ADJOURNMENT G MEMO TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: JULY 14, 1981 SUBJECT: AGENDA INFORMATION MEMO After approval of the July 7, 1981 regular City Council minutes and the July 21, 1981 City Council agenda, the following items are in order for consideration: Recently, Dunn & Curry, Inc.:, and Dunn &'Curry Real Estate Manage- ment, Inc. , were disolved and three (3) new companies were formed. The companies are Ed Dunn, Inc. ; Jim Curry, Inc. ; and the Sienna Corporation. Dunn & Curry, Inc. , controlled the many -assets such as Lexington South, Blackhawk Park and other planned unit develop- ments that were under development by Dunn_ & Curry Real Estate Management, Inc. Mr. Dunn and Mr. Curry, during the past several months decided to disolve their partnership and, therefore, worked out an arrangement where they were able to equally divide up all of their assets. Rod Hardy, Jahn Hankinson and Bruce Nimmer who were equal partners with EdDunnand Jim Curry in the real estate management company decided to form their own company called the Sienna Corporation. The Sienna Corporation is a real estate manage- ment and development company and is responsible for completing such developments as Wedgewood, Canterbury ; Forest, Meadowlands, Thomas Lake Heights and any other subdivisions - that were under development The Sienna Corporation has reached an agreement with JimCurry to develop the Lexington South planned unit development,. They are not -developing Blackhawk Park which is controlled and owned by Ed Dunn. Mr. Hardy is planning to make a brief appearance` and summarize for the City Council the fact that Dunn & Curry are; no longer developing land together and the role of the Sienna Cor- poration as a real estate management and development company.; There is no action required. July 1 , 1981 Agenda Information Memo July "14, 1981 Page Two Carol Lindo was planning to appear at the 'June 16, 1981 City Council meeting to discuss the impact special assessments have caused her as a result of the development of Vienna Woods. As stated in a previous memorandum, Carol Lindo' s issue is simply one of economics. She was given :lots by the developer of Vienna Woods in an agreement to allow development in her general area. With the lots, she also assumed special assessments. More than likely, had economic condi- tions continued as they were in 1978, Mrs Lindo wouldhave sold the lots and realized the gain that she had expected. The economy soured regarding the development of single family lots and Mrs. Lindo has assessments on lots .she is having problems paying. Mrs. Lindo has asked that she be given an opportunity to explain her situation with the City Council. There is no action suggested on this item. Park Department -- There are two , (2) ` items to be considered under the Park Department. 1. Advertisement- for- Bids- -for- Approximately- 50- Trees -- The Park & Recreation Director fias prepared specifications to bid approxi- mately fifty ( 50) trees for planting in City Parks throughout the City. The size of the trees varies from two to three inches in diameter and there are approximately eight to ten species to be considered in the bidding. The trees will be planted and guaranteed for aperiod of one (1 ) year by the supplier. This program :is budgeted for 1981; under the Shade Tree Program. ACTION TO BE CONSIDERED ON THIS"MATTER: To approve a bid opening for August 12, 1981 and consider the award of the bids at the August 18, 1981 regular City Council meeting. 2. Title -Transfer - The Advisory Parks & Recreation Committee is recommen i.ng tat the City accept a title transfer of land from Mr. Jim Tilsen to the City of Eagan referred to as Lot 11 in the WildernessRun 4th Addition. The lot is adjacent to existing City park property on Dunrovin Lane. The lot has steep topography, ` sloping towards Carlson Lake which makes .the lot_ difficult for a single family, home to be built. This lot will provide additional space and, opportunity for the Park Department to extend 'a possible future trail from the east edge of the lake to the south side. The only cost to the City is approximately $500 to cover special assessments and taxes pending on the property. Enclosed on page is a map that illustrates the proposed acquisition. Subsequently, a feasibility report has been prepared and is being presented to the Council for considers- ton of the installation of this collector road. ACTION TO BE 'CONSIDERED ON THIS MATTER: To receive the feasibility report and order the public hearing to be held on August 18, 1981. ' PROJECT- 346 D. Project '346, Receive Report/Order Public Hearing for Cinnamon Ridge First Addition -- The preliminary plat for the Cinnamon Ridge First Addition was approved at the June 16, 1981 Council, meeting. On July T, 1981, the City Council received a petition from the developer requesting a feasibility report for, the installation of streets and utilities in this referenced subdivision. This report has now been completed , and is being presented to the City Council for information and review. ACTION TO BE CONSIDERED 'ON -THIS MATTER: To receive the feasibility >4 report for Project 346 (Cinnamon Ridge 1st Addition) and order the public hearing to be held on August 4, 1981 . CONTRACT- 80-12, E. Change Order #2 for Contract 80-12 -- Change Order #2 for Con- tract 80-12 (Project 286) to add $250 of, sod to the site for Pump k House #6 is in order for consideration. This sod 'is required in ,lieu of seed to prevent erosion for a' portion of the pump house site. ACTION TO BE CONSIDERED ON THIS MATTER: To approve Change Order #2 for Contract 80-1.2 as an addition of $250 for the reasons as stated. SAN ITARP SEWER- EXTENS IRN MARTIN SHIELDS F. Receive Petition/Order Feasibility Report for Extension of Sanitary Sewer Line for Martin I Shields, Property -- Mr. Martin Shields has petitioned the , City requesting an extension of a sani- tary sewer line . to be installed and assessed against his property ` due to the upgrading of Pilot 'Knot Road. The proposed extension would run from a manhole adjacent to Lemay Lake -and run south to a _point in the existing twenty foot storm sewer easement and then west along the south side of the twenty four foot storm sewer to a point on the west side / of Pilot" Knob Road. Mr. Shields' is also Agenda Information Memo July 14, 1981 Page Six presenting a request for waiver of hearing and has agreed to all assessments levied against this particular improvement. It is anticipated that this sanitary sewer line could be approved as a change order to an existing contract. The petition and waiver of hearing notice will be examined by the Director of Public Works. ACTION . TO BE CONSIDERED ON THIS MATTER: To accept the petition and order a feasibility report and prepare a contract change order resulting in the acceptance of a waiver of hearing for the extension of a newer line to serve the Martin Shields' property. PROJECT- 335- TWIN VIEW MANOR 2ND ADDITION A. Project 335 for Twin View Manor 2nd AdditionSanitary Sewer, Water, Storm -Sewer and Street Improvements -- On April 21 , 1981, the 'City received a petition from the developer for a feasibility report for streets and utilities for improvements in the proposed Twin View Manor 2nd Addition development. This feasibility report was presented to the City Council for review on June 16 with the public hearing scheduled for July 21., The preliminary plat for this project was approved on, July 16, 1980. Ohm l� tk !7a Darid 1'. 0lsner �(( nn1 versary' Preliminary Report on Twinview Manor Second Addition Utility and Street Improvements Project 335 Eagan, Minnesota May 21, 1981 SCOPE: This project provides for the grading and street surfacing of Richard's Court located within the Twinview Manor Second Addition plat. House services, storm sewer improvements, and a temporary access are also included as part of this project. Not included in the project are the sanitary sewer and water main which were previously constructed as part of Project 264. FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance with the Master Utility and Street Plans of the City of Eagan. The project as outlined herein can best be carried out in two contracts. Contract I would include the grading of Richard's Court and the installation of house services as outlined herein. Also included as part of Contract I would be the con- struction of a gravel base, construction of a temporary access, and installa— tion of all storm sewer improvements. Contract II would include construction of the remaining street section for gravel base and the bituminous surfacing with concrete curb and gutter. Page 1. 4223a e DISCUSSION: CONTRACT I A.) STORM SEWER IMPROVEMENTS: The storm sewer facilities presented herein provide for the collection of storm water runoff from the green-space in Twin- view Manor Second Addition and Richard Court, and the transportation of this water to the future Walden Heights storm sewer facilities. In the interim, a flared end section will be placed on a storm sewer stub to the west and water will be allowed to follow a natural drainage route that leads to Thomas Lake. B.) HOUSE SERVICES: House services will be installed to g residences and will consist of a l inch copper pipe water service and a 4 inch cast iron pipe sanitary service placed in a common trench. The services will extend from the street to the property line. C.) RICHARD'S COURT (Grading) : Richard's Court is a proposed street with, a 60 foot right-of-way and a 60 foot radius cul-de-sac. After installation of the house services a 6 inch gravel base will be constructed unless existing soil conditions warrant a different thickness. CONTRACT II D.) TEMPORARY ACCESS: A 24' wide temporary access is proposed in order to al- low entrance to Richard's Court prior to the development of the Walden Heights Plat. The access will consist of a 2" thick bituminous surface over 6 inches of gravel base. When Walden Heights is developed, the access will be graded over and sodded and Twinview Manor will take access from streets in the Walden Heights Addition at that time.' Page 2. 4223a / 0 0 E.) RICHARD'S COURT (Surfacing) : Street surfacing for Richard's Court in- cludes the construction of a 7 ton, 34 foot wide street with surmountable con- crete curb and gutter. Overhead costs are estimated at 25% and include legal, engineering, administration, and bond interest. EASEMENTS AND PERMITS: 1. A 20' wide permanent easement will be required for the construction of the storm sewer discharge into the property west of Twinview Man- or. This easement will be located in the right-of-way of Richard Court in proposed walden Heights and is expected to be acquired at no cost to the City. 2. An access permit must be acquired from the Dakota County Highway for the temporary access onto Cliff Road (Co.Rd. 32). In the event that this permit cannot be obtained from the County, access must be ob- tained on the right-of-way of proposed Walden Heights streets. Page 4. 4223a l � ASSESSMENTS: Assessments are proposed to be levied against the benefited property located within Twinview Manor 2nd Addition. A preliminary as- sessment roll is included at the back of this report. The preliminary assessment roll indicates assessed costs for the pro- posed lots within the Twinview Manor 2nd Addition. Sanitary sewer and water laterals have been previously assessed under project No. 264. Trunk sanitary sewer and water main have also been previously assessed under Project No. 234. Trunk storm sewer has not been previously as- sessed and is therefore proposed to be assessed as part of this project, with the exception of a portion of proposed Lot 11 as shown on the assessment figure at the back of this report. A portion of the water main construction is trunk water main and is in accordance with the City's Water Supply and Distribution Plan. FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance with the Master Utility Plans of the City of Eagan. The project as outlined herein can best be completed under one contract including sanitary sewer and water main. Storm sewer, site grading, and road construction will be per- formed by Univac under a separate contract. DISCUSSION: A. Sanitary Sewer: A 12 inch sanitary sewer is proposed to provide service to the new Univac Facility. The proposed 12" sanitary sewer will be constructed on a line 15 feet west of the west line of the Natural Gas easement as indica- ted on the drawing at the back of this report. B. Water Main: A 16 inch trunk water main is proposed to be constructed along the north edge of the new Univac Facility. The trunk water main will connect Page 1. 4469a to a 16 inch plug to be constructed as part of Coachman Land Company Ist Addi- tion, Project 323A and connect to an existing 12" plug located at the inter- section of Pine Ridge Drive and Red Cedar Road. A 10 inch lateral main will be constructed to loop around the proposed building. Hari!F. 015,,1 Ziversar� Preliminary Report on Brown Lake Outlets , Storm Sewer Project 339 Eagan, Minnesota June 1 , 1981 SCOPE: This project provides for the construction of an outlet. draining Brown Lake (LP-6) to Thomas Lake. FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance with the Storm Sewer Master Plan for the City of Eagan. It can best be carried out in conjunction with another project in order to form a larger project for bidding purposes . DISCUSSION: Heavy development in recent years in the west half of Section 34 has resulted in a storm water drainage problem in this area. Storm drainage from all of the Beacon Hill development and portions of the Johnny Cake Ridge, Ridgecliffe and Brittany Manor Developments is carried through storm sewers to a pond in the eastern edge of Beacon Hill . This pond (LP-57 on the Master Plan) experienced a great deal of flooding early in the development of Beacon Hill , At that time a ditch was constructed draining LP-57 to a larger pond on undeveloped property to the east , This Pond (LP-6) is now experiencing flooding problems and the owner of the proper- ty has requested a solution to the problem. Page 1 , 4362a ¢0 The Master Plan for Storm Sewer indicates that Pond LP-57 is to be drained to LP-6 by means of a storm sewer pipe with a 7 cfs capacity. When Beacon Hills Addition was developed, permission was given for a temporary ditch to be constructed to allow excess water from LP-57 to flow into LP-6, This caused some erosion and high water on LP-6. The property owner of the land around LP-6 has filled in the ditch and an 8" diameter temporary overflow pipe has been placed through the berm. It is proposed to install the permanent outlet pipe from LP-57 to LP-6 at this time, This 12" diameter storm sewer pipe would be installed 10' from the existing central sanitary sewer trunk and therefore, would not conflict with future development of the property it crosses . Pond LP-6 must drain to Thomas Lake. However, the elevation of LP-6 is considerably lower than that of Thomas Lake and a storm water lift station is therefore necessary. It is proposed to install a lift station structure at LP-6 at this time which would be large enough to accommodate the two 15 horse power pumps which will be installed when development in the area is completed and the required three phase power is available. Until the three phase power becomes available, it is proposed to use a 5 horse power submersible pump which operates under the currently available single phase power. This pump would lower LP-6 at a rate of approximately 6" per day. The discharge line for this pump will be crossing approximately 600' of undeveloped property and discharging into a low area in the proposed Walden Heights development from where it will flow overland into Thomas Lake, Since it is very likely this line will have to be relocated when development occurs, it is proposed to use a 4" PVC discharge line which would be abandoned when development does occur. The cost of the 4" plastic temporary discharge line would be approximately 1/3 the cost of the permanent 8" ductile iron force main. Page 2 . 4362a 4-1 It is proposed that the normal water elevation of LP-57 be established at the 911 ,0 elevation shown on the Master Plana The development plan for Beacon Hill shows that the high water area of the pond has been reduced slightly which will have the affect of raising the high water level from 919 .0 as shown in the report to 919 .6 . The development plan also shows the lowest house ele- vation in the area to be 922 .5, so the revised elevation should present no problem. It is recommended that the 892.1 normal water elevation shown in the Mas- ter Plan be retained and the outlet for LP-6 be established at this elevation. Barton Dunn was present and indicated that he represented Richland Development Corporation. He explained the back- ground of the plat and the proposal. Several neighboring property owners were present and objected to more than two additional single family lots. There were also concerns about reducing the frontage of the lots below 85 feet noting the generally larger lots in the area. There was also discussion concerning the utility and street project in the area and also the assessments against the parcels. After discussion, Wilkins moved, Turnham seconded the motion to recommend approval of the revised preliminary plat of Overview Estates conditioned upon the following: 1. All lots shall have individual services for utilities. 2. That there be no problem with providing gas service or telephone service to the newly created plat. 3. No variances shall be allowed for the side setbacks and the homes shall not exceed the lot coverage requirement. u. All other applicable ordinances shall be complied with. All voted in favor except Gits who voted no. Haywood then moved, Turnham seconded the motion to recommend approval of the variance to provide for one-half to one foot variances on the lot width in an R-1 district noting that all frontages would be at least 84 feet on the street side. The second application submitted is a request for a preliminary plat, Norvin Oaks, which will consist of approximately 3.72 acres and will contain 3 single family lots. ZONING AND LAND USE Presently, the zoning of the property is A (Agricultural) and allows a minimum of 1 dwelling unit per 5 acres. The proposed land use indicates an R-2 (Mixed Residential) with a density of 3-6 dwelling units per acre. The zoning request is to R-1 (Residential Single District) which would allow 1 acre lot sizes in an R-1 zone without sewer and water. CONI-IVTS The proposed parcel is located south of Slater's Acres. There is an undeveloped portion between Slater's Acres and Mr. Storland's property. To the east is the new alignment of Cedar Avenue. To the south is undeveloped property which also has a land use designation of R-2, and to the west is undeveloped property which has a land use indicated as R-2 (Mixed Residential) 3-6 dwelling units per acre. The proposed parcel did have access from old Cedar Avenue. However, with this new right-of-way for Cedar Avenue, the access has been provided to the south- west corner of the parcel which connects to Slater's Road. In looking at the parcel itself, there is a pond located in the northeast corner of the parcel, and the rest of this site is covered with trees and has sone topography which exceeds 12% slopes. In reviewing this subject parcel, it is difficult to pro- vide public access to the 3 lots which are in question. Due to the topography, private easements would have to be provided because public streets are impossi- ble to install to provide access to these proposed lots. If an easement is proposed to provide access to Lot 1, this easement should run all the way along the west property line of Lot 1 in order to provide access to the land-locked Parcel between Slater's Acres and Mr. Storland's property. In Lot 3, there CITY OF EAGAN NORVIN OAKS JUNE 23, 1981 PAGE TWO could be additional dedication of right-of-way to the property line of Lot 3. This would provide public access to the lot. However, the topography is quite severe in order to provide a full public street to this property. At the present time, Mr. Storland is proposing to subdivide the 3.72 acres into 3 single family lots. The lot sizes for each of the parcels would exceed 1 acre, and if the zoning were granted to allow an R-1 District, the zoning ordinance would allow private septic systems on lot sizes of 1 acre. In re- viewing the Comprehensive Plan, Section 10 under Ordinances, Page X-4 regarding public septic systems and wells, the Ccnprehensive Plan states that Eagan will require a minimum of 5-acre lots for development of a private septic system in an un-sewered area of Eagan. In this section, it also indicates that Eagan will adopt the requirements of WPC 40 for the installation of new systems. Therefore, the zoning ordinance and the Comprehensive Plan deviate regarding lot size requirements for septic systems. The Comprehensive Guide Plan also indicates that septic systems would not be allowed in areas that have slopes which exceed 12%, and it is difficult to see where septic systems could be provided for the newly-created parcels. Presently, utilities are located in James Street, which is on the north end of Slater's Acres. In order to provide utilities to Mr. Storland's property, they would have to continue south on Slater's Road and then in on the right- of-way which has been provided for Mr. Storland by the State of Minnesota. Therefore, utilities are in the area but are not available to this site at this time. In reviewing this application, the applicant has all of the right to petition for rezoning and plat approval, because the zoning ordinance does allow 1-acre lot sizes without utilities in an R-1 District. With utilities being close to the property but not immediately available, staff feels that this may be premature development to allow private septic systems on 1-acre parcels when utilities are possibly just a couple of years away. If approved, the plat should be subject to the following conditions: 1. Sewer and water shall be provided to the site or the applicant shall waive his right to appeal the assessments for sewer and water. 2. Detailed plans shall be submitted to City staff in regard to has the septic systems will be installed for each of the newly-created homes, and these septic systems shall meet all the building code requirements and PCA requirements. 3. The easement shall be extended to the north property line of Lot 1 in order to provide access to the land-locked parcel. 4. The right-of-way dedication shall extend to Lot 3 in order to pro- vide public access to this lot. 5. The applicant shall provide grading, drainage and erosion control plans to the staff of how access is going to be provided to each lot. 6. The plat shall be subject to the park dedication requirements. CITY OF EAGAN NORVIN OAKS JUNE 23, 1981 PAGE THREE ENGINEMUIG RECOMMENDATIONS 1. A 10' utility easement must be dedicated adjacent to all public right-of- way and centered over all cCMMOn lot lines. 2. UTILITIES Trunk sanitary sewer to service this proposed site has been provided under the Cedar Avenue Freeway along James Street to the intersection with Slater's Road. In order to provide service to this site, sanitary sewer would have to be extended down the west right-of-way off the new Cedar Avenue Freeway or south along Slater's Road, and then easterly along the newly-installed Private access road to the Storland property provided by MnDOT. Both ex- tensions of sanitary sewer laterals would be cost-prohibitive for this pro- Posed development. It would be feasible only if the additional area to the east of this proposed plat were developed to help share in the cost of this lateral extension. Watermain to service this proposed plat would have to be extended southerly frau James Street along the westerly right-of-way of the new Cedar Avenue Freeway (approximately 1,000 feet) or easterly along the newly-installed Storland access road frau Slater's Road (approximately 750 feet) . ACCESS Access to this proposed plat has been provided by a 24' bituminous-surfaced road with 3' gravel shoulders. This was installed as a private access to the existing Storland residence and was not upgraded to the 32' standard streets with concrete curb and gutters that would normally be required with development in this area. GRADING AND DRAINAGE The general slope of this property is to the northeast towards the existing Pond (AP-34) , which is referred to as Slater's Pond. This pond has a pro- Posed controlled elevation of 933.7 with an anticipated 100-year elevation of 940.0. This pond will eventually require the installation of a storm sewer lift station to discharge to the pond north of James Street, which has a positive outlet through the Cedar Avenue storm sewer system. EAMENTS AND RIGHTS-OF-WAY If this plat is approved, in addition to the normal 10' drainage and utility easement centered over common lot lines and adjacent to all public right-of- way, a ponding and utility easement must be dedicated to incorporate the pond in the northeast portion of this proposed plat over Lots 1, 2 and 3 of sufficient description to incorporate the 940.0 elevation. Ted Wachter appeared as did Mr. and Mrs. Storland noting that the parcel was originally 7 acres with the balance of 3.72 acres after the MN/DOT Cedar Avenue taking. There were concerns about the lack of municipal sewage and water and also the fact that a portion of the land contained 12% slopes. Mr. Storland indicated that he would agree to a 30 foot easement along the west line of the parcels to the north line of Lot 1, and there were no objections from neighboring owners. Gits moved, Wilkins seconded a motion to recommend approval of the application for rezoning to R-1. All voted in favor except Krob who abstained, not having been present for the entire con- sideration. Gits then moved, Wilkins seconded the motion to recommend ap- proval of the preliminary plat upon the following conditions: 1. Sewer and water shall be provided to the site or the applicant shall waive his right to appeal the assessments for sewer and water when they are extended to the property or once in the future. 2. Detailed plans shall be submitted to City staff in regard to how the septic systems will be installed for each of the newly created homes, and these septic systems shall meet all the building code requirements and PCA requirements. 3• The right-of-way dedication shall extend to Lot 3 in order to provide public access to this lot. 4. The applicant shall provide grading, drainage and erosion control plans to the staff covering access for each lot. 5. The plat shall be subject to the park dedication requirements. 6. A 10-foot utility easement must be dedicated adjacent to all public right-of-way and centered over all common lot lines. 7. A utility and ponding easement shall be dedicated over Lots 1, 2, and 3 to incorporate the 940.0 elevation. 8. A 30-foot half right-of-way public easement shall be dedicated over the westerly lot line of Lots 1 and 2 to provide dedicated right-of-way access to existing parcel to the north of this proposed plat; in the event however that another access is provided to the property to the north of the plat that the 30-foot public easement will be vacated by the City at the request of the then owner of Lot 1. 9. The owners of Lots 1 and 2 shall not object to and shall waive objections to any assessments associated withupgrading a public street along the westerly boundary of this proposed plat, when and if required in the future, which waiver shall bind the heirs and assigns of the owners. CONIUM= In reviewing this application, staff has had a problem identifying the exact zoning of the property. From 1959-1978 the zoning map has always shown the sub- ject parcel as I-1 (Light Industrial District) . In revising the zoning map for 1980-1981, staff had gone back and researched the files, applications, and resolu- tions accompanying the rezoning request. The Eagan files at this present time do not show any application or resolution that this property was rezoned. How- ever, it is the City Attorney's opinion that since the property has been shown since 1959 through the 1978 rezoning maps, that the property is in fact zoned industrial and that the 1980-1981 zoning map is in error and should be corrected on the next revision to the zoning map. The applicant has already received a sign permit for an advertising sign at this location. However, the sign permit only allows the square footage of up to 250 square feet per sign. The permit has been obtained for the past 4-5 years and has been renewed yearly. Therefore, an advertising sign could be constructed at this location. The applicant, however, is requesting to increase the 250 square feet of signage for a total area of 672 square feet. The dimensions of this sign mould be 14' x 481 . The height of the advertising sign is proposed to be 62' from ground level. Ordinance 10, Subdivision 3 states, "no advertising sign shall exceed 250 square feet in area except when adjacent to limited access highways, in which case the City Council shall determine the maximum size after reviewing applicable conditions including terrain, safety factors, etc." Subdivision 4 states, "no advertising sign shall exceed 40' measured at lot level or roadway level. Whether lot level or roadway level is used is based on visibility fac- tors on the adjacent roadway." As mentioned earlier, 3M National Advertising Co. has received a permit for an advertising sign at this location a number of years ago and is only requesting to increase the size of the sign. Mr. Gerald Osterloo appeared for the applicant and stated that the location would be on the Chicago Northwestern right-of-way immediately south of I-494. The proposal was to project a sign with a total signage area of 672 square feet on a 62-foot pylon with 27 feet above the I-494 road level. A permit has been acquired for a standard advertising sign at that location and it was proposed to increase the size. Members of the Planning Commission objected to allowing increases of size particularly the excessive number of square feet proposed by the applicant. Wilkins moved, Hall seconded the motion to recommend denial on the basis that it would exceed the City's allowable limit of square footage for an advertising sign. Bell for Eagan Unlimited, Inc, , for an Off-Sale Liquor .License for the Safari at Eagan Mall -- An off'-sale liquor license application was received from Mr. Robert Bell for the Safari at Eagan Mall to be located on Cliff Road. Mr. Bell resides in Edina and is the part owner of the 1 & 44 off-sale liquor store located on Hwy. 169 in Shakopee. The other two (2) applicants are Sheila Sukerman of. Golden Valley and Edward Swadden of Plymouth. Chief of Police DesLauriers ' has made an investigation of the three (3) applicants. This liquor license policy specifically states that four (4) off-sale .`liquor licenses shall be allowed at the present time in the City of 'Eagan. More specifically, two licenses are allowed in the general western area of the City near Cedar 'Avenue and Hwy. 13, one license in the general northeastern. area of the City and one license allowed in the general south central area of the City. An off-sale liquor license was granted at the January 20, 1981 City Council meeting to McCrea and Associates, Inc. , for the Safari Mall shopping center. The off-sale liquor license application specifically stated that the intoxicating liquor license would be located at the Safari Mall shopping center. Ray O'Neill & Associates is handling the retail. and office leasing ;for the Safari at Eagan Mall and apparently was not aware that McCrae & Associates had applied and been granted an off-sale liquor license for the Safari at Eagan Mall. It was explained by this office that the off-sale liquor license was processed and acted upon favorably by the City Council with the Safari at Eagan Mall as the business location for the south central license. It was also explained that it is not the City of Eagan!,s position to require lease agree- ments or become involved in leasing as it - g pertains 'to retail space with the center. It appears that the off-sale liquor store as proposed by McCrea & Associates Inc. Chalet Liquor that the applicant, Mr.isBell, is tappl�in he proposed faa the Safari at Eagan Mall. In speaking with Mr. O'Neill, it is their intent to use a portion or all of the area originally proposed for a Coast to Coast Hardware Store for an off-sale liquor store.' The minutes of November 5, 1980, when the City Council acted upon the Safari at Eagan shopping City state ' "The project would include 83,000 gross square feet with 22,000 square feet for a Red Owl Store, also a Snyder Drugs Coast to Coast and about 15 to 17 more tenants." It has been explained to 'both Mr. O'Neill and the applicant that this policy does. exist and that all off-sale liquor licenses have been issued and, more specifically, the off-sale liquor license has been issued for the south 'central area of the City. Hedges City Administrator City of Eagan 3795 Pilot Knob Road Eagan, MN 55122 Re: Safari Mall Eagan, MN Dear Mr. Hedges: I am writing to you to provide you with background information on our efforts to date to get a liquor store tenant for Safari Mall . In early 1980 two different parties contacted us regarding their interest in leasing space in Safari Mall for a liquor store business. At the time we had not yet begun the small tenant leasing program, and they were so advised. In December, 1980, one of the above two parties, Mr. McCrae, contacted us again, and we set up an appointment for he and his wife to come in and discuss leasing space for a liquor store. Mrs. McCrae attended that meeting and we discussed various aspects of the design of the center and their interest in the center. Shortly thereafter, in January of 1981, Mr. McCrae called to inform us that they had been issued a liquor license by the City of Eagan. This came as a complete surprise to us since the way our business normally works the landlord and prospective liquor store tenant first negotiate and agree upon lease terms and conditions, and then the prospective tenant applies to the appropriate authorities for a license. However, since in this case the McCraes now already had a license, we asked them to come in to discuss lease terms. Ultimately we worked out the basic rental terms for a 3,600 square foot space in the mall . And in addition we offered them an alterna- tive of buying an outlot and putting up a free standing liquor store. Thus, from January on, two different offers were open to them for a liquor store at Safari . Their stated preference throughout this time period was to try to do the free stand- ing deal . Periodic phone calls to Mr. McCrae in the months that followed resulted only in him telling us that he was still trying to put the free standing deal to- gether. On June 12, 1981 I spoke with Mr. McCrae once more. On this occasion I told him that we were withdrawing the outlot offer and asked him to give us a decision on the 3,600 square foot mall space offer by June 15, 1981. On June 15th he called and told us that he just couldn't do anything at this time. 7AT Mr. Thomas L. Hedges City of Eagan July 16, 1981 Page 2 Development of Safari Mall was moving ahead rapidly by this time, and because of our experience with our similar shopping center development in Maple Grove, Minne- sota, we made a decision to make a significant change in the major tenant make-up of Safari Mall . We decided to put a liquor store in the space which had been desig- nated for a hardware store, and to enlarge the space to 13,000 square feet. Our reasons for this were two fold: 1. Our proposed hardware store tenant in Safari , Coast to Coast, is the same hardware store tenant we have in our Maple Grove Center. However, that center is now open, but Coast to Coast has not yet found a franchisee for the store. Thus the hardware store is not yet open and will not be open in the near future. 2. Our liquor store tenant in our Maple Grove center, Chalet Liquor City, liked the Eagan area and was willing to lease space if we could provide him with 13,000 square feet. The principal owner and operator of Chalet is Mr. Dick Swadden. Our experience in dealing with Chalet Liquor and Mr. Swadden in Maple Grove has convinced us that Chalet Liquor would be an excellent addition to the City of Eagan. Mr. Swadden is involved in the ownership and operation of several low margin liquor stores in the metropolitan area including two under the Chalet name. He has demonstrated to us very clearly that he is a person of excellent reputation who has the experience and know-how to make a success of the business and, most importantly, the financial strength to carry through on his committment to get the store open once the lease is signed. The essence of Mr. Swadden's operating philosophy is "to pass the savings on to the customer". Most all liquor stores buy through wholesalers who add a certain mark- up to the store's cost. Mr. Swadden has the ability to buy directly from the manu- facturers and pass on the savings to his customers. He is also one of very few in the business that have their own bonding room. This allows him to act as his own importer with foreign distillers and brewers, minimizing additional middleman and taxation costs, and creating still greater savings for his customers in the form of lower prices. We have reached agreement with Mr. Swadden on terms for leasing space in Safari Mall for a liquor store under the Chalet or some other name, and Mr. Swadden has made application to the City of Eagan for an off-sale liquor license. Because the question of a liquor store in Safari Mall now involves a major or anchor tenant, and design of the center must be finalized very shortly, we feel that time is of the essence in considering Mr. Swadden's license application. Contract 81-61 Accept .Bids/Award Contract for Pilot Knob Center Utilities & Gravel Base -- The Director of Public Works and City Administrator had bothspoken with a ' representative of Kraus Ander- son prior to the July 7, 1981 City Council meeting, and originally the request of Kraus Anderson was to cancel the bids received for Contract 81-6. The reason for the cancellation was due to their inability to obtain the necessary financing -for continuing with Pilot Knob Shopping Center project. However, on July 7, 1981, a request was received from Kraus. Anderson asking that City Council Consideration on the bids be continued until the July 21 , 1981 meeting to allow the owners of the project to continue their pursuit of finding financing for the; tax exempt mortgage financing. At the time of this memorandum; 'there has not been any indication expressed by Kraus Anderson as to whether they' will proceed with the project. The low bidder, if! bids are to be awarded, was Lametti & Sons in the amount of :$360,000. Therefore, with these considerations for the future `improvement of Cedar Grove 3rd and 4th Additions, the recommendations that were made by the Director of Public Works for the 1981 seal coating program were verified and supported by the Public Works Committee. Workmen!s Compensation and,'Gieneral Liability Insurance Renewal - The wrrkmen's compensation and general liability insurance policy is in order for annual renewal by the City Council. The City Administrator asked that Valley View Insurance Company, the City's workmen' s compensation and general liability insurance agent request a: bid from the League of Minnesota Cities who is also offering workmen's compensation and general liability insurance packages to municipalities. Consequently, the Home Insurance Company and League of Minnesota Cities both bid general liability, and workmen's compensation. The bid receivid ' from the League of Minnesota Cities was in the amount of $96,372,, while 'the` bid received from the Home Insurance Company was $90,039. These' bids compare with a premium cost of $108,481 for the City` last year. Therefore,' the City will receive a net premium reduction in the amount of $181442. There are no recommended changes to either the '.workmen's compensation or general liability insurance package. City Counciimember Smith has worked with City ,. 'administration' on several occasions analyzing the package policy, auto policy, workmen's comPensationand the umbrella insurance. There are no changes being recommended to the policy as it was in effect for 1980-1981. The premium runs from July 1, 1981 to July . 1, 1982. Copy Machine -- At a special City Council meeting, the City Administrator was asked to provide a method of financing . the pur- chase of a new copy machine for use at the City Hall. The present copy machine is unable to handle the volume of copying that the City performs with consistent quality and reliability. ' The machine cannot double side without frequent repairs, cannot print on dif- - ferent 'wei hts of paper g such as letterhead,, and it is the suggestion and recommendation of the maintenance persbnnel that the machine be: completely rebuilt. Even . if rebuilt, it would not be able to perform many of the needs of the. expanding City departments. The Administrative' Secretary,, Holly . Duffy, wa,s asked by the City Administrator, along with the Secretary to the Director of Public Works and City Planner, to review a number of copy machines that are available on the market to determine which machine would best satisfy the copy needs for the City' of Eagan. The following copy machines` were reviewed: Cannon ,400, Xerox 3450 and 8200, Savin 880 and 790, Minolta EP' 710 and, IBM LII-20. Though there are several other machines available, on the market be the closest to meeti , these seemed to _ ng the needs of our organization. By purchasing the machine outright, it is not a requirement that the City _enter into. a service 'contract; and, more than likely, an eui - ment certificate which is recommended to purchase tequipment by both the Director of Finance ,and City Administrator, would be sold for less than 11.15% The equipment certificate could' be retired from three to five years. The equipment certificate is scheduled for sate this fall, which includes the Toro Groundsmaster, road grader, trucks for maintenance, and if given approval, a copy machine. ACTION TO BE CONSIDERED. ON THIS NATTER To approve or deny the purchase of a new IBM II1-20 copy machine. s/Thomas- 1,. -Hedges - city -Administrator a To MEMO TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: JULY 15, 1981 SUBJECT: INFORMATIVE MEMO FERN- PEDERSON- HOME- ON-NICOLS-ROAD Official notice has been served on Fern Pederson asking that her home either be improved to meet code requirements or removed to prevent a health, safety and welfare nuisance on her property. Mrs . Pederson, who did reside in North Dakota, now resides in Minne- apolis and has been very nice to work with on this issue. She is asking that the Fire Department burn the buildings as a part of their training program. SHADE- TREE- PROGRAM The Shade Tree Division of the Minnesota Department of Agriculture recently conducted a field inspection of our City' s shade tree program. The purpose of the inspection was to check for compliance with applicable shade tree laws and regulations in accordance with the contract provisions of our grant in aid agreement with the State Department of Agriculture. The comments as written by the inspector were very positive regarding prompt inspection and removal and also that the City has performed a great deal in expanding the sanitation and reforestation program which is directly under the operations of the Director of Parks &Recreation and the City Tree Inspector. I-35E- APPROVAL/CITY- OF- EAGAN The City has received a copy of a letter written by Charles Weaver, Chairman of the Metropolitan Council, to the regional coordinator of MnDOT stating that the Metropolitan Council has considered and and adopted the approved construction of I-35E through Burnsville, Apple Valley, Eagan and Mendota Heights as proposed in the location design study report which includes the alternate A-2 design. Also as a part of that review and approval are various park and ride sites which include within the City of Eagan sites at the inter- change of I-35E and Cliff Road and also Yankee Doodle Road and Pilot Knob Road at the interchange of I-35E. MOWING- OF PUBLIC BOULEVARDS The City Administrator, at the request of the City Council, directed the Park Director to have certain boulevard areas adjacent to Meadowland on Rahn Road and Wildwood Lane, as well as Wilderness Run Road east of Pilot Knob Road, mowed by the Park Department. One of the problems encountered by the Park Department in achieving 21 Informative Memo July 15, 1981 Page Two this objective was the great number of rocks, particularly 'on the boulevard adjacent to Wildwood Lane and Rahn Road that were apparently dumped by either contractors or homeowners. It was required that the maintenance crew remove the rocks before mowing could be performed in this area. The City Administrator has asked that a cost program be established to determine, with the exception of the first mowing, the cost to the City for performing this main- tenance function. WATER- TREATMENT FACILITY A draft questionnaire and support information as discussed at the July 7, 1981 City Council meeting will be available for review and comment at the August 4. 1981 City Council meeting. The Director of Public Works and City Administrator will compile the information for City Council review. G.0. IMPROVEMENT- BOND SALE As a reminder, the General Obligation Improvement Bond Sale for $4,530,000 worth of G. 0. improvements is scheduled for 12 :00 noon Wednesday, July 22 , 1981 . A special City Council meeting is scheduled for that same day at 5:30 p.m. to consider the bond sale award.
