Mike and Pam,
Thank you for coming in to talk with me today and for sending this information. I discussed the matter with Brian and tatked with
the Fire Marshal about the proposal and fence material.
First, I did verify that the timber surround with pea gravel has been present for many years. As such, it does not have to be moved,
except for correcting the encroachment onto the neighboring property,which you propose to do. The note about landscaping
crossing over the property line was included for your information it is not required to be removed or relocated. Any encroachment
of landscaping over the property line is a matter between the two property owners.
Second,the Fire Marshal said that the material you propose for the privacy fence is still considered a combustible material.
Something like chain link or a decorative aluminum or iron fence would be acceptable, but that would not provide you the same
level of privacy.
Third, recreational fires must be located a minimum of 25'from all combustible materials(including dwellings,structures,fences
and decks, etc.), and a minimum of 10'from all property lines. The plan you provided shows the fire pit a distance of 9'from the
center of the pit to the property line. Therefore,to bring it into compliance,the fire pit will need to be relocated. If the privacy
fence remains a part of your proposal,then the fire pit must be a minimum of 25'from the privacy fence, measured from the edge
of the fire pit not the center. Alternatively,you may wish to omit the privacy fence from your proposal,then the fire pit would need
to be relocated to a minimum distance of 10'from the property line.
Please let me know how you want to proceed and then submit the Zoning Permit application for relocation of the fire pit and timber
surround, and fence if included. I have again attached a Zoning Permit application and informational handout, and site survey of
your property which you can use as a base for the Site Plan drawing to accompany the Zoning Permit application.
Please note that this only addresses the matters pertaining to the Zoning Permit. Please follow up with Brian on the other items
mentioned in his/etter.
