Action To Be Considered: Recognize Don Holz, Joel Klein and Lee Markell for their volunteer hours at Holz Farm. Facts: ➢ Don Holz is being recognized for reaching the 2500 hour volunteer milestone at Holz Farm. ➢ Joel Klein is being recognized for reaching the 1500 hour volunteer milestone at Holz Farm. ➢ Lee Markell is being recognized for reaching the 250 hour volunteer milestone at Holz Farm. ➢ The volunteer efforts of the Friends of the Farm have been an extremely valuable component to the success of preserving the 1940's farming heritage for the community. ➢ The Friends of the Farm organization provides volunteer hours and financial support that allow for programs and restoration work at Holz Farm. ➢ Volunteers from the Friends of the Farm and the Eagan Garden Club contributed over 1600 hours of service to Holz Farm in 2014. ➢ Friends of the Farm volunteers are recognized by the City Council after they have reached specific volunteer hour milestones. Spring is a busy time at the farm as the volunteers and City staff prepares the farm for the Holz Farm Spring Festival on Sunday, May 17 and summer camps that will take place in July. The Farm also hosts the Eagan Garden Club plant sale on Saturday, May 9. Parks & Recreation Director Johnson will recognize Don Holz, Joel Klein and Lee Markell in honor of their dedication to Holz Farm. Mayor Maguire arrived at 6:05 p.m. Henry Jandewerth, resident, addressed the City Council regarding the City's 2015 Community Visioning project. A regular meeting of the Eagan City Council was held on Tuesday, April 21, 2015 at 6:30 p.m. at the Eagan Municipal Center. Present were Mayor Maguire, Councilmembers Bakken, Fields, Hansen and Tilley. OLD BUSINESS Ordinance Amendment — An Ordinance Amendment to City Code Chapter 6.38 Regarding Kennel License Regulations City Administrator Osberg introduced the item noting at the February 17, 2015 meeting, Council directed preparation of an ordinance amendment to kennel license regulations. The City issues kennel licenses to facilities that house four or more dogs, cats, ferrets, or rabbits or a combination of those City Council Meeting Minutes April 21, 2015 3 page animals. Osberg noted the proposed ordinance amendment would not add new regulations. It would codify standards already used during annual license inspections. Mayor Maguire opened the public comment. There being no public comment, he turned the discussion back to the Council. Councilmember Fields moved, Councilmember Bakken seconded a motion to approve an ordinance amendment to City Code Chapter 6.38 regarding kennel license regulations and direct the City Attorney to publish an ordinance amendment summary. Aye: 5 Nay: 0 NEW BUSINESS Preliminary Subdivision and Variance — Dan Rogers City Administrator Osberg introduced the item noting the Council is being asked to approve a Preliminary Subdivision (Preusse 3rd Addition) to relocate a shared boundary and to approve a Variance (parking setback) for properties located at 4131 and 4141 Old Sibley Memorial Highway. Planner Thomas gave a staff report. The applicant was available for questions. Mayor Maguire opened the public comment. There being no public comment, he turned the discussion back to the Council. Councilmember Tilley moved, Councilmember Fields seconded a motion to approve a Preliminary Subdivision (Preusse 3rd Addition) to relocate a shared boundary for properties located at 4131 and 4141 Old Sibley Memorial Highway, subject to the following conditions: Aye: 5 Nay: 0 1. The developer shall comply with these standard conditions of plat approval as adopted by Council on February 2, 1993: B1, C1, C2 and E1. 2. The property shall be platted. 3. The lower parking lot on Lot 1 shall include a permanent physical barrier (fence, curb, parking blocks, etc.) along the entire northern edge of the parking lot. 4. All erosion/sediment control plans submitted for development and grading permits shall be prepared by a designer who has received current Minnesota Department of Transportation (MNDOT) training, or approved equal training as determined by the City Engineer in designing stormwater pollution prevention plans. Also, all personnel responsible for the installation of erosion/sediment control devices, and the establishment of vegetation for the development, shall have received Erosion/Sediment Control Inspector/Installer certification through the University of Minnesota, or approved equal training as determined by the City Engineer. 5. Striping of the upper parking lot (Lot 2) shall be modified to provide a 20' minimum drive lane opening to the lower parking lot (Lot 1), measured perpendicular to the direction of traffic. 6. The applicant shall provide private cross -easements for ingress/egress and shared parking, in a form acceptable to the City Attorney, at time of Final Subdivision approval. Agenda Information Memo May 5, 2015 Eagan City Council Meeting CONSENT AGENDA AWARD contract for Fire Station Four remodel/addition and APPROVE additional funding from the Community Investment Fund Actions To Be Considered: ➢ Award a construction contract, with alternates, to Kue Contractors in the amount of $1,238,587, for the remodel and expansion of Fire Station Four. ➢ Approve additional funding of up to $770,000 from the Community Investment Fund. Facts: ➢ Eagan Fire Station Four is located at 4200 Dodd Road. The Fire Station was constructed in 1987 and is in need of both mechanical and functional updates. ➢ The fire station is located in one of Eagan's best areas for recruitment of paid -on- call firefighters. The current design only allows for two large response apparatus to be housed at the station. As part of the Fire Department's consolidation of fire stations plan, Fire Station Four would be one of three fire stations serving Eagan. This would require the addition of one more apparatus bay to accommodate an existing elevated master stream fire truck. The new apparatus bay addition is approximately 2,200 square feet. ➢ The 2013 cost estimate for hard costs for this project in its initial stage of planning was approximately $780,000. In December 2014, the Council approved $780,000 funding from the Community Investment Fund. ➢ With the revised total project cost—hard costs, soft costs, and contingency—of approximately $1,550,000, an additional $770,000 funding will be required. ➢ The Community Investment Fund balance currently is $2,400,000. (The Cascade Bay filtration upgrade and the renovation of Old Town Hall—estimated at $750,000 total for the two projects—will be paid from this fund as well.) ➢ In March of 2015 an updated cost estimate for hard costs for this project was $1,214,097. Some of the differences between the 2013 and 2015 cost estimates are outlined below: o An approximate 24% increase in construction costs from 2013 to 2015. o An increased scope of work as the project was allowed to proceed into a formal design process. These changes included: ■ Moving both restrooms and bringing them into ADA standards. ■ Expanded parking lot pavement to allow for turning radius of fire apparatus with new addition to existing building. ■ A control system for the HVAC system that allows city maintenance staff to access remotely and matches control systems at other city facilities. ■ Replacing the trench drains in the existing fire apparatus bays to repair deteriorating 27 year old metal drains. ■ Replacing all existing lighting fixtures with energy efficient LED fixtures. ■ Demolition of an existing kitchen that is not needed in order to expand the training classroom area. ■ Relocation of some existing utilities to meet current building codes. ➢ We received proposals from thirteen general contractors for this project. ➢ Staff and CNH Architects are recommending that we award the contract to the low bid from Kue Contractors in the amount of $1,214,217. ➢ We are also recommending that we include Alternate #1 and #2. o #1 is to locate a fire hydrant on the fire station property to allow for on- site training and equipment testing. There is currently no fire hydrant on the fire station site. This alternate bid is $10,678. o #2 is to replace the existing stoop and apron in front of the main apparatus bays. These have failed twice in the past years and will need replacement again if not addressed in this project. The original project in 1987 did not include footings for this area which has caused failures from frost movement. This alternate bid is $13,692. ➢ Adding alternate 1 & 2 to the base bid brings the hard cost to a total of $1,238,587. ➢ CNH has created a complete building project cost which is outlined below. Bid Process The pre-bid process went smoothly and there was significant general contractor as well as subcontractor interest in this project. This was evident by the large number of general contractors obtaining bidding documents as well as the high volume of requests for bidder lists we responded to. Bid Results The bids for the Fire Station #4 project were received on April 21, 2015, based on the plans and specifications developed by CNH Architects and our consultant team. The bids were opened and read aloud to all in attendance. There were thirteen conforming bids submitted by general contractors as shown in the table below. As noted above, the bids were relatively tight with the apparent low bidder, Kue Contractors, being just 3.1% below the next grouping of three contractors all of which were in the $1.25 million range. The low base bid of $1,214,217 for the fire station addition and remodeling is approximately 10% below the cost estimate provided by CNH Architects on March 12, 2015. CNH Architects has interviewed Kue Contractors to discuss their comfort level with their bid and ask some general qualification questions. They have reviewed their subcontractor bids and feel good with their bid amount. Kue Contractors, Inc. was founded in March 1994 and does a variety of commercial construction with significant public sector work including many municipal clients as well as school district work. Specifically relevant, they have worked on three previous fire station projects including the Montevideo Fire Station completed in February of this year. The project manager for the Fire Station #4 project, Joe Kuechle, has over 30 years of experience in the construction industry. CNH Architects contacted nearly a dozen of Kue Contractor's clients and architects from their past public project work. Several of the individuals interviewed have had multiple projects completed by Kue Contractors in the past 5 years. The consensus was a very positive recommendation for the company. Recommendations Base Bid - Fire Station #4 - $1,214,217: CNH Architects considers this bids to be competitive and of good value. As noted above, we have interviewed the low bidder and found them to be responsible and responsive to the documents. Consequently, CNH Architects recommends awarding the contract for the Eagan Fire Station #4 Addition & Remodeling to the low bidder, Kue Contractors, Inc. There are two alternates that were bid as separate costs as part of the bidding process. I will summarize each below. Alternate #1— Fire Hydrant - $10,678: This alternate represents the extension of water line and installation of a fire hydrant at the northeast corner of the fire station site. There are currently no fire hydrants on the fire station property. This hydrant will allow for fire training exercises at the station as well as the ability to fill fire apparatus quickly outside of the station. The price for this alternate is a good value and falls in the lower third of the prices provided within the different bids. Consequently, CNH Architects recommends approving this alternate as part of the contract award. Alternate #2 — West Apparatus Bay Apron and Stoop - $13,692: This alternate would replace the current west apparatus bay aprons that have failed twice in the past 25 years. These would be replaced with full foundations (stoops) and attached concrete slabs. This will provide for stable slabs leaving the apparatus bays that are not susceptible to frost movement and would be consistent with current design standards. The price for this alternate is a good value and falls in the middle of the prices provided within the different bids. Consequently, CNH Architects recommends approving this alternate as part of the contract award. Facts: ➢ Each year at the time of the renewal of the City's property/casualty insurance policies, the City Council is asked by the League of Minnesota Cities Insurance Trust (LMCIT) to take formal action to "waive" or "not waive" the statutory tort limits to the extent of the insurance coverage being purchased. ➢ Minnesota Statutes provide the maximum liability of any municipality on any claim to be $500,000 when the claim is for death by wrongful act or omission and $500,000 to any claimant in any other case and $1,500,000 for any number of claims arising out of a single occurrence. These limits do not cover MN Statutory Liquor and Federal Laws (civil rights and disabilities). ➢ The City is annually provided an option to purchase excess liability coverage, in effect raising the statutory limits. However, because the statutory limits have been upheld in numerous court cases and because of the relatively high premium costs, Eagan has chosen over the past number of years not to purchase any excess liability coverage. ➢ Choosing not to waive the statutory tort limits means that an individual claimant could potentially recover no more than $500,000 on any claim to which the statutory tort limits apply. The total that all claimants could potentially recover for a single occurrence to which the statutory tort limits apply would be limited to $1,500,000. ➢ Staff has not done a survey, but in discussing the issue with the City's insurance agent there does not appear to be a consistent conclusion reached by the various cities insured by the LMCIT as to either purchase excess liability coverage and/or to waive or not waive the tort limits. Individual City philosophies and financial situations are most important in informing the decision. While staff has not requested a complete legal analysis of the issue, the City Attorney sees the decision to waive or not waive the tort limits as a matter of public policy for the City Council to decide. The application form has been submitted and deemed in order by staff. Approval is contingent upon the following conditions: o The Eagan Lions Club must provide a certificate of liquor liability insurance. o The licenses shall provide paid or volunteer private security to monitor the licensed area and the licensee shall be subject to any order by the Eagan Police Chief as to required security measures and personnel, including the required security personnel numbers, permitted or required entrances and exits from the designated area, as a condition of the license. o The licensee shall designate an on-site manager of the licensed area who shall be within the licensed designated area at all times during the hours of sale. The on-site manager shall complete training in alcohol beverage service and shall train any server and security personnel of the same. ➢ The Eagan Lions Club has also applied for an off-site gambling permit to conduct bingo on July 4, 2015. After review, staff found no reason to deny the permit. Final approval is granted by the Gambling Control Board. ➢ The July 4th Funfest Committee has applied for a Special Event Permit for the annual parade to be held on Yankee Doodle Road and Central Parkway. Facts: ➢ In September 2014, the City of Eagan invited bidders to submit sealed quotations for the 2014-2015 snow and ice control season/operations. Quotations were received from five bidders on September 17, 2014. ➢ Birch Lawn Maintenance was the successful bidder for the street and cul de sac snow removal. ➢ On October 6, 2014, the City Council approved an agreement with Birch Lawn Service for the 2014-2015 plowing season. ➢ Birch Lawn Maintenance provided excellent service during the 2014-2015 plowing season. ➢ The 2014-2015 agreement is renewable for a second year, if mutually desirable. ➢ In addition to extending term of the agreement to cover the 2015-2016 plowing season, the amendment also contains the following modifications to the original agreement: o Reduces the quantity of equipment to a minimum of four (4) pieces in lieu of a minimum of five (5) pieces of equipment. o Increases the hourly rate to $75.00 per hour per truck in lieu of $70.00 per hour per truck. o Reduces amount of the required financial guaranty to $2,500 in lieu of $5,000. ➢ The amendment has been reviewed by City Staff and found to be in order for favorable Council action. She went on to state that their proposal would provide the best test case based on the conditions imposed and the interest the request has garnered from the neighborhood. Member Sagstetter asked what she anticipated the impact of the use would have on the neighborhood. Ms. Bramer stated her belief that it would have no impact on the neighborhood as it would be no different than having relatives staying at their home periodically. Member Prashad stated that as a realtor,'it was his experience that rentals can impact nearby property values. He stated further that he is an advocate of property rights and privacy. Ms. Bramer stated she understood the comments but noted that the concerns for house -sharing in San Francisco were due to the fear of a spike in property values making single family properties less affordable. Chair Filipi opened the public hearing. Dale Runkle, 3669 Pinecrest Court, stated he and his neighbors were confused about why they are even at the meeting being that the commercial nature of the proposed use is in direct conflict with the allowed uses in the R-1 zone. He stated he is concerned with the impacts short-term rentals will have on his property and neighborhood. He concluded with four reasons why the proposed permit should be denied: 1. It is inconsistent with the intent of the Zoning Ordinance. 2. It is inconsistent with the R-1 zoning. 3. An adequate use already exists on the subject lot. 4. It does not promote health, safety and welfare. Advisory Planning Commission April 28, 2015 Page 3 of 5 Robert Shane Barth, 3668 Pinecrest Court, stated his opposition to the proposed use including strangers accessing the rear yard and lake by crossing his property and he provided a summary of issues/concerns including damage to his property from landscapers hired by the Bramers last year and parking in the cul-de-sac that has impacted trash collection and snow removal. John Lodoen, 3660 Pinecrest Court, stated he and his wife purchased their home in 2013 and they have made significant improvements to the property. He stated his opposition is based on the proposal being inconsistent with the area and not meeting the following CUP criteria: it would be detrimental to public health, safety and general welfare of the neighborhood, would not be harmonious with the objectives of the Comprehensive Plan and City Code provisions, it will change the essential character of the area, trash collection and snow removal has been compromised by guest parking, it will not promote the general welfare and it is not consistent with R-1 zoning. He went on to state that his opinion that the requested permit would only serve to benefit the Bramers. Victor Froloff, 3648 Pinecrest Court, stated his concerns with safety, property values, privacy and traffic. There being no further public comment, Chair Filipi closed the public hearing and turned the discussion back to the Commission. Member Piper asked if a person can lease a room long term. City Planner Ridley stated long term rentals are permitted and provided the example of a homeowner renting rooms to friends and stated the City Code allows up to five unrelated persons to be defined as a family. Member Prashad stated that his experience as a property manager made him familiar with established criteria for renting properties including credit and criminal background checks, etc., and that he does not see that the same due diligence would be applied here. Member Vanderpoel thanked the neighbors for coming and stated their concerns are understandable but some may be misguided. She stated her belief that the proposed use falls outside of the R-1 purpose. She also stated action on this type of permit would be premature until the City Council decides whether or not to direct an ordinance amendment regarding short- term rentals in the single family zone. Member Piper stated his agreement with Ms. Vanderpoel. He went on to state his belief that there is potential in allowing the general use once the City Council has reviewed all available information and best practices and determines the suitability of the use as a whole and not on an individual basis. Member Piper moved, Member Sagstetter seconded a motion to recommend approval of an Interim Use Permit to allow short-term rentals of their basement, subject to the conditions listed in the staff report. After the motion was made and seconded, Member Sagstetter stated he shares the same concerns as other members. He stated the use may be appropriate somewhere in Eagan but not in an R-1 area. Member Dierkes agreed with other members of the commission. Advisory Planning Commission April 28, 2015 Page 4 of 5 Member Prashad stated he did not believe the proposed use is compatible with the area Member Piper stated he wanted to clarify that his belief is that this type use is suitable in an R-1 area because that is where you would find the largest homes and that every B&B he has stayed in has been in a single family home. As such, he said it may be an appropriate use in an R-1 area in his opinion but he would prefer the topic be discussed in a different setting. The question was called and all voted against. Member Piper moved, Member Vanderpoel seconded a motion to recommend denial of an Interim Use Permit to allow short-term rentals of their basement, subject to the following conditions: 1. EXISTING CONDITIONS The 37,500 SF lot is developed with an existing single family home and attached garage constructed in 1987. SURROUNDING USES The subject site is surrounded on all sides by single family detached homes, save for Fish Lake to the south. EVALUATION OF REQUEST Proposal — The applicants are proposing the Interim Use Permit (IUP) to allow short-term rentals of their walk -out basement for a period of three years or until the City of Eagan modifies the City Code to allow for short-term rentals in residential areas, whichever occurs first. Presently, short-term rentals are defined in the City Code as hotels or motels. This type of commercial activity is only permitted in commercial zones and is not permitted in residential zoning categories. Compatibility with Surrounding Area — The applicant believes the use, if properly managed and regulated, is compatible within a single family neighborhood. Typically, the City of Eagan has not encouraged commercial activities withinn residential districts as a means of preserving the residential nature of those areas. Home occupations (home offices, etc.) are permitted as an accessory use in a residential district, but only if they do not involve signage, frequent customer traffic, outdoor storage or other features out of character with a residential neighborhood. Cily Code — The City Code states "The purpose of an interim use permit is to allow a reasonable use of property for uses not spceifically permitted in a zoning district on a temporary basis as deemed appropriate by the city council upon recommendation of the advisory planning commission and benefit the public good." Directed Review — A question regarding short-term rentals in residential zoning districts was raised late last year and the City Council directed staff to research the general use and how other cities typically regulate it. City staff reached out to metro area communities and found that where the use is allowed, it is typically provided for via Conditional Use Permit (CUP), sometimes in parallel with a licensing requirement to provide for annual reviews of compliance with conditions. Planning Report — Bramer IUP April 28, 2015 Page 4 This information was shared with the City Council and they asked for additional information regarding operational requirements, lodging taxes, etc. City staff contacted the City Attorney and the Eagan Convention and Visitor's Bureau (ECVB). The City Attorney has concluded that: ® The City may regulate all home lodging accommodations to ensure that all are subject to the same rules. ® The rental of a room or rooms for sleeping accommodations offered to the public for a period less than a week would fall within the definition of hotel/motel lodging which may require a license. ® ADA requirements would not apply. ® All licensed lodging establishments are subject to the same fire and health inspections. Lodging accommodations are subject to the Eagan lodging tax and the tax must be imposed and collected. The ECVB has stated they are not opposed to this type of lodging, provided the purveyors are required to meet the same criteria the 15 Eagan hotels are subject to — including State Fire Marshal inspections, the implementation of all ADA standards and Eagan's local lodging tax ordinance. Prior to reporting the additional findings to the Council, the Bramer IUP application was submitted. To date, the City Council has not formally considered whether or not to allow the short-term rental use via a CUP that would run with the land without a term or on an interim basis with a fixed term (IUP). Applicant's Narrative — The applicant states "...we have proposed specific conditions on the permit to address concerns raised by our neighbors, including mandating that all parking be in our driveway and that individuals may not access the basement by trespassing on our neighbor's property." The applicant also proposes a condition requiring at least one of the owners be present when the basement is being rented. "By authorizing the interim use permit, we will be able to provide further information regarding the demographics of renters, and can serve as a "test lab" to determine whether the conditions proposed are workable, and whether any concerns of neighbors are justified." After enjoying the property for over a year and a half, a friend suggested we look into renting out our walk -out basement on Airbnb to short-term renters, as we did not often use the space. I wasn't familiar with Airbnb, so I did some research. Airbnb is a website for people to rent out lodging on a short-term basis, with over 800,000 listings in 33,000 cities and 192 countries. Users of the site must register and create a personal online profile before requesting a booking — think of it as an intersection of Facebook and Expedia. Every property is associated with a host whose profile includes recommendations by other users, reviews by previous guests, as well as a response rating and private messaging system. Unlike hotels or motels, the host (homeowner) on Airbnb can choose to accept a booking or reject it. In our case, we communicate with potential guests in advance, ask them the reason for their stay, read reviews of the potential guests posted by other homeowners, and get general information about them prior to accepting their booking request — after all, these guests are sharing our home with us and we want to feel comfortable! We also make sure will be present when the guest is staying with us. After we educated ourselves about Airbnb and the process, we put together a listing. A copy of our listing on Airbnb (which is currently de -activated), along with some of the photos of the space, are included as Attachment 1. Within 24 hours of listing our property on Airbnb we had our first booking — a college student from China who was visiting a friend in Apple Valley. She preferred to stay in a residential neighborhood rather than in a hotel — she was very shy and valued her privacy. The guest stayed with us for a week, and left us a wonderful review of the space and the location. Indeed, all reviews for our property, which appear on Airbnb's website, are attached as .Attachment 2. Each guest has access to a community guide book that we put prepared that includes our favorite spots in Eagan, which we love to highlight. In addition, because we stay at the home (and don't rent out the lower level when one of us can't be there overnight), guests have appreciated that we are always available to address any concerns they have. Notably,_we have not had a single incident or problem with any of our guests since we started accepting booldWs. In fact, all our guests have been friendly, personable, gracious, and respectful of our neighborhood, and they have all loved staying at our place. Since our first booking, we have had over 20 separate reservations by a wide variety of people, including A couple in town for the night for a wedding. An older gentleman who wanted to bike in the area and wanted somewhere where he could easily get 131s bike on the road, .Foreign eel ,e shnimts,at, VW: Eau.:.Claire who wanted to come up to shop at the Eagan outlet mall and the Mall of America. e ., u �€ • An individual looking to purchase a home in the area who wanted to get a sense of what the neighborhood was like. • A couple from Minneapolis who needed a short vacation from their children and wanted somewhere calm and serene to work. • A number of people who were in town for a week or two for work. • A young professional who stayed with us for 4 weeks from Sunday night to Friday morning. They are building a house in Woodbury, but the home wasn't finished prior to them selling their fust home. They looked into hotels, but wanted something with a more "homey" feel to it. We have invested all of the proceeds from the rental of our lower level to improve the unit, and in turn, improve the home's property value — and we believe our reviews reflect our commitment to provide an excellent environment for our guests. Specifically, we've utilized the fiends we received to redecorate, add a concrete pathway to the door, install a mini -fridge and microwave, and invest in toiletries for our guests to use. In late November, after we were alerted by a neighbor to the potential prohibition on short-term rentals, we immediately cancelled all existing reservations and reached out to the City for guidance. Based on our conversations with the City Planner, and an understanding that the City has begun the process of evaluating short-term rentals, we have decided to apply for an interim use permit. As part of this request, we have proposed specific conditions on the permit designed to address concerns raised by our neighbors, including mandating that all parking be in our driveway and that individuals may not access the basement by trespassing on our neighbor's property. Furthermore, (and as was the case will all of our earlier bookings), we propose that a condition of the interum use permit include one of us staying at the property when there are guests in the lower level (which will allow one of us to still travel for work). Indeed, the regulations we propose in the interim use permit go further than any requirement of an individual who is renting out their own entire home on a long term basis, which does appear to be allowed or an individual that allows a friend or family member to stay at their home on a short-term basis. It is important to note that there are hundreds of Airbnb rentals in the Twin Cities metropolitan area. (A quick search resulted in 702 listings as of the date of this letter.) There are other current listings in Eagan, as well as in the surrounding suburbs, ranging from single rooms to entire homes. While this may be more of an issue for the City to consider when it looks to regulate short-term rentals going forward, it's important to realize that by prohibiting short-term rentals in Eagan the city would be missing out on capitalizing on a growing group of consumers who would otherwise infuse money into the local economy. In addition, other cities have regulated the activity and allow for Airbnb rentals. In order to assist the Council in developing regulations, I provided the city planner with information regarding how other cities have approached this issue. For example, Duluth requires a permit and imposes certain conditions on those seeking to rent out their homes on a temporary basis. The interim use permit we are requesting goes fin ther than what is required in Duluth, by imposing stricter regulations on how our home can be rented. We would like to be actively involved as the City develops regulations for short-term rentals, and believe we can provide significant insight leaving been a successful Airbnb host over the past 4 months. By authorizing the interim use permit, we will be able to provide further information regarding the demographics of venters, and can serve as a "test lab" to determine whether the conditions proposed are workable, and whether any concerns of neighbors are justified. Third, the homeowners will agree to any conditions the council deems appropriate, and will also provide the Council with any information it requests in order to assist the Council in developing regulations regarding short- term rentals. Fourth, the use meets the standards set forth in the zoning regulations regarding conditional use permits, as follows: A. Will not be detrimental to or endanger the public health, safety, or general welfare of the neighborhood or the city. Because the homeowners will be residing in the home, the short-term rental arrangement is more akin to allowing a family member or friend stay on a short-term basis, rather than an operating hotel. In fact, there will be less of an imposition on the neighborhood given the conditions proposed than if family members of friends were staying, including a prohibition on street parking and an agreement to discontinue rentals in the event of any substantiated complaints. Moreover, by offering short-term rentals, the local economy benefits by the extra traffic at shopping centers, restaurants, and grocery stores. B. Will be harmonious with the general and applicable speck objectives of the comprehensive plan and Code provisions. Again, as the home will be occupied by the homeowners any time there are individuals residing at the property, it will retain its character as a residential home. C. Will be designed constructed, operated and maintained so as to be compatible in appearance and use with the existing or intended character of the general vicinity and will not change the essential character of that area, nor substantially diminish or impair property values within the neighborhood. There will be no changes to the exterior of the home, except for improvements by the homeowners. It would be impossible for a passerby to notice that a short-term rental is occurring in a portion of the home for example, there will be no signage indicating that the property is available for rent on a short-term basis. D. Will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools The short term rental will use the same services as the existing homeowners. E. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be hazardous or detrimental to any persons, property or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare or odors. The short term rental will use the same services as the existing homeowners. F, Will have veh"lar ingress, and egress to the. property which does not create traffic congestion or interfere with traffic on surrounding public streets. Because any vehicles will be parked on the homeowner's driveway, there will be no congestion on the street. G. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. This is not a concern with the proposed use. H. A few weeks later[ came home to see a Landscape crewin the process of putting in a concrete walkway in those locations. They had cut the sod, put in concrete forms and were preparingto pourconcrete next. Tyson and the crew foreman approached me to saythat our Comcast cable line had been severed but temporarily spliced. Comcastwould be outto fix, and i was to send the bill to the Landscape company. The line was severed because no one called to request a markingof wires& pipelines before digging! I was shocked that my permission granted for small walking stones had turned into concrete paths with no discussion, but Ile titgo. Withinafewweeks when i was attemptingto blowout my lawn sprinklersystem to prepare for the winter, I discovered that two sprinkler heads and two lines had been cut by the excavation forthe concrete paths, one above and one below. With nearly 100% of Pincrest Ct neighbors in attendance we discussed the following objections; 1. Public safety concerns A room rental whether by the hour, day, night, or week, leaves the door open for renting to unsavory individuals. The applicants would have us believe that they will screen prospective boarders. People CAN and DO lie and misrepresent themselves. if the city allows this permit we lose all control over who will be walking our street and interacting with our children. The applicants are asking us to trust them in who comes and goes in our neighborhood and they will do what is right and best for us. The applicants don't mention anything about criminal background checks on their customers. There are 2 Marriot hotels just across Pilot Knob where police can patrol the lot and work with hotel management to check for fugitives. These checks will not happen in our neighborhood. Thus far they have misled us and moved forward leaving us to guess what was going on. This business venture is for the applicant's financial gain, not for the peace and safety of our neighborhood. We submit that the quest for financial gain will rule over the well-being of our neighborhood. These applicants know that we don't want this and now they are attempting to ram it down our throats. There is definite tension regarding this lodging proposal that is attempting to wedge a lodging house into our Single Family Residential Zoned neighborhood. 2. PARKING The applicants will have you believe that parking will no longer be an issue. The parking was and if passed will remain a problem. There is not sufficient street parking because of the cul-de-sac design. In the past, these boarders have parked too close to our private driveways, blocked mailboxes, and caused problems during snow plowing and garbage pickup. What will the applicants do with the boarders invited guests? Parking is bound to spill onto the street. Because the proposed property is at the very end of the 16 home cul-de-sac it will affect every home owner on the block with additional traffic from transient renters. 3. PROPERTY VALUES A lodging house may lead to blight and decreased home values in our neighborhood. Imagine that you want to sell your home and the prospective buyer learns that there is a daily lodging house a few doors down the street. After several prospective buyers walk away due to the lodging permit in a residential area you would be forced to lower your asking price. Short term lodging houses have caused major headaches in neighborhoods across the country. Once approved, there is little recourse. Remember that these short term boarders will have no skin in the game and no real interest in our neighborhood. We googled airbnb lawsuits from neighborhood groups and found countless articles on lawsuits across the country attempting to stop the airbnb invasion. One of the articles states that airbnb was founded in 2008 in San Francisco which ironically is a city that was forced to ban and vigorously enforces short term rentals... transient rentals are, by their nature, hard to regulate. We have enjoyed our neighborhood until about a year ago when a neighbor several houses down from ours began renting their property (1422 Rocky Lane). Since then, we have had increased vehicle traffic, garbage in the street and repeated illegal parking during the winter parking ban. We have many small children in our area and the increased traffic, especially when the vehicles have shown disregard for other rules such as parking, heightens safety concerns. I am concerned that allowing short-term rentals such as those proposed by Mr. and Ms. Bramer would set a precedent that will allow the proliferation of these rentals to proliferate in our neighborhoods. Although I appreciate the conditions set by the Planning Commission such as requiring off-street parking and the presence of the owners during the 12-7am hours would mitigate one of the problems we've experienced in our neighborhood, I believe that there are other areas zoned appropriately for rental in our City and that we have several nice hotels in the area that would seem to eliminate any compelling need to open up our neighborhoods to this type of use. (Although I'm not sure how the presence of the owners could actually be enforced.) Further, if the Bramers would like to open a commercial business, they should explore areas in the city where that is currently allowed.
