eagan. Page 2. 3839a 1 A special ponding area is being required by the Minnesota Department of Natural Resources in the Fort Snelling State Park. The cost of this special pond and overflow system from this pond to the Minnesota River within the Fort Snelling 'State Park will be the total responsibility of Mn/DOT without partic- ipation by the City of Eagan. This pond and overflow system is estimated to cost approximately $300,000.00. The cost of the Eagan share of this construction is expected to be paid for from trunk area assessments to benefited property in Eagan within the drainage area served. Assessments will be levied for the trunk area oversize charge for the area involved based upon the current zoning and/or land use of the land involved, all in accordance with the current assessment policy. Also included are the gravel base and surfacing of the streets within this first phase. FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance with the Master Utility and Street Plans for the City of Eagan. The project as outlined herein can best be carried out in two contracts. Cocntract I would include the construction of all the utilities as well as the aggregate base on the street located in Phase One. Contract ll would consist of the construction of the concrete curb and gutter and bituminous surface on this street which will be named Golfview Drive. DISCUSSION: CONTRACT I A. Sanitarx Sewer: An existing 12" R.C.P. sanitary sewer is located on the south side of Yankee Doodle Road adjacent to Tomark, a 10" diameter sewer lat- eral will connect to this existing trunk and will be constructed in the south boulevard of Yankee Doodle Road and in Golfview Drive in Phase One of Tomark. The two 72 unit apartment buildings which make up Phase One will receive ser- vice from this 10" diameter sewer. This lateral will provide service to prop- erty to the south and east as this area develops as well as to future Tomark Development. Page 1. 4094a s[4- t B. Water Main: An 1.8" diameter water trunk is in place along the south side of Yankee Doodle Road across the Tomark Addition. An 8" diameter lateral will be constructed within Golfview Drive to provide service to Phase One and will eventually follow the Golfview Drive alignment through future Tomark Additions and connect to the 18" diameter trunk in place on the west side of Lexington Avenue. Hydrant leads and 6" diameter services to the two large apartment buildings in Phase One will connect to the 8" diameter lateral. Water pres- sures in Phase One of Tomark will range from 55 psi to 65 psi static pressure. C. Storm Sewer: The storm sewer pond shown on the Master Plan as DP-10 is lo- cated within the Tomark Addition. Catch basins on Golfview Drive near Yankee Doodle Road and a storm sewer lateral in the south ditch of Yankee Doodle Road leading to DP-10 will drain Phase One. The construction of a storm sewer trunk draining DP-10 to a larger pond, DP-5, was discussed in the preliminary report for the O'Leary Lake outlet, Project 322. D. Street Construction: Golfview Drive is a proposed street to be constructed on a 60' right-of-way platted within Tomark. The developer of Tomark will grade this street to a subgrade condition as a part of the site grading of the plat. After the installation of utilities, a 6" aggregate base will be con- structed on Golfview Drive. CONTRACT II E. Street Surfacing: The surfacing of Golfview Drive includes the construc- tion of a 5 ton street, 32' wide with B618 concrete curb and gutter. Contract II construction consists of completing the aggregate base and installing the curb and gutter and bituminous surfacing. Also included are topsoil and seed for the boulevards of Golfview Drive. Wpm niY�11IVer Preliminary Report on r-:,AA'' Overhill Farm Addition Project 332 Hay Lake Trunk Sanitary Sewer - Project 321 Eagan, Minnesota May 12, 1981 SCOPE: This project provides for construction of sanitary sewer, water main, storm sewer, and streets within Overhill Farm Addition. Overhill Farm Addi- tion comprises of 49 single family lots and 7 double family lots. To provide sanitary sewer to Overhill Farm Addition requires the construction of trunk sanitary sewer adjacent to the south shore of Hay Lake (Pond LP-31). The Hay Lake Trunk Sanitary Sewer is therefore included as part of this pre- liminary report. FEASIBILITY AND RECOMMENDATIONS: The project is feasible and in accordance with the Master Utility and Street Plans for the City of Eagan. The project as outlined herein can best be carried out as two contracts. Contract I pro- vides for the construction of the Hay Lake Trunk Sanitary Sewer, utilities within Overhill Farm Addition, and the placement of an aggregate base on a properly prepared subgrade within Overhill Farm Addition. Contract II pro- vides for the construction of the remaining portion of the aggregate base and bituminous surface in conjunction with concrete curb and gutter in Overhill Farm Addition. Page 1. 4042a DISCUSSION: CONTRACT I I. SANITARY SEWER (HAY LAKE TRUNK) : The Hay Lake Trunk Sanitary Sewer is an 18" RCP sanitary sewer constructed adjacent to Hay Lake. The sanitary sewer will connect to an existing sanitary sewer at Dodd Road and Wilderness Run Road and end at the proposed trunk sanitary sewer included as part of the pre- liminary report for South Oaks Storm Sewer Project 327. The sanitary sewer will be constructed at a ground elevation of approximately 910 which is the high water level for Hay Lake. The invert elevation of the sanitary sewer ranges from 895 to 897. II. SANITARY SEWER (OVERHILL FARM ADDITION) : An 8 inch sanitary sewer is proposed on the centerline of streets within Overhill ' Farm Addition. The sanitary sewer will connect to the proposed trunk sanitary sewer located on Hay Lake Road as outlined in the preliminary report for South Oaks Storm Sewer Project 326. III. WATER MAIN: A 6 inch water main is proposed to be constructed within the Overhill Farm Addition as indicated on the drawing at the back of this re- port. The water main will connect to an existing 16 inch water main located on Dodd Road with a future extension into South Oaks Addition. IV. SERVICES: This construction provides for the installation of sanitary sewer and water main services 15' past the property line. Sanitary sewer ser- vice is 4 inch and water main service is 1 inch. V. STORM SEWER LATERALS: Storm sewer laterals proposed herein are presented on the drawing at the back of this report. Storm sewer proposed herein pro- vides drainage from low points located within street right-of-way. STREET (SURFACING) : This construction provides for the placement of the remaining portion of the aggregate base and the bituminous surface in conjunc- tion with surmountable concrete curb and gutter for a 32' 5-7 ton residential section. ASSESSMENTS: Assessments for sanitary sewer, water main, services, storm sewer, and streets within Overhill Farm Addition are proposed to be levied against the benefited property. A preliminary assessment roll is included at the back of this report. Lateral benefit from trunk for sanitary sewer and storm sewer included as part of Project 326 (South Oaks Storm Sewer) will have. to be included to determine the total assessable cost per lot within Overhill Farm Addition. Final assessment rates for construction of lateral facilities will be determined by final costs and be assessed to each benefited property. Trunk sanitary sewer and trunk water main have been assessed for this area as part of Project 241. There is presently a pending assessment for this area for trunk storm sewer as part of Project 326. Mayhew Project in the Amount of $525,000 -- A public hearing has been officially noticed in two (2) newspapers to consider an application for industrial revenue financing as proposed by Edward H. Mayhew, a sole proprietorship. The amount of the industrial revenue financing requested is $525,000. It is estimated that 35 new jobs will be created at an estimated payroll of $875,000. Mr. Mayhew is planning to develop, construct and own the John Henry Foster Company Building, a 16,000 square foot office/warehouse building upon its completion. This office/warehouse building site is planned for a platted and properly zoned lot located at the southwest corner of Apollo Road and Mike Collins Drive in Eagandale Industrial Park. The first phase of the construction is for a 16,000 square foot facility with a second phase expansion 'Within five (5) years of an additional 6,000 square feet. A site plan and concept plan were given to the City Planner on May, 8, 1981 and he has completed his review- of the plans . RUNKLE, CITY PLANNER DATE: JUNE 12, 1981 RE: THE MAYHEW SITE PLAN REVIEW FOR INDUSTRIAL REVENUE BONDS The Mayhew site is located on Lots 3, 4, 5, and 6, Block 4, Eagandale Center Industrial Park #3. 'Therefore, the subject parcel is platted and would allow an industrial building. The subject parcel contains approximately 3.5 acres and the building proposed contains 17,024 square feet for a total of 11% lot coverage. The proposed building meets all setback requirements according to Ordinance 52 and the parking spaces design contains 10 x 20' spaces. There is additional space to the west which would allow expansion in the future if and when development would occur. At the present time, the proposed site plan meets all City ordinances, and if industrial revenue bonds were not re- quested, City staff could issue this permit as the building is proposed. The detailed plans for the exact number of parking spaces and landscape plan will be required at the time the applicant applies for the building permit. Assessment Hearings -- There are twelve (12) assessment hearings scheduled for final consideration and acceptance by the City Coun- cil . Most of. the projects are developer oriented projects and there should be little discussion. Attached is a summary sheet of the various projects that were installed under a number of different contracts that are ready for final assessment on Ipage *I. The rates that are shown are representative of the "typical, average" assessments for the various types of improvements ( streets , utilities, storm sewer, gravel base restoration, grading and related) . Figures noted by an asterisk imply that a residential equivalent for lateral benefit rate is being applied. Because all lots are not always assessed uniformly, individual property owners assessments should be looked up separately on the large worksheets which are available in the assessment clerk' s office. The City' s consulting engineer, Bob Rosene, and the Public Works Director will be available to answer questions pertaining to the construction or the assessments as levied. It should be noted that, in several cases, certain property owners have already received a deferment approval previously by the City Council . However, the City legally noticed the property of the assessments so that they can be legally recorded as an assessment which has been deferred. Several property owners may object to receiving the notification after approval of deferment by the City Council . Following the summary sheet are ten : (10) pages that outline the improvements installed and assessed with the rate used for assessment calculation. Also on each project breakdown sheet is the number of parcels affected, years assessed, rate of interest, total amount assessed and the contract the project was constructed under. The City Administrator and Director of Public Works will provide information on each of the twelve assessment hearings as outlined. Al Harp for a Conditional Use Permit to Allow Outside Storage Located on Lot 4, Block 2, Halley' s 1st Addition -- A public hearing was held by the Advisory Planning Commission at their May 26 , 1981 meeting. The public hearink was held to consider an application submitted by Al Harp requesting a conditional use permit to allow outside storage located on Lot 4, Block 2, Halley' s First Addition. The APC is recommending approval of the conditional use permit to the City Council . This item was scheduled on the June 2, 1981 City Council agenda, however, continued until the 6-16-81 meeting due to the absence of the applicant. For additional information on the matter, please refer to the report as prepared by the City Planner found on pages 73 through 77 of the June 2, 1981 City Coun- cil packet. For action that was taken by the APC, refer to the minutes enclosed on page - '1. ACTION TO BE CONSIDERED ON THE MATTER: To approve or deny the recommendation of the APC for approval of the conditional use permit as stated. 07 Z AL HARP OUTSIDE STORAGE -- HALLEY'S 1ST ADDITION i The public hearing regarding the application of Al Harp for conditional use permit to allow outside storage on Lot 4, Block 2, Halley's 1st Addition was then convened by Chairman Joe Harrison. Mr. Al Harp was present and it was noted that the property is currently zoned I-1 with Land Use Plan indi- cating R-2 mixed residential. It was noted Mr. Harp's present place of busi- ness on Dodd Road has received complaints concerning noise generated and storage of materials and Mr. Harp has now constructed a building in Halley's Addition. Lot coverage would be 9.4% and it is proposed that the entire area would be enclosed with security fencing. Several neighboring residents appeared, some of whom objected to the proposal for outside storage of paint products noting Mr. Harp is in the tennis court painting business, and stating that there is inadequate fire protection without City water. There is also no City sewer available and further the railroad right-of-way has caused fire danger in the past. Water runoff was stated as another problem without storm sewer in the area. Mr. Ed DuBois, a current neighbor of Mr. Harp, appeared and favored the change. Gits moved, Bohne seconded a motion to recommend to the Council that the application be approved subject to the following conditions: 1. That Mr. Harp sign an agreement drafted by the City Attorney that he will not object to his fair share of assessments for utilities once the utilities are approved for this addition. 2. A detailed landscape plan shall be submitted showing the screening around the outside storage area and shall include an adequate landscape bond to be released no sooner than one year after landscaping is completed to the approval of the staff. 3. Storage shall not be allowed to exceed the height of the fence. 4. The parking area shall have an asphalt surface and concrete curbing put around the perimeter of the parking area. 5. Dust control measures shall be used periodically on the outside storage area. 6. Storage shall only be allowed within the area designated by a fence. 7. All of the equipment and materials that are presently being used for his business shall be relocated to Lot 4, Block 2, Halley's 1st Addition. Stuke for a Conditional Use Permit for On-Sale 3.2 Beer License and Amusement Device License -- A public hearing was held before the Advisory Planning Commission at their May 26 , 1981 meeting to consider two (2 ) applications submitted by Richard E. Stuke. The first conditional use permit to allow an indoor recrea- tion center for the building which was originally constructed for the Jerry Lewis Theatre and more recently used as the Juke Box located in the Cedarvale Shopping Center area was recommended for approval by the APC and given approval by the City Council at the June 2 , 1981 meeting. A second request for an on-sale 3. 2 beer license was also given consideration by the City Council at the June 2, 1981 meeting. There were a number of concerns raised by the City Council regarding that request. Those concerns have been addressed by the City Staff along with Mr. Stuke. Enclosed is a copy of a site plan that illustrates how the recreational center and recreational sales are pro osed within the building. This site plan is enclosed on page - $ . On page , for reference, also enclosed is a copy of a memorandum from-0ity Planner Runkle that addresses various issues regarding the 3. 2 on-sale beer license request as proposed for the recreation center. A second application for an amusement device license is also in order for consideration. Mr. Stuke is proposing to locate 13-14 amusement devices within his recreation center. RUNKLE, CITY PLAINER DATE: JUNE 11, 1981 RE: ADDITIONAL INFORMATICN ON THE 3.2 BEER AND WINE APPLICATION SUBMITTED BY EtJ= STUKE Since the City Council Meeting of-June 2, 1981, City staff has met with Mr. Stuke to explain the concerns that the City Council has in regard to grant- ing the 3.2 beer and wine application for this type of facility. Staff has also reviewed the amusement device ordinance, and according to this ordi- nance, a conditional use permit is not required for machines, but each of the machin%will have to be licensed with the City of Eagan. Therefore, the remark made at the City Council Meeting regarding an additional conditional use permit was incorrect. Therefore, the only item left for discussion is the conditional use permit to allow 3.2 beer and wine for Mr. Stuke's re- creational facility. As mentioned earlier, staff has met with Mr. Stuke to look at alternates of how the area could be divided off so 3.2 beer could only be allowed in cer- tain locations. Mr. Stuke had indicated that it would be impractical to partition part of the recreational facility off in order to restrict or not to restrict the beverages. Mr. Stuke indicated that it would be difficult to have one person watch the entire facility if this were to be the case. The option Mr. Stuke is proposing is to request the conditional use permit to allow 3.2 beer and wine at his facility, and he would limit or restrict the age of anyone under 19 years of age would not be allowed in this recrea- tional facility. Therefore, no partition or separation would be required frau minors vs. adults in this facility if the age was restricted to 19, and then 3.2 beer and wine could be served in the entire facility. The last concern of the City Council was in regard to how many amusement devices Mr. Stuke was planning to put in the recreational facility. He stated that the garage site had been graded 20 years ago and had-not been built; further, that substantial excavation and removal of three to five trees would be required if the vari- ance were not granted for the construction of a garage. The neighboring property owner has about the same garage setback and Mr. Witt stated that he would place the garage at the same setback as the next door neighbor. Richard Winkler for Preliminary Plat of Winkler/Jackson Addi- tion -- A public hearing was held before the Advisory Planning Commission at their regular meeting held on April 28, 1981 . The APC continued the hearing until the May 26 , 1981 meeting to allow the City staff time to work on additional studies . Action was taken by the APC to recommend_ denial of both the rezoning and pre- liminary plat to the City Council at the May 26, 1981 APC meeting. At the June 2, 1981 meeting, the rezoning with various changes as originally recommended was approved by the City Council. Fol- lowing the action that was taken for the rezoning, there was much discussion in the audience; and with the number of people who were leaving the City Council chambers and due to a several minute delay betweenagenda items, it was discovered that the developer had left and the preliminary plat for the Winkler/Jackson Addition was no longer present for review. Therefore, action was taken to continue the preliminary plat of Winkler/Jackson Addition until the 6-16-81 meeting. The preliminary plat consists of the following: Lots 1-5, Block 1 have been designated as a limited business district. The 5 lots contain 8.9 acres. Lot 6, Block 1 has been designated as multiple with a density of 14 dwelling units per acre. Lot 6 consists of approximately 10.2 acres. Outlot A of the plat has been designated as park and consists of approximately 4.4 acres. Lot 1-6, Block 2 contain 1.95 acres and have been designated as R-1 (Single Family use) . Lot 1, Block 3 contains 7.74 acres and has been designated as neighborhood business district. Outlot B at this present time contains the 44.7 acres, and the area which was shown as limited business which contains 8.6 acres for a total acreage of 53.45 acres. This 53.45 acres had been designated as an R-3,or townhouse use,with a maximum density of 5.5 dwelling units per acre. The outlot mentioned here will be replatted and go through the public hearing process once the layout and the design have been prepared for Outlot B. Thursday, May 21 , 1981 , the official bid opening was held at City Hall to receive bids for the purchase of a 1981 road grader. As stated in the last City Council information, this itft of equipment is a major expenditure and therefore a detailed report analyzing the bids and comparing the various machines bid in addition to reviewing the dollar amounts was performed by the Public Works Director. The Director of Public Works and Superintendent of Public Works have spent considerable time attempting to design and purchase the best piece of equipment suitable for municipal work. The Director of Public Works has outlined some of the major reasons why the staff is recommending the purchase of a John Deere 670A. There are many more technical reasons after analyzing the bids as to why that piece of equipment is best suited . for work to be performed by the City of Eagan. The cost of a road grader is significant and each of the suppliers would like very much to be granted the bid award by the City Coun- cil . If the John Deere 670A submitted by Valley Equipment is awarded by the City Council, the major reasons as well as technical reasons would be provided to the City Attorney for substantiation as to why the low bid was not accepted and recorded in the official minutes . Because this is a major equipment acquisiticn for the Public Works Department of the City of Eagan, the detailed analysis of the bids received is presented in this report along with a recommendation with bid award. BAGiC=U',1Z INFOPtiSATICN In the 1980 budget, a provision was made whereby a new road grader would be purchased for the Public Works Maintenance Division to be funded through the sale of equipment certificates. " This new acquisition was to increase our maintenance fleet as it pertains to gravel road maintenance and snow removal. The existing road grader presently in use is a 1965 Wabco straight-frame road grader. During the past 5 years, the Maintenance Division has experienced greatly increased major repair costs to this existing road grader by way of trans^.ission overalls, engine replacements, etc. With this new acquisition, this existing 1965 Wabco will perform as a secondary and backup unit to be disposed of as the need diminishes or completion of its useful life. SPECIFICATIONS The Superintendent and the Director of Public Woks Department reviewed the capabilities of our existing road grader, analyzed its shortcamings and re- searched other similar cccrunities to determine the size and type of road grader that would best service the existing and growing needs of the City of Eagan. The new road grader specified is an articulated machine which pro- vides for a pivoting moverent at its midsection which allows the grader to operate in smaller, confined areas where rigid frames cannot be used (i.e. shoulder grading, cul-de-sacs, etc.) . After determining the proper size, contact was made with various local dealers to review the type of equignent they had available. Based on this information, a detailed set of specifi- cations were compiled listing the minimum and best requirements to meet the City's needs. Review of the specifications used in the recent acquisition (12-15 months) of similar models by other axmnmities (Lakeville, White Bear Lake, Burnsville, etc.) , in addition to discussions with cammimities pre- sently using the different makes and models available provided the necessary and adequate input used to prepare these specifications. TOTAL COST BID The actual cost of owning a major piece of heavy equiprment by a city not only reflects the actual purchase price paid, but the cost to own and aper- ate that piece of equipment over a period of -time. As the Council may re- call, this "total cost bid" concept was used in the bid proposals for the recently acquired tractor/backhoe. It has long been realized that a moiler- e . r Bid Review - 1981 Articulated Motor Grader with Wing June 1, 1981 Page two ately designed,or built piece of equiFrent,requires more maintenance during its life, and is subsequently worth less money at its end salvage value than a higher-quality machine. Subsequently, the best financial considera- tion may not always be the lowest purchase price, but that machine that has the lowest total cost for a fixed period of years. Subsequently, we again requested that each dealer certify the maximum dollar amount that the City will be responsible for during its first 5 years of ownership as it pertains to a detailed list of items. Any cost exceeding this amount during the first 5 years, or 7,000 hours of eperaticn, will be borne solely by the supplier/manufacturer. The City absorbs all maintenance costs up to the maximum stated after which all repairs are 100% guaranteed. This provides the City with a planned maximim expenditure for the ao;u.isi- tion, operation and maintenance of this vehicle for the first 5 years. Another aspect of the "total cost bid" concept is the inclusion of a guar- anteed repurchase price. This provides the City with the flexibility of requiring the dealer to repurchase this particular machine at arn,ti'me with- in the 5 year period if the City so desires. This guaranteed repurchase is backed by a certified bond in favor of the City of Eagan. This clause protects the City from being saddled with a particular piece of machine that may be a "lemon" due to recent innovative design chances, etc. The City retains the right to keep the machine in its service as long it desires, or to sell it on the open market if a better price can be obtained. Based on the bids received, it is conceivable that the City of Eagan could turn around and sell this machine within 6 months to the original dealer for an actual realized net profit of $900-$13,600 (depending upon machine purchased) . If the machine is sold at the end of 5 years, the actual cost to the City is reflected under the column "total cost after resale in 5 years". (A nega- tive (-) would indicate the "TOTAL COST" to the City (note: this does not take into consideration the finance costs of funding the actual purchase price of the machine) . M-TARA=7 ANALYSIS Because a sophisticated piece of heavy equipr ent like a road grader is very ccrplex due to its multiple number of functions, each make of machine is inherently different frau its ccrpetitor. Consequently, it is difficult, if not impossible, to write a set of specifications for all machines to meet it without exception. Charpion 715A - Although this machine is the low bid, it has several devia- tions from the specifications that the City feels are major deviations. The transmission is a torque-convertor which relates to a 20% loss of horse- power from the engine to the drive wheels. The differential lock/unlock for the 2 tandar. ubeels cannot be activated while driving under load. It is also believed that this requires more fuel amsurption than the arpeti- tive models. The hydraulic pumps are gear-driven in-lieu of the newer piston pumps. The brakes are the drum-shoe- type .vs. the required disc. The articulation cannot be used while scarifying, ripping or plowing snag which reduces the effectiveness of this machine. John Deere 670A-672A The second bid,submitted by valley Equipment was for a 672A all-wheel drive road grader. It is felt that the additional cost is not justified to pro- vide a drive-train to the front wheels for the City of Eagan based on our anticipated use. Therefore, no further discussion will be made pertaining to this model. The 670A does not have any major deviations frau the speci- fications, and all minor deviations present no problem in meeting the City's needs. This :machine canes very close in quality and price to the needs of the City. It has many advantages in its operating statistics in addition to operator comfort and accessibility to controls. Caterpillar 120G Ziegler Inc. submitted two bids. One is for a machine in stock while the other would be a factory-order machine. The in-stock machine has 3 major deviations from the minimum specifications: 1. No blade float control is available, 2. Does not have a scarifier attachment, and the tires are slightly 6 smaller than required. All competitive models bid contained 3. these three options. If required to be added, the price would then equal that of their second bid within $100. With the exception of those three deviations, the Caterpillar 120G does not I ave any significant deviations from the specifications that the City could not live with. SLM,%M/RDC'CU?=ATION Considerable time was spent by the Superintendent and the Director in eval- uating the detailed specifications for each machine, the advantages and dis- advantages of the particular makes and models, and reviewing the perspective suppliers at their service facilities. Because of the complexity of these machines, a detailed analysis listing all advantages and disadvantages of their respective machines would result in a much more detailed and expanded report. However, after evaluating the capabilities, effectiveness, costs,and City needs, we feel that the deviations from the standard specifications as submitted by Borchert-Ingersoll for the Qiampion 715A are greater than the cost savings involved and consequently, their bid should not be considered as it does not meet our required specifications. Similarly, Caterpillar 12OG (No. 1) as submitted by Ziegler Inc. has major deviations from the mini- mum specifications required by the City. Although this model has many features that would be desirable, we feel that it is nnre than necessary to meet the needs of our Maintenance Division. Section 16.06, Subdivision 2, provides that no pylon sign shall project more than 27 feet above the lot or roadway level. 16.03, Subdivision 3 provides that no sign shall be located nearer than 10 feet from any street or highway right-of-way. 16.06 Subdivision 3 provides that a shopping center may have a pylon sign or free-standing sign for each major adjacent street. Mr. James Lilly appeared for the applicant and indicated that Charles Olson will lease the former Warner Hardware property on Lexington Avenue. The purpose will be for the storage of custom outfitted trucks and equipment. All parking stalls will be on the south side of the building and the proposed storage is currently asphalt surfaced. There were no objections to the appli- cation and it was further noted that access will be from the future frontage road on the west side of I-35E. It was suggested that cross sections from I- 35E and from the ramps be acquired showing the proposed storage but it was noted that no elevations of I-35E had been acquired by the City at the present time. Hall moved, Wilkins seconded the motion to recommend approval of the application subject to the following conditions: 1. Storage of material within the area shall be limited to ten (10) feet in height. 2. Only materials or equipment related to the operations of occupants of the building on this site shall be permitted in the outside storage area. 3. A ten-foot chain link fence will encircle the area proposed for outside storage. 4. All currently existing parking stalls in the front of the building would remain. 5. A landscaping plan which provides shrubbery around the perimeter of the site (on the outside of the fence) shall be approved by the staff and implemented by the applicant within one year of the conditional use permit date of issuance or adequate landscape bond shall be provided. 6. The conditional use permit shall be approved for an indefinite period of time provided the conditions herein are met at all times and all provisions of other City ordinances pertaining thereto are also met. Formal approval of the audit report by the City Council is tradi- tional . Contract 80-7, Terminate Contract/Authorize Claim -- Swede Erickson, Inc. , the contractor for the installation of utilities in the Windcrest, Duckwood Trail and Windtree Additions has not been able to complete the project by the required completion date which will adversely affect the subsequent street contract already awarded. Therefore, upon recommendation of the City Attorney, it is recommended that the City Council take formal action to ter- minate the contract and authorize the staff to file a claim for uncompleted work and the assessment of liquidated damages: The certified notice of termination has been .forwarded to the contractor at this time. However, this should be reinforced by official Coun- cil action should legal proceedings be required. ACTION TO BE CONSIDERED ON THE MATTER: To authorize termination of the Contract 80-7 for Windcrest, Duckwood Trail and Windtree Addition utilities. CONTRACT 80-18 F. Contract 80-18, Terminate Contract/Authorize Claim for 1980 Sealcoating -- During the sealcoating project of 1980, the con- tractor failed to complete all portions required under the plans and specifications. In addition, the majority of the work that was completed has been found to be unsatisfactory within the one (1 ) year guarantee period. The contractor has previously indicated that he would return to correct any problems and complete the pro- ject. However, this contractor has gone bankrupt and the City is starting to receive claims from the suppliers for the material used. Therefore, staff is requesting Council authorization to terminate this contract and file the appropriate claims against the bonding company to insure that the project is completed and that non-acceptable work is corrected. ACTION TO BE CONSIDERED ON THE MATTER: To authorize the termination of Contract 80-18 ( 1980 Sealcoating) and processing of claims as necessary. CONTRACT 81-1 G. Contract 81-1 to Approve Plans and Specifications for Galaxie Avenue Grading and Utilities -- Due to the progression of the con- struction of I-,35E from the southwest corner of the City, it is necessary to relocate Galaxie Avenue from the present intersection with Cliff Road easterly to the existing intersection of Blackhawk Road. In addition, the City must install whatever trunk utilities crossings are proposed through the freeway alignment prior to its ion Agenda Information Memo June 12 , 1981 Page Twenty-Eight construction. These trunk crossings are also necessary to provide service to the westerly portion of Ridgecliffe 1st Addition. The City will be performing the grading and relocation of Galaxie Avenue for MnDOT in conjunction with our utility crossings. This reloca- tion grading is subject to federal aid funding and requirements ; and, therefore, it is necessary for the City Council to pass a formal resolution approving the plans and specifications . The resolution, a -copy of which' is enclosed on page ©- , will be incorporated in an agreement to be presented for ocial action at a future date. Authorization to advertise for bids will be requested when the agreement is brought back to a City Council meeting in the future. A review of this request by the Public Works Director results in a recommendation of denial based on insufficient warrants being met requiring the installation of a three-way ' stop sign at this intersection. It appears that the reason for the request is based on a concern for the speeds on Donald . Avenue along with a request to have the speed limit reduced to 20 miles per hour. It should be noted that state law prohibits an enforceable speed limit to be posted below 30 miles per hour. Cooperative Power Association Transmission Line Alignment - CPA is proposing to extend additional transmission lines through the City of Eagan to provide additional service required by the continued growth of the City. These transmission lines will be a 69KV power line proposed to be constructed from Deerwood/Blackhawk Road Substation to LeMay Labe/Yankee Doodle Road Substation. This will require the installation of a major overhead transmission line easterly along Deerwood Drive to Pilot Knob Road, thence north to Wescott Road then easterly to Lexington Avenue. The City staff has concerns pertaining to a high transmission overhead power line along the east side of Pilot Knob Road and the south side of Wescott Road which would be adjacent to the frontage of the new Dakota County Library site, the future Eagan City Hall and future City Community Center site. These transmission lines will consist of approximately 45 foot tall steel poles with three singular insulator supports for the main transmission lines with minor underbuilt for required smaller distribution lines. Discussions with CPA indicate that it is cost prohibitive to bury these high voltage transmission lines, hence the overhead proposal . In order to pro- ceed along the alignment, they will require an easement dedication of the easterly twenty feet of the City of Eagan' s 40 acres at the corner of Wescott and Pilot Knob Road. Along Wescott Road, CPA will be in the existing right-of-way. The staff would like to receive some comment and input from the Council as to the pro- , posed alignment of this major overhead facility and consideration of a possible alternative alignment continuing east along Deerwood Drive through Patrick Eagan Park and thence north along Lexington Avenue. Any other suggested alternatives would be appreciated for staff contact with CPA. CPA will be reluctant to change their proposed relocation due to the costs involved in preparation of easement documents and surveys to date. No specific action is required on this item other than general comments the staff can use in working relationships with the CPA staff.
