ADJOURNMENT 4 f MEMO TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: AUGUST 14, 1981 SUBJECT: AGENDA INFORMATION After approval of the August 4, 1981 regular City Council minutes and adoption of the August- 18, 1981 City Council agenda, the fol- lowing information is in order for consideration: FIRE DEPARTMENT A. Fire Department. -- There are no items to be considered for the Fire Department at this time. POLICEDEPARTMENT B. Police Department -- There are no items to be considered for the Police Department at this time. PARK-DEPARTMENT C. Park Department -- Item #1: Bid Opening to Purchase Approxi- mately 50 Trees -- At the July 21, 1981- City Council meeting, the Park & Recreation Director was directed to prepare specifications to bid approximately fifty (50) trees for planting in City Parks throughout the City. The size of the trees in the specifications varied from 2" to A Bids were opened on August 13, 1981 at 11 :00 a.m. Only one (1) bidder, Minnesota Valley Landscape, Inc. , West Bush Lake, Bloomington, bid the proposal form as supplied by the City of Eagan. As the City Council recalls, $8,000 was budgeted for 1981 for the purpose of purchasing and planting trees on�ublic property throughout the City of Eagan. Enclosed on pages through is a copy of the bid proposal which includes the various species and unit price for each.. The Director of Parks & Recreation is requesting action that would authorize the bid submitted by Minnesota Valley Landscaping and would allow him flexi- bility to review each of the trees and trusting his selection so the best trees are selected for planting. Memo August 14, 1981 Page Two Item #2: Revision to Park Dedication Fee -- At the last regular meet ng of the Advisory Park & Recreation Committee held on August 6, 1981 , action was taken to . recommend an increase in the park dedication "fee presently administered by the City.. Presently, the fees are Single Family at $300, proposed to $400; Townhouse at $250, proposed to $332;: and Apartment at $187, proposed at $252. At the Advisory Park & Recreation Committee meeting, the Director of Parks & Recreation provided the committee members with land sale comparables, which has been the rationale traditionally used by the City to establish ,the cash dedication fees. For a copy of the recent sales that was compiled by the Director of Parks and Recreation, refer -to a Icopy of the August 6, 1981 Advisory Parks & Recreation Packet. PUBLIC WORKS DEPARTMENT D. Public Works Department - There are no items to be considered for the Public Works Department at this time in the agenda. • • August 13, 1981 MEMO TO: TOM HEDGES, CITY ADMINISTRATOR FROM: KEN VRAA, DIRECTOR OF PARKS AND RECREATION RE: ADVISORY COMMITTEE RECOMMENDATIONS; PARKS DEDICATION At the August 6th Advisory Parks and Recreation Committee meeting, the committee made a recommendation regarding an increase in parks dedication. I've been asked to submit this recommendation to the council for their re- view. Background: The committee, and members of a sub-committee, have reviewed a potential increase in the parks cash dedication requirements since the early part of this year. Discussion of the issue by the committee involved a re- view of the various formulas and methods used at deriving parks dedication. The committee deciding that the existing 10% land dedication and cash dedication were being successfully used within Eagan, and that a change from this formula was not appropriate at this time. Prior to the August 6th committee meeting, staff prepared a memo outlining recent land purchases within Eagan and what the various cash dedication re- quirements would be under established land values. (see August 6 park packet) As you know, the committee discussed at considerable length what it felt the issues were, the need for updating cash dedication requirements, and the concern for providing sufficient funds for future park land acquisition/ development. The committee recommendations was based on the following: 1. That recent 1981 land sales averaged to $10,433 an acre. In as much as these sales were for large parcels,of land, it was the conclusion of the committee that smaller parcels, which would be purchased for park needs, may well exceed this average amount. 2. That there has been a recent trend in multiple housing resulting in rapid growth in population with higher densities; and increased needs for park service. Further, that park land in multiple zoning would be more expensive than that which is zoned single family. 3. That recent land purchase for park - Rahn Park - was at $10,000 per acre. 4. To insure funding for future park acquisition which has been identi- fied in the comp plan because park bonding is not a certainty. 5. To keep up with the inflationary market for land and sustain the cash dedication requirement at a level consistent with potential park land purchases. 6. That there had been no increase since April of 1980, and that the committee recommendation should project itself ahead to when a new cash dedication fee would take affect. The committee recommended that this fee would then be in effect until at least December of 1982. After rejection of an initial_ motion, the committee recommended that the fees be increased as follows: 7 Page 2 • • Single Family -- $100.00 Town House -- 82. 00 Apartment - 65.00 These amounts are based on acreage cost of $10,000. Staff briefly reviewed proposed residential plats from January 1, 1980 to the present. If the recommended cash dedication were to have been in effect the City would have generated an additional $37,000. (this figure is approxi mate and does not include Cinnamon Ridge or Winkler/Jackson which were a combination of land and cash) (Staff had discussed the possibility of pro- jecting ahead the potential income from the fees, but it's virtually impossible to determine) The committee is making the recommendation with the intent that the new cash dedication requirements would be in effect by January 1, 1982. I-35E, Approve MnDOT Plans & Specifications (Cedar Freeway to Cliff -Road) -- Detailed plans and specifications have been sub- mitted by MnDOT for review and approval . by the City of Eagan. This project will continue north from the present interchange of I-35E with Cedar Avenue Freeway to the east side of Blackhawk Road ,north of Cliff Road. This segment provides for the construction of both Cliff Road and Blackhawk Road bridge overpasses. ACTION TO BE CONSIDERED ON THE MATTER: To pass the resolution approving the plans and specifications for the construction of I-35E from south of Cliff Road to east of Blackhawk Road and authorize the Mayor and City Clerk to execute said resolution.. I-494 AGREEMENT B. I-.494, Approve MnDOT Agreement #60546 (Storm Sewer Cost Parti- cipatian) During consideration of the public hearing for Project 302 which provided for the trunk storm sewer outlet from O'Neill Pond to the Minnesota River along I-494, it was anticipated that the first stage of the $936,000 construction cost participation by the City of Eagan was estimated to be $653`,400. Additional review of this first stage construction by the Federal Highway Department indicated that additional federal funds could be applied to this trunk storm sewer construction, thereby reducing the City' s cost participation on ,the first phase to approximately $303,000 which results in a $350,000 savings to the City of Eagan. In addi- tion, the staff was successful in negotiating with MnDOT to allow our cost participation to be paid in installments. Therefore, MnDOT has prepared a formal cost participation agreement formalizing -these items , which is now being presented to the Council for formal approval. ACTION TO BE CONSIDERED ON THE MATTER: To pass a -resolution approving MnDOT Agreement #60546 (I-494 Storm Sewer Cost Participa- tion) and authorize the Mayor and City Clerk to execute said reso- lution and agreement Agenda Information Memo August 14, 1981 Page Four CONTRACT 80-29 C. Contract 80-29, Final Payment/Acceptance (Well #6 - Pump) The City has received a request for final. payment from the con- tractor through the consulting engineering firm along with a certi- fication of compliance with plans and specifications which has been verified by Public Works maintenance personnel. All costs associated with this contract are theresponsibilityof the water utility fund. Final construction costs equalled the original con- tract bid, ACTION TO BE CONSIDERED ON THE 'MATTER: To approve the first and final payment for Contract 80-29 to Bergerson-Caswell, in the amount of $19,928 and accept for perpetual maintenance. Project 344, Winkler/Jackson First Addition (Sanitary Sewer) -- On June 16, 1981, the City received a petition from the developer of the Winkler/Jackson Addition and subsequently prepared a` feasi- bility report which was presented to the Council on July 21 , 1981 with a public hearing being scheduled for August 18. The consulting engineering firm will conduct the public hearing and will be availa- ble to answer any questions. Colbert, Director of Public Works Date: 5248a ' WINKLER/JACKSON ADDITION SCOPE: This project provides for construction of lateral sanitary sewer to serve Winkler/Jackson Addition. Winkler/Jackson Addition is a 92 acre site located between the Trunk Highway 77 and the City of Burnsville directly south of Cliff Road. The proposed zoning for the site is a combination of commer- cial and R4 multiple. FEASIBILITY AND RECOMMENDATION: The project is feasible and is in accordance with the Master Sanitary Sewer Plan for the City of Eagan. The project as outlined herein can best be carried out as one contract. DISCUSSION• SANITARY SEWER: It is proposed to construct a 10 inch and 8 inch sanitary sewer through Winkler/Jackson Addition at the location indicated on the draw- ing at the back of this report. The proposed sanitary sewer will connect to an existing 12 inch sanitary sewer located within the right-of-way of Trunk Highway 77 (Cedar Avenue Freeway). The proposed alignment for sanitary sewer prior to Slater's Road is through low areas to minimize the depth of cut dur- ing installation. Also included is the jacking or augering of an 8 inch sani- tary sewer at two locations to provide sanitary sewer service west of Slater's Road. An existing 8 inch sanitary sewer is located along James Street provid- ing service for the southerly portion and for that portion west of Slater's Road. AREAS TO BE INCLUDED Construction Area Assessment Area NW 1/4 Section 31 NW 1/4 Section 31 Parcel 011-26 Parcel 011-26 Mn/DOT R/W Plat No. 19-11 Page 1. 5248a COST ESTIMATE: A detailed cost estimate is presented in Appendix A at the back of this report. The total estimated cost including contingencies and all related overhead is $118,288. Overhead costs are estimated to be 27% and in- clude legal, engineering, administration, and bond interest cost. EASEMENTS: An easement will be required to construct the sanitary sewer through Winkler/Jackson Addition. The depth of the sanitary sewer adjacent to Slater's Road will require the sanitary sewer to be constructed outside the right-of-way of Slater's Road. Easements acquired within Winkler/ Jackson Ad- dition are anticipated being acquired in conjunction with final approval of the plat. It is assumed no cost will be required for their acquisition. A permit is required for construction of the sanitary sewer within Trunk Highway 77. ASSESSMENTS: Assessments are porposed to be levied against the benefited property located within Winkler/Jackson Addition. Lots within Block 1 and 3 are proposed to be assessed for lateral sanitary sewer improvements as out- lined herein. Trunk sanitary sewer was previously assessed as part of Project 4275. A preliminary assessment roll is included at the back of this report. Fi- nal assessment rates for construction of lateral facilities will be determined by final costs and be assessed to each benefited property. Colbert Director of Public Works Date: Jy 7 41V 5239a �2 WILDERNESS RUN ROAD SURFACING SCOPE: This project provides for the surfacing of approximately 7,500 feet of Wilderness Run Road from the west line of Section 26 to Dodd Road. Wilderness Run Road is a proposed 46 foot wide street with an 8 foot bicycle path located on the north side. This project also provides for storm sewer construction and stubbing of sanitary sewer and water main. FEASIBLIITY AND RECOMMENDATIONS: The project is feasible and is in accordance with the Master Utility and Street Plans for the City of Eagan. The project as outlined herein can best be carried out under one contract including both utility and street surfacing. Wilderness Run Road is classified as a minor collector street and is elig- ible for Municipal State Aid Funds. Municipal State Aid Funds allocated to the City of Eagan, however, are presently committed to other projects within the City. It is proposed, at the request of the affected property owners, Lexington South, Inc. , as part of this project that a residential equivalent rate be assessed over the entire length of Wilderness Run Road at this time. The income generated from this assessment will then be used to construct a 46 foot wide street to the east edge of Wedgewood Addition from the west line of Section 26. The remaining portion of Wilderness Run Road will be constructed entirely with Municipal State Aid Funds when they become available. It is therefore recommended as part of this project to construct Wilder- ness Run Road from the west line of Section 26 to the east line of Wedgewood Addition and include all utility and street construction as one contract. Due to the present bidding climate, it might be desirable, however, to include as an alternate bid, construction of Wilderness Run Road to Pond LP-61 assuming a positive trunk fund balance would result not utilizing any City funds. Page 1. 5239a 23 DISCUSSION: For discussion purposes sanitary sewer, water main, storm sewer and streets include construction for the entire length of Wilderness Run Road. A. SANITARY SEWER: Eight inch sanitary sewer stubs are proposed at manholes where future intersections are expected. These future stubs are indicated on the drawing at the back of this report. B. WATER MAIN: Six inch water main stubs are proposed at locations that are best able to serve expected future developments. A 12 inch water main stub is proposed to the north where Wescott Hills Road is expected to be located. C. STORM SEWER: It is proposed to construct storm sewer inlet structures at the low points and at proper design intervals to collect storm runoff on Wild- erness Run Road. The runoff will be conveyed from these inlet structures to the proper ponds as outlined in the Comprehensive Storm Sewer Plan. D. STREET (Surfacing): This construction provides for the construction of an aggregate base on a properly prepared subgrade followed by placement of the bituminous surface in conjunction with B618 concrete curb and gutter. The proposed street section includes 4 inches of bituminous surface and 8 inches of aggregate base. Also included is the construction of an 8 foot wide bi- cycle path located on the north side of Wilderness Run Road. A permanent easement is required to construct storm sewer between ponds LP-50 and LP-46. 4. A permanent easement is required to construct storm sewer from Wilderness Run Road to Pond LP-61. The above easements are anticipated to be acquired upon final approv- al of this project. It is assumed that no cost will be required for their acquisition. COST ESTIMATE: Detailed cost estimates are presented in Appendix A at the back of this report. Trunk sanitary sewer and trunk water main have previously been assessed for this area under Project No. 241. Trunk storm sewer will be assessed to each development as it occurs. REVENUE SOURCES: Revenue sources are presented in two parts. The first part presents revenue sources for the entire length of Wilderness Road assuming MSA funds were available. The APC is recommending approval of the rezoning and preliminary plat as presented. This item was considered by the City Council at the July 21, 1981 City Council meeting. Questions were raised regarding the ability- to provide utility services to the proposed plat. The item was continued until. the August 18 City Council meeting to allow the Director of Public Works to research the feasibility of servicing this property with sanitary sewer. Several questions were raised by the City Council regarding the excessive number of trucks and trailers that are continually observed at the U -Haul location. The City Council asked that U Haul bring their conditional -use permit into compliance before` any further consideration is given to the business sign permit Information regarding site elevations to determine how the proposed sign will be viewed from new Trunk Highway 13 and the Cedar Avenue Freeway was also requested of the U Haul represen- tative. Site elevations as requested from U Haul have not been received to date; however, once reviewed by the City staff, they will be sent out as a part of the Administrative Packet on Monday. U Haul for Sign Permit -- A freeway sign application for busi- ness identification purposes was received from the U Haul Corpora- tion located at 3890 Cedar Avenue. The proposed pylon sign would contain two separate sign areas totaling 110 feet of signage per side. The construction of the sign will consist of steel pylons and plastic signage with interior illumination. The total height ght of the sign is proposed to be 27 feet above the roadway level . The application, submitted by Suburban Lighting for a conditional use permit for a pylon sign for the U Haul Corporation at Cedar Avenue and Highway 13 was originally considered by the City Council on September 16, 1980. At that time, the application was continued until a study was completed concerning the types, sizes and usage of signs along the freeway. After the matter was reviewed, an amendment to the sign ordinance was recommended to the City Council and adopted on July 7, 1981 . The amendment allows an on premise pylon sign for identification purposes for a business sign located directly adjacent to the freeway. An additional free standing ground sign is allowed if located on the side of the property oppo- site the freeway. All signs must comply in all other respects with the provisions of the existing sign ordinance. The property on which the sign is to be located is contiguous with the Cedar Avenue Freeway property. No other pylon signs are existing within 300 feet of the proposed U Haul sign. The current zoning of the property is GB (General Business ) which allows this type of sign as a conditional use permit. If the proposed sign is approved, it should be subject to the following conditions : i 1 . The pylon sign may not be located within 300 feet of any other pylon sign, measured on the same side of the street. 2. The pylon sign shall not project more than 27 feet above 4 the roadway (Cedar Avenue Freeway) level. 3 . This type of pylon advertising sign shall not exceed 125 square feet in area per side. 4. McDonald' s Corporation for a Conditional Use Permit for a Drive Thru Facility (1995 Silver, Bell Road) -- A conditional use permit application was originally received by the City and officially addressed at a public hearing by the APC on April 28, 1981 to con- sider a drive thru facility to be added to the existing McDonald' s Restaurant located , at 1995 Silver Bell Road. This application was tabled by the APC which requested-additional layout information. Action to review the application and recommend approval to the City Council was taken at the APC meeting of July 28, 1981. Action was taken by the City 'Council to ' continue the application for fur- ther staff recommendations and' reconsideration at the August 18, 1981 meeting. The City staff has met with Mr. Al Inde, the Mc- Donald' s representative, and it appears that a reverse traffic circulation would not be feasible due to (1) the location of the kitchen facility, and (2) the fact that the drivers would be approaching the order and pickup facility on the passenger side of the vehicle This would cause a safety problem with the driver leaning across the vehicle in an effort to pick up and make payment for food. After further review and study of the circulation pattern proposed for the drive thru restaurant facility, there are no other alternatives to be recommended by the City staff. Mr. Inde has reviewed the proposal with his staff and there is not recommendation for deviation from the plans presented at the last City Council meeting. Eagan _City Hall. Present were Chairman Harrison and Planning Commission Members Hall, Bohne, Gits, and Krob. Those absent were Turnham, Wilkins, and alternate Haywood. McDONALD'S CORPORATION CONDITIONAL USE PERMIT The Chairman convened the public hearing regarding the application of McDonald's Corporation for conditional use permit for a drive-through facility to be added to the existing McDonald's restaurant located at 1995 Silver Bell Road. Mr. Al Inde was present on behalf of the applicant and indicated that the only difference between the present application and that submitted for the April 28, 1981 APC meeting was that there Were two changes including the western exit only driveway be narrowed from the existing 24 feet to 20 feet i i with additional curbing and a directional sign at the far northern end of the parking lot would guide people to the drive-through facility. He also -4S 1 ` submitted data regarding comparable drive-through facilities in other McDonald's locations. He stated the trash would be stored in metal dumpsters without roof. There were concerns about violations of the exit and entrance 'locations by patrons and questions about pedestrians entering and exiting the building in the lanes of traffic. Hall moved, Harrison seconded the motion to recommend approval of the application subject to the following conditions: 1. An additional exit sign shall be installed on the eastern side of the exit driveway (i.e. western driveway) to supplement the existing sign and to more clearly mark the exit only driveway and an additional entrance sign shall be installed to supplement existing entrance sign. t 2. The directional sign shall be constructed at the northeron end of the parking lot as shown to direct traffic to the drive-through. 3. The refuse collection area shall be constructed as shown on the western side of the parking lot with design similar to existing building and which plans shall be agreeable with the City. 4. A guardrail shall be constructed along the outer edge of the sidewalk which is on the eastern side of the buiding. This guardrail should effectively limit access to the building from the east and will discourage i pedestrian traffic across the drive-through exit alley. j I 5. Special Use Permit for a Mobile Home for JoyceMeissner -- The mobile home permit for Joyce Meissner was not renewed per pre- vious City Council action. Mrs. Meissner has made application for a special use permit requesting theat the City Coucil reconsider the granting of a special use permit for the mobile home located at 3240 Dodd Road, Lot 5, Block 1, Joyce Addition. As stated in the last agenda information, the zoning of the parcel is neighbor- hood business. The City Administrator has spoken with Mrs. Meissner since the last City Council meeting, and, again, her primary reason for locating the trailer on the property is • to provide additional security for the family television repair business located on that parcel. Presently, the Reverand and Mrs. Meissner reside in the church parrish adjacent to Trinity Lone Oak Church. Their sons live in the house located adjacent to the television repair shop and an employee lives in 'the mobile home.. Mrs. Meissner is planning to be present at . the meeting on Tuesday and address her request as well as answer any questions for the City Council. COOPERATIVE POWER UTILITY EASEMENT E. Utility Easement for Cooperative Power Association - On August 4, 1981 , the City Council considered a request from CPA regarding the dedication of a 41 foot utility : easement along the west side of the 40 acre parcel presently owned by the City of Eagan, in the southeast corner of Wescott Road and Pilot Knob Road. After reviewing the report submitted by CPA, the Council directed staff to meet with CPA and receive further clarification on .the feasi- bility of alternative routes. A meeting was held on August 12, 1981 with representatives from engineering, right of way and environ- mental divisions of CPA as well as the Director of Public Works and City Administrator. Apparently, CPA has originallyproposedthat the transmission line continue on north of Wescott Road on Pilot Knob Road to Yankee Doodle -Road and then in an easterly direction from that intersection. . They encountered several problems with that alternative including:the severe curve around Fish Lake and the necessity. to cross the proposed freeway i.n two different locations. This would require future redesign once the . freeway is constructed. Another alternative to cross Deerwood Drive through Patrick Eagan Park to Lexington Avenue requires approval by DNR, approvals from State Planning and the federal government regarding 41 Agenda Information Memo August 14, 1981 Page fieri the necessity for the City to' purchase additional land that was originally acquired through a federal grant because of the power line taking and, in addition, costly condemnation on Lexington Avenue to acquire the necessary right of way. The third alternative to proceed easterly on Diffley Road from Pilot Knob Road to Lexing- ton Avenue and north on Lexington Avenue was proposed to be costly because of the required right of way and also the uncertainty of the future design for Diffley Road regarding the contour and eleva- tion of that roadway presenting, additional problems . The Director of Public Works and City Administrator feel that Cooperative Power Association has fully explored the various alternatives and it appears the, most suitable alignment for the transmission line is the route proposed by CPA. Additional blue ; prints indicating the alignments have been requested from CPA and, to date, they have not been received by the City. A copy will be enclosed with the Administrative Packet on Monday if received prior to delivery of the packet. If this utility ' easement is granted, it should be subject to a condition whereby CPA agrees to pay for all costs associated with any possible future adjustment and/or relocation of. this facility due to the future upgrading of Pilot Knob Road. Another condition for consideration might be the requirement for all concrete pole structures along the Wescott Road alignment. This would eliminate the need for guide wires and certainly improve the aesthetics of the transmission line. CPA officials have in- dicated that they would have no objections to either of these two requirements . ACTION TO BE CONSIDERED ON THE MATTER: To approve or deny the dedication of the 41 foot utility easement` adjacent to Pilot Knob Road in the NW4 of the NWk of 'Section' 22 , and authorize the Mayor; and City Clerk to execute said easement. File No. 49231 Dear Sir: As requested by the Council, we have computed the cost of a fourth altern- ative method of handling the storm water drainage in the vicinity of Ponds LP-57 and LP-6. This includes the installation of a temporary lift station and force main from Pond LP-57 directly to the ditch in Cliff Road. This in- stallation is not capable of handling all possible storms but will minimize the possibility of flooding damage on the Brown property around proposed Pond LP-6. The permanent lift station of LP-6 will still be required when that land develops and this temporary station and force main would be removed. This plan proposes a temporary concrete lift station structure in Pond LP-57, an 8" PVC force main laid along the east line of the Beacon Hills Addi- tion in the 5' wide utility easement and discharging into the ditch on Cliff Road. The force main would be buried with approximately l' of cover to mini- mize physical damage and vandalism during the period that the temporary force main was in use. The water from this force main would drain east in the Cliff Road ditch to the culvert under Cliff Road which drains across the Richard Scherer property down to Thomas Lake. There is no formal easement for drain- age across the Scherer property at this time. It is a natural drainageway and does drain the area south of Cliff Road every time it rains. No major erosion problems are anticipated because the rate of flow from the force main is small compared to the flows carried by heavy rains. The cost of providing the temporary pump chamber, force main, pump instal- lation and temporary electric panel is estimated at $28,000.00. In addition, the cost of bringing 3 phase power by Dakota Electric Company to the lift sta- tion is estimated at $3,000.00. Page 1. 5755a S C • • City of Eagan August 13, 1981 Eagan, Mn. 55122 Re: File No. 49231 For the pump, we could utilize the existing third 30 HP submersible pump from the Carlson Lake Lift Station which was used for pumping Blackhawk Lake last year. This pump has not been reinstalled in the Carlson Lake Lift Sta- tion and is being kept for possible use to pump Blackhawk Lake in the event that its level should rise too much prior to the completion of the Blackhawk Lake Outlet. With the large storage capacity of Blackhawk Lake, we would have sufficient time to obtain another rental pump for that purpose should its ele- vation raise too much. This 30 HP pump would be capable of providing a flow of 2 cfs or approxi- matey 900 gpm from Pond LP-57. With this capacity, most of the water flowing into LP-57 would be pumped to the Cliff Road ditch. However, it is probable that a short duration, high intensity storm of between a 2 and 3 year frequen- cy could cause some overflow into the Brown property. Larger, less frequent storms of short duration and high intensity could cause larger amounts to overflow during those periods of time when the pond was full and the rate of inflow exceeded the capacity of the pump. However, the total quantity of water expected to overflow would be quite small compared to the volume of water removed by the pump. A second alternative pump which could be used would be to purchase a 20 HP submersible pump of the size and type which will eventually be used in the permanent lift station in Pond LP-6. Such a pump is estimated to cost approx- imately $9,000.00 and would be capable of pumping 1 cfs or approximately 450 gpm from the pond. Whereas this rate of flow may cause fewer problems with erosion on Cliff Road and across the Scherer property, it would also allow significantly larger quantities of water to overflow from the pond into the Brown property. It is therefore recommended that the 30 HP pump be used if this alternate is selected. If this alternate No. 4 is selected, it can be anticipated that approxi- mately $5,000.00 to $10,000.00 of the estimated $31,000.00 would represent the salvage value of the materials to be removed when the permanent lift station installation was eventually made in Pond LP-6. Attached hereto is a map showing the proposed location of the lift station and force main in relation to the adjacent property. The lift station is shown in pink, the force main in green and the open drainage along Cliff Road in blue. Ponds LP-6 and LP-57 are also shown in blue. Project 346, Cinnamon Ridge 1st Addition (Utilities & Streets) -- At the August 4, 1981 City Council meeting, the Council closed the public hearing but continued consideration of the award of Project 346 based - upon additional information to be supplied by staff pertaining to grading and drainage of the Cinnamon Ridge 1st Addition. Subsequently, staff has obtained additional eleva- tions of the property in the River Hills Ninth' Addition and has reviewed in detail the proposed grading, drainageandponding area in the Cinnamon Ridge First Addition proposed plat. George Ohman for Rezoning from A (Agricultural) to R-4 (Residen- tial Multiple District) Consisting of Approximately 3.3 Acres - An application was submitted 'requesting rezoning of approximately 3. 3 acres from A to R-4 by Mr. and Mrs. George Ohman. The Advisory Planning Commission is recommending denial to the City Council and since the APC meeting, a letter was received from Mr. and Mrs George Ohman, stating "Mr. Hedges, we will not be at the August 18, 1981 Council meeting as we have withdrawn our application for rezoning. " Since the applicant has withdrawn the application, action to consider approval or denial of the APCs recommendation is no longer required. Therefore, copies of the City Planner's report and appropriate attachments were not enclosed`.as background information. Briefly, the 3.3 acres is a separate parcel ; however, there are approximately 100 acres in the NWk which are presently zoned agricultural. This is the first zoning request within this quarter section abutting Cliff Road on the north and Parkview Golf Course on the east To the west and south, the property is still zoned agricultural. The comprehensive land use guide has designated this parcel as R-2 with a density of 3 to 6 dwelling units per acre. Therefore, the request of a three story, brick, multiple dwelling containing 84 dwelling units was considerably higher, approximately 25 units per acre as opposed to the Land use designa- tion of 3 to 6 units. ACTION TO BE CONSIDERED ON THE MATTER: To provide a motion stating that no action is taken due to the applicants, Mr. and Mrs George Ohman', withdrawing the application for rezoning. ZONING AND LAND USE Presently, the site is zoned NB (Neighborhood Business District) and the sale of 3.2 beer is allowed within this zoning district through the grant- ing of a conditional use permit. Besides obtaining a conditional use per- mit for the particular parcel, the applicant must also meet all of the re- quirements in Ordinance 43, the non-intoxicating malt liquor ordinance. CON=S As you may recall, there is sane past history in this neighborhood business center as it relates to the sale of beer, wine or liquor. In the past, there has been a request for an off-sale liquor store in the first phase of this neighborhood center. The liquor ordinance stated that in order for a facility to be located in this area, it had to be 300' frau the property line of a church or a school. Since the original application had been made, the City amended its liquor ordinance to require that the 300' spacing be frau building to building instead of lot to lot. This would then allow an or-r-sale liquor *store to be constructed in the second phase of the pro- posed neighborhood center. In this particular neighborhood business dis- trict, the property to the north is presently zoned PF (Public Facilities District) and has a church located on the subject parcel. Also, the area on the southside of County Road 30 is also zoned PF (Public Facilities Dis- trict) with another church located on this parcel. Therefore, the 300' spacing requirement is an important factor for the location of any facility which has to do with on-sale or off-sale of wine, beer or liquor. Presently, Piccolo's Pizzeria is located in the first phase of the neighborhood center. It has been operating for the past 6-8 months, and the applicant is now re- questing that a conditional use permit be granted in order that 3.2 beer 67 f CITY OF EAGAN PAT MILER - PICCOLO'S PIZZERIA ,JULY 28, 1981 PAGE TWO can be served within the existing restaurant. It is the staff's understanding that a conditional use permit could be ob- tained for this particular site. However. when the applicant requests the 3.2 beer license, a variance from the 300' provision would have to be ob- tained in order to have this license granted to this facility. It is the staff's understanding that Pat Miler has had discussion with the pastor of the church north of the subject parcel in regard to this on-sale 3.2 beer license. It is the staff's understanding that the pastor would give the consent of the church for Piccolo's to obtain a 3.2 beer license. If approved, the conditional use permit should be subject to all of the con- ditions in Ordinance No. 43, Non-Intoxicating Malt Liquor Ordinance. Mr. and Mrs. Miler were present and submitted a letter from the pastor of the Beautiful Savior Lutheran Church indicating that the church board had no objection to the ant for the 3.2 license in the location within the o300 thetoance spacing under Ordinance No. 43. Because of the unique situation of the back of the building facing the church and there being no objection from the church board, Gits moved, Hall seconded a motion to recommend approval of the application on the basis of the above understanding noting in effect it was a variance. The ordinance requires a 10 x 20' parking space. The majority of this site is set up to service tractor trailers for Mr. Sack's proposed business. The site plan shows parking for 22 trailers and 6 tractors. The applicant is also showing a gas pump on the site for the use of this truck terminal operation. : The proposed site plan meets all the setback requirements and ordinance re- quirements of the Light Industrial District. The applicant is also working on a landscape plan where sod and plantings will be provided in the front of the truck terminal. Mr. Dennis Briguet, attorney, appeared as did Mr. Sack. There Were no objections to the application. There were questions concerning storage and setbacks, apparently which i are all being complied with. The applicant stated that he will not allow on- street employee or customer parking. Hall moved, Harrison seconded the motion to recommend approval of the application sub4ect to the following conditions: 1. The applicant is requesting to plat the property in that mariner. The proposed land use is also R-1 (Single Family) with a density of 0-3 dwelling units per acre. CONNIE<VTS Presently, there is an undeveloped parcel which contains approximately 4 acres located north of Skyline Road and west of Pilot Knob Road. In order to develop this parcel, the applicant must request sewer and water extensions which are presently located on the east side of Pilot Kncb Road. At the present time, the applicant has submitted a petition to the City requesting that these extensions be provided prior to the surfacing of Pilot Knob Road. All lots meet the 12,000 square foot requirement for an R-1 District. How- ever Lots 2 and 3 have only a 70' lot width at the 30' setback. Ordinance 52 requires an 85' width at the 30' setback. Therefore, a variance will have to be granted on bets 2 and 3 in order to develop the plat in this fashion. The west and north lot line of the proposed Oster Addition abuts Highview Park. The Park Director has requested that when the survey is done and the monuments are placed on the lot corners, that the Park Department be con- tacted so park boundary signs can be placed to delineate Highview Park. The Park Director has also requested that the developer provide landscaping along the rear lot lines of 1, 2 and 3 in order to delineate the park pro- perty from the residential lots. 70 r • CITY OF EAGAN PRELIMINARY PLAT - OSTER ADDITION JULY 28, 1981 PAGE TWO The proposed layout for the subdivision maximizes the develcpxnent potential for this parcel. The cul-de-sac which has been provided appears to be the best way to service this parcel. The location of the cul-de-sac is at a point where it has been placed the farthest west on the parcel that it can be placed in order to provide as much stacking roan and turning roan from Skyline Road and Pilot Kncb Road. The applicant is proposing to dedicate 30' of right-of-way for Skyline Road. The applicant is also proposing to dedicate a 75' half right-of-way for Pilot Knob Road. It is the staff's understanding that the right-of-way on Pilot Knob Road in other locations within this area has only been 55' for a half right-of-way. Therefore, the 75' dedication may be reduced 25 ' ' to the 50' half right-of-gray. This will be worked out between preliminary and final plat approval. If approved, the plat should be subject to the following conditions: 1. When the monuments are placed on the west lot lines of Lots 1, 2 and 3, the surveyor shall contact the Park Department in order that the Park Department can place the park boundary signs. 2. Landscaping or vegetation shall be planted on Lots 1, 2 and 3 in order to delineate the single family lots frau the park property. 3. The plat shall be subject to the park dedication time of final plat approvalrequirements at the . 4. A variance would have to be granted on Lots.2 and 3 to allow less than the 85' width requirement at the 30' setback. Sufficient right-of-way must be dedicated to provide for a 50' half right-of-way.of Pilot Knob Read. 5. COLBERT, DIREC'T'OR OF PUBLIC WORKS DATE: JULY 23, 1981 RE: PRELLN1INARY PLAT - OSTER ADDITION (JOHN O'TOOL) The Public Works Departnent has the following cements to offer for considera- tion of preliminary plat approval: UTILI'T'IES Sanitary sewer and watermain of sufficient size and capacity to handle this proposed development is available within the right-of-way of Pilot Knob Road. However, the elevation of the sanitary sewer line requires that approximately 4-8 feet of additional fill must be placed over lots 2, 3 and 4 to provide gravity sewer service for potential future hcmesites. Sewer and water stubs for future extensions to service this plat are being provided under Project 334 in conjunction with the upgrading of Pilot Kncb Road. There are presently no sewer and water utilities within the Skyline Road alignment to the south of this plat. The existing hcmesites of Treffle Acres along the southside of Skyline Road are presently serviced with onsite sewer and water facilities. In the future, it is anticipated waterrain will be extended from Pilot Knob Road to the west along Skyline Road. Sanitary sewer to service the houses on the southside of Skyline Read (Treffle Acres) will have to be provided by a sewer extension frau the west as the need is dictated by the existing home- sites and possible future replatting of the Treffle Acres and Zehnder Acres plats. STREET'S Because of the configuration .of this proposed plat and the restricted access to Pilot Knob Road, the proposed cul-de-sated configuration of the internal street is the most feasible way to provide access to the proposed nine lots of this plat. This internal street will have to be constructed to present City standards of 32' bituminous surfacing with concrete curb and gutter. Skyline Road which will provide access to the proposed Oster Drive, is pre- sently a 20-22 foot wide gravel road. Mien Skyline Road is upgraded, the Oster Addition will be responsible for its share of the improvement costs. However, due to the fact that future required utilities are not yet in place along Skyline Road, it would be premature to construct Skyline Road to exist- ing City standards of bituminous surfacing with curb and gutter. Two alter- natives would be available to insure that the Oster Addition shares in this financial responsibility for the future upgrading of Skyline Road: 1. Escrow an anticipated future assess-ient figure for the improve- ment of S:.yline Road to be applied :hen Skyline Road is upgraded. 2. Construct the north half of Skyline Road (16') to present City standards of bituminous surfacing with concrete curb and gutter as a part of the construction requirements of this plat. -73 PUBLIC WORKS DEPAR'IT�= REPORT PRELL','11NARY PLAT - OSTER ADDITICN JULY 28, 1981 PAGE TWO Due to the fact that there is no anticipated time frame for the installation of utilities in Skyline Road or its proposed future upgrading, it would be difficult to establish an accurate cost figure of sufficient aTmunt to cover anticipated future construction costs. The second alternative would insure that the Oster Addition plat has fulfilled its obligation towards Skyline Road at the present time. The future installation of sanitary sewer and watermain could then be constructed within the south half on unirproved portion of Skyline Road at same future date as the need requires. GRADING AND DRAINAGE A proposed grading and drainage plan has not been submitted for review by staff at the time of this report. The 'property generally slopes frau the southeast to the northwest corner. Due to the elevation constraints of the sanitary sewer mentioned previously, additional fill will have to be placed in the northwest corner of this proposed plat. In addition, an internal storm sewer system will have to be provided to pick up the anticipated future low point of Oster Drive through its curvature to provide drainage into the storm sewer presently being constructed with the improvement of Pilot Knob Road. The additional run-off generated by the development of this plat will be handled by the internal storm sewer system which will discharge directly to the Minnesota River via the proposed storm sewer for Pilot Knob Road and I-494. EASL',=S/RIGHTS-OF WAY The present in-place Skyline Road is located on the south h 30' right-of-way that was dedicated as a part of Treffle Acres. The north 30' half right-of- way will have to be dedicated as a condition of this plat. In additicn, the present 33' half right-of-way for Pilot Knob Road was increased to a 50' half right-of-way through the acquisition of the additional 17' due to the construc- tion onstru -tion of Pilot Knob Road. It is not anticipated that any additional right-of- way over the 50' presently available will be required. A minimum 20' utility easement centered over the common lot line of Lot 6 and 7 will have to dedi- cated to provide access for the required sewer and water laterals. In addi- tion, a 15' utility easement centered over the common lot line of Lots 5 and 6 will have to be dedicated for future extension of the required storm sewer facilities. All other commrmmon drainage and utility easements adjacent to public right-of-way and centered over common property lines will be required in accordance with standard City policy. Mr. C. E. Dahlgren, planner, appeared for the applicant as did Mr. O'Toole and Mr. Torgerson. The four-acre parcel was reviewed by Mr. Dahlgren noting that all lots would be at least 12,000 square feet but that Lots 2 and 3 have only a 70-foot lot width at the 30-foot setback. He stated that it is possible with the County requiring only 50-foot half right-of-way for Pilot Knob Road, the applicants could comply with the ordinance and read- just the lot lines. Some neighboring residents appeared and objected to the higher density use in relation to the surrounding lots, further objecting to the back of lot lines on Skyline drive with other houses on the south side of Skyline Drive fronting on Skyline Drive. There were suggestions as to screen- ing and berming of several lots and also objections to the possibility of two accesses to each lot including cul-de-sac and Skyline Drive. Gits moved, Krob seconded a motion to recommend approval of the preliminary plat upon the following conditions: 1. That no variances would be required at the setback lines and compli- ance with the City Ordinances. 2. That screening and landscaping plans be prepared and submitted to the City staff for review and approval along the rear lot, lines of Lots 6, 7, and 8. 3. That lots 1, 6, 7, 8, and 9 not be permitted to have access to Pilot Knob Road or Skyline Road. 4. When the monuments are placed on the west lot lines of Lots 1, 2, and 3, the surveyor shall contact the Park Department in order that the Park Department can place the park boundary signs. I 5. Landscaping or vegetation shall be planted to the City's specifica- tions on Lots ll, 2, and 3, in order to delineate the single family lots from the park property. 6. The agricultural zoning is the lowest zoning classification in the City of Eagan. Presently, the lot size in an agricultural district is one single family dwelling unit per 5 acres. Once utilities are available to the parcel, the site may be zoned to a higher zoning classification. The Ca:prehensive Guide Plan desig- nates the subject parcel as R-2 (Mixed Residential) with a density range of 3-6 dwelling units per acre. carom= As you may recall, the applicant had requested rezoning and preliminary plat approval on the subject parcel in January of 1981. The subject parcel con- sisted of approximately 36 acres and contained 170 dwelling units. The re- vised planned development proposal consists of the same acreage, but the density has been redubed to 160 dwelling units. This change occurs in the reduction of 5 duplex buildings, or 10 dwelling units. The road alignments have remained basically the same as it was originally submitted with the first plan. The only other change is the shifting around of some of the 8-plex units and the relocation of the open space has been shifted from the north- west quadrant of the north-south street to the southeast quadrant of the same street. According to the Eagan Comprehensive Guide Plan, the land use designated for this particular parcel is R-2 (Mixed Residential) with a density range of 3-6 dwelling units per acre. The applicant is proposing to extend Covington Lane through the Galaxy Park planned development to tie into Galaxy Avenue. The applicant has also con- tinued Narvik Drive north to Galaxy Avenue. The site plan also shows a stub street which will provide access to an outlot in Ri.dgecliffe Development. This stub street will make it possible to develop with the first phase of the Galaxy Park Planned Development. The applicant has sketched an overall design for the outlot in Ridgecliffe as to how this parcel could be developed once the street has been extended to the property. FIRST PHASE OR PRELLNUNARY PLAT The first phase of the preliminary plat will consist of approximately 17.3 acres and contain 82 dwelling units. The dwelling unit breakdown is as follows: 4 single family lots, 11 duplex buildings, or 22 dwelling units, and 7 8-plex buildings, 56 dwelling units - TOTAL: 82 dwelling units. Also in this plat is a .9 acre area which will be used for open space and a tot lot for the overall develcpment.and an 18.2 acre cutlot which will have to be replatted in the future to plat the remaining 78 dwelling units. In reviewing the preliminary plat for this development, there are two additional things the staff would like to see with this first phase. First is that Coving- ton Lane rights-of-way be dedicated through the Galaxy Park Planned Development at this time, and secondly that a ponding easement be provided at the elevation required by the City Engineer. In reviewing the preliminary plat, the applicant is proposing 32 units, or 4 8-plexes on Lot 1, Block 1. According to the area of Lot 1, Block 1, it would only allow 30 dwelling units. Therefore, a lot line will have to be shifted to add approximately 1,200 square feet. Lot 1, Block 2 also is approximately 2 units over what would be allowed for the square footage. These lot lines can also be adjusted to acomr-odate the 24 dwelling units. The rest of the lots and blocks are in excess of the square footage for the structures which are proposed. Mr. Greg Ingram of Urbanscope and Tom Heiberg appeared for the applicant. Noting the applicant had appeared before the Planning Commission in January of 1981, and the application was eventually denied by the City Council, Mr. Ingram reviewed the revisions to the application. The density was reduced from 170 to 160 units with a reduction of five duplex buildings or ten dwelling units. The other change was a shifting of some of the eight-plex units and a reloca- tion of the open space from the northwest quadrant of the north/south street to the southeast quadrant of the same street. The proposed addition would be an expansion of the warehouse facility which would consist of approximately 24,375 square feet. This expansion would be doubling the existing warehouse facility. The office which is existing would not change in size with this proposal. The office ocuplex contains approximately 3,672 square feet. The reason the applicant is requesting the variance to exceed the 35% lot coverage is that the materials for expansion are less costly and are of a standard size for the proposed addition. If the structure would be con- structed smaller, it would require additional cost and special ordering of materials to carply with this 35% lot coverage. Presently, the facility has 29 parking spaces which are located on the east side of the building. In reviewing the site plan, it appears that the parking is within a few feet of the east property line. The parking requirements for the proposed facility would be 83 parking spaces. However, the applicant has indicated that 83 spaces would . not be needed for this facility. The applicant has indicated that 29 spaces would be more than adequate to service this facility but has provided provisions on the site that between 54 and 74 additional parking spaces could be added if the building. is ever sold or a higher intensity use is ever proposed. On the west side of the building, it appears that there is already an access which is being used by the industry on the left. If this expansion is approved, this one access could service both facilities in order to eliminate the direct accesses onto Gemini Road. In reviewing the proposed site plan, all the building setback requirements are - met for the industrial district. If approved, the variance should be subject to the following conditions: 1. If the office portion of this facility is expanded, additional parking spaces shall be required by City staff. 2. If the City determines that additional parking is required for this expansion to the C. A. Roberts building, the applicant shall add the additional parking spaces required by City staff. 3. The proposed structure shall not exceed 38% of Lot 10, Block 6, Eagan- dale Center Industrial Park #3. 4. An adequate landscape bond shall be submitted and not released until one year after the landscaping has been ca-pleted. 5. A joint easement shall be provided to allow both businesses to use the westerly access. Roberts Company concerning its public hearing for the grant of a variance to exceed the 35% lot coverage for industrial building on Lot 10, Block 6, Eagandale Center Industrial Park No. 3 providing for 33% lot coverage. He explained that the hardship was that the structural street and existing buiding would be identical to that in the addition which would double the area of the warehouse building and would add greatly to the construction cost of the addition. There was discussion concerning the potential precedent but that it has been established in other cases in miscellaneous industrial subdivisions in the City. There were no other variances required except there was concern about the inadequate green space on the east- side and the possibility of requiring the last row of parking on the east side to be eliminated to comply with the setback and green space requirements. Krob moved, Gits seconded a motion to recommend approval of the variance to provide for 38% lot coverage subject to the following conditions: 1. If the office portion of this facility is expanded, additional park- ing spaces shall be provided as required by the City. 2. Diamond "T" Ranch Water Service (Jerry Thomas) -- As a result of the Special Assessment Committee meeting on July 28, 1977 and the City Council meeting of August 2, 1977, a temporary water con- nection was granted to Jerry Thomas for a period of up to two years to service the Diamond 'IV Ranch located on County Road 30 east of Blackhawk Road. This temporary water connection was granted due to the future I-35E construction which would displace the Dia- mond "T" Ranch. Subsequently, 'the Assessment Committee and City Council felt that, since the water connection was only for a tem- porary period, there were to be no lateral or connection charges levied for the use of this water service. On August 5, 1980, the City Council, at the request of Mr. Jerry Thomas, continued this agreement for an additional one year period. PAUL ALIGNMENT C. I-35E Resolution for St. Paul Alignment -- The City Administra- tor has reported periodically in informational memos about his attendance as Eagan' s representative on the I-35E Coordinating Committee which has been studying the I-35E corridor alignment alternatives proposed for St. Paul. Briefly, the Metropolitan Council was asked to coordinate a study of various alternatives for constructing the I-35E corridor referred to as the Pleasant Avenue corridor in St. Paul. Barton Ashman, consulting engineers, were hired by the Metropolitan Council to perform this study at a cost of approximately #1,000,000. There. are twelve (12) align- ments that were proposed as alternatives in the draft environmental impact document. The various city administrators in Northern Dakota County have been meeting recently to formulate a position to recom ment to City Councils the alternative that would be most desirable. County Commissioner John Voss has also attended those meetings and stated that he would prepare a resolution which he plans to present to the Dakota County Board of Commissioners at the August 18, 1981 County Board meeting for consideration. The various cities in Northern Dakota County are submitting this resolution for consi- deration by their various councils in a hopeful effort to present a unified position at a public hearing to be held in early September in St. Paul. RESOLUTION REGARDING DRAFT ENVIRONMENTAL IMPACT STATEMENT FOR INTERSTATE 35E FROM T.H.110 (DAKOTA COUNTY) TO INTERSTATE 94 NEAR DOWNTOWN ST. PAUL. WHEREAS, interstate 35E is expected to serve as a vital traffic arterial between northern Dakota County and St. Paul; and, WHEREAS, the proper development of Interstate 35E as a freeway is needed In order to provide an adequate level of service for trucks and other vehicular traf fic generated from within and outside the Metropolitan area; and, WHEREAS, improper development of Interstate 35E through St. Paul would have an adverse effect upon Interstate 35W and T.H. #3 (Lafayette Freeway; and, j WHEREAS, Federal Interstate funding, which will end in 1983, appears to be r an absolute necessity in order to complete Interstate 35E to downtown St. Paul , BE IT THEREFORE RESOLVED that the City of strongly supports the development of the segment of Interstate 35E under consideration as a freeway from T.H. #110 to Interstate #94 (Alternative "A" or "Al" in the Draft Environmental Impact Statement) , for the following reasons: 1 . Only a continuous freeway would appear to provide an adequate level of service for trucks and other vehicles. i � Z 2. The entire route as a freeway would be eligible for 90/10 ratio Interstate funding and this would ease the funding burden placed upon the State of Minnesota. 3. Only a continous Interstate 35E route through downtown St. Paul with connections both north and south to Interstate 35 would relieve traffic demands upon other major routes and permit them to function as planned and designed. BE IF FURTHER RESOLVED that if an alternative, other than a continuous freeway route Is adopted, the City of urges the following provisions: 1 . The design shall be generally consistent with Alternative "K" as illus- trated to the Draft Environmental Impact Statement except that a direct connection shall be made to Interstate #94. Said connection would pro- vide for a continuous route for small vehicles through downtown St. Paul and provide eligibility for 90/10 Interstate funding. 2. Any alternative shall also provide a specific funding commitment, by some government agency, to the Central Business District (CBD) by-pass and short-line routes in order that truck traffic may be properly served if a continuous freeway route is not constructed as urged herein. Resignation of Dick Pettit (Advisory Park & Recreation Committee) -- The City has received a letter of resignation from Dick Pettit who is a member of the Advisory Parks & Recreation Committee. Dick has been asked by his employer to relocate for a period of one year in New York and therefore will not be able to serve the remainder of his term. His situation is exactly the same as Jean Loken who resigned in July due to a one year transfer to New York. Since an opening was recently advertised in the paper and only one resident did respond, Mr. Donn Schumaker, it seemed appropriate to include his letter and resume for your consideration. If Mr. Schumaker is appointed or the City Council wishes to readvertise, the term of appointment is for an unexpired term ending December 31 , 1981 . Ordinance Codification -- The City Administrator is recommending the hiring of Municipal Ordinance Codifiers, Inc. , a law firm loca- ted in Minneapolis , to recodify all of the ordinances in existance within the City of Eagan. A codification will revise, rearrange and codify all ordinances with additions and deletions as may be necessary or desirable to provide a workable and current code. The municipal codifier will study the City' s present ordinances and prepare a list of code or chapter topics and designation of sequence for consideration and approval. He would then review and catalog all present code. and ordinance provisions and list and catagorize such ordinances the City is required by law to retain. There are many conferences held with the City Attorney and City Administrator and at various times during the codification process with the appropriate department heads. The City Council will be advised of the various conference meetings and will be welcome to attend. The City Administrator has a copy of the codification proposal which outlines the work to be performed by Municipal Or- dinance Codifiers, Inc. It was suggested by the City Administra- tor that the attorney, Mr. Roger Jensen, representing Municipal Ordinance Codifiers, Inc. , meet with City Councilmember Egan and City Attorney Hauge prior to the Council meeting on Tuesday to review the proposal. As suggested at the budget meeting, the codi- fication proposal can be financed with additional revenue if that should occur during 1981, be budgeted as a general fund expenditure for 1982 or considered as federal revenue sharing in late 1982. TAX EXEMPT MORTGAGE FINANCING The most recent statistical data sheet regarding tax exempt mort- gage financing is enclosed on pages through �I for your review. Our anonymous telephone cal er regarding tax exempt mort- gage financing contacted this office again two (2) days ago at which time he told me his 'name. Come to find out, this person bought a home before the tax exempt mortgage financing program in the Duckwood Addition from Ken Appelbaum. His name is Mr. Jack Holsather - and he has performed some limited remodeling work in recent months. Apparently, Mr. Holsather is default on some con- tract payments to Mr. Appelbaum and has questioned how two other homes, one built by John Burford and one by Morrel Realty that are in his neighborhood could have secured financing through the tax exempt financing program. Mr. Holsather happens to be the same person who was denied the basketball hoop by the City of Eagan. There never was a consortium of builders upset with the tax exempt mortgage financing program. The City Administrator, before knowing this information, had scheduled a meeting with Mr. Holsather for z Thursday, August 13, 1981, with the City Attorney and Mr. Holsather never came to the meeting. As district boundaries were substantially changed over the years, the apparent tendency was to relate the numbering system to the Commission- ers holding office rather than to maintain a more consistent numbering system. , The greatest inconsistency today is the fact that Districts 4 and 5 do not have any common boundaries. Another factor, which has existed for years, relates to the election years. The Commissioners in Districts 1 , 3 and 5 are elected in presidential election years F and the Commissioners in District 2 and 4 are elected in even numbered - non-presi- dential election - years. If we were to change the DiStrict number designations i today, that system would have to be changed. I hope this brief explanation gives you some insight into the apparent reasons for the District numbers as they exist today. A restoration order will be prepared and prior to finalization of this order we will again inspect the site to ascertain if you have complied with the removal . This order will provide you with an opportunity to demand a formal hearing if you desire. Additionally, a criminal complaint may be initiated. Secondly, the levels of Oak Chase Pond may be adjusted to a level that best serves the public purpose. There has been concern that the level is maintained too low and the Department will consider any requests received from the City for changes in the maintained level.
