Voss, President November 24, 1980 The Honorable Mayor & City Council City of Eagan 3795 Pilot Knob Road Eagan, Minnesota 55122 Dear Madam Mayor & City Council Members: Since I will become a Dakota County Commissioner in January of 1981, it is necessary to re-define my Planning Consultant role with the City so that any conflicts can be avoided. Therefore, I propose the following related to Dakota County matters: 1 . I will not represent the City as a Planning Consultant on any matters . where I expect to be voting on the same matter as a County Board Mem- ber. . In this instance, "represent" means drafting reports or recom- mendations or making public presentations. 2. I will not represent the City as a Planning Consultant at any meeting with the Dakota County Staff or Dakota County Board. In my new role as a Dakota County Commissioner, I do expect to confer with members of the City Council and City Staff on a broad range of issues. I will not, how- ever, be representing the City as a Planning Consultant or charging the City for my time on County-related matters. In drafting an understanding such as this, it is difficult to anticipate every eventuality. Hedges , City Administrator FROM: Chief of Police SUBJECT: Diesel Squad Cars On Monday, November 24, 1980 at 2:00 P.M. we opened the bids as advertised for two diesel squad cars . There are three companies who bid; they are: Cutlass 88 Lindahl Oldsmobile off, X39 -5$,916 .09 Malkerson Oldsmobile 8, 700 .00 8, 900 .00 Joe Graeves Motors 8 ,690 .00 8, 790 .00 After reviewing the bid prices and the items requested, I had a question in my mind as far as Joe Graeve' s bid, which did not include an inside trunk release but did includea remote control • for the left hand rear view mirror. I spoke to John Kline, Fleet Manager, and he assured me the trunk release was included in the price and we could deduct $16 from their quoted price for the remote control mirror. The reason we did not include the remote control mirror is because on the last two Cutlass ', they have been lost in the car wash. Therefore, the low bid is Joe Graeves Motors at $8, 674 on a Cutlass and $8, 774 on the Delta 88. My recommendation is to buy two Cutlass vehicles for a total price of $17, 348. Boyer Truck & Equipment Company for a Conditional Use Permit for Outside .Storage -- A public hearing was held at the October 28, 1980 APC meeting to consider a conditional use permit application to allowoutside storage' for trucks for Boyer Truck ,& Equipment, Inc. This item was on the agenda for consideration . at the regular , City ;Council meeting held on November - 18, 1980; however, the, applicant was not present at that meeting. Action was 'taken by the APC to recommend approval of the application to the City Council, subject to four (4) conditions. RUNKLE, CITY PLANNER APPLICATION SUBMITTED An application has been submitted for conditional use permit to allow outside storage for trucks for Boyer Truck and Equipment Inc. COr.1NIENTS It is the staff's understanding that Boyer Truck & Equipment purchased Lot 8, Block 1, Sibley Terminal Industrial Park, which was formerly the location of Brad- Eagan Goodyear Tire Company, then New Star Car Wash. The building has been in existence for sometime prior to the purchase by Boyer Truck & Equipment Co. The applicant is requesting to repair and recondition new and used trucks for industrial needs. According to Ordinance 52.07, Subdivision 15, this facility could fit into a permitted use or a conditional use within the I-1, Limited Indus- trial District. Since the applicant is proposing outside storage, staff is re- questing that a conditional use permit be acquired prior to the storage of any trucks. The existing building has had outside storage in the past, and the location is suitable for the proposed type of use. The applicant has submitted some background information for your review in consider- ation for the conditional use permit. If approved, the conditional use should be subject to the following conditions: 1. The outside storage area shall have an asphalt surface and concrete curbing around the perimeter of the storage area. 2. No more than a 3-1 slope shall be provided on the northside of the storage area. 3. The landscape plan shall be submitted and be approved by the City staff. • Also, a $2,000 landscape bond shall be submitted and not released until one year after the landscaping has been completed. 4. All parking and storage shall be retained on the lot. Absolutely no on-street parking. I ' i BOYER TRUCK & EQUIPMENT, INC. History and Background Boyer Truck & Equipment, Inc. , was incorporated June 18, 1980. The company was established to engage in the final manu- facturinq of trucks for ready-mix cement and construction trades, the sales of such completed trucks and the used trucks traded in thereon, and the attendent truck service and body repair and paint work. It was the intention of the company to locate in the south Twin Cities metropolitan are in order to serve the Dakota, Carver and Washington county areas. Boyer Truck & Equipment, Inc. , is owned by Philip S. Maas. Mr. Maas is also the owner and president of Boyer Ford Trucks, Inc. Boyer Ford Trucks was incorporated under Minnesota laws as McDonald Motor Company on February 15, 1934. The company went through two name changes in the following years becoming Bill Boyer Ford, Inc. on October 1, 1964. On August 20, 1979 the name Bill Boyer Ford, Inc. , was changed to Boyer Ford Trucks, Inc. , reflecting the company's change from an automo- bile agency to a truck-only dealership. Boyer Ford Trucks is located at 2811 Northeast Broadway, Minneapolis. The company occupies a 33,000 square foot sales and service facility on a 6.25 acre site. t Boyer Truck & Equipment has been granted a license by the State of Minnesota as a truck further manufacturer. This license has been granted on a temporary basis pending inspection by the Minnesota Department of Public Safety. • Page 2 Presently, Boyer Truck & Equipment has eight employees. Employment is projected to reach 25 people during 1981 with an estimated annual payroll of approximately $550,000. Location and Site Boyer Truck & Equipment is locating at 3291 Terminal Drive, Eagan. The legal description of this property is Lot 8, Block 1, Sibley Terminal Industrial Park. This is a 4.6 acre site with a 18,500 square foot office, service and warehouse facility. The following improvements are being made to the property: Grading and blacktopping of site to the northeast of building and existing blacktcp to property line, observing setback require- ments. Install new entrance to Terminal Drive and widen existing frcnt driveway from 18 feet to 24 feet. Regrade area 100 feet to the north of existing blacktop and install 6 inches of gravel base. Install approximately 588 feet of concrete curb and gutter to meet or exceed city recommendation. In addi- tion, beautification landscaping is planned for Spring 1981. The grading has been done to provide drainage from the newly surfaced area to Terminal Drive. Please see drawing attached. Parkin The anticipated parking requirements for this operation are as follow: 30 automobiles, 12 completed new trucks, 18 used trucks, plus a maximum of 12 trucks waiting for service work. The space require for this parking is approximately 7 Pa ge 3 30,000 square feet. With the parking lot improvement Boyer Truck & Equipment has made, there will be approximately 70,000 square feet of parking and storage space available on site, not including driveways. There will also be approx— imately an additional 73,000 square feet available for future expansion if necessary. Mr. Maas was present and discussed the appli- cation in detail. Mr. Maas stated the applicant is uncertain whether it will fence the property for security purposes but that it will be determined later. He also stated that there will be night lighting with about eight night lights around the parking area and a sales volume of about 10 units per month is projected. Krob moved, Harrison seconded the motion to recommend approval of the application subject to the following conditions: ; 1. The outside storage area shall have an asphalt surface and concrete curbing around the perimeter of the storage area. 2. A minimum of 3-1 slope shall be provided on the north side of the storage area. 3. The landscape plan shall be submitted and be approved by the City staff. Also, a $2,000 landscape bond shall be submitted and not released until one year after the landscaping has been completed to the City's satisfaction. 4. All parking and storage shall be retained on the lot. There shall be absolutely no on-street parking. All voted yes. RUNKLE, CITY PLANNER APPLICATION SUBMITTED The first application submitted is a request to rezone approximately 33 acres from agricultural to R-1 (Residential Single District) and R-2 (Residential Double Dis- trict). The second application submitted is a request for preliminary plat approval for Overhill Farm Addition, which consists of approximately 33 acras and will con- tain 42 single family lots and 14 duplex lots, 28 units. COMTENTS f� The applicant is proposing to subdivide the property because sewer and water and streets have been provided to his property. The proposed development will consist j of 56 lots. The applicant is proposing to plat duplex lots where his property abuts Cliff Road and Dodd Road. The remainder of the plat would be single family lots. Lots 1-7, Block 1 and Lots 1-7, Block 4, would be duplex lots. i The proposed plat appears to be well designed. All lots meet the minimum lot require- ments. a The plat continuity has also been provided. The applicant has extended Twiggy Street from the South Oaks Plat and is also proposing to dedicate park land in conjunction with the South Oaks Park. 75-foot half right-of-way shall be required on Cliff Road. According to the park and ponding formula, 70%,of the 10% park dedication has to be land prior to receiving credit for any of the water. The proposed plat only has 65% of the park as land. Therefore, only 1.75 acres of park land will receive credit. The remainder, or 1.55 acres, shall be made as a cash contribution according to the current park rate at the time final plat is approved. If approved, the plat should be subject to the following conditions: 1. Plat shall be subject to Dakota County Plat Commission's review and comments because the plat abuts Cliff Road. 2. .75-foot half right-of-way shall be dedicated for Cliff Road. COLBERT, DIRECTOR OF PUBLIC WORKS DATE: OCTOBER 23, 1980 RE: PRELIMINARY PLAT - OVERHILL FARM ADDITION The Public Works Department has the following comments to offer in regards to con- sideration of the above-proposed preliminary plat: UTILITIES Sanitary sewer of sufficient size and capacity is available at the intersection of the future extension of Wilderness Run Road with the recently upgraded Dodd Road. This is approximately 500 feet north of the location of this proposed plat. It will require the extension of this trunk sanitary sewer across an easement that is presently being acquired from the property immediately to the north and adjacent to the Overhill Farm Addition plat. This trunk sewer will then be constructed through the northeast corner of this plat to provide future service for the South Oaks Addition, which is located to the east and immediately adjacent to this proposed plat. Sub- sequently, this sanitary sewer extension will have to be provided for before this plat can be finaled, as its installation is necessary to provide the sewer service for this proposed plat. Water main facilities of sufficient size is readily available along the frontage ad- jacent to Dodd Road. Internal water main lateral distribution will be handled as a part of this plat's development, which will provide a future extension to the South Oaks Addition. STREETS Access to this proposed plat will be provided by way of the recently upgraded Dodd Road and providing for a connection to the South Oaks Addition. The internal resi- dential street distribution meets with staff approval and does not have any proposed grades that exceed 8%. GRADING AND DRAINAGE The overall topography of this proposed plat is situated on a small hill which pro- vides for drainage in all four directions. The majority of the drainage will be handled by internal storm sewer systems which will be directed into Hay Lake immedi- ately to the north of this plat, which presently does have an outlet to control the water elevation. Approximately one-third of the southerly portion of this proposed plat will drain towards Dodd Road or towards the existing marshy, drainage ditch - parallel to and adjacent to the northside of Cliff Road. This drainage will empty into the two ponds located within the South Oaks Addition, which ultimately drains into the pond located on the southside of Dodd Road immediately south of the South Oaks Addition (LP-28). This pond (LP-28) presently does not have an outlet and is of such an elevation that is creating ponding and flooding problems to adjacent properties. It is anticipated that this pond will require a storm sewer outlet which will then drain to Hay Lake through the Overhill Farm plat. Because of the present high water problems associated with the two ponds in South Oaks and Pond LP-28, it is recommended that the final plat for Overhill Farm Addition not be approved until storm sewer outlet for Pond LP-28 has been ordered in by Council action. 2 � CITY OF EAGAN PREL '. NAR'' PLAT - OVERHILL FARM ADDITION OCTOBER 23, 1980 PAGE 7,70 Some steep grades will be created in the northeast corner of this plat due to the fill required in this vicinity. It is recommended that no slope greater than 2:1 be created outside of this public right-of-way. In addition, the existing previously referenced drainage area adjacent to Cliff Road along the south portions of this proposed plat must be propagated during all future lot developments. Due to the fact that it presently transgresses across these proposed newly created lots, it is recommended that it be redefined and reconstructed adjacent to Cliff Road to eliminate any potential blockage, disturbance, etc. to the development of any in- dividual sites along the southerly allowance of this plat, or adequate drainage easements be granted to protect this drainage way. EASE.1ENTS AND RIGHTS-OF-I"JAY Sufficient right-of-way has been dedicated for the recently constructed Dodd Road adjacent to the west edge of this plat. In the northwest corner of this proposed plat, the alignment of Dodd Road was realigned slightly to the west. This has created a triangular parcel of excess boulevard right-of-way in the extreme north- east of this plat. It is recommended that this triangular-shaped parcel of excess City boulevard right-of-way be incorporated into the final plat of the Overhill Farm Addition. Correspondingly, it is recommended that the old alignment of Dodd Road in the northwest corner of this plat be vacated priorsto final plat approval. Additional right-of-way will have to be dedicated to provide for a 75-foot half right-of-tray adjacent to County Road 32 (Cliff Road). In addition, a specific drainage easement will have to be dedicated adjacent to Cliff Road along the southerly portion of this plat to provide for continuation and preservation of the existing drainage swale. There will also have to be suffi- cient utility easements dedicated to provide for the extension of proposed future trunk sanitary sewer to the South Oaks Addition. Also, we will have to insure that adequate drainage and utility easements are provided for the anticipated storm sewer outlet from Pond LP-28 to Hay Lake (LP-31). David Dehler was present and described the application in detail and stated that the park land will be increased in size to reach the 707 land/30% water requirement under the Eagan ordinance. He stated that the applicant would not include the triangle at the northwest corner of the plat because the land is not owned by the developers. There were concerns by the Public Works Director regarding grading and drainage and also a number of neighboring property owners from South Oaks Addition and south of Cliff Road were present with questions and strong concerns about drainage. Mr. Colbert recommended that a storm sewer outlet for Pond LP-28 to Hay Lake be ordered in by the Council prior to approval of the final plat of Overhill Addition because of the current high lake levels in the area. The i staff recommended that the triangle in the northwest be vacated by the City and conveyed to adjacent property owners including the Michael Dineen and the Dehler family. It was noted that the plat had not been submitted to the Advisory Park Committee for recommendation. Concerns of the neighbors included the street configur- ation and potential traffic through South Oaks lots. All lots will have only internal access and no access from Dodd Road or Cli f_-Raad. Discussion regarding open storage on Roger Olson property At the direction of the City Council, the question regarding open storage on the Roger Olson property was researched by City staff. According to the City Planner, Mr. Dale Runkle, after examining the past history of the Eagan Zoning Ordinance, it appears that Ordinance 6, the first Zoning Ordinance was adopted February 3, 1960 and published March 3, 1960. Enclosed on page 24 is a copy of Subdivision 5 of Ordinance 6 for your review. This ordinance only allows one single family dwelling structure and garage permitted on any such lot provided the same shall have at least one off street parking space. On February 18 , 1975, Ordinance 52, which is the Zoning Ordinance, replaced Ordinance #6. Ordinance 52.01 repeal and 52 .02 amendment covers the procedure as to how Ordinance 52 , the Zoning Ordinance was adopted. This section of Ordinance 52 is also reviewed for your review to illustrate the relevance of this ordinance to original Ordinance 6. A copy is enclosed on page %C. After Ordinance 52, the Zoning Ordinance, was adopted in 1975, Ordinance 52.07 Subdivision 4 designates the permitted uses and accessory uses within a residential district:., Enclosed on page �_is a copy of this page of Ordinance 52 for your review. Therefore, the Ordinances relating to the various uses allowed in a residential single family district have been outlined by copies of Ordi- nance 6 and Ordinance 52. Regarding the status of the Olson Property, it was found after researching the building permit that a building permit was issued to Mr. Roger Olson on September 15, 1964 for Lot 7, Block 9, Country Home Heights Addition. It is apparent that the building permit was issued - after Ordinance 6 had been adopted. According to City Planner Runkle, the storage of heavy or commercial equipment on Lot 7, Block 9 or Lot 9, Block 9, Country Home Heights was in violation of Ordinance 6 and is in violation of Ordinance 52 as interpreted by the Planning Department. Wachter then appeared at the meeting at this point. LAKE PARK ADDITION - PROJECT #265 PUBLIC HEARING The next public hearing convened by Mayor Murphy consisted of Project #265 relating to Lake Park Addition utility and street improvements. Councilmember Parranto did not participate and abstained from voting. There were no objections nor appearances at the hearing. After review by the City Engineer, Smith moved and Wachter seconded the motion to close the hearing, to order in the project and to authorize the preparation of plans and specifications by the City Engineer. All members voted in favor except Parranto who did not vote. Egan then moved and Wachter seconded the motion, all members voted in favor except Parranto who did not vote, to spread assessments on the project over 10 and 15 years as recommended by the City staff. f ?.5=t SAFARI ESTATES PROJECT #245 PUBLIC HEARING Mayor Murphy next convened the public hearing regarding utility and street improvements in the general area of proposed Safari Estates Addition consisting of Project #245. It was noted that a hearing had been held at an earlier time regarding the Safari Estates project and that the present hearing is a newly noticed hearing. Mr. King appeared on behalf of his mother requesting a deferral of assessments until the highway pattern is completed in the general area including I-35E and Cedar Avenue. It was recommended that the Kings wait until the assessment hearing and then make the request at that time. Wachter moved and Egan seconded the motion to cicse the hearing , to order in the project and to request the City Engineer to prepare the plans and specifications. All members voted in favor. It was noted that no one objected to the project. ROGER OLSEN PROPERTY The Mayor then announced that the Council would discuss the complaint being brought against Mr. and Mrs. Roger Olsen regarding the alleged use of their residential property at 2850 Pilot Knob Road for storage of heavy duty commercial trucks and for the operation of a business out of that location. The City Attorney was requested to read his letter dated May 15 re- garding the background and the alleged violations of the Eagan ordinance and State law. Mrs. Olsen was present as was John Klein, the complaining party. Ordinance #6 provisions were reviewed which zoning ordinance was in effect in 1964 when the original residential building permit was acquired by the Olsens for their property. Several alternates were discussed as to disposition of the issue includ- • 0 City Council Minutes 0 1,18 Page Four I•lay 15, 1979 ing requesting the Olsens to apply for a conditional use permit, to move the vehicles off the premises , to offer the Olsens a period of time in which to move any commercial vehicles from the property according to comparable previous decisions of the Council or to find them in violation of Zoning Ordinance #52 . A number of area residents appeared, most of whom indicated that they did not object to the present use of the property by the Olsens and Mrs. Olsen read a statement explaining the potential vandalism problems on industrial property owned by them in Sibley Industrial Park and that they would not be able to construct a commercial storage facility at the present time. Mr. Klein stated that he has seen up to 7 commercial vehicles on the property at one time and had some pictures of the Olsen property. It was noted that the allgeged improper use of property in the City usually comes before the City Council upon complaints of neighbors and there were no immediate neigh- bors who indicated an objection to the use of the property by the Olsens. After considerable discussion, the City Council took no action on the complaint including the fact that there appeared to be a dispute as to how many trucks were being used on the property or being parked on the property. D 79-75 ASSESSMENT COMMITTEE MINUTES - APRIL 19 , 1979 Mr. Hedges requested the City Council review and act upon recommendations of the Assessment Committee covering their meeting of April 19, 1979. 1. Lakeside Estates Addition. The City Administrator reviewed the question of buildable sites in Lakeside Estates Addition due to the proposed installation of sewer and water within the subdivision. There were a number of property owners who appeared some of whom objected to the proposed method of the Assessment Committee recommending that the assessments be levied on the basis of the potential buidable lots which were computed to be 46 lots. There were other alternate suggestions to the assessment method within the subdivision. Egan suggested that the staff review the plat to determine how many buildable lot sites there are in the subdivision. Parranto moved and Wachter seconded the motion to accept the recommendation of the Assess- ment Committee and that the staff be requested to review the plat for the number of buildable sites within the subdivision with the understanding that the final decision will be made by the City Council after report from the staff of the maximum number of buildable sites. All members voted yes. S0 3: MEMO TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: NOVEMBER 26, 1980 SUBJECT: INFORMATIVE MEMO A meeting is scheduled for Monday, December 8, 1980, at the Mendota Heights City Hall at which time, the Metropolitan Council :will provide an update on the 1-35E Environmental Statement Process as it relates to that segment planned through the City of St. Paul. If any member of the Council can attend the meeting, please notify this office on Monday. A letter was copied to the City of Eagan from Mr. Ed McMenomy to Ed Dunn, ` stating that his firm has been employed to make location recommendations and initial negotia- tions for a schoolsite in Eagan. The letter further states that land located in Section 23, adjacent to Northview Athletic Field is one of the search areas. Mr. McMenomy did meet with Mr. Dunn this week to discuss that location as a potential high school site. The Metropolitan Waste Control Commission is to improve and expand its communications with over 100 local units of government it serves in the seven county metropolitan area. Therefore, the MWCC is reactivating its sewer service area advisory board. The MWCC would like for each city to appoint someone to represent the community on the City's respective sewer service area advisory board. The City of Eagan's Advisory Board consists of Bloomington, Burnsville and Eagan, which is commonly referred to as the BEB'. Enclosed on page s � is a copy of the letter submitted to Mayor Blomquist from the Chairman of the MWCC. A letter was received from Mr. Dale Nelson, director of the Youth Development Plan of the Community Action Council. The Community Action Council is asking that the City allocate $935 to support the Community Action Council's Youth Development Program for 1981. A copy of the letter is enclosed on pages 5 A through SS' for' your review. This item was not considered as a part of the budget-or 1981. It was explained to Mr. . Nelson that any requests for appropriations from the City Council should be made during the late summer months or early fall months so proper consideration while drafting an operating budget can be 'given to requests of this nature. Enclosed on page .5-G is a 'revised meeting schedule for December. Enclosed on pages S 7 through . is the most recent update of the loans committed under the tax exempt o gage program. However, I have spoken with Banco in recent days and it appears that all the money will be tied up and, more than likely, loans will be committed in the very near future. Mr. Hedges : In 1980, the Community Action Council' s Youth Development Program was active in several areas to prevent youth problems in Eagan. Following is a list and brief description of the projects conducted this year: 1) "One-Up" - We obtained funding from CETA's Youth Employment and Training Program to work with eight handicapped youth in Burnsville and Eagan. We are very proud of what the program has accomplished thus far. 2) "Teenage Consultants" (TAC) - Fifteen ninth graders attended training sessions on communication, relation- ships and chemical abuse, and have subsequently spoken to other youth groups passing on what they have learned. These young people have been enthusiastic and willing to help other youth. 3) "Youth Reflections" - With help from the Burnsville Optimist Club, we are publishing a magazine that is run and written by youth in Burnsville and Eagan. Support from local businesses is helping to pay the costs of publication . 4) "Parent-to-Parent" - We are training a group of ten parents in the Burnsville-Eagan area to be resources to other parents having questions or needing support concerning their children's chemical use and sexual attitudes and feelings. 5) "Park Builders" - Students from School District 196 at Rosemount High School built equipment for parks in Eagan. The Center for Disease Control will be providing funds for us to work with school and community members to prevent teenage alcohol abuse and teenage smoking. The office of Juvenile Justice and Delinquency Prevention will be providing the bulk of financial support for our program.
