The City Council has previously authorized the purchase of two police patrol cars , an Oldsmobile Cutlass Diesel and a Buick Skvlark.. Chief of. Police DesLauriers is recommending the purchase of two more vehicles during the month of April . Enclosed is a memorandum from Chief of Police DesLauriers requesting the purchase of squad cars and the specifi- cations for the cars desired. This information is found on pages _ through � - Several weeks ago, Chief of Police DesLauriers met with the CityCouncil as discussed the policy for purchasing police patrol cars . At that time, members of the City Council asked that a study be completed reviewing the efficiency and per- formance of all police patrol cars to provide some additional. back- ground data prior to ordering the other .two police patrol cars as budgeted for 1980. Hedges, City Administrator FROM: Chief of Police SUBJECT Purchase of Squad Cars In the 1980 budget we had proposed the purchase of four squad cars. We have already purchased one Cutlass diesel and one Buick Skylark and I mould Like to recommend that we purchase two more vehicles during the month of April. We have done a study on the maintenance costs, mileage, etc. on our present marked and unmarked squad cars and as I have stated before, all of our police personnel feel that the Larger police package vehicles are the proper equipment for police duty. However, due to the city council's mandate to purchase smaller vehicles with more economical fuel consumption, I would Like to recommend that we purchase two new four-door 1980 diesel Oldsmobile Cutlasses. Due to the Low mileage on our present Cutlass (5,309 miZes), our study does. not indicate any valuable information regarding the comparison of the diesel Cutlass to the Larger gasoline models. However, the Cutlass has been getting 172 miles per gallon of fuel and because the price of diesel fuel is not expected to increase in the coming year as much as the cost of gasoline and because we can order the diesel Cutlass with heavy duty suspension steering, brakes, etc., I would Like to recommend that we purchase this type of vehicle. I can attaching a list of specifications that should be included in the bidding process. I feel that Oldsmobile, Buick and Chevrolet should be able to bid these speci- fications and I feel that we will be able to receive at Least five quotes on this type of bid. Ma tin DesLauriers MD/vk 3 THE LONE OAK TREE — THE SYA1BOL OF STRENGTH & GROWTH IN OUR COMMUNITY 0 • MEMO TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: MARCH 28, 1980 SUBJECT: PATROL CAR STUDY The City Council met with Chief of Police DesLauriers several weeks ago to dis— cuss the existing policy and procedure for the selection and purchase of police patrol cars. At that time, members of the City Council asked that a performance study be made of all existing cars so data could be avai-lable to compare the operational. expense and other related factors of the various automobiles used for police patrol cars before any additional police patrol cars are purchased.. Police Chief DesLauriers with the assistance of the Assistant Police Chief has prepared the attached study. The City is currently using ' seven (7) cars for patrol duty. They. are Squads #1 through /#10 as referred to on the attached sheet. Squad #12 is used for investigative duties and, because it is not exposed to the vigorous use of a patrol car, it is not and accurate comparison to the other seven vehicles. The 1980 Buick Skylark was involved in an accident and was not used for comparative purposes for several of the categories. The purpose of the study was to examine the cost for operation of various police patrol cars. First, an 'effort was made to examine, the mileage or use of each vehicle. Then the operating and maintenance costs with the exception of fuel and insurance were related in the next column as indicated. On both, the cost average per month and a maintenance cost per mile was related. The maintenance cost per mile with added depreciation per mile, giving a total maintenance and operating figure per mile, is the most accurate method of illustrating. the operating maintenance expenses. The fuel was examined in a separate column, which illu— strates what each vehicle is receiving on a miles per gallon and also related in a cost per mile basis. The factor used in determining the cost per mile to be consistent with all vehicles was 60,000 at $1.10 per gallon. For purposes of ,comparison for total operation including fuel and depreciation, the 1979 Ford LTD II and 1979 Oldsmobile Diesel were used. Both cars were purchased three weeks apart and have approximately the same amount of miles on them. Realizing that the cost for fuel is increasing on a monthly basis, each of the eight police cars as indicated in the study were examined at different variable price rates from $1.20 per gallon to $1.50 per gallon. As you can see, there is a significant difference in total dollars between the Oldsmobile Cutlass Diesel and, for example, a Ford LTD. The study takes into consideration operating expenses and does not place empha— sis on the purchase price and trade in expense realizing a total net capital investment to the City for each police patrol car. There are too many variables involved with this consideration,realizing that the purchase price is changing on a monthy basis due to economic conditions and further the trade in and/or sale price for a used police patrol car has been based upon market conditions and has remained relatively constant in previous years. Normally, a used police patrol car is purchased by taxi cab companies. The City has not had any experi— ence in selling a diesel powered vehicle or x-bodied vehicle used as a police patrol car, adding to the difficulty of performing this part of a study.. Hopefully, this information is helpful; the Chief of Police and City Administra— tor will continue examining the operational and depreciational expences for all vehicles used by the Police Department in the future. PUBLIC WORKS DEPARTMENT -- Item 1 : The City of Eagan has, received ,a ' rea'uest from two property owners located on Carnelian Lane requesting the installation .of a stop sign controlling the traffic on Carnelian Lane and Amethyst A copy of this request and location map is available on pages 13 through 9_ Public Works Director Colbert has indicated that the Public Works Depart merit does not recommend the installation of the stop sign at this location due to the insufficient warrants being met that are re- quired by the Manual on Uniform Traffic Control Devices (MUTCD) . The City Administrator will comment in further detail on this matter at the meeting on Tuesday. ACTION TO BE CONSIDERED ON THE MATTER: To approve or deny the request for stop sign at the intersection of Carnelian Lane and Amethyst. • '-� tj, lyUU Mayor, City of Eagan Eagan City Council Eagan City Engineer tide the undersigned request that action be taken to change the traffic flow pattern on CarnelianLane between Rahn Rd. and 3lackhawk Rd. The volume of traffic, speed of vehicles and the number of small children, especially in the area of Carnelian Lane& Amethyst, have created a situation that we feel is going to result in injury or death to a child. Possibly, the placing of a stop sin at the above location would shift traffic, other than local, to Highway #13 or Co. Rd. #30. It is interesting to note that during the past year a stop sign was placed on Carnelian Lane at Flint. We are sure this led to a traffid flow change and a reduction of'fear .for the residents of that area. Thank you for your cooperation in this matter. Richard L. Agenda Information Memo March 28 , 1980 Page Three Item 2: The ,City of Eagan has received a maintenance agreement room MnDOT for the installation of temporary signals and street lights at the Trunk Highway #55 bypass with County State Aid Highway #43 (Lexington_ Avenue) , Eagandale Boulevard at County State Aid Highway #43 (Lexington. Avenue) and Blue Gentian Road. The City' s responsibility pertains to supply of the electrical power for the signals and lights and also to maintain the street lights. This is consistent with -previous maintenance agreements . The resolutions as presented by the. State are in order for consideration. ACTION TO BE CONSIDERED ON THE MATTER: To approve the resolution authorizing. the Mayor and City Clerk to execute M.nDOT agreement #59925M. Approval and Execution of Agreement with State of Minnesota: for Construction of Storm Sewer Regarding I=494 -- In conjunction with MnDOT' s construction program of I-494 and the upgrading of T.H. 55, it is necessary that the City of Eagan:plan for the proper storm sewer outfall for -O'Neil Pond (FP-1 ) located in the NE-4 of Section 2. The City is presently in the process of preparing a feasibility report for this major storm sewer outlet project . However, until this report is completed and a decision is made whether a gravity outlet will -be constructed along I-494 or the originally proposed lift station and force main will be constructed along T.H. 55 , it is necessary to leave all options open. There fore , if the lift station outlet and force main are deemed the most feasible outlet alternative, it will be necessary to install the force main within the right-of-way of T.H. 55 . Because of the pending MnDOT improvement project for T, ':,. 55 , it, will be neces- sary to have this force main installed as part of this project. On February 19 , 1980, the City Council authorized staff to request MnDOT to prepare an agency agreement for this force main installa- tion. . nstallation. . The Public Works Director has been in receipt of the agree- ment which is to be executed by the City of Eagan. This agreement still provides an option for the City to withdraw its request for instaliation within ten ( 10) days_ after opening of the bids . There- fore ,. it is recommended that the City Council : ACTION TO BE CONSIDERED ON THE MATTER: Approve. Agency Agreement No. 59923 for the installation of- an 18 inch ductile force main as a part of the T.H. 55 improvement project. FINAL PLAT MEADE ADDITION D. Extension of Time for Final Plat of Meade Addition -- The City Administrator received a ' letter approximately one month ago from Mr. and Mrs . William Meade that states as follows : "We would like to request an extention of time for one year on the preliminary plat -of Meade Addition." The City Administrator contacted Mrs Meade and informed her that the � City Council must have reasons as to why the final platting is to be continued. She expressed economic. reasons . She was asked to submit a letter to the City - stating the reasons ; however, to date, no letter has been received. The City Administrator will follow up on this matter. Therefore, unless this letter i's received: prior to Tuesday, it is recommended that this item again be continued. Proclamation "Volunteer Recognition Week" -- Mayor Blomquist received a -letter from the Governor' s Office asking. that the City of Eagan proclaim the week of April 20 through 26 , 1980, as ".Volun- teer Recognition , Week" . This dates coincide with- the National Volunteer Recognition Week and will be set aside by Governor Quie as a time to recognize . and honor Minnesota' s many fine volunteers . During this week, many agencies and organizations will be paying tribute to their volunteers . "Volunteer Recognition Week" not only , affords - volunteer programs and community leaders the opportu- nity to. salute their volunteers , but also to carry the word of their achievements to the entire community. This , in turn, encoura- ges greater citizen involvement to meet the community"s needs by drawing attention to the opportunities and rewards of volunteer . services . The City Administrator will contact the Governor' s Office for. information and materials as well as a sample proclamation. ACTION TO BE CONSIDERED ON THE MATTER: Approve a proclamation for April 20- through 26 , 1980, as "Volunteer Recognition Week" • The City Administrator will inform the City Council of any activities he is aware of transpiring that week. FINAL PLAT SOUTH DELAWARE HILLS F. Extension of Time for Final Plat of South Delaware Hills -- A letter was received from.,Mr. Dick Parranto, President of R.M. Parranto Co. , Inc._, requesting an extension of time for the final plat of South Delaware Hills for six months . Energy Audit Grant Application -- The application for funding a mini-audit of City owned government buildings to identify energy saving measures which can be implemented quickly at a low cost is completed.. I According. to Administrative Intern -Elizabeth Ryan, after the City receives funding to conduct the mini-audits , the City ,is also eligible to apply for a maxi-audit grant if the need is indicated. The maxi-audit application deadline is June 1 , 1980. The City is eligible for 50% federal and 50% state funding of :the ` total cost of the total cost of the audits . Therefore, no financial commitment is required of the City. The mini-audit will suggest some simple changes to the buildings that would allow energy savings . The maxi-audit is much more technical and offers a more detailed energy .analysis of each building. At this time, there are no funds forimplementingthe changes, only funding for learning what the energy deficiencies are in each of the City buildings . If there should be funds left over after audits are performed throughout the state, the , Minnesota Energy Agency is considering applications for funding actual improvements to public buildings . ACTION; TO BE CONSIDERED ON THE MATTER: To authorize the Mayor and City Administrator to submit an application for a grant agree- ment for a mini-audit in the amount of $2 ,400 to the Minnesota Energy Agency. CHANGE ORDER #2 - IMP. #239 A H. Approve Change Order No. 2 for Imp No. 239 A (Thomas Lake Road Utilities) -- This change order is brought about by certain revisions to the Thomas Lake Road utility improvement during field construction. They consist of five parts : PART ONE: This provides for an approximate $5,000 deduct to do the incorporation of a ponding; area within the Thomas Lake Heights Addition which allows the -reduction in pipe size construction. PART `TWO: This results in an approximate $8 ,000 deduct to the contract due to the revisions in the project that were necessitated by elimination of Heine Pond from the system and providing for a bypass around it, across County Road, 30. PART THREE: This provides for an approximate addition of. $15,000 to the contract, due to the inadvertent omission of approximately 700 feet of storm sewer pipe 'in the Evergreen Acres plat to incorporate the existing ponding areas into the s*orm sewer system. FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance with the Master Plans for Sanitary Sewer, Water Main and Storm Sewer and the Major Street Plan for the City of Eagan. For bidding purposes it can best be carried out in two projects; one for utilities and the other for street im- provements. DISCUSSION: The Ches Mar East Development consists of 48 single family and 36 double family residential lots located on the north side of Cliff Road at the proposed intersection with Lexington Avenue. Utilities were installed in the First Addition under City Improvement 79-3 in 1979. The proposed Second Addition will consist of 24 single family residential lots while the Third Addition will consist of 1 single family and 6 double family residential lots. Both additions are located on the west side of Lex- ington Avenue. Sanitary sewer service to the Ches Mar East 2nd and 3rd Additions will be provided through laterals connecting to sanitary sewers constructed in Lexing- ton Avenue as a part of City Improvement 79-3• Page 1. 13C °�U 4 • • Water service will be provided through laterals connecting to a 20" diame- ter water ,trunk in Lexington Avenue which was also installed as part of City Improvement 79-3. Connections will be made in two places to provide looping for both additions. Storm sewer laterals draining the Second and Third Additions will lead to a pond located to the north of the additions. This pond, shown on the Master Plan for storm sewer as LP-39, drains to LP-53 which has an operating lift station outlet. All of the streets within the proposed Ches Mar 2nd and 3rd Additions will be constructed to the City standards for normal residential streets. A normal residential street in the City of Eagan has a 32' wide bituminous driving sur- face, surmountable concrete curb and gutter and a 5 ton carrying capability. FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance with the Master Plans for Sanitary Sewer, Water and Storm Sewer and the Major Street Plan for City of Eagan. For bidding purposes it can best be carried out in two projects, one for utilities and the other for street improvements. DISCUSSION: The Brittany 2nd and 3rd Additions consist of 68 single family residential lots located east of Johnny Cake Ridge Road in Section 33 in Eagan, Minnesota. The 2nd and 3rd Additions are a part of the Brittany Sub- division which consists of 111 single family and 10 double family residential lots. Sanitary sewer service for the Brittany 2nd and 3rd Additions will be. provided by a series of laterals draining to sewer laterals constructed in 1979 in the Brittany 1st Addition. As is in accordance with the Master Plan for Water for the City of Eagan, a 16" diameter water trunk will be constructed through the Brittany 2nd and 3rd Additions in an east-west direction. Laterals connecting to this trunk and to laterals in the Brittany 1st Addition will provide looped service for this development. Static water pressures in the 2nd and 3rd Additions will range from 80 psi to 95 psi. Page 1. 17C .4 Storm sewer laterals serving the Brittany 2nd and 3rd Additions will drain to Ponds LP-5 which currently has a gravity outlet to the north and LP-3 which will have a lift station outlet to the north at some time in the fu- ture. The force main for this lift station outlet has been constructed, how- .; ever, the lift station itself will not be constructed until the need for it arises. All of the streets within this development will be constructed as normal residential streets with 32' wide bituminous driving surfaces, surmountable concrete curb and gutter and 5 ton carrying capabilities. This project will include the construction of two bituminous pathways. A 10' wide bituminous pathway is proposed for the east side of Johnny Cake Ridge Road along the entire length of the Brittany development with an 8' wide path- way proposed between Sherwood Way and the Dakota County Park to the south. All of the construction on this project will take place on street rights- of-way or on permanent easements provided on the Brittany 2nd and 3rd Addi- tion record plats. The description of these: drainage easements have been checked by staff and have been incor- porated in to the platting of the Brittany Addition. Council on April -1 , ACTION TO BE CONSIDERED ON THE MATTER: To close the public hearing and eitherapprove or deny the vacation of drainage and utility easements dated 1975 OLD BUSINESS ORDINANCE #71: A. Ordinance .#71 "An Ordinance Prohibiting the Sale, Transfer & Possession of Drug Related Devices ," Eighth Circuit Court Decision -- The City of Eagan was notified_ by the United States Court of Appeals for she Eighth Circuit :by mail on Saturday, March 22, 1980, that the Eighth Circuit chose to reverse and remand with directions that the District Court enter a preliminary injunction until a trial at which the merits of the Ordinance can be fully weighed regarding the case of Ma`_{'n Magic vs . the City of Eagan. Each member of the City Council was provided a copy of the nine page decision. There was a brief discussion retarding the matter at the special City Council meeting held on Tuesday, March 25 , 1980; however, there was no action taken. Brad Smith from the City At- torney's Office has provided the City Council With some alternatives regarding this case and further enforcement of Ordinance No. 71 . This matter should be discussed. and some direction given' to the City Attorney and City Administrator as to how to proceed regarding an amendment to Ordinance No. 71 and further the decision by the Eighth Circuit. There has been consideration that the City Admini- strator contact dministrator ' contact communities throughout the State of -Minnesota for financial- support regarding any further action as it pertains to the decision and Ordinance No. -71 . ACTION TO BE. Preliminary Plat for "Coachman Land Co." --- At the March 4, 1980 , City Council meeting, there was great discussion regarding the feasibility of approving the Coachman Land Company 1st Addition Plat with the proposed two cul de sacs . This, item was continued and staff was `directed to prepare a schematic sketch showing how these two cul de sacs might be eliminatedandreplaced with a "looped" street . In addition to the Rosewood Corporation' s original -plat r.eauest for approval of the two cul de sacs , several variances to the front and side set back requirements for the structures were also requested. Subseauent to Council ' s direction, the Public Worcs Director has prepared a proposed alternate showing how the development of this particular parcel could be handled without the necessity of cul de sacs. Although the City staff' s rendition eliminates two structures proposed by Rosewood Corporation, it- does tdoes not require any variances from front or side yard set backs . If these variances were granted, two additional units could be placed similar to the original proposal .submitted by Rosewood Cor- poration. As can be seen by thelayout , a copy is enclosed on page qj for your reference, a loop street does not necessarily have to deter from the aesthetic development of a parcel of pro- perty. it does- not require . lining up the 'townhouses in "row bar- ranks" configuration. This revision also eliminates three direct driveway accesses , onto Four Oaks Road and substitutes a possible substantial landscape buffer area. This still incoporates the placement of a tennis court and a ' smal.l tot lot to service the needs of this proposed development . John Polk, architect, appeared for the applicants and indicated the parcel consists of 5.2 acres with one proposed platted lot. There was discussion concerning a proposed sidewalk on the east side of Federal Street. After discussion, Roszak moved, Krob seconded the motion, to recommend approval of the preliminary plat and the detailed site plan subject to the following recommendations: 1. The proposed development as shown on the revised plan,and the R-2 density assigned to Outlots "B"and "C", and an R-3 density assigned to Outlot "A" would allow approximately 496 dwelling unit which would be 14 dwelling units less than .the actual Planned 'Development Agreement. Therefore, the proposed plat which- has been submitted at this time is in conformance with the original Blackhawk Park Planned Development. Because of the variation in topography, it is recommended that a blanket variance on a ten foot setback be granted for this plat with the justification and authorization for granting the setback variance to be at the discretion of the Building Inspector and/or City Engineer. This will help provide maximum slopes of 2.5:1 and will help to preserve much of the natural topography and tree cover on this plat. It will also eliminate potential encoachment into the ponding areas on the west side of Thomas Lake Road. Some minor elevations will have to be adjusted to the final approved grading plan. The original plat, Thomas Lake Heights consists of approximately 100 acres and contains 115 single family lots. The applicant is now requesting to replat 37 acres west of Thomas lake Road to contain 43 four-plex buildings, 172 dwelling units. Everything east of Thomas Lake Road will remain the same as was originally platted. I have enclosed a copy of the original report for your review. 3. The proposed area being replatted contains 37.3 acres and should. have a maximum density of 270 dwelling units, 67 buildings. The applicant is requesting 172 units, 42 buildings which is a substantially low townhouse density. The original parcel has an R-4 density under the planned development which could allow a max- imum of 12 units per acre. 4. All quads meet the setback requirements of the R-3 zoning districtlthe design of the development has taken the topography into consideration as to minimize the, amount of grading which has to be- done within this area. Because of the topography, there is much more open space than what you would normally find in a townhouse development. 5. The applicant is requesting to put a' model townhouse in the northwest or south- west quadrant of Clemson Drive-and Thomas Lake Road. 6. At the present time Clemson Drive is a long dead end street, the street will con tinue when the property to the west develops. 7. Outlot'B"is not being developed at this time . their may be a possibility that outlot"B"may be traded for the small parcel which is -west- of Outlot"A" and east of Thomas Lake Road. COLBERT - DIRECTOR OF PUBLIC WORKS DATE: FEBRUARY 22, 1980 RE: PRELIMINARY PLAT —THOMAS LAKE HEIGHTS (DUNN & CURRY) "REVISED" The Engineering Division has the following comments to offer in regards to consideration of the above referenced plat: UTILITIES: - Trunk sanitary sewer and water main facilities are available within Thomas Lake Road, of sufficient size and depth to handle this proposed development. It is my understanding that the developer intends to install the utilities by private contract rather than petitioning for City improvements. If this is the case, the developer should be made aware that all trunk assessments must be paid at the time of final plat approval. Any internal utilities that will be required to continue.our trunk system, must be installed as the developers responsibility. STREETS: Access to this proposed plat will be handled by way of the improved Thomas Lake Road and publicly dedicated internal City streets. Because of the difficult terrainandvariation in topography,: the proposed cul-de-sacs cannot feasibly be eliminated and therefore are acceptable as shown. EASEMENTS AND RIGHTS- OF-WAY: Sufficient right-of-way has already been dedicated for Thomas Lake Road. - The right-of-way dedication for the proposed interior street layout is acceptable as shown. Fran the origin of this planned development there have been several changes. First, a 15 acre parcel was sold for an elementary school. Second, the alignment of Thomas Lake Road has shifted to the north to provide better road access to County Road 30. Third, there was a zoning trade which -transpired between the City of Eagan and Dunn & Curry. The trade which was made allowed the conmercial property on County Road 30 and Thomas Lake Road to move to the northwest quadrant of County Road 30 and Pilot Knob Road. The coitmercial land at County Road 30 and Thomas Lake Road was replaced-with an R-3 land use, mixed residential, 6-12 units/acre. 2. Because of the shift of Thomas Lake Road the City is now in the process of re-evaluating the park land on the west side of Heine Lake. Because the park land is being platted as an outlot at this time and development will not occur on this outlot, the proposed plat will not hinder the City's decision to accept or reject the proposed park land. 3.- The zoning on the portion of the plat which is being developed is designated as R--1 and R-4 land uses. The R-1 -is single family with a density of 0-3 units/acre; the R-4 is multiple with a density of 12 units+/acre. The developer is proposing to develop this portion of the plat with an R-1 density, single family lots which would- yield approximately 2 units/acre. 4. Outlot A, which is not being developed at this time however, in the future the developer is proposing to construct garden apartments at an R-3 density, 6-12 -Ura' 5. Outlot C, another outlot not being developed at this time will have a density of R-2, mixed residential-3-6 units/acre. Thomas Lake Heights June 20, 1979 Page 2 6. The entire plat consists of 100 acres. Of this 100 acre, 34.3 will be platted as outlots and only 65 acres would develop into single family dwellings. 7. There are a substantial number of lots which do not meet the normal width requirement for single family lot. However, all lot areas are 12,000 square feet or greater in size. The Beacon Hills Planned Development was the only other plat that the City has deviated from the 85 foot m nim n width for a single family residential lot. 8. Thcnas Lake Road is a collector street. The plat has been designed to have all lots obtain access from internal or residential.streets. 9. The Park Ccntnittee has informally reviewed the Thomas Lake Heights plat. Their main concern was to get a trail connection between Balsam Lane and the cul-de-sac within Heine Addition. The developer is proposing to dedicate the requested trailway. The Eagan Park Conmi.ttee will take formal action on Thomas Lake Heights plat at their July meeting. 10. There are two (2) cul-de-sacs, Ponderosa Court and Greenwood Point, which exceed the 500 foot max n m requirement. If approved, the variances for these cul-de-sacs would be granted. If approved, the plat should be subject to the following conditions: 1. All lots which abut Thmas Lake Road will have restricted access. 2. The density and type of structure should be indicated for each outlot so the future property owners will know in advance what the future development plans are for Outlots A and C. 3. Internal sanitary sewer and water main distribution systems will be designed and/or approved by the City prior to their installation. STRE�IS Access to this plat will be provided by the presently under construction Thomas Lake Road collector street. This plat shows seven (7) cul-de-sacs of which three (3) require the approval of a variance to the 500 foot length according to our present subdivision ordinance. Receive Petition for Street Improvement, Project #305 (Wescott Road) -- °As reported in the 3-18-8 .0 City Council Packet, Wescott Road from Pilot Knob Road -to Denmark Avenue, is presently nearing completion_ under Project #225 . Wescott Road is proposed to be extended to Lexington Avenue as a part of the .Comprehensive Major Street Plan. The City Council , in its negotiations with the Dakota County Board of Commissioners for the location of the new Library facility on the forty acretract of land, assured the county that Wescott Road would be extended to Lexington Avenue from Denmark Ave. Since the second phase of the improvement will be needed by the end of 1981 , it was recommended atthe last City Council meeting that the preparation of a feasibility report. be authorized to begin planning and construction of that. segment of roadway in the community. There was concern expressed by the City Council as to whether the City would be' able to bond for construction pro- jects due to the municipal bond index. Council Member Parranto also addressed certain questions relating to the proposed improve- ment of ' three different segments of roadway in the community. COLBERT - DIRECTOR OF PUBLIC WORKS DATE: MARCH 14, 1980 RE: MAJOR STREET PLAN In reviewing the comments that Coucilman Parranto has put forth in his letter toyou on February 26, 1980, I offer the following comments for consideration: 1. In regards to his questions over the timing of improvement of County Road31 (Pilot Knob Road), our proposed five year major street plan indicates a two mile segment from County Road 28 to County Road 30 being scheduled for possible improvement in 1984. The two mile segment from County Road 30 to the south corporate limits is shown for a proposed scheduled construction in 1982. This is due to the fact that the central two mile section between County Road 28 and County Road 30 cannot be constructed until the freeway interchange with 35E has been completed south of County Road 28. This project is anticipated not to be completed prior to 1984 due to the recent delays incurred by the Blackhawk Lake decision. 2. The Wilderness Run Road extension, east of Lexington Avenue, is tentatively scheduled for 1980 improvement. Councilman Parranto indicated concerns over the needs to build this road at this time, as there is not any immediate demand. The purpose for the early installation of this segment of roadway is due to the fact that.it is a municipalstate aid road, with payment being immediately reimbursed from our municipal state aid fund. In the 20 year projection of funding through bond issues for the major streets in the City of Eagan,one suggested solution to help in the early,funding stages was to construct municipal state aid system first. This will allow us to collect assessments from these road, while being immediately reimbursed from the municipal state aid fund. This will help to finance future major street constructions that have to rely solely on municipal bonds for their funding. 3. Silver Bell Road between Highway 13 and Blackhawk Road, was tentatively proposed for upgrading in 1981. . This upgrading was going to consist of a two inch.bituminious overlay on the existing cross section to bring it up to its ultimate design,nine ton capacity. There is no intention to widen it from its present 44 foot width. This also is a state aid street, with funding being provided through the municipal state aid fund with no bonding being required for its construction. Pilot Knob Rd. south of Yankee Doodle and north of Co. Rd. 30 is sceduled for 1984. South of Co. Rd. 30 it is scheduled for 1982. I should think that these should be reversed and the road built in order. 2. Wilderness Run Rd. east of Lexington is scheduled for 1980. As of now I cannot think of any reason to build this road. There are no plats in the area that I know of, nor has there been any demand. I think that more information is required before ':his road project is scheduled. 3. Adding 18% for engineering, legal, administrative and other appurtenant costs we have a total of $4,088,700. There are other considerations such as the $800,000 for project number 218 for which the feasibility and authorization are over two years old and probably subject to revision. ORDERED IN - CONTRACTS Again according to the attached information, we have paid or retained $326,265 with an additional $1,727,335 obligated as work progresses for a total of $2,053,600. Adding the 18%, we have a total of $2,423,248 either paid out or obligated in the form of contracts. 079 • • Construction Project Financing Memo March 18, 1980 Page Two The City had set out a tentative schedule to sell bonds in July to cover these construction payments and this is where the problem arises. A second bond sale would be considered for the end of the year. As things now stand, there are no funds available for construction. It would be my recommendation that the City award whatever contracts have been scheduled for the remainder of March and the April 1 Council meeting and then table , action on any other contract awards until the legislature has acted. By doing this, we are. gambling that we make the $2,423,248 problem somewhat worse, but that we will get a favorable bill. See the memo "Status of the Muni— cipal Bond Interest Rate Bill". It does appear that the legislature will act and the .City will not have a pro— blem, On the other hand, if we cannot sell the bonds in July as scheduled,. we will have a very serious cash flow problem by the end of the summer just considering the contracts already awarded. I would also recommend that the .City not attempt to establish any priority to the projects and award contracts for the most pressing. I think we have the financial capability to finance some projects internally on a short—term basis, but we should not add to the problem past the middle of April. There is already a significant loss to the City in terms of interest earnings due to the timing of the bond sales. Device Ordinance -- The City of Eagan and City Council have periodically been confronted with applications for game room licenses,or establishments such as. the bowling alley which display and operate various mechanical _ amusement devices . There has been discussion by members of the City Council periodi- cally to give consideration to a mechanical amusement device ordi- nance. The City Attorney' s office has prepared a draft mechanical amusement device ordinance , a copy is enclosed on pages C, (a throughfor your reference. Mr. Kevin Eide reviewed o—r finances from t. e cities of Bloomington, Robinsdale, St. Louis Park, Minnetonka, Richfield, and Crystal . CSS • CITY OF EAGAN DAKOTA COUNTY, MINNESOTA PROPOSED ORDINANCE NO. - AMUSEMENT DEVICES THE CITY COUNCIL OF THE CITY OF EAGAN, DAKOTA COUNTY, MINNESOTA, DOES HEREBY ORDAIN SECTION .01 -- DEFINITIONS. As used herein a mechanical amusement device is defined as a machine which, upon the insertion of a coin, token or slug, operates or may be operated for use as a game, contest or amusement of any description, or which may be used for any such game, contest or amusement, and.which contains no automatic pay off device for the return of money coins, checks, tokens or merchandise, or which provides for no such pay off by any other means or manner. The term mechanical amusement devices shall include pin ball machines, mechanical minia- ture pool tables, bowling machines, shuffleboards, electric rifle or gun ranges, miniature mechanical devices and games or amusements patterned after baseball, basketball, hockey, tennis, soccer, juke boxes and similar games, which may be used solely for amusement and not as gambling devices. SECTION .02 -- LICENSE REQUIRED. No person, firm, or corporation shall maintain, keep, or sell within the City of Eagan, a mechanical amusement device as hereinbefore defined without first obtaining a license therefor from the City Council, except that this ordinance shall not apply to mechanical amusement devices held or kept in storage or for sale, and which are not actually in use or displayed for use. SECTION .03 -- APPLICATION RFQUIREMF.NTS Application for such license shall be made to the City upon A form to be supplied by it for that purpose. The required license may be secured either by the owner of the machine or the person in whose place of business the machine is placed for use by the public. The application for such license shall contain the following information: 1. Name, address, age, and dat,e and place of birth of the occupant. 2. Prior convictions of applicant, if any. 3. The place where the machine or device is to .be displayed or operated and the business conducted at that place. 4. A description of machines to be covered by,the license including mechanical features, name of manufacturer, and serial number. L�1� 0 SECTION .04 -- LICENSE/FEES AND PROCEDURE Subdivision 1. The annual license fee for any individual or business owning a mechanical amusement device within Fagan shall be determined according to the total number of machines that individual or business has located within the City. Number of Machines Owner's License Fees 1-2 $100.00 (Example Only) 3-15 $300.00 (Example Only) More than 15 $400.00 (Example Only) In addition, an annual license fee for each mechanical amusement device shall be required. The annual license fee for each machine shall be Subdivision 2. All such licenses for mechanical amusement devices shall expire on the day of of the effective year. Applica- tions for licenses shall be considered by the City Council, and, if approved by the City Council, a license shall be issued by the City Clerk. License fees paid to renew an expired license shall be paid on or before of the year preceding the effective year. Any annual fee paid later than ten working days after December lst shall be subject to an additional administra- tive service charge double the amount of the license or fifteen ($15.00) dollars, whichever is least. SECTION . 05 -- INSPECTION. One copy of the application shall be referred to the Chief of Police or his designated inspector who shall investigate the location wherein it is proposed to operate _such machine, ascertain if the applicant is a person of good moral character, and either approve or disapprove the application. No license shall be issued to any applicant unless it has been approved by the Chief of Police or his designated inspector. SECTION .06 -- DISPLAY OF LICENSE. The license or licenses herein provided for shall be posted permanently and conspicuously at the location of the machine in the premises wherein the device is to be operated or maintained. SECTION .07 -- TRANSFERABILITY. Subdivision 1. The license may be transferred from one machine or device to another similar machine upon application to the City to such effect and the - giving of a description and the serial number of the new .machine or device. 2 • Not more than one machine shall be operated under one license and the applicant or licensee shall be required to secure a license for each and every machine displayed or operated by him. Subdivision 2. Licenses are issued for one location only, and such licenses are nontransferable between locations. SECTION. .08 -- REVOCATION OF LICENSE. Every license issued under the City is subject to the right, which is hereby expressly reserved, to revoke the same should the licensee directly or indirectly permit the operation of any of the devices licensed herein contrary to the provisions of .this Code or the laws of the State of Minnesota. Written notice shall be given to the licensee specifying the violation with which he is charged. At such hearing the licensee and his attorney may present and submit evidence or witnesses in his defense. If after a hearing the licensee is found guilty of such violation, the license may be revoked by the City Council. SECTION .09 -- SEIZURE AND DESTRUCTION OF MACHINE. If the Chief- of Police or his designated inspector shall have reason to believe any mechanical amusement device is used as a gambling device, such machine may be seized by the police and impounded. If upon trial of the exhibitor for allowing it to be used as a gambling device said exhibitor is found guilty, such. machine shall be destroyed by the police. SECTION .10 -- GAMBLING PROHIBITED. No person, firm or corporation shall permit the operation of such a machine or device for the making of side bets or gambling in any form. No prize, award, merchandise, gift, money or anything of value shall be given to any player of such machine or device. SECTION .11. OPERATION BY ITINORS. Subdivision Every licensee, and every person, firm or corporation, upon whose premises a mechanical amusement .device is located and is open to operation by minors, shall himself or through his agents or servants, cause the following regulations to be conspicuously displayed in the area where such device is located, and shall cause said regulations to be rigidly enforced: 1. Gambling or wagering of any type whatsoever is prohibited. 2. Food or drink is prohibited in any room where a mechanical amusement device is located. 3. Smoking is prohibited *in any room where a mechanical amusement device is located. 4.
