FIRE "DEPARTMENT -- Thereare no i-tems to be considered for the Fire Department at this `time, B. POLICE DEPARTMENT -- Item #1:. Proposed County Jail Facility -- The Dakota County Board ot ,C mmi"ssioners is considering a` new jail facility for Dakota County. The location 'of this jail facility has been discussed with Police Chiefs from the western and northern cities in Dakota County, and, it is their opinion that the facility should be located where the population is currently located_ and projected for future years. Mayor Blomquist asked - that this item be addressed by Chief of Police DesLauriers and that there be some discussion by the City Council as to whether they meet with Eagan' s appointment to a study committee and discuss the , matter ' in further detail or another procedure preferred by the City Council . Please refer to the memorandum entitled "New ' Jail Facility" prepared by Chief of Police DesLauriers enclosed on pages i through' for your reference. Berthe Assistant Chief of Police cows 9 May 1980 TO: Mayor Bea Blomquist FROM: Chief of Police SUBJECT: New Jail Facility Per your telephone call on May 7th, I do have some thoughts in regard to the type of facility and the location. I have discussed this subject before with several Chiefs from the western and northern cities in Dakota County. I would like the City Council to meet with Mrs . Karen Ferguson and discuss what possibilities are available. I feel the facility should be centrally located (for discussion pur- poses I would say in the City of Rosemount) . The new facility . should be capable of handling: . 1. All juvenile detentions , at least until the court hearings . 2. All Huber Law inmates . ' 3 . All persons. jailed awaiting first appearance in court. This facility should have sufficient court rooms to handle all juveni�e court cases as well as adult court cases, includingury trials , for all petty misdemeanors and misdemeanors, which is 900 of our court cases . The present county Jail could continue;to handle all adult inmates com- mitted to the county jail for morn than 72 hours . Ourpresent county court is located in Burnsville and the facilities are leased and are not suitable fcir Jury trials. The county court at the new centrally locate& facility could save many miles of travel for the Sheriff's Department in tti8: transporting of prisoners , for local police officers , family mem$ars and/or parents of inmates and for attorneys . The majority of persons jailed are from Burnsville, Apple Valley , Eagan, Inver Grove Heights , West St-. Paul and South St. Paul. Of the total of 872 prisoners transported in 1979 to the county jail , more than half (452) were from Burnsville, Apple ,Valley and Eagan (see the attached figures received from the Dakota County Sheriff's office) . o� THE LONE OAK TREE — THE SYMBOL OF STRENGTH & GROWTH IN OUR COMMUNITY MAYOR BEA BLOMQUIST 9 May 1980 Page Two "New Jail Facility" During ,1979 we had 40.3 persons inourlock-ups and..of this total , 129 were transported by the Dakota County Sheriff's Department . Our need for a secure Juvenile. Detention Center is immediate. At the present time, we have no facility for juveniles in Dakota County and many hours are spent trying to locate a place for them. The location and type of facility should be reviewed by the Eagan City Council and i would welcome the opportunity to discuss this further if the Council can arrange, the time to do so . It is their recommen- dation that the Staff be directed to research the feasibility of establishing ' a special tax levy district for all property. abutting gravel roads . The Public WorksDepartment will provide two (2) dust control oil applications each year as far as the budget will provide. Future allocations for gravel` road maintenance' will be considered in relationship to the seal coat maintenance priorities as established ,by dollars budgeted for the 1980 _seal coating pro- gram and, further, if it is possible` to levy a special - tax by way of a district or assessments . The City .,-Administrator and Director of `Public Works will provide an updateon , their research at the meeting. Item #3: Parking Stall `Dimensions -- The Public Works Committee also reviewed the City's standard parking stall ' dimensions of 10' feet by 20 feet and recommended that the policy remain the same with the following variances: nine. foot by 20 foot parking spaces will be allowed for underground or , structural parking facilities (ramps) due to excessive economic hardship of _ structural costs.. ' Also ten "`foot by 18 foot parking -spaces will be allowed where space for. the 'front bumper overhang is provided ('parking lot peri- meters ) . Item #4: Seal Coating Project -- The five year CIP was. discussed in with the entire City Council at .the special meeting held on May 13, 1980, and subsequently approved, providing for a catch up program of three years and review annually thereafter. The Public Works Committee decided not to review the seal coating pro- ject, realizing the entire Council ,would be reviewing it the same evening. Item #5: Traffic Control `for New Developments -- The placement mop and/or yield signs was discussed regarding the location of these signs in new developments. It was recommended that stop signs be placed to provide proper right .of way control on all four legged ' intersections and T intersections for residential streets (60 foot right of way) meet collector or arterial streets (80 foot to '150 foot ROW`) Action may be required on Items #2 and #5 .depending on additional staff input. by the City Council meeting on Tuesday.. Temporary Beer Permit for Cedarvale Lanes Softball Team -- Mr. Arnold Doering, manager of the Cedarvale Lanes Softball Team has made application for a temporary beer permit fora tournament at the Univac Field on June 21 and June 22. Mr. Doering is a resi- dent of the community, residing at 2096 Shale Lane. The application fee has been paid, and approved by the Police Department. Project -77-21 (Ches Mar East 1st Addi- tion Streets) -- This change order was -previously approved. on March 5 , 1980 by the City Council. Since then, it has become more feasi- ble. to advertise for bids. Subsequently, on .May 6, the City Council approved plans and specifications for Imp. 80-13 for this work. Therefore, this change order is .to be cancelled. 3. Change Order #1 for Imp. 79-15 (Vienna Woods Streets) -- Because of a delay in the developer' s grading and subsequent inflation, an -increase in unit prices is necessary for the contractor. The developer has agreed and will be assessed the additional costs . The change order amounts to $31,481. 4. Change Order #1 for Imp". 79-8 (Meadowlands Streets) - Because of unavoidable delays and inflation, the contractor isrequesting and the developer has agreed to an increase in unit. prices. This will be , added to the assessments . The `total change order is an increase of $15,255. - 5. Change Order #1 for Imp.. 79-16 (Alexander Road and Park Cliff Streets) Becaus-e of delays by the developer and inflation, the contractor is requesting and the 'developer has agreed to an increase in costs . These costs will be added to the assessments . Part one is for - Park Cliff and consists of $6,816.50. Part two is for Alexander Road and consists of $27 ,670. The total amount . of the change order is $34,486.50. , 6. Change Order #2 for Imp. Project 240 A (Drexel Heights Streets) -- The contractor could not perform the street work in Drexel Heights in 1979 as contracted due to the emergency utility repair work that was required in that, same " addition. The contractor is requesting an increase in unit prices due to inflation and the. developer has agreed. to pay all those price increases . This project will be` assessed and: the change order amounts to. $3,888. 8. Change Order #2 for Imp. 237 (.Thomas Lake Road) Because of delays in acquiring_easementsalong the south portion of Thomas Lake Road, the contractor was unable to complete the sidewalk work in 1979. The cost 'will be charged to the major street fund. The additional cost for the improvement is $770. 8. Change Order #3 for Imp. 236 A (Meadowlands Addition Sewer and Water and Storm Sewer) -- Part one of this change order' con- sists of installing: five ( 5) additional sewer, and water services to Block 4 of Meadowlands Addition at the request of the developer. The cost of $4,250 will be assessed. Part two consists of instal- ling additional storm sewer. for the R.L. Johnson's Alexander Road project, to eliminate potential drainage and erosion problems. The cost .of $8,900 will be assessed The total cost of this change order is $13 ,150. COUNCIL ACTION TO BE CONSIDERED ON THIS MATTER: To either approve or deny each of-the change orders as listed above. OAK CHASE 4th BOND- REDUCTION E. Oak Chase 4th <Bond Reduction -- The developer is requesting a reduction in the letter of credit .pertaining to payment of assess- ments for streets and utilities . A review in this development file indicates that this developer has commited 20% which has been paid and certified. Therefore, it would be. in order for the City Council` to- consider a reduction --in the letter ; of credit for Oak Chase 4th Addition in the amount of $4,650. Area to Hwy. 13 Area - A public hearing -notice was published in the Dakota County Tribune and all persons affected by the proposed improvement were sent notice of the storm sewer hearings. - The Director of Public Works and Consulting Engineer ' Bob- Rosene, held an informa- tional ,meeting on Wednesday, April 30-, 19$0, with a number of pro- perty owners who would be directly affected by .the proposed improve- ments . The purpose of the meeting was to explain to the residents why the project was necessary: and also how the project would impact` . their property. There are some alternatives. to consider for this project; those are explained in the attachments prepared by the Consulting Engineer. All the costs for the proposed project, along with maps and other information are outlined in the feasibility report. A copy is attached' on pages _ through Q( , . Pawefsky Blackhawk Lake Outlet Harlan M.Olson ' Improvement Project 297 David E.Olson Eagan, Minnesota March 4, 1980 SCOPE: This project covers the construction of a storm sewer outlet to Black- hawk Lake in Eagan, Minnesota. FEASIBILITY AND RECOMMENDATIONS: The project is feasible. It can best be carried out as outlined herein and not as a part of any other project. DISCUSSION: A large amount of development in recent years, combined with rainfalls in excess of the 25" per year which is considered normal for this ' part of Minnesota, has caused the water in several lakes in Eagan to rise to a level harmful to the surrounding property. To prevent damage to this proper- ty, outlets were constructed to several of these lakes in 1979. Under City Improvements in 1979, outlets were constructed to Heine Lake (storm sewer Pond BP-5 on the Master Plan), Thomas Lake (BP-7) , Carlson Lake ' (LP-42) , Oak Chase Pond (LP-53) as well as to several smaller ponds in the southern and central portions of Eagan. In accordance with the Master Plan for Storm Sewer for Eagan, the storm sewers draining these lakes and ponds were constructed to drain to Blackhawk Lake, shown on the Master Plan as BP-1, ' City Improvement 80-5 as ordered by the City Council will involve the construction of a storm sewer draining Fish Lake (JP-4) , as well as several adjoining ponds, to Blackhawk Lake. It is anticipated that this construction will occur during the early part of the 1980 construction season. Page 1 . 23C / 1 1 The construction of the storm sewers under City Improvements in 1979 and 1 1980 will have the affect of increasing the drainage area contributing water to Blackhawk Lake from 315 acres in 1978 to 2,400 acres when the Fish Lake 1 Outlet is completed. It is anticipated that the majority of the property 1 draining to Blackhawk Lake will be developed by the year 2000. When this de- velopment is completed, all of drainage districts shown on the Master Plan as 1 Districts "B", "J" and "L" and representing approximately 10,700 acres will drain to Blackhawk Lake. 1 Assuming an average rainfall of 25" and assuming that 20% of the annual rainfall will run overland and through storm sewers to Blackhawk Lake, 1,000 1 Acre feet of water would be introduced to the lake from its 2,400 acre drain- 1 age area in 1980. Careful monitoring of the elevations of Blackhawk Lake since late 1979 has indicated that approximately 400 acre feet of water would 1 be handled through seepage through the shoreline area and bottom of the lake. With the anticipation that 1,000 acre feet of water will be introduced 1 into Blackhawk Lake in 1980 and 400 acre feet will be removed through natural 1 seepage, it follows that the remaining 600 acre feet of water must be removed from the lake through a storm sewer outlet. If not removed, the net affect of 1 600 acre feet of water on the 50 acre surface of Blackhawk Lake would be to raise its elevation 12 feet which would do a considerable amount of damage to ' property surrounding the lake. The Master Plan for Storm Sewer for the City of Eagan indicates that the 1 water is to be removed from Blackhawk Lake by means of a large storm sewer 1 lift station. Because of the rapid increase in energy costs currently being experienced and the large volume of water to be removed, a gravity outlet will 1 also be discussed as an alternate in this report. 1 Page 2. 1 /s The lift station alternate beingconsidered would consist f o a large ' storm water lift station to be constructed on the western edge of a pond lo- cated a short- distance west of the main body of Blackhawk Lake. A short storm ' sewer pipe or open channel must be constructed draining Blackhawk Lake to this pond. Since only 2,400 of the ultimate total of 10,700 acres of drainage area ' will be affecting Blackhawk Lake at this time, it is suggested that two 77 horsepower pumps be installed at this time if the lift station alternate is to ' be used. At that time in the future when more pumping is required, two 180 horsepower pumps would be added to the two in place giving the lift station the capacity suggested in the Master Plan for Storm Sewer. This would be a ' total connected capacity of 514 horsepower. The storm sewer lift station on Blackhawk Lake would pump through a 30" ' diameter force main to the intersection of Robin Lane and Blackhawk Road. From this point it would be carried by gravity storm sewers to the large drainage ditch in the Cedar Industrial Park on the north side of State Trunk ' Highway 13. An alternative to the large storm sewer lift station would be to install ' a deep storm sewer pipe which would carry the water by gravity to the drainage ditch described in the paragraph above. This gravity storm sewer would be ' constructed within the right-of-way of Robin Lane from Highway 13 to Blackhawk ' Road and on easements from Blackhawk Lake to Robin Lane and from Highway 13 to the drainage ditch in Cedar Industrial Park. ' A large portion of the gravity outlet to Blackhawk Lake would be imprac- tical to construct by the open cut method because of the extreme depth of the ' sewer involved. It becomes necessary to tunnel the sewer from a point 200' west of Blackhawk Lake to a point on Robin Lane, a distance of approximately ' 1,060 feet. Page 3• l(4r�' ' Because of the tunneling involved, the initial cost of the gravity outlet ' is considerably more than that of the storm water lift station, however, the gravity outlet has a number of advantages over the pumping station. Some of ' these advantages are as follows: 1. Because of the large volumes of water being drained from Black- hawk Lake, the annual energy costs of the pumping station would be very large. Also, it is probable that the cost of energy will increase faster than inflation which will increase these pumping 1 costs markedly in the future. 2. Construction costs will be assessed as a part of the storm 1 sewer trunk system, while pumping and maintenance costs must be taken from the general operating budget. With levy limitations below the rate of inflation it will be difficult to budget lift station power costs in the future. 3. Lift stations require constant observation and maintenance, ' while a gravity outlet would require little attention. 4. The most economical site for the lift station would be in an area where it would be extremely difficult to construct a mainte- nance road. Private property would have to be crossed to reach the lift station. 5. The gravity outlet could be completed in November of 1980, while it is doubtful that the lift station outlet could be ready for service before April 1981, due to the slow delivery of the ' large pump involved. 6. Power outages frequently occur during intense storms, which is ' the very time when flood damage is likely to occur. Therefore, storm sewer lift stations are the least reliable when they are ' needed the most. Page 4. /7 1 1 The NOHW (Normal Ordinary High Water) elevation for Blackhawk Lake was established by the Department of Natural Resources in 1976 at elevtion 792.3• 1 The Master Storm Sewer Plan tentative) established d the control elevation for 1 the normal water level of the lake at 791.3 or 1 foot below the NOHW. The DNR has preferred that the control elevation of land locked lakes such as Black- 1 hawk be set at from l' to 1.5' below the NOHW. With recent wet years, the water level in Blackhawk Lake has risen to be 1 very close to the NOHW. The installation of the storm sewer inlet line from 1 Thomas Lake and the relieving of the extra high water level on Thomas Lake and Heine Lake raised the water level to approximately elevation 795 for a short 1 period. The installation of the temporary lift station at the west end of Blackhawk Lake together with normal seepage has lowered the level to approxi- 1 mately elevation 793 at this time. 1 Discussions with residents with land abutting the lake have indicated that some and possibly all of the abutting residents would like to see the normal water level raised from 791.3 to 7914 or 795 to provide a deeper lake. The Department of Natural Resources has indicated that such action could be 1 taken after a Public Hearing provided that all abutting landowners agree to 1 the new level. Questions have been asked concerning the impact of raising the outlet 1 elevation on the plans of Mn/DOT relative to the side slopes of I-35E adjacent tot the east end of Blackhawk. The DNR has stated that the previously estab- lished NOHW would govern these plans and they would not be effected by any 1 subsequent adjustment in the normal water level of the lake. It is suggested that this be confirmed in writing and agreed to with the various authorities 1 involved such as Mn/DOT, U.S. Army Corps of Engineers, and U.S. Fish and Wild- life prior to taking any action to permanently change the normal water level 1 of Blackhawk Lake. 1 Page 5. ' The cost of construction of either the Lift Station Outlet or the Gravity Outlet would be paid for from assessments to benefiting property within the ' drainage area served g e ved by the outlet. Maps at the rear of this report show the areas proposed to be assessed for this project using either alternate. All of this property is within the drainage area served by the Blackhawk Lake Outlet ' or the storm sewer trunk continuing across T.H. 13 into the Cedar Industrial Park drainageway. COST COMPARISON: The following costs are shown in order to compare the cost to construct and operate the gravity outlet with the lift station outlet for periods of 20 ears. Th P � 40 and 80 y e life of the gravity outlet is taken at 80 years though there is no reason to believe it will not be usable indefinitely with some maintenance. These costs are all based upon current construction costs and current cost of operation, maintenance and electricity for pumping. Inflation was omitted in these costs for comparison purposes as its effect is difficult to predict. However, it isrobable that electrical etrical energy costs will increase faster than the normal inflation which provides a cost compar-- ison dramatically more favorable toward the gravity outlet. COUNCIL ACTION TO BE CONSIDERED ON THIS MATTER: Is any combination of -three (3) different alternatives . One alternative is to remain status quo which is to enforce Ordinance #49 banning trapping in City parks only. The second alternative is to regulate- trapping within the City of Eagan as outlined in the Ordinance prepared by the City Administrator and City Attorney' s office. The third alternative is to amend that ordinance and prohibit trapping com- pletely within the City of Eagan. a MEMO TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: MAY 15, 1980 SUBJECT: PROPOSED TRAPPING ORDINANCE At the City Council meeting held on April 15 , 1980, a petition was submitted. with approximately 300 names of residents from the City of Eagan who "believe that the steel jaw leg hold trap cur- rently used in Eagan is cruel and inhumame and should not be used for the capture of wildlife and, as is often the case , domestic. pets . As citizens of your . City, we urge you to sponsor and support legislation to stop the use and sale of leghold traps in our com- munity." Several - people who had signed the petition did speak at that meeting ,in favor of an ordinance which would ban or prohi- bit the use of leghold animal traps within the community. There were also a few persons present, two (2 ) who reside in the City of Eagan, who were opposed to an ordinance that would restrict the use of traps within the community. After a general discussion by the City Council and more testimony from the audience , the City Administrator was directed to research ordinances from other metro- politan communities to determine how trapping is handled within those cities . He was also asked to prepare any additional informa- tion that would be helpful to resolve the concerns that were pre- sented to the City by the trappers present at that meeting. Various information was distributed at . the April 15 meeting which provides facts and fallacies about trapping, trapping and wildlife management and articles about trapping and hunting. This informa- tion is sponsored by the pro trapping and hunting organizations . I was unable to find any additional information which would be helpful regarding the . pro trappers . Research was completed at the Dakota County Courthouse to examine the sale of trapping licenses during the past several months . Out of 120 licenses examined, two ( 2 ) were sold to residents of Eagan. One is an apartment owner'. and one is a single family resi- dent . Children under the age of sixteen do not require a license and therefore it is difficult to 'know how many children are trapping within the community. Of the 120 licenses examined, most of the licenses.-were issued to residents of Farmington, Inver Grove Heights and South St . Paul . It was also interesting to learn that only three stores in Eagan sell trapping licenses and that no licenses were sold by any of these. stores in 1979 . These stores are Coast to Coast , Hardware Hank and Valley Hardware. Only Hardware Hank sells traps and these are only size 0 gopher traps . Approximately twelve ( 12 ) were sold in 1979 da Trapping Ordinance Memo May 15 , 1980 Page Two Approximately twenty-five ordinances were reviewed. Most all 'of the ordinances reviewed restrict or ban the use of leg hold traps . Most of the ordinances make exceptions for a trap that specifically is designed to kill rats , mice, gophers or moles . Most of the ordinances do not apply to the use of cage type live traps or other traps employed for the control of nuisance animals as long as such traps are tended by the property owner and the property owner has a special use permit granted by a representative of the city. Attached is a map indicating those cities where ordinances - were reviewed and the attached key outlines the level of trapping allowed if any in those communities . After reviewing the ordinances and giving some considerable consi- deration to the petition asking for the restriction or ban of ani- mal traps within the City of Eagan, it seems that the City Council has three ( 3 ) alternatives : 1 . To continue a status quo by enforcing Ordinance 49 Subsection 3 , which prohibits trapping in City narks . In other words , trapping, would be allowed as long as a license is secured throughout the remainder of the City. 2 . To enact an ordinance that would prohibit trapping on any property which is less than five acres in the community. The exception would be that persons residing on parcels of . property of less than five acres could use a quick kill trap which would control mice , gophers and other small rodents . Those property owners who reside on five acres or more would have to obtain a special trapping permit from the Eagan Animal Warden and/or Chief Of Police . 3 . The third alternative is to prohibit trapping anywhere within the community. In summary, it appears that of the licenses reviewed at the Dakota County Courthouse , only two residents are legally trapping within the community who are over the age of sixteen. Additional licenses could be reviewed by checking with the State of 'Minnesota to see if other licenses filed were from Eagan residents . However, even if the number is greater than two, those persons licensed over the age of sixteen are quite few in relationship to the population. Local hardware stores are not selling licenses and it appears have sold very few traps and therefore are not affected whether trapping is continued or prohibited within the community. The City Admini- strator along with assistance from the City Attorney' s office has prepared an ordinance entitled as follows , "An Ordinance Restricting the Use of Animal Traps Within the City of Eagan A copy of this proposed ordinance is attached for your- reference. C 9 Trapping Ordinance Memo May 15, 1980 Page Three This ordinance attempts to address all the issues by prohibiting trapping by anyone than the owner of the parcel of land on which the trap is to be set within the community. This would exclude persons setting traps around the community which cause a nuisance to local residents who are not aware of the traps being located on or adjacent to their property. A second provision would prohi- bit trapping on land no greater than five acres with the exception of allowing residents to use quick kill traps for the purpose of maintaining control of small rodents such as mice, moles or gophers . The third provision allows property owners who own a parcel of land which is greater than five acres to obtain a special trapping permit from the City and the purpose for the application. This ordinance would place controls on the use of traps throughout the community, while allowing the local home owner to still control his or her rodent problems and also provide flexibility to the larger property owners who wish to trap for the purpose of control- ling nuisance animals or other reasons as approved by the City. Since there are only two licenses which have been issued to the City of Eagan per the records of the County, it appears that the hardship caused by restricting ordinances if this ordinance is passed is to those persons under the age of sixteen. This ordinance can be modified or revised to provide more or less restrictions depending on how the City Council wishes to proceed with this issue . As previously stated, the other option is to not pass any further restrictions on the use of trapping and continue enforcement of the restriction of trapping within "the City parks through the en- forcement of Ordinance 49 . If there is any additional research the City Council desires, please contact me on Monday or Tuesday and the information will be pro- vided. AN ORDINANCE RESTRICTING THE USE OF ANIMAL TRAPS WITHIN THE CITY OF EAGAN THE CITY COUNCIL OF THE CITY OF EAGAN DOES ORDAIN: SECTION .01 -- DEFINITIONS. The following words and terms, when used- in sedin this ordinance, shall have the following meanings: TRAP - Any mechanical device, snare, artificial light, net, bird line, ferret, hawk, vehicle or contrivance whatever used to cath, snare, kill, or otherwise restrain the free movement of animals or birds. TRAPPING - The setting, laying or possession with intent to set or lay a trap in the City of 'Eagan. SECTION .02 -- VIOLATIONS. Subdivision 1. Trapping by anyone other than the owner of the parcel of land upon which the trap is to be set, or his family is prohibited. Subdivision 2. Trapping is prohibited upon land which is owned as a parcel which is no greater than five acres except for quick kill traps. Subdivision 3. Trapping is prohibited upon land which is owned as a parcel which .is greater than five acres unless the owner of said parcel first obtains a special trapping permit from the Eagan Animal Warden, which permit shall also to approved by the Eagan Chief of Police. Subdivision 4. Trapping is prohibited within, and within 100 feet of, any city, county or state park or organized recreational area or within 100 feet of any school property. SECTION .03 -- APPLICATION FOR PERMIT. The application for special trapping permit shall be in writing and shall specify the type of animal sought to be trapped, the location where each trap is to be set and the days for which the trapping permit is sought. SECTION .05 -- PENALTY. Violation of any provision of this ordinance shall be a misdemeanor and shall upon,conviction thereof be punished by a fine not to exceed $500 and/or imprisonment not exceeding 90 days. SECTION .06 -- INVALIDITY. The invalidity of any part of this ordinance as declared by a court of competent jurisdiction shall not affect the validity of the remainder thereof. SECTION .07 - CONFLICTING ORDINANCES REPEALED. All ordinances or parts thereof in conflict with the provisions of this Ordinance or of the Code hereby adopted are hereby repealed. SECTION .08 - EFFECTIVE DATE. This Ordinance shall take effect upon its adoption and publication according to law. The preliminary plat and detailed site plan is for the approval of the first phase of a shopping center in accordance with the planned development agreement. The APC recommended approval of the <preliminary plat and detailed site plans per conditions listed in the APC minutes . A copy of :those minutes is enclosed on pages, through 3"1 The City Council considered ' these ' applications -and the ' APC recommendations at the April 15, 1980, City Council meeting. There was some concern by the audience about the validity of the mailing' list and further questions about the PUD agreement. These items have been researched and are explained in the fol.lowing manner. First of all, the Wood- gate Homeowners Association has retained an attorney to review the publication list, development agreement and other pertinent in- formation that is a matter of City records regarding this issue, r-The attorney, Mr. Clint McLagen, has met with the City Planner and � City Attorney and has gone through the development agreement file. Since there were questions about how the legal notice: and publica- tion requirements for the original PUD transaction were handled, City Attorney Hauge has written a letter. to Mr. McLagen explaining that procedure Please. refer to page '3$ for a copy of that letter, and hopefully this will clear ' any any questions regarding the legal notice requirements. There were also some questions from the audience regarding the mailing list used for the public hearing held by the Advisory Planning Commission on March 25, 1980. The legal notices were prepared by Dakota County Abstract and checked by the City offices prior to mailing all the notices. The City does not have adequate staff to research all the names submitted by various' abstract companies for legal notice purposes , to verifywhetherthat property owner is , in fact, the current property owner. With the number of lists we receive for public` hearing_ requirements, it would take a full time.. person to review the abstractors' lists . A copy of the mailing list will -be availa- ble for inspection at the City Council meeting_, and if any City Councilmember - would like to review, it prior to the Tuesday evening meeting,: please contact the City Administrator's office and a copy will be sent out to you. The City Planner and Director of Public Works have completed a rather thorough report on the preliminary _ plat and detailed site plan proposal, a copy of which is, enclosed on pages 9 through 53 for your reference. The parcel in question, Safari at Eagan, was a part of the Eagan 500 PUD which is Blackhawk Park, Inc This PUD was approved on August 7 1973, according to the PUD agree- ment file. Exhibit C of the Blackhawk. Park PUD agreement shows. the 28.4 acre parcel of property, proposed for Safari at Eagan; as a community; shopping center and general business district. A copy of that exhibit is enclosed on page +s for your review. Another document showing the south portion o�t e' Blackhawk Park, Inc. , which< is that part of the PUD between Cliff Road and County Road 130 is also enclosed on page, for your reference A land use and density ; data report that breaks down the entire Eagan 500 PUD is enclosed on page 5(,, and dated July, 1973. The City Staff feels confident that the records are in order for this PUD agree- ment,- that all mailing notices were done in accordance with City policy and that the recommendation of the APC is in order for consi- deration. Two' (2) tot lots shall be provided by the developer for the preschoolers within the townhouse district. 6. A $2,000 landscape bond shall be required and not released until one year after the landscaping has been completed. 7. A detailed grading and erosion control plan shall be submitted and approved prior to final plat application. 8. All outstanding trunk area assessments shall be paid at the time of final plat application if trunk utilities are installed privately by the developer. 9. Sufficient drainage and utility easements shall be dedicated to incorporate the 890.0 elevation within Block 1. Additional drainage andutilityeasements should be dedicated over the common area of Lot 1, Block 3, Outlot A and Outlot B. 10. The trailway connection to the Heine First Addition shall be dedicated and installed at the time of development of this plat, as the responsibility of the developer. In addition, the request for setback variance due to topographic conditions in the subdivision was recommended for approval by the City. Krob moved, Gits seconded the motion, to approve the 10-foot variance for setback purposes to permit the City Building Inspector to allow variations in setback to conform with topography and tree cover. All voted.in favor. MCDONALD'S RESTAURANT -- NICOLS ROAD The public hearing regarding the application of McDonalds Corporation for conditional use permit to allow a Class 2 restaurant in the community shopping center area, conditional. use permit for pylon sign located on proposed Lot 1, Block 1, Mari Acres, and for detailed site plan approval for a 'McDonald's restaur- ant, and variance for the 20,000 square foot minimum building requirement was next convened. There was discussion regarding the recommendation of the Planner to continue the application until Hillcrest Development submits the application for final plat approval for Mari Acres. Harrison moved, Turnham seconded the motion, to continue the public hearings for each of the applications mentioned above until the final plat application is submitted by Hillcrest Development. All voted yes. SAFARI AT EAGAN PRELIMINARY PLAT The Chairman next convened a public hearingregarding the application of Fortune Realty, -Inc. , for approval of the preliminary plat of Safari at Eagan consisting of 30 acres. containing four lots and one outlot and an application for detailed site plan approval for the first phase of the community shopping center in accordance with the planned development for Blackhawk Park PD. Mr. Byron Watschke was present and explained the history of the Blackhawk Park PD. The original plat for the PD was devised in 1972 and the zoning for the 30 acre parcel for community shopping center use was approved at that time. Mr. Watschke reviewed the. plan and indicated the proposed start for construction would be in 1980 with occupancy in 1981 for an 87,500 square foot shopping center with Red Owl market, Snyder Drug Store, hardware store, and 37,800 square feet of additional retail for 21 smaller -stores, In addition, there are three extra lots for free- standing buildings, and the shopping center would include an enclosed mall. There were strong concerns by the Planning Commission Members about adequate unloading 3G AFC Minutes March 25, 1980 Page Three area for trucks at the supermarket and for the smaller shops. The developer in- dicated that Mr. Greg Du'Monceau, architect, was present on behalf of the developer. All loading for all shops will be from the rear or from the north side of the building according to the developer and owner and there were con- cerns by Planning Commission Members that there be no loading or unloading of trucks on the south side of the building. Mr. Win Scott, president of the Woodgate Homeowner's Association and other residents from Woodgate were present and objected to the shopping center on the basis of its being an alleged uneconomic proposal at the present time. There were questions regarding berming and landscaping and the plan for landscaping was reviewed. The recommendation of the Park Committee is that there be a 50- foot trail as a condition of the approval of the preliminary_ plat along the west line of the plat connecting to other park land to the north and south. Mr. Watschke agreed to the dedication of the 50 feet as requested. After an extended discussion, Krob moved, Gits seconded the motion to recommend approval of the preliminary plat subject to the following conditions: 1. The parking lot and parking and loading areas in the rear shall have asphalt surfacing and concrete curbing around the perimeter of the parking area. 2. The plat shall be subject to the recommendations of the Dakota County Plat Commission. 3. All refuse should be stored within an enclosed building. 4. An adequate landscape bond shall be required and not released until one year after the landscaping has been completed with detailed landscape plan to be submitted and approved by the City. 5. The parking areas shall contain 10 by 20 foot stalls and a minimum of 24-foot driving isles. 6. An architectural design for the entire commercial area shall be ap- proved by the Eagan City Council. 7. The proposed street which is being platted shall be installed with the first phaseof construction. 8. A minimum of 392 parking spaces shall be provided with the first phase of the 'shopping center. As the other lots are developed, additional parking will be provided as required by the City. 9. The City shall approve site plans for Lots .1, 2, and 4 at the time thea lots are ready to be developed. 10. The owner will grant a 50-foot all purpose trailway easement on the west boundary of the proposed plat for future trail connection from the N.S.P. Trail to the Dakota County Park. 11. That signing be provided at the rear for deliveries and no deliveries to be made at front or south side of mall building. 12. Developer shall provide a pond easement in the southwest corner of this proposed plat of sufficient size and elevation as approved by the City Engineer. _ 'NP i • APC Minutes March 25, 1980 Page Four 13. A revised grading and drainage plan shall be submitted and approved prior to application of final plat. This plan shall also incorporate effective erosion control measures approved by the City. 14. A revised site plan must be submitted; and approved prior to final plat application. 15. Parcel pickup for the grocery store shall be located entirely on the east side of the building. 16. A 50-foot all purpose trailway easement shall be dedicated over the western portion of this plat. All voted in favor. Krob moved, Turnham seconded the motion, to approve the application for detailed site plan as submitted. All voted yes. EAGANDALE INDUSTRIAL PARK NO. 1 -- LOTS 10-14, BLOCK 3 The next public hearing convened covered the application of Rauenhorst Corporation for waiver of plat for Lots 10-14, Block 3, Eagandale Center Industrial Park No. 1. It was noted that Lots 10 and 11 were being combined and that Lots 12, 13, and 14 would be split under the proposal. Michele Foster of Rauenhorst was present and reviewed some changes in the location of the buildings from that originally submitted to the City staff. It was determined that a replat was not required because no utility easements were included along the lot lines of the former plat. After discussion, Gits moved, Krob seconded the motion, to recommend approval of the application subject to the following conditions: 1. All parking spaces shall have a dimension of 10 by 20 feet and all parking areas have an asphalt surface with concrete curbing around the perimeter of the parking area. 2. All easements shall be required as requested by the City staff. 3. An erosion control plan shall be submitted prior to the issuance of the building permit. 4. Drainage and utility easements shall be provided as required to incorpor- ate sanitary sewer and water main distribution system. 5. That the lots comply with all applicable City ordinances and final plan to be approved by City staff. All members voted yes. It is my understanding that you have been engaged by the Woodgate Homeowners Association to represent them concerning the preliminary plat application of Fortune Realty for approval of pre- liminary plat of Safari At Eagan. I indicated to you that I would try to get more information regarding the 1972 and 1975 notices and I am enclosing photocopies of a notice dated ,6-19-72 and one of 6-10-74 regarding the Blackhawk Park PUD. To the best of my information, no notices were sent out to surrounding property owners unless the property intended to be rezoned was an area of 5 acres or less which prior to 1973 required notice to property owners within 200 feet and after 1973 notice within 350 feet. In 1975 the City Council amended its Ordinance No. 6 and adopted Ordinance No. 52 the new Zoning Ordinance, and then required that notice be sent to property owners through the mail within 350 feet of area intended to be rezoned. Prior to that, under Ordinance No. 6, the property owner who submitted an application to rezone was required to submit a list of property owners within 200 feet of a parcel of five acres or less for notice according to M.S.A. 462.357. Hopefully this answers the questions that you had but if you would like other information please let me know. You indicated you would let me know who did not receive notice of any hearings regarding either the present hearing for preliminary plat approval or any earlier hearings for which you felt notice was required to be sent. RUNKLE, CITY PLANNER APPLICATION SUBMITTED: An application has been submitted for a preliminary plat, Safari at Eagan, which would consist of approximately 30 acres and contain four lots and one outlot. The second application submitted is for a detailed site plan approval for the first phase of a community shopping center in accordance with the Planned Development Agreement. COMMENTS: 1. Fortune Reality has purchased the south 30 acres of the Blackhawk South Planned Development which has a proposed land use for a community shopping center. Mr. Watschke is proposing to develop the first phase of the project into an 87,500 square foot shopping center which would contain a Red Owl Super Market, Snyder Drug Store, Hardware Store, and 37,800 square feet of additional retail or 21 smaller stores. 2. The proposed plan for the first phase of the center follow the original concept which was submitted with the Blackhawk Park Planned Development. The developer is proposing the same access points with a curvilinier street which would provide public access to all the parcels. At this time the first phase is only the shopping center. The outlot is still undetermined as to the exact use. Enclosed is a copy of the original concept plan which was proposed when the urea was designated as a Community Shopping Center use under a planned development. 3. Phase one which is lot 3 block 1 contains 8.4 acres and the proposed building would contain 87,500 square feet for a lot coverage of 23%. Ordinance #52.07 Subdivision 14,allows a maximum of 30% lot coverage. The parking re- - quirement for this retail facility is based on the .net leasable area.According to Staff's calculations the developer would have to provide 392 parking spaces. Presently the plan indicates 409 spaces. _ 39. --- FOR 1 NE RE Y •AFAR: AT E� MARCH 19, X80 PAGE TWO 4. The proposed shopping center meets all setback requirements according to Ordinance 52. 5. Access to the proposed shopping center would be off of Thomas Lake Road on the east and the proposed road which is being platted on the west. This road will. line up with Beacon Hill Road on the south in order to provide a four way intersection on Cliff Road. The devel: per is also proposing a right turn in and right turn out access from Cliff Road, which will have to receive approval from Dakota County Plat Commission. 6. The developer has done: a good. job for internal traffic circulation. They have seperated the customer traffic from the employee and service traffic as much as possible. The service and loading area will be all on the north side f of the building and access will be obtained from the platted street on the north. 7. Itis the staff's understanding that the building material will be brick on all four sides of the building. When the area to the north ,of this center develops there will be visual impacts from all four sides. 8. The proposed plan indicates two area identification signs for the shopping center. Ordinance 16 allows up to one free standing sign. A pylon signmaybe allowed for each major adjacent street. The Council shall determine the maximum size after reviewing applicable conditions;, terrain, safety. The applicant is proposing a sign at the west and east corners of the center, which would contain 43 square feet each. The Council should determine if they would permit one signor both signs. Either sign should not project more than 27 feet in height from the grade of Cliff Road. If approved, the plat should be subject to the following conditions: 1. The parking lot and parking and loading areas in the rear shall have asphalt surfacing and concrete curbing around the perimeter of the parking area. 2. Plats should be subject to the recommendations of the Dakota County Plat Commission. 3. All refuge should be stored within an enclosed building. 4. A $2,000.00 landscape bond shall be required and not released until one year after the landscaping has been completed. 5. The parking areas shall contain a 10 by 20 foot stall and a minimum of 24 foot driving isles. 6. An architectural design on the entire commercial area shall be approved by the City of Eagan. 7. The proposed street which is being platted shall be installed with the first phase of construction. 8. A minimum of 392 parking spaces shall be required with_ the first phase of the shopping center.. The City shall approve site plans for lots 1,2, and 4 at the time the lots are ready to be developed. The Park Committee has requested a 50 foot trail easement on the west boundary of the proposed plat for future trail connection from the N.S.P. Trail to the Dakota County Park. Although park dedication is not re- quired on a commercial development, the Park Committee is requesting that this be a condition of the overall planned development. ENGINEERING-RECOT.D.ENDATIONS: 1. Developer shall provide a pond in the southwest corner of this proposed plat of sufficient size and elevation as approved by the City Engineer. 2. A revised grading and drainage plan must be submitted and approved prior to application of final plat. This plan shall also incorporate effec- tive erosion control measures. 3. A revised site plan must be submitted and approved prior to final plat application. 4. Parcel pickup for the grocery store shall be located entirely on the east side of the building. 5. COLBERT - DIRECTOR OF PUBLIC WORKS DATE: MARCH 20, 1980 RE: PRELIMINARY PLAT -SAFARI AT EAGAN The Engineering Division has the following comments to make in regards to the above referenced plat: UTILITIES: A sanitary sewer and water main of sufficient size and depth is available along Cliff Road and Thomas Lake Road to handle this proposed development. STREETS: Access to this proposed plat will be available via the improved Thomas Lake Road and County Road 32 (Cliff Road). It will also be serviced by an internal street which should be constructed to City standards and dedicated as public right of way. This will serve as a loop street from Thomas Lake Road to Cliff Road. GRADING/DRAINAGE: An internal storm sewer system will have to be constructed along the internal loop street to intercept the drainage from the parking lot and building areas. . This storm sewer will then be directed to the northeast corner towards an existing ponding area on the west side of Thomas Lake Road. This ponding area is presently connected to Thomas Lake to provide the Positive drainage outlet. It is recommended that a ponding area be provided for in the southwest corner of this proposed plat as a primary detention/ sedimentation pond. An erosion control plan will have to be submitted pertaining to the proposed grading. There will have to be some minor adjustments to the grading plan and/or the building elevation to provide for the proper drainage of the parking lot. This will be required before final plat approval. SITE PLAN: The site plan will require some minor revisions incorporating raised islands., parking stall and driving isle dimensions, etc. Without this. revised parking lot layout . and site plan, it is difficult to tell what the final number of parking stalls provided will be. It is recommended that a truck dock screening wall be incorporated wits, the same building materials as the overall structure to completely incorp- orate and screen the loading dock area for the grocery store. 6 • CITY OF EAGA° - ,,"JG ':: ERI1JG DIVISION SAFARI AT EAGAN MARCH 20, 1980 PAGE T110 EASE7.1ENTS: The City has been planning for a' connection between the all purpose highline trail and the Dakota County Park System. This north/south connection is intended to follow along the William Brothers pipeline easement which tra- verses across the western portion of this plat. Therefcre, an easement will have to be dedicated to the City providing for this all purpose trail con- nection. The easement which is required has been established at 50 feet. All other standard drainage and utility easements have been shown on the revised preliminary plat dated March 12, 1x80. This provides for the aF-�ropriate 75 foot half right of way on Cliff Road and the necessary 40 foot half right of way along Thomas Lake Road. At the time the preliminary plat was reviewed by the Plan- ning Commission, the proposed building was reviewed and it was discovered that a conditional use permit should have been submitted for outside storage. 1. The outside storage area is proposed to be surfaced with crushed limestone. The area would have a perimeter chainlink fence which would be 8' high with three strands of barbed wire. The plan also indicates the location of the mercury vapor outside security lighting which would be attached to the building. CONDITIONS• If this conditional use permit is approved for outside storage, it should-be subject to-the following conditions; A. The conditional use permit shall be approved for an indefinite period of time provided the conditions herein are met at all times and all provisions of other City ordinances pettaining thereto are also meta B. Those present . were Planning Commission Members Hall, Wilkins, Krob, Gits, and Bohne. Those absent were Harrison and Roszak. Vice-Chairman -Hall chaired the meeting. AGENDA Wilkins moved, Hall seconded the motion, to accept the agenda as distri- buted with the addition of a request for an application for waiver of plat covering Lots 13 and 14, Block 2, Duckwood Estates. All voted yes. MINUTES The minutes of the March 25, 1980, meeting were reviewed. Gits moved, Wilkins seconded the motion, to accept the minutes as distributed. All voted yes. MARDELANN ADDITION CONDITIONAL USE PFFMIT The first public hearing convened concerned the application of Frank Hasselman for a conditional use permit to allow outside storage located on part of Government Lots 2 and 3, Section 17, in proposed Mardelann Addition. Mr. Hasselman was present and there were no objections to the application. After discussion, Krob moved, Wilkins seconded the motion, to recommend approval of the application subject to the following conditions: 1. The conditional use permit shall be approved for an indefinite period of time provided the conditions herein are met at all times and all provisions of other City ordinances pertaining thereto are also met. 2. To approve or deny theconditional use permit application for Diamond T Ranch per APC recommendation. {o APC Minutes April 22, 1980 Page Two DIAMOND T RANCH, JERRY THOMAS -- CONDITIONAL USE PERMIT The next public hearing convened by the chair concerned the application of Mr. and Mrs. Jerry Thomas to allow riding stables and stabling of horses in an Agriculturally zoned area consisting of 40 acres south of Cliff Road on Pilot Knob Road adjacent to the Dakota County regional park. Mr. and Mrs. Thomas were present and indicated that 13.6 acres would be used for horse stable and the remainder for grazing and pasture with fence around the entire 40 acres. There were questions from the Planning Commission Members but no neighboring residents objected to the proposal. There was a suggestion that the barn. be located as far south as possible in order to avoid odorproblems in the proposed residential area to the north. The south 600- feet of the 40 acres will be used for the building because it contained the former farmstead. No utilities are available at the present time and the County Park Department has indicated that the County park trail will connect to the property. There were concerns about disposal of manure and Mr. and Mrs. Thomas indicated that a contract can be set up for the disposal of manure on a weekly basis. Additional concerns related to site distance from Pilot Knob Road and the possibility of extra traffic lanes on Pilot Knob. The County Highway Department will review the use and also review the proposal for turn lanes. The applicants indicated that there was no intention of requesting a liquor license. After considerable discussion Hall moved, Gits seconded the motion, to recommend approval of the application with the understanding that the applicants accept all of the conditions subject to the following conditions: 1. The conditional use shall be granted for a period of ten (10) years subject to revocation by the City Council if the conditions included in the granting of the permit are not met at all times. 2. Prior to final approval of a conditional use permit by the City, the City shall receive a letter from Dakota County (Parks Department) indicating that they are in accord with the use of the,Dakota County Park trails by this horse stable and riding facility. 3. The applicant shall submit a copy of the contract with Lehmann Mush- room Company or other satisfactory subcontractor for removal of manure at least once each week. This contract or a similar contract shall be in effect at all times while this site is utilized for the stabling of horses. No manure shall be permitted to be stored outside at any time. 4. This conditional use permit shall be reviewed .by other governmental agencies in accordance with the provisions of the "Zoo Area Development Guide" prior to final approval by the City of Eagan. 5. The conditional use permit shall only be. granted to 13.6 acres and shall not extend to the entire 4.0 acre area except for pasture purposes. CENTRAL FENCE AND SUPPLY COMPANY CONDITIONAL USE 'PERMIT AND RFZONING The chairman then convened the public hearings regarding the application of Central Fence and Supply Company for rezoning from Agricultural to I-1, Limited Industrial and conditional use permit to allow outside storage on two parcels of property located at the intersection of Wescott Road and and eCountvnt Road 63. near Highway 449. The outside storage of fencingsupplies for Central Fence and supply Company only will be located on the south two acres of the site. It was noted that Central Fence owns a parcel in Inver Grove Heights adjacent to the area proposed to be rezoned in Eagan. Mr. James Sander, attorney for Central Fence, and Mr. Leonard owned bHeralen, ntence president of Central Fence, were present. The property is zoned Light Industrial in Inver Grove Heights and Mr. Sander indicated the -- 2-1/2 acre tract would include an 8-foot chain link fence to store the fencing materials. There was discussion concerning access for County Road t63 to the -- storage site. The applicant requested that the 8-foot fence not be required to be placed 10 feet south of the proposed office site, but rather on the property line of the proposed office site parcel. Mr. Sander indicated that there are no objections to the conditions but preferred not to be assessed or be required wer and water service. PLANNING CONSIDERATIONS: 1. The applicant indicated that there would be approximately 50 horses stabled at this location in a 40' x 80' barn. There also would be a corral , a 70' x 36' clubhouse, a parking lot surfaced with crushed rock, and a pas- ture area. The riding stable would not be operated as such during the winter months except for sleigh rides. Most of the horses would be re- moved from the site during the winter months. There would be a cross- country ski facility operated at this location in conjunction with the County's Regional Park during the winter months. There would be no residential housing located at this site. 2. The applicant has - indicated that all .feed would be hauled to the site and no feed would be grown on the site.. The applicant also indicated that Lehmann Mushroom Company would contract to pick up the manure at least once each week wherein the horse barn would be cleaned and no manure would to stored outside. 3. The applicant has been coordinating the development of this facility with the Dakota County Parks Department. The applicant indicated that all horse trails and_ corss-country ski trails originating from this site will lead directly to the County Park and horses would not use trails in other direc tions unless the City of Eagan develops other trails for this purpose. The- only heronly long-range possibility may be the development of a trail along Pilot Knob Road, however, none are-planned at this time for use as equestrian trails. �1 4. The applicant proposes to develop a crushed rock parking lot and not provide a bituminous surface. The applicant would, however, set back the parking lot 50' from the nearest edge of Pilot Knob Road right-of-way (125' from center line) and the driveway from. Pilot Knob Road to the parking lot would be sur- faced. The applicant indicated that there never is a need for more than 30 parking stalls and there also may be horse trailers parked on this lot for persons driving in to use the trails in the Dakota County Park. The appli- cant also indicated that the parking area has been sized to accommodate horse trailers and the parking for 30 vehicles. 5. The applicant indicated that there would be no request for liquor in con- junction with the clubhouse facility and utilities would be provided by , constructing a private well and septic system. I 6. In the past, the City has encouraged the development of this type of facility at this location wherein the Dakota County park area can be utilized for" equestrian purposes. This use at this location if properly controlled, would appear to be much better than internal locations surrounded by resi- dential development. The City's Comprehensive Plan does not designate this property for this use, however, horse stables are developed so infrequently that it is difficult to anticipate the exact and proper location for this use. The proposal would not appear to be in conflict with the City's Comprehensive Plan if proper access controls can be achieved along Pilot Knob Road. CONDITIONS If this conditional use permit is approved it should be subject to the follow- ing conditions; A. We have also had previous discussion with the applicants regarding this proposed facility, both at the public Hearing for the Lebanon Hills Development Plan and on other occasions. The Dakota County Parks Department is in general accord with the use of the Dakota County Park trails by the customers of this facility. , At the present time, however, horse trails and cross country ski trails have not been developed in the section of Lebanon Hills Park between Pilot Knob and Johnny Cake Ridge Road immediately adjacent to this site. Every effort will be made to develop trails in this area in a timely manner, should this facility be located as planned. The installation of a barbed wire boundary fence, as mentioned in the planning report, would not be permitted. Barbed wire is not allowed on park property. The Dakota County Parks Department will begin installation of a combi- nation of wood and smooth wire fencing around the park this summer. A written agreement would be required to allow for direct access from the subject property to the park trails. No surface runoff from the stable or horse lot area may be drained on- to park property including Jensen Lake. No septic system drainage will be allowed onto County park property. We recommend that the applicant contact this department officially re- questing approval for use of the park trails and for provision for direct access. The following information should be -included: - The types of uses proposed The times of day and times of year these uses would occur - A complete breakdown of all fees which would be charged, including parking fees, if any - A drainage plan showing the present and future drainage planned for the site a Dale C. Rezoning: The. Central Fence and Supply Company owns property at the inter- section of Dodd Road and T.H. #49; half of which is located in Eagan with the other half being located in the City of Inver Grove Heights. The area in Inver Grove Heights has been developed with three (3) buildings wherein Central Fence and Supply Company is operating its business in an area zoned Limited Industrial . Central Fence and Supply Company purchased the adjacent approximate three acres located in Eagan which is occupied by a residence. Central Fence proposes to rezone the Eagan portion from Agricultural to Limited .Industrial in order that their entire area may be zoned Industrial and also that they may expand their existing business to the entire property. The Eagan portion of the property would be used in the near future for out- side storage and the existing residence, which is being rented, would be converted later in 1980 to an office. At present, the employee .parking area is located on the Eagan portion of the property. The Eagan Comprehensive Plan proposes "mixed residential" use of iow density for this area. The adjacent area _to the east, however, as indicated above in Inver Grove Heights, is zoned Limited Industrial and the area to the north- west in Eagan is also zoned Limited Industrial for the West Publishing Company's facility. Therefore, it would not appear that this would constitute a "spot zone". �s 2. Conditional Use Permit: A. The conditional use permit would pertain to the approximate 2 acres wherein the applicant would-'store materials and equipment related to their fencing operation. The area would be surfaced with crushed limestone and the applicant would construct an 8' high chainlink fence with three strands of barbed wire around the perimeter of ' the outside storage area. The fence also would include 6' high wood slats for solid screening and the area outside the perimeter of the fence, along Dodd Road, would be landscaped with a berm and juniper plantings. B. The City's staff requested the applicant to submit a detailed site plan indicating details in the vicinity of the proposed office building such as driveways, parking areas, surfacing of parking areas, landscaping, drainage and similar details. This more de- tailed site plan has not been submitted by the applicant. CONDITIONS: If this property is rezoned and if the conditional use permit is approved, it should be subject to the following conditions; 1 . A more detailed site plan in the area of the existing home/proposed office shall be submitted and approved by the City prior to final approval of the conditional use permit. 2. Accesses to the property from County Road 463 - Dodd. Road - as approved by Dakota County. 3. The conditional use permit shall be approved for a period of seven (7) years provided the 'developer complies with the conditions under which the condi- tional use permit is granted and all other pertinent ordinances of the City. 4. The applicant shall be required to dust control the outside storage area at all times. 5. The perimeter fence shall be set back a minimum of 20 feet from the r-o-w line along Dodd Road and the setback area shall be bermed and landscaped as approved by the City. The driveways and parking area related to the proposed office shall be surfaced prior to the development and use of the outside storage area.. 6. Materials and equipment,stored in the outside storage area shall relate directly to the Central Fence and Supply Company's operation and no other outside storage shall be permitted unless approved by the City Council of Eagan. 7. At such time as any additional structures are developed on this property the property shall be platted. 8. With the rezoning of this property and the approval of a conditional use permit the City does not intend to promote the dual use of property wherein the existing house would be continued to be used as a residence for a long period of time. The petitioner haS indicated that their existing operation, located in Inver Grove Heights, recently had their on site sewage disposal system completely upgraded and.repaired within the last two (2) years. They indicate that their on site sys-em is capable of handling the proposed converted use of the existing residential property located in Eagan. Consequently, they indicate that they will be connecting the existing residential property to 'their on site disposal system presently located within the limits of Inver Grove Heights. At the time of the installation of the sanitary sewer and water main facilities, the existing single family residence property owners (Mr. and Mrs. William Sachwitz) requested special consideration in regards to their proposed assessment for lateral benefit from trunk utilities. The Special Assessment Cornittee at their meeting of October 30, 1978, indicated that if, and when,, this property were ever converted to another use rather than its existing single family residence; that it would have to assume its assessments for lateral benefit from trunk utilities, from both the sanitary sewer and the water main. Consequently, if this rezoning is approved, Central Fence and Supply Company must pay their lateral assessments in accordance with the proposed Limited Industrial assessment rates. The Public Works Department feels that this existing residence should be connected to the sanitary sewer system, rather than the existing on site disposal system, regardless of any rezoning. Drainage: The natural drainage of this subject parcel presently drains to the northwest, where there exists a storm sewer system. We do not anticipate any problems in regards to the drainage as a result. of this proposal. Site Plan: A detailed site plan has not yet been submitted, indicating the limits of the different ground cover (crushed rock, bituminious, landscaping, etc. ). It was noted that the Special Assessment Committee on October 30, 1978, indicated that if and when the property was converted to another use rather than the existing single family, that it would be required to assume the assessments .for lateral benefit from trunk utilities for both sanitary sewer and water. After considerable discussion, 'Krob moved to recommend that the property be rezoned to Light Industrial. Gits seconded the motion subject to the con ditions. hereinafter mentioned relating to the conditional use permit. All voted in favor. Krob then moved, Gits seconded a motion, to recommend approval of the conditional use permit to allow ,a fence around the outside storage area relating to the south approximately two acres of the site with line the understanding that the fence would be allowed on the internal property between the two designated parcels, subject to the following conditions includ- ing those that apply to the rezoning application. 1. A more detailed site plan in the area of the existing home/pposed the office shall be submitted and approved by the City prior _to final approval conditional use permit. The applicant shall be required to dust control the outside storage area at all times. - 5. The perimeter fence shall be set back a minimum of 20 feet from the right-of=way line along Dodd Road and the setback area shall be be tined and land- scaped as approved by the City. The driveways and parking area related to the proposed office shall be surfaced prior to the development and use of the out- side storage area. 6. Materials and equipment stored in the outside storage area shall relate directly to the Centrad Fence and SupplyCompany's operation and no other out- side storage shall be permitted unless approved by the City Council of Eagan. 7. At such time as any application for building permit is requested of the City, the property shall be platted. 8. With the rezoning of this property and the approval of a conditional use permit, the City does not intend to promote the dual use of property wherein the existing house would be continued to be used as a residence for a long period of time. The applicant shall submit a proposed schedule for converting the residence into an office which shall be approved and become a part of this - -- conditional use permit. 9. Lateral benefit from trunk water main and sanitary sewer shall be assessed against this property in accordance with existing assessment policy pertaining to Limited Industrial zoning. 10. A detailed site plan shall be submitted and approved, indicating the limits of the open storage, parking area, entrance drive, and landscaping ground cover. This plan must also indicate grading elevations and drainage patterns. 11. The existing residential property (proposed office complex) shall be connected to existing sanitary. sewer sysetm rather than to the on- site disposal system at the time of conversion to office use. 12. Tim Eller of Centex Homes was present and he indicated that Centex Homes had eroneously interpreted the restrictions concerning setbacks. There were no objections from neighboring property owners. There was discussion by Mr. Eller concerning the hardship to the purchaser and Mr. Eller indicated that the plan could be changed but would still need a 1.94 foot variance from the side yard setback requirement. After discussion, Wilkins moved, Krob seconded the motion, to recommend dis- approval of the application based upon the understanding that at the time application for approval of the plat was submitted, the applicant indicated that there would be no variances, there was no substantial hardship shown, and smaller lots were intended to be sold at lower prices according to the applicant when the plat was first submitted. Those in favor were Wilkins, Krob, and Bohne. Those against were Gits and Hall. ST. FRANCIS WOOD SECOND ADDITION REPLAT The Public Hearing concerning Lexington Development Company for replat approval of St. Francis Wood ,Second Addition covering Lots 19 through 22 of St. Francis Woods Addition was continued at the request of the applicant. RIDGE CLIFFE ADDITIMI REZONING AND PRELIMINARY PLAT The next public hearing convened by the Chairman concerned the application of U.S. Homes Corporation -- Orrin Thompson Homes -- for rezoning of a 144 acre parcel from Agricultural to R-1, R-2, and R-3, Residential and preliminary plat approval of Ridge Cliffe Addition. The proposal includes 81 acres of single family, 36 acres of quadrominiums, 2.6 acres of doubles, 16.6 acres of park, 1.85 acres pond, and 6.10 acres miscellaneous streets, etc. The proposal would include 385 dwelling units with a 3.2 average residential and 2.66 overall density. Mr. Orrin Thompson, Robert Carlson and Chuck Winden `appeared for the applicant. It was noted that the Park Committee had informally reviewed the proposal but that the exact location of the park may be changed. The model home area would be at the southeast corner and it was noted that there would be two Outlots that are too narrow for development adjoining Cliff Road with several alternate uses. One adjacent owner was present and raised questions concerning the stub streets and the method of developing the heavily treed area adjacent to this property near Cliff Road. Objections were raised and the questions were answered. The developer opposed the looping of cul-de-sacs H and J although the developer indicated that the number of lots would be no less than possibly one additional lot. Mr. Colbert stated that it would be :possible to connect the cul-de-sacs but there are not an- excessive number of cul-de-sacs in the subdivi- sion and strong terrain issues were raised by the applicant, including tree cover. There was discussion concerning proposed R-2 uses along Galaxie Avenue, but the applicant requested that Lots 17 through 22, Block 2, be rezoned to R-3 and that Lots 15 and 16, Block 2, and Lots 23 and 24, Block 5, be rezoned to R-2. There was a question from Member Wilkins. concerning why quads would be located in the center of the R-1 zoned area. Mr. Thompson stated that the design of the quads would tend to lend themselves to R-1 areas and also the quads are centered so that the R-1 area wouldabutadjoining R-1 property. PLANNING CONSIDERATIONS: 1 . When the Beacon Hill area was platted some undersized lots (minimum 75' wide) were permitted. In so doing, it was stated that side yard setback variances would not be permitted in this subdivision and the applicant would be required to construct homes which could meet the minimum setback requirements for these smaller lots. Several lots in the subdivision, however, met or ex- ceeded the City's minimum 85-foot width requirement and on an average, the overall development met minimum requirements. 2. The lot upon which a variance is being requested is not one of the smaller lots. This lot (Lot 1 - Block 8 - Beacon Hill Addition) is located on a cul-de-sac and has a width of 85 feet which meets minimum code require- ments and it is 16,940 square feet in area which exceeds minimum code re- quirements. The variance is caused by the proposed construction of a home which is 68 feet in width. On a lot that measures exactly 86.06 feet in width at the setback line, the home cannot meet the 10 foot setbacks along each side of the lot and this caused the request for a 1.94 foot variance. 3. The lots that are east and west of the subject lot are both vacant but platted for future single family development. The lot located along the side where the setback variance is requested is in the adjacent "Johnny Cake Ridge" plat which is being developed by U.S. Homes Corporation. This is a very large lot and there would be ample opportunity to locate a house on this lot that would be setback a considerable distance from the lot in question-. Rezoning: The proposed rezoning of the Ridgecliffe area from Agricultural to Residential R-1 and R-3 appears to be consistent with the Eagan Comprehensive Plan. It is projected under the Plan that this area develop with mixed residential uses ranging in an overall density from 3 to 6 units per -acre. The overall density proposed under the Ridgecliffe deyelopment is less than three units per acre and the average residential density is 3.2 units per acre. The new Comprehensive Plan also proposes a park at the general lo- cation shown on the Ridgecliffe preliminary plat. The applicant only requested R71 zoning for the single family area and R-3 zoning for all of the multiple dwelling areas including the double bungalow area. It is recommended that the double bungalow areas be rezoned as fol- lows; go • Lots 23 and 24 of Block 5 to R-2 Lots 15 and 16 of Block 2 to R-2 Lots 17 through 22 of Block 2 should be combined into one (1 ) lot and, rezoned R-3 (see explanation below) Proposed Lots 17 through 22 of Block 2 would front on Galaxie Avenue and as double bungalows would create several individual driveways along .this minor arterial . Rather, this area should be rezoned to R-3, R-4 or Limited Business wherein the number of driveways could be reduced. This area also does not relate well to other residential development and it is expected to be directly across Galaxie Avenue from. a commercial area. The applicant also owns the existing adjacent residence to the north which is located at the southeast quadrant of Galaxi.e Avenue and Cliff-Road. The rezoning of the lots in the plat should be coordina- ted with,the rezoning and future use of this property. 2. Preliminary Plat: The preliminary plat is generally well-designed and provides for collector streets, parks, right-of-way dedications and similar details considered by the City. The only problems which may exist are described below; A. The City is in the process of reviewing the adequacy of the proposed neighborhood park (16.61 acres). This -will be considered by the Park Committee at the May 1 , 1980 meeting and could result in minor revisions to the plat. The general location and acreage appear to be consistent with what the City had been expecting for park dedication. B. The applicant is proposing the dedication of an east-west collector street through the property - Covington Lane - "as an 80'. right-of-way which was requested by the City. -It appears, however, that low density development in this area will not generate enough vehicular trips to warrant the need for a collector street (total of 2300 to 3000 trips per day). The City Engineer will comment on the need for this collector street. 3. Conditions: If this preliminary plat is approved, it should be subject to the following conditions: A. The proposed double bungalow lots, which would front on Galaxie Avenue, shall be platted consistent with the rezoning of this area (R-2 or into one-lot or multiple or limited business zoning). B. The location of the park shall be determined by the City Council after review by the Park Committee and any major unanticipated revisions shall be referred back to the Planning Commission, for review. C. A trail shall be required to be constructed by the developer at his cost along the north side of Covington Lane for the entire distance of the preliminary plat. 1� D. This preliminary plat shall be reviewed by the Dakota County Plat Committee prior to final approval by the City. (The plat abuts on a County Road - County Road #32 - Cliff Road,) E. The applicant shall be required to provide berming and a landscape "screen" where dwelling units have a side or rear yard along Cliff Road, Johnny Cake Ridge Road or Galaxie Avenue. Berming and screening shall only be required where the grades are substantially the same as that on the abutting roadway where protective screening can be es- tablished. F. A "model home" area shall be permitted along proposed cul-de-sac "L" for a period not to exceed five (5) years. The applicant shall submit a detailed plan indicating how this area will be altered for model homes and how the area will be reverted to normal residential development after use for model .homes- has ceased. This plan shall be approved by the City Council with the approval of the final plat. G. The applicant shall be required to submit street names to the City for approval prior to the final approval of the preliminary plat., H. If Covington Lane remains a collector through this preliminary plat, any dwelling unit or garage variances from the minimum 40' setback shall be considered at this time as a part of the approval of the preliminary plat (applicant has indicated a desire for 30' setbacks for garages but has not submitted a formal request). I. The applicant shall be required to grant the City a 60' wide street easement over the property which lies between the Bjelland and Stertz properties for a future street extension. The proposed lot at this location should be platted as an outlot. J. The 3.44 acre parcel that lies west of tots 12 and 13 of Block 5 shall be platted as an outlot. It is expected that this area will be re- platted when the adjacent area to the west is developed K. The applicant shall be required to submit plans for totlots in each of the three quadrominium blocks and a totlot shall be developed in each area by the applicant. L. The applicant shall be required to submit "bylaws" for the homeowner's association(s) to the City for review prior to approval of the final plat. M. Lot 1 of Block 2 should be redesigned and incorporated into the platting of the Esther Johnson property which is shown on the preliminary plat and which is owned by the applicant. ENGINEERING RECOM ENDATIONS: 1. A storm sewer study must be performed and submitted for City approval, evaluating the existing and available capacity of the on ponding systems prior to final plat approval. 2. Sufficient temporary easements must be granted to provide for the temporary cul-'de-sacs along the western edge of this proposed plat for streets "G", "C" and Covington Lane, and also street "I", adjacent to the Marstad property on Cliff Road. 2) MEMO TO: ADVISORY PLANNING COMMISSION C/O DALE C RUNKLE, CITY PLANNER FROM: THOMAS A. COLBERT, DIRECTOR OF PUBLIC WORKS DATE: APRIL 17, 1980 RE: PRELIMINARY PLAT - RIDGE CLIFFE ADDITION (U.S. HOMES CORPORATION) The Public Works Department has the following comments to make in regards to the above referenced preliminary plat: Utilities: Major sanitary sewer and water main facilities of sufficient size and depth are available to handle the proposed development as submitted. These utilities presently exist along Johnny Cake Ridge. Road and along `Cliff Road. The internal distribution system will be designed with the respective improvement project to serve the various phases of development. Drainage: The 144 acres proposed to be developed under this plat lies within three major drainage areas. The first area encompasses approximately 37 acres along the south side of Cliff Road, including the existing individual private parcels surrounded by this proposed plat. This drainage would discharge into the existing pond located in the north central portion of the proposed plat, which would then have this outlet directed into existing storm sewer and ponding system located within the Woodgate Addition. The ultimate outlet for this overall storm water is into a very deep ponding area within the N.S.P. easement north east of the Mallard Park Second Addition. The ultimate outlet from this down stream pond will be outletted into the recently installed trunk storm sewer from Thomas Lake to Blackhawk Lake. The next major drainage area is located in the northeast corner of this proposed plat adjacent to Johnny Cake Ridge Road just south of Cliff Road. This water will drain into the existing in place storm sewer system on Johnny Cake Ridge Road, which ultimately discharges into Pond LP-4 located within the Johnny Cake Ridge and Brittany Addition plats on the east side of Johnny Cake Ridge Road. The third major drainage area encom- passes the west two thirds of the south half of this proposed plat. Drain- age will be directed into an existing pond located south of Covington Lane within block eight (8). There is also a smaller internal pond within block five (5) to handle surface drainage. These ponds are ultimately proposed to be connected to a proposed future storm sewer system along Galaxie Avenue and eventually up towards Rahn Park. This storm sewer system has not yet been installed. Capacity of the on site ponds within this proposed plat has not been evaluated to determine their capacity in rela- 'tion to the projected run -off created by the development of this proposal. This will have to be reviewed and evaluated prior to final plat approval. Streets: All streets proposed for this plat are less than or equal to a 5.0% grade. The layout of this proposed plat was dictated by limited access points along Cliff Road and Johnny Cake Ridge Road, existing private property configurations along Cliff Road, the location of the east/west neighborhood collector Ci ty of Ea; an is • Ridge Clif e Addition April 17, 1980 Page Two (Covington Lane-) and internal topography features (ponds, hills, excess of slopes, etc. ) Although Covington Lane, east of Johnny Cake Ridge Road, is a community collector between Johnny Cake Ridge Road and the future connection to Pilot Knob Road, it is not necessary to continue this community collector status through the Ridge Cliffe Addition. Covington Lane, through Ridge Cliffe Addition,will act as a neighborhood collector. Subsequently, it can be reduced from its required 80 foot right of way with a 44-48 foot street surface to- a 60 foot right of way with a 36 foot street surface. In addition to this, it is also recommended that a side walk be placed at the developers expense, along the north side of Covington Lane. Maintenance of this side walk should be incor- porated within the t6wnhouse association by-laws. After reviewing the road configuration within this plat, it was determined that the two existing cul-de-sacs "H"and"J" could be eliminated by a looped connection. The Public Works Department reinforces the comments made by the Planning Department regarding the required 60 foot street easement over the property which lies between . the Bjelland and Stertz properties, adjacent to Cliff Road. Tim Eller of Centex Homes was present and he indicated that Centex. Homes had eroneously interpreted the restrictions concerning setbacks. There were no objections from neighboring property owners. There was discussion by Mr. Eller concerning the hardship to the purchaser and Mr. Eller indicated that the plan could be changed but would still need a 1.94 foot variance from the side yard setback requirement. After discussion, Wilkins moved, Krob seconded the motion, to recommend dis- approval of the application based upon- the understanding that at 'the time application for approval of the plat was submitted, the applicant indicated that there would be no variances, there was no substantial hardship shown, and smaller lots were intended to be sold at lower prices according to the applicant when the plat was first submitted. Those in favor were Wilkins, Krob, and Bohne. Those against were Gits and Hall. ST. FRANCIS WOOD SECOND ADDITION REPLAT The Public Hearing concerning Lexington Development Company for replat approval of St. Francis Wood Second Addition covering Lots 19 through 22 of St. Francis Woods Addition was continued at the request of the applicant. RIDGE- CLIFFE ADDITI0.7 REZONING AND PRELIMINARY PLAT The next public hearing convened by the Chairman concerned the application of U.S. Homes Corporation -- Orrin Thompson Homes -- for rezoning of a 144 acre parcel from Agricultural to R-1, R-2, and R-3, Residential and preliminary plat approval of Ridge Cliffe Addition. The proposal includes 81 acres of single family, 36 acres of quadrominiums, 2.6 acres of doubles, 16.6 acres of park, 1.85 acres pond, and 6.10 acres miscellaneous streets, etc. The proposal would include 385 dwelling units with a 3.2 average residential and 2.66 overall density. Mr. Orrin Thompson, Robert Carlson and Chuck Winden appeared for the applicant. It was noted that the Park Committee had informally reviewed the proposal but that the exact location of the park may be changed. The model home area would be at the southeast corner and it was noted that there would be two Outlots that are too narrow for development adjoining Cliff Road with several alternate uses. One adjacent owner was present and raised questions concerning the stub - streets and the method of developing the heavily treed area adjacent to this property near Cliff Road. Objections were raised and the questions were answered. The developer opposed the looping of cul-de-sacs H and J although the developer indicated that the number of lots would be no less than possibly one additional lot. Mr. Colbert stated that it would be possible to connect the cul-de-sacs but there are not an excessive number of cul-de-sacs in the subdivi- sion and strong terrain issues were raised by the applicant, including tree cover. There was discussion concerning proposed R-2 uses along Galaxie Avenue, but the applicant requested that Lots 17 through 22, Block 2, be rezoned to R-3 - and that Lots 15 and 16, Block 2, and Lots 23 and 24, Block 5, be rezoned to R-2. There was a question from Member 'Wilkins concerning why quads would be located in the center of the R-1 zoned area. Mr. Thompson stated that the design of the quads would tend to lend themselves to R-1 areas and also the quads are centered so that the R-1 area wouldabutadjoining R-1 property. He also indicated -1a APC Minutes April 22, 1980 Page Six that quads are not compatible with extremely rough terrain. He stated that the quads and doubles would all be sold as single units and the plan is to commence development in 1980. The prices for the quads would- be $50,000 -- $60,000 with the singles from $70,000 to $100,000. Although Covington Lane was proposed to have an 80-foot right-of-way, Mr. Colbert and Mr. Rosene `indicated 60 feet would be adequate because it was not a collector street and a 32-foot improved roadway would be sufficient. A sidewalk would be required on one side of Covington Lane. Mr. Hall recommended reducing Covington to 60 feet to allow 30- foot setbacks which would fit into the terrain more adequately and also would include more property under private ownership for real estate tax purposes. After lengthy discussion, Gits moved, Bohne seconded a motion, to recommend' approval of the application for rezoning to R-1, R-2, and R-3 as designated on the plat and that Lots 15 and 16, Block 2, Lots 23 and 24, Block 5, be rezoned to R-2 and that Lots 17 through 22, Block 2 be rezoned to R-3 together with the other lots designated. in the application. All voted in favor. Gits then moved and Krob seconded the motion to recommend approval of the preliminary plat subject to the following conditions: 1. The proposed double bungalow lots, which would front on Galaxie Avenue, shall be platted consistent with the rezoning of this area (R-2 or into one lot or multiple or limited business zoning) . 2. The location of the park shall be determined by the City Council after review and recommendation by the Park Committee and staff. 3. A trail shall be required to be constructed by the developer at his cost along the north side of Covington Lane for the entire distance of the preliminary plat. 4. This preliminary plat shall be reviewed by the Dakota County Plat Committee prior to final approval by the City. (The plat abuts on a County road, County Road #32 (Cliff Road) . 5. The applicant shall be required to provide- berming and a landscape "screen" where dwelling units have a side or rear yard along Cliff Road, Johnny Cake Ridge Road or Galaxie Avenue. Berming and screening shall only be required where the grades are substantially the same as that on the abutting roadway where protective screening can be established. An adequate landscape bond shall be posted by the Developer as determined by the staff. 6. A "model home" area shall be permitted along proposed cul-de-sac "L for a period not to exceed five (5) years. The applicant shall submit a detailed plan indicating how this area will be altered for model homes and how the area will be reverted to normal residential development after use for model homes has ceased. This plan shall be approved by the City Council with the approval of. the final plat. 7. The applicant shall be required to submit street names to the City for approval prior to. the final approval of the preliminary plat. Covington Lane shall provide for 60-foot right-of-way. The applicant shall be required to grant the City a 60-foot wide street easement over the property which lies between the Bjelland and Stertz properties for a future street extension. The proposed lot at this location should be platted as an outlot. 9. The 3.44 acre parcel that lies west of Lots 12 and 13 of Block 5 shall be platted as an outlot. It is expected that this area will be replatted when the adjacent area to the west is developed. 10. The applicant shall be required to submit plans for totlots in each of the three quadrominium blocks and a totlot shall be developed in each area by the applicant. 11. The applicant shall be required to submit "bylaws" for the homeowner's association(s) to the City for review prior to approval of the final plat. 12. Lot 1 of Block 2 should be redesigned and incorporated into the platting of the Esther Johnson property which is shown on the preliminary plat and which is owned by the applicant. 13. A storm sewer study must be performed and submitted for City approval, evaluating the existing and available capacity of the on-site ponding systems , prior to final plat approval. 14. A five-foot concrete sidewalk must be installed along the north side of Covington Lane as the Developer's responsibility, with maintenance to be the requirement of the adjacent townhouse association 15. Sufficient right-of-way should be dedicated to provide for the future relocated Galaxie Avenue, Cliff Road, and Johnny Cake Ridge Road. 16. This play must be submitted for comments and restrictions by the Dakota County Highway Department prior to final plat approval. 17. Sufficient temporary easements must be granted to provide for the temporary cul-de-sacs along the western edge of this proposed plat for the streets "G", "C" and Covington Lane, and also street "I", adjacent to the Marstad property on Cliff Road. All voted in favor. DUCKWOOD ESTATES PLAT WAIVER The next public hearing concerned the application of Mr. Ken Thomas for waiver of plat for Lots 13 and 14, Block 2, Duckwood Estates. City Administrator Hedges reviewed the application and indicated that because of an inadvertent mistake in the location of the lot line;"between Lots 13 and 14, the basement was installed over the lot line, and a request was made to waive the platting require- ments to adjust the lot line between those two lots as proposed in the application. After discussion, Krob moved, Wilkins seconded the motion, to recommend approval of the application. All voted yes. Bid' Opening for One Ton -Park Maintenance Vehicle - The bid opening for a 1980 One Ton Dump Truck was held on May 15 , 1980. Only one bid was submitted by Ridgedale Ford in the amount of $12,174,00 which is 32% over the estimate in the _ 1980 budget; The Public Works Director has not yet been ablt to obtain- informa- tion as' to why no other bids were received, but he hopes to be able to comment onthis matter at the meeting. Tuesday evening. It is the recommendation of the Public Works Director that, based on the one bid submitted exceeding the estimate, the bid be rejected and modification to 'the specs be made` and -readvertised.
